You cannot have surgical strike against people: Supreme Court to Modi govt

Narendra Modi government today surpassed a major legal hurdle after the Supreme Court refused to stay its notification demonetising Rs 500 and Rs 1,000 currency notes but told it to reduce the inconvenience of the people, saying “you cannot have surgical strike” against them.

“You (Centre) can have a surgical strike against blackmoney but you cannot have surgical strike against the people of the country,” a bench comprising Chief Justice T S Thakur and Justice D Y Chandrachud said, pointing to the long queues at banks and ATMs.

“Carpenters, maids, vegetable sellers are dependent on cash. Are you capable of reducing their trauma? Your aim is to wipe out blackmoney but people are traumatised standing in queues for hours doing nothing,” the bench said.

“They (Centre) call it surgical strike. You (Kapil Sibal appearing for a petitioner) call it carpet bombing. The object of such measures is against the people hoarding cash,”it said.

While observing that fighting the blackmoney menace was a “laudable” step, it asked the Centre to “consider taking steps to ease the pain of the common people” and also consider raising the limit of cash withdrawals.

“Why can’t it be raised to a reasonable level so that there is less number of people standing in the queue,” the bench said, adding that the inconvenience part has to be looked into.

The government told the apex court that the situation was being constantly monitored at the highest level and just now, it has been decided that the banks would allow from today the withdrawal of Rs 50,000 per current account per week and the facilities would also be available to companies.

The apex court did not issue notices to the Centre or the RBI and asked them file a comprehensive affidavit detailing steps taken so far and other proposed measures to ameliorate the harassment and inconvenience caused to citizens due to demonetisation of the high value currency notes.

 

The government, represented by Attorney General Mukul Rohatgi, came fully prepared to defend its ambitious step aimed at curbing blackmoney and counterfeit currency used in financing terror and extremist violence saying the target was to “catch the big fish” which the previous governments could not do in last 50 years.

The bench concluded the day’s hearing by asking the Centre and the RBI to be open to suggestions from various stakeholders and posted the matter for further hearing on November 25 of four PILs questioning the November 8 demonetisation notification.

“Two lakh ATM machines could not have been re-calibrated in advance to be in tune with the new notes as the cat would have been out of the bag,” Rohatgi said, adding that “secrecy is the key to such actions”.

The Attorney General said there were approximately one lakh branches of various banks and two lakh ATMs besides the post offices across the country to dispense cash to the people and restriction on withdrawal was there to ensure that the money be paid to maximum number of people.

He responded to the submission of Sibal by stating that the senior Congress leader was advancing arguements on “complete misconception” that demonetisation was against RBI provisions.
When Rohatgi said that economic policy matters should not be interfered with by the courts, the bench responded saying “We will not interfere with the economic policy of government, but are only bothered about the hardship caused to people”.

Sibal, appearing for one Adil Alvi, said he has also challenged the constitutional validity of the notification as the provision of the RBI has not been complied with.

He referred to section 26(2) of RBI Act and said the government was not authorised to demonetise all series of currency notes of high denominations in one go.

There has to be a legislation if the government wants to demonetise the entire series of Rs 500 and Rs 1,000 currency notes, Sibal said, adding that in 1978, a law was brought to demonetise the currency notes of particular denominations.

Sibal then highlighted the inconvenience faced by the common people in remote areas like Bastar in Chhattisgarh, Uttarakhand, Himachal Pradesh and northeastern states in getting their own money from banks and ATMs and said it was a “surgical strike against the common man.”

“How can there be a cap in withdrawing my own money, which is also taxed,” he said and referred to the promise written on a Rs 500 currency note.

He said that 11 people have died so far and private hospitals are not taking cash for treatment.

“Government says it is a surgical strike on black money.

It is a carpet bombing on the common man,” Sibal said.

Independent legislator and mentor of newly-formed Goa Forward Party (GFP) Vijai Sardesai has criticised the ruling BJP and Prime Minister Narendra Modi over the “chaotically implemented” demonetisation move, saying why are no BJP leaders seen in queues outside ATMs.

Kicking off the party’s campaign ahead of the Assembly polls slated early next year, the Independent MLA from Fatorda also accused Modi while addressing a rally in Margao yesterday of facilitating “complete dilution of ‘Goanness'”.

Slamming BJP and Modi over the “chaotically implemented” demonetisation move, Sardesai asked: “How come no BJP leader is seen in queues in front of ATMs of all banks in the state?”

 

He said the time has come to protect the interests of the local residents of Goa.

“Goa has had enough of nationalisation. Now it is time to usher in ‘Goanisation’ to protect ‘Goenkarponn’ (Goan-ness),” he said while referring to the Centre’s reported move of nationalising six rivers in the state, which the GFP had earlier criticised as the “worst catastrophe awaiting Goans”.

During the event, Monica Dias, general secretary of All India Mahila Congress, joined the GFP. The party that was formed six months ago has been trying to cobble up a secular alliance ahead of the state polls.

Sardesai also alleged that the BJP has put Goa on a “fast-track sale”.

“Modi has intentionally sidestepped the Goa special status issue to facilitate complete dilution of ‘Goanness’ through BJP government’s ongoing policies like Investment Promotion Board, which do not protect the interests of the state or its ethnic population.

“The burden of price rise and the debt-ridden economy of the BJP government will be carried forward to the next government,” he said.

Making a strong pitch for sustainable development of the state for the benefit of Goans, Sardesai promised that the GFP would make amendments to the state laws.

