In a significant development amid political pressure and allegations of cover-ups, a Delhi court on April 1, 2025, directed further investigation against BJP leader and Delhi Law Minister, Kapil Mishra over his alleged involvement in the 2020 North-East Delhi riots. The ruling marks a crucial first step in addressing long-standing allegations of incitement and complicity in the violence.

Additional Chief Judicial Magistrate Vaibhav Chaurasia of the Rouse Avenue Courts orally remarked, “this means FIR,” indicating that the court’s directive for further investigation effectively necessitates the registration of a First Information Report against Mishra. The judge observed that a cognizable offence had been established concerning one of the incidents detailed in the complaint, warranting deeper scrutiny.

The court stated that the evidence presented by the prosecution clearly placed Mishra at the scene and that “all the things were corroborating.” It further noted that Mishra, during interrogation, admitted to being in the area and acknowledged that people had gathered around him, many of whom he knew. This admission, the court stated, “fortifies the allegations of the complainant.”

Significantly, the court pointed out that Mishra’s statement was not framed in terms of support for or opposition to the Citizenship Amendment Act (CAA) but rather in explicitly communal terms. The court noted that Mishra “had not framed his statement under ‘Pro-CAA or Anti-CAA’ but rather ‘DUSRI TARAF MUSLIM’ with the distinction of us and them, wherein them is ‘DUSRI TARAF MUSLIM.’” The judge remarked that such rhetoric “clearly establishes sides and requires investigation to unearth the truth.”

As per a report in LiveLaw, the court further observed that Mishra’s presence in North-East Delhi a day before the riots, which he himself admitted, could not be ignored. Additionally, it directed that senior police officer DCP Ved Prakash Surya be examined, following allegations by the complainant that Surya had threatened protesters, saying, “If you did not stop this protest, then consequence will happen here that you will be killed.” The judge stressed that “his personal interrogation is necessary,” adding, “The series of events reveals that perhaps, if allegations of complainant are found to be true, then DCP Ved Prakash Surya knows something which this Judiciary does not.”

At the same time, the court stated that if the complainant’s allegations were proven false, the Delhi Police would be at liberty to take action under Section 182 of the IPC for filing false information. It also directed the DCP of North-East Delhi to ensure that the order for further investigation was sent to the appropriate police station within its jurisdiction. Failure to comply, the court warned, would hold the DCP legally accountable.

The Delhi Police has been ordered to file a compliance report by April 16, 2025, the next date of hearing. Petitioner Mohammad Ilyas was represented by Advocate Mehmood Pracha, while Special Public Prosecutor Amit Prasad appeared for the Delhi Police.

This directive represents a major step towards accountability in the 2020 Delhi riots case, even if it is beginning 5 years down the lane. Despite the political climate and prior reluctance to act against influential figures, the court’s insistence on further investigation highlights the need for an impartial and thorough probe into the events leading to the communal violence.

Details of the complaint against Delhi Law Minister Kapil Mishra

A Delhi court was hearing a complaint filed by Mohammad Ilyas, seeking an investigation into the alleged role of BJP leader and Delhi Minister Kapil Mishra in the 2020 North-East Delhi riots. The plea, however, was met with strong opposition from the Delhi Police, who argued that Mishra was being falsely implicated as part of a “well-planned conspiracy.”

The complainant, Mohammad Ilyas, sought the registration of an FIR against Mishra, along with then SHO of Dayalpur police station and five other individuals, including BJP MLA Mohan Singh Bisht and former BJP MLAs Jagdish Pradhan and Satpal Sansad.

According to Ilyas, on February 23, 2020, he personally witnessed Mishra and his associates blocking a road and destroying the handcarts of street vendors. He also alleged that the then Deputy Commissioner of Police (North-East) and other officers were present alongside Mishra as he issued warnings to anti-CAA protesters, demanding they vacate the area or face dire consequences.

Ilyas had moved the court in December 2024, urging an inquiry into the roles of Mishra and six others in the riots, which resulted in 53 deaths and over 700 injuries. In March 2025, the Delhi Police reiterated their stance, arguing that Mishra’s role had already been investigated and “nothing incarcerating” had been found.

In his petition, Ilyas specifically named Mishra, Mustafabad MLA and Deputy Speaker Mohan Singh Bisht, the then DCP (North-East), the then SHO of Dayalpur police station, and former BJP legislator Jagdish Pradhan, holding them responsible for inciting the riots. As reported by The Hindu, Ilyas stated that he saw Mishra and his associates obstructing a road in Kardampuri and damaging street vendors’ stalls. Additionally, he alleged that the former North-East DCP and several police officers stood by as Mishra issued threats to anti-CAA demonstrators.

Ilyas also accused the former Dayalpur SHO and others of vandalising mosques across North-East Delhi, further intensifying concerns over the role of law enforcement in the communal violence.

Delhi Police opposes plea seeking FIR

On March 6, 2025, the Delhi Police filed a written submission before a Delhi court, opposing a plea that sought the registration of an FIR against BJP leader and Delhi Minister Kapil Mishra for his alleged involvement in the 2020 North-East Delhi riots.

The police contended that the complaint, filed by Mohammad Ilyas, was part of a “well-planned conspiracy” to falsely implicate Mishra in the riots. They asserted that the BJP leader had no role in the violence and was being deliberately framed.

As part of their argument, the prosecution referred to conversations from various WhatsApp groups, including the Delhi Protest Support Group (DPSG), alleging that certain individuals had orchestrated a social media campaign against Mishra. The police claimed that the hashtag #ArrestKapilMishra was being used strategically to construct a misleading narrative around his involvement in the riots.

Additionally, the Delhi Police maintained that Mishra’s alleged role had already been investigated and that no incriminating evidence was found against him. In an earlier submission from October 2024, the police argued that the riots were the outcome of a “pre-planned conspiracy” designed to incite violence in Muslim-majority areas, particularly around mosques and religious sites. The goal, they claimed, was to escalate “protests” into “Chakkajaam” (road blockades) once a critical mass of demonstrators had gathered.

The police further stated that misleading WhatsApp messages were circulated at the time, falsely alleging that a mob led by Mishra had initiated the violence. They insisted that these claims were part of an attempt to create a false narrative and implicate him in the riots.

Opposition demands resignation of Kapil Mishra following court’s order

The Aam Aadmi Party (AAP) and the Congress on April 1, 2025, demanded the resignation of Delhi Law Minister Kapil Mishra after a city court directed the registration of an FIR to investigate his alleged role in the 2020 North-East Delhi riots.

Addressing a press conference, Delhi AAP president Saurabh Bharadwaj stated that sufficient evidence of Mishra’s involvement was already in the public domain and called for his immediate arrest. “Mishra should resign and be arrested, as the court has ordered an FIR to probe his role in the riots. For the sake of morality, he should step down, just as others accused in the case have been arrested,” Bharadwaj asserted.

As per the report of Times of India, Bharadwaj further criticised the delay in legal proceedings, pointing out that it took over five years for the judicial system to act on the case. Bharadwaj also alleged that a judge who had previously directed the police to take action in the case was transferred to another state.

AAP’s chief spokesperson Priyanka Kakkar echoed the demand, questioning why Mishra was being treated differently from others accused in the riots. “Every other accused in the Delhi riots case has been arrested. Why is Kapil Mishra an exception?” she asked.

Delhi Congress president Devender Yadav also called for Mishra’s resignation, citing the court’s findings. “The Rouse Avenue court has established that there is a cognisable offence against him. This is a serious matter, and if there is any sense of morality left, he should resign immediately to allow for a fair and independent investigation,” Yadav said.

Delhi riots case and Mishra’s incendiary speech

The 2020 North-East Delhi riots: The 2020 Delhi riots, which took place between 24 and 26 February, led to significant violence in North-East Delhi, resulting in 53 deaths, over 500 injuries, and extensive property damage. Ironically, while a majority of those killed and harmed were Muslims, most of those who have been arrested for their role during the riots are also Muslims. Several student leaders and activists, including Umar Khalid, Gulfisha Fatima, and Sharjeel Imam, were accused by the police of conspiring to incite the riots. These remain in jail, with the trial yet to begin. However, a fact-finding team formed by the Delhi Minorities Commission concluded that the violence was “planned and targeted” and held BJP leader Kapil Mishra responsible for triggering it.

