The environment of communal harmony in Maharashtra is vitiated today like never before by a few organisations that are very actively working to achieve this. Those in power in the state do not consider complex questions like unemployment, inflation, development, issues faced by farmers and workers, important to address.  They are just interested in capturing votes through creating disharmony and hate in society. Ideals of Chhatrapati Shivaji Maharaj, Shahu Maharaj, Jyotirao Phule, Dr Babasaheb Ambedkar are constantly under attack.

Without acknowledging the seriousness of the current situation some people within the Muslim community are in fact almost handing over to these forces the means to attack.

Why are photographs of Aurangzeb being displayed today? Who is our king – someone like Chhatrapati Shivaji Maharaj who gave space and dignity to our ancestors or kings like Aurangzeb who did not give any space to the people of this land? Why then are people displaying his photo?

During Aurangzeb’s rule most of the generals and officers were Rajputs and Brahmins. Not only that, most of his advisors were also from amongst them.

The only Muslims that he (Aurangzeb) had were those Pathans and others who came with him. He never gave any space to the Muslims from this land.

Then why are we proudly using his images?

In Kolhapur where a ruler like Shahu Maharaj gave the Dalit and Muslim population not only equal space but also respect and dignity, it is unfortunate that such events happened in that same region.

We have to realise that those who mislead and instigate poor Muslims in the name of religion are their true enemies.

Most Hindus, not only in Maharashra, but in the whole country, are even today working hard to maintain Hindu-Muslim unity.

If a few Hindus from the allegedly privileged castes and classes are working to create an environment of hate in their bid to retain power, then this is not the way to counter them. We have to follow the path that Mahatma Gandhi showed us. Violence can never be fought with violence, violence has to be countered by love. Humility in the face of aggression is the only solution.

When some people from the Muslim community make problematic statements, foster enmity and hate, take a position against the entire Hindu community and faith, it puts at risk those among the Hindu communities and people that are standing alongside the Muslim community.

These actions of ours do not speak against the communal Hindu forces, they in fact put at risk the actions and work of those from the Hindu community that are working to fight the communalisation of our society. We have to realise this.

Keep faith in the Constitution

Today in Maharashtra there is an attempt at creating situations of disharmony in various places like Mumbai, Aurangabad, Akola, Buldhana, Tryambakeshwar, Shevgaon. In some places it seems like the actions of groups that are dividing society and are anti-national are almost backed by the police. The police allow morchas to happen and allow violence to happen even when they are present by not taking any action against those indulging in the violence. They do not take action against those that give hate speeches and calls to divisiveness and violence.

The Muslim community today needs to take note of the nature of those in power in the Centre and the state. The country split into two in 1947 even as we got Independence. Even though Pakistan was created, India did not become a Hindu nation, it became a secular nation. It became a republic maintaining its vast diversity of religion, caste, region, language, culture. The Constitution authored by Dr Babasaheb Ambedkar created an inclusive nation that promised justice to all its citizens.

The RSS that got formed in 1925, however, only always wanted this nation to be a Hindu nation. Golwalkar Guruji of the RSS had critiqued the Indian Constitution by calling it a “quilt just made up (stitched together) by borrowing laws from different nations. Realising the incomplete dream of the RSS of making ours into a Hindu nation then, this is the agenda that is now being pursued actively since 2014. A large part of the systems of governance are today controlled by this brand of Hindutva politics.

The damage caused by the Shahbano incident

It seems that many people from among the Muslim community are simply not understanding the gravity of this hold of Hindutva on the systems and structures of governance. The earlier irresponsible acts of some Muslim leaders of playing a communal politics cannot be indulged in. By politically organising to oppose the Shahbano judgement (1986 and thereabouts) we have harmed the future of our community. We do not seem to realise the seriousness of these acts and their implications.

Today’s situation is not of discord between Hindus and Muslims. Simple.

It is of State power against the Muslim community and we must understand the difference. Those who have power today from Delhi to Maharashtra have a singular agenda. They want to consolidate power through creating divisiveness in the nation, among people. What was once done successfully by the British, the same tactics are today being used by the current dispensation in power. In such a situation the Muslim community must calmly find a path of least resistance. Today the Muslim community has fallen behind the Dalits and Adivasis in education. We must pay attention to this. We must ensure that not a single child around us is kept away from getting education.

We cannot travel backwards!

