In a deeply troubling incident in Ahmedabad, Gujarat, nursing student Hafiz Abu Bakr was denied permission to sit for his Gujarat University GNM nursing examination at LG Hospital due to his beard. The examiner, Sarayu Raj Purohith, allegedly instructed Abu Bakr to remove his beard before he could begin the examination.

The video of the incident may be viewed here:

As provided by a report of the Observer Post, Abu Bakr claimed that he was stopped outside the examination hall and told to shave off his beard before being allowed to proceed. A video of the incident, which went viral on social media, shows the examiner stating, “If a student maintains a beard, I believe we should conduct an examination or ask them a question.” This discriminatory statement raises serious concerns about the lack of professionalism and the infringement on personal rights in educational institutions.

There is no official rule that mandates the removal of a beard for examinations, yet the examiner’s actions suggest a deeply ingrained bias against religious expression, particularly against Muslim students. As per the report, the individual who filmed the incident highlighted the absurdity of the demand, stating, “There are no rules as such to ask someone to shave their beard in a classroom; it is only permitted to ask if you are in a position to offer a job or in a job interview.” Abu Bakr also recounted an additional humiliating interaction, where the examiner questioned whether he had completed the Hajj pilgrimage. Upon Abu Bakr’s response that he had performed Umrah, the examiner reportedly accused him of lying and insisted that he shave his beard completely, implying that his religious identity was subject to interrogation.

In an attempt to defend her actions, the examiner claimed that no discrimination based on religion took place and that examinations are conducted fairly for all students. However, the absurdity of the demand—especially considering the complete lack of any formal rule requiring a shaved face—demonstrates a deeper problem of cultural and religious intolerance masquerading as routine procedure. The individual who recorded the video rightly pointed out that simply conducting exams for everyone does not give anyone the right to impose such personal and religious demands on a student.

The incident has drawn condemnation from various quarters, including Shazad Khan Patan, an AMC leader, who expressed his concern over the growing religious intolerance in Gujarat. He stated, “I learned about the incident from the media. A Muslim student’s exam had been denied because he had a beard. In this nation, fanaticism has reached such a high level that students have to deal with it. It’s a pretty embarrassing situation.” Patan further accused the state of Gujarat of becoming a hub for religious extremism, where such discriminatory practices are becoming increasingly normalised. He emphasised that the Indian Constitution guarantees the right to religious freedom, including the right to express one’s faith through visible markers such as a beard or a hijab.

This incident is a glaring example of the growing religious intolerance in India, where actions rooted in personal beliefs and cultural biases are increasingly encroaching upon the rights of individuals. What is even more disturbing is that such discriminatory actions are often justified by authorities as a part of regular procedures, further normalizing the marginalization of religious minorities. In a secular country like India, where the Constitution protects the rights of individuals to practice their religion freely, incidents like these are not just shameful—they represent a dangerous erosion of the inclusive, pluralistic values that the nation was built upon. The incident serves as a stark reminder of the ongoing struggles that religious minorities, particularly Muslims, face in India today, and the urgent need to challenge such discriminatory practices at every level of society.

Hate crime committed against foreign students in Gujarat University https://sabrangindia.in/hate-crime-committed-against-foreign-students-in-gujarat-university/ Mon, 18 Mar 2024 13:13:05 +0000 https://sabrangindia.in/?p=33908 Foreign students attacked in GU, rooms and motorcycles vandalised over namaz row

The post Hate crime committed against foreign students in Gujarat University appeared first on SabrangIndia.

Introduction

The incident, which occurred on March 16 around 10:30 PM in the night when some foreign students from Afghanistan, Tajikistan, Sri Lanka, and African countries had gathered to offer Taraweeh (night prayer offered during Ramadan) close to their hostel in Block A of Gujarat University, which is located in Ahmedabad has caused an international uproar.

A serious and embarrassing incident of hate crime has emerged from Gujarat University where five students from overseas have been attacked for offering namaz and also found their rooms vandalised by the mob. Pertinently, Sri Lankan and Tajik student, one each, were badly injured in the attack, and had to be hospitalised. As bad as the violence on the person was the fact that the mob vandalised AC, phones, laptops, and motorcycles of the students and several videos of the incident has seen been doing rounds on X (formerly Twitter).

In one of the videos that emerged the mob can be seen pelting stones and other material from the ground while verbally abusing foreign national and shouting “Jai Shree Ram”. The nature of the hate crime in the present case suggests not only communal hatred but also xenophobia and racism, as apparent from the sloganeering and curses hurled at the foreign students, which is captured on record.