Mishra’s alleged role in inciting violence: Delhi Cabinet Minister and BJP leader Kapil Mishra is accused of provoking violence through a speech delivered at Maujpur Chowk on February 23, 2020. In his speech, he issued an ultimatum, demanding that the police clear anti-CAA protest sites within three days or risk intervention by his supporters.

The fact-finding report had noted that “violence started in different pockets almost immediately after the short speech of Shri Kapil Mishra on 23 February, 2020, at Maujpur, in which he openly called for forcefully removing the protestors at Jafrabad in North-East Delhi.” It further highlighted Mishra’s explicit warning: “After that, we will not listen to the police if roads are not cleared after three days…”

The committee criticised the Delhi Police for failing to act against Mishra, despite senior officer DCP Ved Prakash Surya standing beside him during the speech. The report stated that “the open admission of ‘not listening’ to the police and extra-legal tactics should have been seen by the authorities as inciting violence.” The committee concluded that by not apprehending Mishra, the police “failed to take the first and most immediate preventive step needed to avoid violence and protect life and property.”

Legal challenges against Mishra and other political leaders: Multiple legal petitions have been filed seeking an FIR against Kapil Mishra for inciting violence. Human rights defender Harsh Mander had petitioned for an FIR against Mishra under Section 153 of the IPC (provocation for riot) and Section 125 of the Representation of People’s Act (causing ill will between communities for electoral purposes). These sections do not require prior government sanction.

Similarly, CPI (M) leader Brinda Karat has been pursuing legal action against politicians whose speeches allegedly incited violence against anti-CAA-NRC-NPR protestors. She approached the Delhi High Court after her plea to register an FIR against Union Minister Anurag Thakur and BJP MP Pravesh Verma for their alleged hate speeches was dismissed by a trial court on technical grounds. The trial court had ruled that a prior sanction from the central government was required before proceeding. Karat challenged this ruling, arguing that such procedural objections should be addressed early to prevent unnecessary delays in cases involving hate speech. (Details may be read here.)

As elections and voting concluded on June 1 and the country awaited the final results on June 4 with bated breath, a closer look at BJP’s electoral campaign revealed that hate speech, dog whistling, and communally charged rhetoric remained prevalent. As part of its Hate Watch segment, Sabrang India and Citizens for Justice and Peace (CJP) have collated the top incidents of hate speech in the month of May 2024.

Solapur, Maharashtra

Another serial offender has raked Maharashtra with his hate speech once again on May 4.

BJP MLA from Telangana’s Ghoshamahal constituency in his speech asked the state’s chief minister Eknath Shinde to not campaign or ask Muslims for votes, and instead to ask from those who ‘save Gaumata.’ He also further called for not buying halal certified goods and demanded bulldozers to start demolitions in Maharashtra as well.

“We had heard of land jihad, and love jihad. Now we hear of vote jihad.’ Referring to Salman Khurshid’s comment for voters to commit vote jihad, he goes further, “There was a time, when ‘you’ did a lot of jihad, now is not that time anymore because if you do jihad now, Modiji will hammer you (thok denge).”

Consequently, according to Siasat News, Singh along with Nitesh Rane were booked by the police for their speech on May 7th.

Ayanagar, Delhi

New Delhi’s Ayanagar reportedly saw a communally charged speech by BJP’s Rajya Sabha MP Rakesh Sinha who spoke of ‘chopping off fingers’ of those who ‘point fingers’ at Ram.

“I promise you that after 2024, the mosque from Kashi Vishwanath will be done for. The mosque in Mathura will also get done with. We are well aware of how to chop off the fingers of those pointing fingers at Bhagwan Ram, Bhagwan Krishna and Bhagwan Shiva’s temples. The incoming Narendra Modi government will remove the shadow that Mughals have cast over our Bhagwan Krishna’s Mandir after returning in 2024.”

Nanded, Maharashtra

On May 4, Kajal Hindustani, a social media influencer, gave an incendiary speech, urging the Hindu community to do ‘love and land jihad.’

In the name of secularism, you are being played. Your brother is sitting like a butcher and is chopping you. In nine states and in many districts, Hindus have become a minority. After railway and the defence, Muslims own the most land. Our women, temples, land and gau mata are not safe. Nor is the Hindu safe in this country. You have only one nation. Other Hindus are running to India from Pakistan, Afghanistan, and Bangladesh. Indian government has promised them citizenship. But where will you go? The Hindu is running from here, from Assam, Bengal etc. Till when and where will you run? How much will you run? Our jihadi brother, he is dreaming of Ghazwa e Hind. What is Ghazwa e Hind? Making India an Islamic nation. They are working according to a terrorist, Talibani ideology. What are we doing? We are only raising slogans. Till when will you stay like this, watching your sister get targeted by ‘love-jihad?’ You get prepared, you too do ‘love-land jihad’, do religious conversions.”

Navneet Rana gave a hate-filled speech on May 9 while campaigning for the BJP’s Madhavi Latha who is contesting from Hyderabad.

She was speaking to Asaduddin Owaisi and his brother Akbaruddin Owaisi, “The younger brother says ‘remove the police for 15 minutes so that we can show them what we can do’. I want to tell the younger brother that it might take you 15 minutes, but for us it will only take 15 seconds. it will take us all of 15 seconds if we come to it.”

Similarly, on May 11 in Maharashtra’s Aurangabad she made the following speech.

“We don’t need 15 minutes to finish you up. We can do it in 15 seconds. I am not scared of any ‘Pakistan ki aulad’.” Pakistan ki aulaad is a slur used to refer to Muslims in India. He continues saying, “Ayodhya was just a glimpse, Kashi and Mathura are left.”

Kalkaji, Delhi

Notorious offender and BJP Leader Kapil Mishra, who shot to fame for his hate speech after the northeast Delhi riots for saying “Desh ke Gaddaron ko, Goli maaro saalon ko.”, is once again in the news for giving highly charged hate speech.

If one lane has two houses, one man has two kids one has 12. Allah ki dene” The crowd laughs, “Now the government says to combine property of both, and give equally to both. Now who will get the most money?’ The crowd jeers. “Are they not giving 10,000 rupees to laundya (slur), to Rohingyas. Now, you have a look at any photo of any Rohingya woman, have you seen? Four kids in the side, fifth in her hand, and the sixth – ?” The crowd jeers that the sixth is in her ‘stomach. Is it not the case? These Rohingya and Bangladeshi are taking money for going to school and giving to those who go to madrasa. Will we let that happen? Also, secondly, they will take the reservation given to Dalits, OBCs, and Adivasi and give it to Muslims. Will we let that happen?”

Hamirpur, Himachal Pradesh

On May 23, Hamirpur in Himachal Pradesh witnessed a speech charged with communal tones by BJP MP and Minister of Information and Broadcasting of India, Anurag Singh Thakur. He was speaking about alleged “Muslim appeasement” by Congress. The phrase is often used as a bogey by right-wing supporters as a dog whistle.

“Congress will give reservations to Muslims and they will distribute property amongst people having more wives and children.”

Kolhapur, Maharashtra.

On May 20, Vishwa Hindu Parishad’s General Secretary Surendra Jain’s speech similarly made a charged speech filled with conspiracy theories directed against Muslims. He made the speech in Maharashtra’s Kolhapur, saying “Wherever Hindus are a minority, they are in danger. Fear mongers about Muslims and Christians sending money from abroad to convert Hindus in India. Hindus are being tricked into Christianity. We are under attack from Muslims and Christians.”

He further spoke of a united ‘Akhand Bharat,’ invoking countries such as Germany, Israel and Vietnam, and demanding that Hindu land in Pakistan and Bangladesh be “brought back.”

