In recent weeks, sitting legislators and influencers have stirred intense controversy by using communal rhetoric in political discourse in Maharashtra. BJP leaders, including Nitesh Rane, T Raja Singh, and Supreme Court advocate Ashwini Upadhyaya, have been vocal proponents of such divisive rhetoric, amplifying baseless conspiracies theories like “love jihad,” “land jihad,” and even promoting the false notion of a demographic war. Rane, a Cabinet Minister in the Maharashtra Government, holding a constitutional post, has delivered a series of inflammatory speeches targeting Muslims, warning of harsh actions against those allegedly conspiring against Hindus. His rhetoric deems to paint Muslims as enemies of the state, pushing for laws that would discriminate against them.

Similarly, T Raja Singh, notorious for his divisive views, has with his statements about “Ghazwa-e-Hind,” a theory that frames Muslims as a threat to India’s identity. Alongside these leaders, right-wing influencer Kajal Hindustani has propagated harmful stereotypes and hate against Muslims.

Nitesh Rane: spreading misinformation and suspicion through alleged theories of ‘Love Jihad’ and ‘Land Jihad’

Nitesh Rane, the BJP MLA from Kankavli in the Sindhudurg district of Maharashtra and now the Maharashtra Ports and Fisheries Minister, has emerged as one of the most vocal proponents of aggressive hate speech in the state. Many of his speeches from February 2025 have caused a significant uproar, raising concerns for the social climate in the state. 

February 20, 2025 

February 20, during a public felicitation event at Jagadguru Ramanandacharya Shri Swami Narendracharayaji Maharaj Nanijdhama in Ratnagiri, BJP MLA Nitesh Rane delivered a hate-filled speech targeting Muslims. 

Rane in his speech said that, “Because issues like Love Jihad and Land Jihad are actively happening around us. Through Love Jihad and religious conversion, a large-scale effort is underway to bring countless Hindu mothers and sisters into Islam by those engaging in Jihad.”

He propagated unfounded conspiracies about ‘love jihad’ and ‘land jihad,’ intensifying his rhetoric by labelling Muslims as “jihadis.” Rane also criticised Mazhars and Dargahs, claiming that the said structures “pop up anywhere,”.

He further added that, “I have initiated a program through my ministry to make our 720-kilometer coastline Jihad- free. Therefore, in all these matters, it is extremely important for me to receive Swamiji’s guidance and blessings from time to time. All the illegal activities happening around us—wherever you look, spreading the green cloth, building mazars and tombs everywhere—against all this, our Maharashtra government will take a firm stand without any Hindutva-based bias. On this occasion, I assure Swamiji of this today.”

His words not only spread fear but are also baseless accusations against an entire religious community. His speech serves as another example of the dangerous rhetoric emerging from political figures in the region.

February 19, 2025 

On February 19, at a Shiv Jayanti event organised by the VHP and Bajrang Dal in Sawantwadi, Sindhudurg, Maharashtra, BJP MLA Nitesh Rane delivered a series of inflammatory remarks targeting Muslims. He boldly declared, “This is a Hinduwadi government,” and went on to threaten that in Sindhudurg, anyone who even “looks at Hindus in an incorrect manner” would face consequences, urging people to contact him directly to “settle it before next Friday.”

Rane said that, “the Chief Minister is a staunch Hindutva. If anyone in this Sawantwadi, this Sindhudurga, keep evil eye at my Hindu religion, just give me a call, I will make sure that he doesn’t go to that place again on Friday. Don’t worry about anything.”

He also labelled Muslims as “green snakes,” who are involved in a deep-rooted conspiracy against Hindus. Rane’s speeches continued in this vein throughout the month of February, spreading more hateful conspiracy theories, and even suggesting that if Muslims “looked at Hindus in an incorrect manner,” they would face consequences. He stated that, “Our government is very bad. What is going on around I am aware of everything. You don’t have to struggle. Wherever something wrong is happening, wherever someone tries to slaughter a cow, wherever someone tries to smuggle, wherever green snakes try to wriggle, just make one call, and leave the rest of the arrangements to me.”

February 8, 2025 

On February 8, at the Hindu Rashtra Adhiveshan organised by the Hindu Janajagruti Samiti in Kudal, Sindhudurg, BJP MLA Nitesh Rane delivered a divisive speech, alleging that ‘jihadis’ were targeting Hindu temples and again referring to Muslims as ‘green snakes.’ He said that India is a Hindu nation and alleged that Muslims were conspiring to turn the country into an Islamic state by 2047. Rane then propagated the baseless conspiracies of ‘love jihad’ and ‘land jihad,’ fearmongering about the supposed Islamization of India. He accused Muslims of attempting to seize Hindu lands and religious sites, symbolically covering them with a ‘green shroud.’ 

Nitesh Rane’s speech is deeply problematic due to its divisive and inflammatory nature. He quite deliberately, and repeatedly perpetuates harmful stereotypes and spreads fear by framing certain religious communities as a threat to Hindu society. His speech begins with claims of “Love Jihad,” “Land Jihad,” and references to the “Waqf Board,” which without evidence, target Muslims and imply a coordinated effort against Hindus:

“While taking out these rallies, there were some cases of Love Jihad, some cases of Land Jihad, and some cases related to the Waqf Board. We, as the Sakal Hindu Samaj, took out those rallies and went to meet the affected families and we tried to provide them justice. How far have these Islamization and Jihadisation people reached? How much has their courage grown? You all should all imagine this. You people should be able to guess where the danger is from.”

This statement fuels unfounded fear and animosity, casting Muslims as a monolithic and hostile group. He further stokes this narrative by discussing the supposed encroachment of Muslims on religious sites, such as temples:

“I always wonder—if you want to spread Islam, why do you always target our temple lands? If you want to build a mosque or a dargah, then buy an open piece of land yourselves and say, ‘We want to build a mosque here, a dargah here.’ But they always want to do these things on the land of our temples.”

Such rhetoric incites division, mistrust, and hostility. He concludes by framing this as a grand conspiracy:

“By 2047, they want to turn our Hindu nation into an Islamic nation. Their evil eyes are on the temples, and we should be moving towards ensuring how to keep them safe,” Rane Said.

Rane referred Savarkar in his speech and said, “Swatantryaveer Savarkar has written very well that the Hindu society suffers more from Hindus themselves than from Muslims. Some of these people ask me how I can call it a Hindu nation, as it does not fit within the Constitution.”

February 5, 2025 

On February 5, at a public event organised by a coalition of far-right groups in Wagholi, Pune, BJP MLA Rane delivered an inflammatory anti-Muslim hate speech, propagating the baseless conspiracies of ‘land jihad’ and ‘love jihad,’ while falsely claiming that Muslims aim to turn India into an Islamic state. 

During his speech, he urged Hindus to rent homes only to fellow Hindus, warning that “it starts with one Aslam, and then you have a hundred Aslams.” Targeting the azaan, he claimed that if Hindus rented to Muslims, soon they would be overrun and the azaan would echo five times a day. He openly advocated for housing discrimination, urging the audience to “just declare that you don’t rent to non-Hindus.” Rane further fuelled the conspiracy of ‘love jihad,’ continuing to spread baseless fears of a demographic threat.

February 3, 2025 

On February 3, in Chandrapur, Rane made a chilling threat towards Muslims, declaring that acts like “Love Jihad,” “Land Jihad,” and “cow slaughter” would no longer be tolerated. At a religious assembly, Rane openly warned the minority religious community, stating that the state had a Hindutva-based government, and if these issues persisted, they would take direct action.

He was quoted as saying:

“If these people sporting beards do not stop this Love Jihad, Land Jihad, and the drama against Hindu society in time, then even those sitting in Pakistan will not be able to recognize you. I guarantee.”

His rhetoric targets Muslims as a collective threat to Hindu society, presenting them as part of a grand conspiracy to turn India into an Islamic nation by 2047. The speech perpetuates harmful myths such as “Love Jihad” and “Land Jihad,” which have no basis in reality but are used to fuel hatred and division. Rane asserts:

“When the police conducted their inquiry and asked what exactly they were plotting here, they responded by saying that their goal is to make India an Islamic nation by 2047, and all their efforts are directed towards achieving that.”

