However, this initiative has not been without entrenched opposition, these leading to legal challenges and debates about its necessity and consequences.

Historical Context and Importance of Caste Data:

The historical context of caste-based census in India dates back to 1931, during the time of British colonial rule. This comprehensive census attempted to capture the intricate tapestry of caste identities that make up the social fabric of the country. However, since then, the endeavour to gather caste-related data has been met with various challenges, often rooted in concerns related to “privacy, discrimination, and the potential for political manipulation.” Hidden by these stated concerns, however lies a caste privilege based resistance reluctance to be faced with data that will, in every likelihood, upturb propagandist views.

Despite the passage of time and the evolution of Indian society, the question of caste remains deeply embedded within its social, economic, and political dynamics. The consequences and continued widespread prevalence of the caste system continue to shape access to education, employment opportunities, and even political representation. In recognition of these enduring inequalities, the concept of affirmative action emerged in the form of the caste-based reservation system.

The reservation system was conceived with the intention of addressing historical injustices, ensuring that historically marginalized and oppressed communities receive opportunities for advancement and upliftment. However, the efficacy of this system hinges on the availability of accurate and up-to-date data. Without reliable caste data, it becomes increasingly challenging to implement targeted policies that can effectively address the complex socio-economic disparities arising from centuries of caste-based discrimination.

In this context, the revival of caste-based census is not merely a statistical exercise; it carries significant socio-political and policy implications. Accurate and current data on caste demographics is essential for designing and implementing policies that cater to the unique needs and challenges faced by various communities. Caste as an Intrinsic Marker within Indian Democracy:

Despite the significant changes that accompanied India’s transition to a democratic nation, caste continues to play a substantial role in both social and political spheres, to the extent of causing restrictions and exclusions.

In Indian democracy, caste manifests itself in several ways:

1. Social Identity: Caste remains a central identity marker for individuals in Indian society. One’s caste often determines their social status, access to resources, and opportunities. This stratification has persisted despite constitutional provisions for equality and social justice.
2. Political Representation: Caste affiliations frequently influence political dynamics. Political parties often seek to appeal to specific caste groups to secure votes, leading to caste-based voting patterns. As a result, caste considerations often shape electoral outcomes and the composition of legislative bodies.
3. Economic Inequities: Caste has contributed to economic disparities, with certain castes historically dominating all economic sectors. This has led to unequal distribution of wealth and resources, perpetuating socio-economic divisions.
4. Educational Opportunities: Caste influences access to education, limiting opportunities for marginalized groups. This results in unequal educational attainment levels and reinforces social hierarchies.

Impact on Social and Political Spheres:

The enduring influence of caste has far-reaching implications for Indian society:

1. Social Inequities: Caste-based discrimination and untouchability continue to marginalise certain groups, denying them dignity, rights, and opportunities. This leads to social exclusion, limiting mobility and perpetuating a cycle of disadvantage.
2. Lack of Social Mobility: The rigid caste structure obstructs upward social mobility. Underprivileged caste individuals often face barriers in accessing education, jobs, and other opportunities, constraining their ability to improve their socio-economic status.
3. Fragmented Politics: Caste-based political mobilisation can lead to fragmented and identity-driven politics. While it empowers specific communities, it can hinder broader solidarity and compromise the pursuit of common national goals. However to overcome this, confrontation of existing privileges captured by dominant castes is a pre- requisite.
4. Policy Implementation: The lack of accurate and up-to-date caste data hampers the effective implementation of policies aimed at addressing socio-economic disparities. The absence of a comprehensive understanding of caste dynamics can lead to misallocation of resources.

Nation Builders’ Intentions and Post-Independence Efforts:

The framers of India’s constitution recognised the detrimental impact of the caste system on social cohesion and sought to create a modern, egalitarian nation. With the aim of eradicating caste-based discrimination and inequality, they incorporated provisions for social justice, reservations, and equal rights for all citizens.

However, erasing centuries of caste-based discrimination proved challenging. Despite the idealistic vision of India as a casteless society, the deeply entrenched nature of caste required more than legal reforms. Over time, political leaders recognised that caste could not be ignored, leading to policies such as affirmative action to uplift marginalized communities.

While India has made progress, the legacy of caste endures. The challenge lies in reconciling the aspiration for a modern, inclusive society with the reality of deeply embedded caste identities. Acknowledging and addressing caste-based inequalities is essential for building a truly democratic nation where every citizen enjoys equal rights, opportunities, and dignity.

