Germany Bows to Turkish Pressure: Allows Prosecution of Comedian who Mocked Erdogan

German chancellor, Angela Merkel, has bowed to Turkish pressure –for which she has been  criticised by members of her own cabinet —after she acceded to a request from Ankara to prosecute a comedian who read out an offensive poem about the Turkish president, Recep Tayyip Erdoğan. Erdogan’s regime has become synonymous with curbs on freedoms, attacks on minorities and a stifling of dissent.

While Merkel has defended her decision, trying to stress that it did not amount to a verdict on whether Jan Böhmermann was guilty or not, but should be understood as a reaffirmation of the judiciary’s independence, she is facing increasing criticism for the act. Merkel was left with the final decision on whether Germany’s state prosecutor should start proceedings against Böhmermann after Erdoğan requested the comedian be prosecuted. Under an obscure section of Germany’s criminal code, prosecution for insults against organs or representatives of foreign states requires both a notification from the offended party and an authorisation from the government.

PEN International has issued a strong statement in condemnation of the decision.  

“The German government’s authorisation for the prosecution of comedian Jan Böhmermann for broadcasting a crude poem that allegedly insulted Turkish President Recep Tayyip Erdoğan in accordance with a German law on insulting foreign leaders, infringes on the fundamental right to freedom of expression, German PEN and PEN International said today.

'The decision by Chancellor Angela Merkel came after the Turkish Embassy lodged a formal request with the German foreign ministry to prosecute Böhmermann, after the comedian read a poem in a late-night programme screened on the German state broadcaster ZDF at the end of last month that accused president of Turkey of, among other things, “repressing minorities, kicking Kurds and slapping Christians”.

‘There has been some discussion about the vulgarity of Böhmermann´s mock defamatory poem. We trust in our judicial representatives to know that freedom of expression is not about taste or the quality of literature. It´s about freedom and civil rights,’ said Regula Venske, General Secretary, German PEN

‘As Josef Haslinger, president of German PEN, has pointed out, Jan Böhmermann´s action can be understood as a paradoxical intervention. By adding one defamatory cliché after the other, Böhmermann drew our attention to some obscure paragraph criminalising lèse-majesties in German criminal law. We call upon the German government to quickly proceed with its abolition.’

'Merkel made the decision today on whether Germany’s state prosecutor should start proceedings against Böhmermann, after Erdoğan pressed charges against the comedian. Insulting heads of state is illegal under an obscure section of Germany’s criminal code, which requires authorisation from the German government. If found guilty, Böhmermann could face up to five years in prison or – more likely – a fine.

'Merkel has indicated that the law will be repealed by 2018.

'President Erdoğan has made extensive resort to Turkey’s criminal defamation laws to silence critics and opponents, having lodged over 1800 personal insult suits since he became President in 2014.

'International human rights standards put a high value on uninhibited expression in the context of ‘public debate concerning public figures in the political domain and public institutions’. The Human Rights Committee, which oversees the implementation of the International Covenant on Civil and Political Rights to which Germany is a state party, has made clear that the ‘mere fact that forms of expression are considered to be insulting to a public figure is not sufficient to justify the imposition of penalties’. Human rights bodies have also pointed out that heads of state and public figures should tolerate a higher degree of criticism than ordinary citizens.

‘The test of a nation’s commitment to freedom of expression comes when its government has to decide if it should use an obscure law, which protects only one class of people (in this instance foreign heads of state), to prosecute the author of what is clearly a satirical poem. Germany has decided to do so because a foreign government – Turkey, which is hardly a beacon of freedom of expression, which has an appalling record in protecting free speech, and has prosecuted writers and journalists over the years – wants Germany to act the way Turkey itself would in similar circumstances,’ said Salil Tripathi, Chair of PEN International’s Writers in Prison Committee.

‘The question is not whether Jan Böhmermann is a good poet, whether his work has aesthetic value or whether it was deeply offensive – that remains a matter of individual taste. The question is whether Germany – which has pledged to repeal the law by 2018 – should use the law as if it had no other choice. Robust democracies thrive on sharp debate and biting satire, even if it is in poor taste. Germany must act consistent with its own, European, and international standards of free speech and drop all charges against Böhmermann immediately.’