We never pay attention to what are the real issues of the Muslim community. Those constantly instigating Muslims in the name of religion are not our saviours, they are in fact our enemy. Mohammad Paigambar has not only said that we must forgive our enemy, but has also asked the followers to respect other religions. We must watch out and take care that our actions are not such that we are creating enmity with those who are our friends.

Taufik from Kolhapur, Hasib Nadaf from Sholapur, Muzzamil from Buldhana, Badruzzama, Jabbar Bhai, Sayed Shehzad from Akola, Shaukat Tamboli, Samir Kazi, Nasir Shaikh from Ahmednagar, these are the youth who should be our heroes. The community should stand with these youth from the Muslim community and follow the path of modernism.

Travelling backwards using the name of religion is not going to help the Muslim Community. If the present environment prevails, then even those who today stand with the Muslim community will be scared to do so.

I respectfully call upon the Maulvis from the Muslim community to make efforts to maintain harmony, a harmony with which Muslims have both lived, and contributed to this land.

A day after 10 persons, who happened to be Muslim were arrested following a case of ‘rioting’ during a garba (dance) event at Undhela village of Matar taluk in Gujarat’s Kheda district, the Gujarat police has ordered an inquiry into video clips purportedly showing policemen flogging at least five persons, who were arrested in a rioting case, in full public view. This was reported by the Deccan Herald today. The minister of state for Home, Harsh Sanghvi has kept completely silent on the reportedly unlawful action of the Gujarat police.

The videos show villagers cheering for the policemen as they thrashed the men one by one. Widely circulated on social media platforms, the videos have attracted criticism from all quarters. “We have ordered an inquiry after taking cognisance of the videos,” Director General of Police Ashish Bhatia reportedly told the DH. This partisan and unlawful behaviour of the Gujarat police comes fast on the heels of their inaction against extra-constitutional outfits like the Vishwa Hindu Parishad (VHP) and the Bajrang Dal (BD) forcibly ‘preventive’ participation of all communities, especially Muslims, in the celebrations over the past 10 days.

The shocking incident of the police reportedly taking law into their own hands took place on Tuesday, October 4,  in Undhela village of Matar taluk, in central Gujarat’s Kheda district, a day after local police arrested 10 persons from the Muslim community following a case of rioting during garba event in the village.

Rajesh Gadhia, Kheda District Superintendent of Police, while saying that he was looking into the video, explained that it started with village sarpanch Indravadan Patel, as part of his “mannat” (pledge) organising garba on the occasion of Ashtami (8th day of Navratri) at the village temple, which shared its wall with a mosque.

“Normally, the garba is organised at a different place in the village, but for one day it was being held at the temple as pledged by the sarpanch. There were over 250 people, mostly women. However, some people from the other community objected as it was adjacent to the mosque. Initially, it was just a heated argument, but it turned into a brawl. Stones were thrown and many, including five-six women, were injured. A police team was also attacked,” Gadhia told DH.

Gandhia added that the FIR named 43 persons and a mob of hundreds of people. In their initial action taken by Tuesday morning, the police arrested 10 persons, all from Muslim community, and brought them back to the village where they were publicly beaten up. The shocking video shows two men in plain clothes holding the arrested men, one by one, by their arms, tied to an electric pole, and another man, in plain clothes, beating them from behind. The videos, shared widely, also showed a group of men, women and children watching, clapping and shouting “Bharat Mata ki Jai”.

Commenting on the incident, minister of state for home, Harsh Sanghvi said: “This was an attempt to disturb a religious festival by a certain kind of people. Some anti-social elements tried to break the peace. I want to say that in Gujarat anyone who abides by the law will not be troubled (Kayda ma rahshe to fayda ma rashe).” Conspiciously the minister who takes an oath under the Indian Constitution made no mention, leave aside criticise the blatantly illegal and unlawful action of the Gujarat police.

One of the MLAs from Congress party objected to the police action and tweeted: “The accused were tried to a pole and were flogged by police in public while villagers clapped. Only the courts have the right to punish (the) accused, not the police. They shouldn’t have taken the law into their own hands.”

An FIR has been filed 5 policeman from Badaun, Uttar Pradesh for brutally torturing a Muslim youth in his early 20s under the suspicion of cattle theft for the purpose of slaughter. It has been reported that he was made subject to electric shocks and a stick was inserted in his rectum.

The doctors at the hospital reportedly said that the patient was getting seizures regularly as his nervous system has been affected severely, possibly because of a shock. “Since the case is under investigation, we can’t provide further details about the medical examination report,” a doctor told TOI.