This unfounded claim creates an atmosphere of fear and suspicion, portraying Muslims as scheming to overthrow the country’s demographic makeup.

He continues with further inflammatory statements:

“Because in the beginning, only one comes. Just one—someone named Aslam. And then he will bring 100 more Aslams along with him. He will start cooking food that we don’t prefer, and because of that smell, the Hindu community will begin to leave. Then, five times a day, their loudspeakers will start blaring.”

This passage not only reinforces the idea of Muslims as an invasive force but also promotes communal fear by linking Muslims to undesirable behaviour.

Additionally, Rane makes claims about “Love Jihad,” where he manipulates personal stories to push the narrative of Hindu girls being brainwashed:

“I have met sisters who have been victims of Love Jihad. You would be shocked to see their miserable condition. These girls are brainwashed to the extent that they refuse to recognize their own parents.”

This kind of rhetoric is not new for Rane, who has long harboured views that fuel communal animosity. At this event, he claimed that a strict law against religious conversions would be introduced in Maharashtra. He further warned Muslims involved in such acts of “trapping” Hindu women that the government would deal with them harshly, reinforcing the idea of an aggressive, intolerant Hindutva ideology.

Recently, two FIRs were filed against Nitesh Rane for alleged hate speech targeting Muslims in Ahmednagar. Both FIRs were filed by the Ahmednagar Police against Nitesh Rane for his controversial remark. Rakesh Ola, the Superintendent of Police in Ahmednagar, confirmed the registration of two FIRs—one on September 1, 2024, and the other on September 2, 2024. These FIRs were filed at the Shrirampur and Topkhana police stations, respectively. Rane made his speeches during public meetings in the Shrirampur and Topkhana, in support of Hindu seer Mahant Ramgiri Maharaj, who had made derogatory remarks about Islam and Prophet Muhammad. Rane warned of repercussions if the Maharaj was harmed. In his address, Rane had said, “If anything happens to Maharaj, there will be repercussions. I’m going to give this threat in the language which you understand. If you have done anything against our Ramgiri Maharaj, we will kill you after barging into your mosques. You must remember this threat,” Rane had said, reported Times of India.

On September 5, an FIR was also filed against Nitesh Rane for his hate speech. The case was registered by the Gittikhadan police in Nagpur under sections 196, 299, 302, 352, and 353(2) of the Bharatiya Nyaya Sanhita. The FIR follows a complaint lodged by Mohammed Yunus Patel (47), a resident of Awasthi Nagar in South Nagpur, who alleged that Rane hurt the religious sentiments of a specific community during a speech he delivered in Ahmednagar on September 1, 2024, as HT reported.

Rane’s rhetoric, including claims of Love Jihad and Land Jihad, is not an isolated incident but part of a wider strategy by certain BJP leaders to stoke communal fears for political leverage.

T Raja Singh: Escalating divisive narratives

T Raja Singh, BJP’s MLA from Goshamahal in Hyderabad, is notorious for his controversial and often extremist views. His speech at the Deccan Summit in Pune on February 8, 2025, only further reinforced his reputation. Singh stirred the pot by promoting the divisive conspiracy theory of “Ghazwa-e-Hind,” falsely claiming that Muslims were plotting to turn India into an Islamic nation.

“They have another Pakistan inside India, these land jihadis.”

Singh went on to misrepresent historical events and figures, wrongly alleging that former Prime Minister Manmohan Singh had declared that Muslims had the first right to India’s resources. 

His rhetoric also targeted religious educational institutions, especially Madrasas, and he called for the construction of temples in historically disputed locations like Kashi, Mathura, Bhojshala, and Sambhal, where Mosques stand at the moment. In his mind, these temples, built after destroying the current Islamic religious structures, would “remove the stains” from these sacred sites, promoting the idea of religious purity while targeting Islamic places of worship.

Singh’s speeches only contribute to a growing sense of fear and mistrust between India’s communities, feeding into a larger narrative of religious confrontation and division.

Kajal Hindustani: A right-wing influencer encouraging harmful communal divisions

February 19, 2025 

Kajal Hindustani is another key figure spreading dangerous communal poison. At a Shiv Jayanti event in Nagpur on February 19, Hindustani not only pushed the harmful “love jihad” narrative but also revived harmful stereotypes about Muslims. She referred to Muslims as “jihadis,” equating them with violence and radicalism. Additionally, she launched an attack on the Muslim practice of Azaan, fuelling the existing prejudice against Islamic religious practices.

This kind of speech is highly problematic, as it promotes an environment where one community’s practices and identity are vilified and targeted. Hindustani’s reach as an influencer amplifies her harmful messages, reaching a much wider audience.

Following the complaint filed by Citizens for Justice and Peace (CJP) on October 25, 2024, against Kajal Shingala, also known as Kajal Hindustani, for delivering an anti-Muslim hate speech at an event in Thane, an FIR was registered on October 30, 2024, at the Wagle Estate Police Station in Thane. The FIR charges Hindustani under sections 299, 302, and 353 of the Bharatiya Nyaya Sanhita, 2023, which address offenses related to promoting religious animosity and public mischief. In addition, the event’s organizer, Veer Bahadur Yadav, was also booked for his involvement in permitting the speech. 

Ashwini Upadhyaya: Legitimising hate and conspiracy theories

February 20, 2025 

Ashwini Upadhyaya, a Supreme Court lawyer and prominent BJP leader, has also been vocal in spreading far-right narratives. On February 20, at a lecture on the Indian Constitution in Parbhani, he advocated for the restoration of “historic sacred places” like Kashi, Mathura, and Bhojshala, referring to which he claimed that the Mosque had been built after destroying temples. This rhetoric is rooted in the ideological push for the Ram Mandir, built at the destruction site of Babri Majid, and other religious sites to be reclaimed as symbols of Hindu supremacy.

Upadhyaya’s speeches are filled with conspiracy theories, including baseless claims about “love jihad” and “land jihad.” He further exacerbated these fears by drawing on international examples, citing China and Israel as models for population control measures. Linking population control to “love jihad” reflects a troubling trend where he frames demographic changes, especially Muslim migration, as a grave threat to India’s Hindu identity.

February 11, 2025 

On February 11, in Raigarh, Upadhyaya made statements about “infiltration jihad” and the alleged presence of six crore “infiltrators” in India, many of whom, according to him, were Muslims. Such claims serve no purpose other than to stoke fear and division in society.

February 2, 2025 

On February 2, in Pune, at the V.D. Savarkar Memorial Lectures organized by Swanand Janakalyan Pratishthan, Supreme Court lawyer Ashwini Upadhyay demonized Muslims by selectively citing cases where Hindu women were murdered by Muslim men. He stirred fear about ‘infiltration’ and led the audience in an oath against alleged ‘land jihad’ and ‘love jihad,’ promoting unfounded and divisive claims about demographic threats.

The role of Hindu Janajagruti Samiti: furthering hate and division

Hindu Janajagruti Samiti, a far-right organisation, also plays a significant role in spreading of conspiracies and peddling hatred with potential to harm our social fabric and harmony. On February 3, during a press conference on Bangladeshi ‘infiltrators’ at Marathi Patrakar Sangh, Mumbai, organized by Hindu Janajagruti Samiti, Sanatan Sanstha leader Abhay Vartak claimed that on alleged Bangladeshi “infiltrators,”. Abhay Vartak, claimed that up to ten lakh Bangladeshi immigrants live in Mumbai, which he linked to an increase in crimes and unemployment. His remarks were clearly aimed at inciting fear and suspicion towards the Muslims living in Mumbai, holding them responsible for collectively attacking the Indian economy. Vartak further promoted the conspiracy of “land jihad” and “love jihad,” underscoring how these controversial and harmful ideas are being propagated at multiple levels.