Deoghar, Jharkhand

On May 22, repeated hate speech giver, Himanta Biswa Sarma reportedly spoke in Jharkhand and gave a communally charged speech. He said, “Assam has suffered due to infiltrators and Rohingya. The Infiltrators consist of about 36% of the population, they have come from Bangladesh and settled in Assam. In 10 years, Jharkhand will be like Assam as well (with regards to the migrant population), the demography will change. It’s under the rule of the opposition that most infiltration happens.”

He further spoke about Kashi and Mathura as well, “We need 400 seats to build these temples; Madrasa & Mulla. It’s not our job to make Mullas. I shut down about 700 Madrasas in one day. Hemant Soren allows namaz in the state assembly, so if that happened then we should also be able to recite the Hanuman Chalisa. They are giving Fridays off, we have to stop it like I did in 12 districts of Assam. Vote for us to stop infiltration, build the Krishna Janmabhoomi Temple and the Gyanvapi Mandir. Vote for a united Kashmir and vote to shut down all these Madrasas.”

Palghar, Maharashtra

Uttar Pradesh Chief Minister Yogi Adityanath further sparked controversy as he claimed that the Azaan (call to prayer) will disappear from mosques in the next five years. He made the speech in Palghar, Maharashtra.

According to The Observer Post, he said, “Today you must be seeing that all the encroachments in Uttar Pradesh have been removed. Now, no one even thinks about riots there. Now no one offers prayers on the streets in Uttar Pradesh. Even the loudspeakers from the mosques have been taken down. In the next five years, you will see that people will forget that these things even existed.” The report states that a complaint against this statement has been filed at the ECI.

On May 29, the chief minister of UP again made a speech laced with communal sentiments, talking about how ‘Muslims will implement personal law,’ “They will implement Muslim personal law. They will become a Taliban regime. Women will have to wear Burqa and they won’t be able to go to school or markets. They want to bring back triple talaq and they want to implement the sharia law. This won’t happen under the BJP. ‘They’ will implement an inheritance tax and through it will X-ray your assets and distribute them among Pakistani, Bangladeshi, Afghan, and Rohingya infiltrators. Aurangzeb’s soul has entered Congress, and now the Inheritance tax is the new jizya. Let’s keep Aurangzeb buried.”

Sangli, Maharashtra

T Raja Singh once again made an inflammatory speech. Singh said, “Shoot in the chest of people who do ‘love-jihad’.” He also encouraged young Hindus to learn how to use weapons and to not hold fear for killing a “love jihadi.”

The event was reportedly organised by Sakal Hindu Samaj.

Mustafabad, Delhi

In Northeast Delhi which is seeing a contest between incumbent BJP leader and singer Manoj Tiwari and Congress’ Kanhaiya Kumar, Kapil Mishra once again gave a speech on May 21, alluding to finding an “Afzal” in “every home”, and how PM Modi will “treat these diseases.”

“They used to ask “how many Afzals will you kill”, and that “you will find Afzal in each household.” Well, from wherever Afzal comes out, we will enter the house and kill him. Till when will they come out? They have stopped now.”

He further adds that the people have only seen a “trailer” and a “calm” Narendra Modi, who was laying the “foundation” for removing “termites.” In the coming third term, he argues, all these “diseases will be treated.”

Kendrapara, Odisha

On May 26, Himanta Biswa Sarma once again gave a communally charged speech in Odisha, saying, “Sri Ram Janambhumi has happened, but in Mathura, our Krishna Janambhumi, the Shahi Eidgah stands at that place. In Kashi, our Vishvanath Baba’s temple had Gyanvapi Temple, now it continues to remain Gyanvapi Mosque. Give Modji 400 seats and across, we have to build Krishna Janamibhumi and Gyanvapi Temple.”

On May 28, Sarma made similar such speeches at Bhadrak and Kakatpur in Odisha, arguing for the need to stop Muslim men from marrying four wives and implementing the Uniform Civil Code.

Ballia, Uttar Pradesh

On May 29 in Ballia, Uttar Pradesh, Home Minister Amit Shah similarly made a speech charging Congress of ‘Muslim appeasement’, “Electricity was only available during Ramzan, but now it is available for 18 hours a day. The Congress party wants to give reservations meant for Dalits, Adivasis, and Scheduled Castes to Muslims, as they have already done in Karnataka and Hyderabad. We will never allow this to happen.”

BJP leader Kapil Mishra has delivered another anti-Muslim hate speech at the Hindu Janajagruti Samiti’s All India Hindu Rashtra Convention, wherein he indulged in fear-mongering, made derogatory statements and promoted fallacies about Halal products. On June 20, 2023, he gave this speech in Panaji, Goa, on the topic ‘The importance of Hindu ecosystem and the response to the terrorism of thoughts’. In his speech, he also targeted a well-reputed social activist in Delhi, Harsh Mander, who runs the ‘Karwan-e-Mohabbat’ campaign in solidarity with the victims of communal or religiously motivated violence. Attacking him, Mishra implied that Mander has been training minor children to create chaos and disturb harmony in the homes run by him as they are more likely to get bail.

It is essential to highlight here that delivering instigating hate speech, making informed statements, and riling the audience to commit violence against the minority communities, such manoeuvres have always characterised Mishra’s career.  A graduate from the Delhi School of Social Work who was part of activist Anna Hazare’s anti-corruption movement, Mishra has courted one controversy after another since the beginning of his stint with the BJP party — from starting the chants of ‘Desh Ke Gaddaron Ko, Goli Maro Saalon ko’ at a pro-CAA rally in December to leading an agitation against the Shaheen Bagh protests by terming it a “hub of anti-national activity”.

Having been sacked from the Aam Aadmi Party in the year 2017, after which he jumped to the Modi-led Bharatiya Janata Party in the year 2019, Kapil Mishra has made many controversial anti-Muslim tweet and statements. In the year 2020, in the run-up to the Delhi assembly elections, the Election Commission had banned Mishra from campaigning for 48 hours after he had posted communal tweets on Twitter.

In his tweets, Mishra had written, “Pakistan has entered Shaheen Bagh. Mini-Pakistans are being created in the city. The law of the land is not being followed in Shaheen Bagh, Chand Bagh and Indralok. Pakistani rioters are occupying Delhi roads,” Mishra had tweeted. In another tweet, he stated, “India Vs Pakistan. There will a contest on Delhi Roads between India and Pakistan on February 8 (poll date).” For this statement, the Delhi Police had also registered an FIR against him.

Thus, communally fired statements promoting a divisive ideology and spread anti-Muslim sentiments is not uncommon to this BJP leader. The extracts from his recent speech is as follows:

The speech:

“There should be no doubt in anybody’s minds, India was a Hindu nation, is a Hindu nation and will remain a Hindu nation. Just like it did not matter if people believed that the Earth revolved around the Sun or not, it did not have any effect on the Earth’s motion. Similarly, even if some people sit and think that them not accepting India as a Hindu nation will mean that it is not a Hindu nation are wrong, India is already one whether they accept it or not.”

“Those who are the enemies of India, they are also standing in opposition to Hindus, and vie-versa.”

“Jahangir Puri area in Delhi is a poor, slum area. People who work here as rag pickers, belonging to the Muslim community and illegal Bangladeshi occupants, live there. During Ram Navmi, these people threw stones and bombs at the procession, and even used gun. One officer of the Delhi Police named Medha Lal got injured with a bullet from the gun. The Hindu people who had taken out the procession did not have any tools or arms in the hands, but nevertheless, they were attacked upon. This happened in the whole of the country.”

“The organisation of Jamiat-Ulema-e-Hind had recently said that even if the Ram Mandir is constructed, they will stand against it whenever they have receive the power. This organisation has been fighting a case for all those Maulanas arrested for forced religious conversions as well as terrorists.”

“If any Halal product is used or bought, a part of it goes to the Jamiat. And with that money, they are fighting the case of terrorists, and of those who shoot at the police.”

“A few days ago, certain minor boys had pelted stones at the Daryaganj Policr station, and had even started a fire at the station. When the police arrested the kids, this activist Harsh Mander came to get them bailed out, stating that they were minors. It was later found that these kids were sent by Harsh Mander only, who had kept them in the teenage home that he runs.”

