The PMO claimed that more than 93 per cent of the five lakh people who participated in a survey on Narendra Modi App have supported demonetization.

The loaded structure of the survey, the questions to which you can only “agree” or “partially agree”, with no option to “disagree”; all of it is typical of this utterly corrupt and dishonest government which holds the people of India in contempt.

The most powerful response to this government is to mock it.

एक पखवाड़े पूर्व अचानक देशवासियों को यह फ़रमान सुनाया गया कि चार घण्टे बाद देश की 86% मुद्रा सिर्फ़ कागज़ का टुकडा रह जायेगी। यह तुग़लकी फ़रमान था, कहावत के रूप में भी, भावात्मक रूप में भी और वास्तविक रूप में भी। आप विश्व के सबसे बड़े लोकतंत्र के, आप ही के शब्दों में, प्रधान 'सेवक' हैं। आपने कैसे इतना बड़ा कदम बिना सोचे विचारे देश की जनता पर थोप दिया?

हम काले धन के सख़्त विरोधी हैं। पर इसके नाम पर आप पूंजीपतियों की गोद में बैठकर आम लोगों को परेशान नहीं कर सकते। जिनके पास सचमुच काला धन है, उनको दबोचने में प्रधानमंत्री क्यों हिचकिचा, सकुचा रहा है? जिस व्यक्ति के एक निर्णय पर करोड़ों लोगों का जीवन टिका हो, क्या उसे बिना आव-ताव देखे, आवेश में आकर, मुखपृष्ठों पर छाने के लिए अनाप-शनाप निर्णय लेने का अधिकार है? मोदी जी आपसे कुछ सवाल है, जनता
जबाब चाहती है।

√ आज देश का किसान त्राहिमाम कर रहा है। उसकी दोनों फसलें बर्बाद होने के कगार पर है। किसानों ने तुम्हारा क्या बिगाड़ा था? किसानों से किस बात का बदला लिया जा रहा है? देश का किसान निर्धन सही, किन्तु निर्बल नहीं है। देश का किसान मोदी को माफ़ नहीं करेगा।

√ देश के भूखे, निर्धन, वंचित को सताने में प्रधानमंत्री को कौन सा नैसर्गिक सुख प्राप्त हो रहा है? तुमने जो हंगामा खड़ा किया है, उसके शोर शराबे में करोडों लोगों के भूख और पीड़ा से कराहने की आवाज दब रही है, पर समझ लो हमेशा नहीं दबेगी।

√ प्रधानमंत्री बताये कि नोटबन्दी के बाद FDI का कितना बिलियन डॉलर देश के बाहर जा चूका है? इस कदम से भारतीय अर्थव्यवस्था में अव्यवस्था की छवि वाला जो नकारात्मक सन्देश पूरे विश्व में गया है, उससे उबर पाने में कितने प्रगतिशील सालों की बलि चढ़ेगी?

√ प्रधानमंत्री बताये कि रुपये की कमजोरी और बदतर हालात का ज़िम्मेवार कौन है?

√ प्रधानमंत्री बताये कि इस कदम से GDP ग्रोथ रेट जो गोते खाएगी, उसकी भरपाई में कितने वर्ष लगेंगे? विकास दर में गिरावट की ज़िम्मेवारी प्रधानमंत्री लेगा या बलि का बकरा ढूँढा जाएगा?

√ नोटबन्दी के कारण अबतक 75 से अधिक लोग मर चुके हैं। इनकी हत्या का दोषी कौन है? PM बताये कि पीड़ित परिवारों को मुआवज़ा दिया जायेगा कि नहीं?

√ प्रधानमंत्री बताए कि छोटे व्यापारियों को हुए नुकसान की भरपाई कौन करेगा? असंगठित क्षेत्र के लोगों को हुई असुविधा और नुकसान का हर्ज़ाना कौन भरेगा?

