“We will not allow the number of deaths to go up from 36 to 37 or 38. Not one more will die,” Chief Justice of India H.L. Dattu was quoted saying in July 2015 when the Supreme Court directed that all cases linked to the Vyapam scam be transferred to the Central Bureau of Investigation (CBI).

Investigations have been dragging on with since then. On October 31, one result of the investigation was revealed: the CBI gave a clean chit to Madhya Pradesh Chief Minister Shivraj Singh Chouhan, who was earlier accused of being “directly involved” in it. Earlier, on October 15, the CBI had ruled out any conspiracy in the 24 deaths linked to the scam. Reportedly , the CBI said that the deaths took place either from natural causes, accidents or suicides before the scam surfaced, or they were because of genuine reasons after the scam. Thus, the probe into all these mysterious deaths stands closed except the one in to medical student Namrata Damor’s death. 

With these preliminary reports submitted by the CBI, certain questions essential to the Vyapam scam seem to be left unanswered by the investigative agency.

Charges of irregularities in the official examinations conducted by the state-owned Madhya Pradesh Professional Examination Board (Vyavsayik Pariksha Mandal – Vyapam) date back to 1995, when initial cases were filed in various police stations in Madhya Pradesh. State govt. officials used to take bribes to get applicants to clear the Vyapam exams and secure govt. appointments. It was estimated that more than Rs 1000 crore was transferred as bribes between 2009 and 2013. A Special Investigative Team lodged a number of cases in 2013 for corrupt admissions and recruitments related to Vyapam. It was also alleged that over the years, various people – students, doctors, journalists and civil servants had died suspiciously because they were either involved or associated with the Vyapam cases while many whistleblowers and investigating officials were threatened. Although the Madhya Pradesh Police put the number of deaths to be 24, Congress party in the state claims that the deaths due to the scam were 46.

Shivraj Singh Chouhan has been the Chief Minister of Madhya Pradesh since November 30, 2005. He also held the Medical Education portfolio from December 2008 to March 2012. In 2012, whistle-blower Ashish Chaturvedi, accused Chouhan of direct involvement in Vyapam. With his Right To Information applications, he found that Chief Minister Chouhan had misled the Vidhan Sabha about issuing orders on sending certain documents for the forensic test in relation to Vyapam which he actually did not.
The main accusation against Chouhan was that he was part of the scam, and involved in fixing recruitments. The crucial evidence for this arose from a hard drive belonging to Nitin Mohindra, a Vyapam official (one of the main accused) which was alleged to contain Chouhan’s name and other details. However, it was later alleged that the hard drive had been tampered with by police officials and details of CM had been removed from it.

Whistle-blower Prashant Pandey, a cyber-security expert, who had earlier helped the Madhya Pradesh Police in Vyapam scam investigation during 2014, reportedly had a copy of Nitin Mohindra’s hard drive in which CM Chouhan’s role in the scam is evident. Although, in its charge sheet before a special CBI court, the CBI denied the allegations of “tampering” with the hard drive.

Another pending issue is the unsolved murder of Namrata Damor. Bafflingly, the police insisted that she had flung herself from a moving train. However it soon emerged that the Madhya Pradesh police had ended their investigation into Namrata Damor’s death on the basis of a second postmortem report, prepared by a doctor who later admitted that he had not examined the body and had based his findings solely on photographs provided by the police. 

Earlier this year, a Comptroller and Auditor General (CAG) report had accused the Madhya Pradesh state government of allowing the Vyapam board to function in a “nebulous atmosphere” with irregular appointments and violation of many rules between 2005- 2015.

Though the CBI has chargesheeted 490 people in the scam including Nitin Mohindra, events unfolding slowly seem to indicate that the truth is yet to emerge from behind the veil cast over it by the powerful accused. Is the freeing of Chouhan from involvement the beginning of the end?

The recently released Comptroller and Auditor General (CAG) report has rapped the state government over Vyapam scam.