According to his sister-in-law, “Police thrashed my brother-in-law the whole night. After realizing that they had picked the wrong person, they handed him Rs 100 and sent him back after torturing him for two straight days. Since then, he has been getting seizures almost every day. On Friday (June 3) his condition deteriorated and we had to rush him to the hospital. He has been severely injured and unable to walk or speak”, reported Siasat.

On May 2, 2022, the victim who is reportedly a vegetable vendor was picked up and detained by the police on his way to work. It is important to note that the victim does not have any prior criminal record.

 Superintendent of Police (SP) (city) Praveen Singh Chauhan said, “The allegations against five policemen were found to be true during a preliminary investigation. We have registered an FIR against them for wrongful confinement and torture. Steps are being taken to suspend them and an impartial investigation will be carried out in this case. We are also supporting the family to ensure the best possible treatment for the victim”, reported Deccan Herald.

A case has been reportedly filed against the police officers under IPC section 342 (wrongful confinement) and section 33 (voluntarily causing hurt) along with others.

CJI NV Ramana on Custodial Torture

In August 2021, at an event organized by the National Legal Services Authority of India (NALSA), Chief Justice N.V. Ramana reportedly said, “The threat to human rights and bodily integrity are the highest in police stations. Custodial torture and other police atrocities are problems which still prevail in our society. In spite of constitutional declarations and guarantees, lack of effective legal representation at the police stations is a huge detriment to arrested/detained persons. The decisions taken in these early hours will later determine the ability of the accused to defend himself. If, as an institution, the judiciary wants to garner the faith of the citizens, we have to make everyone feel assured that we exist for them. For the longest time, the vulnerable population has lived outside the system of justice. The prevailing obstacles like lengthy, painstaking and expensive formal justice processes add to the woes of realising the goals of ‘Access to Justice’. As an institution, the toughest challenge before us is to break these barriers first.”

Judicial Precedent:

In the case of Paramvir Singh Saini vs Baljit Singh and Ors (S.L.P Crl. No. 3543 of 2020), while considering the installation of CCTVs in all police stations across the country to check State abuse, the Supreme Court’s three Judge Bench (Justices Rohinton Nariman, K.M Joseph and Aniruddha Bose) passed a detailed and specific order directing states and the centre to take concrete steps towards ensuring that every police station in the country and all investigating agencies have CCTV cameras in their premises

The bench ordered setting up of state and district level oversight committees that will be responsible for making sure that these CCTV cameras are procured, installed and function so they can be of use during trial. In September 2020, the court had impleaded all the States and Union Territories to find out the exact position of CCTV cameras at each Police Station as well as the constitution of Oversight Committees in accordance with the 2018 Order in Shafi Mohammad v. State of Himachal Pradesh (2018) 5 SCC 311. As per action taken reports filed by 14 states and 2 union territories, the court observed that the majority of the Compliance Affidavits and Action Taken Reports failed to disclose the exact position of CCTV cameras in each Police Station and also did not disclose any details on oversight committees.

In March 2021, the top court expressed its displeasure as both the Centre and the States/UTs did not take the matter seriously. A Bench comprising Justices Rohinton Fali Nariman, BR Gavai and Hrishikesh Roy said, “We reiterate that these are the matters of utmost importance concerning the citizens of this country under Article 21 of the Constitution of India.”

The top court came down heavily on Telangana, Karnataka, Uttar Pradesh, Madhya Pradesh and was most displeased at Bihar’s state of conditions. It noted that nothing has moved forward in these states in terms of installing cameras, allocating necessary budget, etc.

Further, the court also directed the central government to allocate its budget accordingly for CCTV camera installation in different investigation agencies like CBI, ED, etc. It had strictly reiterated that “after budgetary allocation is made within the one month given by us, our earlier orders will be implemented in letter and spirit within a period of six months from the date on which budgetary allocation is made.”

Police misconduct such as brutality, using excessive force, different methods of torture, humiliation, targeting the most marginalised, although does not go unnoticed, rarely attracts penal punishment. Police reforms have been long recognised especially in Prakash Singh and Ors v. Union of India and Ors (2006) 8 SCC 1, in which the Supreme Court came up with seven directives to kick start such reforms and re-shape the police force’s functioning mechanism.

