Former Union Finance Minister Yashwant Sinha on Monday criticized the Citizenship Amendment Act (CAA) saying that it was against the basic structure of the Constitution and that there was no need for the law as the government already had the power to grant citizenship, The Times of India reported.

Speaking to reporters in Lucknow, Sinha who is currently on a 3000-km long Gandhi Shanti March said, “The move is an attempt to divide the society on a religious basis and take the country back to the pre-1947 era.” He also attacked the BJP saying that the “language used in the law” would make it difficult for the law would be implemented. He said, “May be their intention is not to implement it but to mislead people.”

Saying that the government’s move had eroded India’s image as a developing democracy. “European Union Parliament has brought in a resolution against CAA. I am against this step but the government will have to be accountable for denting India’s image in the world,” adding that immigration was a global problem and not just India’s issue.

He said, “Singer Adnan Sami was granted citizenship under the old citizenship law and was also conferred with the Padma award. Sonia Gandhi and Bade Ghulam Ali had also acquired Indian citizenship under the same manner. There was no need to amend the law and give a religious colour to it.”

He also said that relations between Bangladesh and India had soured after the CAA had come into force. “There is a constitutional crisis as the Centre is ignoring state governments which are passing anti-CAA resolutions. The country is also facing social unrest and chaos but instead of reaching out to protestors, the government is suppressing their voice,” he said.

He also spoke about the violence that ensued in Uttar Pradesh all through the CAA protests. “Uttar Pradesh has become the epicenter of violence during the anti-CAA protests. People are staging a dharna peacefully but their blankets and quilts are being snatched and they are being arrested. Is this not terrorism?” he asked.

The former member of the BJP and an ardent critic of Narendra Modi and his government’s policies said that the government had earlier given in to the demands of the people and would have to listen to the public this time around too.

Terming the government and the statements of its ministers as desperate, he said, “The government wants to divert people’s attention from issues like lawlessness, unemployment and suicides by farmers which have taken a backseat.”

“Unfortunately, the middle ground has been completed wiped out in Kashmir and I don’t know what the way forward is,” Sinha said in an exclusive chat with TwoCircles.net before his group left the Valley on Monday evening.

Sinha said that he fears that Government’s use of force will invite retaliation from the people of Kashmir. “I only hope that that will not happen. My urgent plea to the people of Kashmir is to not take that route,” he said.

Sinha arrived in the summer capital Srinagar on Friday as part of “Concerned Citizens’ Group” (CCG) to assess the ground situation in the region.

Other members of the group include former Chief Information Commissioner Wajahat Habibullah, former Air Vice Marshal Kapil Kak, journalist Bharat Bhushan and activist Sushoba Bharve.

Sinha was earlier not allowed to visit Kashmir in September and was sent back to New Delhi from Srinagar Airport. This time they were allowed to visit but were confined to the hotel.

“Once we reached our hotel in Srinagar we realised we are being confined here. We wanted to go to Pulwama and we were told in writing that there is an impending terrorist threat the next day. We intended to visit Shopian but we were not allowed again. They (Security agencies) would write names of people who came to meet us on reception; they would monitor our every action,” Sinha said, adding that they have been under heavy security cover here in the hotel. 

Sinha said that they are feeling disappointed as they were confined to Srinagar district only by the security agencies who cited militancy issues for them not to visit any other area of Kashmir. 

He said they couldn’t meet the persons they intended to gauge the situation at ground level.  

Soon after their arrival, the group met several delegations of traders and businessmen. According to reports, they also interacted with representatives of civil society groups and the Kashmiri Pandit community at a local hotel.

Sinha said the silence of Kashmiris after August 5 is having a tremendous impact. “People have not taken to violence, which is already having an impact. Barring a few incidents of violence, there has been no large-scale violence and the credit for that goes to the people of Kashmir, not the Government of India,” the former finance minister said.