√ प्रधानमंत्री के इस निर्णय में क्या कैबिनेट की सहमति थी? अगर सचमुच थी, तो इस निर्णय में कौन कौन लोग भागीदार थे। क्योंकि जनता जानना चाहती है कि उसकी इस दुर्दशा के लिए कौन-कौन जिम्मेदार हैं?

√ क्या आरएसएस को लोगों की पीड़ा का आनंद आ रहा है? कहीं ऐसा तो नहीं, संघ के आदेश पर ही यह नोटबन्दी का स्वांग रचा गया? मोहन भागवत चुप क्यों है?

√ मोदी बताये कि अबतक देश को कितने manhours और प्रोडक्शन का नुकसान हुआ है? उसकी भरपाई कैसे होगी?

√ प्रधानमंत्री सीमा निर्धारित करके बताएँ कि उनके वादानुसार लोगों के खाते में 15-15 लाख रुपये कब जमा होंगे?

√ क्या प्रधानमंत्री पूरी तरह आश्वस्त है कि बचे हुए 35 दिन में वो सभी समस्याओं का निदान कर देंगे? नहीं तो बतावें कि कितने दिन और जनता को तड़पायेंगे?

जनता को आपके जबाबों का इंतज़ार है।

Kultaran Singh Atwal, a transporter, owns seven trucks. Now, he says, he is forced to keep five of his fleet idle due to demonetisation, as he has been deprived of the minimum Rs 20,000 cash per truck per trip that he requires as running expenses.

Atwal is not an exception. There are many like him. With the government's curbs on withdrawal of money and exchange of old Rs 500 and Rs 1,000 notes, the motor transport business is suffering, since 80 per cent of the business is cash-based.

The All India Motor Transport Congress (AIMTC) — a representative body for 9.3 million truckers, and more than five million bus operators, tourist taxis and maxi cabs — says 70 percent of the vehicles of their members are already off the roads.

The association warns that if the situation is allowed to persist not only the supplies of essential commodities like milk, fruits, vegetables and medicines will get increasingly affected but it will also cripple the lives of 200 million people directly or indirectly dependent on this industry.

"Under the Finance Act, I'm allowed Rs 35,000 per truck per trip in cash for expenses on diesel, octroi, etc.," Atwal, who is the Chairman of AIMTC, told IANS. "How can I survive when there is an overall withdrawal limit of just Rs 50,000?" he queries.

"The government must hike the withdrawal limit or allow cheque-based transactions in our sector."

Bangladesh Opposition Editor Mahmudur Rahman Released After over 1,000 Days in Detention

After 1,322 days in arbitrary detention, journalist Mr. Mahmudur Rahman has been finally released on bail late on Wednesday afternoon (November 23). The Observatory for the Protection of Human Rights Defenders (FIDH-OMCT) have welcomed his long-overdue release, and urge authorities to drop all pending charges against him.

Acting editor of the Daily Amar Desh, a national daily newspaper in Bangladesh, Mr. Mahmudur Rahman was detained since April 11, 2013, when the police raided and shut down the offices of Daily Amar Desh, and charged Mr. Rahman with sedition. Over the past three and half years, Mr. Rahman was charged in 74 separate politically motivated cases. He was repeatedly granted bail by the Courts, but each time he was about to be released the police presented a new criminal case against him in order to keep him in jail. On November 3, 2016, the Appellate Division of the Supreme Court finally upheld Mr. Rahman’s release on bail in the last case to be filed against him, but the judiciary and police took three weeks to actually release him.

“We welcome Mahmudur Rahman’s release, after more than three years in arbitrary detention for simply exercising his rights to free expression. The authorities must stop this type of harassment and repression of defenders and journalists in Bangladesh,” said FIDH President Dimitris Christopoulos.

Despite his release on bail, Mr. Rahman is still facing prosecution under 74 different criminal cases. These cases are case widely regarded to be fabricated and politically motivated, in several instances accusing Mr. Rahman of involvement in crimes that took place while he was already under police custody. It is not yet known when he will be summoned to Court for trial in these cases.

