Traders Move HC on Manual Scavenger Death: Bombay HC

In a welcome move, a traders body has today filed a PIL on behalf of Federation Of Retail Traders Welfare Association against the State of Maharashtra, UDD, CS, Maharashtra, MCGM, MC, MCGM, Chief Engineer, Sewage Operation Department, Chief Engineer, Storm Water Drain and Commissioner of Police, Mumbai with respect to the tragic death of Dr. Deepak Amarapurkar, who fell in an open and uncovered manhole on 29th August 2017. Viren Shah, an old BJP hand is the petitioner.

The PIL prays for registration of offence u/s 304-A of IPC which deals with Death on account of Negligence, have asked for a compensation of Rs.50 lakhs to be paid by MCGM to a Charitable Institute/NGO for the death.

 

The petition also urges the formation of an Advisory Committee of Ex-Bureaucrats and Technocrats to give suggestions in operating manholes, directing the government to fix accountability of the incident of the concerned Officer of MCGM.

The PIL will be mentioned tomorrow before the chief justice and Justice J. Jamdar by Mr. Sujay Kantawala and Mr. Ashish Mehta.
