In a complaint addressed to the Jharkhand State Election Commission, Citizens for Justice and Peace (CJP) has raised serious concerns about the divisive rhetoric employed by BJP leaders Naveen Jaiswal and Shivraj Singh Chouhan during an election rally in Ranchi, Jharkhand, on October 24, 2024. As Jharkhand prepares for its state elections, CJP asserts that these speeches have severely compromised social harmony and threaten the democratic values that elections should uphold.

The complaint highlights how the two leaders’ speeches deviated from issues of development, such as healthcare, employment, and infrastructure, in favour of stoking fear and communal divisions. CJP argues that this rhetoric violates both the Model Code of Conduct (MCC) and provisions under the Representation of People Act (RPA), 1951, particularly Section 123, which prohibits corrupt practices in elections, including attempts to sway voters through communal or religious division.

In his speech, BJP MLA Naveen Jaiswal framed the election as a defence against an alleged “takeover” of Jharkhand by “Bangladeshi infiltrators and Rohingya Muslims,” accusing the ruling JMM-Congress coalition of enabling these communities to settle illegally. By portraying Muslims as an existential threat to Jharkhand’s indigenous culture, Jaiswal’s statements urged Adivasi and indigenous communities to vote based on fear, rather than on traditional governance issues.

Shivraj Singh Chouhan, Minister of Agriculture, echoed and intensified these sentiments, alleging that Bangladeshi immigrants were “stealing” resources, jobs, and even deceiving local women into marriage as a means to gain a foothold in Jharkhand. Chouhan further suggested that these individuals were compromising Jharkhand’s safety and warned that allowing the JMM-Congress government to continue would lead to the state’s “destruction.” His portrayal of an “invasion” of local resources and values by Muslims, CJP contends, is a dangerous exaggeration that fuels xenophobic fears and undermines community trust.

The complaint submitted by CJP includes videos of the speeches, which were shared on Hindutva Watch’s Telegram channel and annexed in the submission, to substantiate their claims of communal and inflammatory content.

Various violations highlighted by the complaint

  • Model Code of Conduct 

The MCC, enforced by the Election Commission of India, aims to maintain fair and peaceful elections by prohibiting divisive and inflammatory rhetoric. It explicitly bans appeals to voters based on caste, religion, or community and calls for restraint from inciting tension between groups. The complaint emphasised that by framing Muslims as a monolithic threat and casting them as “infiltrators,” Jaiswal and Chouhan’s speeches undermine the MCC’s commitment to communal harmony, focusing instead on identity-based fear-mongering rather than development issues.

  •  Representation of People Act, 1951 

The complaint also highlights specific violations under the Representation of People Act, 1951, Section 123, which prohibits corrupt electoral practices, including the use of religious or communal appeals to influence voters. Sections 123(3) and 123(3A) of the RPA bar candidates from promoting enmity or hatred between communities on the grounds of religion or caste. By using rhetoric that positions Muslims as “outsiders” and “threats” to the indigenous population, these speeches not only appeal to communal sentiment but also cultivate distrust and hostility, which the RPA categorically prohibits.

The call for immediate action 

CJP’s complaint details the harm of such divisive speech, explaining how this rhetoric disrupts Jharkhand’s historically diverse and pluralistic social landscape. The complainant argues that framing Muslims as a monolithic threat erodes communal harmony, creates fear and mistrust, and fosters stereotypes that can lead to acts of discrimination and violence. By shifting focus away from issues of public welfare and development, this approach leaves marginalised communities with fewer avenues for genuine solutions to pressing needs, such as employment and healthcare.

The complaint concludes with a plea for the Election Commission to take immediate action, emphasising the need to preserve Jharkhand’s social harmony and ensure that elections remain focused on development and democratic values rather than divisive agendas.

In the wake of the 2024 Lok Sabha elections, a substantive criminal complaint has emerged, filed by Advocate Mehmood Pracha, which alleges extensive manipulation and misconduct in the election process. 

This piece delves into the comprehensive details of the complaint, highlighting  accusations against high-ranking officials of the Election Commission of India (ECI), engineers from Bharat Electronics Limited (BEL) and Electronics Corporation of India Limited (ECIL), and prominent leaders of the Bharatiya Janata Party (BJP), including Prime Minister Narendra Modi, Amit Shah, and J.P. Nadda. 

