

















Defying the government’s prohibitory orders throughout the state, several Samajwadi Party leaders have come together to protests against the Citizenship Amendment Act in front of the legislative assembly complex in Lucknow on Thursday. Despite tight security arrangements, they have decided to stage sit-in protests against the controversial CAA on the orders of the party’s National President Akhilesh Yadav.
Those protesting include Ram Magan Rawat, Arvind Singh Gope, Dr Kuldeep Ujjwal, Rajeev Kumar Singh, Rakesh Verma, Fareed Mehfooz Kidwai and Ramgopal Rawat among other members. However, some SP members were detained and some even had to face lathi-charge by police. Former minister Kamal Akhtar, along with other protestors has been arrested from Amroha and several others have been detained in Mathura and Lucknow. The police resorted to lathi charge to stop protestors from continuing with the agitation. District President Lokmanikant Jadaun, Vice President Ranveer Singh Dhangar and Regional leaders Pradeep Chaudhary, Pawan Chaudhary and Bharat Chaudhary were arrested by the police.

In Lucknow, SP MLA Rajesh Yadav climbed the legislative assembly complex gate shouting slogans ‘Yogi Baba Mast, Pradesh Mein Kanoon Vyavastha Dhwast’. In Mathura, protestors shouted slogans against PM Modi and CM Yogi Adityanath and SP District President burnt an effigy of the CM.
The Samajwadi Party (SP) has announced a sit-in protest at all its district headquarters in Uttar Pradesh on December 19, 2019 on various issues, including the Citizenship Amendment Act (CAA) and farmers’ issues. Keeping the protests in mind, the police had already imposed Sec 144 in the state.

A press note posted by Chief Spokesperson Rajendra Chaudhary on Facebook yesterday had quoted Akhilesh Yadav as saying, “The Bharatiya Janata Party that has a majority in the state is trying to overthrow the values of the democracy and the Constitution of India. In bringing the CAA, it is trying to play the politics of ‘divide and rule’. There are protests going on all over the country against this. Because of the autocracy of the government, the individual’s freedom too is getting muzzled. There will definitely be a protest on December 19 through which the Samajwadi Party will try to bring the attention of the government to the real issues plaguing the people.”
The post also read, “The state has tried to crush all the youth and activists who have risen in dissent against the CAA. Students are being removed from hostels and even female students are being harassed by the authorities. By trying to portray the students as violent, the government is trying to undermine their fight. The students are being falsely charged and framed. The right to protest is a fundamental right and with such actions the authorities are only trying to intimidate the protestors.”
The statement called also called the government’s attention to real issues the failing law and order situation in the state, the increasing number of crimes against women, the anti-farmer policies, the sorry plight of the health and education system, the increasing unemployment and the rising inflation.

Akhilesh Yadav has been vocal in his opposition against the CAA. Tweeting against the BJP government he alleged that it was conspiring to divide the country and society on religious lines by bringing in the Act. He said that the process of bringing in the act had caused a lot of resentment among the people and the Bharatiya Janata Party (BJP) was playing the politics of seduction, trying to gain a larger vote bank and divert the attention of the people from real issues like the economic recession.

The peaceful protestors have been subjected to lathi charge by the police once more. Once more, the powers given to the state have been misused to curb dissent which has become a trend in states run by the BJP government.
The fact that protestors are showing up in large numbers despite prohibitory orders shows that there is an undying and undeterred spirit of agitation against unconstitutional laws being imposed by the State.

