Two horrific incidents were recently reported from two different places in Jharkhand. In the first a Muslim man, said to be mentally challenged was attacked and sustained serious injuries, in the second incident reported, an Adivasi man was beaten to death.

According to Jharkhand Janadhikar Mahasabha’s social media posts, the Muslim man identified as 22-year-old Md. Adil, who is said to be mentally challenged, was brutally beaten up on November 28, when he wandered into a neighbouring village in the Idgah Mohalla in Simdega by mistake. The attackers allegedly threw his cap on the ground and pulled his beard. Adil was then beaten and could barely talk as he recalled that a group of men had attacked him in the area known as Thakur Toli. He sustained injuries to his head.

 

According to the JJM, Adil’s father has named the culprits in his police complaint and a case has been registered. He is recuperating at Rajendra Institute of Medical Sciences (RIMS), Ranchi. The matter surfaced only on Thursday evening after Mahasabha members shared the details on Twitter and tagged the chief minister and Jharkhand police.

Adil’s brother Yusuf Ansari told The Telegraph that on November 28, his brother had discontinued his medicine, and on the fateful day had gone for evening namaz at the nearby mosque. He said, “He (Adil) had gone to the nearby Prince Chowk and had somehow meandered into the neighbouring Thakur Toli, around 2.5km from our locality. We started searching for him when he did not return till 7 P.M. My elder brother got a photo shared in the WhatsApp group which showed our brother looking frightened and being held by someone. We suspected something and went to the neighbouring locality.” 

The family learnt that Adil was beaten up by local youths and the police had taken him to Simdega Sadar Hospital. Yusuf recalled that, “Simdega hospital referred him to RIMS Ranchi after seeing the serious injury on his head. Though RIMS doctors have declared him out of danger, he is still in the hospital. My father had lodged an FIR against three persons and also FIR against several unidentified persons. So far only one Rohit Singh has been arrested.” 

Simdega SP Shams Tabrez however, refused to term the incident as religion-based mob-lynching and told the media that the police “received a complaint from a local scribe residing in Thakur Toli that Adil, who was suffering from mental illness, had tried to enter some houses but could not speak anything when asked. He was beaten up by some youths of the locality for trespassing but there was no communal angle behind the beating. We are investigating the case and one person has been arrested. More arrests will take place during the course of investigation.” 

Tribal beaten to death

Another horrific incident from the state was reported by The Telegraph, where a 35-year-old Adivasi man identified as Sunil Pasi was beaten up by villagers in Khetko under Bagodar police station area of Giridih district. According to the news report, the attackers suspected Pasi “of being a cattle thief” and had kept him hostage on Thursday night. The Bagodar police were informed on Friday morning and then an injured Pasi was taken to Bagodar Community Health Centre. There, the doctor declared him dead.

Shabad Ansari, a high court lawyer and member of Jharkhand Janadhikar Mahasabha told mediapersons, “It is unfortunate that incidents of mob justice and lynching over religion and caste are taking place in Jharkhand. We want the government to take stern action, arrest all culprits and ensure a complete stop on such incidents.”

In Giridih, detailed the TT, a few thieves had tried to enter the house of one Dashrath Mahato in Khetko village on Thursday night, but they escaped when an alarm was raised. However, villagers caught Pasi and beat him up badly, kept him hostage and told the police on Friday morning. According to Bagodar-Sariya sub-divisional police officer Naushad Alam, police reached the spot and rushed a critically injured Pasi to the hospital where he was declared brought dead. A case has been lodged against 14 persons and six have been arrested so far.

Mohammad Faisal Husain, a young vegetable vendor and the sole breadwinner for his family of six, was allegedly beaten to death by the Unnao Police on May 20. Some media reports state that his post mortem report revealed that he succumbed to a head injury. The post mortem examination also found a severe injury behind his ear and at least 12 contusions on his body.

On May 20, his family alleged that he had been picked up by police for flouting the Covid curfew and then tortured at the police station, in the presence of the station house officer.