PEN International opposes the criminalisation of defamation in all cases, calling for defamation and insult to become civil offences. PEN also calls on the German authorities not to bring any charges against Böhmermann and to implement the decision to overturn the law criminalising the insult of foreign leaders as soon as possible.

Meanwhile, in a lighter vein, a satirist blog based in the United Kingdom commented that the “World stunned by revelation that Germany has a comedian!

The decision is also being criticized on account of the recently agreed refugee deal between Turkey and the EU has made the chancellor reliant on the whims of Turkey’s strongman leader. Merkel was one of the main drivers of the agreement, under which migrants arriving in Greece are now expected to be sent back to Turkey if they do not apply for asylum or their claim is rejected.

“Merkel is kowtowing to Turkey’s despot Erdoğan and sacrifices freedom of the German press,” said Sahra Wagenknecht, a senior politician for the German Left party said in a statement to the media.

The chairman of the Turkish Community in Germany, Gökay Sofuoglu, also criticised the German government’s decision, saying: “I would have wished the chancellor had not allowed the trial to go ahead.” Erdoğan had also filed a personal lawsuit against Böhmermann, and Sofuoglu said Merkel should have waited for the outcome of that trial first.

A demonstration in front of the Turkish embassy in Berlin, scheduled for Friday afternoon, has been banned by Berlin police. Activists had announced that they were planning to read out Böhmermann’s poem in front of the embassy.

Böhmermann himself has not commented on the affair since the programme was aired last Thursday. Cologne authorities have confirmed that the comedian and his family are under police protection.

नफ़रत फैलाने वालों की पोल खुलने से फ़ेसबुक क्यों नाराज़ होता है ?

क्या फ़ेसबुक नफ़रत फैलाने वालों के दबाव और इशारे पर काम करता है? क्या लाइक और शिकायत के गणित के ज़रिये तय होगा कि समाज के हित में क्या है और क्या नहीं ? यह सवाल उठ रहा है दिल्ली विशवविद्यालय के अध्यापक और हिंदी के मार्क्सवादी आलोचक आशुतोष कुमार के साथ हुए सुलूक से। फ़ेसबुक ने उन्हें 24 घंटे के लिए ब्लॉाक किया और हमेशा के लिए ब्लॉक करने की धमकी दी। उनकी ग़लती यह थी कि उन्होंने नफ़रत फैलाने वालों की कारग़ुज़ारियों का पर्दाफाश करते हुए एक पोस्ट लिखी थी। ज़ाहिर है, नफ़रती गुंडों ने गिरोह बनाकर उनकी शिकायत की जिसकी वजह से फ़ेसबुक ने ऐसा किया। लेकिन क्या फ़ेसबुक के पास कोई संपादकीय नीति नहीं है जिससे सही-ग़लत का वह फ़ैसला कर सके। अगर नहीं, तो समझिये कि ज़ुकरबर्ग ने आज़ादी का मंच नहीं, धंधा खड़ा किया है जो आने वाले दिनों में  लोगों को मानसिक ग़ुलाम बनाने के लिए इस्तेमाल किया जाएगा। पढ़िये ब्लॉक रहने के दौरान मीडिया विजिल के लिए क्या लिखा आशुतोष ने–  

 फेसबुक ने मुझे 24 घण्टे के लिए ब्लाक कर दिया है , और स्थायी रूप से ब्लाक करने की धमकी दी है ।

हमारा  अकाउंट  दृश्यमान है , लेकिन  हम  न  तो  कुछ पोस्ट  कर  सकते हैं  , न  किसी  और की दीवार  पर  कोई  टिप्पणी कर  सकते हैं . मैंने बजरिए Nirendra Nagar एक पोस्ट   शेअर की थी , जिसमें मुसलमानों के ख़िलाफ़ नफ़रत फैलाने की एक घृणित साइबर साजिश का भंडाफोड़ किया गया था। वह पोस्ट अब भी नागर जी की दीवार पर होगी।

