The Supreme Court today stayed the contempt proceedings against author and activist Arundhati Roy in the Bombay High Court for her article in a weekly questioning the incarceration of Delhi University professor G N Saibaba.

A bench of Chief Justice J S Khehar and Justice DY Chandrachud also granted the leave of appeal to Roy and listed her plea against the issuance of criminal contempt notice by the Nagpur bench of the Bombay High Court for final hearing.

Initially, the court said it wanted to dispose off the case but later considered submissions of senior advocate Chander Uday Singh, appearing for the writer, and observed: “Leave is granted. The proceedings shall remain stayed. List for final hearing”.

The apex court had earlier refused to stay the contempt notice issued against Roy by the High Court on December 23, 2015 for her views on the arrest of Saibaba and the rejection of his bail plea early last year.

The bench had also declined to exempt her from personal appearance before a single judge of the Nagpur Bench of the high court. It had granted liberty to the Registrar of the High Court to file any pleadings or documents in the case and had kept the case for final disposal.

Roy had expressed her views on the arrest of Saibaba in an article published in a weekly magazine last year. Gadchiroli Police had arrested Saibaba in 2014 for his alleged links with Maoists. He has been on bail since June last year.

Early in the morning on June 16, 2017, Comrade Zafar Hussein, an activist of CPI(ML) in Pratapgarh, Rajasthan, was kicked, punched and beaten to death by karamcharis of the nagarpalika (municipality) at the instigation of Nagar Parishad commissioner Ashok Jain when he resisted their attempts to take photographs and videos of poor women from the Bagwasa Kachi basti who were going to defecate in the open. Such photography and videography of women defecating is a clear instance of sexual harassment against women. This incident has yet again established how the Swachh Bharat campaign too is becoming an excuse for lynch mob attacks and attacks on women's dignity and rights. This lyncging at the instigation and instance of Ashok Jain has shown up the dirty face of the Swachh Bharat campaign.

Comrade Zafar himself had submitted a memorandum to the Nagar Parishad some days back protesting against the campaign of public shaming and bullying of women for defecating in the open. In the memorandum he had demanded community toilets and repairing of the non-functional public latrines constructed under the Swacch Bharat campaign. He had also unsuccessfully sought to submit the memorandum to the DM who had refused to accept it.

There have been persistent protests to ensure that the killers are booked.

In two BJP ruled states of Rajasthan and Jharkhand which also recently saw mob violence by saffron goons, CPI-ML is mobilising mass gatherings, protests, and bandhs against such violence.

As the timeline of cow protection moves from Gau raksha to Gautankwad, the nation witnessed a series of attacks against Muslims and Dalits.

lynch On Sunday, the streets of Jantar Mantar resonated with slogans and speeches demanding justice for Junaid, Pekhlu Khan, Akhlaq and other victims of mob lynching.
On the call of Mewat Panchayat for a 3 day sit-in protest, people from Nuh, Faridabad and other places had assembled in Jantar Mantar. A group of 40-50 people from Junaid’s village, Khandawali in Ballabhgarh also attended the protest.

“This has been organised by the people of Mewat… Because of the circumstances now, we feel the need to be on the road to fight,” Sher Mohammed, head of Rajasthan’s Meo panchayat, said.
Jalaluddin Khan, father of 15-year-old Junaid, and Irshad, son of Pehlu Khan, participated in the protest demanding justice for victims of mob lynching.

Nadeem, a protester, quoted as saying: "This protest is against those 200 people who were present at the Asavati platform but didn't come forward to help the injured Junaid and his brothers".

Along with political and social activists, academicians, workers, Jawaharlal Nehru University Students' Union (JNUSU) also gathered at the protest site to express their solidarity. Banners with photos of Dadri lynching victim Mohammad Akhlaq, Pehlu Khan, missing JNU student Najeeb Ahmad, and Junaid floated in the crowd.

Najeeb’s sister, Sadaf Musharraf, spoke about “the number of cows that die from eating plastic…”, and called for “law against mob lynching”.

Earlier, Satarupa Chakraborty, JNUSU General Secretary, said: "JNUSU held meeting with all student bodies and progressive citizens and decided to hold a united protest against mob lynching incidents".

"Since the BJP came into power in 2014, there have been series of attacks on marginalised groups. It must be stopped immediately and JNUSU appeals to one and all to extend support and take part in the meeting at 11 am on Sunday [July 2] to chart out the future course of action," JNUSU said in a release.

The protest call came after hundreds of Delhiites joined the demonstration named 'Not In My Name' to protest against the series of mob lynching. The series of mob lynching started with the gruesome assault on Mohammad Akhlaq by an Islamophobic mob. The series of lynching claimed the life of people from marginalized communities including Pehlu Khan, Hafiz Junaid, Alimuddin from Ramgarh, Jharkhand.

As the timeline of cow protection moves from Gau raksha to Gautankwad, the nation witnessed a series of attacks against Muslims and Dalits. Muslims were the primary target in majority of violence based on bovine issues; from 2010 to 2017, according to a content analysis of the English media. 28 Indians killed in 63 incidents during this time period and Muslims comprised 86% of it.

As many of 97% of these attacks were reported after Modi regime came to power in May 2014. Since then the Sangh Parivar outfits, which led the lynching, have been enjoying state protection and patronage to pursue its ultra-nationalist Hindutva agenda.
