We have politicians wearing saffron, contesting elections and being part of politics all around. Likes of Sadhvi Uma Bharati, Sadhvi Nirnajan Jyoti, Yogi Adityanath and Sakshi Maharaj are ruling the political roost while wearing divinity. To reprimand the Archbishops for expressing their opinions is unfortunate. As they are citizens, they should be and can be concerned about the social issues too.
A VHP spokesperson, Surendra Jain (June 7) stated that the Church in India is trying to destabilize Modi Sarkar. This was in the backdrop of the statements by two Archbishops, the one from Delhi and other from Goa. Archbishop of Delhi, Anil Couto, on May 8, 2018, addressed a letter to all parish priests and religious institutions in the Archdiocese of Delhi asking them to pray for ‘our nation.’ The letter begins with the observation, “We are witnessing a turbulent political atmosphere which poses a threat to the democratic principles enshrined in our Constitution and the secular fabric of our nation.” The letter then requests the 138 parish priests and five religious institutions within Delhi to observe ‘A Day of Fast every Friday, offering our penance and all our sacrifices for our spiritual renewal and that of our nation.’

Meanwhile, the Archbishop of Goa and Daman Filipe Neri Ferrao said that human rights are under attack and the Constitution is in danger, and it’s why most people live in insecurity. Ferrao, in his annual pastoral letter, addressed to “priests, religious, lay faithful and people of goodwill,” and asked Catholics to “play an active role in the political field” and to “shun sycophantic politics.” “As the general election is fast approaching, we must strive to know our Constitution better and work harder to protect it,” and added that “democracy appears to be in peril.”

Both the letters in a way are an expression of the cry of anguish of the plight of religious minorities. The anti-minority violence has seen a quantitative and qualitative worsening during the last few years. While anti-Christian violence is not spectacular and many national commentators even question its occurrence, the fact of the matter is that low level scattered anti-Christian violence is around and most of it is not reported in the national media. Incidentally, the World Watch List 2017 ranks India at number 15, among the worst nations where Christians are persecuted. Four years ago, India ranked 31 on the list.

Vijayesh Lal of ‘Evangelical Fellowship of India’ states that ‘it has documented some 350 cases of violence and other forms of persecution against Christians last year. That is more than double the rate compared with the 140 annually before the BJP assumed power.  This is highest since an anti-Christian pogrom in the state of Odisha in 2008.

Interestingly, around Christmas in 2017; Carol singers were attacked and cases against them were filed on the charges of conversion in MP. The community leaders point out that in their observation such incidents have gone up, more so as the ground level leaders are not reprimanded from the top leading to increase in the culture of impunity.

The violence against the other big minorities like Muslims has also risen in 2017. In 2014, we witnessed (no. of deaths in brackets) 561 incidents (90,) In 2015- 650 (84), In 2016-703 (83) and in 2017- 822 (111). The frightening nature of lynchings in the name of holy cow or beef has also seen a dangerous increase. According to the data collected by IndiaSpend, based on the content analysis of media reporting, “Muslims were the target of 51 per cent of violence centred on bovine issues over nearly eight years (2010 to 2017) and comprised 86 per cent of 28 Indians killed in 63 incidents. As many of 97 per cent of these attacks were reported after Prime Minister Narendra Modi’s government came to power in May 2014, and about half the cow-related violence — 32 of 63 cases –were from states governed by the Bharatiya Janata Party (BJP) when the attacks were reported, revealed our analysis of violence recorded until June 25, 2017.”

So while the VHP spokesperson is just one example, most of those from Hindu nationalist politics have been challenging how Church leaders can make statements which have political implications, how can they give their opinion on issues which can affect the political outcome? One knows that Church leaders have mostly not been making political comments till one witnessed the brutal murder of Pastor Graham Stains in Keonjhar, in Orissa in 1999. Since then some from the clergy did express the feelings, hurt and injury of the community in the wake of this violence directed against the Christian minority. Generally the Church leaders had been focusing on their prayers and the community work in a quiet manner. It is only after the rise of the violence that some of them started speaking on this topic.

