Mumbai: Indians will have lesser cash to use come March 2019 and it could spell a doom equivalent to demonetization.
 
As many as 1.13 lakh automated teller machines (ATMs) across the country might shut down by March 2019 owing to the regulatory changes that make ATM operations unviable because of the huge costs involved, the Confederation of ATM Industry (CATMI) said.
 
The regulatory changes include those on hardware and software upgrades, coupled with mandates on cash management standards and the cassette-swap method of loading cash. “These numbers include approximately one lakh off-site ATMs and a little over 15,000 white-label ATMs, the apex body of the domestic ATM industry said in a statement.
 
As per the latest RBI figures, there are about 2.21 lakh installed ATMs in the country. Other estimates suggest there are 2.38 lakh ATMs in the country.
 
ATMs in non-urban areas will be the worst-affected.
 
Closure of the ATMs will impact thousands of jobs and also the financial inclusion efforts of the government, the industry body said in a statement.
 
“A large number of ATMs in non-urban locations may be shut down due to unviability of operations. If this happens, the financial inclusion programme would be severely impacted as millions of beneficiaries under the government’s Pradhan Mantri Jan Dhan Yojana (PMJDY) scheme who withdraw subsidies in form of cash through ATMs may find their neighbourhood ATM shut,” said CATMi in a statement.
 
The industry body warned that this may result in long queues and chaos similar to what the country witnessed when ATMs were not dispensing cash in the aftermath of demonetization.
 
CATMi said that its members, which include ATM managed service providers (MSPs), brown-label ATM deployers (BLAs) and white-label ATM operators (WLAOs), are already reeling under the financial impact caused by huge losses during and post-demonetisation as cash supply was impacted and remained inconsistent for months. The WLAOs have accumulated losses and the compliance costs can result in over 15,000 machines run by them shutting down, the industry body added.
 
“The situation has further deteriorated now due to the additional compliance requirements that call for a huge cost outlay. The service providers do not have the financial means to meet such massive costs and may be forced to shut down these ATMs, unless banks step in to bear the load of the additional cost of compliances,” said the industry body.
 
It added that revenues from providing ATMs as a service are not growing at all due to very low ATM interchange and ever-increasing costs.
 
“In April, the RBI had mandated a minimum net worth of ₹100 crore for service providers and their sub-contractors handling cash management logistics on behalf of banks. It also directed cash vans transporting money to have CCTVs, GPS connectivity, tubeless tyres, hooters and wireless communication systems. Approximately 100,000 off-site ATMs, and over 15,000 non-bank ATMs could shut down,” Livemint reported.
 
According to CATMI, an estimated outlay of about ₹3,500 crore is needed to comply with the new cash logistics and cassette swap method. “These requirements were never anticipated by the industry participants at the time of signing contracts with the banks. Many of these agreements were inked four to five years ago,” the statement said.
 
“The ATM industry in India has reached a “tipping point”, and unless ATM deployers are compensated by banks for making these investments, there is likely to be a scenario where contracts are surrendered, leading to the large-scale closure of ATMs, the statement said,” the report added.

हमारे मित्र, वरिष्ठ पत्रकार हरजिंदर साहनी ने अपनी पोस्ट में रिजर्व बैंक के गवर्नर उर्जित पटेल के 90 फीसदी बैंक एटीएम में नकदी होने संबंधी बयान की पड़ताल अपने इलाके के एटीएम्स में नकदी की उपलब्धता से की है। मेरा मानना है कि जब वित्त मंत्री इस तरह की बात बोलते हैं तो रिजर्व बैंक के गवर्नर पीछे क्यों रहें। पता नहीं ये लोग किस दुनिया में रहते हैं। संसद भवन के अधिकतर एटीएम खाली रहते हैं। जब किसी में पैसा आता है, लंबी कतार लग जाती है। 
 
