Seven women wrestlers, including a minor, levied sexual harassment allegations against BJP MP and WFI chief Brij Bhushan Sharan Singh and several other coaches. During January 2023, the wrestlers, led by Sakshi Malik, Sangeeta Phogat, Vinesh Phogat and Bajrang Punia, took to the streets of Delhi for the first time to demand the arrest of Singh and his removal as the chief. When no step was taken for four months, the wrestlers resumed their sit-in protest at Jantar Mantar in the month of April. Since then, they have faced multiple threats, violence and abuse at the hands of the Delhi police and the government. Here is a look into the ongoing wrestlers protest.

Protesting wrestlers will resume stir, say govt not ready to arrest WFI chief by June 15

New Delhi: Just a fortnight back after the humiliating treatment meted out to them by the Delhi police, on May 28, the day India’s ‘new” Parliament was inaugurated, they had vowed to immerse their hard earned medals in the Holy Ganga at Hardwar. The last minute intervention by farmer leader Rajesh Tikait had persuaded them to put off their deadline to government to June 15.

Now, with the ultimatum issued by protesting wrestlers to the Union government drawing to a close, Bajrang Punia reiterated on Saturday, June 10that if the government is not ready to arrest Wrestling Federation of India (WFI) chief Brij Bhushan Sharan Singh, who facing sexual harassment allegations, by June 15, their protest would resume.

Following Tikait’s intervention a flurry of meetings with representatives of the union government followed last week. Following one such meeting with the Union sports minister Anurag Thakur, last week news reports on a minor’s complaint being withdrawn had re-surfaced. Today, Saturday June 10 they have stated that they will resume their protest if the government does not arrest Singh by June 15. Thakur, in his meeting with wrestlers earlier this week, had assured that the investigation into the allegations against Singh would be concluded by June 15, and a new WFI chief to be elected by June end. The written assurances from the government did not, however, mention Singh’s arrest.

Punia and other protesting wrestlers held a Mahapanchayat with Khap leaders in Haryana’s Sonipat on Saturday, June 10. They said they had shared the details of their discussions with the government with the Khap leaders at the Mahapanchayat.

“After June 15, we will decide where to start the protest again,” Sakshi Malik thereafter told NDTV  after observing that the government is not serious about arresting Singh.

While noting that efforts are being made by supporters of the government to spread the narrative that there is disunity among wrestlers, she said, “I want to make one thing clear, I, Bajrang, and Vinesh (Phogat) are one and will remain one.”

Furthermore, they also asserted that they will not participate in the Asian Games slated to be held later this year unless their demands are not met. “We will participate in the Asian Games only when all these issues will be resolved. You can’t understand what we’re going through mentally each day,” said 2016 Olympics medal-winning wrestler Malik.

The Delhi Police on Friday, June 9,  had taken wrestler Sangeeta Phogat to Singh’s official residence in Delhi to recreate the sequence of events at the scene of the crime that led to the sexual harassment of which he has been accused. While procedurally correct as per law, there is a question on the propriety of conducting this exercise while the accused politician was in residence.

The Delhi Police is likely to submit in court its report by next week, officials in the know of things said. So far, 180 people have been quizzed in connection with two FIRs filed in the case.

Sections of the media continue the misinformation campaign, however. Vinesh Phogat, Sangeeta’s sister, took to Twitter alleging that fake news is being spread about her sister’s presence at Singh’s residence on Friday, saying that she had gone there to work out a compromise with him. Vinesh clarified that Sangeeta was taken there by the police to recreate the scene.

“This is the power of Brij Bhushan. He is busy harassing women wrestlers by using his muscle power, political power and running false narratives. If the police arrests him instead of breaking us, there is hope of justice, otherwise no,” Vinesh wrote on Twitter in Hindi.

This is not the first time that fake news is being spread about protesting wrestlers. Earlier, it was said that they had ended their protest following the resumption of their regular duties in railways. The wrestlers dismissed them as mere rumuors, being spread with the intention to break them and defame them.

"I changed my statement because I was scared, my family is living under constant threat": father of the minor wrestlers’ complainant

"I changed my statement in Court because I was scared... scared for my family, daughter and myself... my family is living under constant threat"- this was the statement given by the father of the minor wrestler complainant while changing his statement alleging sexual harassment against Wrestling Federation of India (WFI) chief and Bharatiya Janata Party MP Brij Bhushan Sharan Singh. As per the report published by the Hindu, the father of the minor complainant has come out in the open about the threats he has been facing, and the amount of pressure they had been facing. The Hindu reported that the father of the said that he was threatened by people whose names he couldn’t reveal and “his family is living in intense fear”.

On late hours of Thursday, news of the minor complaint’s father issuing a “confession” hit the headlines, just a day after a false news was circulated that the minor has withdrawn her complaint. In the said statement, the father of the minor wrestler has also confessed to levelling a false sexual harassment allegation against Singh because he wanted “revenge” for his daughter’s rejection in the U-17 Asian Championship.

“I was filled with rage that my child’s one-year hard work had gone down the drain because of that referee’s decision in the final and I decided to take revenge,” he stated to PTI.

The father of the minor had also stated that his anger was directed towards the WFI chief because the referee was selected by Brij Bhushan Singh. “The federation appointed the referee (in the match against the minor wrestler which she lost). Who heads the federation? Who else should I be angry at?” PTI quoted the father of the minor, as saying. It is pertinent to noted, that it was based on the said complaint filed by the father of the minor that a second FIR was filed against Singh on April 28 at Connaught Place police station under IPC sections 354, 354(A), 354(D), 34 and section 10 of the Protection of Children from Sexual Offences (POCSO) Act.

The minor’s father, also the complainant, in the FIR had narrated in detail several instances when his daughter was allegedly sexually harassed by the WFI chief. He had claimed that Mr. Singh had “touched her inappropriately” and asked her to “support him, if she needed his support”. He had also alleged that his daughter was “completely disturbed and cannot be at peace anymore …sexual harassment by the accused (Singh) continues to haunt her”. The father also alleged that Brij Bhushan forcefully pulled his daughter towards him and molested her.

He also alleged that Singh had discriminated against his daughter. “To my utter shock, my daughter was hugely discriminated against,” he had said in the FIR.

However, after multiple reports claimed that the girl had withdrawn the complaint and a lot of confusion was created, the minor complainant’s father had told The Hindu that they recorded a fresh statement denying any incident of sexual harassment. However, it has been provided by the father that they have not withdrawn the complaint where they have alleged that Singh discriminated against his daughter.

He said, “We have not taken back any complaint, we have just recorded another statement before the magistrate on June 5, where we have alleged that he discriminated against her when it came to wrestling, and he did not sexually harass her,” the Hindu reported. On being asked why he filed the false case, the girl’s father said “he was fuelled by anger against him because his daughter lost in last year’s trial match”. “We are telling the truth so that it comes out while investigation is under way,” he added.

Elaborating on the same, he said, “My daughter was deliberately made to lose because of the staff that was on duty and the opponent, and everybody hailed from Delhi, which isn’t right according to the rules. I did complain regarding the discrimination to the Federation, but nobody heard me,” as provided by the Hindu. He said he was angry. “I felt disheartened and I was angry and why shouldn’t I be? Mr. Singh was biased against her, I had to sell my house to train my daughter. We only had three options: to get her married, educated or get her into sports. Now, we don’t know what her future will be.” “I understand that we made a mistake and we would like to rectify it,” he said, adding that the referee’s decision, in the trial match, was influenced by Singh.

“The police complaint that we have given, is somewhat true and partly false and we’ve cleared everything that is right and wrong,” he said. When the Hindu asked him about the allegations that his daughter isn’t a minor, he asserted that she is a minor and that they have provided the investigators with “legal documents pertaining to her identity”.

On Singh, the minor’s father said that he has “nothing against him, apart from the anger over how his daughter was treated”. “I will continue to stand with the wrestlers, who have always supported us since day one. What happened to the women is wrong,” the father of the complaint said.

Minor cannot ‘withdraw’ complaint against Brij Bhushan: Lawyer Vrinda Grover explains

Speaking to The News Minutes, and commenting on whether the reported retraction of allegations by the minor is contradictory, Vrinda Grover explained how this is the most normal, natural, and commonsensical thing to happen. Even if the minor did give another statement to the magistrate, lawyer and activist Vrinda Grover points out that calling this a “withdrawal” of the charges or complaint is a legal fallacy. She also said that since a large section of the media panders to the Union government’s power, such reportage creates confusion in the minds of people.

The minor and six other wrestlers had previously filed complaints against Brij Bhushan in April 2023. Speaking to TNM, Grover elaborated that statements by the minor wrestler, are deposed before a magistrate under Section 164 of the Criminal Procedure Code (CrPC). “All 164 statements carry evidentiary value because they are made to a magistrate and signed by the maker of the statement. But such statements still have to be examined before a criminal trial court for their veracity to be established. No complainant can simply give a statement contradicting their previous one and take back their complaint or allegations. Such reportage by the media is not only the wrong interpretation of the law but also confusing,” she said.

“No matter how many statements the complainant gives, she will have to step into the witness box before the court and speak under oath. Since here the complainant is a minor, she will be given the required privacy and witness protection, and her statements will be examined by the court to arrive at their validity. So this is not a “withdrawal” of a complaint or evidence of the accused’s innocence. Once an FIR is filed in a criminal case, it has to be adjudged by a court of law. A crime is considered a wrong against society and the state is duty-bound to prosecute the accused before the law,” she added

Unveiling the fear that victims and survivors face

Changed my statement because I was scared’

While most of the media is focusing on the “confession” given by the father of the minor complainant’s father, and the withdrawal of the sexual harassment allegations against Singh, not much attention is being given to real confession that the father made, which is the pressure and threats that the family has been facing since they came out with their story. The father has revealed that he has been living in fear and was threatened. “I changed my statement in court not because of greed but because I was scared... scared for my family, daughter and myself. Many lives have changed since we raised the allegations. I have to face the society and the people, I was threatened by people, whose names I can’t reveal, and my family is living in intense fear. If anything happens to me or my daughter, how will we live?” he had told The Hindu.

This was not the first time that the minor complaint and the six other women wrestlers have come out and raised the issue of threats of dire consequences and inducements of money were being made to them. Even on the third day of the protest, the two-time World Championship medallist Vinesh Phogat, who has been leading the wrestler protest, said threats were being made to 'break the resolve' of the complainants. Tokyo Olympics bronze medalist Bajrang Punia had also accused Singh's coterie of threatening the family of the minor, the result of which can be seen today.

“They are trying to threaten the minor victim and pressure is being put on the family members to withdraw the complaint. We have learned that one of the people threatening them is a coach who is a Dronacharya-award winner and the other is the secretary of the Haryana Wrestling Association. They went to her house and are putting pressure on the family and also offered money. They want her to take the complaint back. Those women wrestlers who have filed complaints against the WFI president are being threatened too,” Bajrang had said as had been reported by the Indian Express.

Yesterday, after the father of the minor gave the above-mentioned statements, Phogat tweeted the following on her Twitter handle: "Will the daughters get justice in the atmosphere of fear and intimidation???" Vinesh wrote

In another tweet, she said, "May these daughters not lose courage one by one because of the delay in this fight for justice??? God give courage to all."

It will not be a reach to say that considering the amount of state-sanctioned abuse, violence and pressure was being meted out to the protesting wrestlers, this particular piece of news did not surprise anyone, but rather re-iterated the power that men like Singh, and those supporting, him have in our country. The power exerted by this man is such that no arrest has been made, and rather it is the complainants only who are suffering. Besides, this this is not the first case where the complaint has redacted their statements, succumbing to the political and societal pressure put on them, as was witnessed in the Gujarat 2002, Vadodara’s famed Best Bakery case and the Sohrabuddin Sheikh extra judicial killings case. While in the first, Best Bakery, following a Registrar General, Supreme Court’s inquiry, the circumstances that caused prime witness Zahira Shaikh to commit perjury were revealed and she was ordered to serve a year’s of simple imprisonment, the Sohrabuddin case simply fell through the cracks with justice an elusive commodity.

It is a shame that a minor woman, who found the strength to fight against the wrongdoings committed by a powerful and politically backed man against her consent and her body, had to take a step back owing to the threats faced by her and her family.

Questions should now be raised over the continued delay in the arrest of the WFI chief and filing of the charge sheet. Additionally, a need for conducting an inquiry to probe the delay in the case has arisen, to investigate the circumstances leading to this situation where witnesses are being compromised.

Is the police bound by the statement of the father of the complainant?

It is essential to note that even after the father of the complainant has issued the above-mentioned statements, the Delhi police can still proceed with its probe. The statement of the father will not held to be “decisive” of the said case as one the FIR was lodged, the State took over the case and was pursuing it. Thus, the Delhi police is not bound to accept the statement of the father, and it can still pursue the case because the statement of the minor is already there on record under Section 164 of Code of Criminal Procedure (CrPC). Notably, a statement recorded before a magistrate under Section 164 is admissible in court.

The statement of the father will now act as an additional element which the police may look into, and if it finds that the case is false, then it can take action as required by law. Therefore, the power resides with the police to investigate whether this withdrawal by father of the complainant is genuine or coerced, and whether it amounts to perjury or not.

FIRs suggest wrestlers had informed PM about their repeated sexual trauma in 2021

“Even if a single allegation is proved against me, I will hang myself,” these were the words uttered by sexual harassment and POCSO accused Brij Bhushan Sharan Singh, who is the Wrestling Federation of India (WFI) president and BJP MP, after six adult women wrestlers and one minor wrestler came out with their accusations against him. But, now it has come to notice that even Prime Minister of India knew about the sexual harassment that women wrestlers were facing at the hands of Singh and his aides, and yet no attempt was made to remove Singh from his position.

As has been reported by the News Minute, it has been provided in the FIR filed by the women wrestlers that the complainant had met the Prime Minister in the year 2021 and informed him about the sexual harassment. She has further claimed that Narendra Modi had assured her that her “grievances” will be looked into by the Sports Ministry.

According to the FIR, the wrestler said, “I informed the Prime Minister about the repeated sexual, emotional, psychological, and physical trauma that was meted out to me and other female wrestlers by accused no. 1 [Brij Bhushan] in conspiracy with his close aides, to which the Prime Minister reassured me that such grievances will be looked into by the Sports Ministry and I will get a call from the Sports Ministry shortly.”

The complainant said that after her meeting with the PM, a show cause notice issued to her earlier was withdrawn, and Brij Bhushan and aides stopped exerting pressure on her for sometime, as was reported by the News Minute. However, she adds that the mental harassment resumed after a short interval. It is crucial to note here that there has been no mention made here that any attempt was made by the PM to remove Singh from his position of power even after knowing about the abuse. It is also pertinent to note that the Prime Minister has not yet issued anystatement regarding the sexual harassment allegations against Brij Bhushan, and had rather invited the accused to the inauguration ceremony of the new parliament building.

PM Modi once famously said, “Progress of women always gives strength to the empowerment of the nation,” and yet he falls truly short on implementing his words and protecting the women facing sexual harassment at the hands of a predator from his own party.

Even after all this, many other dramatic statements have been made by Singh, who has been time and again denying the allegations against him, calling it a political conspiracy. And now, the details of the key allegations put on him in the two official complaints filed with New Delhi’s Connaught Place police station on April 28 have come out, and they are disturbing and traumatising to say the least.

It is pertinent to note that both the FIRs cite IPC Sections 354 (assault or criminal force to woman with intent to outrage her modesty), 354A (sexual harassment), 354D (stalking) and 34 (common intention) that carry a jail term of one to three years. The first FIR covers the allegations of six adult wrestlers and also names WFI secretary Vinod Tomar. The second FIR is based on the complaint of a minor’s father and also invokes Section 10 of the POCSO Act which entails five to seven years of imprisonment.

The incidents mentioned allegedly took place in India and overseas from 2012 to 2022.

The seven women have put on record multiple incidents of sexual harassment and misconduct that included groping, inappropriate touching and physical contact — during tournaments, at warm-ups and even in the WFI office. At least two instances of demanding “sexual favours” in lieu of professional assistance along with more than 10 episodes of inappropriate touching, molestation that includes running hands over breasts, touching the navel have been made public in a report by the Indian Express. Several instances of intimidation including stalking and a shared sense of fear and trauma also form the key allegations in two FIRs filed.

• “Since the accused (Singh) was always on the lookout to engage in inappropriate talk/gestures…girls, including myself, collectively agreed to not go alone for breakfast, lunch or dinner”.

• “While I was standing in the last row (for team photograph)… the accused (Singh) came and stood alongside me. I suddenly felt a hand on my buttock. I was stunned by the actions of the accused (Singh) while they were highly indecent and objectionable and without my consent… when I tried moving away, I was forcibly held by my shoulder.”

