Hundreds of Delhi Jal Board sewer workers united in their continued struggle against what they have been claiming is their summary and unauthorised dismissal without notice last month, held a public hearing in New Delhi on December 28, last Thursday. After this continued agitation that culminated in a public hearing, the Delhi Commission for Safai Karamcharis Chairman promised to take immediate action. The Public Hearing was held at the Constitution Club of India, New Delhi on 28, December 2023.

Around 300 workers from all across Delhi gathered for the Public Hearing and shared their grievances to the Jury Panel and the audience. The testimonies given by the workers revealed shocking realities of their working conditions. Workers from Pitampura, West Delhi said they were never told what their exact salary was and were paid in cash without any receipt by the supervisor!

Most of these workers, who have been employed as contractual labour since the past 10-15 years, were not given their salary for the last 2 months and were suddenly removed from their jobs this month. No notice was issued by the authorities, and shocked by the sudden removal of hundreds of workers.

One worker, who chose to stay anonymous, said “We have been working for 15 years, many contractors come and go but we have to fight for our daily wage of 450 Rupees!”

Another worker working in Navjeevan Vihar narrated how, he did not get his salary even for Diwali and Dussehra and his family has been surviving on a loan since then. Another worker from Kalkaji, South Delhi said he was suddenly removed from his job on December 7, 2023, without any prior notice or reason. In yet another case, a worker, from Eidgah store, approached the government authorities on non-payment of salary but after the complaint was filed he was removed from his job and has not been hired by any contractor since.

Such intimidation tactics have been used by the contractors which stops the workers from voicing their concerns. Sanjay Gehlot, Chairman, Delhi Commission for Safai Karamcharis, who was part of the Jury, took cognisance of the plight of the issues and assured that he will take immediate action to release the due payment and ensure that their jobs are secured. Senior Supreme Court lawyer, Colin Gonsalves, who was part of the Jury Panel, told the workers,

“Removing you without notice is illegal! Giving your salary in cash is illegal! Not giving you your complete salary is illegal!”

The Jury Panel consisting of Supreme Court lawyer Colin Gonsalves, former Member of Parliament and Vice-President, All India Kisan Sabha (AIKS) Hannan Mollah, Indu Prakash Singh Member of State-level Shelter Monitoring Committee; Amitava Guha, National Secretary of CITU. Others in the Jury included  Dithhi Bhattacharya, Director of Centre for Workers Management; Anil Varghese, social worker; advocate Harnam Singh, Chairperson, Monitoring Committee, Delhi High Court, and Meena Kotwal, Founding Editor, The Mooknayak.

The Jury heard the testimonies of 15 workers and gave the following recommendations:

  • Reinstatement of all contractual sewer workers and payment of all pending dues including wages, provident funds and other social securities. As per the minimum wages notification of the Delhi government for unskilled labour (Dated: October 1, 2022), workers must be paid a minimum wages of at least ₹ 17,494/- per month.
  • While appreciating the effort of the Aam Aadmi Party government to regularize 700 contractual workers of DJB, they must regularise all contractual employees who have worked for more than 240 days and the gaps in employment should be considered a sham and bogus.
  • Implementation of court orders of Writ petition (Civil) 5232/2007 in letter and spirit. Also implementation of supreme Court orders dated 20/10/2023 recommending payment of ex gratia of ₹30 lakh in case of death.
  • The Jury also recommended that the compensation be paid immediately without any delay. ESI and Identity Card for all workers in all sectors. Provision of scholarship for children of sewer workers in educational institutions. Union leaders have decided to approach CEO, Delhi Jal Board tomorrow with these recommendations and the workers have decided to gather at the DJB Varunalaya till they are given their due salary and given their jobs back!

The Public Hearing was organised by Dalit Adivasi Shakti Adhikar Manch (DASAM) in collaboration with unions like Municipal Workers Lal Jhanda Union (CITU), Delhi Jal Board Sewer Department Mazdoor Sangathan, All DJB Employees Welfare Association, Jal Mal Kaamgaar Sangharsh Morcha, Delhi Jal Board Karamchari Union, National Campaign for Dignity and Rights of Sewerage and Allied Workers (NCDRSAW) and organizations like Peoples Media Advocacy group.

