In a strong statement issued this afternoon, the Samyukta Kisan Movement (SKM) has strongly condemned the Yogi Adityanath Government for the arrest of farmers at Dalit Prerana Sthal in Noida Delhi Highway on December 3. 2024. Police have arrested hundreds of farmers including above one hundred women and had forcefully evicted them from the protest site. This is a violation of the Constitutional Rights for peaceful protest and the SKM has urged the judiciary to intervene and protect the fundamental rights. SKM has in this statement reminded the CM  of Uttar Pradesh that using police force cannot resolve the burning issues of the people who have lost their valuable land and livelihood for a pittance.

 SKM even protested the arrogance of the UP Administration both Revenue and Police Departments for nakedly violating the consensus made with the farmer’s leadership on 2nd December 2024 asking for seven days for the Chief Secretary of UP to discuss with the farmers leadership and resolve the demands.  As per their request, the farmers had shifted the spot of the struggle to the Dalit Prerena Sthal of Ambedkar Park and continued the night and day Sit-in struggle. But the Police force was deployed in huge numbers and forcefully evicted the peacefully agitating farmers. 

 The struggle of the project affecting farmers of Greater Noida region to protect their land rights has been continuing for more than the past 18 years. Six farmers had been martyred in the Police firing as part of this struggle during 2008, 2011 and 2012. There were massive struggles across the country against such widespread land acquisition to facilitate corporate profiteering.  In this context, the then UPA2 Government headed by Manmohan Singh was forced to enact the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013(RFCTLARR Act) to protect the land rights of farmers.  

In 2014 however, the BJP led NDA1 Government  led by Narendra Modi passed, without debate, the Land Acquisition Ordinance to invalidate the LARR Act 2013.  Due to the farmers’ struggle across the country under the banner of Bhumi Adhikar Andolan, they failed to enact the law. Howwver, BJP led State Governments including Uttar Pradesh have passed state land laws to violate the LARR Act 2013. Farmers however are continuing the struggle for their genuine land rights and the struggle of Greater Noida project affected farmers is part of this countrywide struggle.   

The statement asserts that the Adityanath Government has failed to ensure justice to the farmers and that the circle rate of land has not been revised since 2017. Farmers in UP have been denied adequate, lawful compensation and benefits assured by the LARR Act 2013 including employment, resettlement and rehabilitation. The Greater Noida project affected farmers are entitled to get back 10% of the developed land, employment for landless farmer households, four times rate of circle rate as compensation apart from resettlement and rehabilitation.  Moreover, the statement says that the BJP led State Government cannot evade its responsibility of ensuring that these lawful rights of the project affected farmers. Apart from Greater Noida farmers, lakhs of farmer households across Uttar Pradesh also have also been affected. The SKM has also appealed to all farmers to consistently advance the struggle until victory achieved and justice is done to all the victim farmer households.

His SC plea challenged an Allahabad High Court order accepting the state government’s refusal to prosecute Chief Minister Yogi Adityanath in a 2007 hate speech case.
 
Gorakhpur: Parvez Parvaz, an ex-journalist and activist, had filed a plea in Supreme Court against the then local MP and now Chief Minister Yogi Adityanath for inciting violence through hate speech in 2007. He was arrested on Tuesday night on the charges of gangrape. His SC plea challenged an Allahabad High Court order accepting the state government’s refusal to prosecute Chief Minister Yogi Adityanath in a 2007 hate speech case.
 
The case against him was lodged at Rajghat police station on June 4. Speaking to Sabrang India, Parvez Parvaz’s lawyer Advocate Farman Naqvi said, “On June 4, the survivor had filed an FIR against a Jumman Mia and a man named Parvez. Please note, his last name Parvaz was not mentioned. She claimed that Jumman Mia called her to a secluded spot where both Jumman and Parvez raped her. Based on this an FIR was filed under section 376 (c) for gang rape.” An investigation followed and the Investigation officer filed a closure report on July 25, 2018. “The Investigating Officer filed a closure report stating the case was false. He based his conclusion on the fact that the scene of crime was not a secluded spot and that there were a few shops there, but the shopkeepers did not see anything. Moreover, the injury report did not conclude that a rape had taken place,” says Adv Naqvi.  However, after this the survivor met UP CM Adityanath following which the police started looking at the case with renewed vigour. “The SSP passed an order rejecting the previous IO’s investigation and the case was handed over to a new IO Shalini Singh.” The petition challenging the FIR was filed on Monday, and on Tuesday Shalini Singh arrested Parvez Parvaz. 