At the Digital Hindu Conclave held in indore on May 27, speakers like Pardeep Bhandari, journalist and founder of Jan ki Baat and former Delhi MLA Kapil Mishra peddled fear and false information through their speeches.

Kapil Mishra said, “These people are distributing pamphlets of saffron love Trap in Indore. They are creating a fuss over who the burqa clad woman should go with.  This will not be tolerated in India. Whether she wants to go with a Hindu, Sikh, Christian and she is a major and is in love with that man then no Qazi/Mulla can stop her. This message should go out. They are doing this to hide the truth which is shown in ‘The Kerala Story’.”

Basically, he was promoting freedom of choice among Muslim women to go and marry men from other religions but the same could not be said about Hindu girls marrying into other religions.

He said that the movie shows the reality, it shows how girls are duped, blackmailed and subjected to substance abuse and then converted then they are sent for terror activities. He said they want to peddle lies about saffron love trap.

Pardeep Bhandari said, “In 2014 majority of the population wanted change and development but there was a significant minority that did not vote for change. Why? Why is it that for a Hindu voter development is very important but for the minority development is not the parameter. For that significant minority why is it that religion is such a big factor for them while voting. I will prove it. Looking at the demography one can tell that it is changing. In West Bengal, Muslim share of total demography is the same as it was in 1941. In 1941 Bengal’s Muslim population was 29.48% in 1951 it dropped down to 19.46% and after it kept increasing in 2011 it went to 27.01% and today it is more than 30%. Now I have an issue that places where  the demography of India is changing, or being changed purposely by secular politicians for their vote bank, their chances of Hindus winning a seat are decreasing. The fact is that in Hindu majority areas if a Muslim candidate is fielded, one who has done good work, he can get votes. We have seen in Karnataka that Muslims consolidated and voted for one party. Where Muslims are 30% why is the person who talks about good for Hindus is not voted to power. This is blatantly communal in nature.”

He questioned that in Muslim majority areas do Hindus have freedom of speech, can Hindu girls roam about safely? Why do they live in fear?

“In Bengal, Constables were recruited a while ago, 90% belonged to Muslim community. Why is it that the demography of some areas is being changed? Until the 2000s Jharkhand tribal population was 35% now it has gone down to 24%. Why?  Because Muslim population has increased which was 15% in 1990 in Santhal area and today it is 27%. Speaking of Bihar, in Seemanchal in 2001, Hindus were more than 50% in 2011 the same dropped to 31% and Muslim population was 68%. The problem is, chances of Hindu candidates getting elected in such areas is negligible. Their chances of availing minority rights are negligible. Will you be able to freely walk around wearing a teeka in these areas? Chances are very low. My issue is not that demography is changing, it is that disproportionately the demography is changing, and this will have long term implications on the destiny of India and we are not realising this just yet.”

On March 18, a Digital Hindu Conclave was organised in Bhopal, Madhya Pradesh. This Hindu conclave, knows as the Digital Hindu Bhopal, was a convention of state’s nationalist social media influencers, which was held at RGPV Naronha Academy in the city. Several provocative and divisive hate speeches were made here. Many “popular” far-right hate speakers found themselves on the invitation list.  That this meet and similar conclaves have the backing of the political regime in Delhi is clear from the active participation of elected officials and even ministers of the MP government.

On Saturday March 25, BJP national co-organisational general secretary Shiv Prakash, state organisational general secretary Hitanand Sharma, State BJP president VD Sharma, medical education minister Vishvas Sarang had inaugurated the Digital Hindu Bhopal convention at RCPV Noronha Academy of administration in the state capital. The Madhya Pradesh state BJP incharge, Murlidhar Rao, had fanned public hysteria, unsubstantiated by fact, stating that after Independence the Muslim population, mosques and number of namazis (faithful from the Muslim community) had increased. “This is a demonstrative example. Hence, no country in the world has the right to teach a lesson to India,” he said, as was reported by the Free Press Journal.

He added that if social media had not existed, the Hindutava revolution would have taken another 30 years to take shape, and that a true Hindu would never oppose Muslims. If Islam eradicates Kafir ideology, only Hindus will be able to coexist peacefully with Muslims around the world, he claims.

He accused the Congress of severing the country from its cultural values while supporting Love Jihad and Land Jihad, and shed light on “diversity.” Referring to BJP MLA Vishnu Khatri’s long struggle to rename Islam Nagar Jagdishpur, he claimed that the Congress never stated that Aurangzeb was the country’s enemy. “If the effigy of Ravana, a Hindu and learned man, is burned every year, why not of Aurangzeb?” he asked, as reported by the Free press Journal.

VD Sharma, the state BJP president, also chastised Rahul Gandhi for claiming that he was not permitted to speak in Parliament. Cultural terrorism, according to Minister Vishvas Sarang, is today’s most serious problem. He emphasised the importance of preserving the country’s culture through social media. Hitanand Sharma also shared his thoughts.

Shivprakash, general Secretary of the national BJP, stated that anti-national forces have adopted a new weapon in the form of social media to spread their narrative. Their principles remain the same, but their appearance and language have changed. They are fighting with the help of social media. “Their conspiracy must be addressed through social media,” he added.

In addition to the above mentioned speeches made by BJP functionaries, star hate offenders like as Kajal Hindusthani (alias Kajal Shingala) and BJP leader Kapil Mishra, famed for his Goli Maro Salo ko remark on peaceful Shaheen Bagh protesters were prominent participants.

A Gujarat resident, Kajal Singhala also known as Kajal Hindustani, who calls herself an activist, has, in the past, delivered hate speech against the Muslim community at Mira Bhayandar, Mumbai. At the event on March 12, she had made aggressive calls for the economic boycott of the entire Muslim community while unabashedly making ridiculous claims about incidents of Love jihad, land jihad and justifying the economic boycott of Muslims. Before this, the hate offender, who purports to be working for the cause of ‘Hindu human rights,’ was a keynote speaker at the Hindu Jan Aakrosh Morcha on February 26, where she made extremely derogatory remarks about the Muslim community in front of an audience of over 1,500 people.

Making exaggerated and misleading statements, she said that “In Navi Mumbai, land jihad has become so prevalent that today 25 Bangladeshi Muslims live in one room.” Making an unconstitutional call, that violates Article 14, 15 and she urged people to boycott Muslim vendors. Hindusthani falsely claimed that they (Muslims) have taken over our produce and fruit markets. I want you to repeat after me: “We, the people of Maharashtra, will boycott them economically.”

Then again today, March 29, at Jamnagar, Gujarat the very same Kajal Shingala aka Kajal Hindusthani delivered anti-Muslim hate speech, peddling conspiracy theories to destroy communal harmony. Vishwa Hindu Parishad and Bajrang Dal organised the event.
 

BJP leader and hate offender Kapil Mishra, apart from 2020, made his last vocal hate speech on April 10, 2022, during the occasion of Ram Navami, was also a speaker at this event.  Kapil Mishra has been one of the most well-known mainstream politicians who is often the first to comment with a communal tone and intent. Even in the year 2020, it was Mishra’s words spoken at a pro-Citizenship Amendment Act (CAA) rally at Maujpur that had led to the most brutal targeted violence in East Delhi on February 23.

The intention behind organizing this digital event was clear from a profile of the list of speakers. At the event, Mishra, Kajal Shingala, and far-right author Kshitij Patukale made specifically stigmatizing statements, compared religious minorities to snakes, distorted history by calling for violence as the only way to achieve ‘Akhand’ Bharat, and raised the issue of Love Jihad.

A transcript of the speeches made by her, a resident of Gujarat, are given below:

Kajal Shingala aka Kajal Hindusthani

Kajal Shingala delivered hate speech targeting Muslims, where she eulogised violence. In her speech, Shingala said that there can never be brotherhood between Hindus and Muslims, and called out those who support secularism and peace between the two communities as a “sinking ship”. She stressed that the making of the Hindu Rashtra is inevitable and no one can stop them. 