• “On the pretext of getting a picture clicked with me, he pulled me towards him by my shoulder… to protect myself, I tried moving away from the accused (Singh)… Since I was not comfortable with the behaviour of the accused of forcing me, I, in order to escape, (his) clutches, repeatedly resisted his attempts and tried to push him away to which he (threatened): “Zyada smart bann rahi hai kya…aage koi competition nahi khelne kya tune?” (Acting too smart? You don’t want to be considered for tournaments in the future?)

 FIR 2- Allegations put forth by the minor wrestler

The minor’s complaint, filed by her father, alleges that his daughter was “completely disturbed and cannot be at peace anymore …sexual harassment by the accused (Singh) continues to haunt her”. The father also alleged that Brij Bhushanforcefully pulled his daughter towards him and molested her. Brij Bhushan then allegedly told her: “Tu merko support kar, mei terko support karunga, mere saath touch mein rehna” (If you support me, I will support you. Be in touch with me).

As per the News Minute, the father of the minor complainant also mentions that when his daughter refused Brij Bhushan’s advances, he allegedly threatened to stifle her chances at the upcoming trials for the Asian Championship, which he later did by clubbing her in the same category as other strong contestants at the trials, against the general practice of giving preference to the medal holder in the national championship. 

The complainant further details how Brij Bhushan called his daughter to his room and tried to initiate “forceful physical contact”, from where she ran, shell-shocked.

The minor athlete alleged that Singh held her tight for a photo. She mentioned that he also pressed her shoulder and purposefully touched her inappropriately. She added that she explicitly told him not to stalk her and that she was not interested in having any physical relationship with him.

• “Holding her tightly, pretending to get a picture clicked, the accused (Singh) squeezed her towards himself, pressed hard on her shoulder and then deliberately…brushed his hands against her breasts”.

• “She clearly told the accused (Singh) she had already told him that she was not interested in having any sort of physical relationship and that he should stop stalking her…”

Based on this complaint, Brij Bhushan has been charged under Sections 354 (assault or criminal force to woman with intent to outrage her modesty), 354A (sexual harassment), 354D (stalking), and 34 (common intention) of the Indian Penal Code, and Section 10 of the Protection of Children from Sexual Offences Act (POCSO). The said Section 10 of the POCSO Act would lead to five to seven years of imprisonment. The minor athlete stated that the harassment took place between 2012 and 2022 in both India and abroad. Following this FIR, Brij Bhushanhad claimed that the POCSO Act is being misused and said he wants it amended.

A decade long pattern of abuse

These women have endured years of trauma, of living in fear and having their autonomy and dignity snatched away, of having no respite from the preying hands of men in power. From being sexually assaulted during training to having a man slide his hand inside their t-shirt under the guise of "checking her breath" to having their body touched without their consent while posing for a photograph, the complainants' accounts demonstrate the level of authority Singh purportedly possessed and exercised in the federation, establishing this pattern to his sexual harassment while enjoying impunity. It is evident from the narratives presented above that time and again Singh used his clout to prey on the survivors, touching them on various pretexts, and isolating them whenever possible to elicit sexual favours. Today, these women are fighting on their behalf, as well as on the behalf of those women who are forced into silence about their stories, against a man who wields such power that even the Prime Minister is silent. From what should have been an act of justice, putting a guilty man behind bars, has become a struggle in which they are being manhandled, dragged, abused, and booked for disrupting the law and order of India!

Who and what are these women battling? On the face of it, they are fighting against a man guilty of committing non-consensual acts on their bodies. But they are also battling an invisible and rigid structure of impunity and abuse of power where a string of powerful men are standing behind one guilty man.

Protesting wrestling champs meet union sports minister, 2nd meet with govt in 5 days

On the morning of June 7, a crucial meeting was held between the protesting wrestlers and Union sports minister Anurag Thakur at his residence, after the previous meeting of the wrestlers with the Union Home Minister, Amit Shah did not yield any positive result. On June 3, a delegation of grapplers and their coaches had met Amit Shah, who had advised them to “allow the law to take its own course”. The government, which have been given time till June 9 to take action against BJP MLA and WFI chief Brij Bhushan Sharan Singh by the farmer leader Rakesh Tikait, have continued with its effort to strike a deal with the protesting wrestlers.

Past midnight Tuesday, June 6-7, Thakur tweeted that the government was willing to have a discussion with the wrestlers over their issues. “I have once again invited the wrestlers for the same,” he had tweeted. The meeting was called by Thakur to discuss the “issues” that the wrestlers had as well as their long-standing demand for arrest of Singh over the sexual harassment and POCSO charges levied against him.  Even after facing so many hardships, the wrestlers have been adamant that they will continue their agitation till Singh, who they have accused of sexual harassment, is arrested.

Before the meeting, Sakshi Malik, who is one of the wrestlers leading the said protest, said that they will not agree to just about anything that the government had to offer. She clarified that their protest would continue till their demand for quick action against Singh was met. Malik has led the protracted agitation against Singh, a powerful Rajput leader from Uttar Pradesh, along with Bajrang Punia and Vinesh Phogat.

After the decision to attend the meeting was taken, the wrestling coach and Dronacharya awardee Mahavir Singh Phogat said that the government’s offer for talks was a good sign. “The government has woken up after so many days. A solution must come out now,” as was reported by the news agency ANI.

“The wrestlers look positive in their approach. We are hoping for a resolution today. The idea is that the sport should not suffer,” said a sports ministry official ahead of the meeting, as reported by the Siasat Daily.

Bajrang Punia, Rio Olympic bronze medallist Sakshi Malik and her wrestler husband Satyawart Kadiyan, were a part of the meeting at the minister’s house. Notably, Bhartiya Kisan Union (BKU) leader Rakesh Tikait, who has been supporting the wrestlers in their protest, was not a part of today’s meet.

As reported by the Siasat Daily, in their meeting with Thakur, the wrestlers put forth five demands to the sports minister which are as follows:

  • The wrestlers stressed on their primary demand that the accused WFI president be arrested on the charges against him.
  • Free and fair elections to be held at the WFI as well as the removal of corruption-accused leaders and better management.
  • A woman be made the head of the wrestling body.
  • Brij Bhushan and his family be kept away from the wrestling body and its elections.
  • Revocation of the FIR filed against them for violation of law and order, after a brawl with the police amid their march towards the new Parliament house on the day of its inauguration.

After the second round of meetings between the government and protesting wrestlers in a space of five days, it has been reported that the government is willing to accept most of their demands, yet the arrest of Singh remains a major bone of contention. No official statement has yet been evinced from the government after the said meeting. Since the wrestlers have refused to bow down regarding these demands raised by them, all eyes are on the government, to see whether they will stand behind the daughters of India, or against them.

Protests and Mahapanchayats announced in support of the protesting wrestlers, 5 days given till medals are immersed in Ganga River

Yesterday, on May 30, the protesting wrestlers, Vinesh Phogat, Sakshi malik, Sangeeta Phogat, and Bajrang Punia along with others, had issued a statement that as a mark of protest against WFI chief and BJP MP Brij Bhushan Sharan Singh over sexual harassment and POCSO ((Protection of Children from Sexual Offences) allegations as well as the manhandling that they had to face at the hands of Delhi Police during their peaceful protest, they were going to immerse their medals in the Holy Ganges river. 

The wrestlers had reached Haridwar at 6 pm to immerse their medals, from where heart-wrenching videos of wrestlers weeping over their plight were watched by millions on social media. Almost an hour later, farmer leader Naresh Tikait reached the spot and urged them emotionally not to throw away their medals. Tikait intervened, drew their medals from them, and sought a five-day time from the protesting grapplers to address their grievances.

The suffering and the plight of the protesting wrestlers, who have had to endure systematic violence, ignorance and apathy at the hands of the Delhi police and representatives of the union government whose radio silence around the champions’ protests has been telling. It has also been a wake-up call.

The May 28 crass brutality of the Delhi police (that is controlled directly by the ministry of home affairs under the union government) has shaken many who were previously silent. The contrast could not have been more stark: the cloak of powerful immunity accorded to the POCSO accused BJP MP, Brij Bhusan Singh who triumphantly participated in the inauguration of the “new Parliament” on an invitation from the Prime Minister and the brute manhandling and misbehaviour with the women Olympic champions protesting for their dignity and rights. Both on Sunday May 28.

Many organisations, political leaders, sportspersons, and celebrities have come out in support of the protesting wrestlers.

Rajya Sabha MP Kapil Sibal slammed the government over the issue of allegations of sexual harassment levelled by women wrestlers against WFI president Brij Bhushan Singh, and asked whether POCSO and immediate arrest apply to all accused other than Singh because he belongs to the BJP. Kapil Sibal is the senior advocate who has previously represented the protesting wrestlers when they had approached the Supreme Court to demand that a FIR be registered against Singh.  While it took an order from the Supreme Court to even get an FIR filed against Singh, the same police was quick and prompt in booking the wrestlers for “violating law and order,” within ten hours! This FIR was filed under Indian Penal Code (IPC) sections 147, 149, 186, 188, 332, 353, Section 3 of the PDPP Act, said Delhi Police.

Naresh Tikait, the head of Balyan khap, said a 'mahapanchayat' will now be held in Muzaffarnagar's Soram village on June 1 to discuss the ongoing protest by wrestlers against WFI. Tikait further provided that several representatives of different khaps and their heads hailing from Uttar Pradesh, Haryana, Punjab Rajasthan and Delhi will be participating in the mahapanchayat to decide the next course of action in the wrestlers protest.

The Samyukta Kisan Morcha, an umbrella group of nearly 40 farmers’ unions, on Tuesday called for nationwide demonstrations on June 1 to support the protesting wrestlers, Sabrangindia has reported.  The Samyukta Kisan Morcha said that nationwide protests will be held to “secure the democratic right to protest by the Indian wrestlers and all other sections of society” and demand Singh’s arrest. “The morcha will coordinate with platforms of trade unions, women, youth, students and all other sections, including intellectuals, to stage demonstrations across India,” it said.

The Democratic Youth Federation of India (DYFI) and the Students Federation of India (SFI) jointly declared a nationwide protest in support of the wrestler’s protest from June 4. "DYFI and SFI demanded the immediate arrest of Brij Bhushan and to withdraw all false cases against the wrestlers immediately. Through this protest, we demand that the Prime minister should apologize for the police violence unleashed upon wrestlers," DYFI national president AA Rahim said.

The sport fraternity finally speaks up- National and International

In a statement on the night of May 30, the International Olympic Committee has condemned the way India's top wrestlers are being treated during their ongoing protest. In their statement, the IOC has "urged the safety and wellbeing of these athletes" and called for "a speedy conclusion" of the investigation. The IOC spokesperson from Lausanne, Switzerland, also said that the “treatment” meted out to the athletes over the weekend, when they were manhandled and detained for hours, was “very disturbing.” The IOC also urged the IOA, headed by P T Usha, which has been conspicuous by its silence so far, to “protect the athletes

It further said that it had been in close contact with United World Wrestling (UWW) - the international organisation governing amateur wrestling - over the situation.

The UWW had also, prior to the IOC, issued a statement on Tuesday saying that it was following "with great concern" the wrestlers' protests "over allegations of abuse and harassment by the president of the Wrestling Federation of India (WFI)".

"It expresses its disappointment over the lack of results of the investigations so far," the statement said and added that the UWW would hold a meeting with the wrestlers to inquire about their safety and "reconfirm our support for a fair and just resolution of their concerns".

The UWW also said that it might suspend the WFI if its upcoming elections were not held on time. As provided by the Indian Express, the IOC and the United World Wrestling are considering holding a joint virtual meeting with the protesting wrestlers.

A veteran of the cricketing fraternity of India, cricketer, Anil Kumble also joined other big sportspersons like Neeraj Chopra, Abhinav Bindra, Sunil Chhetri, who have voiced their support for wrestlers and expressed disappointment over how they were treated on the day India celebrated its new Parliament. Other cricketing icons of the country, even playing the popular IPL tournament that ended only on May 29 post mid-night have been conspicuously silent.

Support flows in from the film industry

A number of celebrities have also expressed their support for the protest, despite their reputation for being oblivious to their surroundings and indifferent to protests and societal movements. The ongoing wrestlers' protest has captured the attention of many people working in various film industries across the country, as more and more people express their support through social media platforms and in interviews. Senior actor Naseeruddin Shah recently expressed his support for the protesting wrestlers and wondered if a film about these athletes would be made. Shah also stated that the Hindi film industry was never one to roll up its sleeves and confront problems head on.

"When has the Hindi film industry ever rolled up its sleeves and tackled a subject which is crying out to be tackled? Will anyone make a film on these girl wrestlers who brought us medals...? Will anyone dare make a film? Because they are scared of the repercussions. It is nothing new that the Hindi film industry is keeping mum on important issues, they always have," the actor told PTI in an interview.

Sharing a collage showing security personnel detaining wrestlers Sakshi Malik, Vinesh Phogat and Sangeeta Phogat by using force, Malayalam actor Tovino Thomas wrote on Instagram, "They are the ones who uplifted our reputation in international sports arenas. They gave colours of success to the hopes of an entire nation! Keep aside their achievements and accolades, but there is a justice that each and every citizen of this nation deserves. They should not be deprived of that justice. They should not be defeated just because those standing on the opposite side are strong. They should be heard and their demands should be considered. Justice should not be delayed, never be denied! Jai Hind."

Renowned Tamil director Pa Ranjith, filmmaker Onir, actor Kamal Hassan, actor Swara Bhaskar, actor Ritika Singh, Uorfi Javed, actor Vidyut Jammwal and Malayalam director Anjali Menon too had recently extended solidarity with the protesting athletes.

The government saves face, spreads misinformation

The BJP government, which is at the centre and has been indirectly shielding Singh from having to bear any consequences provided under law, has been keeping mum about the whole issue of the wrestling protesters. The Congress claimed the BJP's slogan of 'Beti Bachao, Beti Padhao' now means 'Beti BJP ke netaon se bachao' (save daughters from BJP leaders)' and also hit out at Prime Minister Narendra Modi for not making an appeal to the protesting wrestlers urging them not to immerse their medals in the Ganga.

The month-long protest of wrestlers even forced union minister Meenakshi Lekhi to do a little jog --run away from questions on the matter by media persons. She was seen walking briskly and then running when asked to comment on the issue. "Chalo, chalo, chalo," the minister said as she was rushing towards her car. The union minister was chased by a media reporter who kept asking for comments on protesting wrestlers. "What do you have to say on the protesting wrestlers?" she was asked. To this, Meenakshi Lekhi responded that the ‘legal process is going on’.

A similar statement was also given by Smriti Irani, the union minister of Women and Child Development, urging the protestors to wait for the legal process. Ironically, the same government that has on multiple occasions supported the taking law into their own hands, be it the extra-judicial killing of accused and convicts, declaring any dissenter as terrorist, or demolishing “illegal” structures even as the court cases are ongoing, are now appealing for the citizens and media to wait till the law take its course.

It is essential to note that while wrestlers have had to fight a battle for exercising their rights on a daily basis, Singh has been brazenly giving interviews, and issuing statements. Reacting to the intention of the protestors to immerse their medals in the river, Singh said that the wrestlers immersing their medals in the Ganga would not make the court "hang" him.

"Immersing your (wrestlers) medals in Ganga won’t make the court hang me. Present your proof to the court, and if they choose to hang me, I will accept,” WFI chief Brij Bhushan Singh said while addressing a gathering.

A particular group of people are also busy making up stories and controversies regarding this whole issue. Earlier today, a news was circulating stating that the police had not found sufficient evidence in favour of the allegations levelled against Singh by female wrestlers and that it will submit the report within 15 days. As the news came out in the media, the Delhi Police took to Twitter to say: “It is clarified that this news is “wrong” and the investigation into this sensitive case is under progress with all sensitivity.”

Meanwhile, another attempt to build up a controversy is being made, with some individual claiming to be the uncle of the "minor" girl who has accused Brij Bhushan of sexual harassment, Amit Pehlwan, has been hitting out at the protesting wrestlers, saying that they are "misleading" his family and using them to frame Brij Bhushan Sharan Singh. As has been alleged by Amit, the wrestlers are carrying out a scam as his brother's daughter's (niece) age has been changed to 16 years, so that the grapplers can "wrongly utilise" the POCSO Act.

The issue of sexual harassment at the workplace, raised clearly and sharply by India’s Olympic Women champions needs to be faced head on. It is an issue quite commonly brushed aside as an aggressive union government is even at this moment attempting to do.

Farmers to hold countrywide demonstrations in support of women wrestlers: SKM

An extended coordination committee meeting of the Samyukta Kisan Morcha (SKM) at which  Bajrang Punia representing the wrestlers action committee attended as a special invitee, decisions were taken to actively participate in and support the wrestlers struggle demanding the arrest of BJP MP, Brij Bhushan Singh.