The overall atmosphere has been becoming more intolerant, more frightening and Muslims and Christians both have been on the receiving end. Can these men of god speak on Earthly matters? It is true that a Yogi should not be a commissar; a Yogi should not be in the business of business? The secular and profane worlds are different. In societies like ours, which are not fully secularized; clergy does have a hold over society in worldly matters also. We know how a series of Hindu Godmen and women are dominating figures in Hindu nationalist politics. VHP, whose spokesperson is reacting to Archbishops statement; itself is a religious adjunct to RSS combine with political agenda of Hindu Rashtra. We have number of holy people who either directly or indirectly aid to the electoral and other politics. Starting from the likes of Karpatri Maharaj, who aggressively campaigned against Hindu Code Bill, we also saw Sadhus who took the issue of ban on cow slaughter to higher prominence by a march to parliament in the year 1966.

In current times, we have politicians wearing saffron, contesting elections and being part of politics all around. Likes of Sadhvi Uma Bharati, Sadhvi Nirnajan Jyoti, Yogi Adityanath and Sakshi Maharaj are ruling the political roost while wearing divinity. There are number of Maulanas, who have held the political arena, beginning with Maulana Azad himself. To reprimand the Archbishops for expressing their opinions is unfortunate. As they are citizens, they should be and can be concerned about the social issues too.

Ram Puniyani is Chairman, Centre of Study of Society and Secularism and has written several books including Communal Politics: Facts Versus Myths (Sage, 2003), Deconstructing Terrorist Violence (Sage 2015), Indian Nationalism versus Hindu Nationalism (Pharos 2014) and Caste and Communalism (Olive 2013).

Ravish Kumar took to Facebook to challenge the Centre’s Narendra Modi government to come face to face in front of a LIVE camera if it wished to finish off the NDTV.

In a powerful Facebook post, Kumar wrote, “ So you intimidate and threaten us, even put everyone including the Income Tax Department against us. See we are trembling with fear.

Now put your stooges on social media into action to defame us. But in this season of the media playing your tune, sitting in your lap, there is one media house that has refused to do so. For you, success is when every Indian sings your tune, all media houses play your game, sit in your lap. NDTV did not come into being easily, even you know that.

If you are so gleeful to see our end, let’s come face to face  some day on chairs. Before a live camera.

The brazen use of a central agency against a media house comes days after anchor Nidhi Razdan asked BJP spokesperson Sambhit Batra, known for his crass bullying, to leave her show.

Meanwhile the channel has also issued a strong statement that may be read here.

This morning, the CBI stepped up the concerted harassment of NDTV and its promoters based on the same old endless false accusations.
NDTV and its promoters will fight tirelessly against this witch-hunt by multiple agencies. We will not succumb to these attempts to blatantly undermine democracy and free speech in India.

We have one message to those who are trying to destroy the institutions of India and everything it stands for: we will fight for our country and overcome these forces.

REVISED STATEMENT OF NDTV

It is shocking that the CBI conducted searches on the NDTV offices and residence of the promoters without even conducting a preliminary enquiry. This is a blatant political attack on the freedom of the press as sources confirm that under pressure, the CBI has been compelled to file an FIR based on a shoddy complaint by a disgruntled former consultant at NDTV called Sanjay Dutt, who has been making false allegations and filing cases in courts of law with these false allegations. So far, he has not obtained a single order from any of these courts.

Legal analysts are astounded that where courts have rejected giving any order in all these years, the CBI conducts raids based on what is a private complaint.

The allegation appears to be for a loan which has been repaid by Prannoy Roy and Radhika Roy more than seven years ago. (Scroll down for evidence of this.)

Even though lakhs and crores of rupees of dues have not been paid by several industrialists and no criminal case has yet been registered against any of them by the CBI, the CBI has chosen not only to register an FIR, but also conduct a search for a loan which has been duly repaid to ICICI Bank. Moreover, ICICI is a private bank.

