Justice Abdul Nazeer

Justice Abdul Nazeer, is not only one of the judges with longest term at the Supreme Court (SC) of India but also the one, only third in the history of the SC, who was elevated to the highest court in 2017 (to retire on October 20, 2023) without being Chief Justice of any High Court.

On December 26, 2021, he addressed the 16th National Council Meeting of the Akhil Bhartiya Adhivakta Parishad (ABAP) at Hyderabad on the theme of ‘Decolonisation of the Indian Legal System’. His participation in this event was surprising in many respects. It was an organisational meeting of one of the appendages of RSS. According to a Hindi publication of RSS [Parm Vaibhav ke Path Per, 1997] ABAP was created in 1992 to work for moulding the Indian judicial system according to “Bhartiya culture…to suggest amendments in the Indian Constitution… [and] amendment in Article 30”. It is to be noted that according to RSS Bhartiya culture is Hindu culture only. The Indian Constitution needs to be discarded as according to the most prominent ideologue of the RSS, MS Golwalkar [Bunch of Thoughts], “It has absolutely nothing which can be called our own.” It stands for removal of Article 30 of the Constitution which provides minorities right to establish and administer educational institutions.

It is interesting to note that ABAP on its website did not reproduce the text of the address of the Justice for reasons known to them only but thanks to a prominent legal portal (LiveLaw.in) the whole text was made available. Justice Nazeer deliberating on the theme declared that Indian legal system was a colonial legal system which “is not suitable for the Indian population. The need of the hour is the Indianisation of the legal system.”

What he meant by Indianisation of the Indian legal system was made clear by the following utterances of his:

“We must go back in time to the ancient Indian Scriptures to get a true and correct picture of the legal system of ancient India. It is then that we discovered that ancient Indian jurisprudence was founded on the basis of the rule of law and had some of the features that were immensely revolutionary for the ancient world.”

He lamented the fact that the Indian legal system continued to neglect the great knowledge of the “legal traditions as per Manu, Kautilya, Katyayana, Brihaspati, Narad, Yagyavalkya and other legal giants of ancient India” which resulted in “adherence to colonial legal system” that proved to be “detrimental to the goals of our Constitution and against our national interest.”

According to him, “Despite such a rich tradition of highly sophisticated pre-existing legal system which was prevalent in India, foreign legal systems were imposed upon us with every invasion [he means Arabs] and occupation” [by the British] and it is lamentable and “tragic that the same colonial legal system is being continued in a large and changed manner even today in 2021.”

Justice fondly remembered Manu who prescribed “public censure as one of the punishments for crime.” It is immensely sad that a legal luminary gracing the SC Bench is glorifying public shaming as a form of punishment. He completely disregarded the fact that public censure was and is in vogue in totalitarian regimes which leads to witch-hunting [both in literal and macro sense] and lynching. In fact, Allahabad High Court in a judgment [March 2020] declared naming and shaming of CAA protestors by Adityanath government as “nothing but an unwarranted interference in privacy of people” and violation of Article 21.  

He also praised Kautilya and his work Arthashastra for upholding the concept of a welfare state in which “the happiness of his subjects lies the King’s happiness; in their welfare his welfare…”

For Justice Nazeer the present legal system which propelled him to reach to the highest court of justice of India suffered from “Colonial psyche” which led to rejecting the ancient Indian legal system in which “the king was himself subject to the law…The judges were independent and subject only to the law…disputes were decided essentially in accordance with the same principles of natural justice which govern the judicial process in the modern state today.”

In order to know the truth, we need to compare above stated claims by Justice Nazeer with the original writings of two of his favourite ancient Indian legal luminaries, Manu and Kautilya (also known as Chanakya and Vishnugupta).

Manu Code

Some of the laws Manusmriti or Manu Code denigrating Sudras:

  1. For the sake of the prosperity of the worlds (the divine one) caused the Brahmana, the Kshatriya, the Vaisya, and the Sudra to proceed from his mouth, his arm, his thighs and his feet.

  1. One occupation only the lord prescribed to the Sudras, to serve meekly even these (other) three castes.

  1. If Sudra arrogantly teaches Brahmanas their duty, the king shall cause hot oil to be poured into his mouth and into his ears.

  1. A low-caste man who tries to place himself on the same seat with a man of a high caste shall be branded on his hip and be banished, or (the king) shall cause his buttock to be gashed.

Some of the Laws of Manu denigrating women:

1. Day and night woman must be kept in dependence by the males (of) their (families), and, if they attach themselves to sensual enjoyments, they must be kept under one’s control.

2. Her father protects (her) in childhood, her husband protects (her) in youth, and her sons protect (her) in old age; a woman is never fit for independence.

3. Women do not care for beauty, nor is their attention fixed on age; (thinking), ‘(It is enough

 that) he is a man,’ they give themselves to the handsome and to the ugly.

4. (When creating them) Manu allotted to women (a love of their) bed, (of their) seat and (of) ornament, impure desires, wrath, dishonesty, malice, and bad conduct.

It will be interesting to note that VD Savarkar declared Manusmriti to be the “most worship-able after Vedas for our Hindu Nation” and when the Constituent Assembly of India finalised the Constitution of India on November 26, 1949, RSS was angry. Its English organ, Organiser in an editorial on November 30, 1949, complained:

“But in our Constitution there is no mention of the unique constitutional development in ancient Bharat…To this day his laws as enunciated in the Manusmriti excite the admiration of the world and elicit spontaneous obedience and conformity. But to our constitutional pundits that means nothing.”

Kautilya and Arthashastra

One of BJP’s official websites (http://library.bjp.org/jspui/handle/123456789/80) runs text of English translation of Arthashastra (Kautilya’s Arthshastra, tr. by R. Shamsastry) which defends Casteism in the following words:

“The duty of the Brahman is study, teaching, performance of sacrifice, officiating in others’ sacrificial performance and the giving and receiving of gifts. That of a Kshatriya is study, performance of sacrifice, giving gifts, military occupation, and protection of life. That of a Vaisya is study, performance of sacrifice, giving gifts, agriculture, cattle breeding, and trade. That of a Sudra is the serving of twice-born, agriculture, cattle-breeding, and trade, the profession of artisans and court-bards.”

Kautilya’s king is a ruthless dictator: 

It is the king in whom the duties of both Indra (the rewarder) and Yama (the punisher) are blended, and he is a visible dispenser of punishments and rewards; whoever disregards kings will be visited with divine punishments, too. Hence kings shall never be despised. Thus, treacherous opponents of sovereignty shall be silenced.”

Arthshastra is a detailed ready reckoner for torture methods. The chapter VIII in book IV titled as “Trial and Torture to Elicit Confession” reads:

“Those whose guilt is believed to be true shall be subjected to torture…Torture of women shall be half of the prescribed standard. There are in vogue four kinds of torture…Six punishments, seven kinds of whipping, two kinds of suspension from above, and water-tube. As to persons who have committed grave offences, the form of torture will be nine kinds of blows with a cane:–12 beats on each of the thighs; 28 beats with a stick of the tree; 32 beats on each palm of the hands and on each sole of the feet; two on the knuckles, the hands being joined so as to appear like a scorpion; two kinds of suspensions, face downwards burning one of the joints of a finger…These are the 18 kinds of torture…Each day a fresh kind of the torture may be employed.”

Kautilya brazenly prescribed apartheid in human habitants. According to him in a fort, “Royal teachers, priests…and ministers shall occupy sites east by north to the palace. To the west, artisans manufacturing…as well as the people of Súdra caste shall have their dwellings.”

The punishment prescribed for women who are not submissive reads:

“Three beats either with a bamboo-bark or with a rope or with the palm of the hand may be given on her hips…” If a woman goes out in day time “She shall pay a fine of 6 panas (a contemporary coin) for going out at day time to sports or to see a woman or spectacles. She shall pay a fine of 12 panas if she goes out to see another man or for sports.”

Justice Nazeer by glorifying such inhuman legal systems and decrying the constitutionally ordained legal system has violated the oath that to “bear true faith and allegiance to the Constitution of India as by law established…and that I will uphold the Constitution and the laws” which he took while assuming the office. His sermon has greatly insulted the work and contribution of Constituent Assembly of India. 

Justice Nazeer’s address at ABAP suffers from two serious infirmities too; factual as well as normative. Factually, he is hugely wrong when he underlines a single source of Indian civilization and its legal heritage. All his jurist idols – Manu, Kautilya, Katyayana, Brihaspati, Narad, Yagyavalkya – from ancient India, are known for Brahmanical interpretations. Justice Nazeer for reasons known to him only did not bother to refer to Buddhist and Jain heritage of jurisprudence which was amazingly humane and egalitarian.