According to other students from overseas, who witnessed the episode, the incident happened when some foreign students were offering the Taraweeh in the open area near their hostel in Block A of Gujarat University around 10: 30 PM in night when few people started objecting to them and kept shouting “Jai Shree Ram”. Thereafter they left briefly following the argument before returning back with the huge mob of around 25 people, equipped with knifes and iron rods, which started vandalising the hostel rooms, motor cycles and also attacked some of the foreign students, in which the two students were hospitalised. The five students from African countries, Afghanistan, Tajikistan, and Sri Lanka were injured in total.

When the mob first arrived the security guard tried to stop them but soon found himself overpowered by the mob who went on the rampage, destroying the property and attacking the students. In another video, the student can be heard saying that though the police arrived later (around 5 minutes after it received the call at 10:51 PM, as per the Commissioner of Police G S Malik) on the scene they did not detain the members of the mob who could be seen running away at the time in the full presence of the police.

Following the incident, the Commissioner of Police G S Malik has given the statement in which he said that the incident involved around 20-25 people, who were outsiders, and it began after the argument ensued between the two groups. He informed that the FIR has been register against 25 people and the state government is cognizant of the matter. The Hindustan Times reported that the FIR has been registered under Indian Penal Code provisions for rioting, unlawful assembly, voluntarily causing hurt, damage to property and criminal trespass, among others.

On March 17, Ahmedabad Police tweeted that it has arrested two accused in the matter, namely, Hitesh Mevada and Bharat Patel. Ahmedabad City Police Commissioner, G S Malik is on record stating that nine teams have been formed to conduct a probe into the incident. Along with Hitesh Mevada and Bharat Patel, other accused arrested by the police include Shitij Pandey, Jitendra Patel and Sunil Dudhirua. Notably, the accused have not been identified with any political or socio-religious group as of now.

Shockingly, the GU VC Neerja Gupta instead of downrightly condemning the incident was quoted by NDTV suggesting that cultural sensitivity must be inculcated in foreign students! “These are foreign students and when you go abroad, you must learn cultural sensitivity. These students need an orientation. We will sit with them, provide cultural orientation and discuss how to strengthen their security” NDTV reported.

Response from the Authorities

The injured students reportedly came to study in India under the Indian Council for Cultural Research (ICCR) scholarship, which comes under the Ministry of External Affairs. The MEA in the statement has acknowledged the incident and noted that the “State government is taking strict action against the perpetrators.” It further informed that one of the students has been discharged from the hospital after receiving medical attention.

Gujarat University (GU) has informed that international students will be shifted to another hostel meant for NRIs in three days, and will strengthen its security arrangements for the hostels. Additionally, GU VC Neerja Gupta was reported saying that the university has replaced the coordinator of its study abroad programme and NRI hostel warden with immediate effect. She also suggested that “there was some tension between those in the mob and some overseas students, and yesterday’s events led to an escalation”. BBC quoted the Vice Chancellor as saying, “’As per the information available with me, this (prayers) is not the main issue’”. The VC seems to deny that the incident had anything to with player.

In the past similar incidents have occurred in the University was confirmed by one foreign student. Noman, a student from Afghanistan, told BBC Gujarati that similar incidents have happened before. “There is a lot of risk here for students from other countries,” he alleged.

Rising instances of intolerance in Gujarat

Earlier in December 2022, the Maharaja Sayajirao University of Baroda’s Sanskrit Mahavidyalaya was in the news when two students had offered namaz on the premise. The university authorities suggested counselling of the students to make them understand that religious worship should not be conduct in the educational institutions. Right-wing group Vishwa Hindu Parishad had gone to the place and sprinkled Gangajal to purify the place and performed ram-dhun, alleging Islamic conspiracy behind offering the namaz.

Similarly, in June 2023, two men from Nagaland were attacked for selling ‘North Eastern’ food in Ahmedabad. Reportedly, 10 men attacked them saying how could they sell non-vegetarian food items and north-eastern food in a place like Gujarat which is dominated by Hindus, reported Times of India.

In October 2023, Kalorex school teacher was beaten by protestors for teaching students to offer namaz as part of religious activity. The school had even clarified that it did similar activities for different religions for all students.

Perhaps, today the extent of hate has reached such a threshold that simply exchanging different values and traditions itself has become intolerant. With its long history of communal violence, the state of Gujarat has presented one more instance of hate crime in its troubled relationship with establishing communal harmony.