“The cases mounted against Mahmudur Rahman are a clear example of judicial harassment and must be closed. Our organisations urge the authorities to drop all charges against him,” added AHRC Representative Md. Ashrafuzzaman Zaman.

Upon his release Mr. Rahman was admitted to United Hospital in Dhaka, as his health had severely deteriorated while in detention. Mr. Rahman, now 64 years old, was subjected to several types of ill-treament and denied medical care while in jail. Doctors at United Hospital today diagnosed him with the following conditions caused by his treatment during detention: Hypertension; Malnutrition; Severe weakness and urinary problems due to dehydration; Severe Irritable Bowel Syndrome; vertigo; Severe back pain causing insomnia and difficulties walking. Mr. Rahman is still in hospital for further medical examinations and treatment.

“We strongly condemn the judicial harassment that led to the prolonged arbitrary detention of Mahmudur Rahman and the ill-treatment he suffered in this framework. We call upon the authorities of Bangladesh to order an immediate, thorough, effective and impartial investigation into the above-mentioned facts, and to stop criminalising human rights defenders with the clear aim to muzzle them”, concluded OMCT Secretary General Gerald Staberock.

The Observatory for the Protection of Human Rights Defenders (the Observatory) was created in 1997 by FIDH and the World Organisation Against Torture (OMCT). The objective of this programme is to intervene to prevent or remedy situations of repression against human rights defenders. FIDH and OMCT are both members of ProtectDefenders.eu, the European Union Human Rights Defenders Mechanism implemented by international civil society.

According to the report of the Export Promotion Council provided to Parliament today (November 24) – 4 lakh jobs in three major exporting segments- Garment, Leather and Jewellery have been lost to the central government’s ill-thought out plan of de-monetization. In just the past 15 days. 32.9 million people who work in India’s Garment sector alone and who are paid daily/ weekly wages or salaries have not been paid. They are simply not getting their wages.

The scale of the tragedy is huge. BSP Supremo has called it an “economic emergency”, the CPI-M has moved the Supreme Court to immediately ensure that Rs,1000 and Rs 500 older notes are allowed to be used until December 31 to alleviate the hardships of the people. “There is no cash and there are no jobs,” said Sitaram Yechury, general secretary of the CPI-M. “The government must move and move fast to allow legal transactions and alleviate the hardships. The scale of the tragedy is huge.

Notice For Motion Of Contempt Against PM Modi: Yechury

Senior CPI(M) leader, Rajya Sabha member and general secretary of the party, Sitaram Yechuri said the Opposition has served a notice for moving a contempt motion against Prime Minister Narendra Modi for not attending Thursday's Rajya Sabha Parliamentary Session proceedings after the brief lunch break, leading to uproar by opposition leaders.

Yechury said the damage to the economy is increasing on a daily basis due to demonetisation and that PM Modi's presence is mandatory for discussing and finding an apt solution to the quandary.

In television interviews, Yechury said that even previously when demands were made for the prime minister’s presence in the Rajya Sanha –for instance when the 2G Scam needed to be discussed and Dr Manmohan Singh was prime minister-he had sat and listened to the debates in the Rajya Sabbha for more than four days. So why can’t Modi o so now?

Citing reports from the industry and from the Engineering Export Promotion Council (EEPC), he said that four lakh people—from three of the biggest sectors— have lost their jobs in the last one week after demonetisation.
He further highlighted that approximately 31.9 million daily wage workers, employed in textiles and garments sectors, are not getting payment due to the currency ban.
He said, "In this sort of a situation, we only want the government to help these people get their daily wages."
Similar to unsuccessful sessions over the past few days, today's parliamentary session was no different, after a short span of constructive debate in the morning. The session in the upper house was adjourned on a bitter note, which left the opposition parties aggravated yet again.

