On January 20, 2025, Citizens for Justice and Peace (CJP) filed a complaint with the Chief Electoral Officer (CEO) of Delhi, R. Alice Vaz against BJP leader Nazia Elahi Khan. The complaint addresses her deeply inflammatory and hate-filled speech delivered on January 5, 2025, at an event organized by the Hindu nationalist group “Chetna” in Rohini, Delhi. In her speech, Khan made derogatory and divisive comments aimed at Islam and Muslims, which were not only offensive but also a clear violation of the Model Code of Conduct (MCC) as well as provisions of the Representation of the People Act, 1950. The complaints specifically highlight violations that could disrupt public peace, affect the communal harmony, and influence the Delhi Assembly Elections 2025.

Background of the Speech

The event took place on January 5, 2025, in Rohini, a region of Delhi that is home to a diverse population. Nazia Elahi Khan, a leader affiliated with the Bharatiya Janata Party (BJP), addressed a gathering organized by the Hindu nationalist group “Chetna.” The speech quickly turned controversial as Khan launched into a tirade filled with derogatory statements targeting the Muslim community. What began as a political address soon devolved into a vicious and divisive rhetoric that sought to dehumanize Muslims and propagate harmful stereotypes.

CJP’s Complaint to the CEO, Delhi

In its complaint, CJP sought the immediate attention of the Chief Electoral Officer, Delhi, citing multiple violations of the MCC, which prohibits speeches or activities that incite communal violence, disrupt public peace, or foster distrust between communities. The CJP detailed the content of Khan’s speech, emphasizing how it:

  • Incited communal hatred by making sweeping, baseless generalizations about Muslims, painting them as inherently violent and criminal.
  • Violated the ethical and moral guidelines of the Model Code of Conduct, particularly its call for leaders to avoid using religion, caste, or community-based appeals to influence voters.
  • Violated Sections 123(2), 123(3), and 123(3A) of the Representation of the People Act, 1951, which prohibits the use of religious or communal appeal to garner votes and ensures that political discourse remains centred on governance and policy issues.

CJP argued that Khan’s speech, especially during the critical period leading up to the Delhi Assembly elections, had the potential to destabilize the social fabric, incite communal violence, and polarize voters along religious lines.

Key violations highlighted by CJP in its complaint:

The CJP’s complaint meticulously pointed out the specific sections of the speech that violated both the MCC and the Representation of the People Act, 1951.

Stereotyping Muslims as violent and criminal

Khan’s speech included inflammatory statements targeting Muslims as a group. She falsely stated that Muslims were inherently violent, associating them with rape, terrorism, and “love jihad.” One of the most disturbing sections of the speech, transcribed as follows, demonstrates this:

“Tell them (Muslims) to get education, they will not! Tell them to become human, they will not! Tell them to study, they will not study! Tell them to do something, they will not do it! But if you tell them to rape, they will do it immediately. Tell them to do love jihad, they will do it immediately. Tell them to throw bombs, bullets, and ammunition! They will throw it immediately. Tell them to create terror, they will do it immediately.” She said

This statement not only perpetuates damaging stereotypes but also accuses an entire community of violent tendencies based on their religion. Such claims are deeply misleading, devoid of any factual basis, and incite animosity among communities. This is a clear violation of the MCC, which mandates that political leaders refrain from using inflammatory speech that could disturb public peace or harmony, CJP stated in its complaint

Derogatory remarks about Islamic practices

BJP leader Khan during her speech said, that “Tell them (Muslims) to get education, they will not! Tell them to become human, they will not! Tell them to study, they will not study! Tell them to do something, they will not do it! But if you tell them to rape, they will do it immediately. Tell them to do love jihad, they will do it immediately. Tell them to throw bombs, bullets and ammunition!

Here, the speaker engages in harmful stereotyping by accusing Muslims of being inherently violent and prone to terrorism. By falsely associating the Muslim community with rape, “love jihad,” and terrorism, the speech spreads misinformation and incites fear and hatred.

“They will throw it immediately. Tell them to create terror, they will do it immediately. What is it after all? What is there in this community? What is the secret of that heavenly book, that Al-Quran, which is a community that has been troubling people of all religions in the world” she said.

