Less than a month after the Jan. 6, 2021, assault on the U.S. Capitol, Secretary of Defense Lloyd J. Austin took the extraordinary step of pausing all operations for 24 hours to “address extremism in the ranks.” Pentagon officials had been shaken by service members’ prominent role in the events of Jan. 6.

Of the 884 criminal defendants charged to date with taking part in the insurrection, more than 80 were veterans. That’s almost 10% of those charged.

More remarkable, at least five of the rioters were serving in the military at the time of the assault: an active-duty Marine officer and four reservists.

Service members’ involvement in the insurrection has made the spread of extremism – particularly white nationalism – a significant issue for the U.S. military.

Solving the problem

A blue ribbon committee called the Countering Extremist Activity Working Group was quickly commissioned in April 2021 to evaluate the extent of the problem.

The group found about 100 substantiated cases of extremism in the U.S. armed forces in 2021.

The latest instance occurred in July 2022, when Francis Harker, a National Guard member with white supremacist connections, was sentenced to four years in prison for planning an anti-government attack on police. Harker, who carried a picture saying “there is no God but Hitler,” was planning to attack police officers in Virginia Beach, Virginia, with Molotov cocktails and semi-automatic rifles.

Worried, Austin has tightened the rules regarding political speech within the military. The new rules prohibit any statement that advocates for “violence to achieve goals that are political … or idealogical in nature.” The ban applies to members of the military both on and off duty.

Also, for the first time, the new rules prohibit statements on social media that “promote or otherwise endorse extremist activities.”

While the intent behind the new rules is laudable, political speech – even of an offensive or distasteful nature – goes to the core of U.S. democracy. Americans in uniform are still Americans, protected by the First Amendment and afforded the constitutional right of free speech.

In light of the stricter policy, it is useful to consider how courts apply the First Amendment in the military context.

Good order and discipline

While soldiers and sailors are certainly not excluded from the protection of the First Amendment, it is fair to say they operate under a diluted version of it.

As one federal judge observed, the “sweep of the protection is less comprehensive in the military context, given the different character of the military community and mission.”

The “right to speak out as a free American” must be balanced against “providing an effective fighting force for the defense of our Country,” a federal judge noted in a separate case.

These and other federal judges point to the military’s need for good order and discipline in justifying this approach.

While never precisely defined, good order and discipline is generally considered being obedient to orders, having respect for one’s chain of command and showing allegiance to the Constitution. Speech that “prevents the orderly accomplishment of the mission” or “promotes disloyalty and dissatisfaction” within the ranks harms good order and discipline, and can be restricted.

In 1974, for example, the Supreme Court ruled that the Army can punish an officer for encouraging subordinates to refuse to deploy.

The officer’s comments included: “The United States is wrong in being involved in the Vietnam War. I would refuse to go back to Vietnam if ordered to do so.”

In 1980, the Seventh Circuit Court of Appeals ruled that the Army could legally fire an ROTC cadet for making racist remarks during a newspaper interview.

Explaining his political philosophy, the cadet said: “What I am saying is that Blacks are obviously further behind the whites on the evolutionary scale.”

In 2012, a San Diego district court ruled that the Marine Corps can lawfully discharge a sergeant who mocked president Barack Obama while appearing on the “Chris Matthews Show.” At one point the sergeant told the host: “As an active duty Marine, I say screw Obama and I will not follow his orders.”

While each of these statements is protected by the First Amendment in civilian life, they crossed the line in military life because they were deemed harmful to morale and represented what one federal court described as more than “political discussion … at an enlisted or officers’ club.”

The military’s job is to fight, not debate

In deciding these First Amendment cases, courts often hark back to why the military exists in the first place.

“It is the primary business of armies and navies … to fight the nation’s wars should the occasion arise,” the Supreme Court said in 1955.

In a separate case, the Supreme Court declared: “An army is not a deliberate body. It is the executive arm. Its law is that of obedience.”

Quickly following orders can mark the difference between life and death in combat.

On a national level, the degree to which an army is disciplined can win or lose wars. A mindset of obedience does not come solely from classroom training but from repeated rehearsals under realistic conditions.

As a military judge observed in a 1972 decision, while service members are free to discuss political issues when off duty, the “primary function of a military organization is to execute orders, not to debate the wisdom of decisions that the Constitution entrusts” to Congress, the judiciary and the commander in chief.

New policy bans ‘liking’ extremist messages

The U.S. military’s revised approach to political speech prohibits retweeting or even “liking” messages that promote anti-government or white nationalist and other extremist groups.

Does a restriction this broad comply with legal precedent?

As a law professor who has served more than 20 years in the U.S military, I believe the broader rules will probably be upheld if challenged on First Amendment grounds.

The most comparable case is Blameuser v. Andrews, a 1980 case from the Seventh Circuit Court of Appeals where an ROTC cadet espoused white supremacist political views in a newspaper interview.