Rahul Shyam Bhandari, a renowned lawyer and researcher of the history of Indian jurisprudence has done pioneer work on the legal system under Buddhism which could be described as constitutionalism. One of the greatest followers of Buddha in ancient India King Ashoka got the following proclamation, a great example of inclusivity, engraved on a rock known as Rock Edict No 12. It read:

“The Beloved of the Gods, the king Piyadassi, honours all sects and both ascetics and laymen, with gifts and various forms of recognition…On each occasion, one should honour another man’s sect, for by doing so one increases the influence of one’s own sect and benefits that of the other man…This is the desire of the Beloved of the Gods, that all sects should be well-informed, and should teach that which is good…”

According to Bhandari, Buddha propagated that no absolute authority vested in one person. The Vinaya Texts and Patimokkha Texts were the basis of Buddhist legal framework. The first part of Patimokkha dealt with the four gravest sins—sexual intercourse, theft, murder and demonstration of one’s miraculous powers which were punishable.

Jainism also had an elaborate legal system which did not treat women as inferior beings. Acharya Bhadrabahu (367 BC-298 BC) wrote Bhadrabahu Samhit which accorded full inheritance rights to women. If a person died having a son or without a son, property was passed to the widow. The male enjoyed no preferential treatment.

 more critical problem, a theoretical one, with the lecture was that Justice Nazeer was glorifying the pre-modern legal practices as superior to those which were adopted by the Indian Constituent Assembly as integral part of a modern nation building. According to him the august Assembly suffered from “Colonial psyche” thus falling prey to the colonial system. It was horrendous on his part to declare that Manu and Kautilya stood for legal systems based on Rule of Law, Natural Justice and independence of judiciary. Such notions did not exist then. Those were the times when a group of brothers as rulers, the Pandavas, enjoyed the sole authority to put on stake, in a gamble, their kingdom, assets, even joint wife, Draupadi. If it was Rule of Law and Natural Justice prevailed such heinous happening could not have taken place.

The call by Justice Nazeer to return to the golden past (the historicity of which is greatly doubted by the large number of serious historians) is fraught with multiple dangers. De-colonisation was a long-drawn process unleashed in the mid-20th century against the mightiest imperialist powers. It succeeded at the cost of unimaginable human sacrifices offered by the people of the colonies. The object was to get rid of the shackles of imperialism, feudalism and capitalism and march on for a progressive, egalitarian and rational polity. Indian constitution and our judicial system may rightly be found wanting in many respects. The solution lies in further humanizing these, not seeking refuge in the stories of kings and kingdoms.

Justice Nazeer’s sermon bodes ill for democratic-secular polity of India which is already under threat from the RSS-BJP rulers. According to the renowned political analyst, Pratap Bhanu Mehta by using the brute power of the vote and least bothered about constitutional protections they have turned Parliament into a notice board, not a debating forum. In such critical times judiciary, especially the highest court of justice remains the only hope of taming the Hindutva juggernaut which is running amok.

NOTE: It will not be out of context to know that the architect of the Indian constitution, Dr. BR Ambedkar was present when on December 25, 1927 at Mahad, Maharashtra a copy of Manusmriti was burnt. On this day he also called upon to commemorate every December 25 as ‘Manusmriti Dahan Divas’ by burning the same.

The Constituent Assembly (CA) of India finalised the Constitution of India on November 26, 1949, a date which is celebrated now every year as Constitution Day. This Constitution promised a new-born Indian Republic a polity based on democracy, justice, egalitarianism and rule of law. However, RSS was greatly annoyed. Four days after the historic event of approval of it, the RSS English mouth-piece, Organiser in an editorial on November 30, 1949, complained:

“But in our Constitution, there is no mention of the unique constitutional development in ancient Bharat. Manu’s Laws were written long before Lycurgus of Sparta or Solon of Persia. To this day his laws as enunciated in the Manusmriti excite the admiration of the world and elicit spontaneous obedience and conformity. But to our constitutional pundits that means nothing.”

Thus, Rashtriya Swayamsevak Sangh (RSS) wanted this Constitution to be replaced by Manusmriti or Manu Code which is known for its derogatory and inhuman references to Sudras, Untouchables and women. By demanding promulgation of the laws of Manu in independent India RSS was simply following its mentor, philosopher and guide VD Savarkar. According to him,

Manusmriti is that scripture which is most worship-able after Vedas for our Hindu Nation and which from ancient times has become the basis of our culture-customs, thought and practice. This book for centuries has codified the spiritual and divine march of our nation. Even today the rules which are followed by crores of Hindus in their lives and practice are based on Manusmriti. Today Manusmriti is Hindu Law.”

RSS continued to hate the Indian Constitution despite it being regarded as one of the finest documents upholding principles of equality and justice, globally. The most prominent ideologue of RSS, MS Golwalkar declared it to be anti-Hindu. The collection of his writings Bunch of Thoughts which is a Bible for the RSS cadres carries the following statement against the Constitution.

“Our Constitution too is just a cumbersome and heterogeneous piecing together of various articles from various Constitutions of Western countries. It has absolutely nothing which can be called our own. Is there a single word of reference in its guiding principles as to what our national mission is and what our keynote in life is?”

What kind of civilization the RSS and Hindutva camp want to build by enforcing the laws of Manu, can be known by having a glimpse of the laws prescribed by Manu for the lower castes/Untouchables and women. Some of these dehumanising and degenerate laws, which are presented here, are self-explanatory. 

Laws of Manu concerning Dalits/Untouchables

[This selection of Manu’s Codes is from F. Max Muller, Laws of Manu (Delhi: LP Publications, 1996; first published in 1886). The bracket after each code incorporates the number of chapter/number of code according to the above edition.] 

1.    For the sake of the prosperity of the worlds (the divine one) caused the Brahmana, the Kshatriya, the Vaisya, and the Sudra to proceed from his mouth, his arm, his thighs and his feet. (I/31)

2.    One occupation only the lord prescribed to the Sudras, to serve meekly even these (other) three castes. (I/91)

3.    Once-born man (a Sudra), who insults a twice-born man with gross invective, shall have his tongue cut out; for he is of low origin. (VIII/270)

4.    If he mentions the names and castes (jati) of the (twice-born) with contumely, an iron nail, ten fingers long, shall be thrust red-hot into his mouth. (VIII/271) 

5-    If he arrogantly teaches Brahmanas their duty, the king shall cause hot oil to be poured into his mouth and into his ears. (VIII/272)

6.    With whatever limb a man of a low caste does hurt to (a man of the three) highest (castes), even that limb shall be cut off; that is the teaching of Manu. (VIII/279)

7.    He who raises his hand or a stick, shall have his hand cut off; he who in anger kicks with his foot, shall have his foot cut off. (VIII/280)

8.    A low-caste man who tries to place himself on the same seat with a man of a high caste, shall be branded on his hip and be banished, or (the king) shall cause his buttock to be gashed. (VIII/281)

      As per the Manu Code if Sudras are to be given the most stringent punishments for even petty violations/actions, the same Code of Manu is very lenient towards Brahmins. Shloka 380 in Chapter VIII bestowing profound love on Brahmins decrees:  

      “Let him never slay a Brahmana, though he have committed all (possible) crimes; let him banish such an (offender), leaving all his property (to him) and (his body) unhurt.”

Laws of Manu concerning women

1.    Day and night women must be kept in dependence by the males (of) their (families), and, if they attach themselves to sensual enjoyments, they must be kept under one’s control. (IX/2)

2.    Her father protects (her) in childhood, her husband protects (her) in youth, and her sons protect (her) in old age; a woman is never fit for independence. (IX/3)

3.    Women must particularly be guarded against evil inclinations, however trifling (they may appear); for, if they are not guarded, they will bring sorrow on two families. (IX/5)

4.    Considering that the highest duty of all castes, even weak husbands (must) strive to guard their wives. (IX/6)

5.    No man can completely guard women by force; but they can be guarded by the employment of the (following) expedients:

6.    Let the (husband) employ his (wife) in the collection and expenditure of his wealth, in keeping (everything) clean, in (the fulfilment of) religious duties, in the preparation of his food, and in looking after the household utensils.

7.    Women, confined in the house under trustworthy and obedient servants, are not (well) guarded; but those who of their own accord keep guard over themselves, are well guarded. (IX/12)

8.    Women do not care for beauty, nor is their attention fixed on age; (thinking), ‘(It is enough that) he is a man,’ they give themselves to the handsome and to the ugly. (IX/14)

9.    Through their passion for men, through their mutable temper, through their natural heartlessness, they become disloyal towards their husbands, however carefully they may be guarded in this (world). (IX/15)

10.  (When creating them) Manu allotted to women (a love of their) bed, (of their) seat and (of) ornament, impure desires, wrath, dishonesty, malice, and bad conduct. (IX/17)

11.  For women no (sacramental) rite (is performed) with sacred texts, thus the law is settled; women (who are) destitute of strength and destitute of (the knowledge of) Vedic texts, (are as impure as) falsehood (itself), that is a fixed rule. (IX/18)

Reproduced parts of Manu Code above need no further elaboration and commentary. They are too glaringly venomous, fascist and degenerated against Untouchables who are referred to as Sudras by Manu.

It is a hugely sad time for democratic-secular Republic of India that RSS-BJP rulers who worship Manusmriti and want to undo the present Indian polity would be putting up a farcical show of celebrating the Constitution Day. The nation must be at guard to defend the Constitution from wolves in the attire of sheep!