Amongst the seven directives, the most important to the theme is “Police Complaints Authority” to be set up at the State and district level to inquire into public complaints against police officers of and above the rank of Deputy Superintendent of Police in cases of “serious misconduct by the police personnel, which would include incidents involving death, grievous hurt or rape in police custody.”

“The head of the State level Complaints Authority shall be chosen by the State Government out of a panel of names proposed by the Chief Justice; the head of the district level Complaints Authority may also be chosen out of a panel of names proposed by the Chief Justice or a Judge of the High Court nominated by him. These Authorities may be assisted by three to five members depending upon the volume of complaints in different States/districts, and they shall be selected by the State Government from a panel prepared by the State Human Rights Commission/Lok Ayukta/State Public Service Commission. The panel may include members from amongst retired civil servants, police officers or officers from any other department, or from the civil society”, read the judgment authored by Justice Y.K. Sabharwal.

Moreover, in a landmark judgment given by the Supreme Court in the case of D.K. Basu v. State of West Bengal (AIR 1997 SC 610) with respect to an increasing number of custodial deaths in India, the Court laid down 11 specific requirements and procedures that the police and other agencies have to follow for the arrest, detention and interrogation of any person. guidelines were made binding by the court by stating that failure to comply with these would make an official liable for departmental action and also for contempt of court. It was further held that these requirement flow from Articles 21 and 22 (1) of the Constitution and need to be strictly followed. These were to be followed not just by the police department but other law enforcement agencies.

However, the guidelines are being more or less violated and non-compliance of the same does not invite any serious implications.  It’s time these guidelines take the form of legislation or gets inducted in the Code of Criminal Procedure with meaningful implications. After all, violations of the legislature truly intend to safeguard a person’s right to life.

Advocate Shahid Nadeem, lawyer for legal cell of Jamiat Ulma Maharashtra Mumbai has joined in supporting Aman Khan, the techie who was forced to resign from his job in EXFO, Quebec-headquartered multinational company in Magarpatta, Pune.

 

Aaman Khan was harassed mentally by his manager Kishore Kotecha for wearing ‘religious attire’ and for his religious practises in office. The manager said that it was against the company policy when Khan defended that it was his constitutional right to practise his religion. Although there was no such policy of the company in reality.

After continuous harassment and threats from the senior Manager Kotecha, Khan was forced to submit his resignation in the  month of June. But Khan however has written to the company at Canada regarding their policy and has so far not received any reply. In the meantime he has also sought intervention from the Labour Commission of India, collector of Pune and Human rights activists.

Aaman Khan is on a satyagraha from August 15th 2018 as he believes in the Gandhian method of passive resistance and is hopeful that justice will be done to him sooner or later. He is joined by many activists and supporters in his lone battle for his basic fundamental right which completes a month on 15th September 2018.

UrduCity – a Urdu online news portal that publishes such stories is one among the supporters of Aman Khan.

Further Adv.Shahid Nadeem of Jamiat Ulma has written to the Chief Justice of India and also appealed to the Human Rights commission and all NGOs who are working for humanity and Justice in India to support Aaman Khan, 37 years, who is jobless at present and has 12 persons dependent on him.

Aaman Khan is demanding to be reinstated and abolition of discriminative practises in the company.

Yakub Ali, a 22-year-old Muslim man, was killed when the police opened fire against protesters at Kharboja Village of Goalpara District in Assam.  The protesters were marching towards National Highway 37 to demonstrate against the alleged harassment of D (doubtful) voters by the Border Police and Foreigners Tribunals. The rally was led by an advocate n am ed   Nazrul Islam, along with two other advocates.

Currently, as per the directives of the Supreme Court, nearly 100 Foreigners Tribunals are reviewing the list of D-voters. Election Commission identified D-voters were put on that list by the Election Commission stating lack of proper citizenship credentials and thereby dropping their names. Hundreds of such voters, mostly Bengali-speaking Muslims and Hindus of Bangladeshi origin, have been lodged in detention centers across the state. On June 30, the protesters assembled as per the call of Advocate Islam who stated in a leaflet that the rally demands to put an end to the “injustice meted out to Assam’s Muslims and Bengali Hindus.” The leaflet further read, “The national highway would be blocked on June 30 from Makori to Sulmara and Pancharatna and Naranarayan Setu against the injustice”, and it urged the protesters to be non-violent.