CJP said that this speech is deeply problematic and derogatory, especially during the period of the Delhi Assembly Elections 2025. The speaker makes sweeping and false generalizations about the Muslim community, portraying them as inherently violent, criminal, and prone to terrorism. By linking Muslims to heinous acts such as rape, “love jihad,” and terrorism, the speaker promotes harmful stereotypes that incite fear and hostility. These divisive and baseless accusations are not only factually incorrect but also inflammatory, creating an atmosphere of mistrust and hostility between communities.

“During a pre-election period, such statements are highly dangerous as they have the potential to polarize voters based on religion, undermining the principles of free and fair elections. Elections should focus on issues of governance, policy, and development, not on spreading hate and division. The speech directly violates the Model Code of Conduct, which calls for peaceful and respectful discourse, and jeopardizes the social harmony needed for democratic participation. By targeting an entire community with such derogatory remarks, the speaker seeks to manipulate voter sentiment through fear, rather than fostering an informed, inclusive, and fair election process” CJP stated in its complaint

The divisive “Us vs. Them” narrative

Khan went further to attack Muslim religious and cultural identity, attempting to create a sharp divide between Muslims and Hindus. She asserted:

“I know that the way people of Sanatan Dharma read Ramayana, Mahabharata, Shrimad Bhagwad Gita, there is peace inside them, there is humanity inside them, there is a yearning for forgiveness inside them. But you will have to ask for the address of the lane you don’t want to go to, you will have to explain to your daughters that no Abdul is good.”

Here, Khan made a derogatory and sweeping generalization about Muslims, labelling them as inherently dangerous to society. This remark not only sought to disparage Muslims but also propagated a culture of fear and mistrust among Hindus, encouraging religious polarization.

CJP mentioned in its complaint that Khan’s speech shifts the focus of the elections from governance and development to divisive identity politics. Her rhetoric promotes communal anxieties, leading voters to make decisions based on religious biases rather than critical issues like economic growth or healthcare. This practice deepens communal divides and erodes trust in democratic institutions, potentially inciting social unrest in a diverse city like Delhi.

Violation of MCC and People’s Act

Further, Khan’s speech violates multiple provisions of the MCC, which mandates a peaceful and fair electoral process. Her inflammatory language, which appeals to religious sentiments and incites communal tensions, breaches MCC guidelines related to general conduct and election campaigning. These actions distort the democratic process and jeopardize public peace and harmony. Under the Representation of People Act, 1951, Khan’s speech constitutes a violation of Sections 123(2), 123(3) and 123(3A), as it involves undue influence and appeals based on religion. Additionally, her remarks breach provisions under the Bharatiya Nyaya Sanhita (BNS), promoting enmity and causing fear or alarm among communities, leading to potential legal action, CJP stated in its complaint

CJP urged the CEO to take immediate action against Khan, including issuing a public censure, prohibiting her future campaigning in Delhi, and investigating the BJP for promoting divisive rhetoric. Monitoring of political speeches should also be increased to ensure compliance with the MCC and uphold the integrity of the electoral process.

However, on January 10, 2025, CJP also filed a complaint against BJP councillor Ravinder Singh Negi (Vinod Nagar – 198) for delivering an anti-Muslim, communal speech during an election campaign event in Patparganj Assembly Constituency on January 6, 2025. The speech, aimed at securing votes, incited communal tensions and violated the Model Code of Conduct. CJP called for immediate action, stressing the detrimental effect such rhetoric could have on Delhi’s communal harmony, particularly in the context of the upcoming 2025 Delhi Assembly elections.

In a complaint addressed to the Jharkhand State Election Commission, Citizens for Justice and Peace (CJP) has raised serious concerns about the divisive rhetoric employed by BJP leaders Naveen Jaiswal and Shivraj Singh Chouhan during an election rally in Ranchi, Jharkhand, on October 24, 2024. As Jharkhand prepares for its state elections, CJP asserts that these speeches have severely compromised social harmony and threaten the democratic values that elections should uphold.

The complaint highlights how the two leaders’ speeches deviated from issues of development, such as healthcare, employment, and infrastructure, in favour of stoking fear and communal divisions. CJP argues that this rhetoric violates both the Model Code of Conduct (MCC) and provisions under the Representation of People Act (RPA), 1951, particularly Section 123, which prohibits corrupt practices in elections, including attempts to sway voters through communal or religious division.