The allegation that no disclosure was made to SEBI and other regulatory authorities is not only incorrect and false but also does not cloth the CBI with any power to register cases and search which further amplifies the fact that the search by the CBI is only a witch-hunt against independent media.

NDTV and its promoters have never defaulted on any loan to ICICI or any other bank. We adhere to the highest levels of integrity and independence. It is clearly the independence and fearlessness of NDTV's team that the ruling party's politicians cannot stomach and the CBI raid is merely another attempt at silencing the media.

No matter how much the politicians attack us – We will not give up the fight for freedom and the independence of media in India.

Madras High Court stays Centre’s order on cattle slaughter, Both CPIM ruled Kerala and Trinamool ruled West Bengal have opposed the Ban

Staying the operation of the controversial notification passed by Modi sarkar on May 23, the Madurai bench of the High Court sought responses from the state government and Government of India on the issue. On May 23, the Centre passed a notification seeking to regulate the sale of bovines at cattle markets.

The Madras High Court on Tuesday granted a four-week stay on the Centre’s decision to ban the sale of cattle meant for slaughter. The Madurai bench of the high court sought responses from the state government and Government of India on the issue. In response to a PIL filed at the high court, a interim order was passed today by a division bench comprising Justice M V Muralidharan and Justice CV Karthikeyan. On May 23, the Centre passed a notification seeking to regulate the sale of bovines at cattle markets. The order prohibited the sale of animals meant for slaughter. Cows, bulls, buffaloes, calves and camels are among the list of animals that are banned for sale at the cattle markets. The Centre has also tightened the rules for those looking to sell or purchase the animals.

The Centre’s move evoked strong reactions from politicians across the country, particularly in Kerala, West Bengal and Tamil Nadu. Beef Fests have been organised around the country in protest against the Centre’s decision. In Kerala, Youth Congress Workers and organisations associated with the Left took out protest marches against the government. Beef was cooked and freely distributed to the public at many places. Kerala Chief Minister Pinarayi Vijayan strongly opposed the ban and appealed to Prime Minister Narendra Modi to withdraw it. He said the ban could adversely affect the lives of millions of people.

In a letter addressed to other chief ministers, Pinarayi Vijayan has written,

"I am sure that you are already conversant with the Notification containing the Prevention of Cruelty to Animals (Regulation of Livestock Markets) Rules, 2017 issued by the Ministry of Environment, Forest and Climate Change on 23rd May, 2017. The Rules impose a number of restriction on cattle trade which would have serious repercussions on the livelihood of millions of people, especially those in the agricultural sector, in our country.

It appears strange that the Rules are promulgated under the Prevention of Cruelty to Animals Act, 1960 since they have nothing to do with the objects of the Act. Neither are the Rules covered by the express delegation of legislative powers contained in the Act. Hence it is nothing but a covert attempt to usurp the powers of State legislatures in the guise of rules under a Central Act. The subjects covered by the Rules belong to entries 15 and 18 of the State List in the Constitution. This impermissible encroachment into the domain of the State Legislatures is a clear violation of the spirit of federalism, which is acclaimed as one of the basic features of the constitution..

The Rules, by imposing unreasonable restriction on the fundamental right to carry on any trade or occupation under Article 19 (1) (g) of the Constitution, will not stand the test of constitutionality. They also violate the basic right of a person to freedom of choice regarding his food.

It is rather unfortunate that such a drastic measure, producing serious consequences, was introduced in exercise of the rule making power, surpassing the elected representatives of the people and avoiding any public debate. This is nothing but a negation of the democratic principle, which is indisputably accepted as forming part of the basic structure of the Constitution.

Apart from the Constitutional and legal infirmities of the Rules, the disastrous consequences which are likely to arise if these Rules are brought into force make one shudder. It will definitely produce a chaotic situation in the rural agricultural economy in all the States.