Beginning June 1, 2023, all India level mass meetings and demonstrations will be held in all districts and tehsil centres of the country. The protests across India are being held to protect the constitutional right to protest of all citizens and demanding arrest of BJP MP Brij Bhushan Sharan Singh. SKM will coordinate with platforms of trade unions, women, youth, students and all other sections including traders, intellectuals and social movements to make this action massive and successful.

Thereafter, on June 5, 2023, the day when Mahanths and RSS workers holding rally in support of the “accused rapist and criminal Brij Bhushan Sharan Singh MP” in Faizabad, SKM will give call to expose his criminal conduct so far and burn his effigy across India up to village and town level.

Thereafter, the SKM will convene a physical meeting of the general body immediately after June 5, 2023 at New Delhi and decide future plans of actions to continue the struggle.

Protesting wrestlers will immerse their medals in the Ganga, an indefinite hunger strike will follow

Aggrieved by the ill treatment and systematic violence meted out to the protesting wrestlers on May 28, they have now decided to throw their medals into the Ganga River in Haridwar on Tuesday, May 30 at 6 pm. In a statement put out by the wrestlers on their personal twitter handles, they have informed India and Indians that after throwing the medals, they will then sit on an indefinite hunger strike at India Gate, New Delhi. This comes after the wrestlers were brutally and forcefully dragged and detained by the Delhi police, as they prepared to go from Jantar Mantar ,where they have been protesting peacefully since April 23, 2023, to hold a sit-in `Mahila Samman Mahapanchayat’ near the new Parliament Building.

The protesting wrestlers were summarily dragged, forcibly pushed to the ground, manhandled, thrown into buses and removed to unknown destinations while the new Parliament building was being inaugurated, just less than two kms away. Later, an FIR against them was filed for violation of law and order.

Today, all the top wrestlers, including Sakshi Malik, Bajrang Punia and Vinesh Phogat, put out a statement in Hindi on their respective social media accounts, saying they would go to Haridwar and immerse their medals in the river. “We will throw our medals in river Ganga in Haridwar today at 6pm,” said the wrestlers, who have been protesting against the Wrestling Federation of India (WFI) president Brij Bhushan Sharan Singh over sexual harassment allegations.

Furthermore, the wrestlers announced their decision to go on a hunger strike till death by stating, “These medals are our lives, our souls. There would be no reason to live after throwing them in the Ganga today. So, we will sit on an indefinite hunger strike at India Gate after that.”

In the statement, the wrestlers have criticised both the President, Draupadi Murmu and Prime Minister, Narendra Modi for failing to listen to their complaints and turning a blind eye to their plight. The wrestlers condemned President Draupadi Murmu's apathy, claiming that even though she is a woman, she did nothing when Delhi Police manhandled and detained them. The statement read "It came to our mind how to return the medals to our President, who is herself a woman. Our conscience said NO, because she is sitting just two Km away from us and has not, did not utter a single word," the statement read.

They also expressed anguish at the Prime Minister Narendra Modi for prioritising the opening of the new Parliament and inviting WFI chief Brij Bhushan Sharan Singh, who is a POCSO accused, to the occasion, while the protesting women wrestlers have had to face so many hardships. "The Prime Minister who calls us our daughters did not even show his concern for wrestlers. Rather he invited the oppressor (Brij Bhushan) to the inauguration of the new Parliament building. He even posed for photographs in bright white clothes. We have been stained by this brightness," the statement said.

On August 18, 2016 the same Sakshi Malik had received accolades from Modi when she won the Olympic Bronze: a medal at the Rio Olympics, clinching bronze in the Women’s Freestyle 58 kg category with a spirited comeback victory over Aisuluu Tynybekova of Kyrgyzstan.

Unprecedented scenes had enfolded on Sunday when the Delhi police had dragged and manhandled the Olympic and world championships medal-winning players when the wrestlers and their supporters breached the security cordon ahead of their march towards the new Parliament building for the planned women's 'Mahapanchayat'. It was reportedly stated by the police that they acted harshly since the wrestlers did not have permission to move towards the new Parliament building, hours after it was inaugurated by Prime Minister Narendra Modi! In an obviously violent and brutal tussle, the protesting wrestlers and their supporters were taken to different locations in the national capital and later released after having FIRs filed against them. Other senior and younger women’s activists were also detained and released.

It is essential to note that not only did the police use a disproportionate amount of force against the wrestlers and pushed them into buses, the police officers also cleared the protest site by removing the cots, mattresses, coolers, fans and the tarpaulin ceiling along with other belongings of the grapplers. The Delhi Police then also stated that it will not allow the wrestlers back into the protest site.

Before this, the Delhi police had tried to garner a local school under the AAP-ruled Municipal Corporation of Delhi to be converted into a temporary “jail”. Permission for that had been refused by the Mayor.

The People’s Union for Civil Liberties (PUCL) has strongly condemned the brutal manner by which the Delhi Police forcibly arrested the women wrestlers yesterday, May 28, 2023, as they prepared to go from Jantar Mantar where they have been protesting peacefully since April 23, 2023, to the `Mahila Samman Mahapanchayat’ near the new Parliament Building. Without any sense of respect to their contribution to Indian sports, protesting wrestlers, all champions -- Olympic medalists Bajranj Punia and Sakshi Malik, and Asian Games Gold medalist, Vinesh Phogat, and Sangeeta Phogat, who were sitting in the 35th day of their dharna, demanding the arrest of Brij Bhushan Sharan Singh and others were, summarily dragged, forcibly pushed to the ground, manhandled, thrown into buses and removed to unknown destinations.

Soon thereafter, the protest site at Jantar Mantar where the women wrestlers have been protesting since 23rd April, 2023 had the tents dismantled, their belongings including their beddings and coolers thrown away and the protest site cleared by the Delhi police.

Ironically, even as the wrestlers were being forcibly removed from Jantar Mantar, the country’s Prime Minister Narendra Modi was making grandiose announcements in the newly opened Parliament building about India not only being the mother of Democracies but also being a model for other democracies!

The PUCL statement issued by Kavita Srivastava, president and Dr. V. Suresh, general secretary states that “the aggressive and violent action of the Delhi Police stands in contrast to the reluctance of the Central Government to act against the six times BJP MP and three times ex-President of the Wrestlers Federation of India, Brij Bhushan Sharan Singh, for sexual violence against young women wrestlers. This, despite all the seven complainant women wrestlers, including a minor, recording their statements before the concerned Judicial Magistrate under section 164 of the Criminal Procedure Code.”

Apart from the wrestlers, all the groups who lent their support to the demand of arrest of the accused and came out to participate in the Mahila Samman Panchayat, outside the new Parliament building in several hundreds, were detained.   They included former MP Subhashini Ali, Annie Raja, Kawaljeet Kaur and Dipti Bharti of the National Federation of Indian women, Poonam of Pragatisheel Mahila Sangathan, Sucheta De of CPIML (L) and AICCTU, Jagmati Sangwan and Maimoona Mollah of AIDWA, activists Maya John and others of CSW, Purogami Mahila Samiti and AIMSS activists Ritu Kaushik and others, Krantikari Yuva Sangathan activists, JNU students, AISA, NSUI activists were also picked up.

Supporting farmer leaders were either detained in Haryana or Punjab itself or picked up from the protest site at Tikri, Singhu and Ghazipur border. Those picked up from the Haryana borders of Singhu and Tikri included Charanjit Kaur Dhulia, Davinder Kaur Hardaspura, Gurnam Singh Chaudhuri, Amarjit Singh Mohri, Ravi Azad and Jagdeep Aulakh. They also arrested leaders from the Binen Khaps and others in Haryana. Several journalists and bloggers were also picked up, notable amongst them was freelancer Mandeep Punia. Lawyers who were trying to provide legal assistance, including Vertika Mani Tripathi, Abhishist Hela and others, were kept in the dark and not allowed to enter the police stations and meet the detainees. The detainees were kept in more than a dozen police stations, mostly in the outskirts of Delhi.

What was very disturbing was that the four wrestlers were separated and sent to four different police stations and subjected to intimidation and to illegal detention and isolation. The whole idea was to break their morale and demotivate them from returning back to the protest. Even as we release this Press Note, they and other women activists continue to be under illegal detention.

The strong-arm tactics used by the BJP led Central Government through the Delhi police against the women wrestlers ironically exposes the lie of the BJP government as being committed towards justice for women, protecting their dignity and democratic rights.  What is clear is that:

  1. The BJP Government and the Delhi police showed its true anti-women and anti-democratic character by preventing and trying to crush what has been a very peaceful, violence-free and orderly protest of women wrestlers whose only request is to enforce the law against a person who has sexually inflicted violence on them, including ensuring the mandatory arrest of the perpetrator under POCSO.
  2. It is very much a part of the fundamental right of the women wrestlers to peacefully demand accountability and express their protest against the inaction of the Delhi police under the Ministry of Home Affairs to arrest Brij Bhushan Sharan Singh. The women wrestlers have been demanding action since January, 2023. No justice came their way, despite being subjected to two illegal Complaint Committees regarding sexual harassment. It was only thereafter that on 23rd April, 2023 they were forced to make their grievances public by staging their protest in Jantar Mantar. The deathly silence of the ruling Modi regime continues to date.
  3. The reluctance to act on the part of the Modi government to enforce the law against wrongdoers from its own ranks is made clear when we see that the FIR itself came to be lodged only when the wrestlers filed a petition in the SC and the CJI’s Bench ordered registration of a FIR.
  1. What is indicative and best exemplifies the authoritarian, anti-women and anti-democratic mind-set of the Central Government and the Delhi police to the citizen’s fundamental right to protest is the action of the Delhi police who dubbed the protest of the women wrestlers as constituting anti-national act, as it was marring the day when the PM was inaugurating the new Parliament!

How the protests of the women wrestlers seeking fair implementation of the law against a sexual predator can ever constitute an `anti-national’ act belies logic and only exhibits the ignorance to constitutional norms and proprieties.

Vinesh Phogat very poignantly summed up the mood of the protestors in her statement published by the Hindu to the effect that,

“The accused is roaming free, he is being sheltered by the government and we athletes who won medals for the country are now being put in jail for demanding justice for the country’s daughters”.

The civil liberties platform has called upon all citizens groups, women’s, farmers, students, workers, lawyers and other groups to continue being united and demand justice for the agitating women wrestlers and unequivocally condemn the brute force used by the Delhi police to arrest the women wrestlers and others and dismantle their protest site. The PUCL has also demanded that the wrestlers protest site be restored and they be allowed to peacefully agitate by exercising their democratic rights. Besides, all criminal cases registered today, against the women wrestlers and activists be dropped and Brij Bhushan Sharan Singh be immediately arrested.

Strict action should also be taken against those police functionaries who indulged in illegal action and brutal use of force against peaceful protestors.

For a country that claims to support women empowerment, that has had a rich history of women led movements and resistance, the current heart breaking state of affairs with how India’s champion women wrestlers protest is being handled by authorities and police officers reflects a stark and contradictory reality. Over the past 10 days, the women wrestlers of India have been staging a protest at Jantar Mantar, New Delhi, against the Wrestlers Federation of India chief, Brij Bhusan Singh, alleging him of sexual harassment. Brij Bhushan Sharan Singh is also a Bharatiya Janata Party (BJP) MP from Uttar Pradesh.

Only last week, on April 28, the Delhi Police had told the Supreme Court that they will be filing an FIR based on the sexual harassment charges being levied by seven women wrestlers, including a minor, against the WFI chief. It is important to note here, the protesting wrestlers had to move to the Supreme Court seeking the registration of FIRs against Singh. While the said move by the Delhi police only after the women had approached the Supreme Court, was still seen as a ray of hope, the hardships, there has been no let up for the protesting women champions against the impunity enjoyed by a politically influential man in authority.

On May 3, late-night trouble erupted for women champions who have been camping here day and night, at Jantar Mantar. India’s women champion wrestlers were reportedly abused by Delhi Police officers. Several videos of the wrestlers have gone viral on social media, showing them being surrounded by a couple of cops who misbehaved with them. It is even claimed that male police officer pushed women wrestlers without any women officer being present and that two protestors have even been injured. A drunk cop, according to the wrestlers, misbehaved with them, hurled abuse at female wrestlers, and even manhandled them at the protest site. The wrestlers went live on their respective social media accounts to report the incident.

According to the wrestlers, the Delhi Police had physically stopped them from replacing mattresses that got wet due to rain, resulting in the scuffle. "The mattresses got wet due to rain, so we were bringing folding beds for sleeping, but the police did not allow that. Drunk policeman Dharmendra abused Vinesh Phogat and got involved in a scuffle with us," former wrestler Rajveer told PTI.

In one of the videos, Vinesh Phogat stated that the officers of the Delhi Police hit her brother on the forehead and that he was taken to the hospital for treatment. According to the wrestlers, two of them (Dushyant and Rahul) were injured on their foreheads during the commotion. According to Bajrang Punia, who has been supporting the women wrestlers in their fight since the beginning and has been a part of this protest, this whole commotion occurred as some female wrestlers attempted to bring cots to the protest site due to inclement weather in Delhi, but cops refused to let them. It was alleged by Vinesh that when they brought the planks and foldable beds, a lone drunk male policeman, “Dharmendra”, started pushing the wrestlers around, without any female policeman present.

While addressing media persons late at night, Vinesh said, "We went to collect some cots from our vehicles as it's all wet out here. Some cops stopped us and started troubling us. There was no female cop nearby and these male cops started pushing us. Who gave them permission to push female protesters?" Vinesh later asked, "We are being treated so badly for raising our voices. Is this the price of winning medals for the country? If this is the case then I pray no one wins medals..."If they wish to kill us, then let them shoot us," said Vinesh, who can crying inconsolably in the video uploaded by the PTI. "Did we win medals for the country to see this day? We have not even eaten our food. Does every man have a right to abuse women? These policemen are holding guns, they can kill us," an emotionally-drained Vinesh further said.

Sakshi Malik also said, "We are not going to leave this site till our last breath. The antics of Delhi Police are as if we are criminals. There is no respect for women in their eyes. We are not going to leave till we get justice."

"Where were female police officers? How can the male officers push us like that? We are not criminals. We do not deserve such treatment. The drunk police officer hit my brother," Bajrang Punia said while talking to reporters of PTI. Wrestler Bajrang Punia's wife Sangeeta, who is also a wrestler, said she was pushed around by policemen.

Later, Bajrang Punia urged his countrymen to come to Delhi in large numbers to support their protest. "This is my humble request to my countrymen. Please arrive in large numbers in Delhi. We are fighting for your daughters' dignity. Please join us here and show your support," the Tokyo Olympics medalist said, according to PTI.

Punia also exhorted farmers and members of the public to reach Jantar Mantar in their support. "I request everyone to reach Delhi by Thursday morning. This is the time. If not, then when? This is a question of the dignity of our daughters. People like Brij Bhushan are roaming freely despite being criminals and all this is happening to us," he said.

Delhi Police’s Justifications, denial of having beaten any protestors

Based on the official statement from Delhi's ruling Aam Aadmi Party (AAP), it was their decision to provide the protesting wrestlers with cots in view of the ongoing rainy spell in Delhi as rains continue to lash in the national capital. Senior AAP leader and MLA Somnath Bharti had said, "On the instructions of Chief Minister Arvind Kejriwal, we have decided to send foldable cots to the protest site. We hope that this small help will make this tough time a little bit easier for the wrestlers."

Meanwhile, the Delhi police claimed that it was because AAP MLA Somnath Bharti arrived at the protest venue with folding beds without permission that the “scuffle” took place. "Somnath Bharti brought folding beds to the protest site in Jantar Mantar. Since there was no permission, we didn't allow it, so some of the supporters of the protesting wrestlers tried to take out the beds from the truck and this led to an altercation..." Deputy Commissioner of Police (New Delhi) Pranav Tayal provided

"We have told the wrestlers to give complaint on their grievances and will take appropriate action...medical check-up of the Policeman on whom they've raised allegations, being conducted," DCP Tayal added further.

The police officers have now claimed that the protestors wrongfully restrained a police man after accusing him of being drunk. The police has also denied that the protestors were beaten.

Footage from the venue also showed the wrestlers arguing with uniformed Delhi Police officers.  "CCTV cameras must be present. The footage will prove it," protesting wrestler Bajrang Punia told reporters after the claims made by the police, of not having beaten anyone. He also stated that Bharti was not present when the commotion occurred, and that the wrestlers had ordered the beds.

Following the scuffle between protesting wrestlers and police officers, the Delhi Police have tightened security around Jantar Mantar. Allegedly, a large police force has also been deployed on the scene, and the entire area has been barricaded.  As provided by NDTV, the police have now sealed the protest site at Jantar Mantar, thereby stopping the regular flow of well-wishers who were coming to meet the protesting wrestler.

It is pertinent to note that the protesting wrestlers have been accusing the Delhi Police of a lack of support, claiming that the Police has been simply dragging its feet on the case because neither Singh nor the women who have complained of sexual harassment have been summoned for questioning.