The complaint outlines a systematic and far-reaching conspiracy purportedly designed to influence the election results in favour of the BJP, compromising the integrity and transparency of the electoral process. Through meticulous documentation of incidents, evidence of tampering, and procedural violations, this piece aims to present a coherent and detailed account of the allegations, demanding an immediate and thorough investigation to uphold the democratic principles of free and fair elections in India.

Advocate Mehmood Pracha has filed a comprehensive criminal complaint alleging manipulation of the 2024 Lok Sabha elections. The complaint is against The Chief Election Commissioner (CEC), Rajiv Kumar, Election Commissioners Gyanesh Kumar and Sukhbir Singh Sandhu, Officials and engineers of Bharat Electronics Limited (BEL) and Electronics Corporation of India Limited (ECIL), Mr. Narendra Modi,  Mr. Amit Shah and Mr. J.P. Nadda of the Bharatiya Janata Party and other known and unknown persons involved in aiding the BJP to secure an unjust victory. 

Core contentions of the complaint

Use of EVM’s instead of ballot papers

The complaint states that elections are legally required to be conducted via ballot papers unless specific conditions allow for Electronic Voting Machines (EVMs). The 2024 elections, however, were conducted using EVMs in a manner that allegedly compromised both transparency and security, systematically favouring the Bharatiya Janata Party (BJP) and its allies.

According to the complaint, at the beginning of the election process for the 7-Rampur Lok Sabha Constituency in U.P., a meeting was held between the Returning Officer (RO), other election officials, and all candidates. This meeting was audio-video recorded by the RO. During the meeting, Advocate Pracha informed the RO that elections are required to be held through ballot papers, with EVMs permissible only under a special notification as per Section 61A of the RPA. The RO stated readiness to conduct elections via ballot papers if the ECI issued the necessary instructions but failed to provide any such notification, proceeding instead with EVMs.

Adv. Pracha filed Writ Petition (Civil) 5037 of 2024 in the Delhi High Court. On April 6, 2024, the ECI sent a copy of a notification dated March 20, 2024 under Section 61A. This notification however, appeared to be manipulated states the complaint as it was not available online until April 6, .2024, despite the election schedule being announced on March 16, 2024.

Adv. Pracha therefore requests for a thorough investigation to be conducted in order to examine the official files and records at the ECI head office, focusing on the preparation of the notification and the alleged conspiracy to issue an illegal and omnibus notification.

Manipulations of the EVM’s  

The complaint implicates senior ECI officials, including CEC Rajiv Kumar and Election Commissioners Gyanesh Kumar and Sukhbir Singh Sandhu, accusing them of orchestrating a wide-ranging conspiracy to manipulate EVMs. This manipulation extended to other senior ECI officials both at the headquarters and those deputed in various constituencies.

Individuals affiliated with the BJP, such as Mansukhbhai Shamjibhai Khachariya, Dr. Shivnath Yadav, Ms. Shyama Singh, Mr. PV Parthasarathi, and Mr. Krishna Bihari Rai, were appointed as Directors in BEL and ECIL. These appointments according to the complaint were a part of a broader scheme to keep the EVM manufacturing process secretive and manipulatable. 

The complaint states that key components of the EVMs, particularly the microcontrollers, were imported from undisclosed foreign manufacturers. The software or source code for these microcontrollers was ported in a secretive manner to facilitate manipulation. Serial numbers on various EVM components were not permanently affixed, which made it easier to swap machines during the election process without detection. The accessories used with the EVMs, such as wires, batteries, and paper rolls, were uncertified and unverified, further compromising the integrity of the election process.

A significant number of EVMs used in the 2019 election process are reported to be missing records the complaint. The Election Commission of India (ECI) acknowledges this issue as sub-judice, as stated in their FAQs.

Transportation, storage and commissioning irregularities 

On April 8.2024, Adv. Pracha observed EVMs being transported in open, non-containerized trucks without security personnel. The EVMs lacked permanently engraved serial numbers and had detachable stickers, facilitating potential tampering.