Unless we stand together and oppose this anti-federal, anti-democratic and anti-secular move, it may mark the beginning of a series of similar measures aimed at destroying the federal democratic fabric and secular culture of our country. I would therefore fervently appeal to you to convey your objection to the 2017 Rules under the Prevention of Cruelty to Animals Act to the Prime Minister, and to request him to withdraw the Rules introduced without any consultation with the States. Since the matters dealt within the Rules squarely fall within the purview of State Legislatures, the State Governments may be allowed to formulate necessary policies and laws to suit the socio-cultural and economic milieu of the State.

I have already brought these matters to the kind attention of the Prime Minister in a letter dated May 27th, 2017 "

In Tamil Nadu, students organised a Beef Fest at IIT-Madras. Acting DMK president M K Stalin will be leading a public protest on Wednesday in Chennai, demanding the Centre to revoke the notification.West Bengal also saw similar protests against the Centre, with Chief Minister Mamata Banerjee training her guns against the Centre.

The Centre's notification restricting the sale of cattle in the country is glaringly unconstitutional and an affront to federalism besides being a blow to farmers. The centre cannot create any law or issue orders/notification on a subject that is in the State list, in the division of legislative powers between the centre and states. Livestock is a state subject.

In the State List under Schedule VII: Paras 15 and 16 cover livestock.

Here is the original notification, issued under the Prevention of Cruelty Act, assuming powers that the basic Act itself doesnt have. Sabrangindia has broken the story yesterday along with scroll.in

http://egazette.nic.in/WriteReadData/2017/176216.pdf

It can also be read here.

Interestingly, the world's first animal protection law was passed by Hitler in 1933 to ban the Jewish Koushar meat and to selectively harass Jewish biologists.

Already some states and other individuals and organisations are expressing outrage and expressing their desire to approach the Supreme Court where it is hoped it will be struck down as un-Constitutional.

Here are some of the Orwellian terms of the Notification:

Restrictions on sale of cattle.— The Member Secretary of the Animal Market Committee shall ensure that-
(a) no person shall bring to an animal market a young animal;
(b) no person shall bring a cattle to an animal market unless upon arrival he has furnished a written
declaration signed by the owner of the cattle or his duly authorised agent—
(i) stating the name and address of the owner of the cattle, with a copy of the photo identification
proof ;
(ii) giving details of the identification of the cattle;
(iii) stating that the cattle has not been brought to market for sale for slaughter;
(c) every declaration furnished to the Animal Market Committee shall be retained by it for a period of six
months from the date on which it is furnished to them and the Animal Market Committee shall, on
demand made by an Inspector at any reasonable time during that period, produce such declaration and
allow a copy of it or an extract from it to be taken;
(d) where an animal has been sold and before its removal from the animal market, the Animal Market
Committee shall—
II (i) 17
(i) obtain the expenses incurred for each animal, as approved by the District Animal Market
Monitoring Committee, so as to provide the basic facilities for animals and people;
(ii) take an undertaking that the animals are bought for agriculture purposes and not for slaughter;
(iii) keep a record of name and address of the purchaser and procure his identity proof;
(iv) verify that the purchaser is an agriculturist by seeing the relevant revenue document;
(v) ensure that the purchaser of the animal gives a declaration that he shall not sell the animal up
to six months from the date of purchase and shall abide by the rules relating to transport of
animals made under the Act or any other law for the time being in force;
(vi) retain such record for a period of six months from the date of sale;
(vii) produce such record before an Inspector on demand being made by him at any reasonable time
during that period and allow a copy of it or an extract from it to be taken;
(e) the purchaser of the cattle shall –
(i) not sell the animal for purpose of slaughter;
(ii) follow the State cattle protection or preservation laws;
(iii) not sacrifice the animal for any religious purpose;
(iv) not sell the cattle to a person outside the State without the permission as per the State cattle
protection or preservation laws;
(f) where a cattle has been sold and before its removal from the animal market, the proof of sale shall be
issued in five copies, out of which first copy shall be handed over to purchaser, second copy to seller,
third copy to tehsil office of the residence of purchaser, fourth copy to the Chief Veterinary Officer in
the district of purchaser and last copy to be kept intact in the record by the Animal Market Committee.