The words of an eyewitness , Hussain Ahmed Madani, quoted as “About hundred people raising slogans demanding inclusion of genuine citizens in the NRC were stopped close to Naranarayan Setu (a bridge over river Brahmaputra) by the police asking them for the permission letter to hold the protest. CRPF personnel were also present. The aim of the protesters was to block the National Highway 37 which connects Goalpara to the neighbouring Bongaingaon district (and thereafter to West Bengal). Though the protesters had applied for permission, it was not granted by the police.”

While, Goalpara superintendent of police Amitava Sinha said:"When the police and CRPF personnel prevented them from blocking the highway, the protesters started pelting stones at them and at passing vehicles. The security personnel had to resort to a lathicharge and fire a few rounds in the air to bring the situation under control”.
Sinha added: "After being recently released on bail, Islam had sought permission for a road blockade but was denied consent. Yet, he and his supporters went ahead with the blockade. We arrested a few of them while they were on their way to the protest venue but some managed to reach the venue and tried to block the highway".
Rezaul Karim Sarkar, general secretary of the All Assam Minority Students Union, said, "It was a calculated plan of the Goalpara deputy commissioner and the SP to unleash violence on people from the minority community. We demand stern action against the police officials involved in the killing of an innocent picketer."
Opposition parties condemned the Goaplara police firing and demanded a judicial enquiry.

The Jharkhand sub-inspector and a VHP official accused of severely beating Minhaj Ansari in Narayanpur police station have not yet been arrested.

On the night of October 3, Jharkhand police swept down on Dighari village in Jamatara district, detaining 22-year-old Minhaz Ansari, and two of his friends, Shahban and Fahim.

Ansari, who owned a small photocopy shop, lived in the village with his parents, wife, and an eight-month-old daughter. Shahban worked in a vehicle repair shop next to Ansari’s shop.

“I was standing near Minhaj’s shop at about 9 at night, when eight to 10 men in plain clothes arrived on two motorcycles and a four-wheel vehicle,” Shahban told a team of activists that visited Dighari on October 17. “They started to chase and beat Minhaj and me. We tried to run. We thought they were criminals.”

Unbeknownst to the young men, Sonu Singh, the district head of the Vishwa Hindu Parishad's Jamtara unit, had complained to the police that Ansari had posted a photograph of himself with a calf on a WhatsApp group on October 2, followed by another of him posing with beef. The slaughter of cows is banned in Jharkhand.

At the police station that night, said Shabhan, they were thrashed by sub-inspector Harish Pathak and five or six other police personnel. “Later, they beat Minhaj separately,” recounted Shahban. “We could hear his cries. When they put him back in our room, his ear was bleeding. He could not speak, we tried to feed him, but he could not eat, the food would fall out of his mouth.”

A government autopsy report has found that Minhaj Ansari died of “haemorrhage and shock” of injuries “caused by hard and blunt substances”. However, Harish Pathak, the officer in charge of the Narayanpur police station in Jamtara district where Ansari was detained, and Sonu Singh, a Vishwa Hindu Parishad leader – both of whom have been accused of thrashing Ansari at the police station – have not been arrested even two weeks after the autopsy report was completed.

“Government medical records show police tortured Minhaj to death,” said Ghulam Mustafa, Ansari's maternal uncle. “Then, why has the police official-in-charge not even been arrested yet?”
 

'Intestine filled with blood'

After the non-profit news organisation TwoCircles.net on October 10, first reported Ansari’s death in custody, police officials said that the cause of death was likely to be encephalitis, a viral infection. However, the autopsy report by doctors of the government-run Rajinder Institute of Medical Sciences in Ranchi did not find any evidence of either encephalitis or any viral infection.

The autopsy report, first accessed by TwoCircles.net, said:

“The mucus of stomach was highly congested…it was layered with blood, reddish brown in colour. The stomach was empty…2/3rd of the small intestine was filled with blood.
Above noted injuries are ante-mortem caused by hard and blunt substances…Cause of death is haemorrhage and shock."

Senior district officials said that they were waiting for the results of a forensics report before taking further action against Patkhak, the officer at the Narayanpur police station.

“We have preserved the viscera and sent it for further forensic tests,” District Superintendent of Police MK Singh told Scroll.in. "We have suspended sub-inspector Pathak for dereliction of duty.

Dighari village, a neighbourhood of Muslim Ansari and Hindu Bhandari, Rai and Mandal families, is 45 km from Jamtara town in east Jharkhand.

