Bhopal: For over 30 years, Abdul Jabbar struggled to get medical and economic rehabilitation for the victims of Bhopal Gas Disaster of 1984 which had claimed an estimated 20,000 lives over the years and afflicted over a lakh of persons with a variety of ailments. Whatever has taken place in the two fields is mainly due to his efforts. But he left this world on Thursday night (November 14) without his own medical and economic rehabilitation.

Himself a victim of the world’s biggest industrial disaster, he was diabetic, had partially lost his eyesight (treated in a Tamil Nadu hospital with the funds collected through the efforts of senior journalist Hartosh Singh Bal) and was also suffering from heart and kidney problems. Sometime back his left foot was injured in an accident and the injury had developed gangrene. He was admitted to Kamla Nehru Hospital meant for the gas victims. Later he was taken to the so-called super speciality Bhopal Memorial Hospital and Research Centre (BMHRC) which was constructed under the direction of the Supreme Court to provide specialised treatment to the gas victims.

Senior journalist and a close friend of Jabbar’s Aashutosh Shukla wrote in the Times of India two days ago that the two hospitals could not provide the required treatment to Jabbar. Shukla quoted Chief Medical and Health Officer (CMHO), Gas Relief, Ravi Verma as admitting to a shortage of expert doctors in the various Gas Relief hospitals and adding that Jabbar had been admitted to a private nursing home and the total expenditure on his treatment would be borne by the Gas Relief Department.

Whenever there was another programme like holding a rally or undertaking a march, the survivors made their own contributions to defray the expenses. This all had a disastrous effect on his family life as well as on his personal health.

Of the dozens of voluntary organisations which had sprung up in Bhopal in the wake of the tragedy, only Jabbar’s Gas Peedit Mahila Udyog Sangathan (BGPMUS) remained active and completely dedicated to the victims’ rehabilitation. When Jabbar was not busy finalising a petition or appeal to seek relief for the victims, he was running around Gas Relief hospitals or dispensaries pleading the case of some survivor who had earlier been turned away. At other times he was trying to find some soft employment for those whose physical strength had been shattered by the effect of the MiC gas inhaled when the tragedy had occurred. His assistance had been sought by almost every one of the survivors either for getting medicine or for processing his papers for compensation or for pleading with a claims court judge who had rejected the papers on flimsy grounds.

Jabbar was shy of seeking funds. The advice by his friends to create a corpus (for which many of his well-wishers had expressed their eagerness to contribute) was always dismissed by him with cynicism. His belief was that fund collection led to various ills. Matters were arranged on ad hoc basis. Some public spirited advocates, Prashant Bhushan mainly, helped in preparation of petitions and appeals and some friends contributed for the paper work.

After the Gas Relief hospitals had failed him and he was admitted to the private nursing home, the State Government had become aware of the gravity of his condition and taken the initiative to shift him to Asian Heart Institute, Mumbai, for better medical care. While the logistics were being worked out, Jabbar had two massive heart attacks, one after the other and that was all.

Some of his friends had, meanwhile, decided to seek public contributions to support his family comprising his wife Sayra and three young children. An account was also opened in a nationalised bank in Sayra’s name and an appeal was issued for contribution. With Jabbar’s death, it gets urgency. With Congress candidate Kantilal Bhuria’s victory in Jhabua (ST) Assembly constituency in Madhya Pradesh, the dream of BJP leaders Gopal Bhargava and Kailash Vijayvargiya has been shattered. The by-election in Jhabua was necessitated by the resignation of BJP’s G S Damor on his election to Lok Sabha early this year. Jhabua had elected a BJP candidate in 2013 and then in 2018 also.

The BJP had made it a prestige contest and was determined to retain Jhabua seat at any cost. The party fielded Bharatiya Janata Yuva Morcha (BJYM) leader Bhanu Bhuriya in the by-election and the party’s State unit’s top brass campaigned for him.

The Congress chose veteran party leader and former Union Minister Kantilal Bhuria to wrest the seat on which BJP’s Damor had defeated Kantilal Bhuria’s son, Vikrant Bhuria (Congress), in the November 2018 Assembly elections. For Congress, winning in Jhabua was not only a prestige issue but a necessity also. Congress does not enjoy a majority in the Assembly. So, every MLA counts. Kantilal Bhuria’s victory does not give it an absolute majority to the party but takes it to the half-way mark in a House of 230.

BJP leaders, particularly Leader of Opposition in the Assembly Gopal Bhargava and the party’s national General Secretary Kailash Vijayvargiya, had told the Jhabua voters at campaign rallies that the victory of the BJP candidate would end the Congress ‘misrule’ in the State. Bhargava had gone to the extent of announcing that if the BJP candidate won in Jhabua, the Congress government of Kamal Nath would collapse and the BJP government led by Shivraj Singh Chouhan would take its place.
 

