We, citizens concerned with gender justice and minority rights are deeply disturbed with the manner in which a Bill criminalising instant Triple Talaq, was introduced and passed in the Lok Sabha on 28th Dec, 2017 (The Muslim Women (Protection of Rights on Marriage) Bill, 2017)

The Bill aims to protect the rights of Muslim women, but we believe, it will cause more harm to them if it is passed in its present form. We urge you to call for consultations from a wide section of people working with Muslim women so that the aim of securing gender justice is truly achieved.

 Our concern with the current Bill:

a. It has many contradictions and anomalies.

b. It pushes Muslim women into a new statute which will incarcerating their husbands.

c. It gives power to a third person to file a criminal charge, which can be extremely dangerous.

d. It does not specify the time period for the case to be concluded.

e. It does not specify who will provide sustenance to the woman when her husband is in jail.

Utterance of the words “talaq” three times has been invalidated by the Hon’ble Supreme Court in August, 2017, which means that her marriage remains intact. Since the marriage is intact, Muslim women, like all other women, have a recourse in law both criminal (S. 498A of IPC – cruelty to wives) and civil (the Protection of Women Domestic Violence Act, (PWDVA) 2005 which secures the rights of all women facing domestic violence to maintenance, residence, protection from violence and to custody of their children) if they face domestic violence. We believe that Muslim women must take recourse to these two laws to protect their rights.

We, the undersigned, urge that the Bill should be sent to a select committee to discuss its pros and cons in the true spirit of democracy.

Proposed legislation on triple talaq interference in Shariah laws, says Muslim Personal Law Board



The Union government’s plan to bring in a new law to end triple talaq is nothing but interference in Shariah law, the All India Muslim Personal Law Board (AIMPLB) has stated in a press release. The statement adds that the proposed law is in violation of the right to freedom of religion guaranteed to minorities under the Indian constitution.

Issued by the secretary and spokesman of the Board, Maulana Khalid Saifullah Rahmani, the statement said, “Talaq is a religious issue. Once divorced a woman becomes haraam (prohibited) for her husband. Making triple talaq (instant divorce) illegal will mean that the divorced couple will be forced to stay in the relationship. This will put them in a situation which according to Islam is a grave sin, amounting to illicit sex”.

Muslim and other secular women’s organizations contest the Board’s claim that divorce is a religious issue. They are all in favour of a law declaring the practice of instant triple talaq as illegal. However, many suspect the BJP-led NDA government’s motive behind the ‘hasty’ move and are in principle opposed to criminalization of any aspect of family law.  

The Board’s statement said triple talaq is a highly undesirable practice, a misuse of the provision in Shariah law on divorce. However, misuse of a law cannot be a pretext for doing away with the law itself. Citing the provision for declaration of an Emergency under certain circumstances, the statement said the provision was misused in 1975. Despite this, even the opposition which was fiercely opposed to the imposition of Emergency did not scrap the Constitutional after coming to power.

The Board itself is opposed to the misuse of the triple talaq provision and is running a countrywide campaign against the practice, the statement added.  
“In principle we fully support the enactment of a law that makes triple talaq or instant divorce illegal. However, we strongly suspect the intention and the haste with which the government wants to bring in the new legislation,” said Hasina Khan of the Bebaak Collective, an umbrella body of several women’s groups.

The Collective challenges the government’s claim that its decision to move a Bill now is based on feedback that triple talaq is continuing across the country even after being set aside by the Supreme Court in August. “What monitoring have they done? Which Muslim women’s groups have they consulted? In which state? No space has been given for consultation with Muslim women’s organizations,” Khan told Sabrang India.

In view of the above, the Bebaak Collective is deeply suspicious of the government’s proposed move, doubly so in view of the talk of criminalizing the triple talaq practice. “We are in principle opposed to criminalizing any aspect of family law for any community. Marital relations are after all a civil matter.”

The Bebaak Collective is equally opposed to the stand of the All India Muslim Personal Law Board that talaq is a religious issue. “The Board is nothing but an empty balloon without credibility. They are using the legitimate fear the community has of the BJP/RSS to raise the religion bogey”, said Khan.

While the CPM-affiliated All India Democratic Women’s Association (AIDWA) too is generally suspicious of the BJP-led central government’s intent, it has decided to wait for the government’s draft before responding.

“Let the government come out with its draft. Let’s see what it has and we will respond accordingly,” AIDWA general secretary, Mariam Dhawale told Sabrang India.
As for the Board’s views on triple talaq, Dhawale said her organization has consistently opposed the practice and has actively helped individual Muslim women victim’s fight for justice. “In fact, the Board’s position is self-contradictory. It legitimizes triple talaq even while it considers it to be a repugnant practice”, said Dhawale.