Proceeding in the Supreme Court

On May 4, the Supreme Court heard the case today to take stock of the investigation and pass any required order regarding the security. It was reported by Solicitor General Tushar Mehta, who was representing the Delhi Police, stated that “proper security” has been provided to minor complainant. They further provided that an individual assessment of all petitioners was conducted by then, and while they found no threats, they have agreed to give the six complainant security with respect to protest. It was further also stated that that three armed police personnel were deployed in Jantar Mantar for the three who are stationed there and round the clock security is there for all the six. And on the watch of all these, the late night assault on May-3 and 4 takes place!

Significantly, senior advocate Hooda, representing the women champion petitioners mentioned clearly before CJI Chandrachud that the wrestlers had been heckled by drunk policemen at night, to which he replied that they can approach the jurisdictional courts and the Delhi High Court with this matter, and that the Supreme Court will not be hearing this issue!

Supporters detained, attempts to gag dissent

According to the Delhi police, three people have been detained following Wednesday's incident: AAP MLA Somnath Bharti, Rajya Sabha MP Deepender Hooda, and Delhi Commission for Women (DCW) Swati Maliwal. According to a video that have gone viral on social media, women Delhi police officers were shockingly seen dragging and lifting the DCW chief from the protest site in a police van. Meanwhile, in the video, Maliwal can be heard shouting, “Don’t touch me. This is completely wrong.”

After being detained by Delhi police in the late hours of May 3, Swati Maliwal arrived again at Jantar Mantar in the national capital on Thursday morning, May 4. Speaking to Republic, the DCW chief said, "Am I a terrorist? Why are Delhi Police officials troubling me and the wrestlers? They should arrest Wrestling Federation of India (WFI) chief Brij Bhushan Sharan Singh."

Around 15 others, who had reached the protesting site, have also been detained in a bus. AAP minister Saurabh Bhardwaj was also among those. Slogans of ‘jai jawan jai kisan’ and ‘Bharat Mata ki jai’ were also being raised by the protestors.

AAP minister Saurabh Bharadwaj had tagged Delhi L-G V.K. Saxena in a tweet, asking him to take note of the incident. “Please note Lt Governor Delhi. A Delhi Police officer attacked a wrestler at Jantar Mantar. It is alleged that the policeman was drunk. A medical test should be conducted and MLC of the victim should also be registered,” he wrote.

Journalist Sakshi Joshi also posted a video of her being manhandled and detained by the Delhi Police. In the video, she can be heard shouting at the officers that they are tearing her clothes and detaining her without any reason. She also showed her torn clothes in the video. She was then seen sitting in a police bus, and then was taken to the police station.

Journalist Ajit Anjum has also posted a video on YouTube, providing his own narration of the situation that was present at Jantar Mantar. He provided that he had visited the protest site around 12.45 at night, after the Delhi police videos of manhandling the wrestlers had gone viral. When he reached the site, he saw that High level Delhi Police officers were also present at the side, and had barricaded the area, not even allowing journalists to pass. In his video, Ajit Anjun alleged the involvement of the Modi-led BJP government, as the police is under the control of the centre. He had also provided in his video that police could also be heard asking the protestors to vacate from Jantar Mantar. Ajit Anjum also alleged that supporting farmers were also not being allowed to enter the protest side.

While full throttled and government sanctioned attempts are being made to gag the protestors, independent media and any dissenters who are exercising their rights, Singh has been roaming free, declaring that all the complainants against have been manipulated or “paid”. The protesting wrestlers, according to him, were those who were at “Shaheen Bagh and the farmers’ protest”.

Response by the Wrestlers

According to News18, the protesting wrestlers have written to Union Home Ministry seeking strict action against officials responsible for the alleged manhandling of grapplers at the protest site on Wednesday night. In the letter, they have also sought permission to bring waterproof tents, beds, gym instruments, wrestling mats and sound system at the protest.

It has also been reported that the Aam Aadmi Party has called for a meeting of all MLAs, councillors and office bearers of AAP. The party will conduct a meeting on what transpired at Jantar Mantar on Wednesday night.

The #metoo wave had hit India in the year 2018, with women from myriad sectors and industries coming forward with their stories of workplace harassment endured by them. While many such claims had led to criminal cases being filed, even against women who broke the walls of silence, many women had found strength in the solidarity. The front pages of many newspapers were filled with stories of women from all sectors, entertainment, films, journalism even. But the sport industry was majorly silent. Did that mean it was a safe haven for women? Recent disclosures, one after another have exploded this myth: clearly the sports industry of India is an industry, like a myriad others, pre-dominantly run by men, and the level of misogyny found in the sports industry is evidently high. Within the sports, coaches — mentors and purveyors of skill, wisdom and knowledge — hold a certain power over the students, making it easier for them to create an intimidating and fearful atmosphere.

The silence of the women who are a part of the sports industry has finally broken. On January 18, Vinesh Phogat and Sakshi Malik, two of India's most esteemed women wrestlers, have come forth with accusations of sexual harassment against BJP MP and Wrestling Federation of India (WFI) head Brij Bhushan Sharan Singh.

The wrestlers have now gone further and staged a protest at Jantar Mantar in New Delhi to bring this issue to light and seek justice for herself and the other allegedly exploited women wrestlers. Vinesh Phogat, the country’s only double World Championship medalist, spoke to the media and said that coaches and the WFI president Brij Bhushan Sharan have been sexually harassing women wrestlers at national camps. Women wrestlers have been subjected to sexual harassment by some of the coaches at the national camps for years. Additionally, as provided by the Indian Express, Vinesh further claimed that the WFI president is complicit in this pattern of sexual harassment.

Sakshi Malik, India's lone Olympic medalist, shared the dais with Vinesh and endorsed the accusations, saying that they had come to protect those other women wrestlers who had been and were being subjected to this. As reported by Indian Express, Sakshi said that it is for them that these protesting women are battling. She further declared that they will speak up when it's time and offer the names of other people who have been harassing them to the person conducting the investigation.

It is being alleged that Vinesh further said that while she never herself faced such exploitation, she claimed many wrestlers were intimidated from coming forward because of their humble origins. Vinesh provided more information on the ways that national and international wrestlers have been allegedly exploited by the WFI chief and coaches while stating that she worries for her own safety now because she is raising her voice against very powerful individuals. As provided by her, and reported by the Indian Express, this exploitation is happening every day.  She mentioned that they had written to the Prime Minister and the Minister of Sports. She subsequently also told the media that Singh's residence in Lucknow is the only reason the camps are taking place there since it makes it easier for him to take advantage of the girls. She continued by saying that the coaches delve into their personal affairs and relationships and demand full details.

Then Vinesh addressed the wrongdoings and Singh's alleged haughtiness, saying that Singh tortures Vinesh mentally for everything. She went on to say that the wrestlers have to grovel before Singh and his assistant secretary in order to obtain anything, particularly permissions. In order to enter the national camp, the younger generation is offering Singh gifts like money, milk, and ghee. To enter the national camp, coaches must also follow the same requirements.

She then gave the name of a person who traveled to Tokyo with the women's team and claimed that the person was a coach who had no knowledge in women's wrestling as he had accompanied them after paying money. She claimed that the lack of skilled physiotherapists had a negative impact on their chances of winning a medal at Tokyo Olympics.

Reaction of the WFI

Vinod Tomar of the WFI federation crossed the street to speak with the wrestlers in protest because the federation's headquarters proximity to Jantar Mantar and is located in Singh's MP residence. As his attempt at negotiating failed, stated the Indian Express. Before leaving, he told the reporters that Brij Bhushan Sharan Singh, the WFI president, urged him to go speak with the wrestlers who were protesting and let them know they could come to the WFI headquarters and discuss any issues.

The reporters had gathered at Singh's home by that point. Singh has denied all charges even as he deals with the worst crisis of his ten years tenure at the head of Indian wrestling, so far an unblemished record. Following these allegations of harassment, the accused Singh also addressed the media and asserted that only Vinesh is alleging that the WFI had harassed a wrestler in a sexual manner. Nobody else has publicly stated that they have experienced sexual harassment. He added that he should be hanged on the day that even one more wrestler came forward to report that she had been sexually harassed.

“The age for delivering the best performance in wrestling is between 22 and 28 years. These wrestlers who are protesting can't win an Olympic medal. This is turning into anger and that is why they are protesting,” Singh was quoted as saying by the news agency ANI.

Supporters at the protest

Olympic medalist Bajrang Punia, Olympian Anshu, and world junior silver medalist Sonam Malik were among those who joined Vinesh and Sakshi in their protest against the "dictatorial practices" of the federation. Sangeeta Phogat, a nationally rated wrestler and wife of Bajrang, was also there.

According to Bajrang, who was quoted by The Indian Express, everyone rejoices when Indian wrestlers win medals but thereafter no one is concerned about how they are handled, particularly by the federation. If the PMO and the office of the Home Minister pledge that our concerns will be handled, then the protests will end. Else, Bajrang claimed that they will continue protesting as wrestlers can no longer be treated as “ghulams” of the Wrestling Federation of India. He further said that they will now talk about the rot in the federation and the “tanashahi” (autocratic functioning and environment) prevalent over many years.

Action taken against the claims made

In response to the events, Swati Maliwal, chairman of the Delhi Commission for Women, issued a notice against Singh, requesting the investigation and details of the case from the Deputy Commissioner of Police and the Secretary of Sports. A panel formed by the DCW has also sought details of Internal Complaints Committee formed by the Wrestling Federation of India. The panel also asked whether these complaints have been forwarded to the ICC and the Local Complaint Committee (LCC) as per Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

The Wrestling Federation of India (WFI) has been asked for an explanation by the Indian Sports Ministry "within the next 72 hours." Within hours of the protest, the Sports Ministry made it plain in a statement that it "would move to take action against the federation in line of the articles of the National Sports Development Code, 2011" if the WFI does not answer within the next three days.

Previous instances where allegations of Sexual Harassment were made 

There have been 45 reports of sexual harassment in the last ten years, according to data presented by The Indian Express in the year 2020. It was further provided that 29 complaints of these above-mentioned complaints had been made against coaches. As was additionally provided by the newspaper in its investigative report, in numerous instances, the accused have received light sentences, with punishments varying from transfers to a slight wage cut or pension reduction. Investigations involving over a dozen accusations, however, have gone on for years without being resolved. These incidents, however, only form part of an extensive and deeply-rooted system of harassing women sportspersons.

A few instances wherein official complaints had been filed by sportspersons against their harassers, within the sports industry:

  • In June, 2022, an Indian cyclist lodged a grievance with the Sports Authority of India (SAI). The cyclist has accused their coach, R K Sharma, of sexual harassment in Slovenia in May 2022.   The complaint goes into detail about the coach's offensive remarks and sexual advances. The cyclist claimed that the coach "forced" himself into her room, suggested giving her a "post-training massage," offered to have her "sleep with him," and proposed marriage to her because she had no future in sports. A panel to look into the allegations had been established by both the SAI and the Cycling Federation of India (CFI).

  • In July 2021, seven sportspersons accused renowned coach P Nagarajan of sexual harassment. He already had a complaint filed against him and was reportedly abusing athletes for years. He had also threatened the athletes to cease their training.

  • In January 2020, an FIR was registered against a coach for allegedly harassing and molesting a woman cricketer. As had been provided, the victim had approached Gautam Gambhir.

  • A young female athlete claimed that a few senior athletes had sexually harassed her in May 2015. After the incident, the 15-year-old died by suicide, and three other people were hospitalized after ingesting toxic fruits in what appeared to be a suicide pact. The players were undergoing training at the Vembanad Lake, Alappuzha, Kerala, Sports Center of Sports Authority (SAI) water sports facility. An FIR had been filed.

  • During the Asian Games in 2014, a female gymnast accused Coach Manoj Rana and gymnast Chandan Pathak of sexual harassment. Allegedly, the duo made vulgar comments about her attire. It was promised by the Gymnastic Federation of India (GFI) that strict punishment would be handed out to both Pathak and Rana if they were found guilty. However, Jiji Thompson, director general of SAI, cried conspiracy which had resulted from an internal dispute in the GFI. He indicated that the 29-year-old woman was herself at fault for going to police we she was not from India and was practicing at the stadium under the 'Come and Play' scheme.

  • In 2009, a young boxer made the decision to take her own life because she could no longer stand her coach's relentless harassment. The 21-year-old S Amaravathi died by suicide inside the Lal Bahadur Stadium by ingesting poison when she could no longer tolerate the frequent altercations with her coach Omkar Yadav. She was a promising talent and the junior national boxing champion. After she passed away, an investigation was mandated. The hostel staff, however, refuted these accusations and said that she was simply experiencing poor self-esteem.

Sexual Harassment Redressal Mechanisms in place for Sportspersons

According to the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act of 2013, any workplace with more than 10 employees needs an internal complaints committee. The Section 2 (o) (iv) of the said act , which provides the definition of workplace and the institutions that fall under it, states that:

 “Any sport institute, stadium, sports complex or competitions or games venue, whether residential or not used for training, sports or other activities relating thereto.”

Contrary to popular belief, sports facilities are thus considered workplaces for purposes of the law. Despite this, information about the Internal Complaints Committee (ICC) at various federations is hard to come by; the majority isn't posted on the organizations' official websites or on notice boards in training facilities around the nation.

The Act's operative phrase is "workplace." It also defines the terms "employer" (Section 2(g)) and "employee" (Section 2(f)). A person in charge of the "administration, supervision, and control" of the workplace is known as an employer. A workplace Internal Committee (IC) must be established by the company.

In relation to sports infrastructure, competition and event sites, dormitories, and games villages, to name a few sports workplaces, India's numerous sports federations and other governing bodies are employers. Therefore, in accordance with the law, these businesses are required to set up an IC to look into and ask questions about sexual harassment claims filed by sportsmen and sportspeople.

Athletes who were questioned by Scroll.in in 2018 on the existence of a sexual harassment grievance redressal mechanism stated anonymously that nobody has given this significant consideration, with the exception of a few federations. A few allegations continue to surface on a regular basis, but the most of the time the accused coaches are directly employed by the Sports Authority of India, thus federations have no control over them. However, all National Sport Federations (NSFs) are technically supposed to have a complaints procedure in place.

The National Sports Federations and other sport organizations are responsible for ensuring women's safety, under the National Sports Development Code of India from 2011. They are enjoined to establish policies that forbid sexual harassment, inform every one of these policies, and provide suitable platforms for women to bring up the subject. A complaints process must be established, and it must include provisions for a third party with knowledge of the problem of sexual harassment. The majority of federations are in violation of the law since they have not implemented these processes.

In most cases, young women with diverse family background, not all having access to vocal echelons of society make it to the top, after choosing this as a career over much is invested. The absence of a pro-active and sensitive environment can make them voiceless victims.

Although some of these NSFs have athletes' commissions to handle complaints and grievances, they are not - as required - specifically for sexual harassment and are not led by women. The standard method is to approach the president or secretary and speak with them directly. This indicates that there isn't a formal complaint, which is required by the ICC. This also explains why there are frequently no official complaints.

For women who have tackled this nightmare throughout their professional careers, sexual harassment in the sports industry has been a slow-burning fuse for ten years now. This raises serious concerns about women's safety in sports. As can be deduced from the cases provided above, the Sports Authority of India is not doing a fair job at protecting the women sportsperson in India. Through the cases provided about, it can be seen that the SAI is more inclined to protecting its employees, or burying down the case.

The protest staged by these wrestlers have brought across a major void that exists within the sports industry. The workplace sexual harassment law requires that internal complaints committees should contain at least three employees. As this is the general rule, it becomes even more difficult for the woman to approach the authorities with their complaints and receive an impartial treatment. This also depicts the internal hegemonies that exist within the sports industry and the dominance that a woman needs to fight against while approaching the authorities with complaint against their harassers.

Conclusion

Sports are mostly still exclusively a masculine domain despite the proficiency shown by more and more women. Not only when it comes to consumers or athletes, but also in coaching and administration, where the sex-ratio is greatly skewed. It is pertinent to note that in the case of WFI, there is an ICC in place. The question then arises is, why are these women wrestlers and their supporters not approaching them, and are rather opting to protest on roads? Is the redressal mechanism in place not enough to tackle with this issue in an unbiased and fair method?

It is further crucial to pay attention to the deep and serious allegations that are being made by Vinesh Phogat and Sakshi Malik against the predatory behavior shown by the very people that are supposed to teach and train them. How many before had to, and how many after these two will have to suffer through this culture of dominance and impunity?

The authorities as well as the lawmakers need to go beyond just addressing this case and asking for explanations, and should consider if stricter laws are needed. It would be negligent to claim that sexual harassment does not happen to male athletes, especially minors, even though the bulk of cases involving sexual harassment include woman survivors. But, before we arrive at the issue of introducing gender neutral laws, it is essential that we first appropriately implement the protections are already existing to tackle with the systematic oppression of women, and then aim to bring in laws that protect every one, no matter their gender.

