Thursday approached the Deccan Gymkhana police station seeking the registration of a criminal defamation case against right-wing activist, Manohar Kholkarni, self-named Sambhaji Bhide for his allegedly derogatory comments about Mahatma Gandhi’s lineage.

Kholkarni alias Bhide, who is the founder and head of the Sangli-based organisation Shri Shivpratishthan Hindustan, allegedly made objectionable remarks about Mahatma Gandhi in a speech delivered in Maharashtra’s Amravati district in the last week of July. An FIR was registered against Bhide in Amravati on July 29 based on a complaint filed by a group of social activists.

In a tweet on Thursday morning, Tushar Gandhi said he was on his way to Pune to file a criminal defamation complaint against Bhide at the Deccan Gymkhana police station. “Will not take slander against my ancestors without seeking legal redress,” the tweet said.

Speaking to various media outlets outside the police station after the complaint was submitted, Tushar Gandhi said, “My great-great-grandmother and my family are public figures. But we are a private family. This is like coming into my house and insulting my mother and that will not be tolerated. After this issue was raised in the Assembly, the deputy chief minister made a statement and assured that steps would be taken to punish the culprits. But it seems as if something is keeping his hands tied.”

Gandhi sought registration of a case under Indian Penal Code (IPC) sections 499 (defamation), 153 (A) (promoting enmity between different groups) and 505 (statements conducing to public mischief). Tushar Gandhi said that he was associated with the Maharashtra Gandhi Smarak Nidhi and was informed in detail about Bhide’s remarks by the trust. “We decided to file a complaint and use avenues open to a citizen,” he added.

Pune-based human rights activist and lawyer Asim Sarode said, “Tushar Gandhi along with activists from Pune, including Vishwambhar Chaudhari, Dr Kumar Saptarshi, Anwar Rajan and Sanket Munot, today approached the Deccan Gymkhana police station seeking registration of a criminal defamation case against Bhide for the extremely derogatory comments he made about Mahatma Gandhi. A case has been filed earlier regarding these comments. But here, we are seeking criminal defamation provisions which have not been invoked in earlier cases.”

When contacted, Senior Inspector Vipin Hasabnis, in charge of the Deccan Gymkhana police station, confirmed that Tushar Gandhi and others had lodged the complaint. “We will be seeking legal opinion in this regard from the law officer and based on that further course of action will be decided,” he said.

In addition to the criminal case registered in Amravati, two more cases have been registered against Bhide in the recent past—one in Navi Mumbai for his alleged remarks about Gautam Buddha and other social reformers and the other in Nashik for his comments about Mahatma Jyotiba Phule.

On August 7, the Navi Mumbai police registered an FIR against Hindutva leader Sambhaji Bhide following a complaint for his alleged derogatory comments against Gautam Buddha and social reformers Mahatma Jyotiba Phule and Periyar Naicker.

In a shocking twist to the Bhima Koregaon case, the name of Manohar ‘Shambhaji’ Bhide has been dropped from the case as police claim that they have found no evidence against him. The Pune Police submitted as much before the Maharashtra State Human Rights Commission (SHRC) in Mumbai on May 4, 2022, reported Indian Express.

Readers would recall that Bhide’s name was included, along with that of Milind Ekbote, in a First Information Report (FIR) filed by Dalit Rights activist Anita Sawale, just a day after the violence broke out on January 1, 2018. The duo had been accused of instigating the violence by making inflammatory speeches in the run up to the anti-Dalit violence at Bhima Koregaon where one person was killed and several injured.

Though Ekbote was arrested by the Pune Rural Police after the Supreme Court rejected his anticipatory bail plea, chargesheeted in the case and later released on bail, Bhide was never arrested as police say they never had any evidence against him.

Meanwhile, a Mumbai-based lawyer moved SHRC against Bhide’s name being included in the case. Indian Express quoted his complaint as asking, “How long will a sword of FIR hang over the head of Bhide guruji?” He cited a statement by former Maharashtra Chief Minister Devendra Phadnavis saying no evidence was found against Bhide.

Following this the SHRC sought a status report from the Pune Rural Police. On May 4, a report dated May 3 and signed by Superintendent of Police Abhinav Deshmukh that said police have not found any evidence against Bhide was submitted to the SHRC. The report further said his name was dropped from the case.

The commission has now posted the matter for final hearing on July 4.

