A Delhi court modified the conditions in the January 16 dated bail order allowing Bhim Army Chandrashekhar Azad to enter the national capital for medical and election purposes by informing the police about his schedule prior to his visit.

Chandrashekhar Azad was arrested under charges of allegedly inciting violence during the anti-Citizenship Amendment Act (CAA) at Jama Masjid. He had been in custody for 25 days and had initially even been denied proper medical attention, following which he filed for a bail application.

Though the court had rebuked the police and established that the police couldn’t collect any substantial evidence against Azad, it had placed a one-month ban on Azad and restricted him from entering Delhi and asked him to appear before a police station in his native of Saharanpur in Uttar Pradesh every Saturday for a month.

However, at the time of granting bail, the court had remarked that Azad could always use his liberty to seek modification of bail conditions imposed on him by furnishing a Delhi address.

He then contended the order and filed an application on January 18 saying that he wasn’t a criminal and imposing such restrictions on him was undemocratic. The application further stated that since Azad has a local residence in Delhi and being an activist, such restrictions imposed on him, affects his fundamental rights, reported India Legal.

“Chandrashekhar Azad is a leader of the oppressed and depressed sections of society, including minorities and was working for their social and political awareness,” the plea said, adding that he holds weekly meetings of the society ‘Bhim Army Ekta Mission’, of which he is the founder, at his local address in Delhi,” says the plea filed by advocates Mehmood Pracha and O P Bharti.

The application further said that Azad travels throughout the country for the cause he’s working for, hence it would be difficult for him to personally appear before the SHO to report his presence.

The Additional Sessions judge Kamini Lau has asked the Delhi police to verify from the Election Commission of India whether the address he has provided is of an office or a political party and submit a report by January 21st.

Live Law reported that the judge’s order said, “In democracy when election is the biggest celebration, which should have maximum participation, it is fair that he should be allowed to participate.”

The judge has also asked him to reside at the address provided by Azad whenever he is in Delhi, mark his attendance before the Delhi DCP if he happens to be in the capital on Saturday and inform the DCP telephonically about his location if he isn’t in Delhi or Saharanpur.

The judge also discared the prosecution’s submission against him in charges of hate speech as there was no mention of the same in the FIR. The court also recorded in its order that there was no material to suggest that he had indulged in anything that was against law and order, public order or national security.

The fight for Dalit rights has taken a louder voice now more than ever before. We all know of Dr. Babasaheb Ambedkar as being the pioneer of the Dalit movement in India and there are people who have carried his legacy through. Thus, Dalits have found their place in society through politics and activism which has gone a long way in bringing the Dalit voice to the forefront. Assertion of Dalits for achieving equality has increased over the years.

“Indifferentism is the worst kind of disease that can affect people,” said Babasaheb in one of his writings and this has been imbibed by Dalit leaders and activists who followed him and who are still continuing their work for upliftment of Dalits.

Here’s a look at modern day Dalit leaders and activists who will continue to highlight Dalit issues and reform the community:

Chandrashekhar Azad

Born in Ghadkhauli village, Sahranpur, Uttar Pradesh, Chandrashekhar Azad is known to have come to prominence after he put up a board outside his village “The Great Chamars of Ghadkhauli Welcome you”.

He is a law graduate and he along with Vinay Ratan Singh co-founded the Bhim Army or the Bhim Army Ekta Mission to fight for the development and upliftment of Dalits and other marginalized sections.

Bhim Army is an unregistered organization and claims to have over 40,000 members across 7 states. It also runs around 300 schools. He was arrested in 2017 for fanning protest by Dalit Community in Saharanpur and was released more than a year later. He was booked under the National Security Act.

He was recently granted bail by a Delhi Court recognising his right to protest as a constitutional right as he was part of anti-CAA protest at Jama Masjid in Delhi. Even when the police were trying to arrest him, he had managed to give them a slip and had emerged in another protest.

Jignesh Mevani

Jignesh Mevani rose from being a grassroots activist to an elected Assembly member in Gujarat. His rise to popularity was when led the Dalit Asmita Yatra after a video of Dalit men being stripped down and being whipped in Gujarat’s Gir Somnath district went viral. He coined the slogan, “Gai ki loom aap rakho; hume humaari zameen do (You may keep the cow’s tail, give us our land)”.