The Bharatiya Muslim Mahila Andolan (BMMA) has reportedly been meeting Parliamentarians from different parties to canvass support for a law aimed at comprehensive codification of Muslim Personal Law just as personal laws of other communities is codified. Meanwhile, it reportedly supports the enactment of a law making triple talaq illegal as a step in the right direction.  
 

Women's groups support law declaring triple talaq illegal, but suspect BJP's motive, contest Personal Law Board's view

Proposed legislation on triple talaq interference in Shariah laws, says Muslim Personal Law Board



The Union government’s plan to bring in a new law to end triple talaq is nothing but interference in Shariah law, the All India Muslim Personal Law Board (AIMPLB) has stated in a press release. The statement adds that the proposed law is in violation of the right to freedom of religion guaranteed to minorities under the Indian constitution.

Issued by the secretary and spokesman of the Board, Maulana Khalid Saifullah Rahmani, the statement said, “Talaq is a religious issue. Once divorced a woman becomes haraam (prohibited) for her husband. Making triple talaq (instant divorce) illegal will mean that the divorced couple will be forced to stay in the relationship. This will put them in a situation which according to Islam is a grave sin, amounting to illicit sex”.

Muslim and other secular women’s organizations contest the Board’s claim that divorce is a religious issue. They are all in favour of a law declaring the practice of instant triple talaq as illegal. However, many suspect the BJP-led NDA government’s motive behind the ‘hasty’ move and are in principle opposed to criminalization of any aspect of family law.  

The Board’s statement said triple talaq is a highly undesirable practice, a misuse of the provision in Shariah law on divorce. However, misuse of a law cannot be a pretext for doing away with the law itself. Citing the provision for declaration of an Emergency under certain circumstances, the statement said the provision was misused in 1975. Despite this, even the opposition which was fiercely opposed to the imposition of Emergency did not scrap the Constitutional after coming to power.

The Board itself is opposed to the misuse of the triple talaq provision and is running a countrywide campaign against the practice, the statement added.  
“In principle we fully support the enactment of a law that makes triple talaq or instant divorce illegal. However, we strongly suspect the intention and the haste with which the government wants to bring in the new legislation,” said Hasina Khan of the Bebaak Collective, an umbrella body of several women’s groups.

The Collective challenges the government’s claim that its decision to move a Bill now is based on feedback that triple talaq is continuing across the country even after being set aside by the Supreme Court in August. “What monitoring have they done? Which Muslim women’s groups have they consulted? In which state? No space has been given for consultation with Muslim women’s organizations,” Khan told Sabrang India.

In view of the above, the Bebaak Collective is deeply suspicious of the government’s proposed move, doubly so in view of the talk of criminalizing the triple talaq practice. “We are in principle opposed to criminalizing any aspect of family law for any community. Marital relations are after all a civil matter.”

The Bebaak Collective is equally opposed to the stand of the All India Muslim Personal Law Board that talaq is a religious issue. “The Board is nothing but an empty balloon without credibility. They are using the legitimate fear the community has of the BJP/RSS to raise the religion bogey”, said Khan.

While the CPM-affiliated All India Democratic Women’s Association (AIDWA) too is generally suspicious of the BJP-led central government’s intent, it has decided to wait for the government’s draft before responding.

“Let the government come out with its draft. Let’s see what it has and we will respond accordingly,” AIDWA general secretary, Mariam Dhawale told Sabrang India.
As for the Board’s views on triple talaq, Dhawale said her organization has consistently opposed the practice and has actively helped individual Muslim women victim’s fight for justice. “In fact, the Board’s position is self-contradictory. It legitimizes triple talaq even while it considers it to be a repugnant practice”, said Dhawale.

The Bharatiya Muslim Mahila Andolan (BMMA) has reportedly been meeting Parliamentarians from different parties to canvass support for a law aimed at comprehensive codification of Muslim Personal Law just as personal laws of other communities is codified. Meanwhile, it reportedly supports the enactment of a law making triple talaq illegal as a step in the right direction.

Bebaak Collective Condems BJP's Appropriation Of Muslim Women’s Voices

We, as Bebaak Collective (Voices of the Fearless), are writing this statement unequivocally condemning  the comment made by the BJP leader Subramanian Swamy in an event in Mumbai on Friday, 27th October that the party could win in Uttar Pradesh elections because Muslim women believed that it was BJP who could save them from ‘triple talaq’. (See, “Muslim women felt only BJP could save them from triple talaq says Swamy” Indian Express, 28th October) BJP leaders have time and again celebrated the victory of the recent judgement that invalidates the instantaneous practice of triple talaq and the leadership have often claimed the victory to itself, strategically pointing out the silence of the Congress government during the Shah Bano case.