Bhide, a former Rashtriya Swayamsevak Sangh (RSS) worker, is a controversial figure who has been active in propagating militant Hindutva ideology and building Shiv Pratishthan Hindustan. He has been rather active in the past three decades in supposedly ‘spreading awareness’ on the life of Maratha warrior king Shivaji. It is noteworthy that Bhide also faces charges of instigating communal riots in Miraj-Sangli in Sangli district during Ganpati immersion, over an arch sporting a poster depicting the slaying of Afzal Khan. Though a demand was made for his arrest, the then Congress-NCP government didn’t take any action against him. He also played a major role when his organisation ransacked theatres to protest the film, Jodha Akbar in 2008.

On Monday, members of the Republican Yuva Morcha demanded that action be initiated against Manohar ‘Sambhaji’ Bhide in connection with the January 1, 2018 anti-Dalit violence at Bhima Koregaon.

On that fateful day, thousands of Dalit families had gathered at Bhima Koregaon to pay homage to the Dalit Mahar martyrs of the Anglo-Maratha war of 1818. These people, including women and children, were targeted and attacked by members of extreme right wing Hindutva groups, who not only pelted stones at them, but also set their cars and buses on fire! Neighbouring villages meanwhile, allegedly engaged in a social boycott and shut down their shops, thereby denying the gathered Dalits the opportunity to even purchase bottled water.

One person was killed and several injured in clashes that ensued. It is alleged that the attack on the Dalit families was planned. A fact-finding team led by Rashtra Seva Dal discovered that an extremist group called Hindu Aaghadi had been active for quite some time in the area, and had been holding public meetings for the last three weeks, issuing warnings to the people in the gathering that those who would assemble on January 1, would be considered as ‘anti-national’.

The day after the violence an FIR was filed at the Pimpri police station by Dalit political activists Anita Sawale against two well-known Hindutva leaders Milind Ekbote and Manohar ‘Sambhaji’ Bhide. Ekbote, is the President of Dharmaveer Sambhaji Maharaj Pratishthan and the founder of Shiv Pratap Bhoomi Mukti Andolan, and has a long list of charges and police cases against him for allegedly inciting violence.

Bhide is a former Rashtriya Swayamsevak Sangh (RSS) worker and is a controversial figure who has been active in propagating militant Hindutva ideology and building his organisation, the Shiv Pratishthan Hindustan. He has been rather active in the past three decades in supposedly ‘spreading awareness’ on the life of Maratha warrior king Shivaji. Prime Minister Narendra Modi had mentioned him as an inspiration at an election rally at Tasgaon, Sangli in 2014. He was recommended for Padma Shri award by the BJP government in Maharashtra in 2016. 

It is noteworthy, that he also faces charges of instigating the September 2009 communal riots in Miraj-Sangli in Sangli district during Ganpati immersion, over an arch sporting a poster depicting the slaying of Afzal Khan. Though a demand was made for his arrest, the then Congress-NCP government didn’t take any action against him. He also allegedly played a major role when his organisation allegedly ransacked theatres to protest the film, Jodha Akbar in 2008.

While Ekbote was arrested and later granted bail, Bhide was neither arrested nor named in any chargesheet related to the case. In September 2019, the Bombay High Court had directed the police to file a report on Bhide’s alleged involvement in the Bhima Koregaon violence.

Dalit groups have long decried how police have gone soft on Bhide. According to Republican Yuva Morcha leader Rahul Dambale, the Dalit group now plans to start a signature campaign. He has urged Maharashtra Chief Minister Uddhav Thackeray to look into the matter.

Meanwhile, well-known human rights activists and dissenters were implicated in the case and arrested in two rounds of raids. These include Sudha Bharadwaj, Varavara Rao, Fr. Stan Swamy, Anand Teltumbde, Gautam Navlakha, Surendra Gadling, members of Kabir Kala Manch and many others who are currently languishing behind bars on trumped up charges of instigating the violence.

The Bombay high court (HC) on Monday directed the Pune Police to complete its investigation into the alleged involvement of 85-year-old activist Sambhaji Bhide in the Bhima-Koregaon riots and submit its report in a month.

A two-member, division bench of justice Ranjit More and justice NJ Jamadar, while hearing a criminal writ petition filed by Pune resident Anita Sawale, was informed by the petitioner, through advocate Suresh Mane, that the police had in June sought three months to complete its investigation and file a charge sheet or report, which it had failed to do.

Bhide, well known for his political use vitriolic hate speech, had,  along with others, been booked for inciting violence at Bhima-Koregaon on January 1, 2018. The violence had resulted in the death of one. Although a case was registered against Bhide and others, the charge sheet spelling out his role in the violence hasn’t been filed yet. There have been media reports of charges against this set of accused being diluted.