On the 46th anniversary of the Emergency imposed by Indira Gandhi [June 25, 1975] we are witnessing once again the farce of Rashtriya Swayamsevak Sangh (RSS) claiming that it opposed it with full might. It is laughable to find it boasting that RSS fought against the Emergency not due to any compulsion but as article of faith in democracy. How RSS cadres ruling India today love democracy is to be seen and believed. The Indian jails which were supposed to incarcerate anti-social elements are packed with young activists ranging from brilliant school/university students (large number of them being girls) to senior citizens in 70s and 80s with serious ailments. According to a reputed world study “India’s score fell from a peak of 7.92 in 2014 to 6.61 in 2020 and its global ranking slipped from 27th (in 2014) to 53rd as a result of democratic backsliding” under the current RSS-BJP regime.[i]

In fact, totalitarianism is in the veins of RSS cadres who are fond of IRON MEN. That, democracy and RSS are antithetical, is not what critics of the Hindutva politics highlight but is what the most prominent ideologue of the RSS, MS Golwalkar, also known as ‘Guru of Hate’ [whom PM Modi credits for grooming him into a political leader] decreed while addressing the 1350 top level cadres of the RSS in 1940 declared,

“RSS inspired by one flag, one leader and one ideology is lighting the flame of Hindutva in each and every corner of this great land.”[ii]

We must evaluate the RSS claim of fighting the Emergency with the contemporary RSS documents. The 3rd Supremo of RSS, Madhukar Dattatraya Deoras wrote the first letter of praise to Indira Gandhi within two months of the imposition of Emergency. It was the time when state terror was running amok. In letter dated, August 22, 1975 he began with the following praise of Indira:

“I heard your address to the nation which you delivered on August 15, 1975 from Red Fort on radio in jail [Yervada jail] with attention. Your address was timely and balanced so I decided to write to you”.[iii]

Indira Gandhi did not respond to it. So, Deoras wrote another letter to Indira on November 10, 1975. He began his letter with congratulating her on being cleared by the Supreme Court of disqualification which was ordered by the Allahabad High Court,

“All the five Justices of the Supreme Court have declared your election constitutional, heartiest greetings for it.”

It is to be noted that opposition was firmly of the opinion that this judgment was ‘managed’ by the Congress. In the course of the letter, he declared that

“RSS has been named in context of Jaiprakash Narayan’s movement. The government has also connected RSS with Gujarat movement and Bihar movement without any reason…Sangh has no relation with these movements…”[iv]

Since Indira Gandhi did not respond to this letter too, RSS chief got hold of Vinoba Bhave who supported the Emergency religiously, and was a favourite of Indira Gandhi. In a letter dated January 12, 1976, Deoras begged that Acharya should suggest the way that ban on RSS was removed.[v]  Since Acharya too did not respond to Deoras letter, the latter in another communication without date desperately wrote:  

“According to press reports respected PM [Indira Gandhi] is going to meet you at Pavnar Ashram on January 24. At that time there will be discussion about the present condition of the country. I beg you to try to remove the wrong assumptions of PM about RSS so that ban on RSS is lifted and RSS members are released from jails. We are looking forward for the times when RSS and its members are able to contribute to the plans of progress which are being run in all the fields under the leadership of PM.”[vi]

Balraj Madhok, a senior ideologue of the RSS who died as pracharak [whole-timer] of RSS in 2016 in his autobiography without mincing words wrote that Sarsanghchalak Deoras was fond of good living and when was held under MISA, “wrote two letters on August 22, 1975 and November 10, 1975 to Indira Gandhi for reconsidering her attitude towards the Sangh and lifting the ban from it. He also wrote a letter to Shri Vinoba Bhave requesting him to try to remove from Indira Gandhi’s heart anti [Sangh] feelings.” [Zindagi Ka Safar –3: Deendayal Upadhyay Ki Hatya Se Indira Gandhi Ki Hatya Tak (Journey of Life-3: From the Murder of Deendayal Upadhyay to the Murder of Indira Gandhi), Dinman, Delhi, 2003, p. 188-189.]

It is to be noted that former President of the Indian Republic, Pranab Mukherjee was invited by the RSS chief, Mohan Bhagwat as the chief guest at the graduation ceremony of its new recruits in 2018. It would be naïve to believe that Bhagwat did not know that Pranab Mukherjee was indicted as one of the top leaders of Congress for Emergency excesses.

It is shameful that despite these facts thousands of RSS cadres continue to get monthly family pension for the persecution during Emergency. The BJP ruled states like Gujarat, Madhya Pradesh, Rajasthan and Maharashtra decided to award a monthly pension of Rs 20,000 to those who were jailed during the Emergency period for less than 2 month and Rs 10000 to those who were jailed for less than a month. This rule took care of the financial interest of those RSS cadres who submitted mercy letters completing only one or two months’ jail term. For securing such a fat pension there was no such condition that the beneficiary should have been in jail for the whole period of the Emergency.

Interestingly, in the case of anti-British freedom struggle there has not been even a single RSS cadre to claim the freedom fighter pension. It is sad that nobody remembers hundreds of Communist youth who branded as Naxals and killed in fake encounters during the Emergency.

Jallianwala Bagh martyrs

The RSS-BJP rulers of India declare India to be a battle-ground between Hinduism and Islam. Muslims have been declared as ‘Internal Threat’ number ONE [RSS ideologue, MS Golwalkar’s Bunch of Thought chapter xvi]. Many of their leading cadres including those who hold high constitutional posts have been conspiring over-time to ignite a civil war between the two communities (they believe that only such a scenario would divert attention from the anti-people rule by the Hindutva gang). They refuse to treat Muslims as part of the Indian nation, which according to them is a Hindu nation. They have no hesitation in identifying themselves as ‘Hindu nationalists’. Awfully, PM Modi who took oath to uphold democratic-secular polity in 2014, long before had identified himself as a Hindu nationalist with total commitments to the Hindutva project.

However, it was not the scenario during the freedom struggle which the Hindutva organisations; RSS and Hindu Mahasabha led by VD Savarkar, willfully betrayed. Nobody should be surprised to know that in the pre-independence literature of RSS there is no mention of this massacre. The unity of the Indian masses could be witnessed when the British rulers perpetrated one of the worst blood-baths in modern history; the Jallianwala Bagh massacre on April 13, 1919. However, people of India shackled by the most powerful imperialist power of the world, Britain, presented a heroic united resistance. It was no exception. It could be seen again and again since the First War of Independence 1857. It is no hearsay but corroborated by the contemporary British government documents. These amazing eye-opening documents were part of the British archives which became National Archives of India after independence.

The documents, concerning the most volatile period of the Indian freedom struggle, not only showed the Britishers brazenly flouting democratic norms, indulging in barbarism while suppressing the mass discontent but also brought to light hitherto hidden aspects of Indian people’s united heroic fight-back. The contemporary documents are both saddening and amazing. It was hugely shocking to watch the ‘civilized’ British indulging in acts of unprecedented violence against Indians and the amazing way the people of India, collectively and individually, belonging to different faiths and Castes, rose in revolt.

British rulers perpetrated the massacre; Independent India remained/remains indifferent to the victims

These documents make shocking revelations about the reprehensible attitude of the foreign rulers towards victims of the Jallianwala Bagh massacre. In June 1919 the home department came out with the statement which described the British causalities but kept mum on the count of Indian deaths raising an idiotic argument that whatever number would be made public by the British government would not be acceptable to the Indians! 

However, when government repression in Punjab drew world-wide condemnation, the British government appointed a commission of enquiry for investigating the violence in Punjab on October 14, 1919, headed by a jurist from Scotland, Hunter. This commission came to be known as Hunter Commission. It came to the conclusion that at Jallianwala Bagh 381 Indians, including males, females and even a 6-month-old baby were killed by General Dyer’s force. This count was highly disputable as the unidentified bodies (of the people who were not Punjabis but were in Amritsar as it was a famous business/religious centre where also people from other states constantly came in search of livelihood) were disposed of.

The list of martyrs only underlines the multi-religious and multi-Caste character of the anti-British freedom struggle 

The Hunter Commission list of martyrs makes it clear that the protest meeting at Jallianwala Bagh held in protest against Rowlatt Act and arrests of renowned Congress leaders, Dr. Satyapal and Saifuddin Kitchlew (whose son Toufique Kitchlew, an author died in penury) was attended by men, youth, women of all religions and Castes. According to the list 381 Indians died due to the firing of the British army under the command of Brigadier General Reginald Dyer. His invading force mainly consisted of Nepali Gurkhas, Baluch Regiment (manned by Punjabi Muslims, Hindus and Sikhs), the 54th Sikhs and the 59th Sind Rifles soldiers making it clear that the British ruled India with the help of the Indian stooges.  

Out of 381 martyrs only 376 were identified, 220 were Hindus, 90 Sikhs and 66 Muslims. Another significant aspect of this gathering, which reflected in the list of martyrs too, was that if on the one hand businessmen, lawyers, journalists, literary persons, government employees, intellectuals were present, on the other hand large number of audience belonged to the professions like ironsmith, dhobi (washer men) weavers, barbers, helpers, daily-wage earner, carpet-knitters, masons, cobblers and sweepers. Many women were also present. The Caste identities were as wide and included, chartist (traders), Pathan, Jet, Rajput, Brahmins, Barrages, banyan, Sheikh, Slayed, Mambo etc. Notably, 14 Kashmiri Muslims were also martyred who are treated as anti-national by the RSS-BJP rulers. The women martyrs were, Harbir Kaur identified as Jatni and Bitto sister of Sher Singh Jat.

