Ten years ago, Halima Akter, employed at a private company in Agargaon, Dhaka, would not have dreamt of divorcing her husband despite the incompatibility that plagued their marriage.

In 2014, the situation was quite different, which enabled Halima to seek a solution to her problems – a divorce. She sent a divorce notice to her husband of seven years, Rasel Ahmed, on March 18, 2014.

Things have changed in Dhaka in recent years; more and more women are speaking up about their marital problems and seeking a solution. In most cases, divorce is the end result.

Dr Sadeka Halim, sociology professor in Dhaka University, believes this is a positive trend because it means that more women are willing to overcome their fear of social stigma in order to build a better life for themselves.

“In a patriarchal society like ours, women are held primarily responsible for keeping their families together – even at the cost of their own happiness and well-being,” she told the Dhaka Tribune. “But that is a flawed concept, because a husband and a wife are equally responsible for their family.

“Though we have a law to prevent domestic violence, it is still a major problem in Bangladeshi households. In most cases, it is the women who are suffer physical and mental abuse in the hands of their husbands and in-laws. But now many women are speaking up against the abuse and choosing to break out of the vicious cycle.”

According to Dhaka North City Corporation (DNCC) and Dhaka South City Corporation (DSCC) data, around 67% of the divorce notices issued from 2011 to 2016 were by women.
In all five zones of DNCC, 28,355 divorce notices were issued in 2011-2016, 14,966 of which were filed by women.

In two zones (Zone 1 and Zone 4) of DSCC, 4,811 divorce notices were issued in 2011-2016, 3,215 of which were sent by women.

Zones 1 and 4 cover Dhanmondi, Kalabagan, Green Road, Kathalbagan, Nilkhet, Kakrail, Bailey Road, Shantinagar, Ramna, Elephant Road and Old Dhaka.

The numbers of divorce notices are increasing every year.

In 2011, 2,864 notices (1,773 by women, 1,091 by men) were issued in DNCC and 819 (533 by women, 285 by men) in Zones 1 and 4 of DSCC. In 2016, the numbers of divorce notices issued in DNCC was 4,847 (3,426 by women, 1,421 by men) and 852 (569 by women, 283 by men) in DSCC.

Salma Ali, executive director of Bangladesh National Women Lawyers’ Association (BNWLA), said divorce nowadays is also propelled by the fact that women are becoming self-sufficient.

“Before, most women were entirely dependent on their husbands, which is why they tolerated all kinds of abuse silently. But as women are becoming financially independent, they have both the confidence and the opportunity to get out of abusive marriage, even though divorce is still heavily frowned up in our society,” she said.

She said couples with problems should seek counselling first to see if their issues can be resolved without ending the marriage.

However, there are many cases where Muslim men deliberately torture their wives so they would initiate the divorce, because they are under the impression that if their wives seek divorce, they would be exempted from paying denmohor, the alimony that is mandatory under Islamic law, Salma said.

Marjia Mukta, a housewife and mother of an eight-year-old daughter in Agargaon, dissolved her 10-year marriage by divorcing her husband Ekram Hossain because he was having an extramarital affair.
Ekram, who lives in Saudi Arabia, said he did not want to initiate the divorce because he did not want to pay denmohor to his wife.

This is a major misconception, says Dr Kazi Zahed Iqbal, lawyer in the Supreme Court.

“According to Muslim Family Laws Ordinance, 1961, no matter which party files for divorce, the husband must pay the denmohor to the wife,” he told the Dhaka Tribune.

More than 50% Dalits landless, 40% of people displaced for ‘development’ are Adivasis, says CES annual report

New Delhi: Even as the NDA government completes three years in power amid tall claims of development, the India Exclusion Report 2016 released by Centre for Equity Studies (CES) has presented a dismal picture of the condition of historically disadvantaged groups in terms of exclusion with respect to four public goods.

The report was released on Friday, May 12th at the Indian Social Institute in New Delhi. This is the third edition of the annual flagship publication of CES.