Qadir Ansari, who is related to the Ansaris, told the fact-finding team that before Minhaj Ansari was arrested, his uncle was called to the police station, shown the photographs his nephew had allegedly shared on WhatsApp, and was told to send him to the police station. But by the time the uncle returned home late that evening, Ansari had already been arrested.

Soon after the young man was arrested on October 3, the police arrived at their home, Ansari’s family told the fact-finding team comprising Anil Anshuman of the All India People’s Forum, Afzal Anis of the United Milli Forum, Dheeraj Kumar of the Right to Food campaign, Tanvir of Anjuman Islamia, Ziaullah of Association for Protection of Civil Rights, and Akash of the Yuwa Ulgulan Manch. It was late at night.

“We were scared, we did not open the door, they tried to force open the door,” Umar Ansari, Ansari’s father who works in a saw mill, told the activists. “When we opened the door, Harish Pathak, the Narayanpur officer-in-charge started abusing my family. He said he would kill Minhaj.”

Ansari’s sister Gulroshan said: “Pathak made a phone call and made us listen to Minhaj’s cries as he was being beaten. He let me speak to Minhaj on the phone. Minhaj said, ‘My life is in danger, give them everything they ask for.'”

The family said the police took Rs 3,000 cash from their house that night, and also Minhaj Ansari’s laptop, mobile and motorcycle – which they later returned.

Ansari’s uncle Ghulam Mustafa, who accompanied the young man’s parents to the police station the morning after his arrest, said police officer Pathak abused and threatened them.

“Police station official-in-charge Harish Pathak threatened us [saying], ‘Go away, you Miyans, or all of you will be put in jail’ and ‘all Miyans will be straightened now,'” said Mustafa, using a derogatory word for Muslims.

He added, “Sonu Sharma of the Vishwa Hindu Parishad was also at the police station. He slapped and hit Mihnaj. He was urging Pathak to thrash Minhaj.”

After Irfan Ali, Member of the Legislative Assembly from Jamtara, visited the police station that day, Shahban and Fahim were released. But Ansari remained in custody.

“On both October 3 night and October 4 morning, we were put in the same room as Minhaj,” recounted Ansari's friend Shahban. “He could not speak at all. He signalled he would not survive.”
 

Condition worsens

On October 5, the police took Ansari first to the Sadar Hospital at Jamtara, and then to Patliputra Medical College and Hospital in Dhanbad.

Ghulam Mustafa said the MLA called to inform the family that Ansari had been taken to Dhanbad. Members of the family arrived at the hospital the following day.

“We requested the policemen [to let us see Ansari], but Pathak, who was also present there, was not allowing us to see Minhaj,” said Mustafa. “At the hospital, Pathak pushed Minhaj’s mother on the chest. She tried to protect herself and in this Pathak was hurt by her bangles. He threatened us that he will register an attempt to murder case against us.”

The Ansari family filed a written complaint against Pathak, which was later turned into a First Information Report with charges of attempt to murder. Pathak also registered an FIR against Ansari’s family members.

Umar Ansari told the fact-finding team that when the family was eventually permitted to see Ansari they feared that he was dead. “When we finally were allowed, Minhaj was unconscious,” said Umar Ansari. “His mother shook and kissed him, but he did not respond. There was no movement in his body.”

The autopsy on Ansari's body was conducted at the Rajinder Institute of Medical Sciences on October 9.
 

No arrests

Activist Afzal Anis said that district officials were being unresponsive even two weeks after Ansari’s death. “We gave a notice to the administration and have been protesting outside the District Collectorate since morning, but no official has even visited once,” he told Scroll.in on October 22.

District Collector RK Dubey said the charges in the First Information Report against sub-inspector Pathak had been changed from attempt to murder, to murder, after Ansari’s death. “Pathak’s conduct is being supervised by the district Superintendent of Police office,” he said. “After this, he may be arrested.”