रिजर्व बैंक के चारों ओर एक दो किमी के दायरे में दर्जनों एटीएम हैं, मेरा दावा नहीं अनुभव है कि दो तिहाई या तो बंद रहते हैं या उनमें पैसा नहीं होता। किसी एटीएम में पैसा होने की सूचना मिलते ही लोग दौड़ते भागते वहां पहुंच कर कतारबद्ध हो जाते हैं। बैंकों के अंदर भी नकदी का कमोबेस यही हाल है। अपना पैसा निकालने के लिए घंटों कतार में खड़े रहने और नंबर आ जाने के बाद भी गारंटी नहीं कि पैसा मिल जाएगा। टका सा जवाब मिलता है, कैश समाप्त हो गया है।

हम जहां रहते हैं, पूर्वी दिल्ली के गाजीपुर में, वहां पंजाब नेशनल बैंक की शाखा है, और उसका एटीएम भी। एटीएम प्राय: बंद रहता है। बैंक के दरवाजे के पास सुबह छह बजे से ही 30-40 स्त्री पुरुषों की कतार लग जाती है जो दिन चढ़ने के साथ और लंबी होती जाती है। यह नजारा हमें रोजाना सुबह की सैर के समय देखने को मिलता है। अफसोस है कि अरुण जेटली और उर्जित पटेल को यह सब नहीं दिख रहा। जेटली को जब संसद भवन के एटीएम का हाल नहीं दिखता तो, दिल्ली, एनसीआर और देश के अन्य हिस्सों का हाल कैसे दिखेगा। बहुत व्यस्त रहते हैं। संसद भवन में अपने चहेते पत्रकारों के साथ दुनिया जहान की बातें करने की व्यस्तता उन्हें चंद कदम दूर एटीएम का हाल जानने की फुरसत भी नहीं देती। खुदा खैर करे!
 
नोट बंदी के बाद घर में हजार, पांच सौ के नोटों की शक्ल में जमा गाढ़ी कमाई को सरकारी आदेश निर्देशों के तहत बैंक मे जमा करवाने, पुराने नोट बदलने तथा बैंक में जमा रकम का सरकार द्वारा निर्धारित हिस्सा निकालने के लिए बैंक के सामने लगी लम्बी कतारों में घंटों खड़े रहे और खड़े खड़े ही जान गंवा देनेवाले सत्तर अस्सी लोगों की मौत का जिम्मेदार-गुनहगार कौन है, जवाब में पक्ष-प्रतिपक्ष और इस देश की संसद मौन है।

पीएम को संबोधित अपने पत्र में ईएएस शर्मा ने कहा है कि वह निजी कंपनियों को बेशकीमती जमीन के टुकड़े (खेती की और अन्य जमीनें) और खनिज सस्ते में देना बंद करें। इससे इन कंपनियों जनता के पैसे पर मोटा मुनाफा कमाने का मौका मिलता है। पत्र में फॉरन कंट्रीब्यूशन रेगुलेशन एक्ट (एफसीआरए) का भी हवाला देते हुए कहा गया है कि इस कानून का कोई और नहीं खुद भाजपा उल्लंघन कर रही है। चिट्ठी में कहा गया है कि काला धन राजनीतिक दलों के नेताओं और सार्वजनिक संस्थाओं के कर्ता-धर्ताओं की आलमारियों में ठूंसा हुआ है। इसलिए इनकी जांच के लिए विशेषज्ञ जांच एजेंसियों की जरूरत है। ये एजेंसियां ही इन संपत्तियों की जांच कर दोषियों को कटघरे में खड़ा कर सकती हैं। सिर्फ बड़े नोटों पर पाबंदी लगा कर काला धन खत्म नहीं किया जा सकता।

शर्मा की चिट्ठी का ब्योरा यहां पेश है –

प्रिय प्रधानमंत्री जी 

प्रधानमंत्री जी, मुझे खुशी है कि आपने काले धन को खत्म करने के एक अहम कदम के तहत बड़े नोटों को बंद करने का साहसिक फैसला किया। इस तरह के कदम और प्रभावी हो सकते थे अगर आप बीमारी के लक्षणों का इलाज करने के बजाय इसकी जड़ को खत्म करने की कोशिश करते।

जापान के कोबे से आपने कहा कि आपकी सरकार देश में काला धन इकट्ठा होने के खिलाफ कदम उठाएगी। आपने कहा कि सरकार भ्रष्टाचार भी खत्म करने के कदम उठाएगी। आपके इस फैसले का स्वागत है।

