The Supreme Court has directed the Delhi High Court to hear a petition filed by 10 survivors of the Delhi violence. The petitioners have sought directions to the Delhi police to file FIRs against BJP leaders such as Kapil Mishra, Anurag Thakur and Parvesh Verma.
LiveLaw reported that Chief Justice Bobde observed, “We don’t think the extent of such period of adjourning the matter is justified. We are of the view that the matter be heard on Friday. We don’t want to assume jurisdiction when the High Court is seized of the matter. But such matters should not be delayed for long.”
Activist Harsh Mander had filed a similar petition in which the court had given the police one month to file FIRs after the government represented by Solicitor General Tushar Mehta had told the court that FIRs will be filed at an appropriate time. Earlier today, when Mander approached the SC, he hit a roadblock due to his alleged comments against the SC.
In fact, Mehta tried to derail the petition filed by the 10 riot affected people saying it was filed at Mander’s behest as Mander’s lawyer senior counsel Colin Gonsalves was also representing the 10. But the SC concurred that it was unjustified for the Delhi HC to put off its hearing by four weeks. Chief Justice Bobde reportedly told the high court to advance the scheduled date of hearing to Friday and decide the requests for FIRs as expeditiously as possible.