Hundreds of women safai karmacharis gathered at the Jantar Mantar on August 28 in order expose the lies of the government about sewer and septic tank deaths at the Safai Karmachari Andolan’s (SKA’s) 475th day of #StopKillingUs campaign.

SKA gave a national call to stop telling lies and end sewer and septic tank deaths. At the protest, the women safai karmacharis stated that dalit lives and dalit deaths are invisible to the government. They declared that sewer and septic tank deaths are caste atrocities. So they don’t matter to the government with its casteist mindset.

As many as 59 Indian citizens were killed in sewer and septic tanks in 2023 but the government denied and lied to Parliament that only nine persons died. Pained and deeply anguished by these blatant and continuous lies, SKA gave this call.

SKA launched a nationwide #stopkillingus campaign on 11th May 2022 against government apathy on sewer and septic tank deaths. Since that day, safai karmachari women, youth, men and children have been campaigning for #StopKillingUs on the streets across the country every day without a break. August 28 was 475th day of the campaign.

Women who lost their family members in sewer and septic tank cleaning came with evidences of the deaths along with photos of the deceased persons and exposed the government’s lies. They narrated that the government denial and negligence has increased their trauma. The country has forced youth as young as 18 to 25 years to get killed in sewer and septic tanks.

Infants and children of the deceased were also present in large numbers at Jantar Mantar with their mothers, asking, “Where is my father, who killed him?” Not even in a single case has the government done any justice by way of employment, pension, housing, education etc.
SKA has been raising the issue since very long that the government is repeatedly and deliberately fudging data on sewerage workers deaths. Why is the government making such false and misleading statements? How will we stop this atrocity of deaths in sewer and septic tanks if the government that is responsible to protect us is only interested in protecting the perpetrators of these caste atrocities?

SKA raised slogans, banners and placards at the protest site that pushed the demands; Guarantee Right to Life with dignity (Article 21), budget allocations to remove caste based discrimination in sanitation work, rehabilitation with dignity, zero tolerance for sewer and septic tank deaths etc.

The protest concluded with the declaration that the #StopKillingUs campaign will continue every day, till the government makes a truthful and satisfactory response.*National convenor, Safai Karmachari Andolan

Dalit Adivasi Adhikar Andolan released a 10 point manifesto for Safaikaramcharis to ensure that political parties take note and implement their demands.

The Safaikaramcharis who are mostly manual scavengers lead pathetic lives in sub-human conditions and as many as thousands have even lost their lives due to occupational hazards. Yet no political party has taken up their issue to ensure safety measures or suitable compensation or their right to a life of dignity.

The manifesto begins with a demand for an unconditional apology from the Prime Minister for the historic injustice done through manual scavenging.

And to release every individual whether it is a child, man or woman from this labour in a time bound manner. The manifesto also demands that the sewerage deaths of the safaikarramcharis should be recorded and brought out in public along with the measures taken by the Government to stop these deaths.

Implementation of Article 21 of the constitution of India which guarantees the right to Life is another point in the manifesto. This right to be given in the form of issuance of ‘RL 21 card’ . This card should ensure the safai karamchais and their dependants access to quality education, healthcare, livelihood along with all other social security schemes and entitlements.
 

Demand for 1% budget allocation exclusively for the welfare of Safai Karamcharis from the Union budget; a special session in the parliament to stop sewer deaths and liberation and rehabilitation of persons engaged in manual scavenging are another two demands in the manifesto.

The manifesto even demands a separate Ministry to release and rehabilitate manual scavengers headed by the Prime Minister.

In order to increase the accountability the district magistrate should be held responsible for every sceptic or sewer death.
Compensation on the death of a worker should be enhanced to 1 crore a one time payment and subsequent grant of 50 lakhs for rehabilitation.