"I have written a letter to PM and urged that Shivraj Singh Chouhan should be removed from the post of chief minister as Vyapam scam took shape during his tenure. The CAG too has rapped the state government over it," Singh told reporters here today.

The CAG has passed strictures against the Madhya Pradesh government for "systematic subversion of rules" in appointment of director and controller of the scam-tainted Professional Examination Board (also known by its Hindi name -Vyapam).

Singh alleged that 53 persons died and 55 FIRs were registered in connection with the scam. Nearly 2,500 persons were facing investigation by various agencies including the CBI. Now, CAG has highlighted irregularities in it.

Besides, 2,100 persons were arrested in connection of this massive admission and recruitment racket, he said.

"All this (Vyapam scam) transpired during the tenure of Chouhan as CM. He was incharge of the states medical education department when this scam occurred. The CM himself has admitted to the irregularities in 1,378 appointments made through Vyapam," he said. Leader of Opposition said, "Surprisingly, none of the investigating agency summoned the chief minister to get details about the scam.

"When former Prime Minister Manmohan Singh can be summoned on ground of being incharge of coal ministry, why a chief minister cant be examined."

Singh said, earlier, two chief ministers of Madhya Pradesh — Uma Bharti and Babulal Gaur were removed from their post by the top BJP leadership when charges were not even related to corruption.

The unfettered lawlessness and anarchy that the incident has brought to fore is not an exception but reflective of the larger state of affairs in the state that I have made my home. It speaks of media’s biases and its collusion with the ruling party because of which the rampant Jungle Raj prevailing in MP has not been made known to the nation.

But given the upsurge in media’s attention, now is an opportune time to put spotlight on incidents that make clear the pervasiveness of the Jungle Raj in MP.

So below we discuss some of these incidents exploring why they should worry us all;

The Bhopal Jail Break and Extra Judicial Killings
The ease with which the 8 SIMI activist escaped from what is supposed to be a highly secured Central Jail, reveals the sheer incompetence of Shivraj Singh Chouhan government. The Jail’s CCTV were not working, the guards were not following even the most basic of safeguards and even after the alleged break, it was not guards who detected the ‘escape’ but nearby villagers. Such incompetence can be acceptable in the lawless Sub Saharan countries, but how can any state in a nation which aspires to be super power, tolerate this? One can imagine that if the Shivraj government can’t even secure a high security Jail, what chance does it have of securing the people who voted him to power for three terms in a row?

But if the government’s incompetence in securing Jail was disturbing, the on camera killing of these undertrials was beyond shocking. The video clearly showed that the policemen shooting unarmed accused lying injured. These killers in uniform, aware of the support they enjoy from top BJP brass, were so confident of the fact that nobody could touch them, that they had no fear filming their act of murders. When the protectors of law themselves start breaking the law with such brazenness and impunity, what hope can there be for rule of law in such a state?

Vyapam Scam
In the history of India, few scams can rival the Vyapam scam in terms of how pervasive it was, how many people lost their lives due to it and how long lasting its effect were. For nearly a decade, the entire medical entrance examination system in MP was manipulated to ensure only those who could shell out bribes or had connection would get medical seats.

Thus many of nearly a generation of doctors in MP are going to be people who have became doctors not on their merit but by baying bribes. Millions of students’ lives and dreams were trampled by the BJP regime which is accused to have received thousands of crores in bribe to sell medical seats. Many top ministers, bureaucrats and RSS leaders are allegedly behind this mammoth scam. This CM himself handled concerned portfolio for some of the period of the scam and slept over the complaints of irregularity when he was made aware.

Perhaps because of the large number of such high and mighty from BJP regime, which is essentially behind this scam, anyone who could provide evidence regarding the scam was bumped off.

Over 40 people related to the scam have died mysteriously. But apart from a brief period of coverage, the scam has largely gone uncovered in the national media. Because media coverage has dropped, CBI which reports to BJP’s regime at the Centre is quietly busy burying one of the most gruesome scams without much protest.