इस संबंध में मेरे कुछ सुझाव हैं। अगर आपकी सरकार ने इन पर अमल किया तो उसकी विश्वसनीयता और बढ़ेगी।

1.  निवेशकों को बुलाने के नाम पर ज्यादातर राज्य सरकारें सार्वजनिक जमीनों और बेशकीमती खनिजों को कॉरपोरेट कंपनियो को औने-पौने दाम पर सौंप रही है। सस्ती जमीन और खनिज हासिल करने वाली ये कंपनियां जनता के पैसों पर भारी मुनाफा कमा रही हैं। यह प्रवृति देश में काला धन पैदा कर रही है। आपको इस बारे में पहल कर देश में एक सहमति कायम करनी चाहिए ताकि इस तरह के नकारात्मक कदमों पर रोक लग सके। जहां तक संभव हो सरकारों को इन प्राकृतिक संसाधनों के ट्रस्टी की भूमिका निभानी चाहिए ताकि इनका संरक्षण हो। सरकारों को इन संसाधनों को लगभग मुफ्त में बांटने से परहेज करना चाहिए। 2 जी स्पेक्ट्रम घोटाले मामले में सुप्रीम कोर्ट ने खुद यह निर्देश दिया था कि प्राकृतिक संसाधनों को बाजार कीमतों से कम पर न बेचा जाए।

2. कंपनी एक्ट के तहत कंपनियां अपने मुनाफे का साढ़े सात फीसदी राजनीतिक दलों को दान कर सकती हैं। जबकि सामाजिक कार्यों के लिए कंपनियों के लिए दो फीसदी देना जरूरी है। कंपनी कानून के इस प्रावधान से क्रोनी कैपिटलिज्म को बढ़ावा मिलता है। कंपनी कानून में मुनाफे का साढ़े फीसदी तक राजनीतिक चंदा देने का प्रावधान नकारात्मक है। इससे राजनीतिक दलों और कंपनियों में मिलीभगत को बढ़ावा मिलता है। कंपनियां सत्ताधारी पार्टी से इसका अनुचित लाभ लेती हैं। अगर आप राजनीतिक चंदे को बिल्कुल खत्म कर दें और चुनाव लड़ने के लिए स्टेट फंडिंग की व्यवस्था करने का कदम उठाएं तो चुनावी भ्रष्टाचार की जड़ों पर चोट होगी। आपको चुनावी फंडिंग की सफाई और बड़े खर्चे पर चुनाव लड़ने को रोकने के लिए निर्वाचन आयोग की मदद करनी चाहिए।

3. फॉरन कंट्रीब्यूशन रेगुलेशन एक्ट (एफसीआरए) राजनीतिक दलों और राजनीतिक नेताओं को विदेशी कंपनियों से चंदा लेने से रोकता है। लेकिन भाजपा समेत राजनीतिक दलों ने इस कानून का खुल्लम-खुल्ला उल्लंघन किया है। मैंने दिल्ली हाई कोर्ट में इसके खिलाफ एक रिट याचिका दायर की थी। इस पर सुनवाई करते हुए कोर्ट ने 28-3-2014 सरकार को यह निर्देश दिया था कि एफसीआरए का उल्लंघन करने वाली राजनीतिक पार्टियों के खिलाफ कार्यवाही की जाए और दोषी कंपनियों के खिलाफ मुकदमा दर्ज हो। विदेशी कंपनियों से चंदा लेने से देश के हितों से समझौता होता और मुझे दुख है कि कांग्रेस और आपकी भाजपा दोनों ने यह अपराध किया है। आपकी पार्टी न एफसीआरए के संबंध में कोर्ट ऑर्डर को लागू करने में नाकाम रही बल्कि एक कदम आगे बढ़ कर उसने इस कानून में पिछली तारीखों से संशोधन भी कर दिया। इसमें वित्त विधेयक के जरिये पिछले दरवाजे से संशोधन किया गया।