The warehouse storing the EVMs was maintained illegally and unsafely. There was no clear distinction between EVMs meant for training and those for actual elections, violating guidelines and facilitating manipulation. Adv. Pracha has audio-video recordings of the warehouse and transportation and has requested further videography from ECI officials.

During the commissioning process on April 9, 2024 in Rampur, authorized engineers from BEL and ECIL were absent. Adv. Pracha signed a pink slip and made a note in the register as evidence. Later, he encountered individuals claiming to be BEL engineers at the Collectorate, but they were not engaged in any procedures.

At the Mandi, the designated venue for commissioning, Adv. Pracha observed various devices and accessories, such as a large computer mouse-like device (SLU), wires, batteries, and paper rolls, lying in bulk without seals or certification. BEL team leader Mr. Navyajyoti explained the SLU usage and stated that data was stored by the ECI’s local unit at Moradabad, not by his team.

Local officials attempted to prevent Pracha from witnessing the process and communicating with the engineer. Pracha and his associates were threatened with false criminal charges by ECI officials, aiming to intimidate and prevent them from reporting the tampering. The Central Observer’s intervention was necessary to normalize the situation.

ECI officials “conspired to misappropriate election funds by mishandling the videography procedure and safekeeping of EVM-VVPAT machines”, states the complaint, “recording fewer and shorter videos than required. Substandard and insecure infrastructure was used for the transportation, storage, and safekeeping of the machines.”

Several emails were written to the Returning Officer and other ECI officials, including the CEC, highlighting the illegalities witnessed regarding the mishandling and tampering of EVM-VVPAT machines. No corrective measures were attempted despite these communications.

Election day and post-polling manipulation

As stated in the complaint, on April 18, 2024, during the commissioning and distribution of machines, ECI officials mishandled the machines. They used mobile phones and electronics at the venue, with no security checks at entry/exit points. Unauthorized personnel could freely enter and exit, potentially tampering with the machines.

As per the complaint, even after polling on April 19, 2024, mishandling and tampering continued. Machines were brought back to the Mandi for sealing and storage at the warehouse, where officials were seen working on the machines and election papers at night, violating legal provisions. Videography from this period could establish the manipulation of machines and other materials by polling parties.

Despite multiple complaints and letters detailing these issues, the ECI took no corrective action. Notable communications include those dated March 28.,  2024, April, 6, 7, 8, 10, 11, 16, 17 and 19, 2024.

Conspiracy and forgery to influence elections

The criminal complaint accuses officials at the Election Commission of India (ECI) of orchestrating a conspiracy to influence election outcomes through falsification and destruction of critical documents. Specifically, ECI guidelines require that copies of Form 17C, detailing votes polled, remain unsealed with Returning Officers. However, according to the complaint, these records were allegedly destroyed to manipulate the vote count. The complaint further alleges that senior officials at the ECI’s head office in Delhi engaged in forgery, manipulation, and tampering of records to present misleading information in affidavits submitted to the Supreme Court of India. This main conspiracy, alleges the complaint, centered at the ECI’s headquarters at Nirvachan Sadan in Delhi, involved clandestine meetings and other activities aimed at subverting the electoral process.

Manifestation of the manipulation

Numerous malfunctions and anomalies in EVMs suggest nationwide manipulation to benefit the BJP alleges the complaint. It is stated that reports indicate a mismatch between the total number of votes polled and the total number of votes finally counted in 538 Parliamentary Constituencies. In Rampur, the total votes counted were 456 less than the total votes polled, suggesting a conspiracy to alter election results.

Request for investigation

Adv. Pracha through his complaint has called for:

  • Immediate registration of a report under Section 129 of the Representation of the People’s Act, 1951, Section 65/66/66F of the Information Technology Act, 2000 and Section 171F/409/417/466/120B/201/34 Indian Penal Code.
  • Investigation into the roles of all involved, including ECI officials, BEL and ECIL engineers, and BJP members.
  • Seizure and forensic analysis of manipulated EVMs and related materials.
  • Preservation and review of all videography and CCTV footage related to the election process.
  • Examination of official files and records at the ECI head office to uncover details of the alleged conspiracy.

Conclusion

As the farmers ‘Delhi Chalo’ protest enters its fifth day, and farmers are forced to stay confined at the two border points of Punjab and Haryana, namely the Shambhu and the Khanauri border points, and face water cannons and rubber pellets, news has emerged that the Samyukt Kisan Morcha (SKM) has decided to intensify their agitation further in coming days.