The India Exclusion Report reviews exclusion with respect to four public goods, one each in the areas of the social sector; infrastructure; land- labour, natural resources and legal justice. For 2016 Indian Exclusion Report, the topics chosen were, pensions for the elderly, digital access, agricultural land, and legal justice for under-trials.

The report termed Dalits, Tribals, Muslims, and Elderly and Disabled as worst hit by the continuous exclusion from the four chosen fundamental public services.

“The headline of this and indeed every exclusion report so far has been that the evidence is consistent that for virtually every public good that we examine, it is always the same sets of peoples who are excluded,” writes Harsh Mander, who has edited the report in its introduction.

“These are the historically oppressed group of women, Dalits, Adivasis, Muslims, persons with disabilities and casual informal workers and the poor. This report only confirms these findings, and illuminates the multiple ways in which even the democratic state in the Indian republic has failed these oppressed peoples and not assured them equitable access to the public goods essential for them to lead lives of dignity,” he writes.

The report has found that the pattern of land distribution reflects the socioeconomic hierarchy — large landowners invariably belong to the upper castes, cultivators to the middle castes, and agricultural workers are largely Dalits and Adivasis.

“The rate of landlessness was highest among Dalits at 57.3%. Among Muslims, it was 52.6%, and 56.8% of women-headed households were landless. Around 40% of all those displaced by “development activity” were Adivasis,” reads the report.

“Land reform efforts have not benefited Dalits, women or Muslims significantly. Land allotments to SC/ST households were often only on paper, as allottees were forcefully evicted or not allowed to take possession,” the report further adds.

The report has taken a dig at PM Narendra Modi on job creation which was one of Prime its prime election promises.

“Yet more than halfway through his tenure, there are almost no jobs available. Job creation has fallen to levels even below those that the preceding UPA government plunged to,” notes the report.
The report also notes the rising rich-poor gap in the country.

The report further notes that the Digital India, which aimed to cover 1,00,200 panchayats under Phase 1 by March 2014 – added only 48,199 panchayats by April 2016 out of which only close to 6,000 panchayats have internet access.

Regarding the legal justice, the report has proposed that state governments, prison departments and jail authorities must work together, and adopt certain reform measures, to make the custodial system more open and less exploitative.

While reacting to the report, Adivasi activist and political leader Soni Sori in conversation with TwoCircles.net said, “Yes the report indicates the reality of Adivasis.The discrimination with them is not only in these four parameters but many others also.”

“Adivasis don’t get pension and legal justice is out of bounds for them. We have seen it many times; a tribal picked up by police and thrown in lockup for weeks without an FIR,” she added.

National Campaign for Dalit Human Rights (NCDHR), General Secretary, Paul Diwakar said, “The continuous exclusion of Dalits from public goods can be attributed to the fact that they are not at power block. At policy designing and implementation, Dalits don’t have any say and there is lack of accountability involved.”

“So, instead of having policies which are pro disadvantaged sections, they frame general polices,” he told TwoCircles.net.

According to Navaid Hamid, President, All India Muslim Majlis-e-Mushawarat, the findings of report aren’t surprising.

He said, “The government of India which usually calls for sabka-saath and sabka-vikas should spell out the reasons why there is still such exclusion of Muslim in provision of public goods.”

8,000 Dam Effected Families “threatened” with forcible eviction by MP Officials

In an email alert to Sabrang india, leader of the anti-dam movement (Narmada Bachao Andolan (NBA) Medha Patkar has warned that “after almost 32 years of struggle, lakhs of people in the Narmada valley to be affected by the Sardar Sarovar Dam in Gujarat, are being threatened with brutal eviction.”

Signed by Parkar and several of her colleagues, including Nurji Vasave, Sanober Mansoori, Bhagirath Dhangar, Rahul Yadav, Kailash Awasya and others, the email alert reports, the Madhya Pradesh government has begun a frantic exercise of “sending its emissaries to convey to the farmers, labourers and all inhabitants of the Narmada valley that they will have to move out of their homes and hearths, their farms and orchards.”

The 'national media' has been conspicuously anant from any coverage on the issue.