मुम्बई का एक  मुसलमान  आँख पर पट्टी बांध कर सड़क किनारे खड़ा हुआ था। उसने निकट एक तख्ती लगा रखी थी , जिस पर लिखा था – मैं मुसलमान हूँ , मुझे आप पर भरोसा है । अगर आप भी मुझ पर भरोसा करते हों तो गले मिलिए।यह एक सच्ची घटना है । लोग दिन भर उससे मिलते रहे और खबर बनी।

किसी ने इसी घटना के फोटोग्राफ उठाए । और आखिर में एक फोटो जोड़ दिया , जिसमें दिखाया गया था कि आखिरकार वह मुसलमान कमर में बंधे बम से गले मिलनेवाले को उड़ा देता है। (नीचे देखिये, धमाके वाली तस्वीर जोड़कर कैसे अर्थ का अनर्थ किया गया है ! )

यह हरकत अधिक दुखदायी इसलिए है कि विश्वास का सन्देश देने वाले एक प्रयोग को इस रूप में पेश किया जा रहा था कि और ज़्यादा नफ़रत फैले। नागरजी की पोस्ट में इसी घिनौनी साजिश का भंडाफोड़ किया गया था। मैंने इसी पोस्ट को शेअर किया था। यह शालीन और सन्तुलित भाषा में लिखी गई पोस्ट थी।

पहले तो कम्युनिटी स्टैंडर्ड के ख़िलाफ़ बता कर फेसबुक ने इस पोस्ट को हटा दिया। लेकिन उन्होंने मुझसे न तो कोई स्पष्टीकरण माँगा , न स्वयं  दिया। इस बात की शिकायत करते हुए मैंने उसी पोस्ट को दुबारा शेअर किया। फेसबुक ने उसे दुबारा हटा दिया। और 24 घण्टे के लिए ब्लाक कर दिया। और अबकी मुझे सख्त चेतावनी दी है कि अगर मैंने दुबारा ऐसी गलती की , तो वे मुझे हमेशा के लिए ब्लॉक कर देंगे।लेकिन मेरे इस पोस्ट में गलती क्या है , यह नहीं बता रहे।

ध्यान रहे कि मेरे अलावा भी बहुत से लोगों ने उसे शेअर किया है।जिसे फेसबुक ने भी नहीं हटाया है। जाहिर है कि फेसबुक की हमन से कोई ख़ास नाराज़गी है। हमने अपनी  तरफ  से  फेसबुक  को  समूचे  घटनाक्रम  की जानकारी दी है  . लेकिन  न तो फेसबुक ने  हम  पर  लगा  ब्लॉक  हटाया है , न ही उसने हमें कोई उत्तर दिया है.कुछ  दोस्तो  ने  इस  जानकारी  को  फेसबुक  पर  शेअर  किया है . लेकिन  कुछ  दोस्तों ने यह भी कहा है कि जब वे हमें टैग करते हैं तब पोस्ट प्रकाशित  नहीं हो पाती . 

यह एक चिंताजनक  परिस्थिति  है .क्या  सोशल  मीडिया  की  स्वतन्त्रता  भी नियंत्रित  की जा रही है ? क्या कारण  है  कि  साम्प्रदायिक  नफरत फैलाने वाले  हज़ारो -लाखों पृष्ठ  शिकायतों केबावजूद सक्रिय रहते हैं , जबकि प्रगतिशील  विचारों के पन्ने  और  पोस्ट  तत्काल  और ताबड़तोड़ ब्लाक  किए जा रहे हैं ?

कनुप्रिया  की दीवार पर ऋषभ  दुबे  ने  कहा है  कि  साम्प्रदायिक  कंटेंट  की शिकायत  पर  ब्लाक किया गया ठलुआ क्लब  नाम का पेज  मोदी सरकार के आते ही अचानक फिर से सक्रिय  हो गया . ध्यान रहे , ठलुआ  क्लब वही  पेज है , जिसने  विकृत  पोस्ट डाली थी , जिसका भंडाफोड़ नीरेंद्र  नागर  ने किया था , जिसे हमने शेअर  किया , जिसके चलते हमें ब्लाक किया गया . ऋषभ  दुबे ने यह भी बताया है कि वसीम  सर  का ' इंडियन मुस्लिम ' पेज  भी नई सरकार  के आते ही प्रतिबंधित कर दिया गया था .  