These realities once again underlined the fact that before the appearance of protagonists of Hindu and Muslim separatism, Indian freedom struggle was a united movement over-riding religious and Caste divisions. It was a true anti-colonial movement for an all-inclusive India. 

The ideal of Joint Martyrdoms-Joint Heritage of Jallianwala Bagh carried forward by Udham Singh by adopting the name ‘Mohammed Singh Azad’

Udham Singh was 20-year-old orphan (born in a Dalit family) who witnessed the massacre. So deep was the hatred that he vowed not to rest until he had avenged the killing of the innocent hundreds. In order to enter England where one of the perpetrators was living, he travelled to Mesopotamia, Kenya, Uganda, USA and USSR, all in quest of Indian revolutionaries and ammunitions. He survived working as a carpenter and helping to organise the labour movements in the countries where he took refuge. He spent almost two decades as a refugee in different parts of the world. Finally, he could fulfill his vow of taking revenge on March 13, 1940 when he shot dead Michael O’Dwyer, the Lt. Governor of Punjab (the architect of the Jallianwala massacre who ordered the crackdown) at Caxton Hall, London. When taken to court after arrest he identified himself as Mohammad Singh Azad. By adopting this name underscored the fact that the overthrow of the British rule was impossible without the unity of the Hindu, Muslim and Sikh of India.

It was 81 years ago (July 31, 1940) Udham Singh died on the gallows in the Pentonville prison of London. Before kissing the gallows Mohammad Singh Azad said:  

“I did it because… he deserved it. He… wanted to crush the spirit of my people, so I have crushed him. For full 21 years I have been trying to wreak vengeance. I am happy I have done the job. I am not scared of death. I am dying for my country.”

After announcement of death sentence he had told the court:

“I do not care about sentence of death…I am dying for a purpose.. We are suffering from the British Empire…I am proud to die  to free my native land and I hope that when I am gone…in my place will come thousands of my countrymen to drive you dirty dogs out; to free my country…you will be cleansed out of India. And your British imperialism will be smashed…I have nothing against the English people at all…I have great sympathy with the workers of England. I am against the imperialist government. DOWN WITH BRITISH IMPERIALISM!”

There is a strong livelihood that Udham Singh returns to India with this name today he will be lynched by the Hindutva goons.    

Shockingly, even after Independence of the country, nothing changed for the surviving members of the martyrs and grievously injured. They remained neglected what to talk of honouring the families. In India, where persons who were behind bars during Emergency (1975-77) for less than a month, receive INR 10,000 and less than 2 months as INR 20,000 as family pension, the demand of the families of the martyrs that at least they should be entitled for pension and railway concession have not been accepted. Disgusted, ‘the Jallianwala Bagh Shaheed Parivar Samiti’ wrote a letter to the British PM that England should compensate their loss! It only shows the helplessness and hopelessness of the families of the martyrs but surely shamelessness and spinelessness of the Indian rulers.

Hindutva rulers resorting to far more draconian laws than used by the British

On this anniversary of Jallianwala Bagh massacre the hypocrisy of the Hindutva rulers is to be seen and believed. This lot like every anniversary will laud the sacrifices at Jallianwala Bagh and condemn repression by the British by imposing draconian laws like Rowlatt Act.  While they are using far worse draconian laws like DIR, MISA, TADA, POTA, UAPA, AFSPA as every day’s governing tool discarding democratic-secular norms enshrined in the Constitution. It is difficult to count how many intellectuals, lawyers, journalists, activists, authors, poets, artists are behind bars under these laws.

RSS-BJP rulers justify killing by police under their command

It is sad that on the eve of 102nd commemoration of the Jallianwala Bagh massacre in which Hindus-Muslims-Sikhs laid down their live together, some RSS-BJP leaders are allegedly hailing the brutal killing at Sitalkuchi village of 4 young Muslim voters by a central Para-military force under the ministry of home headed by Amit Shah. The Bengal BJP chief, Dilip Ghosh declared that “there would be a Sitalkuchi everywhere.” Another RSS-BJP leader of the State, Rahul Sinha went to the extent of demanding that central forces should have killed eight rather than four people in Sitalkuchi in West Bengal. It is high time that in order to save our democratic-secular India from the clutches of the Hindutva rulers we remember the heritage of joint martyrdoms of Jallianwala Bagh and use it as antidote to the criminal communal polarizing game played by them. It would be the fittest homage to the martyrs of Jallianwala Bagh too.

February 6 is the 131st birth anniversary of Khan Abdul Ghaffar Khan also popularly known as Frontier Gandhi and Badshah Khan. He was a prominent Indian freedom fighter, a die-hard opponent of the two-nation theory and the idea of Pakistan. He was totally committed to Gandhi’s idea of non-violence, enjoyed the same stature in the North West Frontier Province (NWFP), also known as Frontier, as Gandhi had in India.

He opposed with full conviction the inclusion of NWFP in Pakistan but failed. After formation of Pakistan he, his followers and family faced terrible repression at the hands of the consecutive Pakistan governments including the one led by Jinnah and Islam-o-fascists. One of his brothers was assassinated, his supporters butchered by the Islamist fascists, he spent more than a decade in Pakistani jails and was forced to go into exile in Afghanistan. He was declared to be an agent of Hindu India. ML government led by Jinnah did not tolerate the NWFP government led by Badshah Khan’s elder brother and it was dismissed on August 22, 1947; exactly 8 days after the formation of Pakistan.

Whatever ruling classes of Pakistan did to Frontier Gandhi is understandable as he stood as a rock against Islamist politics of declaring Muslims as a separate nation. But what treatment he got and is receiving in India is far more abhorring. The latest instance of his denigration took place in last December in India. A hospital constructing in his honour in Faridabad (Haryana) with the help of Hindu-Sikhs who migrated from NWFP, inaugurated by the first PM of India, Jawaharlal Nehru as Badshah Khan hospital was renamed as Atal Bihari Vajpayee hospital![i]

Frontier Gandhi founded the Khudai Khidmatgars (Servants of God) which was at the head of a patriotic and socially progressive movement. The movement was also nicknamed as ‘The Red Shirts’ due to the colour of uniform it used for its cadres. Their presence was first noticed at the Lahore Congress in 1929 which at that time according to police reports numbered 200,000. Quotation from the Quran against slavery served as rallying points for nationalist enthusiasm and the struggle to liberate the country from foreign rule became the Holy War of Khudai Khidmatgars.  A peerless authority on Muslims and Muslim politics in modern India, Wilfred Cantwell Smith was of the opinion that “No section of India has been more thoroughly nationalist.”[ii]

Khan Abdul Ghaffar Khan referring to violence unleashed by the Muslim League goons in the pre-partition India told in July 1947:

“The Muslim Leaguers are daily taking out processions, raising highly objectionable slogans. They call us kafirs (infidels) and resort to abusive language. I have been personally hooted…Another matter which is causing serious concern to us is the presence in our province of a large number of Punjabis who openly incite people to violence. Not only that, but they have also gone to the length of suggesting in public meetings that the top leaders of the Red Shirts should be done away with. They also proclaim openly that after Pakistan has been established…all of them who are called traitors will be hanged.”[iii]

Ataullah Khan nephew of Khan Abdul Ghaffar Khan’s wife, his servant and friends were killed by Muslim Leaguers when former raised objection to some of the utterances in a Muslim League meeting in a mosque at the village of NWF Province.[iv]

Frontier Gandhi despite leading a province almost 95% Muslims defended joining Congress. He declared:

“People complain against me for having joined the Congress by selling my nation. The Congress is a national and not a Hindu body. It is a jirgah composed of Hindus, Jews, Sikhs, Parsis and Muslims. The Congress as a body is working against the British. The British nation is the enemy of the Congress and of the Pathans. I have therefore joined it and made common cause with the Congress to get rid of the British.”[v]

Khudai Khidmatgars exhibited the spectacle of liberation theology of Islam. It demanded better distribution of land and decried the large estates.[vi] Khan wanted to build a socialist society.[vii]

Ghaffar Khan was a great secularist.