मैं बतौर दूरदर्शन समाचार में कार्यरत पत्रकार सत्येन्द्र मुरली जिम्मेदारीपूर्वक दावा कर रहा हूँ कि 8 नवंबर 2016 को प्रधानमंत्री नरेंद्र मोदी का 'राष्ट्र के नाम संदेश' लाइव नहीं था, बल्कि पूर्व रिकॉर्डेड और एडिट किया हुआ था.

इस भाषण को लाइव कहकर चलाया जाना न सिर्फ अनैतिक था, बल्कि देश की जनता के साथ धोखा भी था.
8 नवंबर 2016 को शाम 6 बजे आरबीआई का प्रस्ताव और शाम 7 बजे कैबिनेट को ब्रीफ किए जाने से कई दिनों पहले ही पीएम का 'राष्ट्र के नाम संदेश' लिखा जा चुका था.
मुद्रा के मामले में निर्णय लेने के रिजर्व बैंक के अधिकार का इस मामले में स्पष्ट तौर पर उल्लंघन किया गया है.
इस बारे में RTI के जरिए पूछे जाने पर (PMOIN/R/2016/53416), प्रधानमंत्री कार्यालय ने जवाब देने की जगह टालमटोल कर दिया और आवेदन को आर्थिक मामलों के विभाग और सूचना और प्रसारण मंत्रालय को भेज दिया. RTI ट्रांसफर का नंबर है – DOEAF/R/2016/80904 तथा MOIAB/R/2016/80180.
यह रिकॉर्डिंग पीएमओ में हुई थी, लिहाजा इस बारे में जवाब देने का दायित्व पीएमओ का है.

प्रधानमंत्री नरेंद्र मोदी ने ‘राष्ट्र के नाम संदेश’ देते हुए कहा कि “आज मध्य रात्रि यानि 8 नवंबर 2016 की रात्रि 12 बजे से वर्तमान में जारी 500 रुपये और 1,000 रुपये के करेंसी नोट लीगल टेंडर नहीं रहेंगे यानि ये मुद्राएं कानूनन अमान्य होंगी.”

केंद्र सरकार की तरफ से दावा किया गया कि यह निर्णय पूरी तरह गोपनीय था और इस निर्णय की घोषणा से पूर्व इसके बारे में सिर्फ प्रधानमंत्री, वित्तमंत्री समेत भारतीय रिजर्व बैंक और वित्त मंत्रालय के कुछ ही अधिकारियों को मालूम था.

वित्त मंत्री अरूण जेटली ने मीडिया को बताया कि 8 नवंबर को शाम 6 बजे आरबीआई का प्रस्ताव आया, शाम 7 बजे कैबिनेट की बैठक बुलाई गई, जिसमें मोदी ने मंत्रियों को ब्रीफ किया और रात 8 बजे प्रधानमंत्री मोदी ने राष्ट्र को संबोधित करते हुए घोषणा कर दी.

पीएम मोदी ने ‘राष्ट्र के नाम संदेश’ को मीडिया में लाइव बैंड के साथ प्रसारित करने को कहा था, जिसे देश के तमाम चैनलों ने लाइव बैंड के साथ ही प्रसारित किया. पीएम मोदी ने देश की जनता को बरगलाने के लिए ऐसा दिखावा किया कि मानों उन्होंने अचानक ही रात 8 बजे राष्ट्र को संबोधित किया हो. यह अचानक घोषणा वाला नाटक इसलिए किया गया, ताकि देश की जनता को भरोसा हो जाए कि प्रधानमंत्री मोदी ने मामले को बेहद गोपनीय रखा है, लेकिन ऐसा हरगिज नहीं था.