अगर  इन खबरों में तनिक  भी  सच्चाई है , तो  इसका  मतलब यह है कि सोशल मीडिया  को नियंत्रित  करने की कोई भीषण दुरभिसन्धि  जारी है , जिसका फेसबुक की ओर से अपेक्षित प्रतिरोध नहीं किया जा रहा है .  हो सकता है , हमारी और पोस्टें  भी हटा दी जाए। हो सकता है  , हमें ब्लॉक कर दिया जाए। 

ऐसा हो तो आप लोग हम सब की इस साँझा लड़ाई को उसी शिद्दत से आगे बढ़ाते रहिएगा। और हो सके तो मेरे साथ घटी इस घटना के बारे में फेसबुक के साथियों को बताइए। आवाज़ उठाई जानी चाहिए। सोशल मीडिया हमारे पास प्रतिरोध का एक सुगम जरिया है। लेकिन अब लग रहा है कि फासिस्ट ताकतें इस माध्यम को भी अपने चंगुल में कस लेने की कोशिश में जुटी हुई हैं, और कामयाब हो रही हैं।

मैं इस समय फेसबुक पर कुछ भी शेअर नहीं कर पा रहा हूँ।लाइक और मैसेज तक नहीं कर पा रहा हूँ। इसलिए हमने मीडिया विज़िल  के जरिए आपसे बात करने का रास्ता चुना।

(फ़ेसबुक ने अब आशुतोष कुमार का अकाउंट खोल दिया है। लेकिन यह एक सबक है कि आने वाले दिनों में क्या हो सकता है। ख़ासतौर पर जब सोशल मीडिया के ज़रिये नफ़रत फैलान वाले अभियान का सीधा रिश्ता सत्ताकेंद्रों से हो। )

Bangladesh: 81-year-old Magazine Editor Arrested for Sedition

Arifur Rahman RabbiNoted journalist, opinionmaker and former editor of the daily Jaijaidin, has been picked up by plainclothesmen. Best known for his incisive criticism of the government during General Ershad’s dictatorship through in his weekly column, Shafik Rehman has come to be known as a sympathiser and an informal adviser of the main political opposition BNP.

Claiming to be police detectives, Detective Branch personnel arrested Shafik Rehman from his house in Dhaka’s Eskaton. Head of Dhaka DB’s south zone, Masrukur Rahman Khalid, told the Dhaka Tribune that Shafik was arrested for plotting to abduct and murder Sajeeb Wazed Joy, son of Prime Minister Sheikh Hasina. Joy is also a prime ministerial adviser for ICT affairs.

The case was filed by DB Inspector Fazlur Rahman with the Paltan police in August, 2015. The inspector had named BNP's cultural wing JaSaS Vice-President Mohammad Ullah Mamun and a number of unidentified BNP leaders. A US court sentenced JaSaS leader Mamun's son Rizve Ahmed Caesar on March 4, 2015 for his involvement in bribery scheme to obtain confidential information from a former FBI special agent in New York.

Maruf Hossain, another deputy commissioner of the police confirmed Rehman’s arrest at a briefing at the DMP media centre. He had also told the media that the BNP-leaning intellectual had been arrested for sedition.
Shafik Rehman’s wife Taleya said three to four people introducing themselves, first as journalists of Boishakhi Television, had come to their house to interview Shafik around 7:30am. She said her husband was asleep then, but went down when whe awoke him. “They claimed to be DB men when we went down to meet them.” Taleya said the plainclothesmen had been rough with her household staff and pushed them around and also scolded them."Later we heard that Shafik was arrested in a case filed with Paltan police station."

