According to a sting operation carried out by ABP News, the special observer for the Varanasi Lok Sabha constituency reportedly spent 48 hours trying to find a way to reject the nomination of dismissed Border Security Force (BSF) personnel Tej Bahadur Yadav, whom the Samajwadi Party had fielded against Prime Minister Narendra Modi in Varanasi.

Praveen Kumar, a senior IAS officer from the Tamil Nadu cadre, was appointed as special observer for the Varanasi Parliamentary seat by the Election Commission (EC). As per an ABP News report, Kumar said that he had to brainstorm for 48 hours to find out which sections under Representation of People Act, 1951 would have to be used to send notices to Yadav, News Central reported. The news channel recorded Kumar making the statement during a sting operation. “I have spent 48 hours… In the gap between first and second nomination, we checked all the rules… We didn’t neglect anything… I had discussions with the DM Returning Officer and lawyers over the phone, Election Commission… Everyone this 33 (3)… There is 33 (3) how you can accept… Go and check section 33(3) on the Internet it will be clear,” he told ABP News.

According to the report, Returning Officer Surendra Singh had issued two notices to Yadav after he had submitted his nomination papers. The first notice was related to Section 9 of the Representation of the People Act, 1951. As per this section, a central government or state government official who has been dismissed for corruption or disloyalty to the State would be disqualified from contesting elections for a period of five years from the date of such dismissal. Further, Section 9 (2) states that in such cases, a person has to obtain a certificate from the Election Commission to contest elections.

Speaking to ABP News, Yadav and his lawyer Rajesh Gupta clarified that there was no need for him to produce an Election Commission certificate as he was dismissed from the BSF for indiscipline. “I found that the rule was specifically for those who were disloyal or corrupt. Such people are meant to take a clearance from the Election Commission. I was not involved in any such thing; I put all my documents together quickly and then submitted the affidavit to the returning officer again. He accepted it,” Yadav said.

Later, the returning officer sent Yadav another notice pertaining to Section 33 (3) of Representation of the People Act, 1951. This section is related to individuals dismissed from government services. Unlike Section 9, this section does not specify “disloyalty” and “corruption” as reasons for dismissal from service.

“Where the candidate is a person who, having held any office referred to in 4[section 9] has been dismissed and a period of five years has not elapsed since the dismissal, such person shall not be deemed to be duly nominated as a candidate unless his nomination paper is accompanied by a certificate issued in the prescribed manner by the Election Commission to the effect that he has not been dismissed for corruption or disloyalty to the State,” states Section 33 (3) of RP Act, 1951.

The returning officer had asked Yadav to submit a certificate issued from the EC that he had not been dismissed for corruption or disloyalty to the state by 11 am on May 1. “He gave me the notice at 6 pm on the previous day. How was I supposed to go to Delhi and bring the certificate? My lawyer still went to Delhi and reached the Election Commission at 2 am. They didn’t allow him to enter. But, finally, he managed to enter at 11 am,” Yadav said.

Senior Election Commission Official Indra Bhushan Verma told ABP News that the observer cannot interfere in the nomination process. Similarly, Chief Election Commissioner of India OP Rawat also mentioned that “the role of an observer is to observe.”

Varanasi District Magistrate Surendra Singh had reportedly told the media that Yadav’s nomination was rejected as it failed to meet Section 9 and 33(3) of the Representation of the People Act, 1951. He had further said that Yadav was unable to submit the necessary certificate issued by EC in the stipulated time.

Yadav had alleged that the officials conspired to reject his nomination. He also underlined that the second notice was given to him only after he could furnish the relevant documents when the first notice. Special election observer Kumar’s claims on camera highlight the fact that efforts were made to stop Yadav from contesting the Lok Sabha elections against Modi.

The Supreme Court had dismissed Yadav’s plea after he had moved the court against EC’s decision to reject his nomination.

It is unclear who motivated the observer to go out of his way to reject Yadav’s nomination but fingers are being pointed at the ruling party. Even though many nominations have been rejected throughout the country, which is usual in any election, this rejection of Tej Bahadur Yadav is been monitored with intense scrutiny as he was to stand against PM Modi.