दूसरे शब्दों में कहें तो आपकी सरकार को विदेशी कंपनियों से चंदा लेने से कोई परहेज नहीं है। भले ही ये कंपनियां देश हित के खिलाफ क्यों न हों। आपकी सरकार इस मामले में एक कदम आगे निकली और इसने इस तरह के आपत्तिजनक प्रावधानों को अनुमति देने के लिए एफसीआरए में ही पिछले दरवाजे से संशोधन कर दिया।

प्रधानमंत्री जी, जब तक आप इस नकारात्मक प्रावधान को खत्म नहीं कर देते तब तक लोग काले धन को खत्म करने के आपके कदमों पर विश्वास नहीं करेंगे।

मैंने 3-4-2016 को (इसकी प्रति आपको भी  भेजी जा रही है) कैबिनेट सचिव को इस बारे में लिखा है। लेकिन मुझे नहीं लगता कि उन्होंने इस पर कोई कदम उठाया है।.
 
4. प्रधानमंत्री जी, काला धन राजनीतिक नेताओं और और अन्य सार्वजनिक संस्थानों में काम करने वाले कर्ता-धर्ताओं के पास जमा है। लेकिन यह बेनामी संपत्ति और अलग-अलग राज्यों में रियल एस्टेट के तौर पर जमा है। आपको इन संपत्तियों का पता लगाने के लिए एक विशेषज्ञ जांच एजेंसी की जरूरत है। ताकि दोषियों को कानून के कठघरे में खड़ा किया जा सके। सिर्फ बड़े नोटों को बंद कर देने भर से काले धन पर रोक नहीं लगेगी।

5. जहां तक विदेशी बैंकों में जमा काले धन का सवाल है तो मैंने आपकी जांच एजेंसियों को कई मुख्यमंत्रियों के इस तरह के खातों की जानकारी दी है। लेकिन आपकी सरकार की एजेंसियों ने इस पर कोई कदम नहीं उठाया। इस संबंध में कोई कदम न उठाने से आपकी सरकार की ओर से उच्च पदों पर भ्रष्टाचार खत्म करने के लिए उठाए गए कथित कदमों पर जनता को भरोसा नहीं हो रहा है। लोगों में इस मामले को लेकर आपकी सरकार के प्रति जो अविश्वास बढ़ रहा है उसे आपको खत्म करने के लिए कदम उठाने पड़ सकते हैं। लेकिन आपको यह काम सिर्फ नारेबाजी की से नहीं बल्कि ठोस कदमों के जरिये करना होगा।

6. भ्रष्टाचार को खत्म करने का एक रास्ता तो यह सकता है कि सरकार जो भी संप्रभु अनुबंध करे उसकी आत्मा की रक्षा हो। यानी सही मायने में इन अनुबंधों की भावनाओं को जमीन पर उतारा जाए। मैं अक्सर देखता हूं कि राजनीतिक संरक्षण में इन अनुबंधों का लगातार उल्लंघन होता है। अब जैसे तेल और प्राकृतिक गैस मंत्रालय के प्रोडक्शन शेयरिंग कांट्रेक्ट को ही ले लीजिये। किस तरह इसका उल्लंघन हुआ है। इस तरह के उल्लंघन के लिए कड़े अनुबंध प्रबंधन की जरूरत है। यह अच्छे गवर्नेंस का एक अहम तत्व हो सकता है और इससे भ्रष्टाचार खत्म करने की दिशा में आप एक अहम संदेश दे सकते हैं।