झारखंड में वॉट्सएप पर बीफ पर कमेंट करने के आरोप में हिरासत में लिए गए मिनहाज अंसारी नाम के युवक की रविवार को पुलिस हिरासत में मौत हो गई थी। और मिनहाज को दिमागी बुखार होने की बात कही गई थी लेकिन अब पोस्टमार्टम रिपोर्ट में खुलासा हुआ है कि मिनहाज़ की मौत दिमागी बुखार से नहीं बल्कि पुलिस के पीटने से हुई थी।

जामतारा जिले में रहने वाले के मिनहाज़ की पुलिस हिरासत में 2 अक्टूबर को तबियत बिगड़ गई थी जिसके बाद उसे स्थानीय अस्पताल में भर्ती कराया गया था। हालत में कोई सुधार न होने के बाद उसे धनबाद ले जाया गया और अंत में 9 अक्टूबर को रांची के रिम्स में उसकी मौत हो गई।

पोस्टमार्टम में शरीर के कई हिस्सों में अंदरुनी चोट का खुलासा हुआ है लेकिन उसके पेट में कुछ नहीं मिला। ऐसे में डॉक्टरों ने उसे पुलिस हिरासत रखे जाने की आशंका जताई है।

 

हालांकि, स्थानीय जमतारा पुलिस के उस दावे की जांच जारी है जिसमें उसने मिनहाज़ के इनसिफेलाइटिस की बीमारी से पीड़ित होने की बात कही थी. अब उसके विसरा को सुरक्षित रख लिया गया है जिसे आगे की जांच के लिए भेजा जाएगा. विसरा रिपोर्ट के आधार पर ही पुलिस के दावे की सत्यता की जांच हो सकती है।

एनडीटीवी की खबर के अनुसार,ताजा घटनाक्रम के बाद दुमका जिला प्रशासन ने अब सभी एडमिनिस्ट्रेटर को व्हॉट्सऐप पर ग्रुप चलाने वाले एक सर्कुलर जारी कर कहा है कि उन्हें केवल ऐसे लोगों को समूह का सदस्य बना चाहिए जिन्हें वे पहचानते हों और यदि कोई सदस्य कोई आपत्तिजनक सामग्री पोस्ट करता है तो उसे तत्काल समूह से निकाल दिया जाना चाहिए. ऐसा नहीं करने पर एडमिनिस्ट्रेटर जिम्मेदार होगा और इसके खिलाफ आईटी एक्ट के तहत कार्यवाही की जाएगी।

Social media users have erupted in anger on the report that a Muslim youth was brutally ‘tortured’ by police in BJP-ruled Jharkhand after cops arrested him for a beef-related message on WhatsApp.

Many are asking if his body too should be draped in tricolour and his family be given Rs 25 lakh compensation just like the family of one of the Dadri murder accused Ravi.

Ravi’s family was given Rs 25 lakh and his body was kept draped in tricolour until the Union Culture Minister Mahesh Sharma had visited the village in Dadri pay his ‘respect’ to the departed soul. The photo of Sharma folding his hands before Ravi’s dead body had gone viral on social media platforms.

Others have questioned the general treatment of Muslims in a what’s now being termed as BJP’s India.

22-year-old Minhaz Ansari had died in police custody on Sunday.

According to media reports, 22-year-old Minhaz Ansari died on Sunday and his police allege he was tortured to death by cops during his custody.

What caused local journalists to suspect Mihaz’s death was the reluctance shown by local cops in showing Minhaz’s face when they arrived at the police station.

When Minhaz was shown to the media on Tuesday last week, he was slumped against a wall and his face covered with a cloth, reported NDTV (see photo below).

Police had also struggled to explain the circumstances leading to his arrest. Minhaz’s condition had raised suspicion that he may have been brutally tortured, prompting the cops to hide his face from the media glare.

One report said that Minhaz was not able to walk because of continuous beating even when he was being shown to media.

Indian Express reported that the WhatsApp message that prompted police to arrest Minhaz was had started doing the rounds in Dighari village of Narayanpura, in Jamtara district, on 2 October. Minhaz was reportedly the creator of the said WhatsApp group.

Though police have denied the allegations of excesses, they’ve now admitted that there were prima facie lapses on the part of the officer-in-charge of Narayanpura police station, Sub-Inspector Harish Pathak.

He has been suspended and an FIR of murder has been registered against him.
 
The news of Minhaz’s death in a state that saw public hanging of two Muslim cattle traders including a 12-year-old earlier this year has generated considerable social media buzz.

In March this year, two Muslim cattle traders were lynched to death by men belonging to right-wing Hindutva group.

They were killed while on their way to a local Friday market in Jharkhand when they were mercilessly beaten up before being hanged to death from a tree.

The incident took place on early hours at Balumath forests in Latehar district, 100km from Ranchi.

Police had later arrested five people in connection with the gruesome murder. The murder accused had confessed to their crime and given the chilling accounts of how they planned and executed the murder.

Minhaz Ansari was a top Twitter trend all throughout Wednesday evening.