More concrete details are awaited in this developing story.

The Supreme Court has directed the Election Commission to look into the grievances of former BSF jawaan Tej Bahadur Yadav, whose nomination was recently rejected by the EC. Yadav’s nomination was significant as he is contesting against PM Narendra Modi from Varanasi.

Yadav had first filed his nomination as an independent on May 23, but filed it again on May 29 when the Samajwadi Party decided to field him as their candidate. However, the EC demanded that he produce documentation detailing reasons for his dismissal from the BSF and rejected his nomination when the said document was allegedly not produced within the time granted.

But Yadav rubbished the EC’s reasons and moved SC. On Wednesday, May 8, an SC bench headed by Chief Justice Ranjan Gogoi ordered the EC to examine Yadav’s grievance. It directed the counsel for the EC to seek instructions and apprise it by the next hearing on Thursday.

Yadav had been suspended after he posted a video online showing the poor quality of food served to BSF jawaans.

Varanasi: The Prime Minister’s constituency, Varanasi, has been a hotbed in this election, especially after the Ex-BSF soldier Tej Bahadur Yadav made public his intention to contest against Modi. The Election Commission (EC) cancelled Yadav’s nomination on Wednesday after he failed to provide additional certificates as requested by the District Electoral Officer (DEO), Surendra Singh.

Tej bahadur

Initially Yadav was to contest as an independent candidate and had filed his nomination for the same. However, three days ago, he decided to contest as a Samajwadi Party (SP) candidate for which he again submitted the required documents to the DEO. On April 30, EC sent a notice to Yadav after it found discrepancies in his nomination papers filed as an independent candidate and as a SP candidate. The EC claimed that the information related to his dismissal from the Indian Army in the two affidavits did not match for which a notice was sent to Yadav with an order to respond by May 1 or his nomination might get cancelled. Yadav failed to adhere to the deadline.

As per Section 9 of the Representation of the People Act, 1951, a person who “having held an office under the Government of India or under the Government of any State has been dismissed for corruption or for disloyalty to the State shall be disqualified for a period of five years from the date of such dismissal.” Further, as per section 33, the candidate is required to submit the additional certificates to explain his/her position. Thus, the EC said that the cancellation is legal and justified. However, Yadav was dismissed only for ‘indiscipline’ whereas section 9 clearly mentions ‘corruption or disloyalty’ as grounds for disqualification.

Yadav has accused the BJP for influencing the EC as he was fighting against Modi and had exposed the condition of the army under Modi’s regime. Yadav said, “My nomination has been rejected wrongly. On April 30, I was asked to produce the evidence. We produced the evidence, still my nomination was rejected.” He also said that he reached the Varanasi polling office at 10.50 am but was not allowed to enter.

Reportedly, a team of BJP members had visited the EC office to appeal for the cancellation of Yadav’s nomination. The team had even expressed its disapproval of giving time to Yadav to submit the additional certificates. Eventually, his nomination got cancelled. Surprisingly, BJP had fielded a court martialed candidate, SS Chouhan, from Manipuri in the 2014 Lok Sabha elections.
On June 7, 1991, Chouhan was court-martialled under sections 163 and 38 of the Army Act, 1950. After a year, the army chief acquitted him of the charges. Notably, no such affidavits are present on the EC’s website which indicates that there was no such order given to the BJP candidate, though as per section 9 it should have been ordered as he was accused of misappropriation of 27 kgs gold.
This shows the dubious stand of the ruling party and the failure of EC to perform its duty without biases.

Yadav and his lawyer Rajesh Gupta have said that they will approach the Supreme Court.

Yadav was sacked from the BSF in 2017 on the grounds of ‘indiscipline’ after he had posted a video on Facebook complaining about the unpalatable food being served to the soldiers.