Kamal Nath’s strategy paid. Kantilal Bhuria was elected with the biggest ever margin of 27,804 votes. Out of the total 1, 72,354 votes polled, he received 96,155 votes as against Bhanu Bhuriya’s 68, 351. There were three intendents also but they did not get many votes, in fact, with 3088 votes, NOTA emerged at the third place.

The Congress campaign in Jhabua was handled by Chief Minister Kamal Nath himself. He decided who of the party leaders and ministers should address the election rallies there. More importantly, he had mollified dissident party leader Xavier Meda who had contested as an independent in the last Assembly elections and made a substantial dent in the Congress vote causing the defeat of Congress candidate Vikrant Bhuria and victory of BJP’s Damor. This time Meda appeared to have worked hard for the victory of Kantilal Bhuria.

Kamal Nath’s strategy paid. Kantilal Bhuria was elected with the biggest ever margin of 27,804 votes. Out of the total 1, 72,354 votes polled, he received 96,155 votes as against Bhanu Bhuriya’s 68, 351. There were three intendents also but they did not get many votes, in fact, with 3088 votes, NOTA emerged at the third place.

Bhuria is quite senior in the organisation. He has been five times MP, a Union Minister and the PCC chief as well. He is, however, a person of mild manners, neither demanding nor assertive and should be happy with whatever Kamal Nath decides for him — a berth in the cabinet or the post of PCC chief which Kamal Nath was asked to hold till a new incumbent was found.

He was PCC chief when a by-election for Jabera Assembly constituency in Damoh district was held in 2011. It was a Congress seat held by former Minister Ratnesh Solomon whose death had caused the by-election. The Congress fielded his 26-year-old daughter Tanya Solomon, a medical practitioner. The party, under the leadership of PCC chief Bhuria, worked hard. Still, Tanya lost. A rattled Bhuria burst out that he had received reports about a senior party leader having sabotaged the party prospects. Not only that, Bhuria also stated that some Congress leaders had for five or six years been working in conjunction with the ruling BJP leaders for furthering their own interests and jeopardising the interests of the Congress party. He promised that action would be initiated against them. He could not muster enough courage to initiate action against them.

Supreme Court was told on August 16 that National Conference leader and member of Lok Sabha Farooq Abdullah had been detained and was not allowed to move freely. It came during the hearing of a petition moved by MDMK chief Vaiko seeking a direction to the Union Government and Jammu and Kashmir administration to produce Farooq Abdullah before the Court. Farooq was said to have been detained, along with other political leaders, as the Modi government had moved to abrogate Article 370 of the Constitution granting special status to Jammu and Kashmir in early august. He did not attend even the monsoon session of Lok Sabha.When some members had expressed concern at Farooq’s absence in the House, Union Home Minister Amit Shah had told Lok Sabha on August 6 that the veteran Jammu and Kashmir leader was perfectly fine and was staying away out at his own free will. He was neither under house arrest nor was he detained. “I am saying it for the fourth time, and I have the patience to say it for the tenth time; Farooq Abdullah has neither been detained nor arrested,” the Home Minister had asserted.

If what the Supreme Court was told on September 16 is true, Amit Shah’s August 6 assertion on Farooq Abdullah in Lok Sabha amounts to a gross contempt of the House, mainly on two counts: for willfully and illegally preventing a member from attending the House in session and for deliberately and willfully misleading the House with a false statement. A sad thing, however, is that the Opposition has not yet shown the signs of recovery from the jounce it had received with Narendra Modi’s coming to power in May 2014. There were several occasions when it failed to raise the issue either in the courts or in Parliament.
For instance, Narendra Modi was first sworn in as Prime Minister on May 26, 2014. The same day he got twice retired bureaucrat Nripendra Misra appointed as Principal Secretary to Prime Minister. Misra was not eligible for any appointment in the government on that day. But President Pranab Mukherjee obliged Narendra Modi and made the appointment in flagrant violation of the existing provisions of the law. Only the next day, the Modi government drafted an Ordinance. President Pranab Mukherjee again obliged Modi and promulgated the Ordinance removing illegality in the appointment of Nripendra Misra retrospectively.
It was not challenged in a court of law and the legality of the manner of appointment of Misra could not be tested. The Opposition was perhaps too stunned by Modi’s unexpectedly massive win. During the first session of Parliament, Modi went to Arunachal Pradesh and announced at a public rally a Rs 58,000 crore package for development of the North-East. Announcing a major decision outside when Parliament is in session clearly amounts to contempt of the House. In this manner went on the defiance of rules and procedures by Modi and the Opposition continued to be afflicted with inertia. There is little sign of it being recovered.
