The Gauhati High Court has once again extended all interim orders passed by it and all its subordinate courts and tribunals. The decision was made bearing in mind that the Covid-19 pandemic has yet not abated and therefore the threat to public health remains prominent.
The original order with respect to this was issued on May 10 and then subsequently extended till June 1 and now till June 15. The order also applies to interim bail and anticipatory bails expiring during this period. They too are now extended to June 15. This also applies to sureties given for interim bails.
In an order passed on May 31, the Gauhati HC said, “Considering the unique, unprecedented and extraordinary situation which has presented in various forms in our life and considering the daily surge of cases during the COVID-19 pandemic, which is now in its second wave, a suo motu proceeding was initiated by this Court in the form of present PIL and certain directions were given on 10.05.2021, whereby all interim orders passed by the Gauhati High Court and all other subordinate Courts and Tribunals were extended till 01.06.2021. This included interim bail orders also.”
Noting how there was a consensus about extending the order, the court extended the term of interim orders saying, “We are also of the considered view that under the present circumstances, the order should be extended. Accordingly, the order dated 10.05.2021 is hereby extended for a further period of two weeks i.e. till 15.06.2021.”