“The Gorakhpur police arrested Parvez late Tuesday night from Kotwali area of the city and produced him today before a local court, which sent him to jail,” said Additional SP, City, Vinay Kumar Singh. 
 
When the petition seeking a stay on the arrests of Jumman and Parvaz was heard on Wednesday before a bench comprising of Justice Ramesh Sinha and Justice D K Singh, the court had stayed the arrest of Jumman. As Parvaz is in Judicial custody his legal team will now apply for his bail as that is the legal remedy available.

A brief background of Parvaz’s case against UP CM Adityanath

“Communal clashes broke out in Gorakhpur and adjoining districts after a Hindu youth was killed in a clash during a Muharram procession. As per an FIR registered, Adityanath allegedly delivered a provocative speech calling out for revenge against the minority community in retaliation for the death of the youth. The police initially refused to register an FIR and lodged it only after the HC intervened,” reported The Hindu.
 
Last May, after the BJP came to power in UP, the state government refused sanction to prosecute Adityanath, who by then had become the CM, on grounds that the prime evidence in the form of a CD had allegedly been tampered with.
 
“However, In February, 2018, the HC, too, dismissed the petition saying that it did not find any procedural error in the conduct of the investigation and remitted the matter to the sessions court in Gorakhpur to ‘pass an appropriate order in accordance with law’. The HC order was challenged in the Supreme Court, which in September 2018 refused to disturb the high court order. Now, as per the high court order, the sessions court has sent out notices to both the parties to appear before it on October 20,” reported Times of India.

The leader of the Samajwadi Party (SP) MP in the Rajya Sabha, professor Ram Gopal created quite a stir in the Upper House of parliament on Friday, raising the issue of violence in Kasganj and accusing the BJP government in UP of stoking the communal flame. The shouting match that followed resulted in the adjournment of the Rajya Sabha.

Addressing the media after stepping out of the parliament hall, the SP leader asserted: “In Kasganj a Hindu has killed a Hindu but Muslims are being targeted. The police are forcibly entering Muslim homes beating them up and slapping false cases against them”. He also alleged that Muslim homes and business premises were being torched in the presence of the police who stood as mute witness.

Gopal slammed the police for accusing Muslims of private firing when it is plain from the video clips accessed by the media as to who was responsible for the private firing in which a Hindu, Chandan Gupta, was killed on Republic Day. He demanded the immediate release of the Muslims, including three brothers from a business family, and action against the actual culprits. Gopal said this was the same demand which he had raised inside the House and exposed the BJP’s game-plan which is why the latter raised a din to hide their shame.

When Gopal raised the issue in the Rajya Sabha, the deputy chairperson, PJ Kurian, asked him to issue a notice and seek a reply instead of directly demanding a statement from the government. Given the heated exchanges that followed, the chair decided to adjourn the House.

According to a report in the Times of India on January 31, “UP police are studying a video that has surfaced, which purportedly shows a group of young men marching towards a Muslim-dominated area in Kasganj on the morning of January 26, with guns. Some of them then fire several rounds. The video, shot from the roof of the local tehsil office, also shows many in the group holding clubs and sticks… In the violence that followed, one man was shot dead and two seriously injured.” The newspaper claimed to have accessed a copy of the video.

Whatever the merit of the allegations made by Gopal against the perpetrators of communal violence in Kasganj and the role of the police and the ruling party, the fact is that are of a very serious nature. While the allegations have made it to lead news report on the front page of Urdu papers, the rest of the national media appears to have totally ignored it.
