We will put an end to moral policing, declared newly elected Karnataka chief minister, Siddaramaiah stated clearly on Tuesday, May 23 and also vowed to put an end to moral policing in the state, and asked police officials to ensure that there is no discrimination between religions, while maintaining law and order. In his maiden meeting with top police officials after the Congress government came to power, he warned concerned officials that they would be held responsible if law and order situation deteriorates and directed them to take strict action against those disturbing harmony through social media posts. “We have asked the police to be people friendly, they should be courteous towards people who come to file complaints. PTI, Deccan Herald and National Herald carried reports of the meeting.

At the same meeting, also attended by deputy chief minister, D.K. Shivakumar rapped Karnataka police officials and asked them whether they are trying to ‘saffronise’ the state police department.

“Are you all set to saffronise the police department? We will not allow it under our government,” Shivakumar stated while addressing the meeting of high-level police officers of Karnataka at the Conference Hall in Vidhana Soudha of Bengaluru.

He did not stop there. “We know how police officers came to the police station wearing saffron shawls in Mangaluru, Bijapur (Vijayapura), Bagalkot and insulted the department,” he said. “You should have come to this meeting wearing a saffron shawl,” Shivakumar warned police officers.

“If it was to be patriotic, then you should have come to work wearing the national flag. We will not allow saffronisation of the police department,” Shivakumar stressed. “Imagine the level the police department would stoop to if an ADGP-ranked officer is indulged in fabricating OMR sheets in the PSI recruitment scandal,” Shivakumar questioned.

The chief minister detailed his government’s concern about deteriorating law and order. Not only the police inspector, DCPs will also be held responsible for crimes and illegal acts like — rowdyism, clubs, and drug menace — in any of their police station limits, and action will be taken against them,” Siddaramaiah said. Addressing reporters here, he said, “during the maintenance of law and order, there should not be any discrimination between religions, and everyone should be seen equally, and should be protected equally.” “No moral policing here on, we will put an end to this…” he added.

Shivakumar emphasized, “People have elected a new government with the expectation of change. Officials should work to respond to their problems,” Siddaramaiah said. He also directed officials to take strict legal action against those disturbing harmony in the society, through inflammatory and provocative posts on social media. The CM will hold a separate meeting to discuss the issue of traffic congestion in Bengaluru, his office said in a release quoting him.

Drug addiction should be prevented, Siddaramaiah said, as he asked “Hoysala” patrol teams to always be vigilant to check crimes. Directing senior officers to visit and inspect police stations, he said the public who come to the police station with problems, should be treated courteously, without looking at them like criminals. Siddaramaiah also told police officials that they should take merciless action to control illegal activities within the police station limits. “Our government does not tolerate goondaism, illegal club activities, drug mafia,” he said. Ministers K J George, K H Muniyappa, B Z Zameer Ahmed Khan, M B Patil, Satish Jarkiholi and senior officials were also present at the meeting. Taking officials to task over some incidents in the previous BJP government tenure, Shivakumar asked, “Are you planning to saffronise the police department?” He said that it will not be allowed in the present government.

Referring to incidents of policemen sporting saffron shawls or dress, during some occasions in Mangaluru, Vijayapura and Bagalkote, during previous BJP regime, Shivakumar did not hold back, “We will not allow saffronisation of the police department, under our government.” Highlighting the involvement of an Additional Director General of Police rank official in the Police Sub-Inspector recruitment scam, the Deputy CM said, “Look at the bad state of the department.” Shivakumar also charged the police with “harassing” Congress leader and now Minister Priyank Kharge, who brought out the scam, by holding a press conference. Accusing the police of filing false cases against Congress leaders and workers, including Siddaramaiah and him, during BJP rule, he said, “We do not hold grudges. We don’t believe in that. You change, leave the old. Start a new job.”

Shivakumar was firm. “You harass those who conducted the press conference and brought this scandal out. You have harassed Priyank Kharge. The Karnataka police department had made a name in the entire country. You have destroyed the honour and dignity of the department.

“Wherever you see, everywhere it is all about money. Everything has to be cleaned under our government. The people are looking forward to a big change by this government. This should begin from the police department,” Shivakumar said.

The message of political change and sharp change in political functioning should reach people. Your earlier behaviour won’t be tolerated. I know how you (the police department) behaved with me and CM Siddaramaiah during the Pay CM campaign. You lodged cases against us. Thousands of false cases were lodged against our party workers. They were harassed. You did not spare me and Siddaramaiah, you could have done worse to normal people,” Shivakumar said.