“They are asked to leave behind their pucca houses, children’s schools, shops and markets, all the sources of livelihood attached to land and the mother river Narmada”, it continues, adding, “All the temples and ghats, mosques and mazars, age-old religious and cultural monuments, not just archaeological but their ancestors’ remnants underneath, which are not live, yet legendary.”

“The officials and employees are merely the carriers of the message that they will be given a tin shed if they come out of their houses, may it be one built of bricks and mud or cement. Those in one-storied building well-to-do farmers and traders too will follow the poor, landless, fisher people, potters and labourers”, the email alert says.

The Madhya Pradesh government move follows the order by Supreme Court bench headed by chief justice JS Khehar to pay Rs 60 lakh compensation towards purchase of land in lieu of the property they lost under the acquisition proceedings for the project, even as telling NBA that the authorities would thereafter resort to force to evict them thereafter, as one “cannot take everybody for ransom” by now allowing the “the project to come up.”

The email alert insists, this is happening when the rehabilitation sites “are not at all ready with amenities, mandated under the Narmada Tribunal, and endorsed by all the judgements of the Apex Court.”

Alleging “huge corruption in the establishment works at these sites, exposed by Comptroller and Auditor General (CAG) and then by NBA”, the email alert says, as many as 40 engineers have been “sacked after a long legal battle indicating the low quality” of the sites, something which was also “exposed by the technical reports by IIT Mumbai and MANIT Bhopal, accepted by Justice Jha Commission.”

Pointing out that “90% of families haven’t shifted to the new sites, which are full of problems with no drinking water or no drainage, leading to waterlogging and submergence of houses”, the email alert says, “Many have no house plots to build houses on, with large pits, unlevelled or black cotton soil. Thousands of families can’t even build the plinths with the meagre compensation for a house paid to them, 10 to 15 years back.”

All this is happening, says Patkar’s email alert, when Prime Minister Narendra Modi will participate in the much-trumpeted Narmada Seva Yatra, to be concluded on May 15, wondering, “Whom are they trying to save this least polluted river for? Why are they suddenly spending Rs 1,000 crore on propaganda?”

Insisting that it’s the corporate power, ranging from Coca Cola to Adani, which is “snatching away the waters leaving the riverine population high and dry”, the email alert says, “The state is getting ready to use force, which they were never ever permitted by any court, till the latest order of February 8 this year.”

All this, says the email alert, is happening when, even according to official sources, “112 villages from four districts in Madhya Pradesh – Badwani, Dhar, Alirajpur and Khargone with 8,000 families – are likely be submerged as of today. Yet, it wonders, why are 76 villages from district Dhar alone are being “asked to vacate”.

The Central Government has finally approved EVMs with VVPAT but will it suffice?

Victory has a hundred fathers, defeat is an orphan, goes the saying. An unprecedented new political situation has risen in UP this time with BJP and its allies romping home with 325/403 seats in the state Assembly.

How did BJP manage such a landslide?

Part of the answer lies in its comfortable majority of 272 in Parliament and the anti-incumbency vote against the BSP and SP governments of the last decade.
But how demonetisation helped the BJP is the real miracle.

It is now an open-secret that the total amount of currency in circulation which was to be deposited in banks from November 8-Decemeber 30 last year has been far exceeded. The RBI is maintaining a deafening silence on the issue despite numerous RTI queries. It is hiding behind the plea of national-security to stonewall the queries.

The fact is that demonetisation has benefitted everyone. The fat cats who had hoarded currency got it deposited in ever-so-eager banks and with jewellers, paying a commission as high as 30%. Thus, it won't be out of place to conclude in retrospect that perhaps the entire exercise was to convert black money as well as fake currency into white-money.

Demonetisation also eased the space constraints for major hoarders as now only 50 notes of Rs 2,000 can make a lakh. Fake currency notes have once again started surfacing. So is it just a vicious cycle?

Many died in bitter cold while standing for hours during the 50 days campaign and yet people voted heavily in favour of BJP. In UP millions of jobless, unemployed, under-employed labourers and daily wagers etc stood in lines to exchange one lakh rupees for their masters on daily basis, and were paid Rs 5,000 towards “service charges”.