As per a report of the Indian Express, the Bharti Kisan Union (Ekta Ugrahan) are now holding protests outside the residences of three senior Bharatiya Janata Party leaders in the state of Punjab. A two-day dharna, starting February 17, will be held outside the house of BJP Punjab president Sunil Jakhar in Fazilka’s Panjkosi village. In addition to this, protests were also launched outside the houses of BJP leaders Captain Amarinder Singh in Patiala and Kewal Dhillon in Barnala.  These protests will be against the state brutality being shown to the farmers at the Shambu border, where many farmers have sustained serious injuries and one had died, as well as in support of the various demands being raised by them, including a legal guarantee for MSP.

In addition to these three sit-in protests, the union has also stated that they will be holding protests at toll plazas in the state as their extension of support to the “Delhi Chalo” call.

Meanwhile, the state is also intensifying their already excessive actions of suppression.

As per a report of the Hindustan Times, around 100 farmers from different farmers associations were arrested at Thanjavur Railway station, Tamil Nadu on the morning of February 17 as they tried to stage a ‘rail roko’ protest in front of the Cholan Express. The ‘rail roko’ protest is also in solidarity with the farmers’ agitation in New Delhi and against the police action by Haryana Police.

In addition to this, on February 16, the Uttar Pradesh (UP) government invoked the Essential Services Maintenance Act (ESMA) and banned any strikes by government employees in all State government departments, corporations, and authorities for a period of six months. The said decision is another state tactic to repress dissent. Notably, ESMA gives the police the power to arrest any such employees found to be violating provisions and conducting strikes without a warrant and imprisonment for a term which may extend up to one year or a fine which may extend to ₹1,000 or both, to any person who instigated a strike which was illegal under the Act.

On the other hand, Farmer leader Sarwan Singh Pandher has raised a demand for the union government to bring an Ordinance on giving a legal guarantee to Minimum Support Price (MSP). The demand comes a day before the fourth round of talks between farm leaders and Union ministers over their various demands.

As per the report of the PTI, Pandher pointed to the power that the union government hold in taking “political” decisions and said, “If it (Centre) brings an ordinance and it can bring it overnight, if it wants so. If the government wants resolution of farmers’ protest, then it should bring out an ordinance with an immediate effect that it will enact a law on MSP, then discussion can proceed further.”

The public speeches, statements and behaviour of BJP leaders hardly enhance the credibility of India. They want to turn the armed forces into an electoral ally with the blatant politicisation of their actions. This was typified in the statements of several BJP office bearers like BS Yeddyurappa, who said that his party would win 22 seats in Karnataka after the strike, or the Jharkhand BJP president, who claimed a win in all 14 seats in that state, or the Delhi BJP chief who tried a crass takeover of the Army uniform, flaunting it as though it were a party flag.

BJP president Amit Shah claims that 250 terrorists were killed in India’s air strike in Balakot while his colleague SS Ahluwalia, a minister in the Modi government, informs the country that in fact the aim was precisely to avoid human casualties in the Balakot strike; that it was meant to send a message to Pakistan. Who then is the liar? While the Foreign Secretary claims terrorists, their trainers and infrastructure were destroyed, the Air Force chief snubbed this kind of talk with his statement that it is not the job of the armed forces to count casualties. The international press has questioned the veracity of the figures of casualties and damage. But Prime Minister Narendra Modi skipped the meeting of opposition parties and even today, the government not just refuses to share information but also wants to silence questions with bullying, intimidation and accusations.

The post-Pulwama strategy of the ruling party for the forthcoming elections is clear enough. For the BJP and the cohorts of the Sangh Parivar, the effort is to convert the great exercise of parliamentary democracy into a platform where jingoism parades as nationalism, where national security is reduced to the size of the chest of the strongman and where all debate is damned as being “anti-national”. This is very convenient for the ruling party as it faces mounting public anger against its five years of rule, which has established records in promises betrayed. Now, instead of unemployment, agrarian distress and other issues of urgent importance to the citizens of India, the ruling party wants to shift the narrative. But for a few – very few – honourable exceptions, the satellite media has done everything it possibly can to support this strategy and to whip up war hysteria, to glorify government claims, to repeat vile accusations against opposition parties, to peddle lies and fake stories without even the pretense of an impartial check.