In his speech, BJP MLA Naveen Jaiswal framed the election as a defence against an alleged “takeover” of Jharkhand by “Bangladeshi infiltrators and Rohingya Muslims,” accusing the ruling JMM-Congress coalition of enabling these communities to settle illegally. By portraying Muslims as an existential threat to Jharkhand’s indigenous culture, Jaiswal’s statements urged Adivasi and indigenous communities to vote based on fear, rather than on traditional governance issues.

Shivraj Singh Chouhan, Minister of Agriculture, echoed and intensified these sentiments, alleging that Bangladeshi immigrants were “stealing” resources, jobs, and even deceiving local women into marriage as a means to gain a foothold in Jharkhand. Chouhan further suggested that these individuals were compromising Jharkhand’s safety and warned that allowing the JMM-Congress government to continue would lead to the state’s “destruction.” His portrayal of an “invasion” of local resources and values by Muslims, CJP contends, is a dangerous exaggeration that fuels xenophobic fears and undermines community trust.

The complaint submitted by CJP includes videos of the speeches, which were shared on Hindutva Watch’s Telegram channel and annexed in the submission, to substantiate their claims of communal and inflammatory content.

Various violations highlighted by the complaint

  • Model Code of Conduct 

The MCC, enforced by the Election Commission of India, aims to maintain fair and peaceful elections by prohibiting divisive and inflammatory rhetoric. It explicitly bans appeals to voters based on caste, religion, or community and calls for restraint from inciting tension between groups. The complaint emphasised that by framing Muslims as a monolithic threat and casting them as “infiltrators,” Jaiswal and Chouhan’s speeches undermine the MCC’s commitment to communal harmony, focusing instead on identity-based fear-mongering rather than development issues.

  •  Representation of People Act, 1951 

The complaint also highlights specific violations under the Representation of People Act, 1951, Section 123, which prohibits corrupt electoral practices, including the use of religious or communal appeals to influence voters. Sections 123(3) and 123(3A) of the RPA bar candidates from promoting enmity or hatred between communities on the grounds of religion or caste. By using rhetoric that positions Muslims as “outsiders” and “threats” to the indigenous population, these speeches not only appeal to communal sentiment but also cultivate distrust and hostility, which the RPA categorically prohibits.

The call for immediate action 

CJP’s complaint details the harm of such divisive speech, explaining how this rhetoric disrupts Jharkhand’s historically diverse and pluralistic social landscape. The complainant argues that framing Muslims as a monolithic threat erodes communal harmony, creates fear and mistrust, and fosters stereotypes that can lead to acts of discrimination and violence. By shifting focus away from issues of public welfare and development, this approach leaves marginalised communities with fewer avenues for genuine solutions to pressing needs, such as employment and healthcare.

The complaint concludes with a plea for the Election Commission to take immediate action, emphasising the need to preserve Jharkhand’s social harmony and ensure that elections remain focused on development and democratic values rather than divisive agendas.

On October 24, 2024, Citizens for Justice and Peace (CJP) filed a complaint with the Maharashtra State Election Commission, raising grave concerns about the violation of election laws through the use of divisive communal messaging in posters displayed across Mumbai. These posters prominently feature Uttar Pradesh Chief Minister Yogi Adityanath, alongside the slogan “बटेंगे तो कटेंगे” (“Batenge to katenge”), which translates to “If divided, we will be cut,” and are alleged to foster communal tensions as Maharashtra heads toward its Assembly elections on November 20, 2024.

CJP’s complaint highlights the inflammatory nature of this messaging, arguing that it is part of a broader attempt to appeal to communal sentiments and polarise the electorate. The posters bear the name of Vishwabandhu Rai, a BJP leader, indicating his involvement in their dissemination. The complaint stresses that these posters mirror remarks made by Chief Minister Adityanath in August 2024 in Agra, where he referred to the political situation in Bangladesh, cautioning against divisions within India and hinting at violent consequences if such divisions occur. The posters leverage these remarks to stoke fear among voters by implicitly linking communal harmony with political outcomes.