CJP, through this petition, demands that the UP-Chief Minister Yogi Adityanath takes moral responsibility for what is happening inside police stations in his state, and also directs the concerned authority to provide compensation to Faisal’s family. We also demand that the guilty police officers are charged under appropriate sections and tried.

On October 7, 2020, an 18 year old second-year student of Delhi University, Rahul Rajput was allegedly beaten to death by members of a female friend’s family. He  was seen with his female friend on CCTV near Adarsh Nagar, West Delhi last Wednesday, after which it is believed that he received a call for tuitions. Moments later he was allegedly thrashed by a group of five people and rushed to a local hospital by his uncle. He succumbed to his injuries later at Babu Jagjivan Ram Memorial Hospital.

On the basis of Rahul’s uncle’s statement to the police, a case under Section 302 (murder) and Section 34 (an act done by several people in furtherance of a common intention) of the Indian Penal Code was registered. “On Wednesday at 7 pm, I got a call from my friend who informed us that four-five boys were beating up my nephew. When I reached the spot, I found that my nephew was being beaten brutally by the girl’s brothers and their accomplices… they slapped, punched and kicked him,” the uncle wrote in his complaint.  

“On Wednesday we received a call at 11:59 pm from BJRM hospital about a patient admitted in an unconscious condition. Rahul did not have any visible injuries. After the post-mortem, the doctor said the rupturing of spleen led to his death,” Vijayanta Arya, the Deputy Commissioner of Police (North West) told The Hindu. The police also say that the girl’s family members were apprehensive about the duo’s friendship.

Reacting to the 18-year-old’s death, Deputy Chief Minister Manish Sisodia today said, “The family had come from a village to settle here. The boy used to teach and help others. We will ensure that those responsible get punished as soon as possible.”

This tragedy is alas not the first such case in Delhi. In February 2018, Ankit Saxena a 23-year-old professional photographer was stabbed to death in Khayala, West Delhi, allegedly by the family members including the brother of the woman with whom he was in a relationship. Often religious hardliners find inter-faith relationships unacceptable. A common allegation is that  Muslim men are luring Hindu women to marry them to produce Muslim off springs. These cases dubbed ‘Love Jihad’ by Hindutva supremacist groups marginalise Muslims and also fail to respect the agency of women.  

The Hadiya case is a reminder for all women to fight for autonomy. When Akhila, a young girl from Kerala, married a Muslim man Shafin Jahan, changed her name and converted to Islam, her father approached the court. Shockingly, the Kerala Court upheld her father’s petition, annulled Hadiya’s marriage to Shafin and “handed over” the 24-year-old woman’s custody to her father! The high court had also asked to investigate whether there were organised or systematic ‘love jihad’ campaigns in the state. When the husband moved the Supreme Court, a Bench comprising Chief Justice J.S. Khehar and Justice D.Y. Chandrachud permitted the National Investigation Agency (NIA) to access the Kerala police report probing an alleged larger conspiracy by terror groups to convert Hindu women to Islam and radicalise them. The SC then heard Hadiya in person and when she asserted that she had married Shafin Jahan of her own free will, the Supreme Court, in a landmark judgment delivered on March 8, 2018 (International Women’s Day), respected Hadiya’s right as an adult woman to choose her partner and set aside the High Court order annulling her marriage.

The constitutional value of ‘Secularism’ is not only embodied in our Preamble but also several other provisions under it. The protection of equal status before the law under Article 14, the guarantee of non-discrimination on grounds of race, caste, sex, religion under Article 15, the abolition of untouchability under Article 17, the freedom to choose any religion and educational institution under Article 25, 29 and 30 to linguistic and religious minorities make up for a framework which rejects the idea of religious preference.

The Indian judiciary must undeniably always strive for propagating the idea of this unity and allowing women’s autonomy and privacy to breathe. Secularism is just not a philosophy limited to a hard-bound copy, it needs to find space in the most remote areas of India to prosper and grow.