Sinha urged that non-violence has more power than violence. “With the number of boots on the ground here, there is no way violence will be allowed to succeed. But non-violence will succeed,” he said.

Sinha said despite being barred from going outside his group met several delegations from South to Central Kashmir. “Everyone is extremely unhappy. There is an atmosphere of fear here. Nobody knows how the future is going to turn out,” Sinha said. He added that Kashmiris have suffered enormous economic and financial loss post the abrogation of Article 370.

“Trade, transport and tourism have been affected. Fruit traders have been severely affected due to early snowfalls. Even if the shops are open, many people don’t have money to buy goods,” he said after meeting with several delegations. 

Sinha further said his group had visited Kashmir many times in the past, but this was the first time they were barred from travelling freely. 

“I think the only reason could be that they (Government) don’t want us to see the ground reality. If we would have been allowed to travel around the valley, we could have understood the ground situation. But many people from the south Kashmir came to talk to us when they learned that we are here,” he added. 

He further said that they have been pleading for the beginning of a dialogue process for years.

“We are having a dialogue at the civil society level but it doesn’t help. It the government of India which must engage people here and be part of the dialogue process,” he said.

He further asserted that he doesn’t know whether their visit will have a positive impact in the long run or not. But he added he will try to inform Indians about the situation in Kashmir.

“Our visit was for the people of Kashmir to show them that there are people in India who are concerned with their plight and therefore we came here,” he said. “Many people have written about the situation in Kashmir, but the atmosphere of fear that prevails here is also prevailing in the rest of the country,” he added. 

Sinha added that the militarization that has taken place in Kashmir since August 5 is far greater than ever in the past. “This is the most disturbing aspect of the present situation in Kashmir,” he added.

Former Finance Minister Yashwant Sinha has once again lashed out at Prime Minister Narendra Modi, this time for the 2016 demonetization, which he calls a ‘scam worth several crores.’

Speaking at the election campaign of the Samajwadi Party’s Lucknow candidate, Poonam Sinha, Yashwant said, “The questions is, why is Prime Minister Narendra Modi not talking about demonetization (in his poll campaigns) which, according to him, was the decision of the century? Why is he not mentioning demonetization in his poll speeches? It was a scam worth more than several lakh crores and I would like to request the new government to investigate this matter as soon as they form the government.”

Further taking a dig at the Modi government for forging the economic data, Yashwant said, “Neither our Prime Minister nor the finance minister (Arun Jaitley) know anything about the economy. The figures released in the public are fudged and false. The figures which are not in favour of the government are simply fudged by the NITI Ayog. This should also be investigated by the new government and actual figures should be released so that the people of the country can be aware of the actual situation of our economy.”

Yashwant has been a vocal critic of Modi and BJP since the time he left the party last year.  Even in his book ‘India Unmade’, Sinha accused the Modi government of destabilizing the economy with the note ban. He said, “If one were to look at the context in which demonetization was done, you will recall we first came out with Jan Dhan Yojana and crores of accounts were created under the pretext of empowering the poorest of the poor by opening their bank accounts. This was in place and suddenly demonetization came. The entire currency came back largely through Jan Dhan accounts.”

Yashwant has also targeted Modi for latter’s repeated reference to Pakistan in his election speeches. He further asked why wasn’t Modi talking about China. “Modi’s 56-inch chest is only for Pakistan and it shrinks to six inches when the Chinese threat is mentioned,” said Yashwant, criticising Modi’s foreign policy.

“By invoking Pakistan all the time, PM Modi has made the mistake of hyphenating the two nations once again,” warned the former bureaucrat-turned-politician

Yashwant claimed the government would leave the country’s economy in shambles and the new dispensation would have a lot to do, including bringing out a white paper on economic conditions, demonetization, GST and others.

Criticizing the low level of language in political discourse, Yashwant said Modi was primarily responsible for this.