In successive instances that call into question its autonomy, the Election Commission has made decisions that unquestionable benefit Prime Minister Narendra Modi. First the EC gave not one, but two clean chits to Modi for his controversial election campaign speeches in Wardha and Latur. It has also rejected applications of several people contesting against Modi from Varanasi.
Addressing a rally on April 1 in Wardha, Modi had claimed that Congress had coined the term “Hindu Terror” to defame the peace-loving Hindu community. “How can the Congress be forgiven for insulting the Hindus in front of the world? Weren’t you hurt when you heard the word ‘Hindu terror’? How can a community known for peace, brotherhood and harmony be linked with terrorism? In the thousand years of history, not a single incident shows an act of Hindu terrorism,” Modi had said.

mODI AND TEJ bAHADUR

He had also gone on to claim that the Congress was banking on Muslim votes as it was unsure of getting votes from Hindus, referring to Rahul Gandhi’s decision to contest from Wayanad without naming him, but alluding his decision to the strong presence of Muslims in the region. Modi had said, “Leaders of that party are now scared of contesting from constituencies dominated by majority (Hindu) population. That is why they are forced to take refuge in places where the majority is in a minority.” This had prompted the Congress party to file a complaint with the EC.

But the EC ruled that Modi’s words did not amount to a Code of Conduct violation. A senior EC official told The Hindu, “The matter has been examined in detail in accordance with the extant guidelines/provisions of the Model Code of Conduct, the Representation of the People Act, 1951, and the report of the Chief Electoral Officer, Maharashtra. Accordingly, Commission is of the considered view that in this matter no such violation has been noticed.”

In the second instance of a decision that went in Modi’s favour, the EC ruled that his April 9 speech in Latur where he urged first time voters to dedicate their votes to the Pulwama martyrs, was not a violation of the Election Model Code of Conduct either. Modi who was addressing an election rally had said, “I want to tell the first-time voters: can your first vote be dedicated to the veer jawans (valiant soldiers) who carried out the air strike in Pakistan. Can your first vote be dedicated to the veer shaheed (brave martyrs) of Pulwama (terror attack).”

But the EC once again ruled that this was not a poll code violation. The EC said, “The matter has been examined in detail in accordance with the extant advisories, provisions of the Model Code of Conduct…after examination of the complete transcript of speech of 11 pages, as per the certified copy sent by the Returning Officer, 40-Osmanabad parliamentary constituency, the Commission is of the considered view that in this matter no such violation of the extant advisories/provisions is attracted.”

But the final nail in the coffin of democracy came when the EC rejected the nomination applications of multiple candidates contesting the election from the Varanasi parliamentary constituency. Varanasi is the constituency of PM Narendra Modi and his opponents included former BSF jawan Tej Bahadur Yadav who was dismissed from service after he exposed the unpalatable food that BSF jawans were forced to eat. The EC rejected his nomination after he allegedly failed to get a Clearance Form from the BSF for contesting elections. The form is supposed to clarify that he was not dismissed for corruption and disloyalty to the state.”

It is noteworthy that Yadav had earlier filed nomination as an independent on April 24. At the time the EC had not made any such demand. It is only when he refiled nomination as the Samajwadi Party candidate that the EC demanded a Clearance Certificate. The demand was made at 6:15 pm on April 30 and Yadav had until 11 am the following day to submit the application. Though he did manage to submit the NOC, it is alleged that he did not do so within the stipulated time. In a statement, Returning Officer Surendra Singh Yadav said, “Shri Tej Bahadur has stated that he has been dismissed from government service on April 19, 2017. Five years has not elapsed and his nomination paper is neither accompanied by a certificate issued in the prescribed manner to the effect that he has not been dismissed for corruption or disloyalty to the state, nor he has been able to produce any such certificate by 11 am of May 1, 2019. Therefore, the nomination paper… is hereby rejected.”

Tej Bahadur will now approach the Supreme Court and the Samajwadi Party has reverted to its original choice Shalini Yadav, whose nomination remained a back-up in case something went wrong with Tej Bahadur’s application.