The MoS, Ministry of Environment, Forest and Climate Change explained how the ‘Wildlife (Protection) Act, 1972, has an incentivized voluntary village relocation programme which inter alia provides for community facilities like access roads, irrigation and drinking water’. It was further explained how the villagers are given an option to either receive package of Rs. 10 lakhs or rehabilitation to be carried out by Forest Department and monitored by District Magistrate.
All such claims of rehabilitation and compensation sound too good to be true on paper and fail on ground. That has been the reality of innumerable government welfare schemes for all categories of marginalised groups in India. Government after government has failed to ensure effective implementation of a good-looking policy.
Survival, a global organization that fights for tribal people’s rights released a report titled “Illegal evictions from India’s tiger reserves”. The report is not just an analysis of the law but has several accounts of persons directly affected, forcefully evicted from their home lands, in complete contravention of the provisions of the law.
The report cited an Economic and Political Weekly article to state that over 1,00,000 people have been removed from protected areas in India. The report goes on to debunk the claims made by the government that compensation and rehabilitation is being provided to the tribal people being evicted ‘with their consent’ from these protected areas. The Report specifically takes a look at forceful and coercive evictions from tiger reserves in India.
The report states that once Adivasis are evicted from the forests, all their rights effectively stand violated including their rights to a secure livelihood, to practice their religion and to protect their culture as their land provides food and housing and is a foundation of their identity, belief system and sense of belonging.
Is eviction of tribal people justified?
The report answers in the negative to this question. The report says that tribal people are evicted from their lands in the name of tiger conservation and fee-paying tourists are welcomed in. The report further alleges that destructive industries and mining activities are also allowed some times.
“In 2019 the central government approved exploration for uranium ore in Amrabad Tiger Reserve, whilst Chenchu families living there were told to leave their homes to create an inviolate space for tigers.”
The report also claims that the Adivasis who live in India’s tiger reserves have managed, protected and depended upon these lands for countless generations. This is why their forests are so appealing to conservationists. It is also held that tribal people are the best guardians of their lands and instead of keeping them at the forefront and working with them to conserve forests, the government is usurping these lands under the garb of conservation, using a top down approach which is leading to an ‘ill-conceived and ineffective’ model of conservation that is in dire need of a transformation.
The Chenchu tribe of Amrabad Tiger Reserve said in their open letter that, “We see the well-being of the forest as our duty, we protect the animals and plants of this wild forest without harming them. This forest is our home. The flora and fauna of this forest are part of our family.”
The report cited some news reports to state that in Biligiri Rangaswamy Temple Tiger Reserve (BRT) (Karnataka) the reverse has been shown: when the Soliga tribe had their rights to live in a tiger reserve recognized, tiger numbers increased far more than the national average; and also that as of 2018, Karnataka, the state with the most tigers, also had the largest number of people living inside the core of its tiger reserves.
The Forest Rights Act (FRA)
As per the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act 2006 (known as the FRA) forest right holders can only be resettled from critical wildlife habitat is certain conditions are met. These conditions require that their rights be recorded and also puts the onus on the government to show that the tribal people in that area are ‘irreversibly harming wildlife and coexistence is not possible’. It also requires that the community needs to give “free and informed consent” for being resettled and rehabilitated which must be done by the Gram Sabha and the rehabilitation and land allocation must be completed.
The FRA was hailed as a monumental law in recognising the rights of tribal people not just individually but also as a community for their land and sustainable use of forest products. The law It recognizes the right of tribal people “to protect, regenerate, or conserve or manage any community forest resource, which they have been traditionally protecting and conserving.”
Wildlife Protection Act
In 2006 even the Wildlife Protection Act was amended in order to recognise tribal rights which also included certain conditions to be met before resettling scheduled tribes or other forest dwellers which are similar to the FRA, as mentioned above and the main clause being consent of the community must be gained to assess whether they are causing irrevocable harm and whether coexistence is possible.
Panchayats (Extension to Scheduled Areas) Act (PESA)
This Act which refers specifically to the “Scheduled Areas” (areas where the tribal population is more than 50%, emphasizes upon the role of Gram Sabha as an appropriate body for making decisions that affect tribal communities and provides that Gram Sabha should be consulted before any resettlements are to take place and that it should approve the plans and projects affecting the tribal people, before such projects are implemented by the government.
Laws disregarded blatantly
It is stated in the report that the Forest Department usually acts in blatant violation of the provisions of the laws and hence effectively the rights of the tribal communities, while forcefully implementing the “resettlement” provisions of the laws.
Many people who were interviewed, had very little understanding of their rights and their rights were not officially recognised, which was the condition to be met for rehabilitation and relocation and hence the entire process can be deemed to be unlawful. It is stated that Chenchu families from Amrabad Tiger Reserve have repeatedly been told by officials that forest rights don’t apply inside the tiger reserve. It has been gathered globally, that the most effective way to lower the incidence of poaching, wildfires and encroachment is to recognize land rights of tribal communities.
Illegal evictions
More often than not, tribal people are not aware that they have the right to say no these evictions and give an informed consent free from duress and coercion. Most evictions are forcefully carried out by Forest Department officials by threatening the tribal people that they will have false cases filed against them and are also told that once they move out of the forest they will be given basic amenities like school and primary health care which are not provided to them while living in the forest.
The Report alleged that the World Wide Fund for Nature was complicit in such evictions and supported forest guards under the garb of working on conservation of Achanakmar and surrounding forests since 2003.
Illegal evictions have been faced by tribal communities in Similipal Tiger Reserve, Nagarhole Tiger Reserve, which are few among the many.
Is compensation and rehabilitation really given?
The report states that monetary compensation is usually not given or if given is less than promised. The promises of fertile lands are also not delivered and instead the evicted tribal people are forced to trek back to the forest for their livelihood as the land allotted to them mostly turns out to be barren un farmable land.
All of this amounts to not only violation of the laws as abovementioned but also the right to live with dignity and also violates the Scheduled Castes and Tribes (Prevention of Atrocities) Act (Known as the Atrocities Act) as the tribal people are abused and made to forcefully give consent for relocation from their homeland, their forests.