Hounding police officers for acting against RSS leaders
While the above cases reveal how blatantly corrupt, incompetent and criminal the Shivraj government is, a recent hounding of Muslim police officer by the government for acting against RSS leader shows how anti minorities and discriminatory it is.

In the month of September when Balaghat district’s Baihar police station in-charge Zia-ul-Haque arrested a RSS pracharak for Anti Islam post, he couldn’t have predicted what lay in store for him.

The RSS created a furore of sorts alleging that its prachark has been assaulted in cell, shut down the whole district, the week M.P government scrambled to appease RSS. The whole police machinery was penalised with IG and SP being transferred and 7 policemen being booked under serious charges such as attempts to murder. The policemen are on the run and the message has been sent loud and clear that RSS people are not to be touched, they are above the law and the police is not to act on any anti-minority activity that RSS indulges in.

The victimisation of police in this case reveals how opportunistic and hypocritical BJP is when in the Bhopal shootout, it wants no one to even question the police. So in MP if policemen acts against RSS, they are not just questioned but also hounded, but if anyone other than BJP loyalist has a complaint with police, they are declared anti national.

In conclusion, one hopes that the dark state of affairs in Madhya Pradesh under BJP regime are at least now given the attention they deserve. While it is fashionable to talk about Jungle Raj in Bihar, there is Jungle Raj at the heart of India that no body talks about. It’s high time BJP was made to answer for this utter lawlessness in Madhya Pradesh, before it talks about Jungle Raj in Bihar or anywhere else.

सेना के जवान के निर्दोष पिता अखलाक के लिये एक दिया ज़रूर जलाइयेगा ,
जिसे फ़र्जी खबर फैला कर भाजपाइयों ने घर में घुस कर मार दिया ,
दो दीपक झारखण्ड में फांसी पर लटका दिये गये दो मुस्लिम देशवासियों के लिये ,
जिनमे से एक की उम्र सिर्फ चौदह साल थी ,

दीपकों में थोड़ा तेल गुजरात के उन दलित देशवासियों के नाम पर ज़रूर डालना जिन्हें पुलिस थाने के सामने बांध कर जानवरों की तरह पीटा गया ,
एक सौ बारह दीपक उन एक सौ बारह निर्दोष आदिवासियों के नाम पर जिन्हें इसी साल मार डाला गया राष्ट्रीय सुरक्षा सलाहकार अजीत दोभाल के आदेश पर छत्तीसगढ़ में ,
पांच दीपक बड़कागांव में गोली से उड़ा दिये गये पांच लोगों के नाम पर जिन्हें इसलिये मार डाला गया ,
क्योंकि उनकी जमीनों के नीचे कोयला है ,
एक दीपक उस मुस्लिम लड़के के नाम जिसे झारखण्ड में थाने में पीट पीट कर मार डाला गया सिर्फ इसलिये क्योंकि उसने मुसलमान होने के बावजूद व्हाट्सएप पर अपने भोजन की प्राथमिकता बताने की ज़ुर्रत करी थी,

एक दीप नजीब के नाम , जिसे सत्ता दल के गुण्डों ने जेएनयू में पीटा और गायब कर दिया और जिसकी मां की चीखें ढ़ोंगी राष्ट्रभक्तों के शोर शराबे में दबाई जा रही है आज भी,

दो दीपक बस्तर के दो आदिवासी छात्रों के नाम पर, जिन्हें घर से निकाल कर महज़ इसलिये गोली से उड़ा दिया गया, ताकि पुलिस का ख़ौफ क़ायम रहे आदिवासियों के दिलों में ,
अट्ठावन दीपक बस्तर की उन अट्ठावन आदिवासी औरतों के नाम पर जिनके साथ भाजपा सरकार नें सुरक्षा बल के जवानों से इसलिये बलात्कार करवाये जिससे आदिवासी अडानी के लिये ज़मीन छोड़ कर भाग जायें ,
एक दीपक, मड़कम हिड़मे के नाम जिसके साथ भाजपा शासन में सैनिकों द्वारा बलात्कार के बाद योनी में चाकू डाल कर नाभी तक चीर दिया गया , ताकि भाजपा को चन्दा मिलता रहे अमीर उद्योगपतियों से, आदिवासियों की जमीनों पर कब्ज़े के बदले,