Meanwhile, the EC also rejected the nomination applications filed by a few independent candidates including turmeric farmers who were contesting elections from Varanasi to highlight their plight in wake of the huge agrarian crisis and absence of fair price for their crop. However, the EC insists that it is not biased and that the applications were rejected as they were either incomplete or that the applicants had failed to follow proper procedure.

A senior EC official told Firstpost, “We could not understand why so many candidates waited till the last minute to file their nominations. Nominations began to be filed from 22 April, and the last date was 29 April. If these individuals had applied earlier, then after scrutiny of their entries, they would have had the time to rectify their errors. Many of them had incomplete forms; others didn’t know they needed their proposal to be signed by 10 people. Only candidates with the backing of a political party need a proposal from just one person.”

Former BSF Soldier Tej Bahadur Yadav, who was dismissed under the Modi regime, after he complained on social media (through a video released on Facebook) about unpalatable food in 2017, is all set to contest the Lok Sabha Elections as an independent candidate from Varanasi.

Modi and Tej Bahadur

What makes the otherwise unequal battle keenly watched is that this also happens to be prime minister Narendra Modi’s constituency, too. This video here shows the clarity in his campaign.:

Aggrieved with the disrespect and ignorance of the army needs, Yadav says that only if representatives from the army reach the Legislature, will the administration pay heed to their demands. Other such candidates are even planning to contest from two other seats; one of them being against Rajnath Singh in Lucknow. But campaign expenses are the biggest hurdle. Yadav has decided to contest as an independent candidate; though he has approached many political parties for extending support to him including the Aam Aadmi Party and the Samajwadi Party, so far there are no takers.

Says Yadav, “The BJP government has failed the forces. PM Modi seeks votes in the name of jawans but has done nothing for them.” The Modi government had promised to restore pension for the BSF soldiers but there has been no progress on that as well. He has decided to contest from the same constituency as that of Modi since, in his view, the prime minister is responsible for politicising the sacrifices of the armed forces. Modi has been finally pulled up  by even the Election Commission (otherwise criticised for it’s lame duck approach towards the ruling party) for misuing the Pulwama massacre and the Balakot attacks. Earlier the ‘surgical strikes’ and ‘Uri’ figured in a spate of election meetings of the prime minister. Accused of non delivery on several counts, this desperate attempt to play on concerns of national security laced with a hatred for Pakistan as a neighbour has also been criticised. Since his days as chief minister, Gujarat, this has been Modi’s preferred election plank.

Now he has a challenger in the face of a BSF jawan. Yadav says that he will even hold his campaign one day after Modi’s campaign to make the public aware about the lies told by Modi in the name of the army to get votes and expose the real condition in which the army men are living.  He has also expressed his sharp disapproval about Yogi Adityanath’s statement ‘Modi ki Sena’ stating that the army belongs to India as a nation and not a particular political party. Further, he says, that the use of the term ‘Chowkidar’ by Modi and his party is an insult to the army; it is the army who are the real chowkidars who guard the borders.

In Varanasi therefore, this time round, it looks like a battle between the real and fake chowkidar!

Delhi High Court has agreed to hear plea seeking to trace ‘missing’ BSF Jawan, who posted video alleging that poor quality food was served to them.

The wife of a BSF jawan, who went public through the social media alleging poor quality food being served to soldiers, on Thursday filed a habeas corpus plea in the Delhi High Court claiming that her husband is untraceable and the family has been unable to contact him for last three days.

MISSING BSF JAWAN

BSF jawan Tej Bahadur Yadav had on January 9 posted a video on Facebook which showed a meal box comprising a watery soup-like dal, which he said had only turmeric and salt and a burnt chapatti.

He had said this is what jawans were served at mealtime on duty at places including the Line of Control (LoC) with Pakistan and that jawans often went to bed on empty stomach.

Pursuant to the video going viral on the social media, the Prime Minister’s Office had sought a detailed factual report on it from the Union Home Ministry and BSF.

A PIL was also filed in the Delhi High Court seeking a direction to the government to depute higher officers to supervise cooking of proper healthy food and its distribution.

Smartphone ban for Army