The enormous media debate, after the judgement, underplayed the efforts of women’s movement and turned it into a game of political rivalry between BJP and Congress. In fact, BJP’s constant reference to the violent and gender discriminatory practice of triple talaq seems to feed into the imagination that the Muslim community is conservative and violent which also creates fractures within the community and legitimises the targeted violence of the men of the community in beef cases or in fabricated terror cases.

We strongly condemn the appropriation of the struggle of women’s groups and want to reiterate that triple talaq could be declared unconstitutional owing to the sustained work of women’s groups in the community and also, because of the legal intervention made by grassroots women’s groups in the apex court supporting Shayara Bano’s petition who challenged the validity of unilateral triple talaq in the court. Bebaak Collective, which is a campaign group, and works with several other grassroots organisations across states, was one of the petitioners to intervene in the court supporting Shayara Bano.

On 22th August, 2017, the honourable Supreme Court of India adjudicated that instantaneous triple talaq will not be acknowledged by the law on a 3-2 majority in a five bench trial while maintaining the ethos of equality as enshrined in the Indian Constitution. This judgement is ‘historic’ in terms that it gives a legal acknowledgement to the demands of Muslim activists across the country and also occult the self styled ‘authentic’ representatives of the community–All India Muslim Personal Law Board (AIMPLB).

However, on the aftermath of this judgement there have been series of occasions where the standing government consciously tried to hijack the victory and misrepresent the events. It must be remembered that it was women’s groups who approached the court and not the current government who only filed an affidavit when directed by the court. However, the successive statements from BJP ministers congratulating Muslim women and projecting BJP as the sole messiah of the community has resulted into further polarization within the community and makes it appear as if the Muslim women’s leadership aligned with the right wing government around this issue.

It appears that these stories before the Gujarat elections and assembly elections of 2019 will strengthen the image of the current government as champion of women’s rights which will successively translate into winning election booths. We strongly resist this appropriation and unabashed manipulation of the Muslim community and especially the women.

On this occasion, we want to ask whether the government has made any real policy level intervention to better the social security of the Muslim community or even whether the government is bringing any schemes or policies to change the material realities of the Muslim women and girls in particular who seem to have evoked this government’s sudden empathy. While it must be remembered that as soon as this government came to power, it criminalized beef consumption and trading; there are increasing number of cow vigilantes under the patronage of the government and other right wing forces. Incidents of killing of Muslims and Dalits on suspicion of beef possession are a much reported reality while the perpetrators of the violence against Md. Akhlaque, Pehlu Khan, Junaid are roaming scot free.

Besides, where was this government when the incidents of mass rape in Gujarat massacre and Muzaffarnagar riots were being pushed below the carpet or orchestrated?  What has the government done to recuperate the lives of several Muslim families who were victims during Muzaffarnagar riots and those who migrated to neighbouring villages and towns? What did the government do when the hindutva strategies like Love Jihad were getting strengthened and anti-romeo squads were functioning in the states like Uttar Pradesh? These protectionist agenda not only led to the social segregation between the majority and minority communities, but also impacted the lives of Muslim women whose mobility was restricted further within the walls of their home.

Where is this verbose government when Najeeb from Jawaharlal Nehru University, Delhi went missing? Why is it being silent partisan with the JNU administration in shielding the ABVP students when Fatima Nafees, as a Muslim woman and citizen of this county, is demanding justice for her disappeared son? We challenge this government to protect the rights of Muslims by ensuring that they implement Sachar Recommendations and they pass the Prevention of Communal and Targeted Violence (Access to Justice and Reparations) Bill, 2011.

Only if we see any progressive move in this direction could we believe that this government is in any way interested in safeguarding the rights of Muslim women. Otherwise these statements and empathy remain hollow as the ruling dispensation has time and again demonstrated that Muslims are second class citizens of this country and prone to both systemic and vigilante attacks.

The government is now shamelessly trying to capitalise on the thirty five years long struggle of women’s movement, which stood by the Muslim community. This statement is a reiteration of strong voices of women activists within the Muslim community, an emergent leadership which cannot be squashed or appropriated by any forces. The current government which otherwise maintains a stoic silence on any incident of violence towards the community, should not try to strike any ‘emotional cord’ with the women of the community while claiming to be their messiah and yet consorting with the dream of ‘hindu rajya’. It must be remembered that this appropriation of the judgement will not only mar the complex questions of gender rights but also reduce the role of progressive political forces as redundant ideas and we must fight against this.