He pointed to how partisan behavior had affected police function. “However, you (police) did not lodge any case against the opposite party (then ruling BJP). You danced to their tunes and colluded with them. Why have you not booked a case on those who issued a statement that Siddaramaiah should be dealt with in the same way as erstwhile Mysuru ruler Tipu Sultan? He provoked murder, but you didn’t book him (former IT and Higher Education Minister C.N. Ashwath Narayan),” Shivakumar stated.

“Is that not a crime? We have evidence of whatever you have done. All this will not be tolerated henceforth. You should change, your conduct should change. If not, we will have to change you. We will not carry forward hatred. We don’t believe in it. Change yourself, start work afresh and give peace to the people,” Shivakumar maintained.

As many incidents of “love jihad” policing in the past have taken place in public spheres, like at bus stops, open garden spaces, by halting bikes, buses and so on, the right wing group, Bajrang Dal has started barging into people’s homes now! Reportedly, in Indore, Madhya Pradesh, the largest city in the state, a group of men belonging to the Bajrang Dal, stormed into a birthday celebration in a house and allegedly thrashed some Muslim men.

A 24-year-old Hindu woman was celebrating her birthday with her friends when a mob, allegedly comprised of Bajrang Dal men barged into the house and started assaulting the Muslim men on allegations of “Love Jihad”. These men were even taken to MIG Colony police station where they were put in jail, reported The Quint.This incident took place on January 21 and the video went viral the next day.

 

 

In the video the men from the mob can be heard abusing the men while the woman is seen hiding her face in exasperation. In the later part of the video, a man can be seen asking one of the men to sit down, while he himself sits on the bed and asks him some questions and then starts thrashing him.  Then the unruly mob can be seen escorting the (presumably) Muslim men out of the room and thereafter they were probably taken to the police station.

 

 

Forced to file conversion complaint

While raising slogans in praise of Bajrang Dal,the mob riding on bikes took the men to the police station and are known to have pressurized the woman (whose birthday party it was) to lodge case of forceful conversion or “love jihad” but she did not relent and insisted that they were only celebrating her birthday. She refused to file any complaint against her friends.

 

 

The publication spoke to the MIG police station in charge, Ajay Verma who said that to avoid further dispute they had charged the men under section 151 [Knowingly joining or continuing in assembly of five or more persons after it has been commanded to disperse] of the IPC and said that the men will be released by Sunday (January 22). However, when Sabrang India spoke to Verma today he said that the men will be taken before the ACP today and are still in police custody. When inquired why they were not presented before a Magistrate in a bailable offence, he said that they were under preventive detention to avoid any “breach of peace”.

The Bajrang Dal claimed that they were conducting a search of the apartment after receiving information that 5 Muslim men and 2 Hindu women were in the flat. They claim that they found intoxicating substances, including liquor bottles and hence they brought them to the police station.

No action against Bajrang Dal

Surprisingly though the charges under which they have been booked and put in police custody, do not relate to finding of any intoxicating substance. Furthermore, the fact that a threatening mob entered a house, a residential premises without permission of the occupant, is a clear offence of criminal trespass (among others) and yet, the police took no action in this regard and the members of the unruly mob are roaming scot free, at liberty to commit more of such offences.

A video of a young man being beaten up by a mob has been doing rounds on Social Media. It has been claimed that the man being assaulted belongs to the Muslim community, and the assaulters are Hindus. In the video, the mob can first be seen accusing the Muslim man of doing something, while the same is being denied by him. The audio of the said video is not clear enough to figure out what is being said. While one person from the mob can be seen holding the collar of the Muslim man as well as slapping him, other people from the mob can also be seen assaulted him and slapping him. Through half of the video, one man from the mob can be seen pointing a finger at the Muslim youth and talking to him. The Muslim man can be seen and heard requesting the people of the mob to listen to him and not hit him.

One person from the mob can then be heard suggesting that the Muslim man should be thrashed more. The youth can then be seen folding his hands. The mob then suggests that he should be hit below his waist. While all this is being said, multiple members of the mob can be seen making a video. He is then dragged away from the wall that he was standing next to and brought to the centre of the mob. Two men from the mob can then be seen flogging the Muslim youth, hitting his legs with sticks, till he falls down.

As per the information provided, this incident is from Khandwa, Madhya Pradesh.