In April this year, the Pune Police had told the court that the role of Bhide and other right-wing activists in the violence was being investigated and that it needed time till June. The court had granted time, but on June 16, the police informed the court that it needed three more months to conclude its investigation, which the court granted.

However, on Monday, Mane informed the court no charge sheet had been filed and hence sought directions to expedite the same. On its part, the state through additional public prosecutor Sangeeta Shinde submitted that the investigation was on in full swing, but it would only conclude by December and hence sought time till then to file the charge sheet or the report.After hearing the submissions, the bench directed the state to conclude the investigation and file the charge sheet in four weeks and posted the matter for hearing on November 11.

He is a controversial figure who has been active in propagating militant Hindutva ideology and building Shiv Pratishthan Hindustan. He has been rather active in the past three decades in supposedly ‘spreading awareness’ on the life of Maratha warrior king Shivaji.

It is notable that he also faces charges of instigating communal riots in Miraj-Sangli in Sangli district during Ganpati emersion, over an arch sporting a poster depicting the slaying of Afzal Khan. Though a demand was made for his arrest, but the then Congress-NCP government didn’t take any action against him. Sambhaji Bhide is also a former RashtriyaSwyamasevakSangh (RSS) worker.

In October 2018, there were media reports that cases against Bhide were being withdrawn.

A year after riots broke out on January 1, dalit victims feel cheated by the authorities as the prime accused still roam around freely while dalit rights’ activists are being arrested.

As the preparations for Bhima Koregoan Shourya Divas are going on, dalit organisations and the common dalit man is angry. Though they remain composed and responsive to all preparations being done by police and administration, anger is boiling as prime accused of the riots are roaming free and charge sheets have not been filed in a single FIR in the riots. Meanwhile, dalit activists have been arrested and branded as naxals, accused for causing riots.

Every year lakhs of dalits visit Bhima Koregoan to pay homage to a war memorial built in the memory of soldiers who got injured or died in the battle of 1818, in which the British Army comprising Mahar and other backward caste soldiers defeated the oppressive Peshwa. Last year, when lakhs of dalits from across the state gathered to pay obeisance on the 200th anniversary of the battle, they were allegedly attacked by right wing extremists. One man died while many were injured. Hundreds of vehicles and properties of dalits were either torched or damaged causing losses up to crores. More importantly, the numerous riots left many local dalits homeless.

As informed by Sandip Patil, Superintendent of Police, Pune Rural Police, 23 FIRs have been lodged in connection with the Bhima Koregoan riots since January 2, 2018. But charge sheet has not been filed in a single FIR. Despite most of the cases being lodged under the SC/ST (Prevention of Atrocities) Act under which arrests of accused before investigation is compulsory, and charge sheet needs to be filed within three months, not a single charge sheet has been filed. Though over a thousand have been accused in the cases, only 121 have been arrested so far, as told by Patil.

Rahul Dambale, a dalit youth leader who has been following the riots closely and helping the victims, said, “Prime accused Sambhaji Bhide and Milind Ekbote are roaming freely despite it being one year since the riots. Bhide, who is accused in many other riot cases, has not even been questioned, forget about arresting him. Ekbote, though arrested after the Supreme Court rejected his bail, was able to get bail due to the weak defence of Pune Rural Police in the Pune court. Now, he is a free man.”

He added, “For a year, no attackers of dalits were arrested or taken action against. But the police have, nonetheless, arrested well known activists working for the rights of dalits, tribal and other marginalised communities, and accused them of inciting the riots at Bhima Koregoan. We are feeling cheated as activists are accused of assaulting the very people for whose rights they have been fighting. The police are doing all this to save Bhide and Ekbote, under the directions of the BJP government.”

Riots Victim Found Dead
Jaidev Sakat, the brother of a dalit victim of the riots whose house was torched at Bhima Koregoan, is disappointed and angry. Puja Sakat, who witnessed a group of goons torching her house in the January 1 riots, was found dead in a well near their house four months later. Police recorded her death as accidental death but her family is sure that goons who had torched their house earlier and wanted to evacuate the family, were behind the murder.

Jaidev Sakat said, “The police inspector Ramesh Galande and Daund deputy superintendent Ganesh More who initially pursued and later threatened us not to lodge a FIR against those goons who torched our house did not face any action. Galande was transferred many months later while More is still at the same post. How can we feel secure or at peace? Our demand was that those officers should be suspended.”