 Specific concerns raised by CJP

  1. Use of communal and fear-based messaging: The core message, “If divided, we will be cut,” positions the upcoming elections within a broader communal and national security framework. By warning of potential violence if certain communities do not “stay united” in line with a particular political vision, CJP argues that the posters are intended to play upon communal divisions, particularly affecting Muslim and minority communities. The complaint also notes that the use of saffron, yellow, and green as the dominant colours in the posters is a calculated move to invoke specific religious sentiments.
  2. Context of CM Yogi Adityanath’s speech in Agra: CJP highlights that the poster’s messaging is drawn directly from CM Yogi Adityanath’s speech, where he raised concerns about the mistakes made in Bangladesh and suggested that a similar fate awaits India if communities remain divided. By utilising such remarks in the context of a highly polarised election environment, CJP argues that the BJP is indirectly fostering fear and sowing the seeds of communal discord.
  3. Impact on Maharashtra’s communal fabric: Maharashtra is known for its political and religious diversity, and Mumbai, in particular, has historically been a flashpoint for communal tensions. CJP warns that such posters can heighten these tensions, especially in a politically charged environment. By invoking fear of communal strife, these messages aim to deepen the polarisation of voters along religious lines, potentially leading to unrest and violence in the state.

Violations cited in the complaint

CJP’s complaint argues that these posters violate multiple provisions of the Representation of People Act, 1951, as well as the Model Code of Conduct (MCC), which came into effect following the announcement of the election schedule.

  1. Violation of Section 123(2) and 123(3) of the Representation of People Act, 1951: Section 123(2) prohibits undue influence in elections, including direct or indirect attempts to interfere with voters’ free exercise of their electoral rights. CJP alleges that the posters are designed to instil fear and promote hatred between different classes of citizens based on religious lines, particularly targeting minorities.
    Section 123(3) prohibits electoral appeals based on religion, race, caste, or community. By invoking religious sentiments and playing upon fears of division, the posters, according to CJP, are clearly designed to influence voters by stoking communal tensions, which breaches this provision.
  1. Violation of the Model Code of Conduct (MCC): CJP contends that the posters also breach the Model Code of Conduct (MCC), which is enforced by the Election Commission of India during election periods to regulate the behaviour of political parties and candidates. The MCC clearly states that no party or candidate should indulge in any activity that aggravates existing differences or creates mutual hatred between communities. It further prohibits the use of inflammatory language, symbols, or slogans that can fuel communal or caste-based divisions.

The complaint comes at a time when the political atmosphere in Maharashtra is already tense. With the Assembly elections approaching, political parties are vying to consolidate their voter bases, and the appearance of these posters could exacerbate existing communal divides. CJP warns that if left unchecked, these posters could contribute to communal violence, disrupt public order, and undermine the integrity of the electoral process.

CJP underscores the importance of maintaining electoral integrity and the secular character of the election process, particularly in a diverse state like Maharashtra. The organisation warns that such attempts to polarise voters along communal lines are likely to result in significant unrest, potentially derailing the entire election process.

CJP’s call for decisive action aims to prevent the use of communal fear-mongering as a political tool and to preserve the integrity of Maharashtra’s democratic process. Through the complaint, CJP made several key demands: the immediate removal of all posters featuring the communal slogan “बटेंगे तो कटेंगे” from public spaces across Maharashtra; a thorough investigation into BJP leader Vishwabandhu Rai’s involvement in the poster campaign, with legal action if he is found in violation of election laws; strict enforcement of the MCC to prevent political parties from using divisive or communal rhetoric; and a public clarification from the BJP leadership disassociating itself from the inflammatory messaging of the posters.

One more case was registered in Lucknow against suspended Gorakhpur hospital paediatrician Dr Kafeel Khan on the complaint of a local resident alleging that a book written by him was being distributed to incite people against the government and create division in society, police said on Sunday.

Five ‘other’ unidentified persons have also been booked in the case lodged at the city’s Krishna Nagar police station.

Dr Khan first became a household name after the 2017 tragedy at Gorakhpur’s BRD Medical College, where several children died due to lack of oxygen cylinders. While for most Indians, he was hailed as a saviour for arranging emergency oxygen cylinders, he faced criminal action along with nine other doctors and staff members over irregularities in their duty. After months of incarceration, all were finally released on bail.

‘Jail was hell for me,’ he had told Sabrangindia in his first interview after his release in 2018. The interview is in four parts.

Krishna Nagar Station House Officer Jitendra Pratap Singh said, “Dr Kafeel was booked after a local resident alleged a book written by him was being distributed to incite people against government and create division in society.”

The Lucknow police told the media that they have started a probe into the case and are trying to identify the other accused. The case was lodged under Sections 420 (cheating), 467 (forgery to make or transfer any valuable security, or to receive money), 468 (forgery for cheating), 465 (forgery), 471 (using forged as genuine), 504 (insult to provoke breach of peace), 505 (statements causing mischief), 295 (defiling a place of worship to insult a religion), 295-A (malicious acts to outrage religious feelings), and 153-B (assertions prejudicial to national integration) of the IPC.

