Three years have passed since Comrade Pansare’s murder. I still remember the tremors of that morning’s violence. Sitting with his hand resting on the pavement, just across the house, Comrade Pansare was trying to say something in spite of the immense pain and bleeding that he was experiencing. I can still remember how warm his hands were as we—the children and I—held him with anguished cries. The bitter saga that followed is still not over.  Resorting to the legal recourse to bring the murderers to justice is, undoubtedly, the right way to go. But, what is justice? Will it be truly served? Several such questions remain unanswered even today. Experiencing the murder of a close family member and accepting the journey thereon towards a larger, collective, intellectual, and political fight has proved to be most rational today.

The protests against the recent spate in the murders of rationalists, and the fight for justice, have not ended yet. Across the country, in various places and through various forums, people are now talking and deliberating overthe murders and the challenges faced by the rationalists. People who stand by the democratic ethos and values are coming together. It seems that only writers and intellectuals are wary of the regressive changes taking place in the country. They are able to gauge the possible challenges that these will bring and unrest that they will cause. This is why, after the murder of Professor Kalburgi, they started openly expressing their anxieties and dissent. The whole “award wapsi” movement, of returning the awards, was done to register their dissent.  Recently, campaigns like “Not in My Name” have also come up. These socio-political developments in the country will only keep growing. It is when such movements and campaigns gain momentum that there will be  a revolution.

Recently, there has been an increase in the number of threats, attacks, and killings of progressive writers, poets, thinkers, and anyone else who opposes religious bigotry and supports cultural diversity and multicultarism. There is an entire horde of people trolling them on social media platforms. There are large scale hate campaigns meant to divide people along the lines of caste, religion, language, and race. The Sangh Parivar and Bharatiya Janata Party (BJP) leaders and ministers openly make statements that go against the democratic and secular values of our Constitution. Interestingly, all this is being done under the garb of nationalism. On one side, geneology experts are stating that, today, no race is superior to the other; on the other side, slogans of “pure hindu” have become a political tool.  There is no country today that can claim geographical integrity, racial and cultural unity, and common history. Because of years of colonialism, multiple wars, and migration most countries today comprise of multiple races and communities.

Geographical and economic unity and a common history are some of the factors that unify India as a nation. Our shared history, especially, is one of the strongest and the most powerful bonds. For the past 10,000 years, the Aryans, Mongolians, Christians, Shakas, Greeks, Huns, Arabs, Persians, and Turks; people from  different continents like central and Western Asia, and Western Eurasia; from countries like Tibet and Burma, have migrated and settled here. People came here, got along and mixed with the people already living here. For years, saints and walis, Sufi saints created an atmosphere of tolerance, dialogue, and mutual understanding. While the Hindu and Muslim kings were fighting for political supremacy, the common people of the country were living together in harmony. While the Muslims were the last to rule the country before the British, under the colonial rulers, even Muslims were exploited and discriminated against under the colonial rule. In fact, Muslims were also a part of our freedom struggle. Our philosophy, painting, architecture, music, cuisine, dressing, festivals; people like Kabir, Guru Nanak, Akbar, Amir Khusro, Mirza Ghalib; the Bhakti and Sufi movement; the Urdu language, all these influenced and informed each other. They reflect our rich history of syncretic cultures, what some have called the Ganga-Jamuna culture. So, although they were unable to stop the Partition, our leaders decided to create a secular and democratic republic. The principals that guide the Constitution, in fact, are these very principals of democracy and secularism. For instance, religion and political structures were separated; special provisions were made to protect the rights of minority communities under Article 29.

This country has seen Muslim, Sikh, and Christrian terrorists and fundamentalists. We have seen several youth take part in the post-partition violence of 1947, in the Kashmir insurgency, in the Khalisthan movement, in Naxalism, in the insurgency in the North-Eastern states, and several other violent movements. It is important to look beyond mainstream view, which sees these movements as threats to the country’s integrity, or as disruptions in law and governance. Instead, we should see these movements through the lens of humanity. Such efforts, to a certain extent, have been made. One learning that has come out of this is that violence is not the answer to our problems. But, when most Hindus, on being provoked through these hate campaigns, become communalised and turn to violence, then humanity and compassion take a back seat And it is women, innocent minorities, dalits, and rationalists who have to bear the brunt of this. Innumerable Mohsin, Junaid, Akhlaq, dalit brothers and sisters, in Una and other states, have been subjected to this violence. While the majority, at 82%, of those killed by the gaurakhshaks were Muslims, we must remember that the rest 18% were Hindus. The situation in our country is so volatile that a rationalist writer, Sanal Edamaruku, has had to take refuge in Finland because his life is at threat here.