Sajib Onafis, assistant editor of Mouchakay Dheel magazine, said Rehman's wife Taleya got a call from the DB office hours after the journalist was picked up by the plainclothesmen. "The DB officials informed Taleya that Rehman was feeling sick and asked them to come to the DB office with his medicines," Sajib quoted Taleya. When Taleya and Sajib went to the DB office, reception staffs accepted the medicines and foods but they were not allowed to meet the detained journalist. Rehman is likely to be produced before Dhaka Metropolitan Magistrate Court on Satirday afternoon.

Shafik Rehman lost his editorship of Jaijaidin in 2008 for his stand against a military-backed government. He has presented many talk shows including Lal Golap (Red Rose) on Bangladesh Television.​

Violence erupts on Ramnavmi: Jharkand

Curfew was imposed at four places in Bokaro Steel City after a group of youths clashed with a Ram Navami procession.

Ram Navami, which drew a crowd of over a lakh to Ranchi's Main Road, was celebrated peacefully today in the capital, but reports of violence sparked by stone-pelting came in from Bokaro and Hazaribagh in the evening, dampening the festive spirit that had spread cheer across Jharkhand in the last few days.   In the steel city of Bokaro, curfew was clamped at 8.45 pm on Friday, April 15, at four places after police resorted to lathicharge and fired teargas shells to control an angry mob of youths who had allegedly pelted stones on a procession led by Bokaro MLA Viranchi Narain around 6 pm. More than two dozen people were hurt, including Bokaro deputy commissioner R.M. Ray, 10 policemen and three journalists, one of them a photographer with The Telegraph, that newspaper reported.

Barely half an hour later in Hazaribagh, at least six persons were injured in stone pelting when a Ram Navami procession passed through Pandu village, around 60km from the district headquarters. Later, an earthmover was set on fire. Newspapers reported that Hazaribagh SP Akhilesh Kumar Jha reached the village promptly with additional forces. The situation, he said, was now under control. The police were talking to elderly members of all communities to ensure that there was no further flare-up.

Police sources told newspapers that trouble had erupted between two communities in Pandu village during the procession when some people objected to cars being parked along the route. “It was a minor issue which led to an argument and stone pelting. Security forces at the spot managed to control the situation. But some elements targeted houses deep inside the village. As per our information, three houses were set on fire, while a fourth was partially burnt,” said Jharkhand police spokesperson and ADGP (Operations) S N Pradhan.

Curfew was imposed in Bokaro steel city area, Maraphari, Balidih and Sector XII police station areas.
 

BJP’s Draupadi Poster in UP Sends Ominous Signals

A Poster Of UP BJP Chief, Keshav Maurya as Lord Krishna fires a controversy; it uses religious symbols as a start up to its campaign ten months before the state elections, signalling the possibility of a campaign intended to polarise the voter on religious lines

A poster of UP BJP president Keshav Prasad Maurya in Varanasi depicting him as ‘Lord Krishna’ and other politicians including Chief Minister Akhilesh Yadav as ‘Kauravas’ blatantly violates the law on mis-using religion for political gain. (Section 123a and 123b of the Representation of People's Act). This law becomes operational once elections are announced and the elections in the state are at least ten months away. This could be interpreted as a shrewd plan to evade the law as the sangh parivar is want to do.

The sudden appearance of this over the past few days poster stoked a controversy with the ruling Samajwadi Party (SP) accusing BJP of hurting the religious sentiments of the people and trying to tarnish the image of Yadavs! All the political opponents of the BJP are shown in the poster as responsible for the 'disrobing' of the 'pure' Draupadi.

Maurya, the newly appointed chief for the Sangh-driven Bharatiya Janata Party in the state, a man who has several criminal cases pending against him, is ironically shown as the righteous victor (sic) : with the Sudarshan Chakra trying to 'rescue' the state (UP).

The scene is a metaphorical portrayal of Mahabharata where Krishna rescues Draupati from attempts of the Kaurava brothers to dishonour her in the court.

This is not the first time that the BJP in UP has brazenly used religion and communally aggressive propaganda to polarise voters.