He considers himself primarily to be an agitator who decided to enter politics to be able to raise issues from a non-compromising position. He has a deep interest in writings of Karl Marx and Babasaheb Ambedkar and the same is reflected in his oratory.

His demand has been that every landless Dalit should get 5 acres of land, which according to him is rightfully theirs. He has earlier worked as a reporter and has a degree in law.

 

Dr. Ruth Manorama

As per Dr. Ruth Manorama, who is a Dalit women’s rights activist, the condition of Dalit women is the worst as they suffer from triple alienation due to their caste, class and their gender. So Dalit women don’t just have to fight upper class oppressors but also men from their own community.

For her work, Manorama has received the Right Livelihood Award in 2006 for “her commitment over decades to achieving equality for Dalit women, building effective and committed women’s organizations and working for their rights at national and international levels.”

She has been actively involved in educating, organizing and mobilizing women, Dalits, urban poor and the unorganized sector from the grass-root to the National levels. She is also the recipient of Dr. B.R. Ambedkar Award for doing work among women and Dalits in Karnataka.

 

Bezwada Wilson

Wilson, himself a Dalit, has vehemently campaigned against the inhuman practice of manual scavenging. He has played a role in saving and helping rehabilitate 3 lakh manual scavengers. He comes from a Dalit family in Kolar who were involved in manual scavenging for generations. He is the national convenor of Safai Karmchari Andolan. He also got a Supreme Court judgment to his credit which directed all States and UTs to provide compensation to families of people who died cleaning sewers. He is a recipient of the prestigious Ramon Magsaysay award.

He was pivotal in getting the Kolar Gold Mines to demolish dry latrines which had to be cleaned by people from his community, including his father and brother. Speaking about the beginning of his journey of caste consciousness, he said, “For the first time, I understood that we are scavengers not because we are illiterate or poor but because we are born into a caste. I started relating all my personal experiences to this history of my people.”

 

Kiruba Munusamy

Kiruba is the first Dalit woman lawyer from Tamil Nadu to practice law in the Supreme Court. She has started a training centre for human rights litigation where lawyers, including women from disadvantaged communities, can be trained with professional skills and provided with a co-working space to act independently. She grew up facing caste discrimination first hand; once in the queue for drawing water from the public tank she moved a pail of water and a higher caste girl poured it all out and cleaned it only because Kiruba had touched it.

She finds inspiration from Babasaheb Ambedkar’s quote, “Cultivation of mind should be the ultimate aim of human existence.” Through her activism she works for the annihilation of caste and supports Dalit women empowerment, indigenous rights, LGBTQI rights, minorities, advancement of disadvantaged groups, and freedom of expression. Apart from the legal framework, she organizes and conducts awareness campaigns, workshops to bring awareness and educate the downtrodden, sexual minorities (LGBTQI) and Dalit women about their fundamental human rights and legal remedies on violation.

New Delhi: While hearing the bail request of Bhim Army chief Chandrashekhar Azad aka “Raavan”, arrested for his protest last month against the citizenship law at Jama Masjid, a Delhi court today asserted that “it is one’s constitutional right to protest” and people were out on streets because “inside parliament, things which should have been said were not said”.

The judge, questioning Delhi Police on the charges listed against Chandrashekhar Azad, said: “You are behaving as if Jama Masjid is Pakistan. Even if it was Pakistan, you can go there and protest. Pakistan was a part of undivided India.”

The Bhim Army chief was arrested on December 21 over a dramatic protest a day before at the iconic Jama Masjid in the old quarters of Delhi, where he surfaced suddenly despite heavy police presence and slipped away after being taken into custody. He was arrested a day later and charged with arson and rioting.

The public prosecutor, representing the police, got off to a rough start when he pleaded ignorance about the First Information Report listing charges that Azad faces in Uttar Pradesh. Additional sessions judge Kamini Lau, who had asked for details of these charges, expressed surprise when the prosecutor said he would “find out”.

The prosecutor also referred to Azad’s social media posts to argue that he had incited violence. When the prosecutor read out a post by the Bhim Army chief about going to a dharna in Jama Masjid, Judge Lau said: “What is wrong with a dharna? What is wrong with protesting? It is one’s constitutional right to protest.” The judge continued: “Where is the violence? What is wrong with any of these posts? Who says you cannot protest…have you read the constitution?”