Amongst other extremist remarks, the cadet told the reporter: “You see, I believe that in the final analysis, the Nazi Socialist Party will take over America and possibly the whole world.”

Finding that the statements harmed good order and discipline, the Seventh Circuit ruled that the Army did not violate the First Amendment when it subsequently removed him from the officer training program.

The cadet’s “views on race relations draw into question his ability to obey commands, especially in a situation in which he regards the military superior as socially inferior,” the Blameuser decision said.

The military has wide latitude in deciding who is deserving of the “special trust and confidence” that comes with military employment. Military officials are free to consider political and social beliefs that are “inimical to the vital mission of the agency” in making hiring and firing decisions, the Blameuser decision said.

Social media posts expressing support for violent political activities will likely be treated in the same way.

As the Seventh Circuit said in Blameuser, by liking or retweeting an extremist message, a service member’s actions are “demonstrably incompatible with the important public office” they hold.The Conversation

The recent decision by the NFL regarding player protests and the national anthem has yet again exposed the fraught relationship between African-Americans and patriotism.

The controversy has taken place nearly a century after another time when African-Americans painfully grappled with questions concerning loyalty to the nation and the struggle for equal rights.

In July 1918, at the height of American participation in World War I, W. E. B. Du Bois, the acclaimed black scholar, activist and civil rights leader, penned arguably the most controversial editorial of his career, “Close Ranks.”

“Let us, while this war lasts, forget our special grievances and close our ranks shoulder to shoulder with our own white fellow citizens and the allied nations that are fighting for democracy,” he advised his fellow African-Americans. Du Bois acknowledged that this was
“no ordinary sacrifice,” but black people would nevertheless make it “gladly and willingly with our eyes lifted to the hills.”

Pressured from league owners, white fans and the president of the United States, black NFL players are now faced with the dilemma of closing ranks and forgetting their “special grievances,” or continuing to protest against racial injustice.

The history of African-Americans in World War I, as I have explored in my work, offers important lessons about how to confront this challenge.

The NFL, race and the national anthem

Last season, during the playing of the national anthem, dozens of NFL players kneeled, locked arms and raised their fists in protest against police and state-sanctioned violence inflicted upon African-Americans. Their actions elicited a fierce backlash, much of it fueled by President Donald Trump, who encouraged his overwhelmingly white base of supporters to boycott the NFL so long as players, in his view, continued to disrespect the flag. Seeking to avoid further controversy, on May 23, Commissioner Roger Goddell announced that for the upcoming season, “All team and league personnel on the field shall stand and show respect for the flag and the Anthem.” Not following this directive could result in teams being fined and players subject to “appropriate discipline.”

Approximately 70 percent of the players in the NFL are African-American. They have also been the most visible faces of the national anthem protests, which began in 2016 with quarterback Colin Kaepernick, who is currently unemployed and suing owners for collusion to keep him out of the league.

I see the decision by the NFL as an unmistakable attempt to police the actions of its majority black work force, impose what amounts to a loyalty oath, and enforce through intimidation and threat a narrow definition of patriotism. The message is clear: Either demonstrate unqualified devotion to the United States or be punished.

African-Americans and World War I

African-Americans confronted the same stark choice during World War I.

In previous conflicts, African-Americans had sacrificed and shed blood for the nation. But patriotism alone has never been enough to overcome white supremacy. By 1917, as the United States prepared to enter the world war, disfranchisement, Jim Crow segregation, and racial violence had rendered African-Americans citizens in name only.

Black people thus had every reason to question the legitimacy of fighting in a war that President Woodrow Wilson declared would make the world “safe for democracy.” African-Americans immediately exposed the hypocrisy of Wilson’s words, while also seizing the opportunity to hold the United States accountable to its principles. They did this, in part, by serving in the army, as some 380,000 black soldiers labored and fought to not just win the war, but to also make democracy a reality for themselves.

African-Americans also recognized the importance of protest. Discrimination and racial violence continued throughout the war, highlighted by the East St. Louis massacre in July 1917, where white mobs killed as many as 200 black people. In response, the National Association for the Advancement of Colored People organized a Silent Protest Parade in New York City, where more than 10,000 black men, women and children peacefully marched down Fifth Avenue carrying signs, one of which read, “Patriotism and loyalty presuppose protection and liberty.”

‘Closing ranks’ and the costs

Just as it does today, protesting racial injustice during the war carried risk. The federal government wielded the repressive power of American nationalism to crush disloyalty to the United States. The Espionage Act (1917) and Sedition Act (1918) severely curtailed civil liberties by criminalizing “disloyal, profane, scurrilous, or abusive language.”