एक दिया खुद के नाम पर ताकि भीतर की साम्प्रदायिकता , घोर घृणा और अनंत लोभ का अंधेरा छंट कर इंसानियत की रोशनी आप तक आ सके

जनवरी 2009 में एमपीपीएससी ने उच्च शिक्षा विभाग में प्रोफेसरों की भर्ती के लिए 385 पदों का विज्ञापन जारी किया था। इसके तहत प्रोफेसर पद पर सीधे साक्षात्कार के माध्यम से नियुक्ति की जानी थी। वर्ष 2011 के मध्य में यह प्रक्रिया पूरी हुई थी। भर्ती को लेकर समय-समय पर कई शिकायतें होती रहीं जिनको देखते हुए उच्च शिक्षा विभाग में आयुक्त कार्यालय द्वारा एक चार सदस्यीय जांच समिति का गठन किया गया था। उसी समिति ने हाल में अपनी रिपोर्ट राज्य सरकार को सौंपी है।
 
जांच समिति ने भर्ती प्रक्रिया में गड़बड़ी से जुड़े कई मुद्दे उठाए हैं। जांच समिति ने कहा है कि आयोग द्वारा विज्ञापन जारी होने तथा चयन हेतु साक्षात्कार पूरा करने के बाद अनुभव के बारे में जो स्पष्टीकरण जारी किया गया वह पूरी तरह नियम के विरुद्ध है। जांच समिति ने कहा कि भर्ती प्रक्रिया के लिए साक्षात्कार होने के बाद अगस्त, 2011 में विज्ञापन में संशोधन जारी किया गया। नियमानुसार यदि संशोधन करना आवश्यक था तो पूरी प्रक्रिया निरस्त कर फिर से आवेदन मंगाए जाने थे लेकिन ऐसा नहीं किया गया।

जांच समिति ने कहा कि उच्च शिक्षा विभाग के भर्ती नियमों के मुताबिक अनुभव योग्यताएं, जो पारंपरिक रूप से पदोन्नति के लिए भी स्वीकार की जाती हैं, से अलग योग्यताओं की व्याख्या या स्पष्टीकरण लोक सेवा आयोग द्वारा जारी किया गया। इससे स्पष्ट है कि चयन में भर्ती के लिए अलग मापदंड अपनाए गए। विज्ञापन जारी करते समय अनुभव योग्यताओं को स्पष्ट न किए जाने से बहुत से संभावित उम्मीदवारों को मौका नहीं मिल पाया।

जांच समिति ने रिपोर्ट में बताया कि सरकारी कॉलेजों में कार्यरत उम्मीदवारों द्वारा प्रस्तुत अनुभव प्रमाण पत्रों के अलावा जो अनुभव प्रमाण पत्र प्राप्त हुए हैं वे प्रारंभिक रूप से संदेहास्पद लगते हैं। अनुभव प्रमाण पत्रों की सत्यता की जांच सरकारी विश्वविद्यालय या कॉलेज से नहीं कराई गई। इसके अलावा उनकी पुष्टि के लिए संबंधित दस्तावेज भी उपलब्ध नहीं कराए गए हैं।
 