When contacted by Indian Express over phone, Dr Khan said, “Neither the government nor the police have told me anything about it. The book in question is available on Amazon and has been on sale for two years. I have been staying outside UP for four years. The book in English has been translated by some people into Hindi and Urdu. I don’t know why they have registered a case against me now,” said Khan.

It may be recalled that, in September 2020, the Allahabad High Court revoked charges under National Security Act (NSA) against Khan, and ordered to immediately release him as he had been in a Mathura jail for nearly six months. Khan was accused of delivering a provocative speech at Aligarh Muslim University in December 2019 during protests against the Citizenship Amendment Act (CAA). The case against him was lodged for allegedly “disturbing public order’.

In a letter, late last week, to the three-member Commission on October 21, retired IAS officer E A S Sarma had formally complained to the Election Commission of India (ECI) stating that “the instructions issued by the Department of Personnel on October 17 to all ministries to nominate officers as ‘district rath prabharis’ was a ‘brazen infringement’ of the Model Code of Conduct (MCC).” The Department of Personnel, incidentally comes directly under the Prime Minister’s Office (PMO).

The Election Commission after receiving this Model Code of Conduct (MCC) violation complaint regarding the government’s plan to involve bureaucrats in a “yatra” to showcase the Narendra Modi government’s achievements, has decided to examine it, sources told the newspaper on October 23, Monday.

The EC had “just received the complaint” and would “look into it”, a top official said.

Referencing an October 14 order, the Union Agriculture Ministry had also made plans for holding a nationwide “Viksit Bharat Sankalp Yatra” from November 20 to January 26 to create awareness about the Modi’s government’s work over the past nine years even as the EC on October 9 announced Assembly poll schedule in Chhattisgarh, Madhya Pradesh, Rajasthan, Mizoram and Telangana.

The MCC came into force from the time polls were announced on October 9.

In a short but strongly worded letter to the three-member Commission on October 21, retired IAS officer E A S Sarma said the instructions issued by the Department of Personnel on October 17 to all ministries to nominate officers as “district rath prabharis” was a “brazen infringement” of the MCC. He also said that the instructions would be a misuse of government machinery for influencing voters. Sarma asked the EC to direct the government to revoke the instructions and impose a penalty on those involved.

On Monday, October 23, in another letter to the EC, Sarma said public servants taking part in any activity that was likely to influence voters was a violation of the Central Civil Services (Conduct) Rules.

On October 12, a response was received by Citizens for Justice and Peace (CJP) from the ECI in regards to their complaint against senior BJP leader Kailash Vijayvargiya.  Vijayvargiya is an electoral candidate from Indore Assembly Constituency No. 1. On October 5, a video of his had surfaced on ‘X’ (formerly known as Twitter) wherein he could be seen and heard delivering a speech in Indore and offering monetary benefits of Rs 51,000 to the polling booth chairman for no votes given to the opposition Congress party.

As per the response received by the ECI, a complaint has been raised by the commission with the concerned officers regarding the impugned speech highlighted in CJP’s complaint. It has further been provided that the commission has also personally forwarded the email to the corned officer for a quick response. A further detailed reply from concerned officers/department is now awaited.

It is essential to note that through the said complaint, it had been highlighted that the speech made by Vijayvargiya amounts to the offence of “corrupt practices” and stands in violation of Section 123 of the Representation of the People Act, 1951. CJP had demanded that strict action be taken against Vijayvargiya for his serious violations and that he should be directed to issue an unconditional public apology as well as a retraction for his utterances. CJP had further urged that the Commission issues a notice to the state and national party in chief of the BJP as this conduct of one of its own elected representatives puts a responsibility on any party that participates in elections held under the mandate of the Indian Constitution to honour and follow its mandate as laid down in both the Preamble and Fundamental Rights (Chapter III).

On July 31, a complaint was sent by Citizens for Justice and Peace to Times Now, raising concerns over the contents of the news show titled “Rashtravad | Gyanvapi Survey के बादज्ञ ानवापी आंदोलन”. The said show aired on July 24 on Times Now Navbharat on the same day that the Supreme Court of India, wherein the court had provided interim protection against the Archaeological Survey of India (ASI) Survey being conducted at Gyanvapi Mosque. In the show, the host conducted a debate segment which had themes furthering a divisive discourse. 