In a damning indictment of Modinomics and the present government’s modus operandi, former Finance Minister Yashwant Sinha, a stalwart of the Bharatiya Janata Party (BJP), has penned a scathing, wide-ranging editorial seemingly addresed to current BJP members of Parliament (MPs). In the editorial that appeared in The Indian Express, Sinha systematically outlines the various failings of the current central government and Prime Minister Narendra Modi, painting a picture of the government as “helpless,” and seemingly out of time.

Sinha recalls the optimism with which he and others worked for the BJP’s 2014 Lok Sabha victory, saying that after nearly four years in office and five budgets having been presented, Sinha says, “…we seem to have lost our way and the confidence of the voters.” 

 
In his frank letter, he roundly criticises the government’s seemingly toothless foreign policy, saying “The sum total of our foreign policy seems to consist of frequent foreign visits by the prime minister and his hugging foreign dignitaries, whether they like it or not. It is completely devoid of substance and has failed miserably even in our immediate neighbourhood, where China is trampling all over our interests.” 
 
He also calls out the government’s failing economic policies, and what can be construed as its indifference to crimes committed against women, minorities, and marginalised sections of society.

Sinha who has considerable experience steering India’s economy, underscores the “grim” economic condition of the country, “despite tall claims to the contrary by the government that we are the world’s fastest growing economy.” As Sinha says, “A fast growing economy does not accumulate the kind of non-performing assets in its banks, as we have done over the last four years. In a fast growing economy the farmers are not in distress, the youth are not without jobs, small businesses do not stand destroyed and savings and investment do not fall as drastically as they have done over the last four years. What is worse, corruption has raised its ugly head again and banking scams are tumbling out of the closet one after another. The scamsters also manage to run away from the country somehow, as the government watches helplessly.” 

Sinha further rakes the Modi government over the coals for failing to ensure a safe environment for women in the country. He writes, “Women are more unsafe today than ever before. Rapes have become the order of the day and instead of acting strictly against the rapists we have become their apologists. In many cases, our own people are involved in these heinous crimes.” He also laments the situations of the Scheduled Castes and Scheduled Tribes, who he says “have been exposed to atrocities and inequities as never before,” with constitutional guarantees given to them under threat.

Sinha pulls no punches when he criticises the inner workings of the BJP, saying “MPs do not get an opportunity, as in the past, to air their views. In the other party meetings, also, the communication is always one-way. They speak and you listen. The prime minister has no time for you. The party headquarter has become a corporate office where it is impossible to meet the CEO.” 

Significantly, Sinha highlights the threat to democracy as the “most important” one that “has emerged over the last four years,” saying that democratic institutions “have been demeaned and denigrated,” adding that Parliament “has been reduced to the level of a joke.” He criticises Modi for not bothering to discuss the disrupted Budget Session with Opposition leaders, saying that Modi then “fasted to shift the blame to others.” In contrast, Sinha says, during Prime Minister Atal Bihari Vajpayee’s tenure, they were “under strict instructions to accommodate the Opposition and ensure that Parliament functioned.” 

 

Sinha also recalls January’s press conference by four senior Supreme Court justices, calling it “unprecedented” and indicative of “the rot that has been allowed to afflict the highest judicial institution of our country.” Even the judges have repeatedly noted that democracy is being threatened, Sinha notes.

Sinha says that it seems as though party’s only objective has become “winning elections by controlling the means of communication, specially the media and social media”. In a dire prediction, he says that “previous experience” indicates that half the current BJP MPs will not get the ticket for the upcoming Lok Sabha elections in 2019, noting that in 2014, 69% “polled against” the BJP. “So, if the opposition unites, you will be nowhere,” Sinha notes, darkly.

Sinha urges other BJP MPs to follow the lead of the Scheduled Caste MPs who have spoken about their disappointment with the government for failing to come through on its pledges to their community. He reminds them of the fact that the interests of country take precedence over the party, just as the party takes precedence over the individual.