Current Scenario: The Bihar Caste-Based Census:

The Bihar government’s initiation of a caste-based survey seeks to gather comprehensive data on the socio-economic conditions of various caste groups, with a focus on historically marginalized and disadvantaged communities. The objectives of this survey are multi-fold:

1. Accurate Representation: The survey aims to provide an accurate and updated picture of the distribution and demographics of different caste groups within the state. This would help in developing targeted policies and interventions for addressing inequalities and promoting inclusive development.
2. Policy Formulation: Accurate data is essential for effective policy formulation. The survey intends to provide policymakers with the necessary insights to design and implement programs that uplift marginalized communities, ensuring that resources and benefits reach those who need them the most.

While the Bihar government’s intent to conduct a caste-based survey is laudable, the recent Patna High Court order reflects an opposing view.

The concerns raised by various communities and activists highlight the importance of ensuring that the survey is designed and executed in a manner that respects the identities and rights of all individuals, while also fulfilling its objectives of collecting accurate socio-economic data for effective policy formulation and inclusive development.

Patna High Court’s Ruling:

The Patna High Court’s recent judgment instructed the Bihar government to immediately halt the ongoing caste-based survey. The court’s decision was prompted by concerns raised in petitions filed by various groups and activists. The key issues highlighted in the petitions included data integrity, data security, allocation of substantial funds for the survey, and the overall legality of conducting such an exercise. The petitioners contended that the survey’s approach was flawed and failed to adequately address the concerns of marginalised communities, particularly transgender individuals and Extremely Backward Class groups.

Reshma Prasad, a transgender activist, raised specific objections regarding the classification of the transgender community as a caste in the census, arguing that it misrepresented their identity and further marginalized an already vulnerable population. Other groups from the Lohar community and some from the Extremely Backward Class also expressed concerns about the survey’s methodology and potential consequences.

The court’s interim order to stop the survey reflects the complexity of the issue and the need for thorough examination. The court’s decision has provided an opportunity for the Bihar government to address the concerns raised by various communities and activists and potentially refine the survey’s approach to ensure accurate and comprehensive data collection.

The demand for a caste-based census is growing in political circles, as leaders are making a bee line to meet with, first Home Minister Amit Shah and now the Prime Minister Narendra Modi. 

On August 23, Bihar Chief Minister Nitish Kumar led an all-party delegation from the state to meet the PM. The regional parties, which see an opportunity to mount pressure on the BJP, particularly ahead of the Uttar Pradesh elections, are reportedly planning to send another delegation to the PM with the same demand later this week, reported Indian Express.

The government, during Parliament has always skirted the issue and about the data collated in the socio-economic survey of 2011, it says that no decision has been made on whether or not to share this data. However, the government made its stand clear that it will not enumerate caste-wise population other than SCs and STs in the impending Census.

Even the National Commission for Backward Classes urged the government to collect data on the population of OBCs during the Census 2021.

The political view

In the run up to the UP state assembly election that will be held next year, the demand for caste-based census has gained momentum. More and more regional parties including the YSRCP, BJD, SP, NCP, BSP, PDP, National Conference, DMK, AIADMK, TRS, Left parties and TMC are lending support to this demand.

CPI (ML) MLA Mehboob Alam said, “I told the PM that there should be a census of people of all religions and castes. Muslims too have many castes. There are about one crore Surjapuri Muslims in the Seemanchal belt. Though the Bihar government puts them under OBC, the Centre does not acknowledge them.”

In the 2009 Lok Sabha elections, 22% OBCs voted for the BJP while 42% voted for regional parties. But within a decade, the support base of the BJP among the OBC seems to have changed dramatically. During the 2019 Lok Sabha elections, 44% OBCs voted for the BJP while only 27% voted for the regional parties, reports IE.

Sanjay Kumar, Co-Director of Lokniti, a Research Programme at the Centre for the Study of Developing Societies, speculated that BJP’s reluctance of conducting a caste census stems from the census unravelling different castes amongst OBCs giving reasons for regional parties to mount pressure on the government to rearrange reservation quota and could also give a news lease of life to regional parties and give them a chance to dominate state Assembly elections.

The Centre’s reluctance to enumerate all the castes stems from precisely the apprehension that it will lead to an insistence on another Bill in order to bypass the legal ceiling and grant quotas proportional to the OBC population that might forever marginalise the influence of the savarnas, the core support base of the Rashtriya Swayamsevak Sangh (RSS) and the BJP, writes Radhika Ramaseshan for The Tribune.

The 2011 caste census raw data was handed over to the Ministry of Social Justice and Empowerment, which formed an Expert Group under former NITI Aayog Vice-Chairperson Arvind Pangaria for classification and categorisation of data. However, it is unclear whether any report was submitted. Tracing the history of caste-based census takes us back to 1931 when the last enumeration of castes was released, any other caste based census carried out after that has been under wraps as the data has not been released to date. Even the Mandal Commission based its findings on the 1931 data and determined that the OBCs constituted 52% of the Indian population. Certainly, data is bound to have changed 90 years later and it could lead to a political stir-up and demands for change in reservations will rise.