“It was in Punjab jail that he formed friendship with Hindus and Sikhs and studied the Hindu scriptures, especially the Gita and the Granth Saheb, the Holy Book of the Sikhs.”[viii]

He stood for united India. According to Khan Abdul Ghaffar Khan, “It is significant to note that while Pathans are intensely freedom-loving and resent any kind of subjugation, most of them are beginning to understand that their freedom can well harmonize with the conception of Indian Freedom, and that is why they have joined hands with the rest of their countrymen in a common struggle, instead of favouring the scheme of breaking up India into many States. They have come to realize that the division of India will result in all-around weakness in the modern world, where no part of it will have sufficient resources and strength to preserve its own freedom.”[ix]

Khan vehemently protested when Congress in June 1947 agreed to the partition of the country. He told Gandhi in June 1947 after CWC meeting, “We Pakhtuns stood by you and had undergone great sacrifices for attaining freedom. But you have now deserted us and thrown us to the wolves…The decision about partition and referendum in the Frontier Province was taken by the High Command [Congress] without consulting us…Sardar Patel and Rajgopalachari were in favour of partition and holding referendum in our province. Sardar said I was worrying over nothing. Maulana Azad was sitting near me. Noticing my dejection he said to me, ‘you should now join the Muslim League’. It pained me to find how little these companions of ours had understood what we had stood for and fought for all these years.”[x]

ML government of Jinnah did not tolerate the NWFP government led by Badshah Khan’s elder brother and it was dismissed on August 22, 1947; 8 days after the formation of Pakistan.

Forgetting Frontier Gandhi and his struggle is reprehensible for another reason. It means that we are becoming a party in covering up one of the worst massacres by the British army in the history of Indian freedom movement; the Qissa Khwani Bazaar massacre of Peshawar. The British rulers believed that non-violent Pathan was more dangerous than violent Pathans. So, when ‘Red-Shirts’ sat for a peaceful sit-in at famous Qissa Khwani Bazaar [literal meaning street where stories are told] on April 23, 1930, the protestors were machine-gunned in which according to the Brirish 20 protestors died but according to nationalist Indian sources more than 400 were martyred.

This cover-up also wants us to forget about Veer Chander Singh Garhwali and his fellow soldiers of the Garhwal Regiment of the British army who refused to fire on the same peaceful Khudai Khidmatgars. They were arrested, court-martialed and were sentenced for life imprisonment.  

The present generation must revisit the life, works, sufferings and sacrifices of Frontier Gandhi and his compatriots to know how shamelessly we have erased our progressive, secular and egalitarian heritage. It is not a small crime, in fact, by doing it we only paved the way for taking over the Indian polity by the Hindutva counterparts of Islamists of Pakistan.

On August 9, 1925 a group of Indian revolutionaries affiliated to the Hindustan Republican Association (HRA) which included Chandershekhar Azad, Ashfaqullah Khan, Ram Prasad Bismil, Rajender Lahiri, Roshan Singh, Manmathnath Gupt and others waylaid the British Government treasury loaded on a passenger train at Kakori railway station (approximately 20 kilometers from Lucknow) and captured the same. The then British rulers and their henchmen branded these revolutionaries as terrorists who were hot-headed adventure loving young men indulging in robberies for buying guns and fire-arms in order to create anarchy.

However, the truth was that this revolutionary group seized the government treasury not for purchasing/manufacturing arms and ammunition but for publishing Socialist literature to be circulated among youth, peasantry and workers so that they were politicised and joined the anti-colonial struggle. This group had left behind the terrorist legacy and matured into a revolutionary political group which believed in involving larger masses in the struggle to overthrow the British rule. It could be seen in changing the name of HRA in 1928 to Hindustan Socialist Republican Association.

In this Kakori Conspiracy Case four of the revolutionaries, namely Ram Prasad Bismil (June 11, 1897 –December 19, 1927), Ashfaqullah Khan (October 22, 1900 – December 19, 1927), Thakur Roshan Singh (January 22, 1892 – December 19, 1927), Rajendra Nath Lahiri (June 23, 1901–December 17, 1927) were awarded death sentences. Ramprasad Bismil was hanged in Gorakhpur, Ashfaqullah Khan in Faizabad, Rajinder Nath Lahiri in Gonda and Roshan Singh in Allahabad between December 17-19, 1927.

These martyrs represented the youth of the country (the eldest, Thakur Roshan Singh being 35 years old and the youngest, Rajendra Nath Lahiri 26 years old) but also pan-Indian character not only in this Kakori action but as a whole. The revolutionary group consisted of Bhagat Singh, Sukhdev (Punjabis), Rajguru (Maharashtrian), Jyotish Chander Pal (Orissa) to name a few. These revolutionaries were also committed to overthrow the colonial rule and establish an egalitarian and secular society.

We can see this commitment concretely in the writings of the martyr Ashfaqullah Khan. He wanted a socialist liberated India. In a ‘Message to Countrymen’ which was smuggled out of Faizabad Jail few days prior to his martyrdom on December 19, 1927 while addressing the Indian Communists he said:

“I am greatly in agreement with you and want to tell you that my heart always weeps for the poor peasants and helpless workers. While on the run I stayed with them and after seeing their condition I often wept…This is absolutely true that whatever they grow or produce, they have no share, they always remain sad and in bad shape. I do agree that for all these things our white Masters and their agents are responsible…I have deep regards for you in my heart and while dying, I fully agree with your political aims. I want that kind of freedom for Hindustan where poor should live happily and with ease. I pray to God that after my death, that day should come at the earliest when Abdullah mechanic of loco workshop, Dhaniya cobbler and common peasants are seen sitting on chairs in front of Mr. Khaliq-uz-Zaman, Jagat Narain Mulla and Raja Saheb Mehmoodabad in Lucknow’s Chhaatter Manzil.

“My comrades, my revolutionary brothers—what I can tell you and what I can write to you, it will be a matter of great pride to you when you will hear that one of your brothers went to the gallows smiling and was happy while dying. I know very well about the spirit which your group has and I was proud of it, and now I am more proud that I am dying as a true revolutionary.” 

Ashfaqullah Khan like his other comrades was highly conscious of the damage communal polarization was causing to the anti-British liberation struggle. It was his firm opinion that communal divides would only help the White master. Exposing the nefarious game communal forces were playing in league with the British masters, he wrote: 

“Oh! How can we appreciate the present day life when our political leadership is going through internal strife? If one is fond of Tableegh [the propagation of Islam for which an all India organization was formed in 1926] the other believes that dying for Shuddhi [conversion of Muslims and Christians to Sanatan Dharma for which Arya Samaj+Hindu Mahasabha started aggressive campaign from early 20th century] only will lead to emancipation. Government secret service agents finance the spread of religious propaganda. Their aim is not to defend religion or help it to flourish but to create obstacles in the path of the moving train [of the freedom struggle].” 

While pouring out his heart for his countrymen both Hindus and Muslims he went on to warn them: 

“Brothers! Your civil war, your internal bickering will not be useful for any of you. This is impossible that 7 crores Muslims can be converted to Hinduism [through Shuddhi] and likewise it is futile to believe that 22 crores Hindus can be turned into Muslims. However, [if they continue fighting with each other] it is easy and very easy that all of them together will continue to be in chains.” 

It was not surprising that martyr Ram Prasad Bismil expressed the identical views in his last message before his hanging at Gorakhpur Jail on December 19. He declared that he was sacrificing life for a country and the world where there would be no slavery:

“The time of execution is fixed for 6.30 am on 19 December. Nothing to worry, I shall be reborn again and again due to God’s grace and my aim will be to ensure complete freedom for the world. That nature’s gifts should be equally shared by all and no one shall rule others. Everywhere people should have their democratic institutions.”

Bismil though a prominent Arya Samajist made it clear like his Ashfaqullah Khan that to defeat the British masters the unity of Hindus and Muslims was a prerequisite.

“I am not disappointed at this time of giving up my life that this is wasted. Sacrifices never go to waste. Maybe because of our sighs that the idea of sending royal commission came to the mind of Lord Birkenhead [Secretary of State for India (1924-8)], for whose boycott Hindu-Muslims got together again. God may give some wisdom to them fast and they become united again. I had told advocate Mohan Lal Saxena, after our appeal was dismissed, that at least to commemorate us this time Hindu-Muslim leaders should be united.

“Government had mentioned that Sh. Ashfaqullah Khan is the right-hand man of Ram Prasad. If a devoted Muslim like Ashfaq could be right-hand man of Arya Samaji like Ram Prasad in the revolutionary movement, then why can’t other Hindus and Muslims unite forgetting their petty interests?” 

Bismil reminded the flag-bearers of the Hindu and Islamic brands of nationalism who were causing communal polarising that, 

“Government had mentioned that Sh. Ashfaqullah Khan is the right-hand man of Ram Prasad. If a devoted Muslim like Ashfaq could be right-hand man of Arya Samaji like Ram Prasad in the revolutionary movement, then why can’t other Hindus and Muslims unite forgetting their petty interests? 

His appeal from the depth of his heart ended with the following amazing words:

Now my only request to countrymen is that if they had even an iota of sorrow at our death, then, with whatever means, they must establish Hindu-Muslim unity; that was our last wish and this only can be our memorialAll religions and all parties should consider Congress as a representative. Then the day is not far, when Britishers have to bow before Indians.”

Unfortunately, the rulers, the mainstream academia and the media have consciously seceded from this great philosophical heritage of the Kakori martyrs. The current Hindutva onslaught is the outcome of our ignorance about the sacrifices of the Kakori martyrs and ideals for which they laid down their lives. If we are able to revive our memories of this glorious phase of the unity of Indians fighting for a society based on justice, the anti-egalitarian and religious polarizing agenda of the RSS-BJP rulers is bound to fizzle out.