Millions of them deposited their masters’ money in their personal accounts, opened new accounts at the behest of their masters. Jan Dhan Yojna accounts saw a huge spike in deposits and their masters’ money is now sitting in their personal accounts.

Prime Minister Narendra Modi announced that he would find some way (in order to make this money their own) and this fired the popular imagination. A poor man who never had Rs 1,000 in his account now had lakhs in it and if he could manage to keep it as his own he would be indebted to Modi forever.

Now the deadline of March 31 is over and obviously the masters will seek return of their money. That’s when it would be most helpful to have a BJP government at the helm to look to for help when complaining to the police about harassment. It is anybody’s guess that an avalanche of such defaulters is in the offing.

Thus, Modi has brought happiness to the poor who were also elated over the fact that the rich and middle-class had been brought down to their level, made to stand in the same queues as them.

This together with the BJP’s anti-Muslim politics, the Central government’s Urjaa Yojna, representation to non-Jatav and non-Yadav communities, anti-incumbency against SP coupled with its ignominious in-house fighting, tilt of the upper castes towards BJP is what the Assembly results are all about.

BSP was vociferous in its opposition to demonetisation while SP could only put up a timid response.

Another factor which has become even more relevant after the civic elections in Delhi is that of Electronic Voting Machines (EVMs). The Modi government has finally approved equipping EVMs with Voter Verified Paper Audit Trail (VVPAT) following sustained opposition from all parties.

BSP supremo Mayawati has gone to Supreme Court which has given four-week’s time to Chief Election Commission (CEC) to reply. It is ironic that this initiative should have come from Mayawati and not the outgoing CM Akhilesh Yadav. Instead, the latter attended the March 18 oath ceremony of Yogi Adityanath while his father Mulayam Singh Yadav whispered in Modi’s ears triggering speculation.

Did we find Mayawati present in Akhilesh Yadav swearing-in ceremony in 2012? Certainly not.

The results from the UP elections have baffled everyone. Even the BJP had not imagined such a landslide victory. People’s confidence in the voting system through EVM has reached a new low, particularly after demonetisation when people have started to believe that anything is possible with BJP at the helm.

In the aftermath of 2014 results, I had in my personal capacity spoken to numerous ministers in UP, suggesting that they should insist that 2017 Assembly polls be with ballot paper. Now it is time to get rid of EVMs or else whatever little semblance of representative power the masses have, that too once every five-years, is slated to be doomed.

Polls are no less than an examination paper where everyone has the right to see the answer script.

EVMs have no takers but our CEC seems committed to the sarkari line. The Supreme Court of Germany in a landmark judgement in March 2009 held that “electronic voting is unconstitutional because the average citizen could not be expected to understand the exact steps involved in the recording and tallying of votes by EVMs”.

EVMs are banned in Germany. They have been abandoned in Holland and Ireland. Technologically advanced Japan and Singapore stick to ballot paper polls. But our CEC continues to insist that EVMs are tamper-proof and the best way out for voting.

There have been hundreds of complaints after the advent of EVMs in 2004, but EC seems unconcerned towards over the possibility of ‘insider fraud’ by any of the thousands of authorised personnel having access to EVMs.

These include Indian developers and manufactures of the machines, the vendors supplying the components including the foreign companies who have been assigned the security sensitive job of fusing software on to the ‘masked’ microchips sourced from them, the local officials who have the custody of the machines before and after the elections etc.

The issue came to light again recently when the chief election officer in Madhya Pradesh, Saleena Singh (April 2,) found VVPAT machines dispensing only BJP votes! (The allegation reportedly turned out to be untrue. Editors).

All such hoaxes have been well documented along with field reports in the book, Democracy at Risk, by GVL Narsimha Rao now freely available on internet. The book clearly indicates that there is room for strong suspicion of insider fraud.

This 230 -page book is a minefield of information and should be available in every political party office in India. The book had been the object of discussion in our Parliament too and BJP has castigated it to be just a personal opinion of LK Advani who has written its foreword.