Seven women wrestlers, including a minor, levied sexual harassment allegations against BJP MP and WFI chief Brij Bhushan Sharan Singh and several other coaches. During January 2023, the wrestlers, led by Sakshi Malik, Sangeeta Phogat, Vinesh Phogat and Bajrang Punia, took to the streets of Delhi for the first time to demand the arrest of Singh and his removal as the chief. When no step was taken for four months, the wrestlers resumed their sit-in protest at Jantar Mantar in the month of April. Since then, they have faced multiple threats, violence and abuse at the hands of the Delhi police and the government. Here is a look into the ongoing wrestlers protest.

Protesting wrestlers will resume stir, say govt not ready to arrest WFI chief by June 15

New Delhi: Just a fortnight back after the humiliating treatment meted out to them by the Delhi police, on May 28, the day India’s ‘new” Parliament was inaugurated, they had vowed to immerse their hard earned medals in the Holy Ganga at Hardwar. The last minute intervention by farmer leader Rajesh Tikait had persuaded them to put off their deadline to government to June 15.

Now, with the ultimatum issued by protesting wrestlers to the Union government drawing to a close, Bajrang Punia reiterated on Saturday, June 10that if the government is not ready to arrest Wrestling Federation of India (WFI) chief Brij Bhushan Sharan Singh, who facing sexual harassment allegations, by June 15, their protest would resume.

Following Tikait’s intervention a flurry of meetings with representatives of the union government followed last week. Following one such meeting with the Union sports minister Anurag Thakur, last week news reports on a minor’s complaint being withdrawn had re-surfaced. Today, Saturday June 10 they have stated that they will resume their protest if the government does not arrest Singh by June 15. Thakur, in his meeting with wrestlers earlier this week, had assured that the investigation into the allegations against Singh would be concluded by June 15, and a new WFI chief to be elected by June end. The written assurances from the government did not, however, mention Singh’s arrest.

Punia and other protesting wrestlers held a Mahapanchayat with Khap leaders in Haryana’s Sonipat on Saturday, June 10. They said they had shared the details of their discussions with the government with the Khap leaders at the Mahapanchayat.

“After June 15, we will decide where to start the protest again,” Sakshi Malik thereafter told NDTV  after observing that the government is not serious about arresting Singh.

While noting that efforts are being made by supporters of the government to spread the narrative that there is disunity among wrestlers, she said, “I want to make one thing clear, I, Bajrang, and Vinesh (Phogat) are one and will remain one.”

Furthermore, they also asserted that they will not participate in the Asian Games slated to be held later this year unless their demands are not met. “We will participate in the Asian Games only when all these issues will be resolved. You can’t understand what we’re going through mentally each day,” said 2016 Olympics medal-winning wrestler Malik.

The Delhi Police on Friday, June 9,  had taken wrestler Sangeeta Phogat to Singh’s official residence in Delhi to recreate the sequence of events at the scene of the crime that led to the sexual harassment of which he has been accused. While procedurally correct as per law, there is a question on the propriety of conducting this exercise while the accused politician was in residence.

The Delhi Police is likely to submit in court its report by next week, officials in the know of things said. So far, 180 people have been quizzed in connection with two FIRs filed in the case.

Sections of the media continue the misinformation campaign, however. Vinesh Phogat, Sangeeta’s sister, took to Twitter alleging that fake news is being spread about her sister’s presence at Singh’s residence on Friday, saying that she had gone there to work out a compromise with him. Vinesh clarified that Sangeeta was taken there by the police to recreate the scene.

“This is the power of Brij Bhushan. He is busy harassing women wrestlers by using his muscle power, political power and running false narratives. If the police arrests him instead of breaking us, there is hope of justice, otherwise no,” Vinesh wrote on Twitter in Hindi.

This is not the first time that fake news is being spread about protesting wrestlers. Earlier, it was said that they had ended their protest following the resumption of their regular duties in railways. The wrestlers dismissed them as mere rumuors, being spread with the intention to break them and defame them.

"I changed my statement because I was scared, my family is living under constant threat": father of the minor wrestlers’ complainant

"I changed my statement in Court because I was scared... scared for my family, daughter and myself... my family is living under constant threat"- this was the statement given by the father of the minor wrestler complainant while changing his statement alleging sexual harassment against Wrestling Federation of India (WFI) chief and Bharatiya Janata Party MP Brij Bhushan Sharan Singh. As per the report published by the Hindu, the father of the minor complainant has come out in the open about the threats he has been facing, and the amount of pressure they had been facing. The Hindu reported that the father of the said that he was threatened by people whose names he couldn’t reveal and “his family is living in intense fear”.

On late hours of Thursday, news of the minor complaint’s father issuing a “confession” hit the headlines, just a day after a false news was circulated that the minor has withdrawn her complaint. In the said statement, the father of the minor wrestler has also confessed to levelling a false sexual harassment allegation against Singh because he wanted “revenge” for his daughter’s rejection in the U-17 Asian Championship.

“I was filled with rage that my child’s one-year hard work had gone down the drain because of that referee’s decision in the final and I decided to take revenge,” he stated to PTI.

The father of the minor had also stated that his anger was directed towards the WFI chief because the referee was selected by Brij Bhushan Singh. “The federation appointed the referee (in the match against the minor wrestler which she lost). Who heads the federation? Who else should I be angry at?” PTI quoted the father of the minor, as saying. It is pertinent to noted, that it was based on the said complaint filed by the father of the minor that a second FIR was filed against Singh on April 28 at Connaught Place police station under IPC sections 354, 354(A), 354(D), 34 and section 10 of the Protection of Children from Sexual Offences (POCSO) Act.

The minor’s father, also the complainant, in the FIR had narrated in detail several instances when his daughter was allegedly sexually harassed by the WFI chief. He had claimed that Mr. Singh had “touched her inappropriately” and asked her to “support him, if she needed his support”. He had also alleged that his daughter was “completely disturbed and cannot be at peace anymore …sexual harassment by the accused (Singh) continues to haunt her”. The father also alleged that Brij Bhushan forcefully pulled his daughter towards him and molested her.

He also alleged that Singh had discriminated against his daughter. “To my utter shock, my daughter was hugely discriminated against,” he had said in the FIR.

However, after multiple reports claimed that the girl had withdrawn the complaint and a lot of confusion was created, the minor complainant’s father had told The Hindu that they recorded a fresh statement denying any incident of sexual harassment. However, it has been provided by the father that they have not withdrawn the complaint where they have alleged that Singh discriminated against his daughter.

He said, “We have not taken back any complaint, we have just recorded another statement before the magistrate on June 5, where we have alleged that he discriminated against her when it came to wrestling, and he did not sexually harass her,” the Hindu reported. On being asked why he filed the false case, the girl’s father said “he was fuelled by anger against him because his daughter lost in last year’s trial match”. “We are telling the truth so that it comes out while investigation is under way,” he added.

Elaborating on the same, he said, “My daughter was deliberately made to lose because of the staff that was on duty and the opponent, and everybody hailed from Delhi, which isn’t right according to the rules. I did complain regarding the discrimination to the Federation, but nobody heard me,” as provided by the Hindu. He said he was angry. “I felt disheartened and I was angry and why shouldn’t I be? Mr. Singh was biased against her, I had to sell my house to train my daughter. We only had three options: to get her married, educated or get her into sports. Now, we don’t know what her future will be.” “I understand that we made a mistake and we would like to rectify it,” he said, adding that the referee’s decision, in the trial match, was influenced by Singh.

“The police complaint that we have given, is somewhat true and partly false and we’ve cleared everything that is right and wrong,” he said. When the Hindu asked him about the allegations that his daughter isn’t a minor, he asserted that she is a minor and that they have provided the investigators with “legal documents pertaining to her identity”.

On Singh, the minor’s father said that he has “nothing against him, apart from the anger over how his daughter was treated”. “I will continue to stand with the wrestlers, who have always supported us since day one. What happened to the women is wrong,” the father of the complaint said.

Minor cannot ‘withdraw’ complaint against Brij Bhushan: Lawyer Vrinda Grover explains

Speaking to The News Minutes, and commenting on whether the reported retraction of allegations by the minor is contradictory, Vrinda Grover explained how this is the most normal, natural, and commonsensical thing to happen. Even if the minor did give another statement to the magistrate, lawyer and activist Vrinda Grover points out that calling this a “withdrawal” of the charges or complaint is a legal fallacy. She also said that since a large section of the media panders to the Union government’s power, such reportage creates confusion in the minds of people.

The minor and six other wrestlers had previously filed complaints against Brij Bhushan in April 2023. Speaking to TNM, Grover elaborated that statements by the minor wrestler, are deposed before a magistrate under Section 164 of the Criminal Procedure Code (CrPC). “All 164 statements carry evidentiary value because they are made to a magistrate and signed by the maker of the statement. But such statements still have to be examined before a criminal trial court for their veracity to be established. No complainant can simply give a statement contradicting their previous one and take back their complaint or allegations. Such reportage by the media is not only the wrong interpretation of the law but also confusing,” she said.

“No matter how many statements the complainant gives, she will have to step into the witness box before the court and speak under oath. Since here the complainant is a minor, she will be given the required privacy and witness protection, and her statements will be examined by the court to arrive at their validity. So this is not a “withdrawal” of a complaint or evidence of the accused’s innocence. Once an FIR is filed in a criminal case, it has to be adjudged by a court of law. A crime is considered a wrong against society and the state is duty-bound to prosecute the accused before the law,” she added

Unveiling the fear that victims and survivors face

Changed my statement because I was scared’

While most of the media is focusing on the “confession” given by the father of the minor complainant’s father, and the withdrawal of the sexual harassment allegations against Singh, not much attention is being given to real confession that the father made, which is the pressure and threats that the family has been facing since they came out with their story. The father has revealed that he has been living in fear and was threatened. “I changed my statement in court not because of greed but because I was scared... scared for my family, daughter and myself. Many lives have changed since we raised the allegations. I have to face the society and the people, I was threatened by people, whose names I can’t reveal, and my family is living in intense fear. If anything happens to me or my daughter, how will we live?” he had told The Hindu.

This was not the first time that the minor complaint and the six other women wrestlers have come out and raised the issue of threats of dire consequences and inducements of money were being made to them. Even on the third day of the protest, the two-time World Championship medallist Vinesh Phogat, who has been leading the wrestler protest, said threats were being made to 'break the resolve' of the complainants. Tokyo Olympics bronze medalist Bajrang Punia had also accused Singh's coterie of threatening the family of the minor, the result of which can be seen today.

“They are trying to threaten the minor victim and pressure is being put on the family members to withdraw the complaint. We have learned that one of the people threatening them is a coach who is a Dronacharya-award winner and the other is the secretary of the Haryana Wrestling Association. They went to her house and are putting pressure on the family and also offered money. They want her to take the complaint back. Those women wrestlers who have filed complaints against the WFI president are being threatened too,” Bajrang had said as had been reported by the Indian Express.

Yesterday, after the father of the minor gave the above-mentioned statements, Phogat tweeted the following on her Twitter handle: "Will the daughters get justice in the atmosphere of fear and intimidation???" Vinesh wrote

In another tweet, she said, "May these daughters not lose courage one by one because of the delay in this fight for justice??? God give courage to all."

It will not be a reach to say that considering the amount of state-sanctioned abuse, violence and pressure was being meted out to the protesting wrestlers, this particular piece of news did not surprise anyone, but rather re-iterated the power that men like Singh, and those supporting, him have in our country. The power exerted by this man is such that no arrest has been made, and rather it is the complainants only who are suffering. Besides, this this is not the first case where the complaint has redacted their statements, succumbing to the political and societal pressure put on them, as was witnessed in the Gujarat 2002, Vadodara’s famed Best Bakery case and the Sohrabuddin Sheikh extra judicial killings case. While in the first, Best Bakery, following a Registrar General, Supreme Court’s inquiry, the circumstances that caused prime witness Zahira Shaikh to commit perjury were revealed and she was ordered to serve a year’s of simple imprisonment, the Sohrabuddin case simply fell through the cracks with justice an elusive commodity.

It is a shame that a minor woman, who found the strength to fight against the wrongdoings committed by a powerful and politically backed man against her consent and her body, had to take a step back owing to the threats faced by her and her family.

Questions should now be raised over the continued delay in the arrest of the WFI chief and filing of the charge sheet. Additionally, a need for conducting an inquiry to probe the delay in the case has arisen, to investigate the circumstances leading to this situation where witnesses are being compromised.

Is the police bound by the statement of the father of the complainant?

It is essential to note that even after the father of the complainant has issued the above-mentioned statements, the Delhi police can still proceed with its probe. The statement of the father will not held to be “decisive” of the said case as one the FIR was lodged, the State took over the case and was pursuing it. Thus, the Delhi police is not bound to accept the statement of the father, and it can still pursue the case because the statement of the minor is already there on record under Section 164 of Code of Criminal Procedure (CrPC). Notably, a statement recorded before a magistrate under Section 164 is admissible in court.

The statement of the father will now act as an additional element which the police may look into, and if it finds that the case is false, then it can take action as required by law. Therefore, the power resides with the police to investigate whether this withdrawal by father of the complainant is genuine or coerced, and whether it amounts to perjury or not.

FIRs suggest wrestlers had informed PM about their repeated sexual trauma in 2021

“Even if a single allegation is proved against me, I will hang myself,” these were the words uttered by sexual harassment and POCSO accused Brij Bhushan Sharan Singh, who is the Wrestling Federation of India (WFI) president and BJP MP, after six adult women wrestlers and one minor wrestler came out with their accusations against him. But, now it has come to notice that even Prime Minister of India knew about the sexual harassment that women wrestlers were facing at the hands of Singh and his aides, and yet no attempt was made to remove Singh from his position.

As has been reported by the News Minute, it has been provided in the FIR filed by the women wrestlers that the complainant had met the Prime Minister in the year 2021 and informed him about the sexual harassment. She has further claimed that Narendra Modi had assured her that her “grievances” will be looked into by the Sports Ministry.

According to the FIR, the wrestler said, “I informed the Prime Minister about the repeated sexual, emotional, psychological, and physical trauma that was meted out to me and other female wrestlers by accused no. 1 [Brij Bhushan] in conspiracy with his close aides, to which the Prime Minister reassured me that such grievances will be looked into by the Sports Ministry and I will get a call from the Sports Ministry shortly.”

The complainant said that after her meeting with the PM, a show cause notice issued to her earlier was withdrawn, and Brij Bhushan and aides stopped exerting pressure on her for sometime, as was reported by the News Minute. However, she adds that the mental harassment resumed after a short interval. It is crucial to note here that there has been no mention made here that any attempt was made by the PM to remove Singh from his position of power even after knowing about the abuse. It is also pertinent to note that the Prime Minister has not yet issued anystatement regarding the sexual harassment allegations against Brij Bhushan, and had rather invited the accused to the inauguration ceremony of the new parliament building.

PM Modi once famously said, “Progress of women always gives strength to the empowerment of the nation,” and yet he falls truly short on implementing his words and protecting the women facing sexual harassment at the hands of a predator from his own party.

Even after all this, many other dramatic statements have been made by Singh, who has been time and again denying the allegations against him, calling it a political conspiracy. And now, the details of the key allegations put on him in the two official complaints filed with New Delhi’s Connaught Place police station on April 28 have come out, and they are disturbing and traumatising to say the least.

It is pertinent to note that both the FIRs cite IPC Sections 354 (assault or criminal force to woman with intent to outrage her modesty), 354A (sexual harassment), 354D (stalking) and 34 (common intention) that carry a jail term of one to three years. The first FIR covers the allegations of six adult wrestlers and also names WFI secretary Vinod Tomar. The second FIR is based on the complaint of a minor’s father and also invokes Section 10 of the POCSO Act which entails five to seven years of imprisonment.

The incidents mentioned allegedly took place in India and overseas from 2012 to 2022.

The seven women have put on record multiple incidents of sexual harassment and misconduct that included groping, inappropriate touching and physical contact — during tournaments, at warm-ups and even in the WFI office. At least two instances of demanding “sexual favours” in lieu of professional assistance along with more than 10 episodes of inappropriate touching, molestation that includes running hands over breasts, touching the navel have been made public in a report by the Indian Express. Several instances of intimidation including stalking and a shared sense of fear and trauma also form the key allegations in two FIRs filed.

• “Since the accused (Singh) was always on the lookout to engage in inappropriate talk/gestures…girls, including myself, collectively agreed to not go alone for breakfast, lunch or dinner”.

• “While I was standing in the last row (for team photograph)… the accused (Singh) came and stood alongside me. I suddenly felt a hand on my buttock. I was stunned by the actions of the accused (Singh) while they were highly indecent and objectionable and without my consent… when I tried moving away, I was forcibly held by my shoulder.”