Shia Board to intervene in Shayara Bano case: "Triple talaq should be banned just like Sati was"

The All India Shia Personal Law Board has decided to intervene in the Shayara Bano case before Supreme Court on the issue of triple talaq. A decision to this effect was conveyed to the media following a meeting of the Board’s executive council in Lucknow on Thursday.



It also called upon the government to ban triple talaq just as the Sati practice among Hindus was banned by the colonial British government long ago.

(Sati practice, first banned in 1829, was applicable throughout the territories under colonial rule. A general ban for the whole of India was issued by Queen Victoria in 1861. The Indian Sati Prevention Act from 1988 further criminalised any type of aiding, abetting, and glorifying of sati).

Speaking to the media, the Board’s spokesperson Maulana Yasoob Abbas stated that the triple talaq method of instant divorce was detrimental to women’s interests.

“Why should the women always bear the brunt of divorce? It is not only the woman but her entire family and her children face the trauma,” said Maulana Abbas, adding, “When Islam treats men and women as equals, how could discrimination against women be justified?”

It may be noted that the triple talaq system of instant divorce is not considered valid among Shias. Commenting on the gross injustice inherent in the practice, he observed: “Even when the government suspends or dismisses a peon, he is given a chance to explain his position, but when a man divorces a woman she is given no chance to put forward her point of view.

Several Muslim women’s organisations – Bharatiya Muslim Mahila Andolan (BMMA), Bebaak Collective, All India Muslim Women’s Personal Law Board – have either already intervened in the Shayara Bano case or are in the process of doing so. The All India Muslim Personal Law Board (AIMPLB), has filed an affidavit in the Supreme Court pleading that the apex body has no right to interfere in Muslim Personal Law matters. Dear Friends and Comrades,

Let us all gather in the national capital on 27th and 28th February 2016 to demand the fundamental rights to life, dignity, equality and non-discrimination, for freedom of religion and expression for Muslim women. Let us bring together the visions and struggles of women’s movements, people’s movements, democratic and civil rights movements to participate in a national-level convention and Rally in Delhi to demand an equitable and just society for all the citizens of this country. We, on behalf of Bebaak Collective: voices of the fearless, extend a warm invitation to all like-minded individuals, writers, researchers, activists, students, professions, non-governmental organisations and autonomous collectives to join this on-going struggle of Muslim women.

We believe , given the current socio-political atmosphere of the country, that this convention is crucially timed. We have witnessed endemic and overt communal riots, beef ban, hate speeches targeted against Muslim communities and saffronisation of education. There have also been covert and systemic forms of violence through the rhetoric of love jihad and ghar wapsi. These instances, along with many other quotidian forms of discrimination and violence against Muslims and other marginalised communities, have fostered an atmosphere of intolerance and fear in the country. The inundating surveillance of the State in the everyday lives of citizens, and specifically marginalised communities like Muslims has heightened the insecurity among citizens in rural and urban areas.

With the rising communal hatred towards Muslims, it is well known that women become the bearers of “honour” of the community and are subjected to strict forms of surveillance and moral policing by members of their own family and community, albeit using the rhetoric of “security” and “protection”. Education, employment and mobility of Muslim women are major causalities under such circumstances. It is thus obvious that the current situation in our country deserves immediate attention and much needed deliberation relating to lived realities of Muslim women.

During the reign of the previous government viz., UPA, the Central government made lots of promises and formulated many policies to better the socio-economic conditions of Muslim communities, including the appointment of Rajinder Sachar Committee in 2005. The report prepared by this committee was hailed as the first of its kind to highlight the “backwardness” of Indian Muslims; and their condition was compared to be lower than Scheduled Castes and Scheduled Tribes. This report not only demonstrated the socio-economic and educational impediments faced by Muslims denying them equal rights but also made crucial recommendations to improve the conditions of this marginalised community. There were several shortcomings in the implementation of these recommendations by the UPA government, including lack of transparency in the budget allocations. Hence, it is difficult to state whether there was any substantial improvement and several issues continue to persist. On the contrary, the current environment of intolerance, stigma and discrimination has deepened the malaise. In fact, Modi government in Gujarat in November 2013 had challenged the formation of Rajinder Sachar Committee by the then PMO, headed by Manmohan Singh, and contended before the Supreme Court that it was “unconstitutional” since it targeted only Muslims and ignored other minorities. Within a week of the BJP government coming to power in May 2015, similar views were echoed by the Minister of Minority Affairs stating that Muslims were not a minority in this country. Even after 18 months in power, the BJP government has not taken any serious steps to implement the Sachar Committee recommendations.