BJP has ready-made answers for everything. It won from the Muslim majority seat of Deoband and pat came its tailor-made reply that Muslim women voted for BJP. Should BJP also know that Muslim women are in other constituencies too?

Out of 86 reserved seats in UP, BJP and its allies won 77. The votes of Scheduled Castes (SC) and Muslims are well above 50% on these seats, hence, Jatavs – the traditional vote bank of BSP – presumably voted for BJP. This is where the alarm bells rang for Mayawati.

It is high time that elections are made fool-proof where confidence and transparency for every citizen is guaranteed. Even VVPAT is not enough as my submission is that EVMs should have two-prints, one deposited with CEC and the other provided to the voter, with an assigned number duly stamped and signed by the presiding officer, just like how it happens in a bank where a receipt is given on submitting an amount.

My vote is my trust and is like my bank account. All political parties should unanimously put up a joint representation to CEC to stop elections in phases too as given the onslaught of social-media online media blitzkrieg and a fight for TRP by news channels the hapless masses are left susceptible to any kind of polarisation.

These days elections have become a month long business. We citizens can wait for a day or a two for results to be declared after manual accounting of every vote.

Peoples trust is at risk. The whole project of voting is becoming a humbug. People’s confidence in the system needs to be restored and this is what needs to be the prime objective of CEC, particularly when 'election hacking' has gone commercial as an article by an Israeli writer Yael Even Or in Tablet Magazine: Did An Israeli Company Hack Zimbabwe Elections? That says it all.

Exodus of Muslims shameful, says UP Minorities Affairs Minister; orders probe

UP’s Minorities Affairs Minister, Baldev Singh Aulakh has ordered a detailed probe from the Sambhal district administration about the exodus of Muslims from Nandrauli village in Sambhal district.

Muslim families fled the village after they were attacked by local Hindus and their houses burnt down in reprisal for a Muslim man’s elopement with a married Hindu woman on May 10.

While talking to the media, the minister said the chief minister has issued clear instructions that there should not be any exodus of any community from any district in the state.

“The culprits should be punished because the exodus of any community from a village is a shameful act,” he said. He also promised necessary action once the report is in.

Meanwhile, Iqbal Mehmood, six-term MLA from Sambhal said the issue will be raised in the state Assembly.

Muslims who fled the village had a harrowing time before finding shelter elsewhere.

“Taking our daughters with us, we ran for six hours into the jungle, to escape the rioters. They followed us on bikes and searched for us through the night,” recalled Yasmeen, a resident of Nandrauli village. It is her son who has allegedly eloped with a married Hindu woman.

“The families which have fled have taken shelter in adjacent towns and cities. They have refused to return and rejected the appeal of Badaun MP Dharmendra Yadav,” Yasmeen told the media.

Sambhal Superintendent of Police, Ravi Singh confirmed that a few Muslims from the village have taken shelter with their relatives in neighbouring villages but insisted there was no exodus. “They will be back to their houses once normalcy will returns,” he added.

Badaun MP Dharmendra Yadav from the Samajwadi Party has appealed to the Muslims to return to their village but those who have fled are reluctant to do so.

Sagir Ahmad of Nandrauli village said that the way persons of the other community struck the Muslim houses in the presence of cops created a fear among the minority community members.

Meanwhile the police administration has suspended the cops who failed to control the situation on May 10, and seven trouble-makers and the youth who had eloped with the woman have been arrested, reports the New Indian Express.

Attacks on Dalits in UP: Valmikis say ‘farewell’ to Hinduism, threaten to convert to Islam

Agitated over growing attacks on Dalits across several cities of Uttar Pradesh, the president of the Bharatiya Valmiki Dharam Samaj, Lalla Babu Dravid has said 500 of its members would be converting to Islam.

The Times of India reports that dozens of members of the Valmiki community took out a procession to immerse the idols of Rama, Ganesh and other Hindu gods into the Ramgunga in Moradabad on Saturday. The procession was intended to be a symbolic farewell to Hinduism.

The protestors raised slogans against the BJP and declare they will help rebuild the Babri mosque.