The impact of hate speech on Maharashtra and beyond

The hate-filled speeches delivered by these lawmakers and influencers are not only harming Maharashtra’s social fabric but also endangering the unity of the nation. Such rhetoric creates an environment where one minority community feels persecuted, that can lead to a cycle of hate and retaliation. Moreover, these statements are dangerous as they normalize a call for violence and discrimination against a particular religious community, portraying them as collectively acceptable responses to perceived grievances.

By invoking divisive terms like “love jihad,” “land jihad,” and “infiltration jihad,” these above-mentioned leaders are playing on people’s fears, creating imaginary threats to the nation’s demographic and religious balance. 

Furthermore, these speeches shrinking the very foundation of India’s secular democracy, where all religions are meant to be treated equally. Instead, they promote a vision of India where one religion is dominant and all others are viewed with suspicion and hostility.

The role of authorities in curbing hate speech

The time has come for a serious conversation about the accountability of public figures, particularly legislators, who use their platforms to promote hate and division. In Maharashtra, BJP leaders like Nitesh Rane, T Raja Singh, Ashwini Upadhyaya, and others have proven that they are willing to sow communal discord for political gain. Their speeches not only undermine the values of unity and secularism but also pose a grave threat to the fabric of society.

It is critical for the authorities to take swift action against hate speech and hold leaders accountable. The continued silence and inaction will only embolden others to follow in their footsteps, further poisoning the political discourse and deepening the divisions within our society. The future of Maharashtra, and indeed India, depends on the strength of its commitment to secularism, equality, and justice. It is time for the nation to stand united against hate, no matter where it originates.

On October 29, an FIR has been registered against the serial hate offender Kajal Shingala, also known as Kajal Hindustani, for delivering anti-Muslim hate speech during an event in Thane. According to the FIR, Hindustani has booked under sections 299, 302 and 353 of the Bharatiya Nyaya Sanhita, 2023, following the complaint submitted by Citizens for Justice and Peace (CJP) to the Chief Electoral Officer, Maharashtra on October 25. In complaint CJP had urged the CEO Maharashtra to take immediate action against the serial hate offender Kajal for delivering her inciting and communal speech, highlighting the violation of Model Code of Conduct (MCC). Following CJP’s complaint, on October 29, Wagle Police Station, Thane City booked the hate offender Hindustani along with the organizer of the event Veer Bahadur Yadav for outraging and wounding religious feelings and statements conducing to public mischief.

Notably, on October 25, Citizens for Justice and Peace (CJP) formally approached Maharashtra’s Chief Electoral Officer, S. Chockalingam, urging swift action and the registration of an FIR against serial hate offender Kajal Shingala. This complaint followed Hindustani’s inflammatory and anti-Muslim speech delivered at the Rananragini Sammelan on Lal Bahadur Shastri Marg in Thane West on October 19, 2024, organized by the right-wing extremist group Sakal Hindu Samaj.

According to the FIR, an event was organized by Veer Bahadur Yadav, Mehandipur Balaji Mitra Parivar (Thane) in which Mrs. Kajal Hindustani aka Kajal Shingala was invited as the keynote speaker for the said event. Around 400 to 500 people were present for the event. At the same time, Kajal Hindusthani during her speech addressed the Muslims and gave many examples of how a Muslim youth brutally murdered a Hindu girl in Delhi. He also called Muslim youths “Jihadists”. Also referring to the Waqf Board as “Land Jihad” they are illegally grabbing land and trying to turn India into an Islamic State.

Further, Kajal Hindustani has hurt the sentiments of the Muslim community by making divisive statements suggesting that Hindus should exclusively purchase goods from Hindu traders. She urged Hindus to display banners of “Varah” God in front of their shops, effectively promoting a boycott of Muslim vendors.

Additionally, Hindustani made derogatory accusations against Muslims, claiming they were involved in illegal conversions. She further targeted Christians by referring to them pejoratively as “Fatherwala,” as per FIR.

It is important to mention that, while accusing Muslim and Christian citizens of forceful religious conversion, Kajal Hindustani employed derogatory slurs such as “Chadar Wala” and “Father Wala,” and deliberately propagated the false narratives of “Land Jihad” and “Love Jihad.” These conspiracy theories aim to create divisions and incite fear within communities. Hindustani also targeted Bollywood actors for their interfaith marriages, according to CJP’s complaint.

Notably, in its complaint before CEO Maharashtra, CJP asserted that the speech delivered by serial hate offender Kajal Hindustani constitutes a blatant violation of the Model Code of Conduct (MCC). This rhetoric not only undermines the integrity of the electoral process but also falls under the provisions of the Bharatiya Nyaya Sanhita, 2023. Furthermore, Hindustani’s statements were in direct violation of Section 123(2) and (3) of the Representation of the People Act, which prohibits the promotion of hatred or enmity on the grounds of religion, caste, or community in relation to elections. This section explicitly bars any candidate or their agents from appealing to religious or communal sentiments to garner votes. The term “Jihadi” used for Indian Muslims are not only divisive and derogatory but also an insidious attempt to exploit religious sentiments for electoral benefit.

In its complaint, CJP also emphasised that the Model Code of Conduct (MCC) was in effect following the election schedule announcement and highlighted how the hate speech delivered by Kajal Hindustani violated several key MCC guidelines. Specifically, Part I, General Conduct, Clause 1 prohibited activities that exacerbated divisions or fostered mutual hatred. Hindustani’s use of terms like “Jihadi” aimed to instill fear and mobilize support, directly contradicting the MCC’s goal of promoting fairness in the election process. Additionally, Clause 3 forbade appeals to communal feelings for votes, yet Hindustani’s rhetoric invoked communal sentiments, risking alienation between different religious groups

The FIR, which cites violations of the Bharatiya Nyaya Sanhita, 2023, highlights the need for accountability in maintaining communal harmony. CJP’s unwavering commitment to combating hate speech not only seeks to hold hate offenders accountable but also emphasizes the crucial importance of adhering to the Model Code of Conduct during electoral processes. CJP aims to protect vulnerable communities and foster a more inclusive society, thereby reinforcing the rule of law and ensuring that divisive narratives have no place in our democracy. This decisive action marks a significant step in the ongoing fight against hate.

As Maharashtra prepares for its state assembly elections poll on November 20, right-wing outfits and serial hate offenders are intensifying efforts to stoke communal tensions. Their tactics aim to manipulate voter sentiment and undermine the integrity of the electoral process. In light of Model Code of Conduct (MCC) violations due to hate speech, Citizens for Justice and Peace (CJP) has approached the Chief Electoral Officer, Maharashtra urging immediate action against the Sakal Hindu Samaj event and requesting the registration of an FIR against serial hate offender Kajal Hindustani.

On October 25, Citizens for Justice and Peace (CJP) formally approached Maharashtra’s Chief Electoral Officer, S. Chockalingam, urging swift action and the registration of an FIR against serial hate offender Kajal Shingala, also known as Kajal Hindustani. This complaint follows Hindustani’s inflammatory and anti-Muslim speech delivered at the Rananragini Sammelan at Lal Bahadur Shastri Marg in Thane West, Maharashtra on October 19, 2024, organized by the right-wing extremist group Sakal Hindu Samaj.

According to CJP’s complaint, serial hate offender Kajal Hindustani through her speech, propagated harmful conspiracy theories, including those surrounding “Love Jihad,” “Land Jihad,” and alleged religious conversions. She accused Muslim citizens of luring Hindu girls into conversion, further claiming that Muslims in India are on a mission to transform the nation into an Islamic state through the so-called Ghazwa-e-Hind. Shingala derogatorily referred to Muslim boys as “Jihadis,” suggesting they are brainwashed into committing fraudulent conversions. Her inflammatory rhetoric not only demonised Muslims by labelling them as “Jihadis” but also attacked their religious identity. Additionally, she targeted Christians, accusing them of illegal conversions and using the pejorative term “Father Wala.”

