Hindu Sena Chief seeks Delhi LG's sanction to prosecute Kamal Haasan

Hindu Sena Chief Vishnu Gupta has sought Delhi Lieutenant Governor Anil Baijal’s sanction to prosecute actor and politician Kamal Haasan, for the remarks he had allegedly made associating terrorism with Hinduism while campaigning during the Lok Sabha elections in Tamil Nadu back in 2019.

According to LiveLaw, the complaint alleged that Kamal Hasaan, who had contested in the seventeenth general elections from Makkal Needhi Maiam, had addressed a huge gathering of Muslim population and said, “I am not saying this because many Muslims are here. I am saying this in front of Mahatma Gandhi’s statue. First terrorist in independent India is a Hindu, his name is Nathuram Godse.”

The complainant Vishnu Gupta has stated that these remarks were made with the mala-fide and criminal intention to ridicule the Hindu religion and to promote feelings of enmity between Hindus and Muslims.

Hasaan has been booked under sections 153A (promoting enmity between groups) and 295A (deliberate and malicious intention of outraging religious beliefs) of the Indian Penal Code (IPC) at the Patiala House Court and because the plaint is at the stage before summoning of evidence, it is mandatory that prosecution sanction be granted under section 196(1) of the CrPC, reported millennium post.

According to LiveLaw, the complaint against Hasaan reads, “That the accused had while making the above said remarks deliberately and maliciously passed absolutely derogatory comments to outrage religious feelings of Hindus by associating terrorism with Hindu religion without any justification with the sole intention to promote enmity between Hindus and Muslims and outrage religious feelings and religious beliefs of Hindus along with the religious feelings of the Complainant. The accused was very well aware while making the said remarks with the intention of outraging religious feelings to insult religion and religious belief of Hindus along with the complainant that his insulting remarks will be heard and seen by citizens of India through TV and electronic media. That the provocative and outrageous remarks made by the accused are grossly offensive and deliberately intended to outrage the feelings of the complainant and Hindus living in India and in other countries.”

After Hasaan’s remarks, he was attacked with slippers while he was campaigning in Thiruparankundram assembly constituency in Tamil Nadu’s Madurai in 2019. He had also offered clarification that he didn’t intend to make communal remarks by linking the barbaric act of terrorism with religion. He had said, “….terrorism is wrong. No religion would accept violence, be it Hinduism or Islam. No religion professes violence and true Muslims present in this gathering would accept this. These Muslims will vouch that terrorism is not their way. They will swear on the holy book they believe in (Quran), that love is their way.”

Chennai: Makkal Needhi Maiam (MNM) president, Kamal Haasan, was reportedly attacked by slippers on Wednesday, while he was campaigning in Tirupparankundram assembly constituency in Tamil Nadu’s Madurai.

As reported by NDTV, the slipper attack came three days after Haasan had said that “independent India’s first terrorist was a Hindu”, referring to Mahatma Gandhi’s assassin Nathuram Godse.

Reportedly, a police complaint has been lodged, naming eleven people, including BJP workers and members of another outfit, Hanuman Sena. Police said that slippers were thrown at the MNM chief who was addressing the meeting from a vehicle. None of the slippers hit Haasan and fell on the crowd gathered at the meeting.

“A group of people tried to create a ruckus and someone attempted to hurl a chappal from the rear end of the meeting area. However, it didn’t land anywhere near Kamal Haasan,” the police commissioner of Madurai was reported as saying.

Hindu Munnani’s Karur district secretary, KV Ramakrishnan, had registered a complaint against Haasan, a few days after his Godse remark, saying that Haasan had promoted enmity among two religious groups. An FIR was registered under sections 153A (promoting enmity
between different groups on grounds of religion) and 295A (deliberate and malicious acts intended to outrage religious feelings) of the Indian Penal Code.

Haasan had approached the court on Wednesday, pleading that the complaint against him be dismissed. However, Justice B Pugalendhi stated that the court could not get involved at the current stage of events. The judge further advised that Kamal Haasan apply for anticipatory bail in view of the situation, which he has done.

Haasan has even defended his statement and said that people are misinterpreting him. “In Aravakurichi I said independent India’s first extremist was a Hindu. It is a historical truth,” he stated. He further added that all his family members were Hindus and that he would not speak in a manner which would hurt their beliefs.  

Strikingly, BJP’s Bhopal candidate and 2008 Malegaon blast accused, Sadhvi Pragya Singh Thakur, condemned Haasan’s Godse remark saying that he was a true patriot. Sadhvi Pragya said, “Nathuram Godse was a deshbhakt, is a deshbhakt and will remain a deshbhakt. People calling him a terrorist should instead look within. Such people will be given a befitting reply in these elections.”

Aravakurichi and Tirupparankundram are among the four assembly constituencies in Tamil Nadu where bypolls are scheduled on Sunday. Kamal Haasan’s Makkal Needhi Maiam or the MNM, which has made a debut this national election, have fielded candidates from these seats.

Chennai: Makkal Needhi Maiam (MNM) president, Kamal Haasan, has once again found himself at loggerheads with the right-wing politicians after his controversial statement  describing Mahatma Gandhi’s assassin, Nathuram Godse, as independent India’s first terrorist.

Speaking at an election rally of his party’s candidate, S. Mohanraj, from the Aravakurichi assembly constituency, actor-politician Hassan said, “I am not saying this because many Muslims are here. I’m saying this in front of Gandhi’s statue. The first terrorist post India’s independence is a Hindu. His name is Nathuram Godse.”

Immediately clarifying that he didn’t intend to make communal remarks by linking the barbaric act of terrorism with religion, Hassan said, “..terrorism is wrong. No religion would accept violence, be it Hinduism or Islam. No religion professes violence and true Muslims present in this gathering would accept this. These Muslims will vouch that terrorism is not their way. They will swear on the holy book they believe in (Quran), that love is their way.”

Hassan further said that he aspired for an equal India where all the faiths could peacefully live together. “Good Indians desire equality and want the three colours in the tricolour to remain intact. I am a good Indian, will proudly proclaim that,” said Hassan.

Even in November 2017, Hassan had taken potshots and drew condemnation from the BJP and other Hindu outfits, after he spoke of hindu terror. Hassan had said, “Hindus cannot challenge others to show extremists among them since extremism has spread to that extent even among the Hindus.” Adding further, he said, “In the past, Hindu right-wing groups would not indulge in violence. They would hold a dialogue with opponents. But now they resort to violence.”

BJP condemned Hassan’s statement and said he is “lighting fire.”

Tamil Nadu BJP chief Tamilisai Soundararajan tweeted, “Actor Kamalahasan recalling Gandhi’s assassination now and calling it Hindu terrorism is condemnable.Standing amidst minorities in TN by-election campaign he is lighting a dangerous fire to gain votes by minority appeasement.kamal didn’t opine on recent Srilanka bomb blast why? (sic).” Adding further, she said, “But dares to take up decades old event which was well enquired & guilty punished ?He threatened to leave india when his film screening was prevented by religious groups!but now he calls himself true indian! True political acting started now having lost the chances in screenplay. (sic).”

Even Vivek Oberoi, who will play the role of Narendra Modi in his biopic, tweeted, “Dear Kamal sir, you are a great artist. Just like art has no religion, terror has no religion either! You can say Ghodse was a terrorist, why would you specify ‘Hindu’ ? Is it because you were in a Muslim dominated area looking for votes?”

Aravakurichi is one of the four Assembly constituencies where bypolls are scheduled on May 19.