Stoking a controversy, the Gujarat University administration has reportedly asked about 300 Afghan students to sign an undertaking that they will not approach media or any other agency about the living conditions in the hostels provided by the university and may get expelled if they breach the directive. The directive was issued after many South Asian students complained about unhygienic conditions in the hostels, according to media reports.

The Afghan students, part of the Study Abroad Programme under the Indian Council of Cultural Relations (ICCR) and Educational Consultants India Limited (EdCIL) scholarships, have been annoyed since last September when they were shifted far from the campus due to their “eating habits and culture”.

Some students claimed they do not eat non-vegetarian food, while some others said they were even ready to abandon their habit if they are shifted to a location close to the campus.

In September last year, the Gujarat University had shifted several Afghan students to a Muslim-dominated locality Lal Darwaja, 10 km away from the campus.

The latest directive stated,”engagement with any outer agency like media or police without prior permission of Gujarat University authorities shall invite immediate expulsion for violating the code of conduct from university/colleges and deportment to their country”.

Neerja Gupta, coordinator for the programme, reportedly said that all students were Muslims and were relocated after other students and neighbours complained about their eating habits. “The (Afghan) students staying at the Lal Darwaja facility are mostly, in fact, all are Muslims. So, looking at their eating habits, community and culture they are put up there. There were attempts to provide a hostel facility in the western parts of the city but we received complaints from both students and neighbours about their habits of eating non-vegetarian food. The students also complained that they do not get non-vegetarian food easily. So, these facilities were shut down,” The Indian Express quoted Neerja as saying.

When contacted by Newsclick, Gupta denied shifting the Afghan students on the basis of food habits. She said that all 35 students were part of undergraduate programme for which there is a hostel facility outside the campus. She said, “While P.G. hostels are in the campus, the U.G, hostels are outside the campus at the centre of the city.Thirty five is the number of students who are admitted this year in under-graduate courses, hence all 35, are staying in UG hostel. Other new students who are admitted to PG courses are staying in campus hostels. The location too is defined looking into the proximity of the college/ institution so that they can save time and money in travel.”

Gupta, however, side-stepped questions regarding the gag order issued by the administration, saying that “There is no such directive exclusively only for foreign students.”

However, the students of the university have a different story about the living conditions at the hostels. Talking to Newsclick, Nitish Mohan, a student of B.A Economics, said living conditions in Gujarat University hostels are deplorable and need to be addressed immediately.

He said,” the DRI Hostel is one of the examples which needs immediate attention. Its building is crumbling and it can collapse if the region is hit by any earthquake. Similarly, 12-14 students are compelled to live in one room and it has two toilets, with no door, for 100 students. The hostel is housed by Scheduled Tribe students who hail from different parts of the state.” He added, Despite being costly, the students rely on water tankers for their daily needs. Do not even think about taking a bath.”

No action against Police despite thrashing students, manhandling faculty members and creating chaos in a prestigious academic institution of the country.

TOI

Vadodara: On the eve of Independence Day this year, when President Ram Nath Kovind was addressing the nation from the Lutyen’s Delhi, in another part of the country, innocent people were facing the brutalities of the nation-state. Yes, Vadodara from where PM Narendra Modi was elected by a margin of 5.7 Lakh votes.

TOI reported on the “Violence shames Sanskarinagari’s MSU campus.”

Students of All India Students Association (AISA) had staged a ‘dharna’ at the Sanskarinagari MSU campus in August after Nitin Barad’s nomination was rejected for the post of faculty general secretary (FGS,) in the faculty-level students association. The officials rejected the candidature on the grounds that as per the rules, if any student is found guilty by a disciplinary committee in the past, he or she is not eligible to contest in polls. But AISA supporters started protesting against the decision.

Dr. Dharmendra Shah, a teacher at Department of Botany, who is also a senate member, was also reportedly threatened by the cops. “I was only trying to placate the students. Suddenly, when I saw the cops rushing towards them, I tried to intervene,” Shah told TOI.

City police commissioner Anupam Singh Gehlot told TOI that police had tried to peacefully persuade students to vacate the premises. “As the students got aggressive, the additional police force was called in. Sayajigunj police inspector said that had the cops not intervened, the agitating students would have assaulted the dean,” Gehlot said, adding that he had sent DCP Deepak Meghani to the spot for inquiring into the matter.

On the same day, Ujjawal Krishnam, a student of MS University of Baroda and a team member of Sabrang India mailed Commissioner of Police, Vadodara City, demanding an explanation on the mishap. He didn’t get any response, the application reached Sayajigunj Police station after almost a month of the incident.