 वॉट्सएप पर आपत्तिजनक सामग्री पोस्ट करने के आरोप में करीब एक सप्ताह पहले गिरफ्तार किए गिए मिन्हाज अन्सारी की रांची के रिम्स में पुलिस हिरासत में मौत हो गई। नारायणपुर के दीघारी गांव के 22 वर्षीय मिन्हाज अन्सारी को 3 अक्टूबर को गिरफ्तार किया गया था। उसके परिजनों ने पुलिस पर उसे प्रताड़ित करने और मारपीट करने का आरोप लगाया है।

पुलिस हिरासत में ही मिन्हाज की हालत बिगड़ने लगी थी जिसके बाद पहले उसे जामताड़ा और फिर धनबाद के पीएमसीएच  दाखिल कराया गया था। उसके बाद उसे रिम्स लाया गया था जहाँ उसकी मौत हो गई। मिन्हाज की मौत की खबर से नारायणपुर में तनाव फैल गया और बड़ी संख्या में लोग इकट्ठे होने लगे। मिन्हाज की मौत की सूचना पर जामताड़ा जिला प्रशासन के साथ राज्य सरकार भी अलर्ट हो गई। राज्य सरकार ने आननफानन में दो लाख मुआवजे की घोषणा कर दी, वहीं डीसी एसपी के निर्देश पर दीघारी गांव में भारी तादाद में पुलिस बल की तैनाती कर दी गई है।

जामताड़ा के विधायक डॉ इरफान अंसारी ने कहा है कि मिन्हाज को दो अक्टूबर को जुम्मन मोड़ से गिरफ्तार किया गया था। वह पूरी तरह से स्वस्थ था। उसे झूठे आरोप में गिरफ्तार कर थाना लाया गया। पुलिस हिरासत में उसकी पिटाई की गई। दो दिनों तक नारायणपुर के तत्कालीन थानेदार हरीश पाठक ने जमकर पिटाई की और उसके सीने पर चढ़कर भी पीटा। इससे उसकी हालत बिगड़ गई।

 डॉक्टर मिन्हाज को जापानी बुखार से पीड़ित होने की बात कह रहे हैं। धनबाद पीएमसीएच के अधीक्षक डॉ आरके पांडेय ने कहा कि मिन्हाज का धनबाद में भी ब्रेन फीवर का ही इलाज हुआ था, लेकिन वह बेहोश था। जामताड़ा के एसपी मनोज कुमार सिंह ने कहा है कि मिन्हाज को जापानी बुखार था और शायद थाना प्रभारी ने इस बात पर ध्यान नहीं दिया। एसपी का कहना है, “दशहरा और मुहर्रम को देखते हुए इलाके में सांप्रदायिक सद्भाव बनाए रखने के इरादे से वॉट्सएप मैसेज पर कार्रवाई की गई। स्थिति अब शांतिपूर्ण है और हम कड़ी निगाह रख रहे हैं।”
 
जिला प्रशासन ने मामले की जाँच के निर्देश दे दिए हैं। सब डिवीज़नल ऑफीसर और सब डिवीजनल पुलिस ऑफीसर इसकी जाँच करेंगे। इस बीच, मिन्हाज की पिटाई करने के आरोपी नारायणपुर के निलंबित थानेदार हरीश पाठक की पीएमसीएच में सुरक्षा बढ़ा दी गई है। सरायढेला थाना में दर्ज एफआईआर के अनुसार, मिन्हाज के परिजनों और परिचितों ने बुधवार की रात पीएमसीएच में हमला कर दिया था। हमले में पाठक घायल हो गए थे। पुलिस निगरानी में फिलवक्त पाठक का पीएमसीएच में इलाज चल रहा है। 

मिन्हाज के माता-पिता ने रांची में मुख्यमंत्री के निर्देश पर मुख्य सचिव राजबाला वर्मा से भी मुलाकात की है। मुख्य सचिव  14 अक्टूबर को दीघारी गाँव जाएँगी। कई पुलिस अधिकारी दीघारी में रुके हुए हैं। ग्रामीण मिन्हाज के परिजन को सरकारी नौकरी देने, पूर्व थाना प्रभारी हरीश पाठक और नारायणपुर थाना क्षेत्र के पबिया निवासी सोनू सिंह के खिलाफ हत्या का मामला दर्ज करने और गिरफ्तारी की माँग कर रहे हैं।