The Constituent Assembly (CA) of India passed the Constitution on November 26, 1949 after almost three years’ deliberations. It was an amazing contribution in the history of the modern liberal democracies as it was not only the lengthiest Constitution in the world history (underlining the fact that the polity it was to govern was diverse and vast) but also created a polity based on egalitarian, democratic and non-sectarian ideals never attempted in the past in non-Western world. This commitment was explicit in the Preamble of the constitution which read:

“WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a SOVEREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC and to secure to all its citizens:

 JUSTICE, social, economic and political;

 LIBERTY of thought, expression, belief, faith and worship;

 EQUALITY of status and of opportunity; and to promote among them all;

 FRATERNITY assuring the dignity of the individual and the unity and integrity of the Nation;

 IN OUR CONSTITUENT ASSEMBLY this 26th day of November 1949, do HEREBY ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION.”

 

RSS demanded Manusmriti AS Constitution

The two ideals namely, Socialist and Secular, added in 1977 only strengthened the resolve of the CA that India was going to be a non-sectarian polity with the people of India in thoughts. It is shocking that the RSS which has complete sway over the Indian politics through its political appendage, Bharatiya Janata Party (BJP) and its cadres loaned to the latter (like PM Modi) mourned the birth of Indian Constitution. The RSS was very angry when Indian Constituent Assembly adopted a democratic-Secular Constitution under the supervision of Dr. BR Ambedkar. We know that the Constituent Assembly of India passed the Constitution on November 26, 1949, the RSS organ Organizer came out with an editorial on November 30, 1949 titled ‘Constitution’ declaring :

“The worst about the new Constitution of Bharat is that there is nothing Bhartiya about it…There is no trace of ancient Bhartiya constitutional laws, institutions, nomenclatures and phraseology in it…Manu’s Laws were written long before Lycurgus of Sparta or Solon of Persia. To this day his laws as enunciated in the Manusmriti excite the admiration of the world and elicit spontaneous obedience and conformity. But to our constitutional pundits that means nothing.”

How RSS denigrates the Constitution of India can be known by the following statement of the most prominent ideologue of the RSS, Golwalkar:

“Our Constitution too is just a cumbersome and heterogeneous piecing together of various articles from various Constitutions of the Western countries. It has absolutely nothing which can be called our own. Is there a single word of reference in its guiding principles as to what our national mission is and what our keynote in life is? No!”

By demanding Manusmriti as constitution of India, RSS, in fact was following the belief of its darling Hindutva icon, VD Savarkar who had declared long back:

Manusmriti is that scripture which is most worship-able after Vedas for our Hindu Nation and which from ancient times has become the basis of our culture-customs, thought and practice. This book for centuries has codified the spiritual and divine march of our nation. Even today the rules which are followed by crores of Hindus in their lives and practice are based on Manusmriti. Today Manusmriti is Hindu Law”.

Faith of RSS brass in Manusmriti, naturally, leads them to believe in Casteism too which gave birth to the debased practice of Untouchability. For RSS Casteism is the essence of Hindu Nationalism. Golwalkar did not mince words in declaring that Casteism was synonymous with the Hindu Nation. According to him, the Hindu people are none else but,

“The Hindu People, they said, is the Virat Purusha, the Almighty manifesting Himself. Though they did not use the word ‘Hindu’, it is clear from the following description of the Almighty in Purusha-Sukta [in the 10th book of Rig Ved] wherein it is stated that the sun & the moon are His eyes, the stars and the skies are created from his nabhi [navel] and Brahmin is the head, Kshatriya the hands, Vaishya the thighs and Shudra the feet. [Italics as in the original text] This means that the people who have this fourfold arrangement, i.e., the Hindu People, is [sic] our God. This supreme vision of Godhead is the very core of our concept of ‘nation’ and has permeated our thinking and given rise to various unique concepts of our cultural heritage.”

What kind of a Hindutva civilization the RSS wants to build by enforcing the laws of Manu, can be known by having a glimpse of the laws prescribed by Manu for the lower castes, Untouchables and women. Some of these dehumanizing and degenerated laws, which are presented here, are self-explanatory. 

A selection of Laws of Manu denigrating Dalits/Untouchables

1.   For the sake of the prosperity of the worlds (the divine one) caused the Brahmana, the Kshatriya, the Vaisya, and the Sudra to proceed from his mouth, his arm, his thighs and his feet. (I/31)

2.   One occupation only the lord prescribed to the Sudras, to serve meekly even these (other) three castes. (I/91)

3.   Once-born man (a Sudra), who insults a twice-born man with gross invective, shall have his tongue cut out; for he is of low origin. (VIII/270)

4.   If he mentions the names and castes (jati) of the (twice-born) with contumely, an iron nail, ten fingers long, shall be thrust red-hot into his mouth. (VIII/271) 

5.   If he arrogantly teaches Brahmanas their duty, the king shall cause hot oil to be poured into his mouth and into his ears. (VIII/272)

6.   He who raises his hand or a stick, shall have his hand cut off; he who in anger kicks with his foot, shall have his foot cut off. (VIII/280)

8.   A low-caste man who tries to place himself on the same seat with a man of a high caste, shall be branded on his hip and be banished, or (the king) shall cause his buttock to be gashed. (VIII/281)

As per the Manu Code if Sudras are to be given most stringent punishments for even petty violations/actions, the same Code of Manu is very lenient towards Brahmins. Shloka 380 in Chapter VIII bestowing profound love on Brahmins decrees:  

“Let him never slay a Brahmana, though he have committed all (possible) crimes; let him banish such an (offender), leaving all his property (to him) and (his body) unhurt.”

A selection of Laws of Manu demeaning Hindu women

1.   Day and night woman must be kept in dependence by the males (of) their (families), and, if they attach themselves to sensual enjoyments, they must be kept under one’s control. (IX/2)

2.   Her father protects (her) in childhood, her husband protects (her) in youth, and her sons protect (her) in old age; a woman is never fit for independence. (IX/3)

3.   Women do not care for beauty, nor is their attention fixed on age; (thinking), ‘(It is enough that) he is a man,’ they give themselves to the handsome and to the ugly. (IX/14)

4.   Through their passion for men, through their mutable temper, through their natural heartlessness, they become disloyal towards their husbands, however carefully they may be guarded in this (world). (IX/15)

5. (When creating them) Manu allotted to women (a love of their) bed, (of their) seat and (of) ornament, impure desires, wrath, dishonesty, malice, and bad conduct. (IX/17)

The reproduced parts of the Manu Code above need no further elaboration and commentary. They are too glaringly venomous, Fascist and degenerated against Untouchables who are referred to as Sudras by Manu. Perhaps this was the reason that the German philosopher, Friedrich Nietzsche who contributed immensely to the growth of totalitarian ideas in Europe in the 20th century, fell in love with this work.

It is to be noted here that a copy of Manusmriti was burnt as a protest in the presence of Dr. BR Ambedkar during the historic Mahad agitation on December 25, 1927. Dr Ambedkar called upon Dalits to commemorate December 25 as the Manusmriti Dehen Diwas (Manusmriti burning day) in future. In fact, the Brahmanism as basis of the RSS world-view is the original Fascism in the history of human civilization.

RSS HATRED FOR DEMOCRACY

It is true that when RSS faced the wrath of the Indian State when Sardar Patel was the home minister of India it criticized the detention laws without trial. In an editorial in Organizer it wrote:

“Section 21 and 22 providing for detention without trial reduce all the wordy assurances about liberty, equality and fraternity to just near meaningless verbiage.”

But once in power the RSS-BJP rulers led by PM Modi have returned to Hindutva’s Fascist and Nazi heritage. They have converted Indian democratic-secular polity into a totalitarian Hindutva oligarchy where any kind of dissent is treated as anti-national and anti-Hindu. It is the continuation of hatred for democracy as decreed by Golwalkar as early as 1940. Golwalkar while addressing the 1350 top level cadres of the RSS declared:

“RSS inspired by one flag, one leader and one ideology is lighting the flame of Hindutva in each and every corner of this great land.”

Quit India Movement (QIM) also known as ‘August Kranti’ (August Revolution) was a nation-wide Civil Disobedience Movement for which a call was given on August 7, 1942 by the Bombay session of the All-India Congress Committee. It was to begin on August 9 as per Gandhi’s call to ‘Do or Die’ in his Quit India speech delivered in Mumbai at the Gowalia Tank Maidan on August 8. Since then August 9 is celebrated as August Kranti Divas.

The British swiftly responded with mass detentions on August 8 itself. Over 1,00,000 arrests were made which included the total top leadership of Congress including Gandhi, mass fines were levied and demonstrators were subjected to public flogging. Hundreds of civilians were killed in violence, many shot by the police and army. Many national leaders went underground and continued their struggle by broadcasting messages over clandestine radio stations, distributing pamphlets and establishing parallel governments. Innumerable patriotic Indians were shot dead for the crime that they were holding Tricolour publicly. Even before that a terrible massacre took place in Mysore where the armed forces of Mysore Raja who was very close to Hindu Mahasabha and RSS shot dead 22 Congress activists for saluting Tricolour.