“The amendments would ensure that businesses in the mining and tourism sectors, which form the backbone of the state’s economy would henceforth have to compulsorily involve a Goan as a partner to do business in the state,” he said.

The legislator also called for enactment of the Goa Sound Act by replacing the Madhya Pradesh Control of Music and Noises Act, which he said was seen as a “deterrent” for the wedding and entertainment industry in the state.

Sardesai cautioned Congress of “earthquakes” within the party fold due to the “failure” of its leadership in combating the ruling dispensation in the state.

He said he was committed to an alliance of all opposition forces in the state “as the public sentiment is in its favour”.

Kejriwal launches blistering attack against Modi, says his name featured in black money list

Delhi chief minister, Arvind Kejriwal, has made sensational allegations against Prime Minister Narendra Modi accusing him of having accepted black money in the past.

Speaking during an emergency session of Delhi assembly, Kejriwal said, “This is for the first time in independent India that a prime minister’s name has cropped up in the list of black money.”

Kejriwal presented documents in the assembly to substantiate his claims adding that the income tax authorities had found a piece of papers during raids at Sahara Group in November 2014.

He said, “They found more than Rs 130 crore during the raid and also discovered a piece of paper from one room, which had Narendra Modi’s name.”

Kejriwal also alleged that, according to an appraisal report by tax authorities, one entry by Shubhendu Amitabh from Birla Group had mentioned Rs 25 crore against Gujarat CM’s name.

This, Kejriwal said, was after the income tax raids in October 2013, six months before the BJP formed government at the Centre.

Kejriwal vowed to reveal more papers, which, he said, will conclusively indict PM Modi in black money case.

His deputy Manish Sisodia said that what Kejriwal revealed today was originally meant for September. In September, the Kejriwal government had announced its intention to reveal what they said was ‘the biggest expose of independent India.’

They had to postpone their plan in view of tension at the LoC.

She said, “I’ve found the mother our prime minister had talked about in Japan. She has denied that her son never deposited Rs 2.5 lakh in her account. She also wants Modi ji to take action against her son for depositing black money in her account.”

She also highlighted how BJP’s West Bengal unit had managed to deposit Rs 1 crore on the day Modi was to make the announcement on demonetisation.

Another AAP MLA, Rajesh Gupta said, “Woh (1975) nasbandi ki emergency thi aur ye notebandi ki emergency hai.”

Kejriwal said, considering the hardship being faced by people, the Delhi government has decided to deploy civil defence volunteers who will provide citizens queueing up outside banks and ATMs with water and refreshments, while also assisting them with paper work.

Sticking to his demand that demonetisation be rolled back, the AAP chief lashed out at Modi, Finance Minister Arun Jaitley, saying the Centre has lost “all sense of proportion due to lack of any concrete plan in executing the scheme.”

“The situation is just the opposite of what the Prime Minister said. The poor are not sleeping. They are spending nights outside banks. Only Modiji’s friends are having good sleep. He has made the poor drink poison in the name of strong tea ‘kadak chai’,” Kejriwal said.

प्रधानमंत्री नरेंद्र मोदी द्वारा नोटबंदी के बाद लोगों में उनके खिलाफ गुस्सा है। ऐसे लोग सोशल मीडिया पर पीएम मोदी के खिलाफ गुस्सा जाहिर करने में पीछे नहीं हट रहे।

रधानमंत्री नरेंद्र मोदी द्वारा नोटबंदी के बाद लोगों में उनके खिलाफ गुस्सा है। ऐसे लोग सोशल मीडिया पर पीएम मोदी के खिलाफ गुस्सा जाहिर करने में पीछे नहीं हट रहे। ट्विटर पर सोमवार (14 नवंबर) को #नोट_नहीं_PM_बदलो टॉप ट्रेंड में था। लोग इसपर पीएम मोदी की सरकार से परेशान होकर उन्हें हटाने की बात कर रहे थे। लोग तरह-तरह से अपनी बात कह रहे थे। किसी ने लिखा, ‘मोदी जी जनता के दुःख में इतना रोये की गोवा, बेलगाम और पुणे के बीच में 3 बार कपड़े बदलने पड़े’, दूसरे ने लिखा, ‘मोदी को समझ नही आ रहा कि बैंक की लाइन मे लगी भीड़, केवल भीड़ नही है, लोग हैं, और उनके सब्र के बांध बहुत मजबूत नहीं होते हैं’, तीसरे ने लिखा, ‘किसी के घर में शादी रुक गयी, किसी के घर में मौत हुई, किसी का इलाज नहीं हो रहा, कोई लाठी खा रहा है, कोई भूखा सो रहा है’ तो कोई लिख रहा है, ‘लाइन में लग के जिस PM को चुना, आज उसी PM की वजह से भूखे प्यासे लाइन में लगे हैं।’

गौरतलब है कि आठ नवंबर को पीएम मोदी के ऐलान के बाद से 500 और 1000 के नोट बैन हो गए। इसके बाद से बैंकों और एटीएम से खुल्ले पैसे निकालने और अपने पुराने नोट जमा करवाने के लिए भीड़ है। पीएम मोदी, वित्त मंत्रालय और रिजर्व बैंक के समझाने और तरह-तरह के दिशा-निर्देश जारी करने के बावजूद बैंकों और एटीएम से भीड़ कम नहीं हो रही। आरबीआई ने रविवार को लोगों से अपील भी की थी कि उन्हें चिंता करने की जरूरत नहीं है बैंक के पास काफी करेंसी है। साथ ही साथ लोगों ने घर में पैसा जमा करवाकर ना रखने का निवेदन भी किया गया था।