• “On the pretext of getting a picture clicked with me, he pulled me towards him by my shoulder… to protect myself, I tried moving away from the accused (Singh)… Since I was not comfortable with the behaviour of the accused of forcing me, I, in order to escape, (his) clutches, repeatedly resisted his attempts and tried to push him away to which he (threatened): “Zyada smart bann rahi hai kya…aage koi competition nahi khelne kya tune?” (Acting too smart? You don’t want to be considered for tournaments in the future?)

 FIR 2- Allegations put forth by the minor wrestler

The minor’s complaint, filed by her father, alleges that his daughter was “completely disturbed and cannot be at peace anymore …sexual harassment by the accused (Singh) continues to haunt her”. The father also alleged that Brij Bhushanforcefully pulled his daughter towards him and molested her. Brij Bhushan then allegedly told her: “Tu merko support kar, mei terko support karunga, mere saath touch mein rehna” (If you support me, I will support you. Be in touch with me).

As per the News Minute, the father of the minor complainant also mentions that when his daughter refused Brij Bhushan’s advances, he allegedly threatened to stifle her chances at the upcoming trials for the Asian Championship, which he later did by clubbing her in the same category as other strong contestants at the trials, against the general practice of giving preference to the medal holder in the national championship. 

The complainant further details how Brij Bhushan called his daughter to his room and tried to initiate “forceful physical contact”, from where she ran, shell-shocked.

The minor athlete alleged that Singh held her tight for a photo. She mentioned that he also pressed her shoulder and purposefully touched her inappropriately. She added that she explicitly told him not to stalk her and that she was not interested in having any physical relationship with him.

• “Holding her tightly, pretending to get a picture clicked, the accused (Singh) squeezed her towards himself, pressed hard on her shoulder and then deliberately…brushed his hands against her breasts”.

• “She clearly told the accused (Singh) she had already told him that she was not interested in having any sort of physical relationship and that he should stop stalking her…”

Based on this complaint, Brij Bhushan has been charged under Sections 354 (assault or criminal force to woman with intent to outrage her modesty), 354A (sexual harassment), 354D (stalking), and 34 (common intention) of the Indian Penal Code, and Section 10 of the Protection of Children from Sexual Offences Act (POCSO). The said Section 10 of the POCSO Act would lead to five to seven years of imprisonment. The minor athlete stated that the harassment took place between 2012 and 2022 in both India and abroad. Following this FIR, Brij Bhushanhad claimed that the POCSO Act is being misused and said he wants it amended.

A decade long pattern of abuse

These women have endured years of trauma, of living in fear and having their autonomy and dignity snatched away, of having no respite from the preying hands of men in power. From being sexually assaulted during training to having a man slide his hand inside their t-shirt under the guise of "checking her breath" to having their body touched without their consent while posing for a photograph, the complainants' accounts demonstrate the level of authority Singh purportedly possessed and exercised in the federation, establishing this pattern to his sexual harassment while enjoying impunity. It is evident from the narratives presented above that time and again Singh used his clout to prey on the survivors, touching them on various pretexts, and isolating them whenever possible to elicit sexual favours. Today, these women are fighting on their behalf, as well as on the behalf of those women who are forced into silence about their stories, against a man who wields such power that even the Prime Minister is silent. From what should have been an act of justice, putting a guilty man behind bars, has become a struggle in which they are being manhandled, dragged, abused, and booked for disrupting the law and order of India!

Who and what are these women battling? On the face of it, they are fighting against a man guilty of committing non-consensual acts on their bodies. But they are also battling an invisible and rigid structure of impunity and abuse of power where a string of powerful men are standing behind one guilty man.

Protesting wrestling champs meet union sports minister, 2nd meet with govt in 5 days

On the morning of June 7, a crucial meeting was held between the protesting wrestlers and Union sports minister Anurag Thakur at his residence, after the previous meeting of the wrestlers with the Union Home Minister, Amit Shah did not yield any positive result. On June 3, a delegation of grapplers and their coaches had met Amit Shah, who had advised them to “allow the law to take its own course”. The government, which have been given time till June 9 to take action against BJP MLA and WFI chief Brij Bhushan Sharan Singh by the farmer leader Rakesh Tikait, have continued with its effort to strike a deal with the protesting wrestlers.

Past midnight Tuesday, June 6-7, Thakur tweeted that the government was willing to have a discussion with the wrestlers over their issues. “I have once again invited the wrestlers for the same,” he had tweeted. The meeting was called by Thakur to discuss the “issues” that the wrestlers had as well as their long-standing demand for arrest of Singh over the sexual harassment and POCSO charges levied against him.  Even after facing so many hardships, the wrestlers have been adamant that they will continue their agitation till Singh, who they have accused of sexual harassment, is arrested.

Before the meeting, Sakshi Malik, who is one of the wrestlers leading the said protest, said that they will not agree to just about anything that the government had to offer. She clarified that their protest would continue till their demand for quick action against Singh was met. Malik has led the protracted agitation against Singh, a powerful Rajput leader from Uttar Pradesh, along with Bajrang Punia and Vinesh Phogat.

After the decision to attend the meeting was taken, the wrestling coach and Dronacharya awardee Mahavir Singh Phogat said that the government’s offer for talks was a good sign. “The government has woken up after so many days. A solution must come out now,” as was reported by the news agency ANI.

“The wrestlers look positive in their approach. We are hoping for a resolution today. The idea is that the sport should not suffer,” said a sports ministry official ahead of the meeting, as reported by the Siasat Daily.

Bajrang Punia, Rio Olympic bronze medallist Sakshi Malik and her wrestler husband Satyawart Kadiyan, were a part of the meeting at the minister’s house. Notably, Bhartiya Kisan Union (BKU) leader Rakesh Tikait, who has been supporting the wrestlers in their protest, was not a part of today’s meet.

As reported by the Siasat Daily, in their meeting with Thakur, the wrestlers put forth five demands to the sports minister which are as follows:

  • The wrestlers stressed on their primary demand that the accused WFI president be arrested on the charges against him.
  • Free and fair elections to be held at the WFI as well as the removal of corruption-accused leaders and better management.
  • A woman be made the head of the wrestling body.
  • Brij Bhushan and his family be kept away from the wrestling body and its elections.
  • Revocation of the FIR filed against them for violation of law and order, after a brawl with the police amid their march towards the new Parliament house on the day of its inauguration.

After the second round of meetings between the government and protesting wrestlers in a space of five days, it has been reported that the government is willing to accept most of their demands, yet the arrest of Singh remains a major bone of contention. No official statement has yet been evinced from the government after the said meeting. Since the wrestlers have refused to bow down regarding these demands raised by them, all eyes are on the government, to see whether they will stand behind the daughters of India, or against them.

Protests and Mahapanchayats announced in support of the protesting wrestlers, 5 days given till medals are immersed in Ganga River

Yesterday, on May 30, the protesting wrestlers, Vinesh Phogat, Sakshi malik, Sangeeta Phogat, and Bajrang Punia along with others, had issued a statement that as a mark of protest against WFI chief and BJP MP Brij Bhushan Sharan Singh over sexual harassment and POCSO ((Protection of Children from Sexual Offences) allegations as well as the manhandling that they had to face at the hands of Delhi Police during their peaceful protest, they were going to immerse their medals in the Holy Ganges river. 

The wrestlers had reached Haridwar at 6 pm to immerse their medals, from where heart-wrenching videos of wrestlers weeping over their plight were watched by millions on social media. Almost an hour later, farmer leader Naresh Tikait reached the spot and urged them emotionally not to throw away their medals. Tikait intervened, drew their medals from them, and sought a five-day time from the protesting grapplers to address their grievances.

The suffering and the plight of the protesting wrestlers, who have had to endure systematic violence, ignorance and apathy at the hands of the Delhi police and representatives of the union government whose radio silence around the champions’ protests has been telling. It has also been a wake-up call.

The May 28 crass brutality of the Delhi police (that is controlled directly by the ministry of home affairs under the union government) has shaken many who were previously silent. The contrast could not have been more stark: the cloak of powerful immunity accorded to the POCSO accused BJP MP, Brij Bhusan Singh who triumphantly participated in the inauguration of the “new Parliament” on an invitation from the Prime Minister and the brute manhandling and misbehaviour with the women Olympic champions protesting for their dignity and rights. Both on Sunday May 28.

Many organisations, political leaders, sportspersons, and celebrities have come out in support of the protesting wrestlers.

Rajya Sabha MP Kapil Sibal slammed the government over the issue of allegations of sexual harassment levelled by women wrestlers against WFI president Brij Bhushan Singh, and asked whether POCSO and immediate arrest apply to all accused other than Singh because he belongs to the BJP. Kapil Sibal is the senior advocate who has previously represented the protesting wrestlers when they had approached the Supreme Court to demand that a FIR be registered against Singh.  While it took an order from the Supreme Court to even get an FIR filed against Singh, the same police was quick and prompt in booking the wrestlers for “violating law and order,” within ten hours! This FIR was filed under Indian Penal Code (IPC) sections 147, 149, 186, 188, 332, 353, Section 3 of the PDPP Act, said Delhi Police.

Naresh Tikait, the head of Balyan khap, said a 'mahapanchayat' will now be held in Muzaffarnagar's Soram village on June 1 to discuss the ongoing protest by wrestlers against WFI. Tikait further provided that several representatives of different khaps and their heads hailing from Uttar Pradesh, Haryana, Punjab Rajasthan and Delhi will be participating in the mahapanchayat to decide the next course of action in the wrestlers protest.

The Samyukta Kisan Morcha, an umbrella group of nearly 40 farmers’ unions, on Tuesday called for nationwide demonstrations on June 1 to support the protesting wrestlers, Sabrangindia has reported.  The Samyukta Kisan Morcha said that nationwide protests will be held to “secure the democratic right to protest by the Indian wrestlers and all other sections of society” and demand Singh’s arrest. “The morcha will coordinate with platforms of trade unions, women, youth, students and all other sections, including intellectuals, to stage demonstrations across India,” it said.

The Democratic Youth Federation of India (DYFI) and the Students Federation of India (SFI) jointly declared a nationwide protest in support of the wrestler’s protest from June 4. "DYFI and SFI demanded the immediate arrest of Brij Bhushan and to withdraw all false cases against the wrestlers immediately. Through this protest, we demand that the Prime minister should apologize for the police violence unleashed upon wrestlers," DYFI national president AA Rahim said.

The sport fraternity finally speaks up- National and International

In a statement on the night of May 30, the International Olympic Committee has condemned the way India's top wrestlers are being treated during their ongoing protest. In their statement, the IOC has "urged the safety and wellbeing of these athletes" and called for "a speedy conclusion" of the investigation. The IOC spokesperson from Lausanne, Switzerland, also said that the “treatment” meted out to the athletes over the weekend, when they were manhandled and detained for hours, was “very disturbing.” The IOC also urged the IOA, headed by P T Usha, which has been conspicuous by its silence so far, to “protect the athletes

It further said that it had been in close contact with United World Wrestling (UWW) - the international organisation governing amateur wrestling - over the situation.

The UWW had also, prior to the IOC, issued a statement on Tuesday saying that it was following "with great concern" the wrestlers' protests "over allegations of abuse and harassment by the president of the Wrestling Federation of India (WFI)".

"It expresses its disappointment over the lack of results of the investigations so far," the statement said and added that the UWW would hold a meeting with the wrestlers to inquire about their safety and "reconfirm our support for a fair and just resolution of their concerns".

The UWW also said that it might suspend the WFI if its upcoming elections were not held on time. As provided by the Indian Express, the IOC and the United World Wrestling are considering holding a joint virtual meeting with the protesting wrestlers.

A veteran of the cricketing fraternity of India, cricketer, Anil Kumble also joined other big sportspersons like Neeraj Chopra, Abhinav Bindra, Sunil Chhetri, who have voiced their support for wrestlers and expressed disappointment over how they were treated on the day India celebrated its new Parliament. Other cricketing icons of the country, even playing the popular IPL tournament that ended only on May 29 post mid-night have been conspicuously silent.

Support flows in from the film industry

A number of celebrities have also expressed their support for the protest, despite their reputation for being oblivious to their surroundings and indifferent to protests and societal movements. The ongoing wrestlers' protest has captured the attention of many people working in various film industries across the country, as more and more people express their support through social media platforms and in interviews. Senior actor Naseeruddin Shah recently expressed his support for the protesting wrestlers and wondered if a film about these athletes would be made. Shah also stated that the Hindi film industry was never one to roll up its sleeves and confront problems head on.

"When has the Hindi film industry ever rolled up its sleeves and tackled a subject which is crying out to be tackled? Will anyone make a film on these girl wrestlers who brought us medals...? Will anyone dare make a film? Because they are scared of the repercussions. It is nothing new that the Hindi film industry is keeping mum on important issues, they always have," the actor told PTI in an interview.

Sharing a collage showing security personnel detaining wrestlers Sakshi Malik, Vinesh Phogat and Sangeeta Phogat by using force, Malayalam actor Tovino Thomas wrote on Instagram, "They are the ones who uplifted our reputation in international sports arenas. They gave colours of success to the hopes of an entire nation! Keep aside their achievements and accolades, but there is a justice that each and every citizen of this nation deserves. They should not be deprived of that justice. They should not be defeated just because those standing on the opposite side are strong. They should be heard and their demands should be considered. Justice should not be delayed, never be denied! Jai Hind."

Renowned Tamil director Pa Ranjith, filmmaker Onir, actor Kamal Hassan, actor Swara Bhaskar, actor Ritika Singh, Uorfi Javed, actor Vidyut Jammwal and Malayalam director Anjali Menon too had recently extended solidarity with the protesting athletes.

The government saves face, spreads misinformation

The BJP government, which is at the centre and has been indirectly shielding Singh from having to bear any consequences provided under law, has been keeping mum about the whole issue of the wrestling protesters. The Congress claimed the BJP's slogan of 'Beti Bachao, Beti Padhao' now means 'Beti BJP ke netaon se bachao' (save daughters from BJP leaders)' and also hit out at Prime Minister Narendra Modi for not making an appeal to the protesting wrestlers urging them not to immerse their medals in the Ganga.

The month-long protest of wrestlers even forced union minister Meenakshi Lekhi to do a little jog --run away from questions on the matter by media persons. She was seen walking briskly and then running when asked to comment on the issue. "Chalo, chalo, chalo," the minister said as she was rushing towards her car. The union minister was chased by a media reporter who kept asking for comments on protesting wrestlers. "What do you have to say on the protesting wrestlers?" she was asked. To this, Meenakshi Lekhi responded that the ‘legal process is going on’.

A similar statement was also given by Smriti Irani, the union minister of Women and Child Development, urging the protestors to wait for the legal process. Ironically, the same government that has on multiple occasions supported the taking law into their own hands, be it the extra-judicial killing of accused and convicts, declaring any dissenter as terrorist, or demolishing “illegal” structures even as the court cases are ongoing, are now appealing for the citizens and media to wait till the law take its course.

It is essential to note that while wrestlers have had to fight a battle for exercising their rights on a daily basis, Singh has been brazenly giving interviews, and issuing statements. Reacting to the intention of the protestors to immerse their medals in the river, Singh said that the wrestlers immersing their medals in the Ganga would not make the court "hang" him.

"Immersing your (wrestlers) medals in Ganga won’t make the court hang me. Present your proof to the court, and if they choose to hang me, I will accept,” WFI chief Brij Bhushan Singh said while addressing a gathering.

A particular group of people are also busy making up stories and controversies regarding this whole issue. Earlier today, a news was circulating stating that the police had not found sufficient evidence in favour of the allegations levelled against Singh by female wrestlers and that it will submit the report within 15 days. As the news came out in the media, the Delhi Police took to Twitter to say: “It is clarified that this news is “wrong” and the investigation into this sensitive case is under progress with all sensitivity.”

Meanwhile, another attempt to build up a controversy is being made, with some individual claiming to be the uncle of the "minor" girl who has accused Brij Bhushan of sexual harassment, Amit Pehlwan, has been hitting out at the protesting wrestlers, saying that they are "misleading" his family and using them to frame Brij Bhushan Sharan Singh. As has been alleged by Amit, the wrestlers are carrying out a scam as his brother's daughter's (niece) age has been changed to 16 years, so that the grapplers can "wrongly utilise" the POCSO Act.

The issue of sexual harassment at the workplace, raised clearly and sharply by India’s Olympic Women champions needs to be faced head on. It is an issue quite commonly brushed aside as an aggressive union government is even at this moment attempting to do.

Farmers to hold countrywide demonstrations in support of women wrestlers: SKM

An extended coordination committee meeting of the Samyukta Kisan Morcha (SKM) at which  Bajrang Punia representing the wrestlers action committee attended as a special invitee, decisions were taken to actively participate in and support the wrestlers struggle demanding the arrest of BJP MP, Brij Bhushan Singh.