The strategy has an even darker side. Kashmir is also to be the centrepiece of the fake nationalist discourse, to contrast the “strong” measures taken by the Modi government as opposed to the opposition parties who talk of peace and dialogue. This was seen in the immediate aftermath of Pulwama, when Kashmiri students and traders in different parts of India were targeted and attacked. These were not spontaneous actions. They were led by members of the Sangh Parivar. Vicious statements against Kashmiris by those holding constitutional posts, such as Arunachal Pradesh Governor Tathaghat Roy, or by other BJP ministers, went without a reprimand, let alone sacking.

While the campaign will run its course, the impact of the toxins injected into the polity by it will have caused much damage to India, both at the international level and internally. And as for the electoral and political benefits that Modi ji and BJP president Amit Shah hope to gain from such a campaign, they may be in for a surprise as there are many uncomfortable questions, even within the framework they want to set, which will dog them in their campaign.

Take the Prime Minister’s recent tall talk about terrorism. He declared in Ahmedabad that he would “settle all scores with terrorists” and “hum unke ghar mein ghus ghus kar maarenge (we will go into their homes and kill them)”. Using the same invective and aggression, he targeted the opposition parties, accusing them of helping Pakistan. He then went on an exercise of self-praise, describing himself as a man who thinks only of the country, whose nature is never to wait long and to give replies immediately. Waving his hands around, he declared that “India is in safe hands”. He has even referred to his government prefixing his name – the Modi government – surely a first in India! I, Me, My. Someone should caution him that he is in danger of tripping over what seems to have become a rather oversized ego.

The Balakot air strike was India’s response to the suicide bombing by Jaish-e-Mohammed in Jammu and Kashmir’s Pulwama

What is the record of his government?

Pulwama occurred when Jammu and Kashmir is under President’s Rule, directly under the central government. In January 2016, when the Pathankot attack took place, the BJP was in the state government too.

The Parliamentary Standing Committee for Home Affairs, which reviewed the security arrangements, had visited the airbase where the attack took place. It said in its report on May 3, “The committee is unable to understand how despite a terror alert (having been) sounded well in advance, the terrorists managed to breach the high-security airbase and subsequently attack it.” It declared that the “security cover at the airbase was not robust.” It mentioned that the perimeter wall was poorly guarded and the base did not have a road around it for patrolling.

Eight months later in September 2016, there was another attack in Uri and once again, the issue of intelligence agencies was raised. Modi ji used the same language as he does today and conducted what is referred to as a surgical strike, claiming to have inflicted serious damage to terrorist camps in Pakistan. But it is clear from the increase in terrorist attacks that it had no significant impact in either reducing or preventing such incidents.

Now once again in the Pulwama attack there are serious questions. How is it that a vehicle loaded with deadly explosives could escape security scrutiny? Who is responsible for this lack of intelligence information? Why were the minimum precautions of road clearance not maintained for such a large convoy of trucks carrying CRPF jawans? Why were proper arrangements for security not made? The Modi government wants to escape these questions with its rhetoric.

But what the BJP conceals is that it is on its watch, both in Delhi and as a partner in the coalition government in Jammu and Kashmir, that the number of terrorist incidents went up by 176 per cent and the loss of lives also increased.

In February, in a written reply to the Lok Sabha, Minister of State for Home Affairs Hansraj Ahir gave the information that there were 1,708 terrorist incidents between 2014 and 2018.

From 222 incidents in 2014, the figure decreased in 2015 to 208 incidents and then shot up to 614 terrorist incidents in 2018. The minister also informed parliament that in the same period, the number of civilians killed in Jammu and Kashmir was 138 – an increase of 35.71 per cent – and the number of security persons killed was 393, an increase of 93 per cent.