None of the posts were unconstitutional, said Judge Lau.When the prosecutor argued that “permission needed to be taken” for such protests because Section 144 was in place, the court shot back: “What permission? Supreme Court has said repeated use of Section 144 is abuse”. Last week, the Supreme Court has said in a significant order on restrictions in Jammu and Kashmir that Section 144, a British-era law banning large gatherings, “can’t be used as a tool to oppress difference of opinion”.

The judge said she had seen protests even outside parliament. “I want you to show me under which law is it prohibited for someone to prohibit outside religious places,” she said, asking for evidence of violence by Azad. “We have drone footage and also evidences showing Azad giving an inflammatory speech,” said the prosecutor, requesting more time to produce the proof and other details. The case will resume tomorrow.

In his bail application, Azad had said the police had invoked “boilerplate” charges against him and arrested him “mechanically” without following the due process of law. He also alleged he had been falsely implicated. The judge’s remarks are significant in the context of the protests across the nation by college students, activists and opposition parties against the religion-based Citizenship (Amendment) Act or CAA. The government says the CAA will help non-Muslim minorities from three Muslim-dominated neighbours – Pakistan, Afghanistan and Bangladesh – to become Indian citizens easily if they fled to India before 2015 because of religious persecution. Critics fear the CAA discriminates against Muslims and violates the secular principles of the constitution.

Saket Sessions Court today granted bail to Bhim Army chief Chandrshakehar Azad Ravan, two months after his arrest. Bhim Army has alleged that the granting of bail was timed with the conclusion of electioneering in two states that are going to the polls on Monday, Haryana and Maharashtra.The organisation has alleged that the ruling BJP “feared” that Azad’s campign in these states would dent its prospects.

Sabrangindia had reported that the arrests of the chief of Bhim Army and 90 others followed their vociferous protests against the “fascist actions of the BJP Government” against the activists who participated in protests opposing the demolition of the Ravidas temple in Delhi and have targeted subsequently. When the organisation had tried protesting a total of 96 persons had been arrested. A statement of Bhim army had said, ” Despite our repeated attempts, the 96 people unlawfully arrested on August 21 continue to be prosecuted. We demand the immediate release of these innocent people who are hounded and targeted relentlessly for the simple fact that they dared to stand up for the rights of the marginalised. We also demand that the temple be reconstructed at the exact same place.”

On August 22, the police resorted to lathi charge to disperse the protesters who had gathered to protest the demolition of the Ravidas temple, a revered place for Dalits. The protesters carried on a march from Ambedkar Bhawan in Jhandewalan to Ramlila Maidan in central Delhi. On the same day, Bhim Army chief Chandrashekhar Azad and more than 90 protesters were detained.

 
The incident had triggered anger among the residents of the village, mostly from the Dalit community. The villagers, led by members of Bhim Army, staged a protest against the demolition on the same day. The protesters had also blocked the Behat-Saharanpur road and chanted slogans against the government. The angry protesters demanded that the people responsible for vandalising the statue be arrested immediately and also called for the installation of a new statue of Ambedkar.

The temple was demolished in earlier in August by the Delhi Development Authority (DDA) which comes directly under the authority of the Central government. It was ordered to be demolished on the plea of encroaching forest land, even though the temple was nearly five centuries old. This 15th century temple located in a forested area was dedicated to Sant Guru Ravidas, a spiritual saint and a poet highly revered by many people and especially Dalit communities in North India.

 

The Ravidas Mandir is of particular spritual and real significance to Dalits in north India.

Following the massive protests against the demolition of the Ravidas temple in Tughlaqabad, dalit leader Chandrashekhar Azad was picked up by the police and beaten up inside the Kalkaji police station, the Bhim Army has alleged. Speaking to Sabrangindia, Vipin Gouraiya of the Bhim Army Student Federation said, ‘near the Okhla metro station a senior police officer told us everything is alright and you can march to the temple. However when we reached the temple  we saw some bikes burning , the police started firing in air and picked up Chandrashekhar Azad and Vinay Ratan Singh without informing anyone. They tied him up and beat him up with lathis all night long’. Over ninety people from the Bhim Army were arrested for rioting. He also said that while others were also beaten up in lock up, Chandrashekhar Azad was the ‘main target’. Five more young boys were picked up by the police next day when they raised ‘Jai Bheem’ slogans on seeing Chandrashekhar Azad, he alleged. Speaking to Sabrangindia, SHO Kalkaji, Atul Kumar denied all allegations and said, ‘Hundreds of people were detained, their lawyers had come along, how is it possible ? A medical was also done and he was produced in front of the magistrate’. Azad has allegedly been booked under the Arms Act among many other provisions of law. He has been sent to Tihar Jail. The Bhim Army is holding a press conference at 4PM today at Women press club in Delhi to throw more light on the matter.