Noises within BJP circles regarding the Modi government’s handling of the economy have exploded out in the open with former Union Finance Minister Yashwant Sinha slamming the functioning of the Finance Ministry under Arun Jaitley.

“The prime minister claims that he has seen poverty from close quarters. His finance minister is working over-time to make sure that all Indians also see it from equally close quarters”, wrote Sinha in a hard-hitting opinion piece in The Indian Express.

Industry, agriculture, construction and services have slowed down and exports have dwindled, said Sinha. Demonetisation “has proved to be an unmitigated economic disaster”, while “a badly conceived and poorly implemented GST has played havoc with businesses and sunk many of them and countless millions have lost their jobs with hardly any new opportunities coming the way of the new entrants to the labour market.”

The methodology for the calculation of GDP had been changed by the BJP government in 2015, after which the growth rate recorded earlier increased statistically by more than 2 per cent. “So, according to the old method of calculation, the growth rate of 5.7 per cent is actually 3.7 per cent or less”, wrote Sinha.

BJP leader Subramanian Swamy has been continuously attacking Jaitley on Twitter, while former BJP minister Arun Shourie had also come out against the Finance Minister’s handling of the economy.

Yashwant Sinha sought to blame “the heavy burden of so many extra responsibilities” that Jaitley had to bear for the state of the economy.

But long-time observers point out that the problems run much deeper. Economist Prabhat Patnaik pointed out in a recent article that the looming recession in India is a product of three factors: the world crisis being imported into the domestic economy, the demonetisation measure whose effects continue to linger, and the Goods and Services Tax (GST) which has suddenly readjusted tax-burdens in a manner detrimental to small producers and traders.

­Patnaik, who was the among the earliest to predict the recessionary impact of demonetisation, said in a recent interview that demonetisation added to a recessionary tendency that has existed for some time because of the world capitalist crisis. While it had appeared for a while that countries like India and China were insulated against the impact of the crisis, that is no longer the case. It is known for some time that the crisis was beginning to hit them.

Investment, net exports and government expenditure have all been showing symptoms of slowing down. Government expenditure increased recently due to the Pay Commission recommendations, but that kind of stimulus will not be there all the time and once its impact wanes, the recession would become much more pronounced. That is what is happening now, said Patnaik. Demonetisation has added to the recessionary tendency, as the informal sector in particular was adversely affected.

Share of Exports in GDP Touch 14-Year Low; GST Collections Down
Figures for the first quarter of the 2017-18 financial year bring out the sluggishness in export growth. While GDP growth in the April-June 2017 quarter – at 5.7 per cent – was more than two per cent lower than in the corresponding period last year, the share of exports in India’s GDP declined to a 14-year old low in the same quarter, Business Standard reported . Export growth in the quarter was a mere 1.2 per cent at constant prices. Export of goods and services accounted for 19.4 per cent of the GDP at constant prices in the April-June 2017 quarter, down from a little over a quarter of the GDP at its peak in 2013-14.

Bad news on the economy front extended to tax revenue as well, with GST collections slowing down in August. GST collections for the month were at Rs. 90,669 crore, down from Rs. 94,063 crore in July. This comes on top of the fact that the final figures for GST revenue are expected to be substantially lower due to refund claims of a massive Rs 65,000 crore in July.

Negative Outlook on Growth
Meanwhile Anil Manibhai Naik, outgoing Group Executive Chairman of Larsen & Toubro (L&T), has said in an interview with Business Standard that the economy is unlikely to revive for the next two years.

“India is in election mode. There are polls either in one state or the other, apart from general elections for the next two years. This will keep the top leadership of the government busy with campaigning and crucial governance will get neglected”, said Naik.

“Besides, the private sector is not in a position to invest, as many companies are dealing with their debt problem, while other large corporates that wanted to invest have completed their capital expenditure programme.”

Calling for an end to all violence in Kashmir valley during the month of Ramzan which is a few days away, a Concerned Citizens Group has once again urged the Modi-led government to use the opportunity to begin the “dialogue with all stake-holders as promised in the agenda for alliance of the Jammu and Kashmir government”.