8 नवंबर 2016 को शाम 6 बजे आरबीआई से प्रस्ताव मंगवा लेने के बाद, शाम 7 बजे मात्र दिखावे के लिए कैबिनेट की बैठक बुलाई गई, जिसे मोदी ने ब्रीफ किया. किसी मसले को ब्रीफ करना और उस पर गहन चर्चा करना, दोनों में स्पष्ट अंतर होता है. मोदी ने कैबिनेट बैठक में बिना किसी से चर्चा किए ही अपना एक तरफा निर्णय सुना दिया. यह वही निर्णय था जिसे पीएम मोदी पहले ही ले चुके थे और कैमरे में रिकॉर्ड भी करवा चुके थे. ऐसे में केंद्र सरकार द्वारा THE GOVERNMENT OF INDIA (TRANSACTION OF BUSINESS) RULES, 1961 एवं RBI Act 1934 की अनुपालना किस प्रकार की गई होगी? क्या इस मामले में राष्ट्रपति महोदय को सूचना दी गई?

मोदी ने संविधान व नियम-कानूनों को ताक पर रखकर देश की जनता को गुमराह किया है और अपना एक तरफा निर्णय थोपते हुए, देश में आर्थिक आपातकाल जैसे हालात पैदा कर दिए हैं. इस निर्णय की बदौलत देशभर में बैंक कर्मियों, बच्चों, वृद्धों, महिलाओं समेत सैंकड़ों लोगों की मौत हो चुकी है और सिलसिला है कि थमने का नाम ही नहीं ले रहा. पूरे देश में बैंकों और एटीएम मशीनों के बाहर लंबी-लंबी कतारें लगी हुई हैं. आज देश का आम आदमी, गरीब, मजदूर, किसान एवं मध्यम वर्ग से ताल्लुक रखने वाला व्यक्ति इन कतारों में लगा हुआ है. जबकि पीएम मोदी ने अपने भाषण में कहा कि “भ्रष्टाचार में लिप्त और काला धन रखने वाला व्यक्ति आज लाइनों में लगा हुआ है, जबकि आम आदमी, गरीब, मजदूर, किसान चैन की नींद सो रहा है.” मोदी के इस वक्तव्य की चारों ओर जबरदस्त आलोचना भी हो रही है.

आज देशभर में लोग प्रधानमंत्री नरेंद्र मोदी को कोसते हुए उन्हें हिटलर और तुगलक जैसी संज्ञा दे रहे हैं. देश की जनता कह रही है कि मोदी ने इस निर्णय के बारे में अपने चहेते, यार-दोस्तों को पहले ही जानकारी दे दी थी. बसपा की राष्ट्रीय अध्यक्ष बहन मायावती एवं अन्य विपक्षी दलों के नेताओं ने भी राज्यसभा में इस बात को भली-भांति उजागर किया था. यहाँ तक कि कई बीजेपी नेताओं और समर्थकों ने भी पीएम मोदी पर देश के खिलाफ साजिश रचने का आरोप लगाया है, जिसके वीडियो क्लिप सोशल मीडिया और यूट्यूब पर वायरल हो चुके हैं. दिल्ली के मुख्यमंत्री अरविंद केजरीवाल ने दिल्ली विधानसभा में प्रधानमंत्री मोदी पर घूस लेने और नोटबंदी की सूचना अपने चहेते पूंजीपति यार-दोस्तों को लीक किए जाने के गंभीर आरोप लगाए हैं, जिस पर बीजेपी और आरएसएस ने चुप्पी साध रखी है.

इस सबके बीच विरोधाभासी बात तो यह भी है कि केंद्र सरकार और आरबीआई ने कालेधन और भ्रष्टाचार को रोकने के लिए उच्च मूल्य वाले 500 रूपये और 1,000 रूपये के नोटों को बंद करने का तर्क देते हुए 8 नवंबर को भारत के राजपत्र में कहा है कि "भारतीय रिजर्व बैंक के केंद्रीय निदेशक बोर्ड ने सिफारिश की है कि पांच सौ रूपये और एक हजार रूपये के अंकित मूल्य के बैंक नोट वैध मुद्रा नहीं रहेंगे…यह देखा गया है कि उच्च मूल्य के बैंक नोटों का उपयोग गणना में न लिए गए धन के भंडारण के लिए किया जाता है जैसा कि विधि प्रवर्तन अभिकरणों द्वारा नकदी की बड़ी वसूलियों से परिलक्षित है.”