In this context, we need to continue to re-claim our democratic spaces and demand equal opportunities for all. We are inviting visionaries and outspoken personalities to address this issue in the plenary of the Convention on Day 1, and plan to deliver a statement/memorandum to the Government after the Rally on Day 2. A detailed schedule will be shared in January 2016.

This convention and rally is organised by Bebaak Collective, a forum of autonomous groups and individuals, striving to further the rights of Muslim women. We are mobilizing women from different states across India for this convention. We call upon you to participate, share your experiences and strengthen our voices in this convention. We have estimated an expenditure of approximately Rs. 3 lakh for the convention and we will provide basic accommodation and food. This is an autonomous, non-funded convention; and we hope to raise funds through donations and registration from participants. We appeal to you all to contribute monetarily and/or volunteer your precious time for organising this convention and rally. Do get in touch with us via this email or the below mentioned address.

We, on behalf of Bebaak Collective: voices of the fearless, extend a warm invitation to all like-minded individuals, writers, researchers, activists, students, professions, non-governmental organisations and autonomous collectives to join this on-going struggle of Muslim women.

We believe , given the current socio-political atmosphere of the country, that this convention is crucially timed. We have witnessed endemic and overt communal riots, beef ban, hate speeches targeted against Muslim communities and saffronisation of education. There have also been covert and systemic forms of violence through the rhetoric of love jihad and ghar wapsi. These instances, along with many other quotidian forms of discrimination and violence against Muslims and other marginalised communities, have fostered an atmosphere of intolerance and fear in the country. The inundating surveillance of the State in the everyday lives of citizens, and specifically marginalised communities like Muslims has heightened the insecurity among citizens in rural and urban areas.

With the rising communal hatred towards Muslims, it is well known that women become the bearers of “honour” of the community and are subjected to strict forms of surveillance and moral policing by members of their own family and community, albeit using the rhetoric of “security” and “protection”. Education, employment and mobility of Muslim women are major causalities under such circumstances. It is thus obvious that the current situation in our country deserves immediate attention and much needed deliberation relating to lived realities of Muslim women.

During the reign of the previous government viz., UPA, the Central government made lots of promises and formulated many policies to better the socio-economic conditions of Muslim communities, including the appointment of Rajinder Sachar Committee in 2005. The report prepared by this committee was hailed as the first of its kind to highlight the “backwardness” of Indian Muslims; and their condition was compared to be lower than Scheduled Castes and Scheduled Tribes. This report not only demonstrated the socio-economic and educational impediments faced by Muslims denying them equal rights but also made crucial recommendations to improve the conditions of this marginalised community. There were several shortcomings in the implementation of these recommendations by the UPA government, including lack of transparency in the budget allocations. Hence, it is difficult to state whether there was any substantial improvement and several issues continue to persist. On the contrary, the current environment of intolerance, stigma and discrimination has deepened the malaise. In fact, Modi government in Gujarat in November 2013 had challenged the formation of Rajinder Sachar Committee by the then PMO, headed by Manmohan Singh, and contended before the Supreme Court that it was “unconstitutional” since it targeted only Muslims and ignored other minorities. Within a week of the BJP government coming to power in May 2015, similar views were echoed by the Minister of Minority Affairs stating that Muslims were not a minority in this country. Even after 18 months in power, the BJP government has not taken any serious steps to implement the Sachar Committee recommendations.

In this context, we need to continue to re-claim our democratic spaces and demand equal opportunities for all. We are inviting visionaries and outspoken personalities to address this issue in the plenary of the Convention on Day 1, and plan to deliver a statement/memorandum to the Government after the Rally on Day 2. A detailed schedule will be shared in January 2016.

This convention and rally is organised by Bebaak Collective, a forum of autonomous groups and individuals, striving to further the rights of Muslim women. We are mobilizing women from different states across India for this convention. We call upon you to participate, share your experiences and strengthen our voices in this convention. We have estimated an expenditure of approximately Rs. 3 lakh for the convention and we will provide basic accommodation and food. This is an autonomous, non-funded convention; and we hope to raise funds through donations and registration from participants. We appeal to you all to contribute monetarily and/or volunteer your precious time for organising this convention and rally. Do get in touch with us via this email or the below mentioned address.