There is no respite from violence in parts of Kashmir and along the Line of Control and the international border, the situation is far from normal in Jammu and Kashmir and we cannot continue to live in denial, said the statement.
 
“The loss of precious human lives, including of the security forces, should be unacceptable to all peace loving people and should be ended at the soonest. This will not happen automatically or through the use of force,” the statement said.
 
The statement also drew the government’s attention to the fact that “several military commanders with years of experience in Kashmir have spoken in favour of a dialogue as a necessary step towards bringing peace to the troubled region. We must record our dismay at the hardening of attitudes all around”.

The 5-member group of “concerned citizens” led by BJP leader Yashwant Sinha has submitted its findings to the Home Ministry in Delhi. This report has been released to the media too, not however receiving the coverage it deserves. The group had visited Kashmir on October 25 for three days during which it met various people from across Kashmir’s ideological divide.

Brief Report of a Visit by Concerned Citizens’ Group to Srinagar

A group consisting of concerned citizens visited Srinagar from October 25-27, 2016.

Centre for Dialogue and Reconciliation played a catalytic role in facilitating this visit and arranged its programme in Srinagar. The group was not, however, limited to any ideology or institution and was not sponsored by anyone.

Although former minister, Mr. Jairam Ramesh of the Congress and former MP Ms. Brinda Karat of the CPI (M) were also scheduled to join the group, they were unable to do so for various personal reasons.

The visiting group consisted of the following:
1. Yashwant Sinha (Former External Affairs Minister )
2. Wajahat Habibullah (Former Chief Information Commissioner and former Chairman of National Minorities Commission)
3. Air Vice Marshal (Retd) KapilKak
4. Bharat Bhushan (Editor, Catchnews) and
5. Sushobha Barve(Executive Program Director of Centre for Dialogue and Reconciliation – CDR)
Everyone paid for their own expenses and no security or financial help was accepted from any institution or government body to ensure that the integrity of the group as concerned citizens was maintained.
The group had the following meetings in Srinagar over three days (October 25, 26 and 27:

The meetings with Main stream political leaders – Dr. Farooq Abdullah, Mr Saifuddin Soz and Mr. Yousuf Tarigami who are supporting this initiative were by individual members of the group. All of them were unanimous in welcoming the group’s visit and talks with the Hurriyat leaders. Members also met separately with other civil society organizations……

BASIC FINDINGS:
Across the political spectrum, the Kashmiris we met spoke to virtually the same script about the history of the Kashmir issue. They may have varied in the exposition of a particular issue but basically all of them argued for a political solution to what they perceived as a political issue. They made the point that this is the fifth generation of Kashmiris which was protesting but to no avail.

Each one spent a considerable amount of time recounting the activities of the security forces which had alienated the population of the Valley. Our interlocutors told us the reasons for the immediate anger and the long term anger which we are quoting below without endorsing them –

REASONS FOR IMMEDIATE ANGER:

1. Excessive use of force by the security forces

The violence which began with the funeral procession of slain militant Burhan Wani has so far resulted in the death of nearly a hundred people. The question that most Kashmiris are asking is: Why were unarmed people going to offer last prayers for Burhan Wani fired at? They were not carrying any sticks, firearms or grenades that they represented a threat to the security forces. Nor did they attack the security forces. The firing at the funeral processions (there were nearly two lakh people gathered for the funeral and the last Namaz Janaza for Burhan Wani had been offered  40 times) is being seen as action of unaccountable security personnel and is being projected as an example of India’s ‘inhumanity’.
The business and trading community is claiming that in the current situation it is not bothered about profit and loss but human loss and about the worsening situation in the Valley. They want an amicable resolution and end to violence by the security forces.
 

2. Use of pellet guns

Use of pellet guns for crowd control was the sorest point of all conversation with Kashmiris we met. They want the pellet guns banned and cannot understand why GoI is delaying this decision and why Indian security establishment is reluctant to give up this weapon.

