Another MCC violation, no action yet against Raghvendra Singh of BJP

CJP has written to SEC flagging second instance of hate speech by Singh during election campaign in UP

The relentless hate mongering of BJP MLA Raghvendra Pratap Singh has led CJP to file another complaint against him before the State Election Commission (SEC) of Uttar Pradesh for delivering another speech during his election campaign. The earlier instance of hate speech was also brought to the attention of the SEC via a complaint dated February 15.

Within a week of this complaint, CJP came across another video of Singh, where he was again seen addressing a crowd of voters during one of his campaigns and can be heard saying, “Any Hindu who doesn’t vote for me has Miyan (slang for Muslims) blood in his veins. He’s a traitor. He is a b***ard son of Jaichand. He’s a h****khor son of his father…I am giving warning this time…traitors of Hindu religion will be destroyed.”

“Even after this warning of mine, if they don’t understand, I will show you what Raghvendra Singh can do. If you humiliate me I will bear it but if you betray the Hindu society, I will destroy you,” he added.

In the earlier instance of hate speech Singh, the incumbent MLA from Domariyaganj in Siddharthnagar district, had said, “If you make me MLA again, they (Muslims) will stop wearing skullcaps and start applying tilaks.” Singh also claimed that after he got elected in the last election, “250 acres of land belonging to Muslims got confiscated, their shops destroyed.” He also asked the crowd, “Will there be Jai Shri Ram or Walekum Salam in Domariyaganj? Durga ji is here with us, promise once in front of her.”

The complaint urges that these “serial hate offences and hate crimes are evaluated and acted upon for what they are, not individual misdemeanors but concerted attempts to not only vitiate the social and political atmosphere but –in brazen violation of Indian criminal law and election law –criminally intimidate voters and also indulge in a corrupt electoral practice.”

The complaint also requests the Hon’ble Election Commission to consider it seriously and  apart from issuing a notice to the individual candidate, to also issue a notice to the state and national party in chief of the Bharatiya Janata Party (BJP) as the conduct of several of its own elected representatives puts a responsibility on the party participating in elections held under the mandate of the Indian Constitution to honour and follow its mandate as laid down in both the Preamble and Fundamental Rights (Chapter III).

The complaint also highlightsd that the speeches flagged under the complaint were directly in  violation of Articles 14,15,16,19, 21, 25-30  of the Indian Constitution apart from violating election law and Indian criminal law. Further, it lists various sections of the Model Code of  Conduct, The Representation of People Act, 1951,  Indian Penal Code that have been violated, and cites Supreme Court judgments in its support. CJP has urged the SEC to take cognisance of the serious violation of the above mentioned Acts and take strict action against the BJP. CJP has also prayed that the SEC pass necessary strictures against BJP MLA Raghvendra Pratap Singh, for the abovementioned and earlier violations as well, and also to direct him to issue an unconditional public apology.

It is pertinent to note that the SEC is yet to take action against Singh for either of these violations of MCC flagged by CJP.