CJP mentioned in its complaint that Kajal Hindustani’s speech constitutes a blatant violation of the Model Code of Conduct (MCC), (come into force in Maharashtra on October 15, 2024) and raises significant concerns about its potential impact on communal harmony and the integrity of the electoral process. CJP further added that such statements contribute to a climate of fear and division during the state assembly elections in Maharashtra, undermining the principles of free and fair elections due to deliberately attacks and targeting on the religious minority to impact and mobilize the electorate in the election process.

While accusing Muslim and Christian citizens of forceful religious conversion, Kajal Hindustani employed derogatory slurs such as “Chadar Wala” and “Father Wala,” and deliberately propagated the false narratives of “Land Jihad” and “Love Jihad.” These conspiracy theories aim to create divisions and incite fear within communities. Hindustani also targeted Bollywood actors for their interfaith marriages.

CJP emphasised the divisive background of serial hate offender Kajal Hindustani in its complaint, noting that this is not her first instance of delivering communal and inflammatory rhetoric in Maharashtra. CJP has been monitoring her speeches throughout 2023-24. For example, on May 4, 2024, at an event in Mudkhed, Nanded, Hindustani propagated the same false narratives, labeling Muslims as “Jihadis” and promoting conspiracy theories surrounding Love Jihad and Land Jihad. She accused Muslim citizens of trapping Hindu girls to convert them to Islam. In response, CJP urged the Superintendent of Police in Nanded to register an FIR against Hindustani for her divisive and provocative speech. Similarly, in April 2023, Hindustani was arrested by Gujarat Police for delivering an anti-Muslim inflammatory speech. Her arrest on April 29 followed stigmatizing remarks made during a congregation organized by the Vishwa Hindu Parishad (VHP) in Una town during the Ram Navami celebrations on March 30, 2023.

In its complaint, CJP strongly asserts that the speech delivered by serial hate offender Kajal Hindustani constitutes a blatant violation of the Model Code of Conduct (MCC). This rhetoric not only undermines the integrity of the electoral process but also falls under the provisions of the Bharatiya Nyaya Sanhita, 2023. Furthermore, Hindustani’s statements are in direct violation of Section 123(2) and (3) of the Representation of the People Act, which prohibits the promotion of hatred or enmity on the grounds of religion, caste, or community in relation to elections. This section explicitly bars any candidate or their agents from appealing to religious or communal sentiments to garner votes. The term “Jihadi” using for Indian Muslims are not only divisive and derogatory but also an insidious attempt to exploit religious sentiments for electoral benefit.

Violation of the Model Code of Conduct (MCC)

In its complaint, CJP stated that the Model Code of Conduct (MCC) is now in effect following the announcement of the election schedule, and that the hate speech constitutes a violation of several key MCC guidelines. Specifically:

  1. Part I, General Conduct, Clause 1: This clause clearly stipulates that political parties and candidates must refrain from any activities that may exacerbate existing divisions or foster mutual hatred among communities. The use of terms like “Jihadi” and depicting Muslim citizens as adversaries aims to instill fear and mobilize support during the electoral process. Such divisive rhetoric directly contradicts the objectives of the Model Code of Conduct (MCC), which is designed to promote unity and ensure a fair electoral environment in the state assembly election process.
  2. Part I, General Conduct, Clause 3: As, there shall be no appeal to caste or communal feelings for securing votes. Mosques, Churches, Temples or other places of worship shall not be used as forum for election propaganda, despite the ban, Kajal Hindustani uses the term for electoral mobilization, as the said speech invoke communal sentiments by promoting a narrative of division versus unity, which, given the political and social context of Maharashtra, could easily foster feelings of alienation and antagonism between different religious and cultural groups.

CJP’s prayer before the CEO, Maharashtra

In light of the grave concerns raised by Kajal Hindustani’s hate speech, CJP has requested the following actions from the Maharashtra State Election Commission in its complaint:

1. Call for proactive action

We pray for the Commission to implement suo-motu actions against hate-speech offenders and to actively monitor events in line with Hon’ble Supreme Court’s directions, ensuring that such incidents do not disrupt the electoral process.

2. Registration of FIR against serial offenders

We urged the immediate registration of an FIR against Kajal Hindustani, a known serial offender of hate speech. This action will serve as a deterrent and help prevent further occurrences of such harmful rhetoric.

3. Stringent enforcement of the Model Code of Conduct: We request that the Election Commission ensure the strict enforcement of the MCC, particularly with regard to preventing the use of communal appeals, inflammatory rhetoric, and any activity that may disturb public peace or target religious communities for political gain.

In light of the blatant MCC violations stemming from Kajal Hindustani’s hate speech, CJP firmly pleads in its complaint that “This foregoing highlights a clear violation of the Model Code of Conduct and the Representation of the People Act, as it underscores the need for political parties and candidates to avoid actions that may deepen existing divisions or foster animosity between communities. The use of terms like “Jihadi” and portraying Muslim citizens as enemies are attempts to incite fear and mobilize support in the electoral process, which the MCC aims to prevent. In light of these violations, we urge you to take cognizance of the enclosed video, register a case against the identified perpetrators as well as the organizers, and arrest them for cognizable offenses under the relevant sections. We also request confirmation on whether police officials videotaped the event as mandated by the Supreme Court. Furthermore, we ask to be kept informed of any developments and actions taken in this case, as this transparency will help rebuild faith in the rule of law and strengthen the police-citizen relationship.”

On July 11, 2024, Citizens for Justice and Peace has been filed a complaint to the Maharashtra Police over the provocative and hate speech delivered by social media influencer Kajal Hindustani in Mudkhed, Nanded, Maharashtra on May 4, 2024. As per the details shared by CJP in complaint, the said speech had been delivered by Kajal Hindustani at an event. Through her speech, she propagated fake conspiracy theories about Love Jihad, Land Jihad, religious conversion, and accused Muslim citizens of trapping Hindu girls to convert them to Islam. She further said that the Muslims of the country are on a mission to make India into Islamic nation by pursuing the mission of Ghazwa-e-Hind additionally, she used the derogatory term Jihadi to refer to Muslims boys, accusing them of being brainwashed to conduct fraudulent religious conversions. She with deliberate intention to disturb the long-standing harmony, urged people to boycott Muslim shopkeepers and called them demon Mahishasura.

A Gujrat resident, Kajal Shingala, who calls herself Kajal Hindustani, has been flagged multiple times for making inflammatory remarks against women and religious minorities. She has had a history of disturbing the communal harmony of India through her provocative and misinformed statements.

CJP highlighted the recent Hate Speeches delivered by her:

In the complaint filed before Police, CJP mentioned that Kajal Hindustani has strong antecedents in inciting hate and is a repeat hate offender as she has been involved in numerous cases of hate speech, and was arrested by the Gujarat police in April 2023 for delivering incendiary anti-Muslim speech at an event organized by Vishwa Hindu Parishad in Una.

On March 5 at Hindu Janakroash Morcha rally organised by Sakal Hindu Samaj in Ratnagiri, Kolhapur, she delivered a hate speech targeting Muslims, and accusing them of pursuing Ghazwa-e-Hind (battle to take over India and make it into Islamic nation). During her speech, she recalled that there are four major challenges before the country, i.e., love jihad, land encroachment, religious conversion, and drugs. Charging the religious minority of encroachment, she said, “They systematically plan all of these. They find a place, arrange 4 pieces of bricks around it, put a green cloth over it, and make it mazaar. Gradually it will take the form of Dargah, and then, when the government would talk about demolishing it, they will engage in stone pelting against the government authorities and police.” In this case, we sent our complaint to Dhananjay Kulkarni (Superintendent of Police, Ratnagiri) and M. Devender Singh (Collector, Ratnagiri) asking them to invoke IPC Sections 153A, and 505 (1) and (2).