There is rising pressure on the Karnataka government as well, to release the caste census data from 2015. The Siddaramaiah-led Congress government in Karnataka commissioned the “Socio-Economic and Education Survey”, in 2015 at a cost of around Rs. 150 crore.

“If the census is done,” a senior BJP leader who is a state minister told IE, “it could reveal the fact that socially backward communities along with SCs and STs constitute more than 80 per cent of the population. So the concept of quota could have to be rethought.”

The socio-economic view

Even though caste drives the socio-economic arena in the country, right from birth, education, access to welfare, jobs, livelihood opportunities, housing, customs, right up to death, the lack of accounting the data on such communities and categorising them as presentable data is surprising. Census data accounts for Scheduled Castes, Scheduled Tribes, religions and linguistic profiles but profiling of the castes is non existent since 1931.

Certainly, the basic argument is that such data will enable better policies and implementation of such policies enabling access to those who are in need of welfare programmes. If the ultimate social aim is to do away with caste, it is important to first identify its existence by counting the population belonging to each of these castes. Although, the political aim of a caste census has never been the annihilation of caste but only appeasement and vote bank.

Rest assured that caste can never be eliminated as long as religion exists, but to bring these castes to parity and equity in a democratic and empirical manner is what we can hope to achieve.

The Justice Rohini Committee of 2017 was set up to look into sub-categorisation of the OBC communities but in the absence of data on castes, this further categorisation is a distant dream.

The 50% cap that was imposed by the Supreme Court, on reservations, is quite arbitrary given that no data to account for castes even exists.

Yogendra Yadav, the political scientist and politician, has argued that the “caste order” fears a caste census since it would expose the “social, educational and economic privileges of the upper-caste Hindus”. It is opined that the reluctance stems from the data indicating that the upper caste population is staggeringly low which would bolster a movement for changes in reservation as high posts in governance, judiciary are usually found to be held by upper castes.

The collection of data of castes, which is a prevailing truth of Indian society has caused such a stir up among party lines, that even members of the ruling government are pushing the demand. As discussed above, the Union government’s reluctance is evident and it fears the data will shake up the socio-political scene in the country. However, a stir-up is impending, considering we are still following numbers collected about a century ago and development policy calls for fresh enumeration to encourage parity and equity. But will the ruling government swallow this bitter pill?

Member of Rajya Sabha, Dr. Anbumani Ramadoss, asked the Ministry of Home Affairs (MHA) whether the Union has any proposal to release the categorised and classified Socio Economic and Caste (SECC) 2011 data, caste-wise and region-wise of Other Backward Classes (OBC) and General Category other than Scheduled Castes (SC) and Scheduled Tribes (ST).

Further, he also questioned the Centre whether they have any proposal to conduct the 2021 population census on caste basis including the castes falling under OBCs and General Category along with SCs and STs.

In a written statement provided by the Minister of State (Home Affairs), Nityanand Rai said that the SECC 2011 data was first conducted by the Ministry of Rural Development (MoRD) and then the Ministry of Housing and Urban Poverty Alleviation (HUPA) in both rural and urban areas.

“The SECC 2011 data excluding the caste data have been finalized and published by MoRD and HUPA….The raw caste data was provided to the Ministry of Social Justice and Empowerment (MoSJE) for classification and categorisation of the data. As informed by MoSJE, there is no proposal to release the caste data at this stage,” stated his answer.

In response to another set of questions posed by Rajya Sabha members Chhaya Verma, Vishwambhar Prasad and Sukhram Singh Yadav about a column for caste census in the proforma for the proposed Census 2021, the Ministry of Home Affairs said, “The Union of India after independence, decided as a matter of policy not to enumerate caste wise population other than SCs and STs.”

Interestingly, last month in February, the Supreme Court had issued a notice to the government on a petition seeking caste-based census in 2021. The plea that was filed by one G Mallesh Yadav, sought directions to be issued to the Ministry of Home Affairs, Department of Social Justice and Empowerment, and the National Commission of Backward Classes (NCBC) for conducting a caste-wise census for backward classes in 2021.

Yadav has argued that the caste-wise census of backward classes has an imperative role in implementing reservations regarding education, employment sectors, panchayat raj elections and municipal elections and lack of such census creates problems in deciding the percentage of reservations for backward classes proportionate to their population. His plea before the top court also states that a proforma of 2021 population census has columns for Scheduled castes and Scheduled Tribes but not for OBCs.