These figures reflect the result of the disastrous policies pursued by the Modi government in Jammu and Kashmir based on the ideological and political agenda of the Hindutva platform of Sangh Parivar. The refusal to accept the special status of Jammu and Kashmir granted by the Constitution of India, the refusal to open a political dialogue with all stakeholders in spite of the assurances given by Home Minister Rajnath Singh on the floor of parliament and the utter failure to implement a single programme of development for the people of the state are the hallmarks of this policy. There are no jobs and a total lack of opportunity; there is a serious agrarian crisis with low prices for agricultural products; the conditions of workers and employees are precarious. Where people’s frustration with their plight was high, the centre and the coalition government were totally insensitive to these requirements. On the contrary, instead of development, the people were met with state repression, leading to an unprecedented alienation of a very large section in the Valley.

In 2014, the people of Jammu and Kashmir registered a high percentage of over 65 per cent in the vote for the state assembly, in spite of the threats of the separatists. The militants were isolated from the people who voted with some hope of development and peace. In five years the situation has changed so much so that in the Lok Sabha by-elections for the Srinagar seat, just about 7 per cent of people voted and the by-election for the Anantnag seat has still not been held.

Today, instead of an elected government, the people suffer under direct rule of Delhi, which makes matters worse. In these five years there has been the growing influence of Islamic fundamentalists destroying whatever remains of Kashmiriyat, and on the other hand, the increasing recruitment of local youth into the ranks of the extremists. The Modi government talks of Kashmir as a piece of territory, but never of the Kashmiri people.

It is well-known that Pakistan is providing the logistics in every sphere for terror attacks including the horrendous Pulwama attack. There is unanimity in supporting all government efforts to get Jaish-e-Mohammed chief Masood Azhar on the global terrorists’ list. But what of the battle to win back the minds and hearts of the people of Kashmir? The five years under the Modi government have highlighted the spectacular failure to do so.

Police officer Gagan Deep Singh, who had saved a young Muslim boy from being lynched by a Hindutva mob, is facing death threats and has gone underground. His family members are also facing death threats from local RSS and BJP leaders. The reason: he defended “indecent behaviour”.

The police inspector in Ramnagar, Uttarakhand shot to fame after saving a Muslim boy from a lynch mob which attacked him for being with his Hindu girlfriend on the premises of a temple. Gagan Deep Singh is now sent on leave, say his colleagues. His seniors in the police department are not protecting them. The Senior Superintendent of Police of Nainital district says that he would like to first provide counseling to him before thinking of any action against Gagan Deep Singh, as if it was his fault.

No action has been taken against the Hindutva goons who were engaged in lynching or the BJP leaders who continue hounding his family. Instead of giving him an award for his bravery, this government wants to fix this officer who has been in service for only 7 months now. We are living in the worst times of our lives. Hope this too shall pass!

Mr Singh earned a lot of fans after the video of him saving the couple went viral on social media. The mob was alleging love jihad by the Muslim youth when the police officer intervened and saved him. In the process, he received several blows on him, too.

The local BJP politicians are also angry with the inspector. “It is not right for the Muslims to bring Hindu girls to the temple,” BJP MLA Rakesh Nainwal is quoted as saying. “They know that it is a temple and it is a pious place.” Rajkumar Thukral, another BJP MLA, is quoted as saying that it was an attempt to hurt the Hindu community’s religious feelings. He questioned the act, saying when Hindus do not go to mosques knowing it is not a place for them, why the Muslims come to the temple.

A  post on the page is in Hindi, dated October 26, 2015 announces that he has a filed a writ petition in the Delhi High Court against what he calls the “media’s provocative and misleading strategy”. He calls on readers to post instances of the media promoting news in a wrong light. “Har jagah gandagi phaila rakha hai in logon ne, aayo inko sabak sikhayen (These people have defiled the atmosphere everywhere, let’s teach them a lesson),” he goes on to add.

Meanwhile, a  lawyers’ body in Delhi district courts today virtually came out in defence of the attackers in black robes in the Patiala House courts, including Vikram Singh Chauhan who was garlanded in Karkardooma courts, to whose bar he belongs. Claiming that certain “outsiders” in lawyers’ robes indulged in violence, the Cordination Committee of all District Court Bar Associations demanded a “fair” inquiry into the incidents. In a shameful expression of defiance in the Karkardooma courts, lawyers held a candle light march for national integrity and against “victimisation” of lawyers. Chauhan, who has been bragging on social media about how the lawyers had taught “anti-nationals” a lesson in Patiala House complex, was reportedly garlanded.