Dambale pointed out that both the policemen were at the spot during the riots but didn’t take any measures to stop the right-wing procession that entered the Bhima Koregoan area and attacked dalits. He said, “More is still part of the team that has been taking various measures for security for this year’s event.”

Sidhartha Dhende, deputy mayor of Pune city, who carried out the fact finding of the riots last year in January, reiterated the same feelings. He said, “The riots were not spontaneous but pre-planned. We have already done a fact finding and handed over all the evidence and finding to the Pune Rural Police and the government, yet no action has been taken against anybody. Everybody in the Ambedkarite movement is disappointed.”

Anger and Resentment Strong, Compensation Pending
He agreed that the Pune Rural Police and administration has been working well for this year’s celebration but he said, “Why did the police not make an attempt to arrest the accused despite having evidence. And if they were keen, the police intelligence could have even sensed the riots and nipped it in the bud. The events at Vadhu Budruk in December 2017 obviously showed an indication of what was going to happen. Why hundreds of dalits are now reduced to complain that the police were standing and watching when they were being attacked on the day of riots? Their eagerness to not let the issue escalate should have been shown at that time.”

Amit Bhongale, another youth who got injured in the riots and was in Sassoon General Hospital for treatment for over four months including a month in ICU, and now has lost his hearing and walking ability partially, had to sit for a hunger strike for over 30 days in front of the collector’s office in November this year to get help. He, along with another riot victim Rama Athawale, sat on strike demanding proper compensation, but for 30 days nobody paid attention. It was only when their conditions worsened, they were promised by the collector that they would be given compensation.

Bhongale said, “Most of the riot victims are struggling to get proper compensation as most of them have lost their houses or livelihood and/or have become handicapped.”

Dambale said, “Dalits don’t want to lose hope, and helping and participating in the preparation of the event is very dear and important to us. But there is so much anger and the feeling of being cheated is just so strong.”

Reports have emerged today revealing that Manohar alias Sambhaji Bhide, a right-wing Hindutva leader from Sangli accused of inciting the Bhima Koregaon violence on January 1 in Koregaon, had been recommended for Padma Sri award by the BJP government in Maharashtra in 2016.

It appears that a ‘high-power’ committee, comprising 10 senior ministers, had recommended his name for the Padma Sri. Curiously enough, the recommendation had been made by the committee using its discretion, even though the government had not received any application for it.

The Hindustan Times report said that the relevant reports were obtained by its team from the state government’s protocol department by filing an RTI application.

SambhajiBhide is also a former RashtriyaSwyamasevakSangh (RSS) worker.

Every year, an 11-member committee comprising 10 ministers and the secretary of the protocol department, shortlists the names to be recommended for the Padma awards as state entries from the applications they received every year. The committee also has powers to recommend the names that haven’t figured in the applications they receive. The recommendations were sent to the Centre on October 12, 2015.

Coometing on this, Dalit leader and activist, Prakash Ambedkar, grandson said it was ‘intellectual bankruptcy’ on the part of the government to have done this, “Neither Congress-led government dared to arrest him, nor incumbent Fadnavis-led government can arrest him for his involvement even though his name is there in the FIR. The reasons behind it are obvious. The local police had initiated the procedure of his externment after the Sangli riots in 2008,” he said. After the BhimaKoregaon violence, Ambedkar, along with other activists had demanded for his and Milind Ekbote’s arrests. Ekbote already received anticipatory bail by the Supreme Court.

However, when the HT team contacted the committee members, they said that they didn’t feel they did anything wrong by recommending his name, infact they appreciated him for having a motive of ‘building an idealistic youth’

On the other hand, Nitin Chaugule, working president of Shiv Pratishthan Hindustan informed that Sambhaji “refused to accept the award” since it was against his principles and ‘wish’ of Shivaji and SambhajiMaharaj.

Bhide was recommended along with PopatraoPawar, medical field practitioners Dr. Anil Kumar, Dr Rumi FarduBehramji, Dr Aswhin Mehta, Dr Ragini Parekh and actors Prashant Damle and Asha Parekh.

Nomination of Bhide in the past only goes on to show the closeness of Maharashtra government with radical Hindutva outfits and its willingness to appease such people who are essentially a threat to the secular and democratic fabric of Indian society.