It is to be noted that after declaring Congress an anti-national and unlawful organization, the British masters allowed only Hindu Mahasabha and the Muslim League to function.

Most of us know that the then Communist Party of India opposed the QIM thus betraying a great phase of mass upsurge in the history of the freedom struggle. But it is well documented that despite CPI’s call for keeping aloof from QIM, a large number of Communist activists participated in it. Moreover, CPI later offered unconditional apology for opposing it. However, what role the then Hindutva camp—consisting of the Hindu Mahasabha and Rashtriya Swayamsevak Sangh —played in the QIM is under wraps for reasons unknown. The Hindutva camp not only opposed QIM but also provided multi-faceted and multi-dimensional support to the British rulers in suppressing this historic mass upsurge. In this connection, shocking documents are available; these should be read to be believed.

 

‘Veer’ Savarkar led Hindu Mahasabha joined hands with the British

While addressing the 24th session of the Hindu Mahasabha at Cawnpore (now Kanpur) in 1942, Savarkar outlined the strategy of the Hindu Mahasabha of co-operating with the rulers in the following words:

“The Hindu Mahasabha holds that the leading principle of all practical politics is the policy of Responsive Co-operation [with the British]. And in virtue of it, it believes that all those Hindu Sangathanists who are working as councillors, ministers, legislators and conducting any municipal or any public bodies with a view to utilize those centres of government power to safeguard and even promote the legitimate interests of the Hindus without, of course, encroaching on the legitimate interests of others are rendering a highly patriotic service to our nation. Knowing the limitations under which they work, the Mahasabha only expects them to do whatever good they can under the circumstances and if they do not fail to do that much it would thank them for having acquitted themselves well. The limitations are bound to get themselves limited step by step till they get altogether eliminated. The policy of responsive co-operation which covers the whole gamut of patriotic activities from unconditional co-operation right up to active and even armed resistance, will also keep adapting itself to the exigencies of the time, resources at our disposal and dictates of our national interest.” [Italics as in the original][i]

This ‘Responsive Cooperation’ with the British masters was not only a theoretical commitment. It soon got concretized in the ganging up of Hindu Mahasabha with the Muslim League. Hindu Mahasabha led by ‘Veer’ Savarkar ran coalition governments with Muslim League in 1942. Savarkar defended this nexus in his presidential speech in the same session of Hindu Mahasabha at Kanpur, in the following words:

“In practical politics also the Mahasabha knows that we must advance through reasonable compromises. Witness the fact that only recently in Sind, the Sind-Hindu-Sabha on invitation had taken the responsibility of joining hands with the League itself in running a coalition Government. The case of Bengal is well known. Wild Leaguers whom even the Congress with all its submissive-ness could not placate grew quite reasonably compromising and socialable as soon as they came in contact with the Hindu Mahasabha and the Coalition Government, under the premiership of Mr. Fazlul Huq and the able lead of our esteemed Mahasabha leader Dr Syama Prasad Mookerji, functioned successfully for a year or so to the benefit of both the communities.”[ii]

Hindu Mahasabha and Muslim League beside Bengal and Sind ran coalition government in NWFP also during this period.

 

Hindutva icon Dr Syama Prasad Mukherjee Deputy CM in Bengal Muslim League Ministry took up the responsibility of crushing QIM in Bengal

Following the Hindu Mahasabha directive to co-operate with the British, the Hindutva icon, Dr. Mookerjee assured the British masters through a letter dated July 26, 1942. Shockingly, it read:

“Let me now refer to the situation that may be created in the province as a result of any widespread movement launched by the Congress. Anybody, who during the war, plans to stir up mass feeling, resulting internal disturbances or insecurity, must be resisted by any Government that may function for the time being”[iii]

The second-in-command of the Hindu Mahasabha, Dr Syama Prasad Mookerjee, also the deputy chief minister in Bengal Muslim league ministry in a letter to Bengal governor on behalf of Hindu Mahasabha and Muslim League made it clear that both these parties looked at the British rulers as saviours of Bengal against Quit India Movement launched by Congress. In this letter, he mentioned item wise the steps to be taken for dealing with the situation.

 

It read:

“The question is how to combat this movement (Quit India) in Bengal? The administration of the province should be carried on in such a manner that in spite of the best efforts of the Congress, this movement will fail to take root in the province. It should be possible for us, especially responsible Ministers, to be able to tell the public that the freedom for which the Congress has started the movement, already belongs to the representatives of the people. In some spheres it might be limited during the emergency. Indian have to trust the British, not for the sake for Britain, not for any advantage that the British might gain, but for the maintenance of the defence and freedom of the province itself.”[iv]

 

RSS followed Savarkar in opposing QIM  

The other flag-bearer of Hindutva, the RSS, was not different in its attitude towards the QIM. It openly sided with its mentor ‘Veer’ Savarkar against this great revolt. The RSS’ attitude towards the QIM becomes clear from the following utterances of its second chief and most prominent ideologue till date, M.S. Golwalkar. While talking about the outcome of the Non-Cooperation Movement and QIM he said:

“Definitely there are bound to be bad results of struggle. The boys became unruly after the 1920-21 movement. It is not an attempt to throw mud at the leaders. But these are inevitable products after the struggle. The matter is that we could not properly control these results. After 1942, people often started thinking that there was no need to think of the law.”[v]

Thus, the prophet of Hindutva, Golwalkar, wanted the Indians to respect the draconian and repressive laws of the inhuman British rulers! He admitted that this kind of negative attitude towards the QIM did not go well even with the RSS cadres:

“In 1942 also there was a strong sentiment in the hearts of many. At that time too, the routine work of Sangh continued. Sangh vowed not to do anything directly. However, upheaval (uthal-puthal) in the minds of Sangh volunteers continued. Sangh is an organisation of inactive persons, their talks are useless, not only outsiders but also many of our volunteers did talk like this. They were greatly disgusted too.”[vi]

It would be interesting to note what Golwalkar meant by ‘routine work of Sangh’. It surely meant working overtime to widen the divide between Hindus and Muslims thus serving the strategic goal of the British rulers and Muslim League. In fact, the contemporary reports of the British intelligence agencies on the QIM were straight forward in describing the fact that RSS kept aloof from the QIM. According to one such report, “the Sangh has scrupulously kept itself within the law, and in particular, has refrained from taking part in the disturbances that broke out in August 1942”.[vii]

These historical documented facts make it clear that Hindutva gang led by the RSS not only betrayed QIM but also rendered great service to the British masters by aligning with the Muslim League when the foreign rulers were faced with the nation-wide popular revolt by the Indians. They in collusion mounted one of the fiercest repressions of the freedom fighters. Shockingly, this gang is ruling India today describing itself as a symbol of Indian nationalism. We need to convey these facts to the Indians so that these traitors are exposed and charged for crimes committed against India.

The RSS/BJP rulers know that betrayal of the QIM by their Hindutva parents cannot be covered up. It is crystal clear that RSS including its top leaders like Golwalkar (head of the RSS), Deendayal Upadhyaya, Balraj Madhok, LK Advani and KR Malkani who were RSS whole timers during QIM did not participate in this Movement. Thus, if the betrayal of the QIM cannot be covered up then rake up polarizing issues with communal motives so that Indians remain at war with each other.

It was 80 years ago (July 31, 1940) Udham Singh died on the gallows in the Pentonville prison of London. Through the contemporary police documents, we come to know that before reaching London he had been to Mesopotamia, Kenya, Uganda, USA, and USSR, all in quest of Indian revolutionaries and ammunition. It was on reaching British shores that he took the name of MOHAMMAD SINGH AZAD. In fact he had secured a passport with this name. He even attempted to organise fellow English labourers. Udham Singh’s choice of the name as MOHAMMAD SINGH AZAD was not a fluke. He chose it to underline the cardinal fact that India could be liberated only by the collective and united efforts of all Indians. There is a reasonable apprehension that if Udham Singh returns to India with this name today he may be lynched.

The British masters wanted to censure any news about his trial so that Udham Singh’s revolutionary deeds were kept hidden in India. The day his trial started in London the Governor General in New Delhi sent a telegram to the Secretary of State.. It read:

“We understand that during the trial the accused intends to pose as a martyr and indulge in heroics. We would be glad if steps are taken to secure that press in England do not report substantially and that Reuters only carry as brief and unsensational a summary as possible.”

This telegram showed that the Britishers, glorified as great believers in the fair-play and rule of law, germane to democracy, were masters in manipulating the fourth estate.

Explaining the reason behind the killing of one of the main perpetrators of Jallianwala Bagh massacre Udham Singh made the following statement.

“I did it because… he deserved it. He… wanted to crush the spirit of my people, so I have crushed him. For full 21 years, I have been trying to wreak vengeance. I am happy I have done the job. I am not scared of death. I am dying for my country.”

He continued,

“I do not care about the sentence of death…I am dying for a purpose…We are suffering from the British Empire…I am proud to die to free my native land and I hope that when I am gone…in my place will come thousands of my countrymen to drive you dirty dogs out; to free my country…you will be cleansed out of India. And your British imperialism will be smashed…I have nothing against the English people at all…I have great sympathy with the workers of England. I am against the imperialist government. DOWN WITH BRITISH IMPERIALISM!”

