Saiyada Khatoon of Samajwadi Party (SP) has defeated the incumbent Member of Legislative Assembly (MLA) from Domariyaganj Raghavendra Pratap Singh of the Bharatiya Janata Party (BJP). Khatoon’s victory is a resounding slap in the face of divisive forces, given how Singh had claimed that if he were elected again, Muslims will wear tilaks.

Saiyada Khatoon has won from the Domariyaganj assembly seat  by a margin of  771 votes, polling  85,098 votes against Singh’s 84,327 votes. She had lost to Singh in 2017 by a mere 171 votes and has come back stronger. 

Singh who is said to be devoted to Uttar Pradesh’s chief minister Adityanath, had had an anti-Msulim stance during his election campaign. He had made shocking statements such as, “If you make me MLA again, they (Muslims) will stop wearing skullcaps and start applying tilaks.” Singh also claimed that after he got elected in the last election, “250 acres of land belonging to Muslims got confiscated, their shops destroyed.” He asked the crowds, “Will there be Jai Shri Ram or Walekum Salam in Domariyaganj? Durga ji is here with us, promising once in front of her.” and, “Any Hindu who doesn’t vote for me has Miyan blood!” 

In the run up to elections, the relentless hate mongering of BJP MLA Raghvendra Pratap Singh had been noted by team CJP and another complaint against him was filed before the State Election Commission (SEC) of Uttar Pradesh for delivering another speech during his election campaign. The earlier instance of hate speech was also brought to the attention of the SEC via a complaint dated February 15. Within a week of this complaint, CJP came across another video of Singh, where he was again seen addressing a crowd of voters during one of his campaigns and can be heard saying, “Any Hindu who doesn’t vote for me has Miyan (slang for Muslims) blood in his veins. He’s a traitor. He is a b***ard son of Jaichand. He’s a h****khor son of his father…I am giving warning this time…traitors of Hindu religion will be destroyed.” He added, “Even after this warning of mine, if they don’t understand, I will show you what Raghvendra Singh can do. If you humiliate me I will bear it but if you betray the Hindu society, I will destroy you!”    

The complaint urges that these “serial hate offences and hate crimes are evaluated and acted upon for what they are, not individual misdemeanours but concerted attempts to not only vitiate the social and political atmosphere but –in brazen violation of Indian criminal law and election law –criminally intimidate voters and also indulge in a corrupt electoral practice.”

The complaint also requests the Hon’ble Election Commission to consider it seriously and  apart from issuing a notice to the individual candidate, to also issue a notice to the state and national party in chief of the Bharatiya Janata Party (BJP) as the conduct of several of its own elected representatives puts a responsibility on the party participating in elections held under the mandate of the Indian Constitution to honour and follow its mandate as laid down in both the Preamble and Fundamental Rights (Chapter III).

The complaint also highlightsd that the speeches flagged under the complaint were directly in  violation of Articles 14,15,16,19, 21, 25-30  of the Indian Constitution apart from violating election law and Indian criminal law. Further, it lists various sections of the Model Code of  Conduct, The Representation of People Act, 1951,  Indian Penal Code that have been violated, and cites Supreme Court judgments in its support. CJP has urged the SEC to take cognisance of the serious violation of the above mentioned Acts and take strict action against the BJP. CJP has also prayed that the SEC pass necessary strictures against BJP MLA Raghvendra Pratap Singh, for the abovementioned and earlier violations as well, and also to direct him to issue an unconditional public apology.

It is pertinent to note that the SEC is yet to take action against Singh for either of these violations of MCC flagged by CJP.

Bharatiya Janata Party’s Raghvendra Pratap Singh (55) is a member of 17th Legislative Assembly of Uttar Pradesh of India who represents Domariyaganj constituency in Siddharthnagar district of Uttar Pradesh. Though he is an elected representative answerable to the people, his tone is more like a ‘dabang’ or local strongman as heard in videos circulating on the social media platforms.

In these videos, he can be seen delivering distinctly divisive, hateful and communal remarks during the election campaigns, often delivered in a threatening tone. Most of his speeches veer towards creating a fear of spreading of communal disharmony, and also fuelling targeted hatred against Muslims and Islam. “Topi band hoiba, miyan log tilak lagai ke chalein… aur aap logan se hi kahi hei chacha SitaRam,” Singh had told his voters that if they elect him again, Muslims will [be forced to] stop wearing their skullcaps and start putting Hindu tilaks on their foreheads and say SitaRam as a greeting. 

Social media has flagged his hate speeches often. However, Singh has carried on undeterred, and seems confident that he is above the law for some reason. He has said things like, “They [MusIims] have circumcision, if they look at our ωomen, I will emascμlate & send them to Pakistan… Listen up Maμlanas if any Hindμ is insulted…then I will hit you so hard and get you cμt up so much that even your name will be wiped off.”