Bhim Army chief Chandrashekhar Azad has raised questions about the fairness and efficacy of conducting elections using electronic voting machines (EVM) instead of the older method of paper ballots.

Speaking at a press conference in New Delhi, Azad claimed, “Since the country has entered into the first phase of general elections, the news and the social media are filled with reports of the malfunctioning of EVMs at unprecedented levels and the complaints about the reliability of the EVM-VVPAT machine.”

He further highlighted the provisions of section 49 MA of the Conduct of Election (Amendment) Rules 2013 that punish voters who complain against a mismatch in who they actually voted for and what appears in the VVPAT slip. 

According to a press release issued by the Dalit Adivasi Shakti Adhikar Manch (DASAM) and other groups and individuals who organised the press conference, “In the eventuality of a voter’s complaint about a wrong choice printed in the VVPAT slip, the presiding officer asks the voter to cast a test vote in the same machine in the presence of all polling officials and representatives of candidates. In the test vote, if it turns out that the VVPAT correctly displays the choice cast in the machine, the ECI declares the voter‟s complaint as false and files charges under section IPC 177 where the voter potentially faces prison terms up to six months. The testing method outlined in the section 49 MA is irrational as it fails to distinguish true and false complain in objective manner.”

This follows a letter by electoral reforms activist Philose Koshy to the Election Commission of India highlighting this exact problem and requesting that the penal provisions be set aside. Citizens for Justice and Peace had also written to the ECI supporting Koshy’s appeal. Koshy had brought up how the provision completely ignores the possibility of hacking of or a malfunction in the EVM.

New Delhi: Bhim Army Chief Chandrashekhar Azad said he will fight the upcoming Lok Sabha elections from whichever seat Prime Minister Narendra Modi contests from in Uttar Pradesh. Even if it is from the Varanasi Lok Sabha seat, he said he doesn’t want Modi to win the election by fighting against weak candidates.
 
“I am afraid that a weaker candidate should not contest against Prime Minister Narendra Modi, by defeating whom he easily walks into the Lok Sabha. I will not let the murderer of my Muslim, Dalit and OBC brothers go to the Lok Sabha from Uttar Pradesh,” said Azad.
 
He said that Congress leader Priyanka Gandhi visited and enquired about his health.
 
“She asked about my health and well being. She came on her own and I did not invite her, I will not invite others also,” he said.
 
Congress General Secretary for UP (East) Priyanka Gandhi Vadra who met Bhim Army chief Chandrashekhar undergoing treatment at a hospital said that the meeting has no political implications but is rather her support to the voice of a youth fighting against the central government.
 
“It is to be seen from the perspective that he is a youth and is struggling. He is raising his voice and saying to society to hear his pain. But this government is so arrogant that it wants to suppress the youth. The government doesn’t want to hear the voice of youth,” said Priyanka Gandhi.
 
Chandrashekhar Azad and his supporters were taken in custody on Tuesday for allegedly violating the model code of conduct by using more than the stipulated number of motorcycles in a political rally.
 
Chandrashekhar was taken ill soon after being detained, following which he was admitted to Anand Hospital in Meerut.
 
They were taken into custody when they were planning to take out a procession to Muzaffarnagar on motorcycles and other vehicles, in violation of the model code of conduct, set in since announcement of poll schedule by the Election Commission of India.
 
Senior Superintendent of Police Dinesh Kumar said: “Azad organised a rally and violated the Model Code of Conduct on Monday. The local officials tried to stop them, but he continued with his rally. He was held for four hours in a private school.”
 
Police said the rally had been organised without required permission at Kasimpura village by Azad. When the police tried to stop the rally, they resisted and later blocked Muzaffarnagar-Saharanpur highway.
 
On Tuesday, Azad started a ‘Padayatra’ from Saharanpur to Delhi and announced to address a rally in New Delhi on March 15.