These words of MOHAMMAD SINGH AZAD rang out through a London courtroom on March 13, 1940, where he was produced immediately after killing Michael O’Dyer, the Lt. Governor of Punjab, the architect of the Jallianwala massacre who ordered the crackdown. MOHAMMAD SINGH AZAD was none other than Udham Singh. Born in a Dalit Sikh family and brought up in an orphanage, Udham Singh was present in the public meeting at Amritsar on the fateful bloody Baisakhi day of 1919.

Having fallen under a heap of dead bodies, Udham Singh had miraculously survived the carnage. But so deep was the hatred evoked by the 20-year old vowed not to rest until he had avenged the killing of the innocent hundreds. He achieved his target 21 years later. And ‘Mohammad Singh Azad’-the name he adopted-underscored the fact that the overthrow of the British rule was impossible without the unity of the Hindu, Muslim, and Sikh populace of the land. Today this call is more relevant when Hindutva rulers are bent upon dividing the Indian nation on the basis of religion.

RSS

RSS is the Hindutva gurukul, (university) which specialises in training it’s cadres in the internalising of half-truths and lies, based on the manufacturing of history. A recent proof of this is evidenced in Ram Madhav’s claim that, Indian democracy survives due to “leaders in the government who fought for that very freedom and are committed to liberal democratic values, not just as a matter of compulsion but as an article of faith.”[i] Described as an ‘RSS ideologue by commercial television channels, Madhav was speaking on the 45th anniversary of the Emergency. His falsified claim is that RSS-BJP leaders fought against the Emergency, not out of compulsion but as an article of faith in democracy. Both claims are while lies. This can be seen not just from the claims of critics of the RSS, but from all contemporary RSS documents available.

Let us take first, address the claim that the RSS-BJP rulers are/have been committed to the liberal democratic values, as an article of faith. The most prominent ideologue of the RSS, MS Golwalkar, also known as the ‘Guru of Hate’ [whom PM Modi credits for grooming him into a political leader] while addressing as many as 1350 top level cadres of the RSS, in 1940, declared, “RSS inspired by one flag, one leader and one ideology is lighting the flame of Hindutva in each and every corner of this great land.”[ii]

With such a philosophical liking for totalitarianism the RSS has hated the sharing of power. This can be seen from the outfit’s strong opposition to the federal structure of the constitution, a ‘Basic’ feature of the Indian republic. Golwalkar, declared in 1961, “Today’s federal form of government not only gives birth but also nourishes the feelings of separatism, in a way refuses to recognise the fact of one nation, and destroys it. It must be completely uprooted, the constitution purified and (a) unitary form of government be established.”[iii]

As far as the Emergency is concerned, the RSS claim of fighting against it, needs also to be evaluated in the light of contemporary narratives as also from RSS’ own documents. In this connection two narratives, one by a veteran thinker and journalist of India, Prabhash Joshi and the other, by TV Rajeswar, former Intelligence Bureau [IB] chief, who was the deputy chief of IB during the Emergency, are of immense importance. They recounted the days of Emergency (or state authoritarianism) when the RSS surrendered to the repressive regime of Indira Gandhi, assured both her and her son, Sanjay Gandhi, of their cooperation to enforce faithfully the draconian 20-point programme, announced by the Emergency regime. Large number of RSS cadres came out of jails by submitting maafinaamas (mercy petitions).
This contemporary, historical narrative by Prabhash Joshi, appeared in the English weekly, Tehelka on the 25th anniversary of the Emergency.[iv] According to Joshi, even during the Emergency “there was always a lurking sense of suspicion, a distance, a discreet lack of trust” about the RSS’ joining the anti-Emergency struggle. He went on to write, that

“Balasaheb Deoras, the then RSS chief, wrote a letter to Indira Gandhi pledging to help implement the notorious 20-point programme of Sanjay Gandhi. This is the real character of the RSS…You can decipher a line of action, a pattern. Even during the Emergency, many among the RSS and Jana Sangh who came out of the jails, gave maafinamas. They were the first to apologise. Only their leaders remained in jail: Atal Behari Vajpayee [most of the time, in hospital], LK Advani, even Arun Jaitley. But the RSS did not fight the Emergency. So why is the BJP trying to appropriate that memory?”

Prabhash Joshi’s conclusion was that “they are not a fighting force and they are never keen to fight. They are basically a compromising lot. They are never genuinely against the government”.

TV Rajeswar, who served as Governor of Uttar Pradesh and Sikkim penned a book, ‘India: The Crucial Years” [Harper Collins], in which, he corroborated the fact, that, “Not only they (RSS) were supportive of this [Emergency], they wanted to establish contact apart from Mrs Gandhi, with Sanjay Gandhi also”.[v] Rajeswar in an interview with Karan Thapar disclosed that, Deoras,

“quietly established a link with the PM’s house and expressed strong support for several steps taken to enforce order and discipline in the country. Deoras was keen to meet Mrs. Gandhi and Sanjay. But Mrs. Gandhi refused.”[vi]

According to Rajeswar’s book,

“RSS, a right-wing Hindu nationalist organisation, was banned in the wake of the Emergency. But its chief, Balasaheb Deoras, quietly established a link with the PM’s house and expressed strong support to several steps taken to enforce order and discipline in the country. Sanjay Gandhi’s concerted drive to enforce family planning, particularly among Muslims, had earned Deoras’s approbation.”[vii]

Rajeswar also shared the fact, that, even after Emergency, the “organisation, (RSS) had specifically conveyed its support to the Congress in the post-emergency elections.”[viii] It will be interesting to note that even according to Subramanian Swamy during the Emergency period, most of the senior leaders of RSS had betrayed the struggle against the Emergency.[ix]

Contemporary documents in the RSS archives corroborate the narratives proffered by Prabhash Joshi and Rajeswar. The 3rd Supremo of RSS, Madhukar Dattatraya Deoras wrote the first letter to Indira Gandhi within two months of the imposition of Emergency. It was the time when state terror was running amok. In a letter dated, August 22, 1975 he began with the following praise of Indira:

“I heard your address to the nation which you delivered on August 15, 1975 from Red Fort on radio in jail [Yervada jail] with attention. Your address was timely and balanced so I decided to write to you”.[x]

Indira Gandhi did not respond to it. So Deoras wrote another letter to Indira on November 10, 1975. He began his letter with congratulating her on being cleared by the Supreme Court of disqualification (in the elections) which was ordered by the Allahabad High Court, All the five Justices of the Supreme Court have declared your election constitutional, heartiest greetings for it.” It is to be noted that opposition was firmly of the opinion that this judgment was ‘influenced’ by the Congress. In the course of the letter, he declared that “RSS has been named in the context of Jaiprakash Narayan’s movement. The government has also connected RSS with the Gujarat movement and the Bihar movement without any reason…Sangh has no relation with these movements…”[xi]

Since Indira Gandhi did not respond to this letter also, RSS chief got hold of Vinoba Bhave who supported the Emergency religiously and was a favourite of Indira Gandhi. In a letter dated January 12, 1976, he begged that the Acharya should suggest a way to ensure that the ban on the RSS was removed.[xii]  Since the Acharya, too, did not respond to Deoras letter, the latter in another letter without date wrote in desperation,

According to press reports, respected PM [Indira Gandhi] is going to meet you at Pavnar Ashram on January 24. At that time there will be discussion about the present condition of the country. I beg you to try to remove the wrong assumptions of PM about RSS so that ban on RSS is lifted and RSS members are released from jails. We are looking forward to the time when RSS and its members are able to contribute to the plans of progress which are being run in all the fields under the leadership of PM.”[xiii]

Significantly, former President of the Indian Republic, Pranab Mukherjee was invited by the RSS chief, Mohan Bhagwat as the chief guest at the graduation ceremony of its new recruits. These recruits are trained to work over-time (on social and political steps) to convert India into a theocratic (Hindu) state. Pranab Mukherjee has been known, and held responsible too, as one of the top leaders of Congress, responsible, for Emergency excesses. The tragedy of the RSS in power at the Centre is that India, while a constitutional democracy, is governed by a love of power, which compels its spokespersons to indulge in doublespeak.

Despite these facts, it is shameful, that thousands of RSS cadres continue to get monthly pension for ‘persecution’ during Emergency. BJP ruled states like Gujarat, Madhya Pradesh, Rajasthan and Maharashtra have decided to award a monthly pension of Rs 20,000 to those who were jailed during the Emergency period for less than 2 months and Rs 10,000 to those who were jailed for less than a month. This rule took care of the financial interest of those RSS cadres who submitted mercy letters completing only one or two months’ jail term. For securing such a significant pension, there is no condition that the beneficiary should have been in jail for the whole period of the Emergency.

Interestingly, in the case of anti-British freedom struggle, not a single person from RSS cadres is fit to claim a freedom fighters pension. Neither does India remember hundreds of Communist youth, branded as Naxals, who were killed in brute extra-judicial killings (“fake encounters”) during the Emergency. Interestingly, the Shiv Sena too, a former Hindutva co-traveler of the RSS openly supported the Emergency.