Ujjawal Krishnam investigated the incident and found serious lapses in the procedural methods. Here are some ten questions by Ujjawal Krishnam for the Gujarat State:

1. There is still no FIR against police and vigilance officers who physically tortured students with proof recorded on camera. I filed an application with CP on the same day [CP 220/18] but it took almost a month to process. What could be a reason? Why was I notified on September 10 whereas I had filed the complaint on August 14? Disturbing and suspicious!

2. No policeman was suspended despite their barbaric act. The reason given was that the police saved Dean of Science Faculty who could be attacked if they had not intervened. Was there any further investigation in the case? As per my investigation, the dean was sitting in his office and was quite safe while the students were protesting outside his office and were sitting on the ground. There was no chaos, CCTV camera records can be checked. So, was the statement given to justify the act of police?

3. Is permission required to express a dissenting voice? Does one need police permission to sing a dissenting song in their own house?

4. Who ordered the lathicharge? it is still unknown. The college concludes by 6 pm and the time of the protest was between 5:00 pm and 5:35 pm. Is it illegal to voice and practice free speech?

5. Two students who were brutally thrashed were Denish Kothadiya and Ashutosh Gupta. Ironically, the police made Denish write an apology letter saying that he was misbehaving with PI Haresh Vora but nothing like that happened. They are being pressurised now as I am actively following up the matter and so, PI is disturbed. I believe, PI is putting some pressure via his contacts so he can run scot free. Hence, this case must be investigated by retired Judge or a SIT where there will be no involvement of any close connection of Sayajigunj Police Station.

6. Ashutosh Gupta, who was seventeen at the time of incident can be seen in photos how he is being pulled and physically tortured. Police didn’t follow the Juvenile Act while dealing with him. No further investigation took place and no local child protection unit of state government took note of it.

7. University Senate member Dr Dharmendra Shah, who also happens to be a professor of Botany department, was mishandled by local PI. Why didn’t police take his official statement? He still stands by his words. Whatever the police did was unjustifiable.

8. AC Sharma, Dean, as per media reports, denied his appeal to police for the lathi charge. So, who gave the police this right? Why was there no FIR against vigilance officers who were also doing the same? Police should know that AC Sharma will not file any case against his own students. Police have no option left now except taking an internal action; CP has asked ACP ‘A’ division to report on the issue. The only accused now are those who committed this serious crime.

9. Why didn’t University administration penalise vigilance actions and file complaint against Sayajigunj police? Is there some internal understanding between the two?

10. This is clearly a severe human rights violation and pinpoints the need for police reform. Question remains, why was this case suppressed?

Shaukat Indori, Gujarat State Secretary of Association for Protection of Civil Rights(APCR) Gujarat says, “We will not let this issue go. If it has happened today, it can happen to someone else too. Police have to take strict actions against culprits.” Social activist Jitendra Chandwani adds, “People are angry and they want immediate action after the issue has resurfaced. We will drive a campaign and urge people to file independent complaints. We will soon send the briefing to Human Rights Commission, Governor of state and CM if commissioner fails to sack involved policemen. Ashutosh was a juvenile when he was tortured. His shirt was torn and he is still scared. None can save the police if this matter goes to court. The incident, truly, is beyond measure.”

“I have demanded the suspension or discharge of involved policemen and vigilance officers. All involved people should also apologise to victims. If state government and police department don’t follow it up and discharge the mentioned people, I will fight this case, our legal team has taken a note of it. I will be consulting my lawyers for further actions. We all are ready to approach the court and stand for the legal battle if internal police action is not immediately taken against the perpetrators. If the police department is defending the blots, there is nothing left in this democratic nation to feel less ashamed of,” Ujjawal said.

“I guess the commissioner is conscious enough. He being a top cop will not be inviting an unnecessary court reprimand on the issue and disrepute to the office by doing injustice to victims,” he said.

The questions put the integrity of the Gujarat varsity at stake. Maharaja Sayajirao University of Baroda, the renowned institution of western India bears the name of Sir Sayajirao Gaekwad III, one of most illustrious leaders who gave India its own international bank, Bank of Baroda. This institution draws learners from various parts of the country. It appears that the university is a puppet in the hands of others. The real issue is the inaction of university administration and the reasons why the university administration didn’t even file a complaint against the police who assaulted their own students and teachers. This is disappointing and baffling.

Gujarat University