The use of pellet guns has led to several people, including children – some as young as 4-years-old – being blinded or partially blinded. These weapons, the Kashmiris point out, are not used in the rest of India even under grave provocation. They were not used in the Jat agitation in Haryana, the protests against Cauvery water sharing in Karnataka or the Patel agitation in Gujarat. All these agitations had resulted in large-scale damage to public property and in some cases even in gang rape of innocent women as in Haryana. Yet pellet guns were not used against the protestors. The fact that the use of pellet guns was reserved only for Kashmir elicited the most amount of anger against India and Indian security forces in the people we talked to.

Asked about stone-pelting, most Kashmiri leaders denied that youngsters were being paid to throw stones. They claimed that this was being done in ‘self-defence’ by unarmed people protesting against India.

3. Night-time raids by security forces

These are ostensibly search operations which have resulted in destruction of property at Kashmir homes –windows, doors, and household goods. Apparently electrical and electronic gadgets are destroyed in the name of search operations. This continues even when the search operation yields nothing.

One explanation we heard of this was that because the security forces get pelted with stones while returning to camp in the evening, they go back at night in anger to take revenge. That revenge in the form of wanton destruction of property to punish the people.

4. Misuse of Public Safety Act (PSA)

The PSA is seen as a revolving door process by the Kashmiris to keep people in jail. Brought into being to deal with timber smugglers by Sheikh Abdullah this draconian law, which does not require the victim to be produced before a magistrate and charged for up to a year, is used to keep trouble-makers in jail for longer than a year. As they are released in one case, another one under PSA is slapped on them in a different police jurisdiction.

However, the major misuse of the PSA is against minors. The amended Juvenile Justice Act for the state does not allow the police to arrest minors under PSA. Yet this has happened on a significant scale. The separatist leaders claim the number is about 6,000 while government sources place the figure at slightly less than half at 2,500. Even this is a large number of children. As there are no juvenile homes or Borstals for confining minors in J&K, they are kept with hardened criminals which can have long term deleterious impact on the minors imprisoned.

Kashmir leaders also allege that people arrested from the Valley are being housed in jails in the Jammu region so that their families cannot get easy access to them. This they claim is against a Surpeme Court order. Kashmir, they claim, has also become the only state which has run out of jail space and seeking to transfer the overspill to jails in MP and other states.

5. Destruction of electric transformers and crops in rural areas

A strange phenomenon of destruction of electric transformers in rural Kashmir is being reported. Apparently over 200 transformers have been destroyed – allegedly by the security forces. This again is apparently aimed at punishing villagers for either pelting stones at them or protesting against them.

There have also been some cases of standing paddy crop ready for harvesting being set on fire at some places. It is not known who is behind this. However, the news of such incidents – some verified and others unverified —  is also fanning anger amongst people.

6. Attacks on Kashmiris outside J&K

There have been some reports of Kashmiri students as well as some Kashmiri traders being attacked in states outside J&K. The Kashmiri people want the safety of students and traders to be ensured by the GoI.

With everyone we strongly raised the issue of opening of schools.

REASONS FOR LONG TERM ANGER:

1. Refusal to recognize Kashmir as a politically contentious issue
Across the cross section of people we met there was anguish about India not recognizing that Kashmir was a dispute. The refusal to see Kashmir as a political issue, people claimed, had resulted in the present situation because a political issue cannot be solved through law and order measures.

2. Refusal to recognize the emotional and sentimental aspects of the Kashmir issue
India, Kashmiri separatist leaders believe, has not understood the wounded psyche of the Kashmiri people. Therefore, it is unable to understand why Kashmiris have locked horns with the world’s largest democracy.

Their argument is that because India does not see the psycho-historical aspects of the problem it tries to reduce it to issues of lack of development or economic growth, need to create jobs or offering economic packages and incentives.