Beginning June 1, 2023, all India level mass meetings and demonstrations will be held in all districts and tehsil centres of the country. The protests across India are being held to protect the constitutional right to protest of all citizens and demanding arrest of BJP MP Brij Bhushan Sharan Singh. SKM will coordinate with platforms of trade unions, women, youth, students and all other sections including traders, intellectuals and social movements to make this action massive and successful.

Thereafter, on June 5, 2023, the day when Mahanths and RSS workers holding rally in support of the “accused rapist and criminal Brij Bhushan Sharan Singh MP” in Faizabad, SKM will give call to expose his criminal conduct so far and burn his effigy across India up to village and town level.

Thereafter, the SKM will convene a physical meeting of the general body immediately after June 5, 2023 at New Delhi and decide future plans of actions to continue the struggle.

Protesting wrestlers will immerse their medals in the Ganga, an indefinite hunger strike will follow

Aggrieved by the ill treatment and systematic violence meted out to the protesting wrestlers on May 28, they have now decided to throw their medals into the Ganga River in Haridwar on Tuesday, May 30 at 6 pm. In a statement put out by the wrestlers on their personal twitter handles, they have informed India and Indians that after throwing the medals, they will then sit on an indefinite hunger strike at India Gate, New Delhi. This comes after the wrestlers were brutally and forcefully dragged and detained by the Delhi police, as they prepared to go from Jantar Mantar ,where they have been protesting peacefully since April 23, 2023, to hold a sit-in `Mahila Samman Mahapanchayat’ near the new Parliament Building.

The protesting wrestlers were summarily dragged, forcibly pushed to the ground, manhandled, thrown into buses and removed to unknown destinations while the new Parliament building was being inaugurated, just less than two kms away. Later, an FIR against them was filed for violation of law and order.

Today, all the top wrestlers, including Sakshi Malik, Bajrang Punia and Vinesh Phogat, put out a statement in Hindi on their respective social media accounts, saying they would go to Haridwar and immerse their medals in the river. “We will throw our medals in river Ganga in Haridwar today at 6pm,” said the wrestlers, who have been protesting against the Wrestling Federation of India (WFI) president Brij Bhushan Sharan Singh over sexual harassment allegations.

Furthermore, the wrestlers announced their decision to go on a hunger strike till death by stating, “These medals are our lives, our souls. There would be no reason to live after throwing them in the Ganga today. So, we will sit on an indefinite hunger strike at India Gate after that.”

In the statement, the wrestlers have criticised both the President, Draupadi Murmu and Prime Minister, Narendra Modi for failing to listen to their complaints and turning a blind eye to their plight. The wrestlers condemned President Draupadi Murmu's apathy, claiming that even though she is a woman, she did nothing when Delhi Police manhandled and detained them. The statement read "It came to our mind how to return the medals to our President, who is herself a woman. Our conscience said NO, because she is sitting just two Km away from us and has not, did not utter a single word," the statement read.

They also expressed anguish at the Prime Minister Narendra Modi for prioritising the opening of the new Parliament and inviting WFI chief Brij Bhushan Sharan Singh, who is a POCSO accused, to the occasion, while the protesting women wrestlers have had to face so many hardships. "The Prime Minister who calls us our daughters did not even show his concern for wrestlers. Rather he invited the oppressor (Brij Bhushan) to the inauguration of the new Parliament building. He even posed for photographs in bright white clothes. We have been stained by this brightness," the statement said.

On August 18, 2016 the same Sakshi Malik had received accolades from Modi when she won the Olympic Bronze: a medal at the Rio Olympics, clinching bronze in the Women’s Freestyle 58 kg category with a spirited comeback victory over Aisuluu Tynybekova of Kyrgyzstan.

Unprecedented scenes had enfolded on Sunday when the Delhi police had dragged and manhandled the Olympic and world championships medal-winning players when the wrestlers and their supporters breached the security cordon ahead of their march towards the new Parliament building for the planned women's 'Mahapanchayat'. It was reportedly stated by the police that they acted harshly since the wrestlers did not have permission to move towards the new Parliament building, hours after it was inaugurated by Prime Minister Narendra Modi! In an obviously violent and brutal tussle, the protesting wrestlers and their supporters were taken to different locations in the national capital and later released after having FIRs filed against them. Other senior and younger women’s activists were also detained and released.

It is essential to note that not only did the police use a disproportionate amount of force against the wrestlers and pushed them into buses, the police officers also cleared the protest site by removing the cots, mattresses, coolers, fans and the tarpaulin ceiling along with other belongings of the grapplers. The Delhi Police then also stated that it will not allow the wrestlers back into the protest site.

Before this, the Delhi police had tried to garner a local school under the AAP-ruled Municipal Corporation of Delhi to be converted into a temporary “jail”. Permission for that had been refused by the Mayor.

The People’s Union for Civil Liberties (PUCL) has strongly condemned the brutal manner by which the Delhi Police forcibly arrested the women wrestlers yesterday, May 28, 2023, as they prepared to go from Jantar Mantar where they have been protesting peacefully since April 23, 2023, to the `Mahila Samman Mahapanchayat’ near the new Parliament Building. Without any sense of respect to their contribution to Indian sports, protesting wrestlers, all champions -- Olympic medalists Bajranj Punia and Sakshi Malik, and Asian Games Gold medalist, Vinesh Phogat, and Sangeeta Phogat, who were sitting in the 35th day of their dharna, demanding the arrest of Brij Bhushan Sharan Singh and others were, summarily dragged, forcibly pushed to the ground, manhandled, thrown into buses and removed to unknown destinations.

Soon thereafter, the protest site at Jantar Mantar where the women wrestlers have been protesting since 23rd April, 2023 had the tents dismantled, their belongings including their beddings and coolers thrown away and the protest site cleared by the Delhi police.

Ironically, even as the wrestlers were being forcibly removed from Jantar Mantar, the country’s Prime Minister Narendra Modi was making grandiose announcements in the newly opened Parliament building about India not only being the mother of Democracies but also being a model for other democracies!

The PUCL statement issued by Kavita Srivastava, president and Dr. V. Suresh, general secretary states that “the aggressive and violent action of the Delhi Police stands in contrast to the reluctance of the Central Government to act against the six times BJP MP and three times ex-President of the Wrestlers Federation of India, Brij Bhushan Sharan Singh, for sexual violence against young women wrestlers. This, despite all the seven complainant women wrestlers, including a minor, recording their statements before the concerned Judicial Magistrate under section 164 of the Criminal Procedure Code.”

Apart from the wrestlers, all the groups who lent their support to the demand of arrest of the accused and came out to participate in the Mahila Samman Panchayat, outside the new Parliament building in several hundreds, were detained.   They included former MP Subhashini Ali, Annie Raja, Kawaljeet Kaur and Dipti Bharti of the National Federation of Indian women, Poonam of Pragatisheel Mahila Sangathan, Sucheta De of CPIML (L) and AICCTU, Jagmati Sangwan and Maimoona Mollah of AIDWA, activists Maya John and others of CSW, Purogami Mahila Samiti and AIMSS activists Ritu Kaushik and others, Krantikari Yuva Sangathan activists, JNU students, AISA, NSUI activists were also picked up.

Supporting farmer leaders were either detained in Haryana or Punjab itself or picked up from the protest site at Tikri, Singhu and Ghazipur border. Those picked up from the Haryana borders of Singhu and Tikri included Charanjit Kaur Dhulia, Davinder Kaur Hardaspura, Gurnam Singh Chaudhuri, Amarjit Singh Mohri, Ravi Azad and Jagdeep Aulakh. They also arrested leaders from the Binen Khaps and others in Haryana. Several journalists and bloggers were also picked up, notable amongst them was freelancer Mandeep Punia. Lawyers who were trying to provide legal assistance, including Vertika Mani Tripathi, Abhishist Hela and others, were kept in the dark and not allowed to enter the police stations and meet the detainees. The detainees were kept in more than a dozen police stations, mostly in the outskirts of Delhi.

What was very disturbing was that the four wrestlers were separated and sent to four different police stations and subjected to intimidation and to illegal detention and isolation. The whole idea was to break their morale and demotivate them from returning back to the protest. Even as we release this Press Note, they and other women activists continue to be under illegal detention.

The strong-arm tactics used by the BJP led Central Government through the Delhi police against the women wrestlers ironically exposes the lie of the BJP government as being committed towards justice for women, protecting their dignity and democratic rights.  What is clear is that:

  1. The BJP Government and the Delhi police showed its true anti-women and anti-democratic character by preventing and trying to crush what has been a very peaceful, violence-free and orderly protest of women wrestlers whose only request is to enforce the law against a person who has sexually inflicted violence on them, including ensuring the mandatory arrest of the perpetrator under POCSO.
  2. It is very much a part of the fundamental right of the women wrestlers to peacefully demand accountability and express their protest against the inaction of the Delhi police under the Ministry of Home Affairs to arrest Brij Bhushan Sharan Singh. The women wrestlers have been demanding action since January, 2023. No justice came their way, despite being subjected to two illegal Complaint Committees regarding sexual harassment. It was only thereafter that on 23rd April, 2023 they were forced to make their grievances public by staging their protest in Jantar Mantar. The deathly silence of the ruling Modi regime continues to date.
  3. The reluctance to act on the part of the Modi government to enforce the law against wrongdoers from its own ranks is made clear when we see that the FIR itself came to be lodged only when the wrestlers filed a petition in the SC and the CJI’s Bench ordered registration of a FIR.
  1. What is indicative and best exemplifies the authoritarian, anti-women and anti-democratic mind-set of the Central Government and the Delhi police to the citizen’s fundamental right to protest is the action of the Delhi police who dubbed the protest of the women wrestlers as constituting anti-national act, as it was marring the day when the PM was inaugurating the new Parliament!

How the protests of the women wrestlers seeking fair implementation of the law against a sexual predator can ever constitute an `anti-national’ act belies logic and only exhibits the ignorance to constitutional norms and proprieties.

Vinesh Phogat very poignantly summed up the mood of the protestors in her statement published by the Hindu to the effect that,

“The accused is roaming free, he is being sheltered by the government and we athletes who won medals for the country are now being put in jail for demanding justice for the country’s daughters”.

The civil liberties platform has called upon all citizens groups, women’s, farmers, students, workers, lawyers and other groups to continue being united and demand justice for the agitating women wrestlers and unequivocally condemn the brute force used by the Delhi police to arrest the women wrestlers and others and dismantle their protest site. The PUCL has also demanded that the wrestlers protest site be restored and they be allowed to peacefully agitate by exercising their democratic rights. Besides, all criminal cases registered today, against the women wrestlers and activists be dropped and Brij Bhushan Sharan Singh be immediately arrested.

Strict action should also be taken against those police functionaries who indulged in illegal action and brutal use of force against peaceful protestors.

For a country that claims to support women empowerment, that has had a rich history of women led movements and resistance, the current heart breaking state of affairs with how India’s champion women wrestlers protest is being handled by authorities and police officers reflects a stark and contradictory reality. Over the past 10 days, the women wrestlers of India have been staging a protest at Jantar Mantar, New Delhi, against the Wrestlers Federation of India chief, Brij Bhusan Singh, alleging him of sexual harassment. Brij Bhushan Sharan Singh is also a Bharatiya Janata Party (BJP) MP from Uttar Pradesh.

Only last week, on April 28, the Delhi Police had told the Supreme Court that they will be filing an FIR based on the sexual harassment charges being levied by seven women wrestlers, including a minor, against the WFI chief. It is important to note here, the protesting wrestlers had to move to the Supreme Court seeking the registration of FIRs against Singh. While the said move by the Delhi police only after the women had approached the Supreme Court, was still seen as a ray of hope, the hardships, there has been no let up for the protesting women champions against the impunity enjoyed by a politically influential man in authority.

On May 3, late-night trouble erupted for women champions who have been camping here day and night, at Jantar Mantar. India’s women champion wrestlers were reportedly abused by Delhi Police officers. Several videos of the wrestlers have gone viral on social media, showing them being surrounded by a couple of cops who misbehaved with them. It is even claimed that male police officer pushed women wrestlers without any women officer being present and that two protestors have even been injured. A drunk cop, according to the wrestlers, misbehaved with them, hurled abuse at female wrestlers, and even manhandled them at the protest site. The wrestlers went live on their respective social media accounts to report the incident.

According to the wrestlers, the Delhi Police had physically stopped them from replacing mattresses that got wet due to rain, resulting in the scuffle. "The mattresses got wet due to rain, so we were bringing folding beds for sleeping, but the police did not allow that. Drunk policeman Dharmendra abused Vinesh Phogat and got involved in a scuffle with us," former wrestler Rajveer told PTI.

In one of the videos, Vinesh Phogat stated that the officers of the Delhi Police hit her brother on the forehead and that he was taken to the hospital for treatment. According to the wrestlers, two of them (Dushyant and Rahul) were injured on their foreheads during the commotion. According to Bajrang Punia, who has been supporting the women wrestlers in their fight since the beginning and has been a part of this protest, this whole commotion occurred as some female wrestlers attempted to bring cots to the protest site due to inclement weather in Delhi, but cops refused to let them. It was alleged by Vinesh that when they brought the planks and foldable beds, a lone drunk male policeman, “Dharmendra”, started pushing the wrestlers around, without any female policeman present.

While addressing media persons late at night, Vinesh said, "We went to collect some cots from our vehicles as it's all wet out here. Some cops stopped us and started troubling us. There was no female cop nearby and these male cops started pushing us. Who gave them permission to push female protesters?" Vinesh later asked, "We are being treated so badly for raising our voices. Is this the price of winning medals for the country? If this is the case then I pray no one wins medals..."If they wish to kill us, then let them shoot us," said Vinesh, who can crying inconsolably in the video uploaded by the PTI. "Did we win medals for the country to see this day? We have not even eaten our food. Does every man have a right to abuse women? These policemen are holding guns, they can kill us," an emotionally-drained Vinesh further said.

Sakshi Malik also said, "We are not going to leave this site till our last breath. The antics of Delhi Police are as if we are criminals. There is no respect for women in their eyes. We are not going to leave till we get justice."

"Where were female police officers? How can the male officers push us like that? We are not criminals. We do not deserve such treatment. The drunk police officer hit my brother," Bajrang Punia said while talking to reporters of PTI. Wrestler Bajrang Punia's wife Sangeeta, who is also a wrestler, said she was pushed around by policemen.

Later, Bajrang Punia urged his countrymen to come to Delhi in large numbers to support their protest. "This is my humble request to my countrymen. Please arrive in large numbers in Delhi. We are fighting for your daughters' dignity. Please join us here and show your support," the Tokyo Olympics medalist said, according to PTI.

Punia also exhorted farmers and members of the public to reach Jantar Mantar in their support. "I request everyone to reach Delhi by Thursday morning. This is the time. If not, then when? This is a question of the dignity of our daughters. People like Brij Bhushan are roaming freely despite being criminals and all this is happening to us," he said.

Delhi Police’s Justifications, denial of having beaten any protestors

Based on the official statement from Delhi's ruling Aam Aadmi Party (AAP), it was their decision to provide the protesting wrestlers with cots in view of the ongoing rainy spell in Delhi as rains continue to lash in the national capital. Senior AAP leader and MLA Somnath Bharti had said, "On the instructions of Chief Minister Arvind Kejriwal, we have decided to send foldable cots to the protest site. We hope that this small help will make this tough time a little bit easier for the wrestlers."

Meanwhile, the Delhi police claimed that it was because AAP MLA Somnath Bharti arrived at the protest venue with folding beds without permission that the “scuffle” took place. "Somnath Bharti brought folding beds to the protest site in Jantar Mantar. Since there was no permission, we didn't allow it, so some of the supporters of the protesting wrestlers tried to take out the beds from the truck and this led to an altercation..." Deputy Commissioner of Police (New Delhi) Pranav Tayal provided

"We have told the wrestlers to give complaint on their grievances and will take appropriate action...medical check-up of the Policeman on whom they've raised allegations, being conducted," DCP Tayal added further.

The police officers have now claimed that the protestors wrongfully restrained a police man after accusing him of being drunk. The police has also denied that the protestors were beaten.

Footage from the venue also showed the wrestlers arguing with uniformed Delhi Police officers.  "CCTV cameras must be present. The footage will prove it," protesting wrestler Bajrang Punia told reporters after the claims made by the police, of not having beaten anyone. He also stated that Bharti was not present when the commotion occurred, and that the wrestlers had ordered the beds.

Following the scuffle between protesting wrestlers and police officers, the Delhi Police have tightened security around Jantar Mantar. Allegedly, a large police force has also been deployed on the scene, and the entire area has been barricaded.  As provided by NDTV, the police have now sealed the protest site at Jantar Mantar, thereby stopping the regular flow of well-wishers who were coming to meet the protesting wrestler.

It is pertinent to note that the protesting wrestlers have been accusing the Delhi Police of a lack of support, claiming that the Police has been simply dragging its feet on the case because neither Singh nor the women who have complained of sexual harassment have been summoned for questioning.