In another video that emerged of her at an event in Nagpur organised by the same organisation on February 2 this year, she asked Hindus to socially boycott Muslims, arguing that any relation between a Hindu and a Muslim is impossible, as the latter wants to commit Ghazwa-e-Hind. In this case, we sent our complaint to Kamlakar Gaikwad (Superintendent of Police, Nagpur) and Vipin Itankar (Collector, Nagpur) asking them to invoke IPC Sections 153A, and 505 (1) and (2).

Similarly, on February 6, 2024 in a speech delivered at Shri. Shivaji High school in Navapur (Nandurbar), she urged that “Only buy groceries from Hindu brothers, only give jobs to Hindu brothers. If your Hindu brother is selling a Tomato at an expensive price than others, then buy less quantity but buy only from your Hindu brothers”, once again accusing the Muslim community of overbreeding, Ghazwa-e-Hind, and terrorism. In this case, we sent our complaint to Vinayak

Mahamuni (Sub Divisional Officer, Nandurbar) and Manisha Khatri (Collector, Nandurbar) asking them to invoke IPC Sections 153A, 505 (1) and (2).

This theme was further repeated during her speech on January 31, 2024 at an event in Jalgaon. In this case, we sent our complaint to M Rajkumar (Superintendent of Police, Jalgaon) and Ayush Prasad (Collector, Jalgaon) asking them to invoke IPC Sections 153A, and 505 (1) and (2).

The complaint also provides the recent directives issued by the Supreme Court of India in regards to curbing hate speeches, which directs the police to video tape such events that has a probability of hate speeches being delivered and then file suo-moto FIRs against the speakers and organisers and the circular issued by DGP Maharashtra in February, 2023 and May, 2023 urging strict action on Hate Speech.

CJP dispatched complaints to the Superintendent of Police (SP) and District Magistrate (DM), Nanded (Maharashtra), urging prompt action that the inflammatory and divisive speech delivered by Kajal Hindustani amounts to insightful and provocative. CJP has urged mandatory registration of FIR in incidents of Hate Speeches in compliance with the Hon’ble Supreme Court’s Order dated April 28, 2023, in which the division bench of Justice KM Joseph and BV Nagarathna in Ashwini Kumar Upadhyay v. Union of India [W.P. (C) No. 943 of 2021], directed all States/UTs to register Suo moto FIR against Hate Speech irrespective of religion. The court added that when any speech or any action takes place which attracts offences such as Section 153A, 153B and 295A and 505 of the IPC etc., suo moto action will be taken to register cases even if no complaint is forthcoming and proceed against the offenders in accordance with law.

Most crucially, we have also invoked the binding judicial orders of the Supreme Court in the Shaheen Abdullah vs Union of Indian (Writ Petition (Civil) 940/2022) which mandate the police to suo moto register cases in incidents of hate speeches, as per law.

With this substantive background and facts, CJP urged Maharashtra police to take action as per sections 196, 197 (1), 352 and 353 of the Bharatiya Nyaya Sanhita, 2023 and any other provisions of law, as deemed necessary by the police.

Seven complaints, to various police jurisdictions from Ratnagiri to Saswad, including Kamthi city (Nagpur), Jalgaon, Navapur (Nandurbar), Dongri (Thane), Saswad (Pune), Hupri and Ratnagiri (Kolhapur) have been filed by the Citizens for Justice and Peace in the past months against serial offenders Kajal Hindustani, T. Raja Singh, and Nitesh Rane from the controversial organisations like Sakal Hindu Samaj and Hindu Janjagruti Samiti. Four of these, against Hindustani, Singh, and Rane were filed before the jurisdictional police stations this week. Three previous complaints related to hate speech and events in January-February 2024 were filed on February 23 this year. CJP has invoked recent orders of the Supreme Court in the Shaheen Abdullah Case (WP (C) 940/2022) to approach jurisdictional officers and district magistrates (DMs) with these complaints while also ensuring that the Director General of Police is cognisant of these citizens’ actions.

March 2024 was blotted with hate speeches in Maharashtra taking forward a trend that has been marked since the change in the state government in June 2022. This has given the state the dubious distinction of entertaining a spate of such hate events that have on occasion’s seriously disturbed social peace. The January 2024 incidents at Mira Road-Bhayander are the most recent examples (See here, here, and here).

This week, by April 3, 2024, we have dispatched four of the seven complaints to the Superintendents of Police (SPs) and DMs, urging prompt action, beginning with registration of complaints and investigation in these cases. Evidence of the videos of these controversial speeches have also been provided. In these complaints, CJP has urged registration of offences under IPC Sections 153A (promoting enmity), 505 (statements conducing public mischief), and in some cases under Section 506 (criminal intimidation).

The hate speeches that have been delivered by Kajal Hindustani, Nitesh Rane, and T. Raja Singh -all associated formally or informally with the ruling dispensation in the state – not only slur and denigrate the Muslim community by spreading Islamophobia, but they also promote enmity between different communities, propagate false conspiracy theories like “love jihad and land jihad” and most critically contain the threaten of physical violence.

Most crucially, we have invoked the binding judicial orders of the Supreme Court in the Shaheen Abdullah vs Union of Indian (Writ Petition (Civil) 940/2022) which mandate the police to suo moto register cases in incidents of hate speeches, as per law. Besides, several executive orders by the Director General of Police (DGP) Maharashtra have also been relied on in these complaints. In coming months, CJP will also monitor hate speech and address the issue before the Election Commission of India (ECI) since the Model Code of Conduct (MCC) is in place.

Details of the complaints filed

Kajal Hindustani

This theme was further repeated during her speech on January 31, 2024 at an event in Jalgaon. In this case, we sent our complaint to M Rajkumar (Superintendent of Police, Jalgaon) and Ayush Prasad (Collector, Jalgaon) asking them to invoke IPC Sections 153A, and 505 (1) and (2).

Nitesh Rane

Rane is BJP MLA from Kankavli assembly constituency, and another regular face when it comes to delivering inflammatory speeches. On 27 February he made an incendiary speech in Dongri, Thane, accusing the residents of land jihad and threatened to evict them. He said he will burn them in a generator, terming the residents as illegal Bangladeshis. Additionally, he warned the police to take law and order in his own hand if the police did not comply with his directives.

Cautioning the police, he said, “If you want to maintain law and order situation under control, then you must stop all this illegal activity. It is the police’s responsibility. We have told you and come today. Otherwise, we will come tomorrow and get into the buildings and send all the Bangladeshis to Bangladesh. That’s why we have come to give a final warning…Where these Bangladeshi and Rohingya are coming from, nobody knows…We will not let any Bangladeshis take our rightful land. Now under ‘land jihad’, if anyone tries to evict Hindus, then they must know we are all standing here like a wall for our Hindu people.”

In this case, we sent our complaint to Sadanand Mane (Senior Police Inspector, Dongri Police Station) and Ashok Shingare (Collector, Thane) asking them to invoke IPC Sections 153A, 505 (1) and (2), and 506. Incidentally, in the month of January 2024, he had been booked by the Mumbai police under IPC Section 153A for delivering the anti-Muslim inflammatory speech during his Solapur rally.

T. Raja Singh

On January 31 this year, Raja Singh, who is an MLA from Goshamahal assembly constituency in Telangana and facing more than 40 criminal charges, delivered a fiery speech in Saswad, Pune, inciting the crowd to provoke violence against Muslim community by peddling fake narratives in the name of Love Jihad, and threatened them to take over their religious places in Mathura and Kashi even as he boasted about the demolition of Babri Masjid. He can be heard in the video saying, “Wherever you Jihadis have demolished our temples and built mosques over it, I challenge you, not one of them will remain”. An excerpt from transcribed speech reads, “If you find any Love Jihadi, cow slaughterer, or someone indulging in religious conversion, then report about that person to the government or police in the first place, if they don’t act, then respond in the manner of Chatrapati Shivaji.” Furthermore, he encouraged arms training for Hindus in order to defend themselves against Muslim threat, and asked the crowd to get ready for “Hindu Rashtra”.

In this case, we sent our complaint to Pankaj Deshmukh (Superintendent of Police, Pune Rural) and Suhas Diwase (Collector, Pune) asking them to invoke IPC Sections 153A, and 505 (1) and (2).