This is not just about the killings of those who dared to question the ideology of the ruling government. It is an attack on the constitutional values, secular ideology, and the democratic system that people like Dabholkar, Pansare, Kulburgi, and Lankesh were trying to protect. They dared to challenge the Sangh Parivar’s agenda of making India a Hindu nation. They were encouraging people to think, to question, and to dissent. It is important that, as rationalists and as those who stand against violence, we recognise and acknowledge that these murders were politically motivated.

What India’s first Home Minister, Sardar Vallabhai Patel, wrote in a letter to Shyama Prasad Mukherjee after Gandhi ji’s death remains relevant even today. He wrote, “Our reports on RSS and Hindu Mahasabha show the evidence that the actions of these organisations, especially those of the RSS, led to the creation of an atmosphere in the country that made such a terrible tragedy possible.” (18 July, 1948. Sarveshwar Dayal Saxena, a famous hindi poet, in his poem, “Nation is not a Map Drawn on the Paper,” questions the indifferent people living in today’s restless and violent times.

यदि तुम्हारे घर के एक कमरे में आग लगी हो
तो क्या तुम दूसरे कमरे में सो सकते हो ?
यदि तुम्हारे घर के एक कमरे में लाशें सड़ रहीं हों
तो क्या तुम दूसरे कमरे में प्रार्थना कर सकते हो ?
 
If your house is on fire,
Can you sleep in the other room?
If bodies are rotting in one of the rooms of your house,
Can you pray in the other room?
We are also faced with the same questions today. Can we breathe freely in an environment filled with hatred and violence? Can we live happily as human beings? Violence or humanity; hatred or love and compassion; superstitions or rationality; these are the choices before us. Are we going to leave behind a rich, cultural life for our next generation or a monotonous one? Democracy or Hindu Pakistan? We need to choose.
To ask in poet Balli Singh Chima’s fashion,
 
तय करो किस ओर हो तुम, तय करो किस ओर हो ।
आदमी के पक्ष में हो, या कि आदमखोर हो ।।…

Emotions were high as were the resoluteness of all of gathered at 9 a.m. to recall that awful day, a year ago when Comrade Pansare was shot at. Over 500 activists and students assembled along with Umatai Pansare, the rest of the surviving family and myself at 9 a.m. this morning. We met in remembrance and struggle.

The march then proceeded to Bindu chowk with revolutionary songs being sung along the way. Umatai Pansare and others garlanded the statues of Dr Babasaheb Ambedkar and Jotiba Phule.

“The long march to justice and equality that was severely jolted with the killing of Mahatma Gandhi, and then again with the shooting of Comrade Govind Pansare, a year ago will continue till the ideology that kills is rooted out,” Bhai ND Patil said here today while talking to the media.

Severely criticising the lack of political will of the present Maharashtra government in getting to the bottom of the conspiracy that killed Govind Pansare, ND Patil said, “the present government does not have the will to nab the killers.”

Finally the gathering that had by now grown to over one thousand met at the Prince Shivaji Maratha Boarding College, Govind Pansare’s alma mater. The elderly principal of the Prince Shivaji Maratha Boarding College, DB Patil, who was a long time colleague of Comrade Pansare was emotional in his recollections. Over one thousand students of the school and college participated in the remembrances.

It is the slow pace of the struggle for justice that is enervating and draining. The Bombay High Court, even at the last hearing of the case, used harsh words, calling the attitude of the government and the investigating agencies “a miscarriage of justice.” Yet the matter drags on. Sameer Gaikwad, the sole man arrested, who is still in jail has approached the High Court for a transfer of the trial out of Kolhapur. We, on the other hand, have asked the High Court to direct that the Special Investigation Team (SIT) appointed in this case (with its chief in Pune, one investigating officer in Pune, another in Kolhapur) be directed to only deal with this case and not with all and sundry other responsibilities. This prayer is yet to be heard out.

Meanwhile, in the trial court, the bail for Gaikwad has been rejected at the last hearing. I (Megha Pansare on behalf of the family) have made an application for the Ballistic Report to be sent to Scotland Yard. (There were reports of the similarity of source and kind in the bullets used to kill Dabholkar, Pansare and Kalburghi). The accused on the other hand has asked to be released from his isolation cell. The judge in the trial court at the last hearing has asked for a report from the jailer on the matter of Gaikwad’s state of mental health.

Megha Pansare takes on MOS home, Kiren Rijiju

 
Bullet cartridges in the three killings suggest a common set of killers, accused Sameer Gaikwad and Rudra Patil likely to be commonly involved; Sanatan Prabhat the organ of Sanathan Sanstha has ‘marked’ out Dabholkar and Pansare as ‘targets’ yet the union home ministry tells Parliament that there are no connections?
 