7. आजकल राजनीतिक संरक्षण की आड़ में एक और भ्रष्टाचार बेतहाशा बढ़ा है। राजनीतिक संरक्षण की वजह से पीएसयू बैंकों की ओर कॉरपोरेट कंपनियों को बगैर ड्यू डिलिजेंस ( जांच-परख) के बड़े कर्ज दिए जा रहे हैं। इसके एक ज्वलंत उदाहरण के तौर पर ऑस्ट्रेलिया में आपकी मौजूदगी में अडाणी समूह को एक अरब डॉलर ऋण देने के लिए स्टेट बैंक ऑफ इंडिया का समझौता है। बिना ड्यू डिलिजेंस को अडाणी समूह को इतनी बड़ी राशि का ऋण देने का करार हो गया। हालांकि जनता के भारी दबाव में यह एएमयू रद्द कर दिया गया लेकिन पीएसयू बैंकों ने तथाकथित कैपिटल डेट रीस्ट्रक्चरिंग का खूब दुरुपयोग किया है। इस स्कीम की वजह से बड़ी मात्रा में पब्लिक फंड एनपीए बन गया। आरबीआई और सार्वजनिक क्षेत्र के बैंकों के बीच हितों का टकराव देखने को मिला है। वित्त मंत्रालय और सार्वजनिक क्षेत्र के बैंकों के बीच भी हितों का टकराव है। इस टकराव को खत्म किया जाना चाहिए। सार्वजनिक क्षेत्रों के बैंकों में तुरंत सुधार के कदम उठाए जाने चाहिए।
मुझे उम्मीद है कि आप इन सुझावों पर अमल करें ताकि भ्रष्टाचार और काले धन के खिलाफ उठाए गए आपके कदमों का सही परिणाम मिले।

मैं इस पत्र का बड़े दायरे में प्रसार इसलिए कर रहा हूं कि इससे अहम मुद्दे पर लोगों को बीच ज्यादा बातचीत और विमर्श हो।

In this open communication, the former IAS officer has urged the prime minister to stop giving away large tracts of land (including fertile arable land), precious scarce minerals to private companies at highly subsidised rates, allowing them to profiteer at cost to the public exchequer. The letter also refers to the blatant violation of the Foreign Contribution Regulation Act by none less than the ruling party, the Bharatiya Janata Party (BJP).
 
Further, the letter states that black money is stashed away by both political leaders and other public functionaries in the form of benami land and other real estate property in different States. You need a specialised investigating agency to trace those properties and force the culprits to face the law of the land. Demonetising higher currency notes alone may not suffice.

Dear Prime Minister,
 
I am happy that you have taken the bold step to demonetise higher denomination currency notes as an important effort to flush out black money. Such a step will yield better results if your government also simultaneously addresses the systems that breed black money and correct those systems. Instead of addressing the symptoms alone, it will be more effective to address the root causes of the disease of corruption.
 
I understand that you have made a statement from Kobe in Japan that your government would take further action not only to curb black money generation but also step up the campaign against corruption. It is a welcome statement.
 
In that connection, I suggest that you consider the following approaches that can enhance the credibility of your government.
 