In another speech made on January 30, 2024 in Hupri, Kolhapur, at Hindu Janjagruti Samiti event, he addressed the crowd and said that “If you want to shoot the laundons (apparent slurred reference is to Muslim youth) then join Bajrang Dal.” Accusing Muslims of religious conversion and overbreeding, he remarked, “Earlier we had one Afzal, but today we can see the illegitimate children of Afzal Khan on every nook and corner of the streets. You can see them everywhere.”

In this case, we sent our complaint to Mahendra Pandit (Superintendent of Police, Kolhapur) and Amol Yedge (Collector, Kolhapur) asking them to invoke IPC Sections 153A, and 505 (1) and (2).

Thus, it is evident from the analysis of such hate speeches that they often scripted with same concepts and conspiracy theories, repeated time and again, in one or the other form, whose only purpose seems to demonise religious minorities and create fear psychosis in the mind of ordinary citizens, especially Hindus.

Citizens for Justice and Peace (CJP) has Hate Watch as a clear programme wherein it monitors hate speeches made through different media and complaints to relevant authorities. As a civil liberties movement that has been at the forefront of defending citizens’ liberties, including freedom of speech and expression. At the same time, it consistently tries to ensure a distinction between hate (harm-inciting) speech and controversial (free) speech.

Hence apart from regular complaints to the National Broadcasting Statutory Digital Authority (NBDSA), on ground hate events are agitated before the jurisdictional police stations. Hence, pursuant to Supreme Court orders, CJP has actively pursued police authorities and has written several complaints to police and local administration since January this year against hate speeches delivered in Maharashtra by the fringe elements. In all our complaints we have tagged relevant Superintendent of Police (SP) or Senior Police Inspector of the concerned Police Station, and Collector of the district in which the reported incident of hate speech took place. Additionally, DGP of the state of Maharashtra, Rashmi Shukla, has been marked in the complaints despatched physically and through email.

The state of Maharashtra has been in the national news over the last few months as the growing instances of hate speech delivered in political rallies by the extremist leaders came to the limelight. On March 20 last year the issue grabbed the headlines as The Indian Express reported, “4 months, 50 rallies in Maharashtra, one theme: ‘Love jihad’, ‘land jihad’ and economic boycott”. As the Lok Sabha elections will begin from April 19, such incidents are most likely to increase further, which might not only attract penalties under various provisions of Indian Penal Code, but can also violate the Model Code of Conduct and the provisions of the Representation of the People Act, 1951.

The push to remain in power is at the heart of political campaigns. In this poll merry-go-round—as dominance at the national level shifted to a party that does not balk from using hate-filled rhetoric— polling day, December 3 will reveal whether this ploy still works.

Two major national parties –the Bharatiya Janata Party (BJP) and a diminished Indian National Congress (INC) clash here. The 230 assembly seats are divided into Chambal, Bhopal, Baghelkhand, Mahakoshal, Malwa and other regions. The issue is whether any change in this large, central Indian state will herald some shift in the upcoming, 2024 parliamentary elections.

This is an incident from November 5. The person, Malini Gaur is also  among  a string of Hindutva hate-offenders. She has been Indore Mayor for 4 times. Recently, in a press- conference a reporter asked her some questions about her responsibilities and role, when she made a hateful statement against the minority sect. The reporter asked why the ‘Nigam’ (municipality) is not allowed in the Muslim areas and why the Muslims are so scared of her family? And why no Muslim wants to put remarks on her liability as a mayor?

In response, the mayor Malini, who was sharing the stage with other leaders gave a biased explanation. She said ‘I do not require vote of those, who don’t chant ‘Vande Matram’ or ‘Bharat Mata ki Jai’ while it’s neither a mandatory term nor a fundamental duty of any Indian citizen.

Balaghat, November 5, 2023

Apparently both the Congress and BJP are fierce political competitive, but just like the tales of harmony, no one has a monopoly over the propaganda to support a propaganda. It takes a certain murky amount of hate to support hate. A congress leader has been reported showed appreciation for an RSS-led march in Balaghat. As reported the leader Madhu Bhagat hailed the RSS volunteers with flowers on a street. The former MP Munjare has accused him of having connections with BJP.

Later, he also gave validations of this to the ‘Punjab Kesari’ publication.

Chattarpur, November 2, 2023

The “monk” ofBhageshwar Dham, Dhirendra Shastri addressed the Hindu youth and took oath to achieve the target of Hindu-Nation. He also greeted another controversialcompanion T. Raja who took oath to dedicate himself for the forged great resolution of founding a Hindu-Nation. While addressing the throng he said– ‘Do you want your temples to get devastated? Do you want Muslims to eat filthy food and do vulgar activities in your temples and devout destinations? Do you want to suffer like Kashmiri Pandits?’

The public shouted, “No’”.

‘Then I request you to support the Sanatani Hindu leaders, who are fighting for you and me.’ He asserted.

He also provoked the public to join their hate-mission in Telangana and instigated them through the sheer fake narrative of ‘Love-Jihad’.

Hindutva-watch has also posted a 20 second video on ‘X’ (Previously Twitter), on November 2, where cow-vigilantes are harassing two Muslim truck drivers in Betul. These persons are linked with the Rashtriya Hindu Sena and they are vehemently pushing the drivers into a car. Hate-speeches are systematically organised to promote such abhorrent incidents.

In Bhaisdehi, Betul, (reported by Hate Detector on October 24) the Vishwa Hindu Parishad organised an event to promote Hindutva conspiracy theories. A right-wing leader delivered a speech laced with distortions.  He even incited the gathering to arm themselves and by imputation be prepared for violence, ‘There should be a weapon in each household! Power-display is crucial! It’s important for the sake of life!’

Referring to the ongoing Israel-Palestine conflict, he said, ‘Israel is counted among one of the most powerful countries of the world, then how does Hamas attack Israel? …. When the police break-in their (Muslims) houses, they get swords, guns and pistols but we don’t even keep a baton to kill a snake!’

He also incited the love-jihad propaganda to provoke them to purchase weapons – ‘Within 5 to 10 years, there will be a war in India! They (Muslims) are targeting our mothers and sisters to convert their religion.’

Such communal claims seek to divine the ordinary voter. Citizens arming themselves are offences under the Indian Arms Act but unfortunately Indian police authorities are loth to prosecute hate speech.

Vidisha, October 4, 2023

On October 4, 2023, Kajal Shingala again addressed a group of Hindu girls in Vidisha and made controversial remarks about the banned Progressive Front of India (PFI). She said, “They have a roadmap to turn India into an Islamic state. The declaration letter of PFI will give you goosebumps! Muslim boys get official training to work on their agenda.’

Sagar, September 22, 2023

On September 22, 2023 the right-wing leader Kajal Shingala addressed young Hindu girls in the Sagar district to rouse hate and mislead them through a fake narrative of “Love-Jihad”. The congregation accumulated students from several schools and colleges of the city, where Kajal incited the crowd through her sensational use of language. After a brief oath-session to save “religion and culture from Muslim minorities”, she raised more conspiracy theories. She also made problematic statement about Prophet Muhammad and his wife Hazrat Ayesha. She stated – ‘We feed the first bread to Gau-ma (mother cow) and they eat the first bread with beef, Are we similar? In our religion we worship 6- and 9-year-old girls in Navratri, but in their religion, they get married at 6 and physically molested at 9, Are we similar?’

Further, she asserted,” ‘They are doing business behind the veil of love! But this is not love, this is ‘Love jihad’!  This is a part of their international conspiracy! The Muslim boys get funded by foreign countries to trap our girls. They get 50,000 per month for their contribution!’ She also requested these girls to watch ‘The Kerala story’ which is just another controversial film, criticised for  its communal agenda.

She also stated that India is known for this culture and enriched tradition and they (Muslims) want to abolish our values.  They are converting the Hindu girls through Love-Jihad to establish their autonomy.