Without mentioning names, Shingala referred to Shah Rukh Khan’s recent visit to Vaishno Devi temple, before the release of his movie Pathaan, as well as Aamir Khan’s photograph doing Kalash pooja, and said that “Ghar Vaapsi” will be performed on all such non-Hindus. “Ghar Vaapsi” is a Hindutva programme meant to convert those belonging to other religions to Hinduism. it is conducted by right-wing organsations Vishva Hindu Parishad (VHP), Rashtriya Swayamsevak Sangh (RSS), Bajrang Dal, and their allies. Through her speech, she spread misinformation regarding the property controlled by Waqf Board and alleged that the Waqf board is forcibly snatching land from the Hindus. 

She also spoke highly about the bulldozer culture introduced by the Ajay Bisght/Adityanath-led government while praising the ongoing demolition in Gujarat.

The speech:

“Now when I talk about Hindu nation, those who are watching this clip and have “sulemani” germs in the stomach will get cramps. Those people say that they will not let India turn into a Hindu nation. To them, I just want to say that you people also used to say that we will not let Ram temple be built, and now look at it.” (Time stamp- 0:00-0:20)

“I saw the photos of Ram Mandir a few days ago. You used to say that we won’t let Article 370 be removed, and yet, it was removed. I am telling you that we will ensure that India gets declared as a Hindu nation. It is a Hindu nation already, but now it will get declared.” (Time stamp- 0:20-0:36)

“There are people now are worshipping Mahadev now, Bolly people who go to Vaishno devi temple, some of them even do “Kalash Puja”, all these will undergo “Ghar waapsi”.” (Time stamp- 0:36-0:48)

“Lord Krishna himself said that whoever is with the religion, they are “Dharmi”, but those who are not siding with the religion, they are “a-dharmi”. So, all those who come in the way of religion, they all will be cleaned out of the way. These people might be our own or someone else, they will all be destroyed.” (Time stamp- 0:48-1:04)

The chale ithaas likhne, mrityu se ghabra gaye ho,

Chahta balidan hai ran, aur tum ghar ko aa gaye ho.

Yeh ahinsa matr bharm hai, shtruyon ka jaal hai yeh,

Maan lo tum baat meri, Hinduon ka kaal hai yeh.

Yadi ahinsya pujya hoti, shri Krishna kyu gita sunate,

Aur shanti hetu youdh nishchit, bhed kyu humko batate.

Kayaro ke bhaanti tum kyu yudh se katra rahe ho,

Chahta balidan hai ran, aur tum ghar ko aa gaye ho.

Soo rahe hai jo abhi tak darp saare jaag jae,

Ab utho toh ghosh karo ki sarp saare bhaag jae.

Yeh samay sangram ka hai, tum svayum se takra rahe ho,

Chahta balidan hai ran, aur tum ghar ko aa gaye ho.

Bhaed saare bhul kar varna saare bhul kar, socho ki hum ek hai

Bheej lo sab muthiyan, bolo ki hindu ek hai.

(You have to re-write history, but you are afraid of death,

The sacrifice is to be made, and you have come home.

This non-violence is just a myth, it is a web of chains of the enemies,

Just listen to what I am saying, this is the time of Hindus.

If non-violence were revered, why would Shri Krishna sing the Gita?

And if the war would have been won by peace, then why did you tell us the difference?

Why are you shying away from war like coward?

The sacrifice is to be made, and you have come home.

All those who are sleeping, may they wake up,

Now get up and announce that the snake will run away.

This is the time for struggle and you are clashing with yourself,

The sacrifice is to be made, and you have come home.

Forget all that segregates us, all the hierarchies and the separation, and think we are one

“We should have a very clear mindset now, either you can ride in the boat of a Muslim or a Hindu. If you say that I will keep one foot on the Muslim boat and the other one on the Hindu boat, then it is guaranteed that you will drown. You can ride two boats at a time, just as there cannot be two swords in the same field.” (Time stamp- 2:08-2:33)

“Those who preach the message of brotherhood, I want to tell them they openly killed Kanhaiya lal, is this brotherhood? They are still sloganeering regarding Nupur Sharma, saying “Gustakh -E- Nabi Ki Aik Saza Sar Tan Se Juda,” is this brotherhood?” (Time stamp- 2:33-2:47)

If this is brotherhood, then I want to say that

Jab jihadi khulam khula talware leharate ho,

Aur humari yatraon par patthar fenke jaate ho,

Jab inke bhopu din mei 5 baar chillate ho,

Aur chalisa padhne wale jail mei daale jaate ho,

Jab mancho se shiv Shankar ka mazak udhaya jaata ho

Aur pratikaal karne wale ke sarr tan se juda kiye jaate ho,

Peedha kahugi har hindu ki aur har jihadi ka kratiya kahugi,

 Bhaadh mei jae bhaichaara, mai toh keval satya kahugi.

(When jihadis openly wave swords,

And stones are thrown at our rallies and yatras,

When their loud speakers screams 5 times a day,

And those who read the Chalisa are put in jail,

When Shiv Shankar is mocked from the stage

And the ones who say anything have slogans of death raised against them,

I will say that I will put forth every problem faced by Hindu and call every jihadi a criminal.

“How did Islamic illegal capture increase in India? The PFI has already said that by 2047, they have to make India an Islamic state, even though the said PFI have already banned them. But who put this in their mind? It must have come from some Jama Masjid in India, the Jama Masjid must have set this agenda that they need to convert India into an Islamic state before 2047. (Time stamp- 3:19-3:45)

“What do they need to do for that? Commit love-jihad, illegal capture of land in the name of Waqf Board, commit forced religious conversions. This is just the preview of how these people want to take over India as they say “Ladh ke liya Pakistan aur hass ke lenge Hindustan”. In the name of waqf board, they are taking over our land.” (Time stamp- 3:45-4:04)

“In Tamil Nadu, there is this village called Tiruchendur, wherein the waqf board is establishing claim on a Chandraswami temple that has been there for 1600 years. These people themselves came here around 1400 years ago, how is this land yours?” (Time stamp- 4:05-4:23)

This waqf board and these encroachment agencies are very fond of poetry, so I thought that okay maybe I should also write two lines for them:

Kahi flyover, kahi roadways, kahi railway aur kahi defense ki zameen kabzate hai

Yuhi nahi hari chaddhar oudh kar yeh peer baba bann jaate hai

(Somewhere flyovers, some roadways, somewhere railways and some defense lands are occupied.

That is how they suddenly start wearing the green supatta and become the messenger of God)”

“At every place, these people have encroached upon lands illegally. If you look at it carefully, after the defense and the railways, it is the waqf board that has the most space.” (Time stamp- 4:45-4:56)

“Because we were just talking about the Islamic illegal capture, it makes me really happy to tell you that there has been a very long struggle for the Hindus of Gujarat in regards to the Dwarka district which was the land of our Krishna. On Dwarka, there had been a lot of Islamic illegal capture. Since last 4 months, the bulldozer has been working there and a lakh acre land is now Islamic illegal encroachment free.”  (Time stamp- 4:56-5:26)

“This ongoing demolition is the biggest demolition in the whole of India.even in our history there has not been such a big demolition.” (Time stamp- 5:26- 5:35)

BJP Leader Kapil Mishra

BJP leader Kapil Mishra spoke about ‘Love Jihad’. Taking the recent murder of Shraddha Walker, whose live-in partner Aftab Poonawala stored her chopped body in a refrigerator, he attacked the Muslim community and their festival of Ramazan. Weaponising the issue of inter-faith marriages, which the Hindutva outfits refer to as Love-Jihad, Mishra tried to instigate the audience.