Presently, the writ petitions of the Dabholkar and Pansare families pressing for fair investigation have been clubbed together by the Bombay High Court after observing the similarity in both the murders. The Sanatan Sanstha, the organization believed to be behind the killings, has even published a photograph of Dabholkar, marked over with a red cross. One Sanatan Sadhak, Malgonda Patil, who was killed while trying to execute a bomb blast in Madgaon, Goa had also written an article in Sanatan Prabhat, articulating the need to eliminate Dr. Narendra Dabholkar. This Malgonda Patil happens to be a cousin of Rudra Patil. The sketch of one of the suspected murderer in the Dabholkar murder case has a striking similarity with the sketch of Pravin Limkar, who is a prime accused in Goa bomb blast case and is on an Interpol red corner lookout notice.
The accused in the Pansare murder case, namely Sameer Gaikwad is a member of Sanatan Sanstha. The members of Sanatan Sanstha have even addressed a press conference in support of Sameer Gaikwad after his arrest.
 
Other revealing facts have come on record in the ongoing writ petition filed by the Pansare family in the Bombay High Court:

  • that, one Rudra Patil, who is also an accused in the Goa bomb blast case and is a member of Sanatan Sanstha, has also some role in the Pansare murder case;
  • that the wife of Rudra Patil is representing Sameer Gaikwad in the court.
  • It has also come on record before the Judicial Magistrate, Kolhapur, dealing with Pansare murder case that Sameer Gaikwad, an accused in Pansare murder case and the absconding Rudra Patil, an accused in Goa bomb blast case are friends and have an otherwise close association and relationship.

 
(According to a report in The Indian Express on December 11, 2015 among the angles of investigation being pursued by the three agencies involved –CBI, Karnataka CID and Maharashtra SIT –  is of the possible involvement of four missing members of the right wing Sanathan Sanstha who are accused in a 2009 blast case in Margao, Goa. The four missing persons — Jai Prakash alias Anna and Rudra Patil, both from Karnataka, and Sarang Kulkarni alias Sarang Akolkar and Praveen Limkar from Maharashtra — have been sought by multiple agencies for over six years. “We tried to find them but were not able to do so. Initial investigations showed that they escaped to Nepal. Sometime in 2014, they were reported to have returned,’’ said an NIA investigator who was a part of the investigations into the 2009 Goa blast plot in which two alleged Sanathan Sanstha men were killed while trying to plant a bomb to disrupt a celebration they were opposed to.)
 
Given all these facts and circumstances, the statement of the union minister of state for home, Mr. Kiren Rijiju made through a written reply to Rajya Sabha (December 3, 2015) that there is no report to suggest any linkage or connection between murders of comrade Govind Pansare, Dr. Narendra Dabholkar and professor Kalburgi is shocking.
 
We, the family members of Dabholkar and Pansare families, have already expressed our disagreement with his statement as it is contradicts the facts on record. We also wish to know on what basis this statement was made by the minister.
 
Now, today, when reports of the forensic analysis of the bullet cartridges found at the scene of all three incidents suggests the probable involvement of a common set of killers, it becomes essential that the home ministry of the union government immediately issues a clarification on the previous statement made in Parliament.

There is a striking similarity in the modus operandi of these three murders. The three murders have long been suspected to be the handiwork of a right wing group opposed to the outspoken and rational views of the three victims who have consistently criticised the irrational practices and beliefs within the Hindu religious system.
 
When the investigating agencies in all three murder cases are closely coordinating with each other, how can it be stated that there is no connection between these three murders?  Tracing the absconding Rudra Patil has become an important task for the agencies investigating these murders. Counsel for the CBI, Rebecca Gonsalves on November 30, 2015, even made a statement in the High Court to the effect that two members of the ‘same organization’ are under scanner and their phone numbers are under surveillance.
 
According to the CBI submission in the Bombay High Court, on November 30, 2015, ninety- five members of ‘a right wing organisation’ were interrogated and their statements recorded. The said organisation was upset with this and therefore made allegations against the investigating Officer, by holding a press conference. The said set of documents has been filed before the Bombay High Court.
 
All this clearly establishes that the investigating agencies are presently examining the role of the Sanathan Sanstha in both the Dabholkar and the Pansare murder cases. The points listed above sketch the close similarity between the two cases. Hence the statement of the minister of state for home, Kiren Rijiju, in Parliament is misleading and not based on facts.
 
Besides the records of the investigation mentioned above, both Dabholkar and Pansare were targets of the Sanathan Sanstha, as revealed by other evidence mentioned above. As only Dabholkar and Pansare cases are being heard by the Mumbai High Court, the High Court has not made any comment on the Kalburgi case and hence this statement does not encompass that murder investigation.
 
We demand that an immediate clarification from the government of the previous statement is made by MOs home, Kiren Rijiju.
