The Adityanath-led government of Uttar Pradesh has reportedly directed all district magistrates to move applications in courts for withdrawing the cases of Covid violations. According to a report in The Indian Express, the Uttar Pradesh government has issued an order to withdraw “almost three lakh cases of violation of Covid-19 protocols and lockdown rules”. These are cases in which charge sheets have already been registered. 

It is reported that Uttar Pradesh is the first state to issue such an order, but the current and former state legislators and parliamentarians booked under such violations will not be eligible for the relief. According to IE, district magistrates have been asked “to move applications in the courts concerned about withdrawing the cases,” after the state administration reviewed the details of the cases. 

According to the report in “most of these cases, the police invoked IPC sections 188 (disobedience to order duly promulgated by public servant), 269 (negligent act likely to spread infection of disease dangerous to life), 270 (malignant act likely to spread infection of disease dangerous to life) and 271 (disobedience to quarantine rule).”

Uttar Pradesh had been in the limelight as one of the states worst hit by Covid-19 as its health system failed, and reports of people lined up outside ‘emergency care’ hospitals waiting for hours to get the care they need, some dying while waiting, gasping for oxygen, flooded the media.