The speech:

“This Bollywood teaches us to not waste water on the occasion of Holi. The day that you and I become one, the Bollywood will start advertising that on this Ramzan, keep fruits in your fridge and not Shradhha.” (Timestamp- 0:00- 0:38)

“The issue of love-jihad in India is so widespread that there is no district no village left where the conspiracy of love jihad is not happening with our daughters. And even after this, we are the ones who are question on why we even talk on the issue of love-jihad.” (Timestamp- 0:39- 0:55)

“What is solution? The only solution is if you take a pledge in your mind that a daughter is not only one person’s daughter, she is everyone’s daughter. Just like Mother India is everyone’s mother, even when we have our own mothers. Similar to that, a daughter is everyone’s daughter.” (Timestamp- 0:55- 1:22)

“A daughter is a connection. Only when u start thinking that the daughter who is going is also my daughter, her honor is also my responsibility, only then will we have the half solution to this problem.”

Kshitij Patukale

Far-right author Kshitij Patukale weaponised and misappropriated our history and called for revenge. To invoke the feelings of the audience, the speaker said that the Hindus should take revenge for the Hindu women that have alleged been raped in Kabul, Iran and Iraq.

The speech:

“Ramdas Swami has said that keep you god on your head, and then raise a storm. If the need comes, you must destroy your own country too. But, to protect religion, one must do whatever it needed.”

“The current time is utterly unique. Today I feel like this slavery is not just of 300-400 years, but has lasted for 1200 years. Sometimes I feel that the rapes that happened with our women, our daughters and sisters, in the markets of Kabul, or in the cities of Iran and Iraq, or by the Arabian people, that lasted for years, I want to take revenge over that.” (Time stamp- 0:37- 1:10)

“In the morning, we were talking about love. In Maharashtra, there is a prominent poet who wrote about Lord Krishna, and said that one must love everyone, even the ones that you want to hurt. Love is such only that the same Duryodhan that you want to love, you should also kill him if it comes to it.” (Time stamp- 1:10- 1:38)

“Why is our Prime Minister getting entertained everywhere in the world? It is only because we are the youngest country and have the youngest people. It is you young people that are going to rule the whole world. I want to tell you all today that out of these 140 crore people in India, 110 crore are Hindu, and 70% of them are below 40 or 35.” (Time stamp- 1:38- 2:05)

This means that 77 crore or 80 crore Hindu youth, and the world population is 800 crore. 10% world population is Hindu youth. And if we strengthen this percentage by teaching them about Hindu knowledge and Indian culture, then you people will rule the whole world.” (Time stamp- 2:05- 2:32)

“The average age of USA is 40-50, in Europe is 70, and in Japan, no kids are being born. Even in China, the average age is between the ages of 45-50. But, the average age in India is 24. If we look at the economics, in the year 2040, when USA’s average age will reach 75, Europe’s age average will be 90, and the average age in China will be above 65-70, India’s average age will only be 31.” (Time stamp- 2:32- 3:19)

“Then, at that time, the opportunity to rule the world will be with the younger generation of today.”

As citizens groups and individuals get increasingly concerned by this level of public discourse that legitimizes a narrative and creates the ground for stigmatizing and targeted violence, the dominant ruling regime openly patronises these tendencies. On the backfoot when it comes to forcefully countering hate, the political opposition is also wanting.

A viral video of hate-offender Kapil Mishra is making the rounds on social media. In it, Mishra is heard inciting communal hate in a speech he made on April 10, 2022 Ram Navami, around the same time that the Khargone violence took place 40 kms away. Opposition party officials like senior Congress leader Digvijay Singh have alleged links between Mishra’s speech and the violence that ensued in the day.

As many as 10 houses were set ablaze near Talab Chowk mosque on Sunday evening amidst clashes between participants of a Ram Navami procession and local residents. Over two dozen people, including Superintendent of Police (SP) Siddharth Choudhary, were injured during the stone-pelting violence. The clashes eventually spread to other areas in the city.

Reacting to the news, Singh condemned the state government for allowing people to join the procession while armed with swords, lathis and rods. He also asked the government about whether the Khargone administration and police were aware about this speech.

“Is this type of speech not inciting the public on the basis of religion? This is a speech of a place in Khargone and where did Kapil Mishra’s speech take place? Was the Khargone administration and the police not aware of this?” he asked in a tweet.

 

 

While one could still debate the link between the Chowk violence and Mishra’s speech owing to the timing of the incidents, Mishra’s words certainly had an impact on the communal environment in the region. A day later, the Indian Express reported of bulldozers entering the Khaskhaswadi region of the district and tearing down houses. One of these houses was built under the Pradhan Mantri Awas Yojana. However, following the demolition drive, the District Commissioner told the newspaper that the house was built on encroached land. Despite the family having documents that show how the house on Birla Marg was registered in the name of Hasina Fakhroo after the death of her husband.

While Mishra did not explicitly speak of tearing down houses, he said that he and his gang “will invade and attack any house from where a “Moosa exits”. This is in connection with his earlier allegation that some youths on April 9, sloganeered in the name of Burhan Wani inside Jamia Masjid and demanded freedom for Moosa terrorists.

He also warned Hindus against “what happened in Kahsmir should not happen in our mohallahs”. Endorsing The Kashmir Files, he warned that people need to watch the movie and “understand” to prevent versions like Delhi Files and Khargone Files.

“We should not have an identity other than Hindu. If a person talks about any identity other than Hindu, talks about caste, then understand that that person is preparing to make your Kashmir Files. They are dividing us,” he said.

As a response to the anger towards his speech, the BJP on April 12 distanced itself from Mishra. While the state police confirmed to the BJP that Mishra was not present at the scene of violence, Congress leader Singh has been named in an FIR for criticising Chief Minister Shivraj Singh Chauhan’s administration.

Bharatiya Janata Party (BJP) politician Kapil Mishra seemed to have marked the one year anniversary of his volatile speech of February 23, 2020, by making another one. He has reportedly said that if he had to, he would “redo” what he did on February 23, 2020. According to Indian Express, Mishra who was speaking at an event around the controversial book Delhi Riots: The Untold Story which is said to aim at telling the ‘story’ as understood by the right wing, said, “Aaj ek saal ho gaya hai, isliye yeh baat dobara bolna chahata hoon… February 23 pichle saal jo kiya, agar zaroorat pade toh dobara kar lunga (If the need arises to redo what I did on February 23, I would do it all over again). According to Mishra, he has “no regrets, besides the fact that we could not save Intelligence Bureau officer Ankit Sharma and constable Ratan Lal.” 

Mishra was among the many BJP politicians who have been called out for their similar statements, some of which are alleged to have fired communal tensions in the National Capital, especially in 2020. He himself had shared his speech on February 23, 2020, where he stood DCP (North East) Ved Prakash Surya and issued his “ultimatum” and soon enough the riots broke out.

Now, a year later he says, “It’s been a year since Jihadi forces engineered the riots in Delhi. Exactly the same pattern is being seen even now, like what happened on Republic Day. The so-called fringe elements are trying to sabotage peace in the Capital, aided and funded by anti-India forces, both within and outside the country. And the ‘pradarshan se danga tak (from protests to riots)’ model is very much evident,” the Indian Express reported. 

According to the report Mishra laughed and said, “This book has a lot on the conspirators of the riots. So you will not find much in the book about me.” The book “Delhi Riots 2020: The Untold Story,” claims to be an ‘expose’ on Delhi’s February 2020 communal riots, just six months after the communal violence, even though the matter is subjudice. It was ‘launched’ online by the authors themselves because the original publishers Bloomsbury India refused to be associated with the event. Bloomsbury accused the authors of using their brand logo at the launch without permission, and later after scores of activists, authors, journalists, and readers raised concerns about the one-sided book, they withdrew publication. A publishing house, named Garuda Prakashan then published the title. Garuda introduces itself as an “international publishing venture focusing on Indic narratives.” It has been co-authored by senior Supreme Court lawyer Monika Arora, Miranda House Assistant Professor Sonali Chitalkar, and Author and Faculty at Ram Lal Anand College, Delhi University, Prerna Malhotra. Later the authors of the book had met Delhi Police Commissioner in September 2020, and handed over a complaint against the book’s former publisher Bloomsbury allegeding cheating, breach of trust and invoked multiple sections of the Indian Penal Code. The authors, led by Advocate Monica Arora, met the commissioner in his office at the Police Headquarters and handed over their letter of complaint where they have also named activists, writers and journalists, seeking that they too be investigated under the IPC sections.