Deoband: Bhim Army chief Chandrashekhar Azad has been arrested from Deoband in Uttar Pradesh, triggering a standoff between the police and his supporters who aren’t allowing the vehicle to move towards the police station, News18 reported.
 
As per initial reports, the Dalit leader wanted to leave for Delhi to attend events on Kanshi Ram’s birth anniversary on March 15 but was denied permission for the same.
 
Azad had last week announced that his outfit would support candidates who contest against Prime Minister Narendra Modi and Union minister Smriti Irani in upcoming Lok Sabha elections. Azad had also questioned Samajwadi Party chief Akhilesh Yadav over his father Mulayam Singh’s remarks in Parliament wishing a second term for Modi, the report said.
 
Azad was released last year after being jailed under the National Security Act (NSA). He had been arrested from Himachal Pradesh in June 2017 in connection with the May 5 caste violence in which one person and 16 others were injured at Shabbirpur village in UP’s Saharanpur.
 
Azad has been touring the country to organize the Dalit and Bahujan communities to demand their representation in policies.

Chandrashekhar Azad led Bhim Army is organizing a protest rally at Jantar Mantar, New Delhi on March 15 to express Bahujan resentment for tribal evictions and the 13 point roster. Addressing the rally, Azad will take aim at the govt’s inaction and unwillingness to address the concerns of the community.


 
The Bahujan community has been angry with the central government’s inaction and collusion over stripping and diluting the SC/ST/OBC reservations. After the Supreme Court ordered the eviction of tribals from forest lands on Feb 13, there have been many protest rallies across the nation. The forest-dwelling Adivasi communities have been demanding their rights over water, forests and land. The move to erase SC/ST/ OBC representation in universities is taking full force due to the 13 point roster. The Bahujan community has been organizing and facing obstacles in voicing their sentiments ever since their rights have come under the scanner. Bhim Army is again engaging at the grassroots level to pressurize the centre to keep Bahujan sentiments at the fore of their policies.
 
Chandrashekhar Azad led Bhim Army is organizing a ‘Bahujan Hunkar rally’ at Jantar Mantar, New Delhi on March 15 to express Bahujan resentment for tribal evictions and the 13 point roster. Addressing the rally, Azad will take aim at the govt’s inaction and unwillingness to address the concerns of the community.

He will demand the restoration of the 200 point roster, a stay on the eviction of tribals and release of youths arrested under NSA on April 2. Bhim army has urged all its social activists to organize, unite and make the rally a success for future generations.

Lucknow: After Samajwadi Party (SP) and Bahujan Samaj Party (BSP) announced their alliance on Saturday for upcoming Lok Sabha elections, Bhim Army chief Chandrashekhar Azad extended his support for the alliance albeit with reservations.
 
In a Twitter post on Sunday, Azad said that the SP-BSP alliance should have included the Rashtriya Lok Dal (RLD) for its fight against the BJP.
 
He said, “I am not going to contest any elections and I absolutely support the alliance as our main objective is to defeat the BJP in the 2019 Lok Sabha Elections. All political parties who want to save the Constitution must come together, then only the BJP can be defeated. Thus, the RLD should also have been included in the SP-BSP alliance.”


 
Once-arch rivals, SP and BSP announced their tie-up in Uttar Pradesh for the upcoming Lok Sabha polls, sharing 38 seats each and keeping the Congress out of the alliance. The alliance left only two seats for others.
 
However, sources from RLD on Sunday told News18 that the party is still negotiating with the alliance leaders. “RLD is a partner, we fought with SP in Kairana. We will get more seats. Mayawati is unlikely to be flexible and give up any of her 38 seats, so we will reach out to Akhilesh. We may get more seats from SP’s kitty,” sources said.
 
In December, Azad had expressed the same sentiments at the ‘Agenda Aaj Tak’ event in New Delhi. “We will not allow the Congress and the BJP rule alternatively (in the country) … The third front will rise and we will strengthen the Bahujan movement. We will also make the BSP go back to ‘Bahujan hitaya’ from ‘Sarvjan hitaya’,” he said.
 
Asked about which party the Bhim Army would support in the 2019 parliamentary polls, Azad said, “There are the Samajwadi Party and the Bahujan Samaj Party (BSP) in Uttar Pradesh, Tejashwi (Yadav’s) party (RJD) in Bihar, (and) Rashtriya Lok Dal (RLD). I will find others in Rajasthan and Madhya Pradesh.”