“I am sorry I will not be able to mark my presence in person at the August Kranti Maidan to protest against the intended dovetailing of the CAA into the NRC. Nothing has been officially spelt out clearly at present but an atmosphere of fear has been sought to be created by our top government leaders by saying that “No Indian Muslim needs to fear”.
The wave of celebrities joining in to support the students’ protest against the CAA is growing bigger by the day. After Bollywood’s clarion call to the public to join in the protest at the August Kranti Maidan, Mumbai on December 19, many more celebrities have tweeted out in support of the students, condemning the violence they were subjected to by the state.
What is interesting is that many of the newbies on the anti-CAA bandwagon, have previously openly supported and even defended the Modi regime. Just days after the protests at Jamia Millia Islamia University (JMIU) and Seelampur, the government is allegedly trying to make it difficult for protesters to assemble and hold peaceful protests in different parts of New Delhi.
On Thursday morning, the Delhi Metro Rail Corporation sited security concerns behind a series of station shut downs. According to tweets from their official twitter handle, the following stations have been shut down completely: Jamia Millia Islamia, Jasola Vihar Shaheen Bagh, Munirka, Lal Quila, Jama Masjid, Chandni Chowk, Vishwavidyalaya, Patel Chowk, Lok Kalyan Marg, Udyog Bhawan, ITO, Pragati Maidan, Barakhaba and Khan Market. Trains will not halt at these stations. Additionally, Entry and exit gates of Vasant Vihar, Mandi House and Central Secretariat are closed. However, interchange facility is available at Mandi House and Central Secretariat.
It is noteworthy that all these stations are either near areas where protests have previously taken place or are convenient centrally located popular places where demonstrators often gather to hold public meetings. Given how peaceful protest is a democratic right of citizens, it appears that the present regime is showing proto-fascist inclinations in a bid to control dissent. However, undeterred by these tactics and even the imposition of prohibitory orders, peaceful protests are planned across India against the un-constitutional Citizenship Amendment Act (CAA) and the upcoming nationwide exercise along the lines of the National Register of Citizens (NRC) that was recently conducted in Assam.