Essentially, the host, Rakesh Pandey, had picked up a matter that was sub-judice, and presented only one sided facts of the case. Even before the debate had started, the Host had started spreading his diatribe and polarized views. The host tried to build the premise of the show by depicting the Muslim community in a suspicious light, questioning their intentions behind urging an estoppel on the survey. The host had intentionally put polarizing and accusatory questions to the participants of the debate to put seeds of doubt in the minds of his audience by terming the stay on the survey as an attempt to delay the result as “Muslims were scared of the truth coming out.”

Prior to the debate segment, the host had announced the questions upon which the discussion were to take place. The questions, provided below, were instigating and communal in itself:

“1. What was found in those four hours of survey that led to the chaos amongst the Muslim parties?

  1. Why are the Muslim parties so afraid of uncovering the truth beneath the Gyanvapi mosque?
  2. Did the Survey team actually find the evidence of a Temple?
  3. The ASI Survey has been stopped on an interim basis, what will happen afterwards?
  4. Will there be a ‘Gyanvapi movement’ after the survey?”

During the debate segment, a full on media trial on the Gyanvapi mosque case had ensured. Advocate Vishnu Shankar Jain, the advocate on record (AOR) representing the Hindu parties in the court in the Gyanvapi Mosque case were also a part of the panel.  The debate show appeared more like a one sided show promoting the host’s version of the Hindu cause or a religious/sectarian debate rather than a news room debate. In its complaint, CJP also highlighted certain extracts from the show that are specifically contentious.

The complaint stated: “Instead of framing an issue in a sober fashion with an intent to explore various aspects of the debate, the host continued the debate representing his own version of the ‘Hindu cause’. This displays partisan coverage and does not fit well with democratic, constitutional principles of independent journalism. The host continued throughout the show while making some extremely problematic statements towards the end too. At one point towards the end of the debate, the host asked advocate Jain whether the fight of Gyanvapi will be as prolonged as the fight over Ayodhya was for. While the host himself made the comparison of the Gyanvapi case with Ayodhya case, he has also accused the Muslims for comparing the said situation to Babri Masjid to provoke the Muslim Community.”

In the complaint, CJP also emphasized that the not once was it put to question as to whether the Muslim parties had the right to approach the Supreme Court or not. Not once did the host show any doubt regarding the existence of a temple beneath the Mosque, rather have repeatedly implied that the truth of the temple will come out. Thus, it was undoubted that the host let his biases and prejudices against the Muslim community cloud the role he is supposed to play in a debate show and made it evident that he was batting for the Hindu cause.

The complaint stated: “He kept reiterating through the show that the Muslim community, by approaching the Supreme Court, was against the truth coming out, making the entire show a communal battleground. This does not only violate the made guidelines issued by the News Broadcasting Digital and Standards Authority (NBDSA) from time to time of which the channel is a member but also stands in violation of our constitutional principles.”

Through the complaint, CJP has sought the removal of the impugned content from all social media accounts of the channel, and issuance of a public apology for the communal reportage.

On June 2, Citizens for Justice and Peace (CJP) filed a complaint with the National Commission for Minorities (NCM) against the serial hate offender Pravin Togadia, for the deeply Islamophobic and hate filled speeches he made across North India and Assam from December 2022- May 2023.

Pravin Togadia is the founder and President of ‘Antar Rashtriya Hindu Parishad’ and can be regularly seen delivering misinformed and hate filled speeches at several places which target the minorities, specifically the Muslim community.

As a part of CJP’s rigorous Hate Watch campaign, it has been diligently maintaining a record of the hate speeches being made by him on public platforms. CJP thus filed a complaint highlighting the following speeches, and also provided the excerpts of the statements made at the said events:

  • Malwa, Madhya Pradesh- May 16, 2023
    He was heard advocating for laws against “love jihad” and provoking the people listening to his speech by saying, “we want someone to break an eye for an eye.” He further made a baseless claim that in the next 50 years, the increase in population of the Muslims would convert India into Afghanistan and added that “2,000 years ago there was no Christianity” and everyone was a Hindu.
  • Jhabua, Madhya Pradesh- May 19, 2023
    At this event organized at the Choyal Hospital where he stated that in Riyadh a small town was found where a 6,000 year old Shivling was discovered. He claimed, “over 500 crore Hindus have been killed in 2,000 years.”
  • Mandideep, Madhya Pradesh- May 14, 2023
    At the said event, Togadia again delivered insightful speeches and asked the audience to build temples in Kashi- Mathura instead of mosques. He says, “We had said that we will build the temple, even if you do not agree to it, we will stand on your chest and build our temple.”
  • Amla, Madhya Pradesh- May 13, 2023
    At the event, Togadia administered an oath to the Hindus asking them to work with their “body, soul, and wealth” for Hindus. He also brought up the idea of Hanuman Chalisa Kendras so that when a Hindu is in danger from a Muslim or Christrian, other Hindus can gather there to protect such a person. He compared this concept to Churches and mosques.
  • Itarsi, Madhya Pradesh- May 12, 2023
    At the said event, Togadia claimed that the Muslims are trying to reach the level of population prevalent during the Mughal era. He added that in the next 50 years, their percentage of population will increase to 40% from the current 22%. He concluded that at a time when the Hindu population is 78% women are not feeling safe, then at the future levels, it will become worse.
  • Muzaffarpur, Bihar- March 02, 2023
    At the event organized by AHP at MPS Science College, he claimed that India would become “Darul Islam”and based on the public’s mood, he can see this happening in the next 10 years.
  • Jind, Haryana, January 28, 2023
    The event was organized by AHP. He praised the Gujarat model, described his role in the 2000 Gujarat riots, and provoked the audience to join his organization.
  • Palwal, Haryana- January 23, 2023
    At the said event organized by AHP, Togadia spoke for “love jihad” laws, population control laws, and the need to kick out the Bangladeshis from India. He further administered an oath to the audience saying, “Prosperous Hindu, Safe Hindu, Every Hindu.” The crowd at the end showed its support by chanting “Jai Shree Ram”.
  • Karimganj, Assam- December 11, 2022
    At the said event, Togadia in his speech said that he will legislate that “the SP, PM, DM from any other community” other than Hinduism.

The complaint underscores how such Islamophobic and hate filled statements add to an already polarized and divided environment of the country. Such statements are a grave threat to the peace, unity, and integrity of India. The blatantly misinformed statements would invoke fear in the mind of anyone but his speech received applause and support from the audience. He has consistently delivered such speeches since the early 2000’s in Gujarat and has now extended them to North India and Assam.

CJP also highlighted that they have actively reached out to the district and state authorities as well with respect to taking action against Togadia. On May 5, 2022 CJP had filed a complaint to NCM regarding Togadia’s speech made on 24 April, 2022 where he asked the audience to weed out the “outsiders” i.e., the Bengali-speaking Muslims and called for their ethnic cleansing under the guise of an oath. In a prompt action, NCM had, on May 13, 2022 asked the Assam Chief Secretary to take necessary action against him. However, no such action was taken by the state.

Through the speeches highlighted in the complaint to NCM, CJP has sought swift and stringent action against Togadia under the Indian Penal Code (IPC). The complaint states that, “Statements such as these are bound to make things worse; to further generate communal disharmony or feelings of ill will, enmity and hatred between the supporters of different political parties. The utterances also amount to an act which is prejudicial to the maintenance of harmony between different groups and is likely to disturb public tranquility. Moreover, such open intimidation and hate-filled statements only makes the targeted group more vulnerable to violent acts.”

CJP urged that the speeches delivered by Togadia be acted upon and criminal charges be framed against him for making such statements that can affect the lives of the minorities in our country, and threaten the social harmony in general.

In its endeavour to prevent events propagating hate speech, Citizens for Justice Peace has once again sent a preemptive memorandum to authorities regarding the proposed event being organized by Hindu Janajagruti Samiti on February 21 in Ratnagiri, Maharashtra, and raised some concerns about it. Hindu Janajagruti Samiti is the same organisation that has been giving a platform to hate speech offenders to make hate speech by organising events demanding the establishment of a Hindu nation, boycott of Halal meat, ‘love jihad’, religious conversion and cow slaughter.

Through this memorandum, CJP has brought to the notice of District Collector, Ratnagiri as well as Superintendent of Police (SP), Ratnagiri that a Hindu Rashtra Jagruti Sabha event is going to be held in Dapoli, Ratnagiri wherein hate speeches will be delivered, and calls for establishing a Hindu nation will be made, presumable bytargeting and hurting religious sentiments of minorities.