Raghvendra Pratap Singh, has now been booked for his hate speech, where he purportedly said, “Tell me, will any Muslim vote for me? So be aware that if Hindus of this village support another side, they have Muslim blood in their veins. They are traitors…” This is the second FIR registered against Singh in the last 10 days, reported Indian Express. According to the news report, police registered the case against the BJP MLA on the basis of a video doing rounds on social media. Singh, has been booked under IPC sections related to promoting enmity between different groups.

Raghvendra Singh, had earlier ‘warned’ that Muslims will have to “wear tilak” if he wins from Domariyaganj, this time was ‘threatening’ to test the DNAs of Hindus who vote for anyone other than him. “Hindus who will not vote for me have Muslim blood in their veins”, Singh had purportedly said in a recent video circulating on social media. He is also in charge of the Hindu Yuva Vahini, and is hoping that such polarising words help him to get re-elected when his constituency votes on March 3. “If I become MLA again, like gol-topis (skull caps) have vanished, next time the miyan log (term used derogatorily for Muslims) will wear the tilak,” Singh had then said.

He has not altered the script much since then and said, “If the Hindu is going elsewhere, then the blood of the ‘miyan’ (derogatory reference to Muslims) is flowing in his veins. He is a traitor and an illegitimate child of Jaichand.” King Jaichand is a favourite reference for the right wing when they want to label someone a “traitor”. According to Singh, if “a Hindu goes to the other side, he should not be able to show his face. How many of you are Jaichands?” He asked the audience gathered to hear him in their village, adding “give me their names and I will get their blood tested to see if they are Hindus or Miyans. I will get their DNA test done.”

Interestingly on February 23, the Aam Aadmi Party’s Sanjay Singh wrote to the Election Commission of India (ECI) to ban Raghvendra Singh from contesting polls because he “used objectionable language against the Hindu community” in his public speeches. Rajya Sabha MP Sanjay Singh wrote, “This is is an insult to the crores of people belonging to the Hindu community. BJP MLA Raghvendra Singh should be banned from contesting the elections. He has insulted the Hindu voter base in the country.” 

Raghvendra Singh had claimed that he made that remark “in another context, as an example” and that he “had no intention to threaten anybody”.  The remaining three phases of polling in Uttar Pradesh will take place on February 27, March 3, and 7. The results will be announced on March 10.

“Topi band hoiba, miyan log tilak lagai ke chalein… aur aap logan se hi kahi hei chacha SitaRam,’’ Bharatiya Janata Party MLA Raghvendra Pratap Singh has been telling his voters that if they elect him again, Muslims will stop wearing their skullcaps and start putting Hindu tilaks on their foreheads and say SitaRam as a greeting. He said this two days ago, perhaps just before campaigning closed ahead of the second phase of polling in the Uttar Pradesh Assembly elections that is due today, February 14.

Raghvendra Pratap Singh represents the Domariyaganj Assembly constituency in Siddharthnagar district of Uttar Pradesh that will go to poll in phase six, on March 3. 

This is an area considered a BJP stronghold however, the incumbent MLA won the 17th Legislative Assembly election of 2017 by a slim margin of only 171 votes, reportedly the lowest margin in that election, defeating Bahujan Samaj Party candidate Saiyada Khatoon.

This election campaign the man has been louder in his anti-Muslim chants during his campaigns. He has also attempted to rouse the crowds with anti-Muslim chanta asking the women in particular to answer his questions “Will there be Jai Shri Ram or Walekum Salam?” It is the “mothers and daughters” he said who will guard their [Hindu] sons “Durga ji is here with us, promise once in front of her.” The crowd can be heard applauding his abusive language.

Singh, continues to add anti Muslim slurs to the mix and says his Hindu opponents were more dangerous than ‘Katw@s’  and calls them “Vote Katw@s”. Implying that the votes going to the Hindu opponents were the same as voting for Muslims, who the candidate seems to be painting as “dangerous”.

He also claimed that since Muslims were ‘no longer in power/ driven away from poser’ the area “has become safer” as according to him “No goons, notorious criminals are visible on the streets now”. He claimed that now “Women and children are able to roam around safely on the streets. These *&%  do not have the courage to look at our women” the crowds were entertained even though. However, National Commission for Women data reported that over half of nearly 31,000 complaints of crimes committed against women were from Uttar Pradesh. 

MLA Singh, meanwhile, also took pride in the changing of names of various places since the BJP came to power, and listed them out. “Allahpur was changed to Mahesh Yogi Nagar,” he said, and added that many more names have also been changed.