Mishra has been one of the “celebrities” associated with events around the book since then. At this most recent event on Monday, he was invited to discuss the book and said: “We have individually helped Hindu victims of the riots. And then we are questioned for why we do not help the other side. I say that the Waqf board is standing behind them, the entire Delhi government is standing behind them, the media, NGOs are all with them.”
 

The  rise and rise of Kapil Mishra

Kapil Mishra faced flak from civil society and liberal circles for allegedly being the trigger behind the violence in North East Delhi. He had held a rally in support of the Citizenship Amendment Act (CAA), not far from an anti-CAA protest site near the Jafrabad metro station is accused of inciting violence and using hateful words against protesters. Mishra who had previously been suspended from the Aam Aadmi Party (AAP) for his hate speech and later joined the BJP, is not new to controversy. On April 4, 2019, Kapil Sharma, MLA from the Karawal Nagar constituency in the Sixth Legislative Assembly of Delhi, tweeted a violence-inducing post, addressed to Congress president Rahul Gandhi. Misrepresenting the Islamic flag (moon and stars on a green background) with that which represents the state of Pakistan, Kapil Mishra tweeted, “Those who broke down the temples at Ayodhya, Kashi, Mathura and Somnath carried this flag. Those who killed the Sikh Gurus also carried this flag. All terrorists, anywhere, swear by this flag.”

In February, 2019, following the Pulwama terror attack that left 40 CRPF jawans dead, Mishra also posted a series of hate-filled tweets, one of which called for the destruction of the “wombs that give birth to terrorists”. When incidents of violence against Kashmiri students began being reported from across the country, Mishra insisted that the stories were made up and dismissed them as fake news, even though videographic evidence became available. Mishra won the elections by a margin of 44,431 votes. He took his oath in Sanskrit. He was removed from the position of Water Resource Minister in the Aam Aadmi Party government.

It is now 2021, and Kapil Mishra has been busy, speaking in various states, including Hyderabad which he calls Bhagyanagar. He also visited West Bengal. He has been active in Mongolpuri in Delhi where a young BJP/VHP volunteer’s murder is now being communalised. Most recently he has been calling for the demolition of a building he alleged was used to store illegal weapons.

 

 

Earlier this month, a trial court directed the Delhi Police to file a report on Mishra’s alleged inflammatory, incendiary, and provocative speeches delivered during the February 2020 Delhi riots. According to a report in the Muslim Mirror, the trial court has directed the Delhi Police to file a report on the speeches made by Mishra and others which had allegedly triggered the communal riots in North East Delhi, in February 2020. The riots had snuffed out 54 lives, hundreds were injured, and thousands were displaced during, and after the area was engulfed during the communal riots. 

CJP was the first to call out Kapil Mishra

Last year, CJP had started a petition to hold Kapil Mihra accountable for his actions. Our petition on Change.org had asked that if “Indian criminal law has provisions for prosecution of those who incite violence using hate speech. Why then is there no action against this BJP leader?” Our petition, that illustrated how his hate speech, and an ultimatum delivered while standing next to a police officer, legitimised violence. We also highlighted Kapil Mishra’s history of spewing venom against minorities. Our petition was addressed to the Chief Justice of India, and also marked to the Commissioner of Delhi Police and the Chairman of the National Human Rights Commission.

“This is jihad. The one who worked enthusiastically for [hindu] dharma has been selectively killed. This is a terrorist attack, they [the accused] should be treated like terrorists,” words uttered by Bharatiya Janata Party (BJP) politician Kapil Mishra, right after he met the grieving family of Rinku Sharma in Mangolpuri. 

 

 

Rinku Sharma, an activist of BJP’s Yuva Morcha and Vishva Hindu Parishad (VHP), was stabbed last week, by his neighbours reportedly after an altercation at a party in Delhi’s Mangolpuri area. The five accused who have been arrested are identified as Muslim, and even though the Delhi Police have officially said that the 25-year-old man was stabbed to death allegedly after a heated argument and scuffle at a birthday party, the Sharma family has alleged that there is communal angle in this murder. They have been backed by leaders of right wing information and some politicians. Each of those are repeating that the victim was stabbed to death because he was collecting donations for the Ram Temple at Ayodhya. Delhi Police have, so far, not agreed to this theory, and investigations are now being done by the Crime Branch.  However the reportage and ‘information’ being shared in some sections of the media, and on various social media platforms only highlights the attempts being made to make this murder appear like a communal hate crime. 

Kapil Mishra, has been one of the most well known mainstream politicians who is often the first to comment with a communal tone and intent. However, in this case he is being hailed as the one who had started a crowdfunding drive to collect money for Rinku Sharma’s family. On Tuesday, he claimed to have “begun the process of transferring Rs 1 crore,” that he says was crowdfunded by over 9,000 contributors. He said he has passed on the condolences of all those who contribute to Rinku Sharma’s family.

However, it was not just about handing over crowdsourced funds to help a grieving family, Kapil Mishra has openly said that Rinku Sharma’s murder is a “terror act”. And he has claimed that it is not just the accused who are guilty but that they are backed by “masterminds”. He floated the “jihad” theory and said it is now to be investigated who “are the mastermind who poisong the [accused’s] thoughts? They [accused ] attacked him at home, and if that was not enough they went to the hospital and attacked him again” said Mishra even though it is not yet known if the victim was attacked again in hospital. According to reports Sharma succumbed to his injuries and died during treatment. 

Kapil Mishra is now fanning the communal crime theory that has been gaining speed online. “He was killed because he was working most enthusiastically for hindu faith,” he said, asking how in the national capital Delhi, could someone “be attacked like this”, implying that the victim was killed because of his religion.

According to Mishra, “the killers should be hanged to death…” He feels the accused are a part of a larger conspiracy as it were, and has demanded that it must be found “who were behind the killers who created the poisonous intent that they must attack those who come asking for donations for the Ram mandir”. Again, the Delhi Police have not said this is the moditve behind the murder.

Rinku Sharma’s murder is a heinous crime, however some right wing outfits are making it our to be an attack on those who chant Jai Shri Ram, or work to collect donations for the Ram Temple’s construction. According to a report in Navbharat Times, Rinku Sharma’s brother Manu Sharma had claimed that in August last year, a march was carried out in Ayodhya over the construction of the Ram temple and Rinku participated. He alleged that the accused began threatening the Sharma family. And this eventually led to Rinku’s murder. This is the theory now being encouraged in the Mangolpuri neighbourhood where both the victim and accused have lived for a long time. Over the weekend, groups of angry people, some claiming affiliations to right wing organisations allegedly attacked the home of the accused. The accused have been arrested, however, their families may still be in the area, and be vulnerable to attacks.

According to news reports the local police have been patrolling the area, however on Saturday the doors and windows of the accused’s house were smashed by a group that was shouting right wing slogans. The Crime Branch has begun its investigations, and it was reported that the forensic team had also gathered evidence from the crime scene.

A trial court has directed the Delhi Police to file a report on Bharatiya Janata Party (BJP) member Kapil Mishra’s alleged inflammatory, incendiary, and provocative speeches delivered during the February 2020 Delhi riots. According to a report in the Muslim Mirror, the trial court has directed the Delhi Police to file a report on the speeches made by Mishra and others which had allegedly triggered the communal riots in North East Delhi, in February 2020. The riots had snuffed out 54 lives, hundreds were injured, and thousands were displaced during, and after the area was engulfed during the communal riots. 

It is almost a year, to the date when the riots began, and this order passed by the Metropolitan Magistrate, Himanshu Raman Singh at Patiala House Courts, New Delhi, may offer a ray of hope to the riot survivors. The order was passed on a plea filed by human rights defender Harsh Mander who had sought  that a first information report (FIR) be registered against Kapil Mishra. It was passed on January 29 and stated that the court “deems it appropriate to call the report from the Deputy Commissioner of Police concerned” reported Muslim Mirror which also shared an image of the order:

According to the news report Mander had invoked Section 125 of the Representation of People’s Act, and asked that an FIR be registered against Mishra under section 153 of the Indian Penal Code, which does not require prior government’s sanction.