लेकिन, इसके ठीक दो दिन बाद यानी 10 नवंबर को बाजार में 2,000 रूपये का नोट आ गया. और इसी के साथ केंद्र सरकार और आरबीआई द्वारा उच्च मूल्य के नोटों को बंद किए जाने के पीछे दिए गए उपरोक्त तर्क के साथ विरोधाभास पैदा हो गया है, क्योंकि केंद्र सरकार 500 रूपये और 1,000 रूपये से भी अधिक उच्च मूल्य का नोट यानि 2,000 रूपये का नोट लाई है. इतना ही नहीं, बाजार में 2,000 रूपये के जाली नोटों के अलावा जम्मू-कश्मीर में मारे गए आतंकवादियों से नए नोट भी बरामद किए जा चुके हैं. इस घटना ने केंद्र सरकार के दावों को धक्का पहुंचाने का काम किया है और अब मोदी सरकार कटघरे में खड़ी है.

एक तथ्य यह भी है कि आरबीआई के पास 10 हजार रूपये तक के नोट छापने की अनुमति है. पूर्व में इसके अंतर्गत एक हजार रूपये से ऊपर सीधे 5,000 रूपये और 10,000 रूपये का ही नोट छापा जा सकता था, लेकिन वर्तमान में 2,000 रूपये के नोट की नई सीरीज गांधी की फोटो के साथ छापी गई है, तो जाहिर है कि इसकी अनुमति से संबंधित एक्जीक्यूटिव ऑर्डर, नोटिफिकेशन आदि जारी किए गए होंगे, लेकिन आज तक जनता इन संबंधित एक्जीक्यूटिव ऑर्डरों, नोटिफिकेशनों आदि को देखने में नाकाम रही है.

एक तरफ तो भारतीय रिजर्व बैंक का स्पष्ट रूप से कहना है कि भारत की कैश आधारित इकॉनोमी है अर्थात देश के अधिकतर लोग कैश में ही लेन-देन का कार्य करते हैं, वहीं दूसरी तरफ केंद्र सरकार नकद लेन-देन के खिलाफ है और नोटबंदी के बाद बैंको से नकदी निकासी पर शिकंजा कसते हुए लोगों से चेक, एटीएम, मोबाइल वॉलेट, इंटरनेट बैंकिंग इत्यादि द्वारा लेन-देन करने को कहा जा रहा है.

आज देश की जनता खुद को ठगा सा महसूस कर रही है. मेरा मानना है कि मोदी द्वारा लिए गए एकतरफा, पक्षपाती, विरोधाभासी और संदेहास्पद मकसद वाले इस तानाशाही निर्णय की वैधानिकता को माननीय न्यायालय के समक्ष कानूनन चुनौती दी जा सकती है.
पीएमओ को चाहिए कि वह RTI के सवालों का सीधा जवाब देकर RTI एक्ट, 2005 की अनुपालना करे.

A three judge bench led by Chief Justice of India T S Thakur expressed surprise at the Modi government’s reluctance to appoint an independent ombudsman against corruption; it also observed that the law to have Lokpal was passed after a prolonged struggle by civil society and it must become functional regardless whether the incumbent government wants it or notThe Supreme Court on Wednesday, November 23, questioned the Centre for dragging its feet in appointing “corruption ombudsman” Lokpal and observed that the Lokpal law could not be rendered ineffective due to the delay in taking decision by the government on the status of the Leader of the Opposition in Lok Sabha.