Bajrang Dal activists who tried to stop the procession were outnumbered.

“Incidents of attacks on Dalits have increased after Yogi Adityanath has taken over. Dalits have been targeted in Saharanpur, Sambhal, Moradabad, Meerut. The perpetrators are being shielded by the government,” Dravid told the Times of India.

Dravid also alleged that Dalits were being boycotted in several villages.

Moradabad’s BJP MLA, Ritesh Gupta, told the Times of India: “Its their constitutional right to embrace any religion. But allegations against Dalit atrocities are baseless.”

Gupta alleged that Dravid is trying to give a political colour to the issue after the BJP refused to shield his son Vishal who s wanted by the police in a recent firing incident.

Arrest Killers of Pehlu Khan, Drop False Cases: Sons Azmat and Rafiq Khan

The sons of the deceased Pehlu Khan and injured Azmat Khan and Rafiq meet IG, Jaipur Range on May 13, 2017. They demanded the immediate arrest of the accused named in the FIR and a closure to the false cases against them of cow smuggling.

The sons of the deceased Pehlu Khan Irshad and Arif along with seriously injured Azmat and Rafiq, all survivors of the attack that took place at Behror by so called Gau Rakshaks on 1st April, 2017 killing Pehlu Khan, met the IG of Jaipur Range Hemant Priyadarshi under whose supervision all the 6 FIRs related to alleged cow smuggling and lynching in the name of the cow will be investigated by the new IO Mr. Ram Swaroop, Addl SP Kotputli.

They thanked him for transferring the investigation out of Alwar and Behror to Jaipur district with him supervising and also demanded that the false cases of cow smuggling lodged by the police FIRs number 252 / 2017 and 253 / 2017 be fairly investigated and closed so that the false charge and stigma of cow smuggling be removed from them forever and they also demanded that the 6 persons named by Pehlu Khan in FIR number 255/2017, be arrested at the earliest and charge sheet filed.

They all repeatedly reiterated the fact that they were genuine dairy farmers, and their whole region survived on Farming and Dairying. So with an absolute pure intent of selling milk they bought the cows. Each of them also stated that past records of selling milk can be sought by the police if they had any doubt on their intent of buying cows. They also stated that they were attacked simply because they were Muslims.

Seriously injured 25 year old Azmat Khan a multi lingual language expert, with the ability to read and write Arabic, Persian, Urdu, Hindi and some English, told the IG that had the local police come on time Pehlu Khan would have been saved and he would have not have had serious injuries in his spine that it was difficult to walk and stand and sit. He also told the IG that had the local hospital referred them to a better hospital in Jaipur or Gurgaon probably Pehlu would have been alive.For his own treatment he went to AIIMS where the doctors had advised him complete bed rest. RAfiq talked about two of his ribs being broken and his nose being broken, and since he had no money he could not go to any hospital and was healing on his own. He also added that he had gone to buy a buffalo but since his money was insufficient he did not buy any milch animal and was taking a lift back with Pehlu and others when this attack happened. Money from his pocket was grabbed by the gau goondas and he lost 25,000 rs, Irshad told the IG that he could not getover the fact as to how his father was beaten so brutally in front of their eyes and they could not do anything as they too were being beaten. He also said that they were carrying the cows as is the requirement and the vehicles could be measured to know whether they had violated the law.

All four of them also presented the Rajasthan High Court judgement which granted them anticipatory bail on the 3rd of May in the FIR numbers 252 and 253/ 2017

The IG assured them of fair and just investigation. He also told them that they had transferred all the FIRs including FIR number 254/2017 and 256 / 2017 and 257/ 2017, which were of the 11 other people caught by the local goons at Behror that day under the cow smuggling law. They were also put in jail. These people were from close to Nuh too.

The delegation that met the IG included human rights worker Maulana Hanif from Alwar, Hussain Khan the Uncle of Pehlu Khan from Jaisinghpur, Nuh and Kavita Srivastava, President, PUCL Rajasthan, Sumitra Chopra, CPIM, Jiapur district Secretary and BAsant Haryana, coordinator Rajasthan Nagrik Manch.