An FIR has been filed by the victim. According to the FIR, this incident took place on January 3, 2023. The victim, a student of MCA, was returning from a market at 2 pm in the afternoon when a girl came to talk to him, enquiring about some book. As he was talking to the girl, some 3-4 unknown people surrounded him and started asking him why he was talking to the girl. This mob then started abusing him verbally and physically too. As provided in the FIR, people who were passing them witnessed this incident too.

The victim later told his parents about the incident. He also informed that before the mob left him alone, they threatened him that if he is found talking to any other girl, he will be killed.

Incidents of moral policing are being increasingly reported throughout the country, wherein Hindu vigilantes assault or harass people travelling or conversing just because they belong to different faiths.

In September 2022, Wajid Ali was travelling with his parents, when reportedly a pre-dominantly Hindu mob stopped him, assaulted them all, dragged the man after tying him to the bike, tore the clothes of his mother. The incident happened on September 15, 2022 when a mob stopped him near Auria village. Amid religious slogans, Ali was allegedly dragged tied to a bike. The clothes of mother were torn apart & father was thrashed. Reportedly, the assault continued for an hour until Police saved them, said Ali.  In a video clip, Ali alleged that the family was attacked and thrashed owing to their faith. Ali and his family has allegedly led to little or no action from the local police.

Dozens of girl students of a college in Kottayam district in Kerala cut their hair on Wednesday as a mark of protest against the moral policing attack suffered by two students of a local college reported Deccan Herald. Students of the CMS college held the protest in the campus. While two girls initially cut their hair, more students later joined the novel protest. A human chain was also formed in the campus to express a silent solidarity.

Students said that the protest was organised to express solidarity with the students who suffered the moral policing attack as well as a call to rest of society to react to such incidents. Reportedly, a male and female student suffered the attack on Monday night in Kottayam town. A gang of youths attacked the two accusing them of roaming around in the night. Video footage of the incident went viral on social media. 

The students who suffered the attack lamented that no one who witnessed the attack either reacted or came forward to help. The two students were going to give clothes to a friend who was hospitalised.

Three accused in the case were nabbed by the police and a case for an attempt to murder and molestation has been levied against them.

Right-wing goons of Karnataka continue with violent acts of anti-Muslim hate, and moral policing on the streets. This time they waylaid a Muslim man and his Hindu woman companion when the two were travelling in an auto-rickshaw, in Dakshina Kannada district on Tuesday, April 5.

According to news reports, Nazeer (21) was travelling with his friend Pooja (age not disclosed) in an auto-rickshaw that was waylaid near Siribagilu village on the Mangaluru-Bengaluru national highway.

The goons later identified as Theertha Prasad, Jithesh, Surendra reportedly stopped the vehicle and asked the couple their names. Once the goons realised that the two belonged to different religions, they allegedly hit Nazeer on his face and head. They also abused the  couple. According to multiple news reports, police have registered a case under Sections 143, 147, 341, 504, 323, 324, 506 and 153(a) of the Indian Penal Code at Uppinangady police station. 

It is not yet known who informed the goons that an interfaith couple was travelling in an autorickshaw that was clearly being tracked before it was attacked.

Karnataka’s senior Congress leader Siddaramaiah has taken to Twitter to publicly school Karnataka Chief Minister Basavaraj Bommai on the latter’s comments on moral policing. On Wednesday Bommai, was speaking to media persons seeking his reaction to Bharatiya Janata Party (BJP) MLA Umanath Kotian escorting two people accused in a ‘moral policing’ incident out of a police station, after their release on interim bail.

The accused Samhithraj and Sandeep Poojary had been arrested on Saturday after members of Hindutva outfits waylaid a car in which three women and a man were travelling to Karkala and allegedly harassed them at Moodbidri, stated news reports. Among the harassed victims were two Muslims, and two Hindus. The victims filed a complaint and subsequently the Moodbidri police arrested the accused and booked them under Sections 354, 153a, 504 and 506 of the IPC. The BJP MLA escorted them out of the police station.

In reaction to the whole event, CM Bommai reportedly said that moral policing is the ‘natural action and reaction’ when sentiments are hurt. He said, “In society, all of us have to be responsible. There are many sentiments and one must behave in a way that doesn’t hurt such sentiments. When sentiments are hurt, naturally, actions and reactions are bound to happen.” According to a News18 report, the CM added, “Along with government responsibility to ensure law and order, everyone needs to be responsible, everyone must cooperate. Youngsters must ensure the sentiments of society aren’t hurt. This is a societal issue. Can we live without morality? What’s in our control is our morality. When there’s no morality, there will be actions and reactions.”