रिपोर्ट के अनुसार अनुदान प्राप्त संस्थाओं में नियुक्तियों का अनुमोदन उच्च शिक्षा आयुक्त द्वारा किया जाता है। इन संस्थाओं में काम करने से संबंधित कई अनुभव प्रमाण पत्रों के साथ इस तरह के अनुमोदन का कोई भी प्रमाण उपलब्ध नहीं हैं। आयोग द्वारा आठ अगस्त, 2011 को जारी स्पष्टीकरण में बताया गया कि केवल सरकारी और अनुदान प्राप्त गैर-सरकारी संस्थाओं का ही अनुभव मान्य होगा। अनुदान प्राप्त न करने वाली गैर-सरकारी संस्थाओं का अनुभव मान्य नहीं होगा लेकिन नियुक्ति में इस तरह के अनुभव भी मान्य किए गए हैं।

जांच समिति ने सवाल उठाया कि जिस विषय में पीएचडी नहीं है उसमें चयन न होकर किसी अन्य विषय में चयन किया गया। कुछ उम्मीदवारों का चयन पहले हुआ, पीएचडी की डिग्री उन्हें बाद में मिली। कुछ ऐसे उम्मीदवारों का चयन भी हुआ जिन्होंने स्कूल के संविदा शिक्षक के अनुभव का प्रमाण पत्र आवेदन में लगाया था। विश्वविद्यालय अनुदान आयोग (यूजीसी) के दिशा-निर्देश के अनुसार प्रोफेसर पद के लिए चार साल का स्नातकोत्तर कक्षाओं में पढ़ाने का अनुभव अनिवार्य है। आयोग की इस भर्ती प्रक्रिया में इस नियम को सिरे से नकारा गया है।
 
आपको बता दें कि एक बार चयन प्रक्रिया शुरू होने के बाद शर्तों में किसी तरह के बदलाव नहीं होते। अगर ऐसा करना अनिवार्य हो तो पहले के आवेदनों को रद्द कर दोबारा आवेदन मंगाए जाते हैं। उच्च शिक्षण संस्थानों में नियुक्ति की पूरी कार्रवाई आयोग द्वारा संपन्न की गई और अनुभव प्रमाण पत्रों की जांच भी आयोग द्वारा ही की गई थी। आयोग द्वारा प्रस्तुत सूची के आधार पर उच्च शिक्षा विभाग ने चयनित उम्मीदवारों की नियुक्तियां की थीं। दरअसल यह पहली बार नहीं है जब मध्य प्रदेश लोक सेवा आयोग पर सवाल उठे हों। इसके पहले भी परीक्षाओं के पेपर लीक मामले में आयोग संदेह के घेरे में आ चुका है। वर्ष 2012 में आयोग द्वारा आयोजित एक परीक्षा का पेपर लीक होने के बाद पूरी परीक्षा रद्द करनी पड़ी थी।

संदेह की सुई राष्ट्रीय स्वयंसेवक संघ की तरफ भी उठ रही है। जिस समय यह भर्ती प्रक्रिया चली उस दौरान प्रोफेसर पीके जोशी मध्य प्रदेश लोक सेवा आयोग के अध्यक्ष थे। उनका कार्यकाल 13 जून 2006 से 28 सिंतबर, 2011 तक था। आयोग के तत्कालीन अध्यक्ष को राष्ट्रीय स्वयंसेवक संघ की पृष्ठभूमि का माना जाता है। उच्च शिक्षा विभाग के सूत्र नाम न बताने की शर्त पर जानकारी देते हैं कि चयनित कई उम्मीदवार भी संघ की पृष्ठभूमि से जुड़े हैं। इससे पहले व्यापम घोटाले में भी संघ से संबंधित लोगों के नाम आए थे। संघ के उच्च पदाधिकारियों पर आरोप लगे थे कि कई चयन उनकी सिफारिश के आधार पर हुए हैं।

MP व्यापम में जब 50 से ज़्यादा शहीद हो गए तो इस मामले को खोलने वाले आशीष चतुर्वेदी को सुरक्षा दे दी गई। सबसे अच्छी बात है कि सिपाही रहमदिल हुआ तो बीच बीच में साइकिल पर आशीष को बिठा भी लेता है। ज़्यादातर समय आशीष ही चलाते हैं। सुरक्षा के लिए एक डंडा साथ होता है।