This has not suppressed the sense of hurt in the Kashmiri people or quell their political aspirations because these measures do not address the political issue of Kashmir.

3. Designating all Kashmiris as Pakistani puppets
There is also anger among Kashmiris that everything that happens in the Valley is being seen through the Pakistan prism and that this is being done to deny that they are free agents who are raising their own issues with India.

Another consequence of equating the protests in Kashmir with Pakistani machinations, they believe, is that every protesting Kashmiri can be equated with a terrorist and leadership, especially the Hurriyat Conference, is projected on a par with extremists when in fact, it was organised as the political face of a peaceful protest movement.

Even if GoI gets upset with the Azadi slogans, they argue, there is a need to recognize that the Kashmiris are upset and there is a sentiment for Azadi; and that this has little to do with Pakistan. Protestors pick up Pakistani and Chinese flags not because they want to solicit support from these countries but because they know that this riles India. And they want to rile India because it does not listen to them. “If everything that happens here is because of Pakistan, then what are we doing here?” a Hurriyat leader asked.

4. No dialogue with Pakistan
Kashmiri separatist leaders also think that unless India and Pakistan talk there can be no permanent solution to the Kashmir issue. While most of them recommend tripartite talks on Kashmir between India, Pakistan and the Kashmiri leadership (without specifying which leadership), others are willing for some other form of dialogue between the three as in Vajpayee’s time. They called it “triangular dialogue” – presumably one in which India and Pakistan talk to each other and each of them then talks to the Kashmiris also.

There is widespread belief that without engaging Pakistan there can be no resolution of the Kashmir issue.

5. Vajpayee line on Kashmir jettisoned
Most Kashmiris believe that Prime Minister Atal Bihari Vajpayee was sincere in his approach to resolving the Kashmir tangle. They quoted him as saying that Kashmir is an issue which needs to be resolved and that even if Kashmiris want to distance themselves, even that had to be done through cooperation and goodwill.

They believe that Vajpayee saw the human aspect of the Kashmir issue and there was a need to once again appreciate the humanitarian aspects of the issue, irrespective of the state of India-Pakistan relations.

6. Indian public is indifferent to the plight of Kashmiris
Kashmiri separatist leaders believe that while Indian citizens are politically quite aware and quick to question the government, when it comes to the Kashmir issue, they keep quiet. This, they believe, is because they have been conditioned and encouraged to view the developments in Kashmir through anti-Pakistan glasses. GoI’s approach to Kashmir also pushes this point of view. As a consequence, even politically aware Indian citizens have no time for Kashmir.

7. Kashmir being pushed towards anarchy
The situation in the Valley is not being controlled by the separatist leaders as they were all in jail for four months since the day after BurhanWani’s death. The Hurriyat leaders admitted that the street protester is  not under anyone’s control. The streets are being controlled by youngsters who give the call for spontaneous protests. If this continued, they think that they would lose whatever little authority they exercise over the local population and they would not be able to give the protests any political direction.

If such an anarchic situation was to develop in Kashmir, then India would have no reasonable person to talk to, they claim.

8. Kashmiri Pandits living in the Valley
The Kashmiri Pandits who have continued to live in the valley since 1990’s want to be treated on par with Kashmiri migrants and be given same benefits as them because in a sense they are also migrants who have shifted from the original villages to towns. This had been agreed to by the former PM Dr. Manmohan Singh but never implemented. Because of the ongoing agitation, many of the Pandit families, whose breadwinners were employees of commercial establishments were now deprived of a livelihood. The Kashmiri Pandits fear that in light of breakdown of law and order and withdrawal of security their own security was compromised leading to the migration of employees to Jammu where they were not getting salaries unlike other employees who were not able to their offices.In consequence, out of remaining 850 familes, 350 families were planning to migrate.