Bommai’s ‘morality’ comments were criticised widely, and the tallest leader doing that was Karnataka’s former Chief Minister Siddaramaiah who took to a series of tweets putting Bommai under the scanner. He said, “You have accepted your incapability to maintain law and order by justifying moral policing by a few anti-social elements. Please resign & save Karnataka!! Innocent women are being targeted in Karnataka and you are protecting anti-social elements.” He also asked if Bommai was going to “hand over law and order to the RSS or if he was planning to establish Junge Raj.” Siddaramaiah showed his Twitter savvy use of the #MoralPolicing and posted a long thread directed at Bommai.

According to news reports, Bommai accused Siddaramaiah of having got Hindu activists killed during his regime, to which Karnataka’s Opposition party leader in the Assembly warned him that a defamation case against the CM can be filed, but instead he is advised to correct himself. Siddaramaiah said, “Mr Basavaraj Bommai, like an ignorant, you have alleged that I got Hindus killed. Being the Chief Minister of Karnataka, you should have thought it through before making such loose comments. I can file a defamation case for this but I will just advise you to correct yourself.” 

Siddaramaiah also reminded Bommai, of the political legacy of his father S R Bommai, who was also a former CM of the state. He said, “Had you learnt anything from your father Shri S R Bommai (former CM) or me, you would not have joined a communal party just for power and support anti-constitutional activities.”

Bommai junior had attacked Siddaramaiah and posted, “While you were the CM, you became the icon of anti-Hindus by getting killed Hindu activists as Tippu Sultan did in his regime. I need not learn administration or policing from you.”

The Twitter spat between the two politicians has gone on for a few days now, even as the state continues to witness communal attacks at regular intervals.

Guwahati: In yet another case of moral policing that reveals the impunity of the ‘mob’, a mob waylaid an unmarried couple going on a motorcycle and assaulted them for travelling together, police said on Friday. Again, the seat of the tragedy was Assam. The incident went viral on social media following which two people have been arrested.

The mob waylaid the couple in their 20s and assaulted them at Pukhurpur village in Rongjuli area on June 19. The brother of the man who was attacked has claimed that villagers later held a meeting and forced the two to get married.

Assam Director General of Police Kuladhar Saikia said that as no case was filed, the police registered a case and investigations were on. While one person was arrested on Thursday, another person was picked up Friday morning, police said.

They were booked under various IPC sections including 342 (wrongful confinement), 325 (voluntarily causing grievous hurt) and 354b (assault or use of criminal force to woman with intent to disrobe).

Joint statement by women’s activists to immediately disband anti-Romeo squads in UP.

“Anti-Romeo Squads” are policemen and women and vigilante groups, operating outside the purview of law, with the support of the Uttar Pradesh State, which threaten women’s freedoms. The serious issue of violence against women and routine sexual harassment of women in Uttar Pradesh cannot be addressed by setting up anti-Romeo squads.

These “squads” impose their own aggressive and arbitrary code through moral policing. It has already come to light that in many cases, these “anti-romeo squads” have become an even greater source of harassment and fear for women and men, which has even been acknowledged by the DG Police UP in his order of 22nd March and 25th March, 2017.

However, the DGPs order of the 22nd March also opens up the doorway for moral policing as it talks of leaving alone couples in public spaces if their conduct is well within the traditional code. The term traditional code is ambiguous and not defined which once again allows police and public interference into the people’s privacy and the excesses thereof.

We therefore strongly disapprove of the process of this form of policing, including its outsourcing to private actors in some cases, which again the DGP police and the Lucknow SSP have acknowledged, in their letters issued in this regard.

We are clear that maintaining law and order is the primary function of the State and nothing can be done contrary to law, while addressing the issue of women’s safety.

The so-called Anti-Romeo Squads are being encouraged by a State which reneges on its own obligations to maintain law and order.

When the right to personal liberty and privacy is compromised by these squads, the State must be held fully accountable for such violations, and must be made to restore the dignity of the citizens, who are targeted by these squads by adequately compensating them and acknowledging that their rights have been violated.

It is our understanding that the Allahabad High Court Judgement of 30th March, 2017, uncritically legtimises these squads on the basis of the guidelines presented by the DGP and also opens the doorway to bringing in vigilante groups by saying that,
 

“in our considered opinion, it is the duty of the every citizen as well as of the State to come to the aid of women keeping in view the provisions contained in Article – 51A (e)(j) of the Constitution of India which provides that it shall be the duty of every citizen to renounce practices derogatory to the dignity of the women. The action taken by the state government can be a signal project informing the citizens of this State that the time has come when they also have to rise to the occasion to act in the aid of the Constitution by educating and informing their children to observe moral discipline”.