As can be observed, from this Madhya Pradesh monitof on hate, over the past few days alone, the state has witnessed an outburst of hate, meant to provoke a population going to vote. These hate-speeches are directly and indirectly destroying the collective ethos of love and harmony.

Here are some simple tips on how to test news, speeches and social media forwards:

  1. Reliable news does not motivate to anger and reaction
  2. Truth can pain but not incite.
  3. During elections, such speeches violate the Representation of People Act (unfair practice during elections)
  4. Misuse of religion (any religion) and religious symbols during an election campaign violates the Indian Constitution and is a “corrupt practice” under the RPA.
  5. Citizens must always check on such “news,” facts and photographs before either believing them or sharing them.

Hate-offenders, backed by a powerful network of supremacist organisations, have created such false narratives to deepen existing social and caste prejudices, fester communal division and thereafter result in physical segregation and even out and out targeted violence.

  1. A hate-speech lacks data or any rational sense of fundamental accountability.
  2. It creates hysteria
  3. It is supported by prejudice, complexes and supremacist politics.
  4. It is particularly manufactured and systematically spread to deepen community, gender and caste divisions.
  5. It is designed to mislead
  6. It generates a chain of decisive narratives and is against the law of inclusion, non-discrimination and transparency.

Kajal Singhala aka Kajal Hindustani has once again delivered a hate speech and this time in Surat. Despite three FIRs against her, the woman remains undeterred and has continued with her agenda of spreading hatred against the Muslim community, making false and baseless claims about them and their culture and calling for their social and economic boycott. In this speech given to a bunch of women, she thwarted the idea of brotherhood between the two communities by underlining the differences in both Hindu and Muslim cultures, whilst making derogatory and false claims about Muslims, thus demonizing them.

She invokes hatred by questioning the courage of Hindus and incites them to take up weapons, just like Hindu gods did and saying things like do Hindus have the courage to pelt stones, strap bombs, sit for 6 months and do chakka jam like Shaheen Bagh women.

The speech was made at an event organised by Bharat Raksha Manch” and the video surfaced on June 13.

Here are some extracts of her vile speech:

“No matter who is in power, the system is run by these ‘jihadis’”

“The problem is in law and order in areas where the jihadi population is high”.

“He (A Muslim) doesn’t care about unity. His agenda is gazwa-e-hind. His agenda is to make India an Islamic nation and he’s working hard to fulfill this agenda.”

“You wanted to write history but you are afraid of death. The battlefield asks for sacrifice but you have headed home. This non-violence is an illusion, it’s a trap by the enemies. Listen to me, This is the time for Hindus. If non-violence was holy, Sri krishna would not narrate Gita and why would he propagate war for peace. You are a cowardly species, you are hesitant to go to war. The battlefield asks for sacrifice but you have headed home.” (this was a poem she recited in Hindi)

She tried to incite the audience to take up weapons for their own protection. “There should be a big movement so that these jihadis get so scared that they do not dare to abduct any Hindu girl.”

“When these snakes shed their skin, they will come out as jihadis only”

She said, “stop with this brotherhood, as their intention is to only cause riots. How can a cow protector and a cow killer become brothers?”

She then drew parallels between Hindu and Muslim cultures and made baseless and derogatory claims about Muslims and their way of life.

She then made claims that she has a record of 12 deaths of Hindus in the past 5 months but nobody, not even the government talks about it because there is no value of Hindu lives and Hindus do not demand their rights. While they (muslims) pelt stones, strap suicide bombs.

She said, these “puncture walas” (derogatory term used for Muslims) are the only ones saying that there is no development, inflation is on the rise, Unemployment is rising, petrol prices are rising, cylinder prices are increasing.

“Don’t even let him 500 metres or even 1 km near your house or he will enter your society to sell vegetables, fruits and he will destroy you. Their conspiracy is to destroy Hindu families by doing love jihad, land jihad, conversions…Hindus are paying taxes on their temple but he’s not paying any tax.

Kajal is incessant with her diatribe and 3 FIRs and one arrest in the recent past has no effect on her. FIRs have been registered against her in Navi Mumbai, Mira Road and Una (Gir Somnath).

Kajal Singhala a.k.a Kajal Hindusthani, the golden girl of extremist right-wing groups, is back from her break and has delivered two compelling speeches centred on the goals of Hindutva while using the occasion to spew anti-Muslim rhetoric. Hindusthani, who had been away from the limelight for  some weeks after being arrested by Gujarat police a week after delivering a similarly incendiary speech on March 30 on the occasion of Ram Navami in Gujarat’s Una town. The purported speech, delivered at an event organised by Shree Ramkrushna Janmotsava Samiti, had triggered communal clashes in Una at the time.

But now, the serial hate speaker is back and has given two speeches both located within the state of Gujarat. Through both the speeches, Hindusthani has majorly targeted and provoked Hindu women, urging them to take up arms to protect their dignity, their religion and their nation. As a part of our rigorous hate watch campaign, we have been diligently maintaining a record of the hate speeches being made by her on public platforms. From the pattern of her speeches, a major agenda behind her words, asking women to take the form of Goddess Kali, so that a false image of the revered Goddess combined with a perpetrated sense of insecurity from Muslim men is created in their minds, giving birth to more radicalised and provocative female leaders in like Sadhvi Rithambara and Sadhvi Pragya.

Hindusthani, a calling herself a religious leader, espouses a hard, right-wing, exclusionist ideology, and can be seen delivering incendiary and inciteful speeches through which she has targeted the religious minorities of our country, especially the Muslim community. Her current speeches, which are majorly in Gujarati, repeat the same 3-4 poems that urge the Hindu community to take up arms because “their religion and nation requires it.” In the first speech of the recent set of two speeches, delivered in Surat city of Gujarat, the video of which had been accessed by us on May 27, she delivered another frenzy communal speech, making open calls for establishing a Hindu nation. Through her poems, she called “non-violence a delusion”, something which was not envisioned by Hindu Lords, and said that the Hindus need to be ready now as their “battlefield demands sacrifice.”

In the other speech, made in the Kutch district of Gujarat, the video of which had been accessed by us on May 28, she delivered another communal and hate-spewing speech. Creating fear and insecurity in the minds of her Hindu audience, of the decline or erasure of their Hindu culture, Hindusthani made open calls to the women to take on the responsibility of protecting the Hindu culture and themselves. Selectively bringing in the issue of the Shraddha Walker murder case (because Aftab Poonawalla the man accused of murder is a Muslim), morphed to advantage the Hindu propaganda of Love-jihad, Hindusthani urges the women to become a Shraddha that can protest herself from Aftab, the accused in the murder case. She even spoke about her case, and said that it was the conspiracy of the Muslims to “shut her mouth”. The case against her in which she has been arrested was for the crime of provoking social disharmony with the potentiality of generating violence. She then states with a brazen impunity that even getting booked and sent to judicial custody will not dissuade her as Rani Lakshmi Bai, an icon of the resistance to the Britishers, was her ancestor.

She then proceeds to spread misinformation by saying that the Gujarat police is scared of acting on the illegal and criminal acts of the Muslims, such as throwing stones and glass bottles at the Hindu community processions, alleging that the police is “scared” of them. She further said that the action taken against her was because she was a Hindu, and to make the headlines, and was the police way of justifying the criminal acts committed by the Muslim population.

She also explained that the “trap” of Love-Jihad is being spread through four mediums- Bollywood, social media, creating an environment of fear and through drugs. She states that the Muslim community agenda behind supplying drugs to every district, every city and every village of our country is to ensure that Hindus are harmed and destroyed. With the aim of ensuring that her audience does not believe any other narrative than promoted by her and her peers, she said that the words uttered and ideology promoted by the left inclined social media, communist and the opposition are all a part of the Muslim agenda, and are working from within the country to create a divide.