The Kakori conspiracy (or Kakori train robbery or Kakori case) was a train robbery that took place at Kakori, near Lucknow, on 9 august 1925. This ‘Robbery’ was organised by the Hindustan Republican Association (later was named as Hindustan Socialist Republican Association).
It was executed by Ram Prasad Bismil, Ashfaqullah Khan, Rrajendra Lahiri, Roshan Singh, Chandrashekhar Azad, Sachindra Bakshi, Keshab Chakravarty, Manmathnath Gupta, Murari Lal Gupta, Mukundi Lal and Banwari Lal.
The British rulers secured the death penalty for Ram Prasad Bismil, Ashfaqullah Khan, Rajendra Lahiri, Roshan Singh courtesy a kangaroo court trial on July 18, 1927. Three of them, Roshan Singh (hanged at Naini Jail, Allahabad), Ashfaqullah Khan (hanged at Faizabad Jail) and Ram Prasad Bismil (Hanged at Gorakhpur Jail) on the same day on 19 December 1927. Rajendra Lahiri was hanged at Gonda Jail on December 17, 1927, two days before the scheduled date.
The British government and its Indian lackeys propagated that these martyrs and their comrades who took possession of the British Government treasury being transported in Kakori Mail, near Kakori on August 9, 1925 were simply romantic, hot-headed, adventure loving young men who loved guns and fire-arms. They were referred to as terrorists. It is far from truth. On the contrary, these revolutionaries were highly politicized and aware of the fact that the goal of overthrowing the British imperialist rule in India could not be achieved till the people of India discarding their religious bickering did not unite. They were led by a genuine urge to liberate India from the repressive colonial rule but with mass involvement. Unfortunately, generations after Independence, we remain ignorant of their writings and ideological stands.
Let’s know what the contemporary documents tell us about these young men who laid down their lives for the liberation of India.
(1) British treasury robbed not for buying arms but establishing a printing press for literature
This revolutionary group waylaid the British Government treasury at Kakori and captured the same not for purchasing/manufacturing arms and ammunition but for publishing Socialist literature to be circulated among youth, peasantry and workers so that they are politicized and rise in revolt. It shows this group had passed the stage of terrorism and matured into a revolutionary political group which believed in involving larger masses in the struggle to overthrow British rule.
(2) For a Socialist India
They knew that to overthrow the British rule was a serious task and needed ideological clarity. With this aim they worked tirelessly and formed Hindustan Republican Association/Army [HRA] whose manifesto ‘Revolutionary’ was produced as a proof by the prosecution in the Kakori Case. Even after the martyrdom of these revolutionaries in 1927, other revolutionary leaders like Bhagat Singh and Chandershekhar Azad continued with this effort. The conversion of HRA into ‘Hindustan Socialist Republican Army’ in a secret meeting at Ferozshah Kotla on September 8-9, 1928 gave a clear-cut Communist direction to the revolutionary movement.
In fact, this direction was quite notable in Ashfaqullah Khan’s ‘Message to Countrymen’ which he smuggled out of Faizabad Jail few days prior to his martyrdom on December 19, 1927. He made his socialist commitment very clear when addressing to the Communists of India he wrote:
“I am greatly in agreement with you and want to tell you that my heart always weeps for the poor peasants and helpless workers. While on the run I stayed with them and after seeing their condition I often wept…This is absolutely true that whatever they grow or produce, they have no share, they always remain sad and in bad shape. I do agree that for all these things our white Masters and their agents are responsible…I have deep regards for you in my heart and while dying, I fully agree with your political aims. I want that kind of freedom for Hindustan where poor should live happily and with ease. I pray to God that after my death, that day should come at the earliest when Abdullah mechanic of loco workshop, Dhaniya cobbler and common peasants are seen sitting on chairs in front of Mr. Khaliq-uz-Zaman, Jagat Narain Mulla and Raja Saheb Mehmoodabad in Lucknow’s Chhaatter Manzil. My comrades, my revolutionary brothers—what I can tell you and what I can write to you, it will be a matter of great pride to you when you will hear that one of your brothers went to the gallows smiling and was happy while dying. I know very well about the spirit which your group has and I was proud of it, and now I am more proud that I am dying as a true revolutionary.”
(3) Anti-people rule survives by dividing people on religious lines
The Kakori martyrs were highly concerned about the damage communal polarization was going to cause to the anti-British struggle. It was their firm opinion that communal divide will only help the British rulers. Ashfaqullah Khan’s ‘Message to Countrymen’, in fact, expressed their collective opinion regarding the game communal forces were playing in league with the British masters, he wrote:
“Oh! How can we appreciate the present-day life when our political leadership is going through internal strife? If one is fond of Tableegh [the propagation of Islam] the other believes that dying for Shuddhi only will lead to emancipation. Government secret service agents finance the spread of religious propaganda. Their aim is not to defend religion or help it to flourish but to create obstacles in the path of the moving train [of the freedom struggle].”
While pouring out his heart for his countrymen both Hindus and Muslims he went on to warn them:
“Brothers! Your civil war, your internal bickering will not be useful for any of you. This is impossible that 7 crores Muslims can be converted to Hinduism [through Shuddhi] and likewise it is futile to believe that 22 crores Hindus can be turned into Muslims. However, [if they continue fighting with each other] it is easy and very easy that all of them together will continue to be in chains.”
The Kakori martyrs belonging to different religions and regions expressed these words of wisdom when foreign rulers had India under their Iron Heel. They could rule India by putting one religious community against the other; institutionalized as Divide and Rule. Sadly, almost seven decades after the birth of a democratic-secular India, the polity has been taken over by RSS/BJP rulers who are using every evil tool in the armoury of the Hindutva fascism to divide India along religious lines. The new Citizen Amendment Act 2019 and war cries for introducing National Register of Citizens will put to shame even the British masters who ruled India once. All those who want to save India from the Hindutva juggernaut must come out on streets, holding photographs of these martyrs in hands and their words of caution and unity on the lips.

The agitation against the Citizenship Amendment Act (CAA) has now become a national issue, not just staying limited to Assam. The students of Jamia Millia Islamia University (JMIU) and Aligarh Muslim University (AMU) who came out in protest to oppose the anti-constitutional CAA were heckled, beaten up and brutally injured have now found solidarity in the influential Bollywood industry who has now asked people to take to the streets and come together to condemn the violence of the police against the students and raise their voice against the undemocratic CAA.

Celebrities, young and old, have voiced their support in the favour of students who have been silenced violently by the state. The anti-CAA agitation is one of the first movements in recent times that the Bollywood industry is throwing its weight after. Not only this is a positive push towards encouraging the general public, but also a welcome move to see that some of these celebs are not scared to value their country and its secularism over the fear of the loss of their privilege.