• In the guise of inviting investors, most State governments have been giving away public lands, precious scarce minerals and other public resources of great value to private companies at highly subsidised rates, allowing those companies to profiteer at the cost of the public exchequer, thereby creating scope for generation of black money. You should take the lead in building a national consensus on putting a stop to this regressive approach forthwith. As far as possible, the governments which are merely public trustees of such resources, should conserve those resources and refrain from doling out natural resources at rates less than their market value, as rightly directed by the apex court in the 2G Spectrum case. 
• The Companies Act permits companies to make political contributions upto 7 1/2% of their profits, whereas the threshold for contributing funds for societal needs (corporate social responsibility) is only 2% of the profits. This is not only a warped provision intended to promote crony capitalism but also a retrograde provision that has resulted in the governments granting quid pro quos to the donor companies, violating the law of the land. If you can abolish political contributions altogether and replace the same by State funding, you will be getting at the root of electoral corruption and cleanse the system once for all. Simultaneously, you should help the Election Commission of India (ECI) in curbing lavish election spending.
• In this context, though the Foreign Contributions Regulation Act (FCRA) prohibits political parties and politicians from accepting donations from foreign companies, many political parties including BJP have blatantly violated the FCRA. I filed a writ  [WP(C) 131/2013] before Hon'ble Delhi High Court who directed your government, in their Order dated 28-3-2014, to proceed against all political parties violating the FCRA and prosecute the errant foreign companies. Accepting donations from foreign companies compromises the national interest and I feel distressed that both the major political parties, namely, Congress and BJP, should have committed such a highly distressing offence! Your government has not only dragged its feet in implementing the court order but has gone one step backwards by introducing an amendment to the FCRA retrospectively through the backdoor of the latest Finance Bill and got it enacted by the Parliament. In other words, your government has no qualms in seeking donations from foreign companies to the detriment of the national interest and has gone to the extreme extent of getting the FCRA amended to accommodate such a highly objectionable provision. Mr. Prime Minister, unless you get this regressive amendment revoked forthwith, the people at large may not have confidence in the steps being taken by you to campaign against corruption. I have written about this to the Cabinet Secretary vide my letter dated 3-402016 (copy forwarded here) but I am not sure whether he has acted on my letter at all.
• Black money is stashed away by both political leaders and other public functionaries in the form of benami land and other real estate property in different States. You need a specialised investigating agency to trace those properties and force the culprits to face the law of the land. Demonetising higher currency notes alone may not suffice.
• As far as black money stashed away in offshore (foreign) accounts is concerned, I have alerted your investigation agencies about several State Chief Ministers and others having such accounts but the investigating agencies under the control of your own government have not responded till date. Inaction on the part of your government in this matter has already eroded public confidence in the earnestness with which your government has conducted itself in fighting corruption in high places. You may have to hasten to correct this public perception, not through sloganeering, but through tangible action.
• One way to curb corruption in government is by enforcing the sanctity of sovereign contracts in letter and spirit. I find that contracts are routinely allowed to be violated by way of political patronage, as it has happened in the case of the Production Sharing contracts (PSCs) of the Ministry of Petroleum & Natural Gas. Strict contract management is one of the ingredients of good governance and you could send a strong message in that direction.
• One source of corruption that has become rampant these days is the political patronage involved in PSU banks dispensing credit to corporates without exercising due diligence. One glaring example of this was the manner in which State Bank of India had flippantly signed an MOU in your presence in Australia to grant a billion dollar loan to the Adani group, without carrying out any due diligence. Under public pressure, SBI had to withdraw from that MOU but it is public knowledge how these PSUs banks have misused the so-called "Capital Debt Restructuring " scheme and other versions of that scheme to expose public funds to the risk of becoming NPAs. There are conflict-of-interest situations between RBI and the PSU banks and the Finance Ministry and the PSU banks which need to be removed and PSU bank reforms undertaken urgently.

 
I hope that you will act on these suggestions so that your efforts to campaign against corruption and black money may yield the desired outcomes.
 
I am circulating this letter widely hoping that it will generated the much needed discussion and debate on this important subject.

देश में जहां 2 लाख दो हजार एटीएम मशीनें हैं वहीं सिर्फ 22,500 एटीएम ही काम कर रहे हैं। सरकार ने बिना तैयारी के नोटबंदी कर दी जिससे आम जनता को खासी दिक्कतों का सामना करना पड़ रहा है।

आधिकारिक सूत्रों से खबर है कि जो भी एटीएम मशीन काम नहीं कर रहे हैं उनके पार्ट्स अब चीन से मंगाए जाएंगे। बता दें कि जारी किए गए नए नोटों को स्वीकार्य करने के लिेए एटीएम में लगने वाले मैगनेटिक कंपोनेंट और हार्डवेयर की कमी की वजह से नोट निकलने में दिक्कतें आ रही हैं। अधिकारियों का कहना है कि एक बार अगर यह पार्ट एटीएम में लग जाए तो एटीएम एक हफ्ते में सुचारू रूप से चलने लगेंगे।
 
यहां सवाल यह उठता है कि दीवाली पर सरकार के कई नेताओं की तरफ से लोगों से चाईनीज समानों को ना खरीदने की अपील की गई थी। तो वहीं सरकार की तरफ से अब एटीएम को चालू करने के लिए सामान चीन से मंगाए जाएंगे।
 
हालांकि स्टेट बैंक ऑफ इंडिया की चेयरपर्सन अरुंधती भट्टाचार्य का कहना है कि सारे एटीएम में इन पार्टों की जरूरत नहीं है। उन्होंने कहा कि एटीएम की पर्याप्त मात्रा में आपूर्ति की जा रही है, आने वाले दिनों में इस तरह की कोई समस्या नहीं होगी। वहीं वित्त मंत्रालय के एक सीनियर अधिकारी ने कहा कि यह एक बड़ी समस्या नहीं है और स्थिति जल्द ही सामान्य हो जाएगी।