It is crucial to note that Hindusthani has been described as a “crowd puller at the local levels” by her Vishwa Hindu Parishad mentors. Thus, she uses the popular terms, and  frequently raises the issue of so-called “love-jihad” — a term used to describe the alleged efforts of Muslims to convert Hindu women through marriage — along with words such as “land jihad“. Most of the times, she refer to the Muslim community as ‘Jihadis’, and ‘aatankwaadi (terrorists)’.

The arrest of Kajal Hindusthani by Gujarat Police

Kajal Hindusthani, who had been evading arrest for a week after she had been first booked for giving a hate speech at Una town in Gir Somnath district during the Ram Navami celebrations, was arrested finally on Sunday, April 9, 2023, after she surrendered at the Una town police station Sunday morning. A local court sent her to judicial custody after the police did not seek any remand. She was sent to Junagadh jail. On April 13, a Gujarat court had granted bail to Hindustani.

As per the information provided by the police, tension had built up after Hindusthani’s speech in Una as a mob of around 200 people had assembled and allegedly indulged in violence by pelting stones and glass bottles at the homes of people and passer-by’s. They had also vandalised vehicles.

Hindusthani was also booked under IPC Sections 195A (deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs), 153A (promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc. and doing acts prejudicial to maintenance of harmony) and 505 (statements conducing to public mischief).

Another FIR has been filed against Kajal Shingala aka Kajal Hindustani, on April 24, for her most vitriolic speech, due to which she had gained publicity in the first place. This was delivered in the Mira Road area of Mumbai suburbs in front of over 1,500 people at the Hindu Jan Aakrosh Morcha event on March 12. She has been booked under sections 153A [promoting enmity between different groups etc]and 505(2) [Statements creating or promoting enmity, hatred or ill-will between classes] of the IPC

In this speech, Kajal made Islamophobic comments like, “I am seeing that Hindus have left Mira Bhayandar and Jihadis have usurped and captured this area.” She highlighted 3 main factors of Islamic encroachments: 1. Love Jihad 2. Illegal Muslim encroachment and 3. religious conversion. She even called Hindus impotent for not taking up violence. She used derogatory words like ‘Fatherwala’ and ‘Chadarwala’ as well, among other things.

The speech had caused ripples in the peace-loving residents of the area who had organised a campaign uniquely called ‘#GetWellSoonGeetaJain’ for which the local MLA Geeta Jain had also attended the events where Kajal spoke. The protestors had printed postcards with slogans and the local MLA’s address and were requesting common citizens to add their names and signatures to it. The citizens were against the vitriolic hate speech made by Kajal. However, this campaign was disrupted by the police saying that the MLA;s name cannot be used in the protest. On being asked why, the police reportedly told the organisers that they will not be able to prevent any ‘untoward’ incident from happening if the MLA’s supporters turn up.

The following day, a delegation of citizens and representatives of political parties including the CPI (M), AAP and Shiv Sena(UBT) met the Mira-Bhayandar Vasai Virar police commissioner with a letter listing elements from the vicious hate speech and requested him to take action against Kajal and others. Madhukar Pandey, the Commissioner of Police, had assured the delegation that the event was recorded and also assured them that action will be taken soon.

This FIR appears to have followed this meeting of the delegation as this is a suo moto action by Mira-road police. The FIR has been filed by Havaldar Ranjit Bange. In the FIR it has been stated that the rally was carried out from Golden nest circle to Salasar Central Park ground and culminated there around 11.30 am. It is stated that workers of Vishwa Hindu Parishad (VHP), Bajrang Dal, RSS, Hindu Jagran Manch, Hindu Rastra Sena etc participated in this rally.

The FIR details what Kajal Hindustani spoke about  including Land Jihad, Love Jihad, how to protect Hindu religion, how Muslim men trick Hindu girls through movies, social media into drugs and love jihad and how Hindus should beware of such things.  The FIR calls this speech objectionable and quotes some extracts from the speech as well, including her calls for economic boycott of ‘jihadis’. The FIR states that the speech intended to create enmity, hatred between religions and was detrimental to communal harmony.

The FIR is under the investigation of Inspector Vijaykumar Chavan.

On Monday as well an FIR was filed against Kajal at Vashi Police station, Navi Mumbai for her speech at Jan Akrosh Morcha held on February 26. She was booked under section 153A (promoting enmity between groups on grounds of religion, race, language, etc.), 153 B (Imputations, assertions prejudicial to national integration), 295A (acts, intended to outrage religious feelings), and 505 (statements conducing to public mischief) of the Indian Penal Code (IPC).

On April 13, a Gujarat court had granted bail to Hindustani, who had been sent to judicial custody for 14 days for allegedly delivering a hate speech during the Ram Navami celebrations that led to communal clashes in Gujarat’s Una on April 1. She was arrested on April 9 after she surrendered to Una Police.

However, after her bail, two more FIRs are against her but neither Vashi Police nor Mira Road police have proceeded to arrest her.

On February 26, 2023, the aforementioned rally had been organised by the Sakal Hindu Samaj to push communal agendas and put pressure on the state government to pass legislation to deal with ‘Love Jihad,’ (‘forceful conversion’), cow slaughter, and ‘illegal encroachment on Hindu land’. It is during the same rally that open calls for an economic boycott of the Muslim community were made.

First Information Report (FIR) has now been filed by the Maharashtra Salokha Samiti against Hindusthani. In the FIR, the complainants have provided the details of the speech given by her, which is as follows: “Now here he was selling apples with a bag. I really want to get down from the stage and see his Aadhaar card whether the seller is Abdul or Ajay. Small things have to be taken care of. There is a vegetable market next to it and Oh Abdul listen, my Hindu brother is boycotting you.”

The complaints, both women, have also highlighted the other statements made by Hindusthani with the aim of creating a religious divide and religious bias, such as “Tu Kali Ban, Tu Durga Ban, Kabhi Na Burkhewali Ban (become goddess Kali, goddess Durga, but never become a burkha donning woman)”. As emphasized by the complainants, Hindusthani has delivered the said anti-Muslim hate speech with the intention of insulting a certain religious group, creating hostility, hatred and divisiveness, which has the potential to hinder national unity and harmony.

Hindusthani has been booked under section 153A (promoting enmity between groups on grounds of religion, race, language, etc.), 153 B (Imputations, assertions prejudicial to national integration), 295A (acts, intended to outrage religious feelings), and 505 (statements conducing to public mischief) of the Indian Penal Code (IPC).

When the SabrangIndia team contacted the police inspector in-charge of investigating this matter, the office provided that no action has been taken yet.

At the mentioned rally, Hindusthani was a keynote speaker. As had been previously reported by the Citizens for Justice and Peace (CJP), she had made misleading and distinctly Islamophobic statements, “In Navi Mumbai, land jihad has become so prevalent that today 25 Bangladeshi Muslims live in one room.” Making an unconstitutional call, urging people to boycott Muslim vendors, Hindusthani claimed that they (Muslims) have taken over our produce and fruit markets. I want you to repeat after me: “We, the people of Maharashtra, will boycott them economically.”

“I urge you to question your Navi Mumbai Municipal Corporation,” she said, citing the ‘illegal’ construction of eight dargahs in APMC fruit market, as well as dargahs near Ghansoli and at several Navi Mumbai stations, as was reported by the Indian Express. Provoking people to damage public properties, she said that “only when the women of our households come out and question the authorities will Navi Mumbai be free of them. Do they seek permission to build illegal dargahs? So why do you need permission to demolish their property?”

Continuing with her communal diatribe, Hindusthani had instigated her Hindu audience to not rent or sell their spaces to them. She further added that if this is happening in your neighborhood, form an association with rules stating that anyone who is not an idol worshipper should not be rented or sold a flat.

It is essential to note here that on April 13, a Gujarat court had granted bail to Hindustani, who had been sent to judicial custody for 14 days for allegedly delivering a hate speech during the Ram Navami celebrations that led to communal clashes in Gujarat’s Una on April 1.

She was arrested April 9 on a Sunday morning, after she had surrendered at the Una police station. A FIR had been registered against Kajal on April 2 under sections 295A, 153A and 505 of the IPC.