According to Muslim Mirror, Mander’s lawyer Sarim Naved said that this may “may pave the way for filing the cases against those who incited and fomented the Delhi riots”. The Delhi High Court had given Harsh Mander the liberty to approach the Magistrate regarding the issue of inflammatory and provocative speeches around the time of the 2020 Delhi riots, stated the lawyer.

Mishra was among the many BJP politicians who have been called out for their similar statements, some of which are alleged to have fired communal tensions in the National Capital, especially in 2020. 

Activist and Communist Party of India (Marxist) Polit Bureau member Brinda Karat has also been seeking legal action against hate speeches by politicians who were targeting those protesting anti-CAA-NRC-NPR and whose words could have incited mobs to violence. Karat had approached the Delhi High Court and challenged the trial court order that had dismissed her plea seeking that a First Information Report (FIR) be registered against Union Minister Anurag Thakur, and  Pravesh Verma, his party colleague and Member of Parliament from Delhi for their alleged hate speeches, targeting those who participated in the anti-CAA protests in Delhi, especially at Shaheen Bagh protest site. 

Karat challenged the August 26 order by a trial court which rejected her plea on technical grounds that certain ‘prior sanctions’ from the Central government had not been obtained, as required under the law. Brinda Karat and CPI (M) leader KM Tewari had filed a complaint in the trial court seeking directions to the Parliament Street Police Station to register the FIR against Thakur and Verma. However, the trial court ruled that the complaint was not sustainable without the prior sanction. Karat, in her petition in the HC, sought quashing of the trial court’s order and also a direction for expeditious disposal of applications under Section 156(3) CrPC (power of a magistrate to direct the police to conduct investigation in respect of a cognisable offence) and that technical objections and maintainability be decided at the threshold to avoid prejudice to the complainant and wastage of judicial time.

However, Mander’s plea only pressed Section 153 of the IPC (provocation for riot) and Section 125 of the Representation of People Act (causing ill will between communities for the purpose of an election), neither of which require prior sanction. Accordingly, the Magistrate has asked the DCP to submit a report and clarify the Delhi Police stand on if they will register an FIR under these two sections against Kapil Misra or not. According to Muslim Mirror, Mander’s lawyer said in case the police does not file an FIR, they will appeal to the Court to order it.  The Police have to file its action taken report on the matter, before the  next hearing on March 9.

In the wake of the gruesome Delhi violence, Citizens for Justice and Peace (CJP) was one of the first to raise concerns and had initiated an Online Petition appealing to the Chief Justice of India, SA Bobde, to hold Kapil Mishra – said to be the chief instigator – accountable for instigating violence using hate speech and prosecute him. The CJP had demanded that Kapil Mishra be held accountable for his words and actions, and sought his arrest for instigating interfaith violence in North East Delhi. 

The anti-minority violence in the North East of Delhi started on  February 23, 2020, the day Mishra led a pro-Citizenship Amendment Act (CAA) rally close to the site of the anti-CAA protest near the Jafrabad metro station. At the protest site, standing next to a uniformed police officer he said, “We will remain peaceful till Trump leaves. After that we will not listen to you.”

The CJP had also taken the matter to the Ministry of Electronics and Information Technology (MEITY) with a complaint against Kapil Mishra, a BJP politician who is using social media platforms to spew communal hate against minorities of the country. The CJP complaint dated November 18, 2020 to MEITY’s detailed how Kapil Mishra was using his Twitter account to circulate a google form for his followers to fill and become a part of “Hindu Ecosystem Team” to work together and build the “right” narrative in the media. The form seeks personal details like name, profession, special interests (“gauraksha, gausewa, fight love Jihad, ghar wapsi, halal, mandir nirmal, hindu ekta, sewa, etc”) of his massive eight lakh followers. The membership form asks one to specify whether they would be joining the team “online” or “on the ground” or both. Mishra continues his communal activities till date.

According to Delhi Police, Devangana Kalita, an MPhil student, and the founding member of Pinjra Tod, a collective of women academics, was trying to create a ‘narrative to  ‘show’  that Bharatiya Janata Party (BJP) politician Kapil Mishra was behind the communal riots that raged through North East Delhi in February 2020.

According to a report in the Indian Express, the Delhi Police, while opposing the bail application of  Devangana Kalita, told a Delhi court that she was creating “narratives” to show that Kapil Mishra was behind the riots, “and making this viral to make people believe it was the truth.” The Special Public Prosecutor Amit Prasad, who appeared for Delhi Police made these submissions were made before Additional Sessions Judge Amitabh Rawat. The court put up the matter for further hearing on December 16. Citing a media report, Kalita’s counsel Adit Pujari had argued that the riots were not started by the anti-CAA protesters, but rather by pro-CAA protesters led by Mishra, reported IE.

However the public prosecutor stated that she created “a narrative” and then made the larger masses believe that the narrative was  correct, “so that the masses believe that the prosecution is targeted against one community… Will these media reports decide the fate of prosecution? The accused is trying to show that Kapil Mishra was behind all these and that the police was investigating only one side… Why has the accused relied on media reports? Because the accused also need to take shelter under something. If the investigation, the prosecution and this country is to continue on the foundation of what is being reported in the media, then that is the end of rule of law,” Prasad was quoted by IE.

He countered Adit Pujari’s contention that the prosecution had selectively placed messages from WhatsApp chats to prove their case against Kalita, saying, “every bit and pieces of investigation cannot be part of the chargesheet”. According to him, Kalita cannot say that her case is different from that of the co-accused Sharjeel Imam and that they were following separate paths, reported IE. “I have demonstrated from the tweet of Pinjra Tod that Pinjra Tod was supporting Sharjeel Imam. From the speeches of Imam, it is clear what was the intent. When I want to connect the two, the accused says they were travelling in separate paths and not to connect them. All that the accused was trying to do is create a narrative and not go beyond that,” Prasad said.

It was only in October that the  Supreme Court through its 3 Judge Bench comprising Justices Ashok Bhushan, R Subhash Reddy and M R Shah dismissed a Special Leave Petition on filed by the Delhi Police challenging the Delhi High Court order granting bail to Devangana Kalita accused in the Delhi Riots. On September 1, 2020 Justice Suresh Kumar Kait of the Delhi High Court had granted bail to the Pinjra Tod activist in the matter Devangana Kalita vs State of NCT Delhi (Bail App. No. 2038 of 2020). 

Additional Solicitor General of India SV Raju, appearing for State of NCT Delhi, had argued that Kalita is an “influential person” and that she could “tamper evidence” in the case and that the High Court omitted to take cognizance of the relevant aspects of this case.  However, Justice Ashok Bhushan questioned the ASG as to, “How can she tamper evidence? She is not going to run away after evidence.” Justice M R Shah also intervened and asked, “How can the influence of a person be a ground to deny bail?” Justice Bhushan further added that in case she attempted to tamper evidence or influence the witnesses, the Delhi Police shall have the option of seeking a bail cancellation. Despite the ASG’s protestations, Justice Bhushan disposed of the petition by saying, “We are not inclined to interfere. It is only grant of bail. Dismissed.” 

Devangana Kalita was arrested on May 23, 2020 in FIR No. 50/2020 registered at the Jafrabad Police Station in relation to the communal violence which had broken out in North East Delhi in February 2020. It was alleged that she mobilized a crowd of a particular community at the protest site near Jafrabad metro station on February 22 and 23 with an intention to instigate a section of people to indulge in rioting that led to loss of lives and destruction of public and private properties. But she was granted bail by the Delhi High Court citing lack of evidence to show that she instigated violence or gave a hate speech. 

She has also been booked under the Unlawful Activities (Prevention) Act, in a separate case related to the communal violence, for allegedly being part of a “premeditated conspiracy” in the riots. In all, four cases have been registered against Kalita, including and in relation to the riots and violence in old Delhi’s Daryaganj area during protests against the citizenship laws in December 2019.