Proceeding in the Supreme Court

On May 4, the Supreme Court heard the case today to take stock of the investigation and pass any required order regarding the security. It was reported by Solicitor General Tushar Mehta, who was representing the Delhi Police, stated that “proper security” has been provided to minor complainant. They further provided that an individual assessment of all petitioners was conducted by then, and while they found no threats, they have agreed to give the six complainant security with respect to protest. It was further also stated that that three armed police personnel were deployed in Jantar Mantar for the three who are stationed there and round the clock security is there for all the six. And on the watch of all these, the late night assault on May-3 and 4 takes place!

Significantly, senior advocate Hooda, representing the women champion petitioners mentioned clearly before CJI Chandrachud that the wrestlers had been heckled by drunk policemen at night, to which he replied that they can approach the jurisdictional courts and the Delhi High Court with this matter, and that the Supreme Court will not be hearing this issue!

Supporters detained, attempts to gag dissent

According to the Delhi police, three people have been detained following Wednesday's incident: AAP MLA Somnath Bharti, Rajya Sabha MP Deepender Hooda, and Delhi Commission for Women (DCW) Swati Maliwal. According to a video that have gone viral on social media, women Delhi police officers were shockingly seen dragging and lifting the DCW chief from the protest site in a police van. Meanwhile, in the video, Maliwal can be heard shouting, “Don’t touch me. This is completely wrong.”

After being detained by Delhi police in the late hours of May 3, Swati Maliwal arrived again at Jantar Mantar in the national capital on Thursday morning, May 4. Speaking to Republic, the DCW chief said, "Am I a terrorist? Why are Delhi Police officials troubling me and the wrestlers? They should arrest Wrestling Federation of India (WFI) chief Brij Bhushan Sharan Singh."

Around 15 others, who had reached the protesting site, have also been detained in a bus. AAP minister Saurabh Bhardwaj was also among those. Slogans of ‘jai jawan jai kisan’ and ‘Bharat Mata ki jai’ were also being raised by the protestors.

AAP minister Saurabh Bharadwaj had tagged Delhi L-G V.K. Saxena in a tweet, asking him to take note of the incident. “Please note Lt Governor Delhi. A Delhi Police officer attacked a wrestler at Jantar Mantar. It is alleged that the policeman was drunk. A medical test should be conducted and MLC of the victim should also be registered,” he wrote.

Journalist Sakshi Joshi also posted a video of her being manhandled and detained by the Delhi Police. In the video, she can be heard shouting at the officers that they are tearing her clothes and detaining her without any reason. She also showed her torn clothes in the video. She was then seen sitting in a police bus, and then was taken to the police station.

Journalist Ajit Anjum has also posted a video on YouTube, providing his own narration of the situation that was present at Jantar Mantar. He provided that he had visited the protest site around 12.45 at night, after the Delhi police videos of manhandling the wrestlers had gone viral. When he reached the site, he saw that High level Delhi Police officers were also present at the side, and had barricaded the area, not even allowing journalists to pass. In his video, Ajit Anjun alleged the involvement of the Modi-led BJP government, as the police is under the control of the centre. He had also provided in his video that police could also be heard asking the protestors to vacate from Jantar Mantar. Ajit Anjum also alleged that supporting farmers were also not being allowed to enter the protest side.

While full throttled and government sanctioned attempts are being made to gag the protestors, independent media and any dissenters who are exercising their rights, Singh has been roaming free, declaring that all the complainants against have been manipulated or “paid”. The protesting wrestlers, according to him, were those who were at “Shaheen Bagh and the farmers’ protest”.

Response by the Wrestlers

According to News18, the protesting wrestlers have written to Union Home Ministry seeking strict action against officials responsible for the alleged manhandling of grapplers at the protest site on Wednesday night. In the letter, they have also sought permission to bring waterproof tents, beds, gym instruments, wrestling mats and sound system at the protest.

It has also been reported that the Aam Aadmi Party has called for a meeting of all MLAs, councillors and office bearers of AAP. The party will conduct a meeting on what transpired at Jantar Mantar on Wednesday night.

The #metoo wave had hit India in the year 2018, with women from myriad sectors and industries coming forward with their stories of workplace harassment endured by them. While many such claims had led to criminal cases being filed, even against women who broke the walls of silence, many women had found strength in the solidarity. The front pages of many newspapers were filled with stories of women from all sectors, entertainment, films, journalism even. But the sport industry was majorly silent. Did that mean it was a safe haven for women? Recent disclosures, one after another have exploded this myth: clearly the sports industry of India is an industry, like a myriad others, pre-dominantly run by men, and the level of misogyny found in the sports industry is evidently high. Within the sports, coaches — mentors and purveyors of skill, wisdom and knowledge — hold a certain power over the students, making it easier for them to create an intimidating and fearful atmosphere.

The silence of the women who are a part of the sports industry has finally broken. On January 18, Vinesh Phogat and Sakshi Malik, two of India's most esteemed women wrestlers, have come forth with accusations of sexual harassment against BJP MP and Wrestling Federation of India (WFI) head Brij Bhushan Sharan Singh.

The wrestlers have now gone further and staged a protest at Jantar Mantar in New Delhi to bring this issue to light and seek justice for herself and the other allegedly exploited women wrestlers. Vinesh Phogat, the country’s only double World Championship medalist, spoke to the media and said that coaches and the WFI president Brij Bhushan Sharan have been sexually harassing women wrestlers at national camps. Women wrestlers have been subjected to sexual harassment by some of the coaches at the national camps for years. Additionally, as provided by the Indian Express, Vinesh further claimed that the WFI president is complicit in this pattern of sexual harassment.

Sakshi Malik, India's lone Olympic medalist, shared the dais with Vinesh and endorsed the accusations, saying that they had come to protect those other women wrestlers who had been and were being subjected to this. As reported by Indian Express, Sakshi said that it is for them that these protesting women are battling. She further declared that they will speak up when it's time and offer the names of other people who have been harassing them to the person conducting the investigation.

It is being alleged that Vinesh further said that while she never herself faced such exploitation, she claimed many wrestlers were intimidated from coming forward because of their humble origins. Vinesh provided more information on the ways that national and international wrestlers have been allegedly exploited by the WFI chief and coaches while stating that she worries for her own safety now because she is raising her voice against very powerful individuals. As provided by her, and reported by the Indian Express, this exploitation is happening every day.  She mentioned that they had written to the Prime Minister and the Minister of Sports. She subsequently also told the media that Singh's residence in Lucknow is the only reason the camps are taking place there since it makes it easier for him to take advantage of the girls. She continued by saying that the coaches delve into their personal affairs and relationships and demand full details.

Then Vinesh addressed the wrongdoings and Singh's alleged haughtiness, saying that Singh tortures Vinesh mentally for everything. She went on to say that the wrestlers have to grovel before Singh and his assistant secretary in order to obtain anything, particularly permissions. In order to enter the national camp, the younger generation is offering Singh gifts like money, milk, and ghee. To enter the national camp, coaches must also follow the same requirements.

She then gave the name of a person who traveled to Tokyo with the women's team and claimed that the person was a coach who had no knowledge in women's wrestling as he had accompanied them after paying money. She claimed that the lack of skilled physiotherapists had a negative impact on their chances of winning a medal at Tokyo Olympics.

Reaction of the WFI

Vinod Tomar of the WFI federation crossed the street to speak with the wrestlers in protest because the federation's headquarters proximity to Jantar Mantar and is located in Singh's MP residence. As his attempt at negotiating failed, stated the Indian Express. Before leaving, he told the reporters that Brij Bhushan Sharan Singh, the WFI president, urged him to go speak with the wrestlers who were protesting and let them know they could come to the WFI headquarters and discuss any issues.

The reporters had gathered at Singh's home by that point. Singh has denied all charges even as he deals with the worst crisis of his ten years tenure at the head of Indian wrestling, so far an unblemished record. Following these allegations of harassment, the accused Singh also addressed the media and asserted that only Vinesh is alleging that the WFI had harassed a wrestler in a sexual manner. Nobody else has publicly stated that they have experienced sexual harassment. He added that he should be hanged on the day that even one more wrestler came forward to report that she had been sexually harassed.

“The age for delivering the best performance in wrestling is between 22 and 28 years. These wrestlers who are protesting can't win an Olympic medal. This is turning into anger and that is why they are protesting,” Singh was quoted as saying by the news agency ANI.

Supporters at the protest

Olympic medalist Bajrang Punia, Olympian Anshu, and world junior silver medalist Sonam Malik were among those who joined Vinesh and Sakshi in their protest against the "dictatorial practices" of the federation. Sangeeta Phogat, a nationally rated wrestler and wife of Bajrang, was also there.

According to Bajrang, who was quoted by The Indian Express, everyone rejoices when Indian wrestlers win medals but thereafter no one is concerned about how they are handled, particularly by the federation. If the PMO and the office of the Home Minister pledge that our concerns will be handled, then the protests will end. Else, Bajrang claimed that they will continue protesting as wrestlers can no longer be treated as “ghulams” of the Wrestling Federation of India. He further said that they will now talk about the rot in the federation and the “tanashahi” (autocratic functioning and environment) prevalent over many years.

Action taken against the claims made

In response to the events, Swati Maliwal, chairman of the Delhi Commission for Women, issued a notice against Singh, requesting the investigation and details of the case from the Deputy Commissioner of Police and the Secretary of Sports. A panel formed by the DCW has also sought details of Internal Complaints Committee formed by the Wrestling Federation of India. The panel also asked whether these complaints have been forwarded to the ICC and the Local Complaint Committee (LCC) as per Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

The Wrestling Federation of India (WFI) has been asked for an explanation by the Indian Sports Ministry "within the next 72 hours." Within hours of the protest, the Sports Ministry made it plain in a statement that it "would move to take action against the federation in line of the articles of the National Sports Development Code, 2011" if the WFI does not answer within the next three days.

Previous instances where allegations of Sexual Harassment were made 

There have been 45 reports of sexual harassment in the last ten years, according to data presented by The Indian Express in the year 2020. It was further provided that 29 complaints of these above-mentioned complaints had been made against coaches. As was additionally provided by the newspaper in its investigative report, in numerous instances, the accused have received light sentences, with punishments varying from transfers to a slight wage cut or pension reduction. Investigations involving over a dozen accusations, however, have gone on for years without being resolved. These incidents, however, only form part of an extensive and deeply-rooted system of harassing women sportspersons.

A few instances wherein official complaints had been filed by sportspersons against their harassers, within the sports industry:

  • In June, 2022, an Indian cyclist lodged a grievance with the Sports Authority of India (SAI). The cyclist has accused their coach, R K Sharma, of sexual harassment in Slovenia in May 2022.   The complaint goes into detail about the coach's offensive remarks and sexual advances. The cyclist claimed that the coach "forced" himself into her room, suggested giving her a "post-training massage," offered to have her "sleep with him," and proposed marriage to her because she had no future in sports. A panel to look into the allegations had been established by both the SAI and the Cycling Federation of India (CFI).

  • In July 2021, seven sportspersons accused renowned coach P Nagarajan of sexual harassment. He already had a complaint filed against him and was reportedly abusing athletes for years. He had also threatened the athletes to cease their training.

  • In January 2020, an FIR was registered against a coach for allegedly harassing and molesting a woman cricketer. As had been provided, the victim had approached Gautam Gambhir.

  • A young female athlete claimed that a few senior athletes had sexually harassed her in May 2015. After the incident, the 15-year-old died by suicide, and three other people were hospitalized after ingesting toxic fruits in what appeared to be a suicide pact. The players were undergoing training at the Vembanad Lake, Alappuzha, Kerala, Sports Center of Sports Authority (SAI) water sports facility. An FIR had been filed.

  • During the Asian Games in 2014, a female gymnast accused Coach Manoj Rana and gymnast Chandan Pathak of sexual harassment. Allegedly, the duo made vulgar comments about her attire. It was promised by the Gymnastic Federation of India (GFI) that strict punishment would be handed out to both Pathak and Rana if they were found guilty. However, Jiji Thompson, director general of SAI, cried conspiracy which had resulted from an internal dispute in the GFI. He indicated that the 29-year-old woman was herself at fault for going to police we she was not from India and was practicing at the stadium under the 'Come and Play' scheme.

  • In 2009, a young boxer made the decision to take her own life because she could no longer stand her coach's relentless harassment. The 21-year-old S Amaravathi died by suicide inside the Lal Bahadur Stadium by ingesting poison when she could no longer tolerate the frequent altercations with her coach Omkar Yadav. She was a promising talent and the junior national boxing champion. After she passed away, an investigation was mandated. The hostel staff, however, refuted these accusations and said that she was simply experiencing poor self-esteem.

Sexual Harassment Redressal Mechanisms in place for Sportspersons

According to the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act of 2013, any workplace with more than 10 employees needs an internal complaints committee. The Section 2 (o) (iv) of the said act , which provides the definition of workplace and the institutions that fall under it, states that:

 “Any sport institute, stadium, sports complex or competitions or games venue, whether residential or not used for training, sports or other activities relating thereto.”

Contrary to popular belief, sports facilities are thus considered workplaces for purposes of the law. Despite this, information about the Internal Complaints Committee (ICC) at various federations is hard to come by; the majority isn't posted on the organizations' official websites or on notice boards in training facilities around the nation.

The Act's operative phrase is "workplace." It also defines the terms "employer" (Section 2(g)) and "employee" (Section 2(f)). A person in charge of the "administration, supervision, and control" of the workplace is known as an employer. A workplace Internal Committee (IC) must be established by the company.

In relation to sports infrastructure, competition and event sites, dormitories, and games villages, to name a few sports workplaces, India's numerous sports federations and other governing bodies are employers. Therefore, in accordance with the law, these businesses are required to set up an IC to look into and ask questions about sexual harassment claims filed by sportsmen and sportspeople.

Athletes who were questioned by Scroll.in in 2018 on the existence of a sexual harassment grievance redressal mechanism stated anonymously that nobody has given this significant consideration, with the exception of a few federations. A few allegations continue to surface on a regular basis, but the most of the time the accused coaches are directly employed by the Sports Authority of India, thus federations have no control over them. However, all National Sport Federations (NSFs) are technically supposed to have a complaints procedure in place.

The National Sports Federations and other sport organizations are responsible for ensuring women's safety, under the National Sports Development Code of India from 2011. They are enjoined to establish policies that forbid sexual harassment, inform every one of these policies, and provide suitable platforms for women to bring up the subject. A complaints process must be established, and it must include provisions for a third party with knowledge of the problem of sexual harassment. The majority of federations are in violation of the law since they have not implemented these processes.

In most cases, young women with diverse family background, not all having access to vocal echelons of society make it to the top, after choosing this as a career over much is invested. The absence of a pro-active and sensitive environment can make them voiceless victims.

Although some of these NSFs have athletes' commissions to handle complaints and grievances, they are not - as required - specifically for sexual harassment and are not led by women. The standard method is to approach the president or secretary and speak with them directly. This indicates that there isn't a formal complaint, which is required by the ICC. This also explains why there are frequently no official complaints.

For women who have tackled this nightmare throughout their professional careers, sexual harassment in the sports industry has been a slow-burning fuse for ten years now. This raises serious concerns about women's safety in sports. As can be deduced from the cases provided above, the Sports Authority of India is not doing a fair job at protecting the women sportsperson in India. Through the cases provided about, it can be seen that the SAI is more inclined to protecting its employees, or burying down the case.

The protest staged by these wrestlers have brought across a major void that exists within the sports industry. The workplace sexual harassment law requires that internal complaints committees should contain at least three employees. As this is the general rule, it becomes even more difficult for the woman to approach the authorities with their complaints and receive an impartial treatment. This also depicts the internal hegemonies that exist within the sports industry and the dominance that a woman needs to fight against while approaching the authorities with complaint against their harassers.

Conclusion

Sports are mostly still exclusively a masculine domain despite the proficiency shown by more and more women. Not only when it comes to consumers or athletes, but also in coaching and administration, where the sex-ratio is greatly skewed. It is pertinent to note that in the case of WFI, there is an ICC in place. The question then arises is, why are these women wrestlers and their supporters not approaching them, and are rather opting to protest on roads? Is the redressal mechanism in place not enough to tackle with this issue in an unbiased and fair method?

It is further crucial to pay attention to the deep and serious allegations that are being made by Vinesh Phogat and Sakshi Malik against the predatory behavior shown by the very people that are supposed to teach and train them. How many before had to, and how many after these two will have to suffer through this culture of dominance and impunity?

The authorities as well as the lawmakers need to go beyond just addressing this case and asking for explanations, and should consider if stricter laws are needed. It would be negligent to claim that sexual harassment does not happen to male athletes, especially minors, even though the bulk of cases involving sexual harassment include woman survivors. But, before we arrive at the issue of introducing gender neutral laws, it is essential that we first appropriately implement the protections are already existing to tackle with the systematic oppression of women, and then aim to bring in laws that protect every one, no matter their gender.
