Complaint Filed For Dismissal of Hate Mongering Assam DSP Anjan Bora:
A Guwahati based lawyer Aman Wadud has filed several complaints against hate mongering Assam DSP Anjan Bora who was suspended from service on February 12, 2016 by the Tarun Gogoi government, after a series of hate comments authored by him on Facebook. A day earlier the screenshots of Anjan Bora’s venomous comments were shared by Aman Wadud on his Facebook and Twitter page which went viral.
On January 24, 2016, Bora, a DSP with the Assam Police wrote on his Facebook account that “We should join hands for a Muslim free Hindustan”; again on February 8, 2016 he posted a comment that “Mr.Rafikul Islam congress Kormi tohotor AZAN bonds korim aru tohotor nisina manuh BTAD t bohut Marilu. Bhale bhale Bangladesh gusi ja. Tur mukhot muti dim goria;” In English this translates as , “Mr.Rafikul Islam congress Kormi I will stop your AZAN, I have killed people like you in BTAD. Go to Bangladesh. I will urinate in your mouth goria”.
In his series of complaints Aman Wadud appreciating the prompt action of Commissioner& Secretary,Home and Political Department, stated that “Anjan Bora is a public servant and was holding a responsible administrative post, he claims to have killed people in BTAD. He threatens to stop the Azaan, he openly calls for a Muslim free India. Thus his act amounts to criminal intimidation.
The accused has openly promoted enmity between different groups on grounds of religion, race, place of birth, residence, language, etc., and doing acts prejudicial to maintenance of harmony.”
Aman Wadud further alleges that Anjan Bora is also a drug addict, who has been suspended earlier too. The Guwahati based lawyer goes on to state in his complaint that “The accused has expressed his criminal intent several times and has also confessed about killing people in BTAD. If ever the accused is reinstated to his service he could abuse his power and position. Therefore the accused should be dismissed from his service after the departmental proceedings for the interest of law and order.”
Aman Wadud has filed complaints against the suspended DSP Anjan Bora with the National Human Rights Commission, the Assam State Human Rights Commission, State Police Accountability Commission Assam, National Commission for Minorities, Assam State Minorities Commission and with the Commissioner & Secretary, Home and Political Department, Government of Assam.
This is a copy of the complaint sent to the National Human Rights Commission, Justice Cyriac Joseph, the Acting Chairman:
February 16, 2016
Subject: Seeking dismissal of Anjan Bora, Dy SP, Assam Police Service.
Respected Sir,
I would like to draw your urgent and immediate attention towards an extremely reprehensible and offensive set of action which violates various sections of Indian Penal Code and Information Technology Act by an officer of the coveted Assam Police Service. Anjan Bora, who before suspension was posted as Deputy Superintendant of Police (Dy.SP) 23rd AP (IR) Bn, ManjaKarbiAnglong.
Fact of the case:
That Sir, the accused Anjan Bora, APS, Dy.SP 23rd AP (IR) Bn, ManjaKarbiAnglong has been making reprehensible and deeply offensive statement on social media site Facebook. (Printouts of
screenshots of his profile are annexed as Annexure 1)
That Sir, On January 24, 2016 at 07:01am one Hirok Hazarika posted a pictures of RSS cadres marching in Dibrugarh town with the caption “DiburagarhJila RSS Path Sonsolon”. On January 24, 2016 at 07:12 am, in the said post the accused Anjan Bora posted a comment stating that “We should join hands for a Muslim free Hindustan” (A printout of screenshots of above statement is
annexed as Annexure 2)
That Sir, on February 8, 2016, at 11:27pm one Beda Jyoti Bhuyan uploaded pictures of APCC President Shri Anjan Dutta with a long caption. In the said post the accused Anjan Bora posted a comment stating that “Mr.Rafikul Islam congress Kormitohotor AZAN bonds korimarutohotornisinamanuh BTAD t bohutMarilu. Bhalebhale Bangladesh gusija. Turmukhotmuti dim goria.” (Printouts of screenshots of the above statement are annexed as Annexure 3.)
That Sir, the accused is an Assam Police Service Officer and was posted as DySP 23rd AP (IR) Bn, ManjaKarbiAnglong before his suspension. His words are very alarming because of the very fact that he holds a responsible administrative post. He has threatened directly the entire Muslim community with life and limb. He also goes on to threaten to stop Azan (Muslim prayer call), his
action thus is also contrary to the Constitutional provisions of right to freedom of religion.
That Sir, the accused Anjan Bora is a public servant and was holding a responsible administrative post, he claims to have killed people in BTAD. He threatens to stop Ajan, he openly calls for a Muslim free India. Thus his act amounts to criminal intimidation. The accused has openly promoted enmity between different groups on grounds of religion, race, place of birth, residence, language, etc., and doing acts prejudicial to maintenance of harmony. The accused Anjan Bora has deliberately and maliciously outraged religious feelings of a class of people by insulting its religion or religious beliefs.
That Sir, The Commissioner and Secretary to the Government of Assam, Home and Political Department has put the accused under suspension by its order dated February 12, 2016 for the same offence and Departmental Proceedings has been initiated against him. But to the best of our knowledge the accused is a drug addict and was suspended earlier too. If at all he is reinstated after a brief period of suspension, it will be dangerous and detrimental to law and order. The accused has expressed his criminal intent several times and has also confessed about killing people in BTAD. If ever the accused is reinstated to his service he could abuse his power and position. Therefore the accused should be dismissed from his service after the departmental proceedings for the interest of law and order. ( Copy of the said order dated 12.02.2016 is annexed as Annexure 4)
Therefore Sir, I humbly pray before your kind office to take cognizance of the deeply offensive statements of the accused Anjan Bora, which violates various sections of Indian Penal Code and Information Technology Act, and initiate an enquiry about his claims of killing people in BTAD and direct appropriate authorities to dismiss him from his service.
Sincerely, Aman Wadud Advocate, Gauhati High Court