A three-judge bench comprising Chief Justice T.S. Thakur, Justices D.Y. Chandrachud and L. Nageswara Rao, hearing a writ petition filed by NGO Common Cause challenging the provisions of Lokpal Act and its Rules, said the law should be made workable and taken to its logical end.

The CJI told attorney-general Mukul Rohatgi, “You (government) seem to be always interested in cleansing the system, then why are you dragging your feet. Appointment of Lokpal is in the right direction. The Lokpal which is intended to bring probity in public life must be allowed to work whether you amend the law or not.”

The bench asked the attorney-general the reasons for the delay of three years in carrying out the necessary amendment to the Act. The AG said an amendment bill was introduced in Parliament and later it was sent to the standing committee which suggested some changes and the bill is still pending. The AG submitted that the Centre was reviewing the entire Lokpal Act and the rules.

The bench pointed out that the Lokpal and Lokayuktas Act, 2013 were passed in December 2013 and they became a law in January, 2014. “We will interpret the rules in a manner to make it functional, till Parliament could amend the rules,” the CJI observed. The AG told the bench that such a move would mean that the court is legislating which Parliament alone can do. It was after a mass upsurge and movement led by Anna Hazare and then joined by others that the Lokpal movement had gained ground in 2011.

Earlier, senior advocate Shanti Bhushan, representing the petitioner Common Cause, submitted that the court should interpret the Act, to bring Lokpal into existence expeditiously, as the political class has not shown any interest in carrying out the necessary amendments to the Act, to make it functional. Saying that the Act was passed in 2013 after a long anti-corruption crusade led by Anna Hazare, Shanti Bhushan asked “Do we need another Anna Andolan to bring Lokpal into being?”

The CJI pointed out that the “selection committee” has not been duly constituted because the selection committee, comprising the Prime Minister, the Speaker of the Lok Sabha, the Leader of the Opposition, Chief Justice of India could not meet to select an eminent person in the panel which will form the search committee to select Lokpal and other Members.

Maintaining that it would not let Lokpal become “a dead letter” or “redundant”, the Supreme Court Wednesday questioned the Central government why it has not appointed the anti-corruption ombudsman in the last two years if it was really concerned about checking corruption and bringing probity in public life. Seeking a deadline from Attorney General Mukul Rohatgi on when the institution would become functional, the bench asked him: “Was it not to be considered as an emergent situation by the government that despite the Lokpal Act becoming a reality in 2014, there is no Lokpal in place? If it is about cleansing the system, which you say this government is concerned about, then why in the last two years you could not make this work? We will not allow a situation where an institution like Lokpal becomes redundant.”
Following this submission, the bench posed a volley of questions to the AG, questioning the intent of the government in having a Lokpal. “If you could do (amend LoP) it for four other enactments so conveniently, what is the problem in doing it for this Act? You claim you are committed to appointing a Lokpal and you have also moved an amendment to this effect so in our opinion, you should welcome a judgment from this court if that expedites everything,” it told Rohatgi.

But the AG said that it would tantamount to the court legislating, which was the Parliament’s role. “But you are not legislating…if Lokpal is meant to be an institution to bring probity in public life and bring down corruption then it must be working regardless whether the government wants it or not or whether amendments have been cleared. This court will read down the related provision to see that it becomes functional. We will not allow a situation where an institution like Lokpal becomes redundant,” it said.

The bench added: “We think that instead of giving an impression that you are dragging your feet, you should come forward and invite an order from the court so that Lokpal starts working. Why do you want people to have a misgiving that government is not interested in having a Lokpal. Ideally, you should do it yourself (by amending the law). But what you have done conveniently in four other enactments, you are not doing it here so accepting your own position, we should have no difficulty in reading down the statute.”

The AG resisted an order from the court, saying amendment in a law was within the ambit of the Parliament and that he was not in a position to commit a time frame for the amendment to be passed. At this, the bench asked him to take proper instructions from competent authorities and revert on December 7.