Raising concerns about the same, CJP, in its memorandum has highlighted previous hate speeches delivered at events organized by the HJS as well as the hate offenders associated with the organisation.

CJP has, in the memorandum, highlighted that “The HJS runs a campaign advocating for the passing of anti-Love Jihad laws in Maharashtra. Extremist Right-wing Hindu groups have been using the term “love-Jihad” loosely now, wielded by an aggressive majoritarianism, woven into a dominant caste Hindu narrative of religious extremism, Islamophobia, and communal hatred. It has also been provided on their website that HJS has been conducting regular workshops to make Hindus “aware” of the consequences of autonomous and free choice marriages, derogatively and provocatively termed ‘Love Jihad.’”.

In the past, many notorious hate offenders and hate speakers, such as T. Raja, Pramod Muthalik, Meenakshi Sharan, H.H. SambhajiraoBhide, Kalicharan Maharaj and Suresh Chavhanke, have been associated with HJS, and participated in their activities. An event had been organized by the HJS last year where notorious hate offender SambhajiBhide had advocated for the boycott of Halal Products.

The memo also points out that on February 3, 2023, the Supreme Court issued directions with respect to an event which was scheduled to be held in Mumbai on February 5 by Sakal Hindu Samaj. The court had taken an undertaking from government of Maharashtra that if permission for this event is granted “it will be subject to the condition that nobody will make any hate speech and in defiance of law or disturbing the public order.” The court also gave directions that it shall be the duty of the police officers to invoke section 151 of CrPC for preventive action in case the need for the same arises.

Accordingly, CJP has urged theRatnagiri Police to take preventive measures to stop this event from taking place and take any other action deemed necessary in this regard.

In addition to this, CJP has also urged Shri Vinayak Bhaurao Raut, Shiv Sena, Ratnagiri-Sindhudurg, Maharashtra to do all that he can in his power, “especially bringing to the notice of Ratnagiri police to take preventive action in this regard by following due process of law. We anticipate that a push from the elected representative of Ratnagiri, a Member of Lok Sabha and a prominent public figure who has always spoken in support of human rights will bolster this endeavour to protect the society from such hateful public events.”

Hate Speech

On January 20, Citizens for Justice and Peace complained to the SDPO, Boisar and Addl SP, Palghar and DGP of Maharashtra to register a complaint against the hate speech given by Senior Vishwa Hindu Prasad, Shankar Gaikar. In the said speech, given at a Shaurya Path Sanchalan Event held at Boisar district of Maharashtra, he made derogatory statements and spewed hate against the Muslims by attacking their culture and history.

In the complaint, CJP has highlighted that the communal and hate spewing speech delivered by Gaikar who espouses a hard, right-wing, exclusionist ideology, through which he has targeted and othered the Muslim Community. He has made deliberate attempts of instigating and provoking his audience by bringing in a version of Maratha history and Islamic history to suggest, prejudicially, a history of conflict.

With an aim of spreading social disharmony, Gaikar can be heard making Islamophobic statements throughout the video, such as, “Kisi mei itni takat nahi hindu ki beti utha kar le jae. Kururta unke khoon mei basi hai yeh dhayan mei rakho. Hindu kabhi krur nahi hota, hindu har samay shrur hota hai, who saamne se ladhta hai. (No one has the power to take away the daughter of a Hindu. Keep inmind that the bitterness is in their blood. Hindu is never cruel, Hindu is always angry, and hefights from the front.)” “Gaddari ka kaam kabhi Hindu karta nahi hai. (Hindus never function with treachery.)”

It is pertinent to note that this is not the first time that Gaikar has made troubling claims and Islamophobic comments. In year 2017, Shankar Gaikar stoked up a controversy by demanding that the recruitment of Kashmiri Muslim youth in the security forces be stopped. Gaikar alleged that there were incidents of theft of weapons and ammunitions from the security forces. According to him, these weapons were used against our own forces. So, he demanded that the recruitment of Muslim youths from Kashmir should stop. In the year 2019, post the judgment of the Supreme Court on the Ram Janmabhoomi-Babri Masjid title suit, Shankar Gaikar said that, “I feel proud to have participated in the cleansing of sins with the demolition of the Babri Masjid”.

Through the complaint to the Maharashtra police, CJP has sought swift and stringent action against Gaikar under certain sections of the IPC in view to the overall unsafe atmosphere for the Muslim community that is being generated through the systemic and the perpetrated use of hate speech and writing within the country.