9. Regression from autonomy to uniformity; togetherness to communalism
Kashmiris believe that today Indian politics has taken such a turn that there is no willingness to listen to even demands for autonomy. Today Kashmir issue is being seen as Hindu vs. Muslim and governance is seen as Jammu vs. Kashmir.

RECOMMENDATIONS: WHAT NEEDS TO BE DONE:

The sense of despair and desperation in Kashmir is increasing by the day. There was unanimity among the civil society and mainstream political leaders that dialogue must begin with the inclusion of the separatist political leaders.
The question then is how to ease the existence of ordinary Kashmiris while leaving aside the complexities of resolving the Kashmir issue permanently.

After listening to a cross-section of Kashmiri voices, the group came to the conclusion that some small steps can be taken by the State government and the Union government to bring some semblance of normality in Kashmir. These proposed steps are listed below.

Steps that the J&K state government can take:
1. Start the process of reopening schools and as a precursor to this, release forthwith all first time offender school children and minors arrested under PSA.*

2. Consider postponing school examinations to a later date instead of insisting on holding them from November 15. Children who have been in jail have not probably had access to textbooks and other teaching material. They should be given sufficient time to prepare for exams.*

3. Repeat offenders amongst minors must be shifted out of adult jails and put up in temporarily designated juvenile detention centres and given psychological counseling.

4. Compensation must be announced for the next of kin of the civilians killed and for those wounded in police or action by the other security forces. This money may be transferred as DBT to designated accounts to prevent extortion and rent-seeking from the suffering families by the state bureaucracy.

5. Rehabilitation packages must be announced to ensure the life-time income needs of those permanently blinded by pellet guns.

6. Compensation and free treatment (both in India and abroad, if necessary) at state government expense for those who have been partially blinded by pallet guns.

7. Set up a blind school in Srinagar for children blinded by pellet guns. The state does not have a blind school and this may be a means of rehabilitation by the state to provide education for children with blindness or partially blindness.

8. Order a judicial commission into excesses by the police, especially the wanton use of pellet guns. While it is widely accepted that such commissions rarely lead to any conclusions, they serve a therapeutic purpose of allowing people to emotionally express themselves and it also helps project the state government as an accountable institution.

*Syed Ali Shah Geelani reciprocated this sentiment when the group met him for a second time to urge him to allow children to go to school, although he couched this in rhetoric that made it the responsibility of the state government to provide the secure conditions for children to attend school.

Steps that the Union government can take
1. Ban the pellet gun with immediate effect as a crowd control weapon. This will have a salutary impact on the Kashmiris. This is not something that should be left to committees or to the security forces.
2. Work with the media not to escalate the situation in Kashmir. Educate media owners about the sensitive nature of the Kashmir issue and not add fuel to the fire in search of viewers and revenue.
3. Dispel the perception that Kashmir and Kashmiris are mere tools to be used for electoral purposes.
4. In its interactions with Kashmiris the centre might reiterate the approach enunciated by the Hon’ble PM that Kashmiris are Indians.
5. GoI move quickly to give facilities of migrants to Pandits continuing to reside in Kashmir Division of J&K.

Although separatist leaders like Syed Ali Shah Geelani and Mirwaiz Umar Farooq talked of being prepared for a dialogue (Geelani talked of “unconditional” talks), it was not within the competence of this group of concerned citizens to suggest when or if such a dialogue process should be started.

However, what we would like to emphasise is that we noted an overwhelming sentiment amongst the Kashmiris we interacted with for setting up a permanent process of dialogue with New Delhi. One of the reasons why so many doors were opened for us by the separatists and ordinary Kashmiris alike was because they saw our visit as a beginning of engagement with ordinary Indians.

The agenda of alliance of the BJP-PDP Coalition Government also commits to a dialogue with all the stakeholders. We recommend that such a dialogue is initiated at the earliest.

The Kashmiris we interacted with acknowledged that we had limitations in leveraging the complexities of the Kashmir issue. Yet, there was a consensus that we repeat our visit and continue this engagement with them.