This rather benign resolve can have overreach where citizen’s groups may begin moral policing and form vigilante groups in the name of disciplining children. We would like this rectified by the court. The court instead could have asked the state government to present a grievance redressal mechanism both for instances of sexual harassment of women and excesses committed by the “preventive mechanism called anti-Romeo squads”, it in this detail that the commitment of the State towards ending violence against women and not encroaching on people’s privacy would have been established.

We would also like to bring to the notice of all that we are deeply disturbed and alarmed that a tweet by well-known Supreme Court lawyer Prashant Bhushan, has led to vigilantes attacking his home and the police registering a FIR against him, under Sec. 153A and 295A IPC, in P.S. Hazaratganj, Lucknow.

As feminists, our viewpoint on the subject of the tweet is different from that of advocate Prashant Bhushan. In our understanding, there is a sharp distinction between consensual friendship, flirtation and love between two adults, irrespective of differences of class, caste or religion in which nobody has the right to interfere and between sexual harassment, stalking and sexual assault of women, on the other.

The FIR registered against Adv. Prashant Bhushan by Hazratganj Police is a clear case of abuse of power, as no such offence is made out on the basis of the tweet in question. This is yet another example of the prevailing high level of intolerance to opinion that is at variance from the majoritarian viewpoint.

  • We demand that the “anti-romeo squads” be immediately wound up by the UP state and women’s groups that have been engaged with issues of ending sexual harassment and violence against women for long periods of time, be consulted to develop mechanisms to end such violence.
  • We also demand that the FIR’s and complaints against advocate Prashant Bhushan be immediately closed. Curbs to freedom of speech is not just intolerance, but in violation of fundamental rights.
  • The free run being given to vigilante groups in UP raises serious concerns about the subversion of rule of law by them. There is urgent need to implement laws preventing violence against women more effectively.
  • The Allahabad High Court judgement be reviewed in the light of its misuse of initiating vigilante groups in the name of citizens disciplining their children.
  • A prompt grievance redressal mechanism responding effectively on instances of sexual harassment along with the responding to the excesses carried out by these squads be put in place.

Not just 'Kiss of Love', but other protests too are being organised in city.

Members of Shiv Sena going berserk in the garb of moral police and literally chasing away couples from Kochi’s Marine Drive on Wednesday evening, has sparked much outrage in the state. The incident that has by now received flak from various quarters, has also paved way for the return of Kiss of Love campaign.

Supporters of the KoL campaign have decided to organize a protest event at Marine Drive at 4pm on Thursday.

The Facebook page of the Kiss of Love Campaign condemned the police for being mute spectators to the incident. The post, with a photo of the moral policing act on Wednesday, asks the police to take off their police hats and to start serving the Shiv Sena.

On Wednesday, a march conducted by the Shiv Sena members to Marine Drive turned violent as the members began to chase away couples, with canes in their hand. All this, while the police did little to prevent Shiv Sena members from taking law into their hands. 

Kiss of Love campaign had been dormant for a while after two of its main faces Rahul Pasupalan and Reshmi were arrested for charges of trafficking. However, the duo were released on bail, with the court noting that the case against them was weak.  

The return of Kiss of Love campaign is not the only reaction this incident has caused. DYFI members are organizing an event named 'Sneha irippu' or 'Love sitting' at Marine Drive where in women and men of the party will be seen sitting at Marine Drive. 

Police inaction
Pinarayi Vijayan and the police department too came under severe criticism for failing to act against the Shiv Sena members. The Chief Minister on Thursday, admitted that there were indeed lapses on the part of the police. 

His response came after Opposition parties took on the CM, for failing to ensure that his police force did heir job right. 

"The police was protecting the anti-socials indulging in moral policing," MLA Hibi Eden told Deccan Chronicle

"The inaction cannot be justified in any modern and civilised society. The government machinery has failed in preventing such shameful incident in a fast-growing metropolitan city such as Kochi," the MLA added. 

After allegations of police inaction surfaced, Kochi city police commissioner suspended Mr Vijayashankar, sub-inspector of Central Station, who was on duty. Other police personnel who were present, have reportedly been transferred to AR Camp.