“100 percent Americanism” entailed the policing of immigrant communities, restricting freedom of the press, jailing anti-war activists, and monitoring African-Americans, including W. E. B. Du Bois, for potential radicalism. This pressure, along with the personal desire to demonstrate his loyalty to the nation, compelled Du Bois to soften his critiques of the government and issue his call for African-Americans to “close ranks.”

“The words were hardly out of my mouth when strong criticism was rained upon it,” Du Bois later remembered. Even during a time of war, most African-Americans refused to set aside the “special grievances” of segregation, lynching and systemic racial abuse. And Du Bois paid a heavy price. William Monroe Trotter, the fiery newspaper editor and civil rights leader from Boston, branded Du Bois “a rank quitter,” adding that his one-time ally had “weakened, compromised, deserted the fight.”

But African-Americans, having fought for democracy, would surely be rewarded for their loyal service and patriotic sacrifices, Du Bois reasoned.

To the contrary, they were greeted with a torrent of racial violence and bloodshed that came to be known as the “Red Summer” of 1919. White people, North and South, were determined to remind black people of their place in the nation’s racial hierarchy. Race riots erupted throughout the country and the number of African-Americans lynched skyrocketed, including several black veterans still in uniform.

The NFL’s decision is essentially an attempt to appease the mob in 2018.

Echoing the backlash following World War I, the vitriolic reactions to the national anthem protests reflect what happens when African-Americans physically and symbolically challenge an understanding of patriotism rooted in white supremacy and racist ideas of black subservience. I believe the NFL has acquiesced to the threats of President Trump and the unrest of its white fan base by establishing a policy that requires black players to remain docile, obedient employees, devoid of any outward expression of racial and political consciousness, which sole purpose is to entertain and enrich their owners.

And now, the NFL wants black players to “close ranks” by giving them the false choice between standing for the pledge or hiding their protest in the locker room, conveniently out of sight of fans in the stadium and away from television cameras.

The league ignores any mention of the “special grievances” of police brutality, racial profiling and antiblack harassment that remain alive and well. Ironically, the NFL has been the one to transform the flag into a political weapon to silence black activism, protect its corporate interests and maintain a racial status quo. Displays of patriotism and loyalty to nation are meaningless when not accompanied by the actual freedoms and protections that come with being a citizen.

W. E. B. Du Bois would spend the rest of his life questioning his decision for African Americans to “close ranks” during World War I. He ultimately recognized that until America reckoned with its racist history and embraced the humanity of black people, the nation would remain deeply wounded. At the age of 90, reflecting on the questions that shaped his decades of struggle, Du Bois pondered, “How far can love for my oppressed race accord with love for the oppressing country? And when these loyalties diverge, where shall my soul find refuge?”

Like the battlefields of France 100 years ago, the football fields of NFL stadiums are just one place where African-Americans have historically sought to answer these questions. And simply closing ranks has never been sufficient. In this moment of racial repression and moral mendacity, when the ideals of democracy are undermined daily, the debate over national anthem protests reminds us that the fight to affirm the sanctity of black life is much longer and deeper than a Sunday afternoon game.

The world needs a miracle. The Iraqi people need a miracle. There is a new plan to bring about this miracle and we need everyone’s help! We need to ask some very high profile people to go to Baghdad and stay there until the threat of war is withdrawn (meaning the troops leave the Persian Gulf).

An appeal from Dr. Helen Caldicott

I write this appeal for your help as a paediatri
cian, a mother and a grandmother — and I am writing about the lives of tens of thousands of children. Although the current administration has demonstrated it has no reservations about slaughtering up to 500,000 innocents in Iraq, there is one person whose life they absolutely will not risk.

That person is Pope John Paul II. While the Pope has already formally denounced the proposed war, calling it a defeat for humanity, as well as sent his top spokesperson to meet with Saddam Hussein, he now must take a historically unprecedented action of his own and travel to Baghdad.

The Pope’s physical presence in Iraq will act as the ultimate human shield, during which time leaders of the world’s nations can commit themselves to identifying and implementing a peaceful solution to this war that the world’s majority clearly does not support.

To persuade the Holy Father to take this unusual but potent action, he must hear from you and millions of others around the world who have already been inspired to stand up and speak out for peace. A mountain of e-mail, faxes and phone calls are our devices to inspire him. Please understand that your taking just a few minutes right now to communicate with him may ultimately spare the lives of thousands of innocent people who at this moment live in complete terror from the threat of an imminent U.S.-lead military strike on their homeland. So here is what you can do to be a part of this powerful final action to stop the march to war in Iraq.

It seems clear that, at this time, you are the only person on Earth who can stop this war.

Indeed, your physical presence in Baghdad, will prevent the impending slaughter of hundreds of thousands of human beings, and force the international community to find and implement a peaceful way to prevent this unprecedented, pre–emptive aggression.

We implore your Holiness to travel to Baghdad and to remain there until a peaceful solution to this crisis has been reached. The lives of the people of Iraq rest in your hands as does the fate of the world.