Mumbai cops say the presence of Bhide would have triggered fresh protests

Facing flak for allowing the prime accused of the Bhima-Koregaon clashes, Manohar Bhide to address a rally in Mumbai, the police has finally cancelled right-wing leader Bhide’s public speech, scheduled to take place in Parel this Sunday. This comes days after the police refused permission to an event organised by student outfit Chhatra Bharati, at which Dalit leader Jignesh Mewani and JNU student leader Umar Khalid were to address students at Vile Parle.

Bhide is the prime accused in the Bhima-Koregaon violence. Based on a complaint by social worker Anita Ravindra Salve, a member of the Bahujan Republican Socialist Party, the Pimpri police filed an FIR against him on Tuesday for conspiring and inciting violence.

Police said they decided to deny permission after an assessment revealed that Bhide’s presence in the city would lead to a law-and-order problem and trigger more Dalit protests. They said it would take a lot of effort to pacify protesters. They said that should Bhide make a provocative statement, it would add fuel to the fire and cause tension not just in the city, but also the state.

“As we did not want trouble, we decided to not permit the organisers to conduct the program,” an officer told the Hindustan Times. Shiv Pratishthan Hindustan, the organisation associated with Bhide, announced on Friday that his speech had been postponed, but not cancelled. It denied Bhide’s involvement in the violence, calling the case against him “false and misleading”.

In a statement issued in Sangli, Bhide denied allegations that he was involved in any violence. “The allegations of a conspiracy are completely baseless. I demand that the government investigate this matter thoroughly. Strong punishment must be given to whosoever is guilty.”“Bhide played no role in the violence. The police still approached us and said we should postpone the talk in case the speech leads anti-social and anti-Hindustan elements to take advantage of the situation and rain violence on Mumbai again. We support the government’s search for the culprits,” said Chetan Balaskar, member of Shiv Pratishthan.
Despite Salve’s assertion that Bhide was at Bhima-Koregaon on Monday, Balaskar said the right-wing leader was at his home town Sangli, which the police could attest to. He blamed Dalit leader Prakash Ambedkar for inciting the Bhima-Koregaon violence. “Those who demand Bhide’s arrest are the actual culprits.”

The Chhatra Bharati and the Aam Aadmi Party demanded a ban on Bhide. “This hate monger should not be allowed to enter Mumbai and disturb its peace. He should not be allowed to address any meetings,” said Priti Sharma Menon, spokesperson, AAP.

Mumbai Mirror had reported the deep links of Bhide (and Ekbote) with the RSS. “Though an FIR has been lodged against both Bhide and Ekbote, nobody is surprised that they have not been arrested yet. Both have deep links with the RSS and wield considerable clout within the ruling dispensation in the state and at the Centre.

In 2014, when Narendra Modi launched his campaign to become the prime minister, he visited Bhide at his house in Sangli and touched his feet. Later, at a public rally Modi declared: “I did not come to Sangli on my own, but I was given orders by Bhide Guruji to visit your city and here I am.”

“Ekbote’s entire family is associated with the RSS. He was a BJP corporator in Pune from 1997 to 2002. Denied a ticket, he fought as an independent for a second term and won. He lost the corporation election in 2007 and to stay relevant floated Hindu Ekta Manch the same year. The Manch has since been at the forefront of anti-Valentine’s Day protests. In 2014, he contested assembly elections on a Shiv Sena ticket and lost. Ekbote’s sister-in-law Jyotsna Ekbote is a sitting BJP corporator in Pune.

“Bhide has a huge fan following in Sangli, Kolhapur and Satara, especially among the youth. Fighting fit even at 85, he walks barefoot, rides a bicycle around the town, travels in state-run buses, and doesn’t own a house. An M.Sc. in nuclear physics and a gold medalist, Bhide was a professor of physics at Pune’s Fergusson College before he joined the RSS as a pracharak. In the 1980s, he floated his own organisation called Shiva Pratishthan Hindustan to spread the message the life of Shivaji Maharaj. His talks on the lives of Shivaji Maharaj and his heir Sambhaji Maharaj often brim with hatred for a minority community.

“Both Bhide and Ekbote till December 29 were not known to be anti-Dalit. Prakash Ambedkar, grandson of Dr Babasheb Ambedkar, expressed surprise at the duo’s involvement in the desecration of Gaikwad’s samadhi. In a statement issued on Tuesday, Ekbote said: “I am saddened by the inconvenience caused to Dalits due to rioting after their visit to Bhima-Koregaon and we condemn the act of rioting.” He added that his organisation considers Dr. Ambedkar and Lahuji Vastad (19th century Dalit warrior who fought against Brits) as icons and that a large number of Dalit activists are a part of Hindu Ekta Manch.
